The promised paradises of colonial capitalism and neoliberalism are set in a perpetually elusive future (Fitzpatrick 1992). This future is not a set destination, but an endless linear journey set to the thrum of ‘progress’ and ‘development’. This paper considers, in the context of recent cases relating to development in the Athabasca tar sands region, what the law of the Canadian settler state does when it is faced with interruptions and ruptures in its timescape. Drawing on Fitzpatrick’s seminal work, The (...) Mythology of Modern Law, I argue that a conceptualisation of law’s behaviour in these contexts as functionally mythological highlights some of the elusive ways that settler law maintains a stranglehold over legal imaginaries of oil and gas developments: by distorting and flattening the pasts and presents of Indigenous societies that pre-dated (and continue to co-exist with) the settler state on ‘Canadian’ land, by mediating between the ‘origin’ of the settler state and the daily rhythms of colonial time through ‘Eternal Objects’ such as property and economic development, and by asserting a general ‘objectivity’ of law to evade any direct grappling with the stark possibilities of the ‘end of the world’ created by the climate crisis. I conclude, drawing on Indigenous scholarship and the work of de Goede and Randalls, that a meaningful response to the climate crisis requires re-enchanted attachments to life that necessitate a departure from the one-dimensional temporality of the mythologies of settler law. Despite the seemingly widespread agreement that racial and ethnic immigration criteria are always wrong, some cases seem potentially permissible and, in particular, do not seem to wrong either disfavored members or nonmembers. I demonstrate that an “antidiscrimination” approach to understanding when and why discrimination is wrong provides a compelling general explanation for this. The explanation’s key ingredient is the concept of global social status: many groups sharing a race or ethnicity have a social status beyond, and that can differ from, (...) their status in a particular state. This experiment investigated the effect of format (line vs. bar), viewers’ familiarity with variables, and viewers’ graphicacy (graphical literacy) skills on the comprehension of multivariate (three variable) data presented in graphs. Fifty-five undergraduates provided written descriptions of data for a set of 14 line or bar graphs, half of which depicted variables familiar to the population and half of which depicted variables unfamiliar to the population. Participants then took a test of graphicacy skills. As predicted, the format influenced viewers’ interpretations (...) of data. Specifically, viewers were more likely to describe x–y interactions when viewing line graphs than when viewing bar graphs, and they were more likely to describe main effects and “z–y” (the variable in the legend) interactions when viewing bar graphs than when viewing line graphs. Familiarity of data presented and individuals’ graphicacy skills interacted with the influence of graph format. Specifically, viewers were most likely to generate inferences only when they had high graphicacy skills, the data were familiar and thus the information inferred was expected, and the format supported those inferences. Developments in neurotechnology took a leap forward with the demonstration of the first Brain to Brain Interface (BBI). BBIs enable direct communication between two brains via a Brain Computer Interface (BCI) and bypasses the peripheral nervous system. This discovery promises new possibilities for future battlefield technology. As battlefield technology evolves, it is more likely to place greater demands on future soldiers. Future soldiers are more likely to process large amounts of data derived from an extensive networks of humans and machines. (...) This raises several ethical and philosophical concerns. This paper will look at BBI technology in current stages of research, future BBI applications in the military and how the potential use of BBIs in military operations challenges the way we understand the concept of responsibility. In this paper, I propose that an individual connected to a BBI ought not to be held fully responsible for her actions. The justification for this proposition is based on three key points such as an individual connected to a BBI does not have the ability to act freely, has a diminished sense of self-agency and may not be able to demonstrate authenticity of the thoughts and memories generated when connected to the interface. Since the times of yore, the Indian culture has always laid importance on service to society as an important responsibility of the business/trader community. The society and local community is the resource pool from which any organization gets its manpower and also so to say ‘the license to operate’. The society is the entity to which an organization owes its existence. Any organization must pay its due in various ways to this important constituency. Though a number of models and frameworks (...) have been identified by experts for Corporate Social Responsibility, the author has found a dearth of real-life cases of leading organizations (especially in the Indian context) and their endeavours towards societal welfare and environmental protection. The author has used the case of Hindustan Unilever Ltd (HUL), a leading company in the FMCG (Fast Moving Consumer Goods) sector in India for the past seven decades, to highlight their best practices towards the society, local community, NGOs and the natural environment. In spite of being a multinational organization, the Company has lived up to the Indian values of service to society. The case follows a descriptive research design and the findings include diverse, innovative and landmark initiatives undertaken by the Company to contribute to societal welfare through rural and women’s empowerment, livelihood generation, rehabilitation and natural environment protection and preservation. The data collection for this case has been done by the author through personal interviews with top executives of the Company and supplemented through other information available in the public domain. Current formal dialectical models postulate normative rules that enable discussants to conduct dialogical interactions without committing fallacies. Though the rules for conducting a dialogue are supposed to apply to interactions between actual arguers, they are without exception theoretically motivated. This creates a gap between model and reality, because dialogue participants typically leave important content-related elements implicit. Therefore, analysts cannot readily relate normative rules to actual debates in ways that will be empirically confirmable. This paper details a new, data-driven method for (...) describing discussants’ actual reply structures, wherein corpus studies serve to acknowledge the complexity of natural argumentation. Rather than refer exclusively to propositional content as an indicator of arguing pro/contra a given claim, the proposed approach to dialogue structure tracks the sequence of dialogical moves itself. This arguably improves the applicability of theoretical dialectical models to empirical data, and thus advances the study of dialogue systems. (shrink)

In certain ways, many disabilities seem to occupy a middle ground between illnesses like cancer and identity-traits like race: like illnesses, they can present a wide variety of obstacles in a range of social and natural environments and, insofar as they do, they are something we should prevent potential people from having for their own sake; at the same time, those same types of disabilities can be, like race, a valuable part of the identity of the persons who already have (...) them. I consider this seemingly dual nature of a significant class of disabilities to attempt to understand the proper relation of those disabilities to persons and how we should value or respect them. I argue for a distinction between embedded disabilities and general disabilities ; importantly not everyone with a disability will turn out to have an embedded disability. I then show that expressing negative value judgments about general disabilities does not typically express disrespect for people with disabilities — thereby addressing a long-standing charge made by many in the disabilities community. Finally, I show that unlike with disabilities, expressing negative judgments about the general form of identity-traits like race does typically express disrespect for people with those identity-traits. Medical student and resident participation in global health experiences (GHEs) has significantly increased over the last decade. In response to growing student interest and the proven impact of such experiences on the education and career decisions of resident physicians, many medical schools have begun to establish programmes dedicated to global health education. For the innumerable benefits of GHEs, it is important to note that medical students have the potential to do more harm than good in these settings when they exceed (...) their actual capabilities as physicians-in-training. While medical training programmes are beginning to provide students with the knowledge to put their GHEs in context, they must remember that they also bear the responsibility of training their students in a framework to approach these experiences in a principled and professional way. It is necessary that these institutions provide adequate and formalised preparation for both clinical and ethical challenges of working in resource-poor settings. This paper outlines potential benefits and risks of GHEs and delineates recommendations to some of the current issues. (shrink)

My paper explores the question of when it is wrong for a state’s immigration criteria to discriminate against people with disabilities, focusing on the idea that discrimination is wrong when it demeans a group, rather than when it disadvantages them. I argue that selecting against people with disabilities often demeans them but might not always do so even when immigration criteria explicitly exclude people on the basis of having disabilities – that is, in cases of direct discrimination. Moreover, I demonstrate (...) that certain cases of less direct forms of discrimination that select against people with disabilities – in particular, when states apply health-cost limits on admissions – can function as proxies designed to exclude people with disabilities and thereby demean them. Finally, I explain why my analysis of discrimination’s wrong does not typically apply to health conditions in general, such as heart, liver, or lung disease or cancer, setting my view apart from a prominent view in the literature. This research delves into a unique and vital aspect of addressing criticisms by some grammarians (al-nohaat) and interpreters against various continuous Quranic readings, focusing on the robustness of their transmission chains (isnad). These chains, often deemed weak by certain grammarians, are examined to understand how they reinforce the credibility of the readings, given the prevalent view that a solid transmission chain significantly minimizes errors in recitations. The data was collected through desk review of library sources, references, journal articles and books. (...) The data was confined to Qur’anic recitations and transmission of two scholar Ibn Aamir and Abu Jafar, who attracted great attention of the grammarians regarding their chain of transmission in their recitations. The data was analyzed in three stages, starting with data reduction, data display, and data verification. This was done to transform data into a meaningful discourse. Key conclusions of the study include the recognition of the Holy Quran, in its multiple readings, as a primary source for Arabic grammar (al-Nahw), with the two scholars using these readings as fundamental evidence for establishing grammatical rules. It also finds a broad scholarly consensus that the "ten recitations" of the Quran are authoritative and immune to criticism. The findings highlight the Quran's profound influence on Arabic language structures and consensus on the authority of recitations with roots in Prophet Muhammad's (PBUH) teaching. Pioneers like Abu Hayyan celebrated linguistic diversity over rigid rules, while incorporating narrator biographies, geographical mapping, and morphological analysis continues to enrich the textual tradition. Recommendations of the study include expanding research on transmission tracking science, boosting recitation studies through computational linguistics, emphasizing ceaseless inspiration manifesting Quran's inimitability, and acknowledging multiplicity under universal wisdom principles. Research teams have made considerable progress in treating absolute uterine factor infertility through uterus transplantation, though studies have differed on the choice of either deceased or living donors. While researchers continue to analyze the medical feasibility of both approaches, little attention has been paid to the ethics of using deceased versus living donors as well as the protections that must be in place for each. Both types of uterus donation also pose unique regulatory challenges, including how to allocate donated organs; (...) whether the donor / donor's family has any rights to the uterus and resulting child; how to manage contact between the donor / donor's family, recipient, and resulting child; and how to track outcomes moving forward. In an era where conditions for education are rapidly changing globally, online assessment presents several opportunities as well as challenges in the higher education landscape. The forceful transition from face-to-face to online assessments, as part of the emergency implementation of online learning due to the COVID-19 pandemic, has affected teaching, learning, and assessment experiences worldwide. This study explores how faculty members in Saudi universities secured their online assessment during phase one of the COVID-19 pandemic. The research aims were: 1) identifying (...) faculty assessment practices before the onset of COVID-19 and comparing these with practices during the pandemic, and 2) identifying the major challenges faced by the faculty members of the study in securing their online assessment to ensure that academic integrity and assessment standards remained intact. Data were collected from seven university professors through a self-reporting survey, followed by semi-structured interviews. The faculty members found the pandemic period to be the best time to change their assessment methods, and incorporate innovative ideas that conformed to both their own beliefs and students’ needs. The factors that influenced the faculty’s assessment alterations were their personal beliefs and learnings from others’ experiences, in addition to the guidelines issued by Saudi Arabia’s Ministry of Education. The results of this study have implications for the development of post-COVID-19 assessment practices and professional development priorities. (shrink)

Neurosurgeons have an especially high rate of exposure to serious ethical challenges in their line of work. The aim of this study was to assess the type and frequency of ethical theories used by neurosurgery residents to make extra- ethical decisions in challenging situations and their relation with the level of residency, and curricular training about medical ethics. A total of 12 neurosurgery residents in Mashhad University of Medical Sciences (MUMS) were interviewed; all the participants were male and aged 29–40 (...) years old. Of all, six were senior and six were junior. Using a systematic review of neurosurgery and medical ethics textbooks, five common cases were selected and a semi-structured, open-ended interview was developed. The interviews were digitally recorded and analyzed in two separate stages. Comparison of the results of the two stages led us to the final judgment about the dominant ethical theory used in each case. In all 60 cases, the decision-making process was compatible with either Deontology (30 cases) or Consequentialism (30 cases). Only in two cases, beside Deontology, the Virtue ethics was used as an alternative in special situations. The ethical theories were not consistent for all the 12 subjects and all the five questions. No statistically significant difference was found between senior and junior residents, neither for each question nor for the aggregate (Odds Ratio = 1.31, 95 % CI = 0.42-4.09, Relative Risk = 1.41, 95 % CI = 0.69-1.9, P-value > 0.20). Only one of the subjects had extracurricular training in medical ethics, consequently precluding further analysis. Although not intended to be evaluated by this study, similar heterogeneity was observed in final decisions. When faced with medical ethics challenges, neurosurgery residents did not follow a consistent ethical theory for making decisions. The type and frequency of theories did not seem to be changed during the residency period. (shrink)

Social movements possess transformative and progressive power. In this paper, I argue that how this is so, or even if this is so, depends on one's explanatory framework. I consider three such explanatory frameworks for social movements: methodological individualism, collectivism, and complexity theory. In evaluating the various appeals and weaknesses of these frameworks, I show that complexity theory is uniquely poised to capture the complex and dynamic reality of the social world.

George, feeling stressed and anxious about the criminal investigation into his firm’s accounting practices, decides that it would do him good to get away and take a long, relaxing vacation in Bermuda. According to popular informed-desire accounts of a person’s good, if George would desire to take a vacation to Bermuda upon being made fully aware of what his experience of the vacation would be like and of all the consequences therein, then this course of action would benefit him. This (...) does not mean that George must actually be privy to whether his fully informed self would desire to travel to Bermuda, but whether he would, according to such an account, determines whether going to Bermuda would benefit George, whether he or anyone else is capable of knowing it. We value possessing knowledge more than true belief. Both someone with knowledge and someone with a true belief possess the correct answer to a question. Why is knowledge more valuable than true belief if both contain the correct answer? I examine the philosophy of American pragmatist John Dewey and then I offer a novel solution to this question often called the value problem of knowledge. I present and explicate (my interpretation of) Dewey’s pragmatic theory of inquiry. Dewey values competent inquiry (...) and claims it is a knowledge-forming process, and I argue that it is competently conducting inquiry that explains why knowledge is more valuable than mere true belief. Knowledge is always the result of a process of competent inquiry (itself valuable) whereas belief can but need not be the result of inquiry. I end by considering and replying to reasonable objections to my pragmatic solution. (shrink)

If states have the moral authority to decide their memberships by denying citizenship, I argue that they may also strip citizenship, from law-abiding members, for the same reasons. The only real difference is that when states revoke citizenship they may need to compensate people for their prior contributions, but that is not unlike what frequently occurs in divorce. Once just termination rules are established, stripping citizenship could become, like divorce, an everyday event. In Metaphysical Themes, Robert Pasnau interprets Thomas Hobbes as an anti-realist about all accidents in general. In opposition to Pasnau, we argue that Hobbes is a realist about some accidents (e.g., motion and magnitude). Section One presents Pasnau’s position on Hobbes; namely, that Hobbes is an unqualified anti-realist of the eliminativist sort. Section Two offers reasons to reject Pasnau’s interpretation. Hobbes explains that magnitude is mind-independent, and he offers an account of perception in terms of motion (understood as a mind-independent (...) feature of body). Therefore, it seems incorrect to call Hobbes an anti-realist about all accidents. Section Three considers Pasnau’s hypothetical response: he might claim that for Hobbes, motion reduces to body and does not exist in its own right. Section Four notes that reductionism about all accidents does not entail anti-realism about all accidents. Even granting Pasnau’s anticipated response, his anti-realist reading does not follow. Contra Pasnau, Hobbes is best understood as claiming that motion and magnitude exist mind-independently. (shrink)

Most challenges to immigration restrictions have not shown that states lack a claim-right to exclude, or a moral right against outside interference to make membership decisions. And an important, unexamined aspect of the claim-right is that states have the right against interference to wrongfully exclude, or the right to do wrong when making admission decisions. A major implication of this right is that even political or economic measures to affect states’ immigration policies are off the table – significantly compromising the (...) prospect of meaningfully addressing the world’s growing refugee crisis. In the form of a reductio argument, I provide reason to reject this position. Specifically, I try to demonstrate that, in the relevant cases, a plausible moral defense for the right to wrongfully exclude can only be given for states with objectionable character – protecting the very states whose immigration policies we should be most concerned with, which is surely morally counterintuitive. Veiled women in the West appear menacing. Their visible invisibility is a cause of obsession. What is beneath the veil more than a woman? This book investigates the preoccupation with the veiled body through the imaging and imagining of Muslim women. It examines the relationship between the body and knowledge through the politics of freedom as grounded in a ‘natural’ body, in the index of flesh. The impulse to unveil is more than a desire to free the Muslim woman. What (...) lies at the heart of the fantasy of saving the Muslim woman is the West’s desire to save itself. The preoccupation with the veiled woman is a defense that preserves neither the object of orientalism nor the difference embodied in women’s bodies, but inversely, insists on the corporeal boundaries of the West’s mode of knowing and truth-making. The book contends that the imagination of unveiling restores the West’s sense of its own power and enables it to intrude where it is ‘other’ – thus making it the centre and the agent by promising universal freedom, all the while stifling the question of what freedom is. Virtual screening is the most critical process in drug discovery, and it relies on machine learning to facilitate the screening process. It enables the discovery of molecules that bind to a specific protein to form a drug. Despite its benefits, virtual screening generates enormous data and suffers from drawbacks such as high dimensions and imbalance. This paper tackles data imbalance and aims to improve virtual screening accuracy, especially for a minority dataset. For a dataset identified without considering the data’s imbalanced (...) nature, most classification methods tend to have high predictive accuracy for the majority category. However, the accuracy was significantly poor for the minority category. The paper proposes a K-mean algorithm coupled with Synthetic Minority Oversampling Technique to overcome the problem of imbalanced datasets. The proposed algorithm is named as KSMOTE. Using KSMOTE, minority data can be identified at high accuracy and can be detected at high precision. A large set of experiments were implemented on Apache Spark using numeric PaDEL and fingerprint descriptors. The proposed solution was compared to both no-sampling method and SMOTE on the same datasets. Experimental results showed that the proposed solution outperformed other methods. (shrink)

Ethics is divided into three realms: Meta-ethics, normative ethics, and applied ethics. Utilitarianism is one of the most significant views in normative ethics, which acts as a true criterion to judge on human deeds in terms of loss and benefits of their consequences. In other words, utilitarianism judges on the amount of happiness for all the ones who have been influenced by that act. Utilitarianism itself is divided into two groups: act-utilitarianism, and rule-utilitarianism. The former concentrates on the amount of (...) goodness or happiness that an act creates in a particular situation and the latter considers the amount of goodness or happiness which results from a principle or rule. J.J.C. Smart is a pragmatist, and an advocate of act-utilitarianism. In this essay we have attempted to investigate some of the problems put forward on the problem of calculating the consequences of acts, then we explain the accepted principles by utilitarianists, and finally Smart’s responses to those problems. Instead of calculating the consequences as a response to these criticisms, Smart talks about comparison of two "Total Situation”, and by doing so he ignores the problem. In order to respond to all the criticisms on the calculation of utilitarianism, Smart, by differentiating between two types of evaluating and calculating consequences of an act and evaluating and calculating possible acts, attempts to appeal to the "Ripples on a Pond Model" and to the "Rules of Thumb" for cases which he is obliged to appeal to rules. Mesenchymal stem cells (MSCs) are present in fat tissues throughout the body, yet little is known regarding their biological role within epidural fat. We hypothesize that debridement of epidural fat and/or subsequent loss of MSCs within this tissue, disrupts homeostasis in the vertebral environment resulting in increased inflammation, fibrosis, and decreased neovascularization leading to poorer functional outcomes post‐injury/operatively. Clinically, epidural fat is commonly considered a space‐filling tissue with limited functionality and therefore typically discarded during surgery. However, the presence of MSCs (...) within epidural fat suggests that itis more biologically active than historically believed and may contribute to the regulation of homeostasis and regeneration in the dural environment. While the current literature supports our hypothesis, it will require additional experimentation to determine if epidural fat is an endogenous driver of repair and regeneration and if so, this tissue should be minimally perturbed from its original location in the spinal canal. The ethical aspect of the online learning is a major priority that has to be addressed by all stakeholders in the educational field. This study sheds the light on establishing a code of ethics for the online learning based on a Palestinian vision. A content analysis was used for related literature in order to drive themes and major topics, then a qualitative approach was used to collect data to test the themes from the field. The study population consisted of 21 (...) educators who have previous experience in online learning and 4 key university specialists with pedagogical experience. Interviews and focused group meetings were conducted with participants. The findings revealed that most of educators’ attitudes toward establishing a code for ethics in online learning mode are positive. The study also revealed that all educational stakeholders play a vital role in the success of online learning and particularly in practicing positive ethics. (shrink)

This study aims to draw a gender based analysis of social and economic conditions of child labourers living in Karachi. Globally the issue of child labour is growing constantly and children are engaged in all sorts of hazardous forms of work, like adults, which deprives them from education, healthy life, child hood activities and balanced diet. In Pakistan the child labour is very common in all economic sectors, but it is mainly found in the informal sector and the household sector. (...) Purposive and convenience sampling techniques of non-probability sampling are used to collect data through structured questionnaire from 900 respondents from eighteen administrative districts of Karachi, which is based upon primarily quantitative and narrowly focused qualitative research methods. The findings of the study reveal that mostly children between the ages of 12 to 14 years are commonly inducted in different economic sectors. This clear violation of child rights makes them vulnerable to health and safety threats and putting them forcefully in hazardous occupations to earn bread and butter for their family by compromising their education.
