According to a rule of traditional logic concerning the relation between general (or universal) concepts, if a given concept is more general than a second one, then the opposition (or contradictory) of the first concept is more specific than the opposition (or contradictory) of the second one. Kātibī, one of the Muslim logicians in the 13th century, has raised a question against this rule and, by giving some counterexamples, claims that it results in contradiction. Some Muslim logicians have replied to (...) Kātibī, and in this paper I have examined their replies. Also, by using rules of modern logic, we may easily show that either Kātibī's argumentation is fallacious or it does not result in contradiction; however, it seems that if modern logic rules had been represented to Muslim logicians, some of those rules would have been rejected by them. According to Aristotelian logic, in categorical logic, there are three kinds of judgements (qaḍīyya): affirmative, negative, and metathetic (ma‘dūla). Khūnajī, a famous Muslim logician in the 13th century, introduces a different judgement (or statement) entitled “affirmative judgement with the negative predicate” (mūjiba al-sāliba al-maḥmūl; henceforth, ANP judgement). Although in the Arabic language, formally, ANP judgement is similar to definite negative (sāliba muḥaṣṣala) and also metathetic judgements, the way of its construction is different from both of them and its truth conditions (...) are different from metathetic ones. From a modern logic viewpoint, ANP may indicate equality judgement; however, attributing it to Muslim logicians is questionable, although some of their wordings may implicitly show it. According to Ḥāʾirī, an Iranian contemporary philosopher and logician, the new judgement is supposed to solve some problems, especially logical explanation of the division of modalities into necessity, impossibility, and contingency (imkān khāṣṣ). However, Ṭabāṭabāʾī, another Iranian contemporary philosopher, disagrees with Ḥāʾirī and regards ANP judgement the same as an affirmative metathetic one. In this paper, while examining Ṭabāṭabāʾī’s and Ḥāʾirī’s reasons, by using some insights into modern logic, I will try to strengthen Ṭabāṭabāʾī’s views, although it may be confronted with some questions or deficiencies. Companies' urge to maximise their profits and their attempts to remain in the highly competitive globalised market gave birth to the TQM concept and have kept it alive. TQM is a comprehensive look which encompasses virtually every aspect of the value chain as well as the human resource and customer satisfaction. Therefore, a great number of companies feel obliged to implement its rules, and procedures. However, the concept is rather complicated and culture-bound, and calls for further research in new settings. (...) The aim of this study is to examine the influences of critical success factors of TQM on customer focus therefore, employees are classified based on their perceptions from critical success factors of total quality management and consequently the level of customer focus is compared between the different classifications. One of Kripke’s innovations concerning the philosophy of language is the doctrine that the truth of some metaphysically necessary propositions is only known a posteriori. The typical example he gives is the identity statement consists of two different proper names that refer to the same referent, like “Hesperus = Phosphorus”. By metaphysically necessary he means that the proposition is true in all possible worlds and by a posteriori knowledge he means that its truth is known by experiment or investigation. Some (...) philosophers have given arguments against Kripke’s doctrine and claimed that such propositions can, also, be known a priori. In this paper, I will defend Kripke’s view by showing that his approach to the issue is linguistic not metaphysical, opposite to his critics. (shrink)

The relationship between morality and law is one of the issues that has provoked considerable controversies. Among others, an important discussion is whether obeying “conventional morality” in public and/or private spheres should be legally enforced by legislators. In this paper, we will look at the controversies over the issue of the “legal enforcement of morality” in the well-known debate between Herbert Hart and Patrick Devlin. In light of Richard Hare's moral philosophy, we will begin by distinguishing three realms of morality. (...) We will then clarify Deviln's view on “conventional morality”, employing the terminology derived from Hare's moral philosophy. After elaborating the implications, consequences, and roots of “conventional morality” in Devlin's view, we will turn to the relation between law and “conventional morality”. Finally, we will criticize Devlin's approach and highlight our objections to his account. By showing the flaws of Devlin's conception of “conventional morality,” we will challenge her legal view of morals. (shrink)

The present study contributes to developing a pragmatic constructivist framework for detecting the nature of real-world’s problems. To do so, we developed a framework that appreciates factual and logical aspects of reality and considers the values of actors participating in the situation using their communication. This occurs by integrating contingency theory and sense-making theory, which utilize rational and discursive inference mechanisms, respectively. In order to effectively cope with the complexity of understanding problems’ nature, it is suggested to use rational and (...) discursive mechanisms in complement. To do so, in this study, organizational information processing theory (OIPT) from contingency theory was utilized to enrich the Cynefin framework stemming from sense-making theory. Then, we used qualitative conceptual analysis to investigate Cynefin papers in a deductive-inductive way to develop the evolved Cynefin framework. The rationality of OIPT improves the analytical capabilities of Cynefin. Additionally, OIPT’s contextual factors facilitate structuring debate sessions to reach a consensus. Cynefin helps us extract contextual narrations, which enables the acquisition of new knowledge. OIPT tries to extract actors’ existing explicit and tacit knowledge. Finally, the developed framework is validated by utilizing it in the field of business process management and discussing how it helps problem-solvers make sense of their processes. (shrink)

Muslim scholars have had different approaches toward modern technologies. Defining the situation in various Islamic countries is dependent on knowing the approaches adopted by their scholars. These approaches create norms which can shed light on the reasons for the success and failure of access to technology and its transference. The present article sets out to analyze the views of the Qom seminary scholars in Iran about the development of modern technologies within the framework of the development sociology using the qualitative (...) methodology of grounded theory. To this end, such techniques as conducting interviews and investigating documents have been used to gather the data. The authors find four paradigm models regarding modern technologies among the Qom seminary scholars. These models are classified into two general categories: optimistic and pessimistic. In the end, an “appropriate technology” approach is introduced as an approach singled out by the researchers. (shrink)

Aristotle has repeatedly stated in his works that 'being has several senses'. Is this to be regarded as his pluralistic ontology, an approach that seems to be too nascent? If so, how can this newfound approach in ontology be linked to the ideas of the father of this science, i.e. Aristotle? These are the questions that the present article seeks to answer. First, we will show that Aristotle thinks of 'being' in four senses. Then, step by step he proceeds to (...) leave different senses aside, insofar as only one sense remains: being in the sense of the figures of the categories. We argue, then, that it is better to found Aristotle's ontological pluralism upon the fourfold sorts, instead of the tenfold categories. We will provide some reasons for this preference, i.e. in defense of the fourfold sorts and against the tenfold categories. Each of these four modes of being will be discussed. Finally, a version of ontological pluralism will be provided and attributed to Aristotle: Sorting Version. According to this version of pluralism, we will demonstrate how Aristotle speaks of the ontologically fundamental structure of the world. (shrink)

Buku ini berawal dari sebuah disertasi yang ditulis Sr. Gerardette Philips, RSCJ, pengarangnya, untuk meraih gelar doktor di bidang Ilmu Filsafat di Sekolah Tinggi Filsafat Driyarkara, Jakarta. Penerbitannya menjadi sebuah buku oleh Interfidei—sebuah Penerbit di Indonesia yang menaruh perhatian khusus pada persoalan dialog antaragama— sungguh layak disambut baik. Penerbitan buku ini dalam bahasa Inggris memiliki segi negatif maupun positifnya tersendiri. Segi negatifnya, hal itu membuat jumlah publik pembacanya di Indonesia lebih terbatas pada mereka yang dapat memahami bahasa Inggris. Jumlahnya jelas (...) jauh lebih sedikit dibandingkan dengan jumlah pembaca buku ini kalau ditulis dalam bahasa Indonesia. Walaupun demikian, segi positifnya, dengan diterbitkannya dalam bahasa Inggris, publik pembaca yang dapat mengaksesnya secara internasional menjadi lebih banyak. Apalagi buku ini juga memuat Kata Pengantar dalam bahasa Inggris dari Prof. Seyyed Hossein Nasr, seorang tokoh Muslim yang hendak ditampilkan pengarang buku ini sebagai pemikir sekaligus pelaku dialog Muslim-Kristen yang melampaui pendekatan pluralisme. Tokoh dari pihak agama Kristen yang ditampilkan oleh pengarang adalah Hans Küng. Selama ini banyak orang beranggapan bahwa pluralisme merupakan paham hubungan antaragama, yang memiliki bentuk pendekatan yang paling tepat dalam melakukan dialog antaragama, termasuk di dalamnya dialog antara umat Muslim dan Kristen. Memang, dibandingkan dengan pendekatan eksklusivisme maupun inklusivisme, seperti ditegaskan oleh pengarang buku ini (hlm. 1; 60–63; 67), pluralisme memiliki kelebihan tersendiri. Namun, pluralisme mengandung beberapa kelemahan yang layak dikritik. Paling tidak ada tiga kelemahan pokok dari pendekatan pluralisme yang dicoba ditunjukkan dalam buku ini. Pertama, pluralisme mengandung bahaya tidak mengambil serius identitas keagamaan yang khas dan berbeda untuk setiap agama karena ingin menekankan keselarasan antara semua agama, agar tidak terjadi konflik antara pemeluk agama yang berbeda. Guna menguatkan pendapatnya, pengarang mengutip pernyataan Paul Knitter (hlm. 64) yang berbunyi: “Karena begitu terpesona oleh keindahan sebuah simfoni, kaum pluralis melupakan perbedaan dan kekhasan dari masing-masing alat musik yang dipakai.” Pendekatan pluralisme juga mengandung bahaya jatuh ke dalam relativisme, karena— terdorong oleh kehendak untuk mau bersikap terbuka terhadap penganut agama yang lain dan mau menghormati perbedaan keyakinan mereka— para pluralis lalu cenderung merelatifkan klaim kebenaran agamanya sendiri. Tanpa harus menjadi seorang eksklusivis—yang memutlakkan klaim kebenaran keyakinan agamanya sendiri seraya menganggap sesat keyakinan agama yang lain—keseriusan untuk sungguh meyakini kebenaran iman agama yang dipeluknya, sangat diperlukan dalam berdialog agar tidak menjadi kompromistis dan jatuh ke dalam relativisme. Sikap terbuka terhadap para pemeluk agama yang lain—yang berbeda dengan agamanya sendiri—memang diperlukan dalam sebuah dialog antaragama yang sejati. Namun, hal itu perlu dilakukan tanpa kehilangan jatidirinya sendiri sebagai pemeluk agama tertentu yang diyakini kebenarannya. Kelemahan ketiga dari pluralisme adalah bahaya menjadi imperialis tanpa disengaja. Kembali mengutip pernyataan Knitter (hlm.68), pengarang menyebut adanya dua kemungkinan seorang pluralis yang berniat baik tanpa disengaja menjadi seorang imperialis. Pertama, dengan terlalu cepat seorang pluralis menarik kesimpulan tentang adanya suatu dasar pijak atau platform yang sama dari macam-macam agama yang ada yang dapat mempersatukan semuanya. Kedua, ia dengan terlalu mudah merumuskan panduan umum bersama untuk melakukan dialog antaragama-agama yang berbeda................ Salah satu kelemahan buku ini—sebagai sebuah buku yang dimaksud- kan untuk dibaca oleh publik pembaca umum—adalah bahwa formatnya masih mempertahankan format aslinya sebagai sebuah disertasi dan belum cukup diolah untuk dijadikan buku yang lebih dapat diakses dan lebih enak dibaca oleh publik pembaca umum. Bahkan di dalamnya masih dapat ditemukan kata “disertasi” dan belum diganti dengan kata “buku” (lihat hlm. 11). Semboyan dalam bahasa Latin “Extra Ecclesiam Nulla Salus,” artinya “Di luar Gereja tidak ada keselamatan,” yang dalam teks asli disertasi salah ditulis “Extra Ecclesiam Nulla Sales!” masih terulang kesalahannya dalam buku ini (lihat hlm. 90). Lepas dari kelemahan kecil di atas, penerbitan buku ini sekali lagi sungguh layak dihargai dan jelas menambah khasanah intelektual yang dapat memperkaya wawasan maupun memberi inspirasi yang berguna bagi siapa saja yang bermaksud mengembangkan dialog antaragama pada umumnya dan khususnya dialog Muslim-Kristen yang menjadi fokus perhatian dalam buku ini. Sr. Gerardette Philips, RSCJ, Ph.D., penulis buku ini, bukan hanya menjadi seorang akademikus yang telah meneliti pemikiran Hans Küng dan Seyyed Hosein Nasr, tetapi ia sendiri sudah cukup lama terlibat dalam upaya mengembangkan dialog Muslim- Kristen. Beliau bahkan sempat menjadi anggota tim penasihat Paus Benedictus XVI dalam Komisi Kepausan dalam Bidang Hubungan dengan Islam. Pengalamannya yang cukup banyak dalam mewujudkan dialog hidup antara umat Islam dan umat Katolik jelas ikut memperkaya wawasan dalam buku ini. (J. Medical ethics is a realm where four important subjects of philosophy, medicine, theology and law are covered. Physicians and philosophers cooperation in this area will have great efficiency in the respective ethical rules formation. In addition to respect the autonomy of the patient, physician's obligation is to ensure that the medical intervention has benefit for the patient and the harm is minimal. There is an obvious conflict between duty of confidentiality and duty of mandatory reporting. Professional confidentiality is one of (...) the basic components in building a constant physician-patient relationship which nowadays, beside the novelty, it is the subject of discussion. Legal obligation of confidentiality is not absolute. In physician-patient relationship, keeping patient's secrets and maintaining confidentiality is a legal and ethical duty, and disclosure of such secrets is mainly through specific statutes. Thus, there are a number of situations where breach of confidentiality is permitted in different legal systems. One of the situations where breaching confidentiality is permitted is the medical mandatory reporting to the relevant authority which is in accordance with many countries' legal systems. Some situations are considered in many countries legal systems' such as notification of births and deaths, infectious diseases, child abuse, sport and relevant events, medical errors, drug side effects and dangerous pregnancies. In this paper, we will examine and discuss medical mandatory reporting and its ethical and legal aspects in the judicial and legal system of Iran and few other countries. Nomophobia (no-mobile-phone phobia) is the fear and anxiety of being without a mobile phone. This study pioneers the investigation of nomophobia in Afghanistan using the Nomophobia Questionnaire (NMP-Q), addressing a crucial gap in the field. We collected statistical data from 754 undergraduate medical students, comprising men (56.50 %) and women (43.50 %), and analyzed the dimensions of nomophobia. While results revealed that all but two participants were nomophobic, they identified three significant dimensions affecting the level of nomophobia among participants: (a) (...) gender, (b) age, and (c) marital status. The study's contributions are precious, given the peculiarity of Afghan political turmoil, security, and human rights issues, especially for women. For example, the study's data collection was abruptly halted in December 2022 due to the Taliban regime's decision to make it illegal for women to enroll in universities as students. Therefore, while examining the characteristics of nomophobia across societies is imperative, it is also vital to investigate what is true of one society, Afghanistan, at one point in time and space. The study concludes by emphasizing the need to broaden participants' scope in future studies to better understand the prevalence of nomophobia across broader societal contexts and forces. (shrink)

The current ecological crisis is a matter of urgent global concern, with solutions being sought on many fronts. In this book, Seyyed Hossein Nasr argues that the devastation of our world has been exacerbated, if not actually caused, by the reductionist view of nature that has been advanced by modern secular science. What is needed, he believes, is the recovery of the truth to which the great, enduring religions all attest; namely that nature is sacred. Nasr traces the historical (...) process through which Western civilization moved away from the idea of nature as sacred and embraced a world view which sees humans as alienated from nature and nature itself as a machine to be dominated and manipulated by humans. His goal is to negate the totalitarian claims of modern science and to re-open the way to the religious view of the order of nature, developed over centuries in the cosmologies and sacred sciences of the great traditions. This study contextualizes business leaders’ perspectives on business-society interaction through the theoretical lens of wisdom. Morally effective interaction between business and society relies on shared perceptions of expected values grounded in leaders’ virtuous behavior. Through empirical fieldwork across industries in a developing society, the article documents how local business leaders perceive wise leadership in dealing with socially complex problems. Using grounded theory, we inductively developed a model of wisdom, executive wisdom, that identifies 14 characteristics of wisdom, located in three groups: (...) technē, wise decisions, and virtuous disposition. This paper examines the 'taking back control' over immigration arguments offered for Brexit and for reinforcing the Southern border of the United States. According to these arguments, Brexit and increased border enforcement were needed to ensure collective self-governance for the peoples of Britain and the United States. I argue that 1. In fact these policies did little to enhance collective self-governance properly understood, and 2. They actually thwarted collective self-governance due their racially exclusionary effects on people of color in Britain (...) and the United States. (shrink)

This paper presents a novel framework for evaluating racial profiling, including 'rational profiling' that does in fact decrease crime rates. It argues that while profiling some groups, such as African Americans and Muslims, is impermissible, profiling others, such as white men, may be permissible. The historical and sociological context matters significantly. Along the way, the paper develops a new theory of what expressive harms are, why they matter, and when it is the responsibility of the state to correct them.

The term takyīf fiqhī stands for one crucial concept in Islamic jurisprudence and refers to one of the important steps in the process of formulating fatwā. It basically revolves around the categorization of particular issues under the appropriate rules and precedents established in Islamic juristic thought. The present article attempts to examine the concept of takyīf fiqhī in a comprehensive manner in terms of its meaning, authority, types, importance, and governing criteria as can be gleaned from the works of Sharī‘ah (...) scholars. This is then followed by an exploration of its application to modern contracts, taking as a case study the Central Provident Fund Nomination in Singapore. The article concludes with the view that the Central Provident Fund Nomination, in terms of its essential characteristics and objective, resembles the Islamic will contract as discussed in books of Islamic Jurisprudence. Many liberal democracies have large populations of “unauthorized” migrants, who entered in contravention of immigration laws. In this paper, I will offer a new argument for allowing long-resident unauthorized migrants to transfer to “legal” status, which would allow them to live and work legally in their country of residence, without fear of deportation. I argue that legalization is required to secure the autonomy of these migrants, and that only by securing their autonomy can the state exercise authority over them legitimately. (...) AimsThis study aimed to investigate barriers in the observation of professional ethics during clinical care from a nursing viewpoint. Also, it examined the association between these barriers and nurse demographic variables.MethodsA descriptive-analytic design was carried out on 207 nurses working in selected hospitals within an urban area of Iran in 2019. Data were collected using a standard questionnaire containing 33 questions that measured barriers to observation of professional ethics. The questionnaire measures three domains of management, environment and individual care.ResultsIn the (...) management dimension, the most important barrier preventing observation of professional ethics was the shortage of personnel. For the environmental dimension, biological changes due to working on the nightshift, and for the individual care dimension, a lack of time were the most important barriers preventing observation of clinical ethics. Findings additionally highlighted a significantly inverse association between barriers to observing professional ethics and the male gender, participating in the ethics workshop and high work-level experiences.ConclusionsIt is suggested that nursing managers in hospitals correct and remove obstacles with careful planning and emphasis on principles and standards of care including environmental and managerial factors and training professional ethics to nurses. The role of responsibility in our common-sense morality of self-defense is complex. According to common-sense morality, one can sometimes use substantial, even deadly, force against people who are only minimally responsible for posing a threat to us. The role of responsibility in self-defense is thus limited. However, responsibility is still sometimes relevant. It sometime affects how much force you can use against a threatener: less if they are less responsible and more if they are more responsible. Is there a well-motivated (...) theory that can explain both why the role of responsibility is limited and why it is sometimes relevant? It is hard to see what theory could unify these disparate elements of our common-sense morality, and if one cannot be found then we may simply have to revise some of our pre-theoretic beliefs. But it would be an important advantage of a theory if it could justify those beliefs. I will argue that there is a theory of this kind: surprisingly, the familiar rights theory of self-defense, defended by Judith Thomson, can do so if it is suitably supplemented. Along the way I will survey some alternative theories of self-defense and show why they are not up to the task. (shrink)

Background: Although human dignity is an unconditional value of every human being, it can be shattered by extrinsic factors. It is necessary to discover the authentic meaning of patients’ dignity preservation from different religious perspectives to provide professional cross-cultural care in a diverse setting. Research objective: This article identifies common experiences of Iranian Muslim and Armenian Christian patients regarding dignified care at the bedside. Research design: This is a qualitative study of participants’ experiences of dignified care elicited by individual in-depth (...) semi-structured interviews. Participants and research context: A purposeful sample of 10 participants (five Iranian Muslims and five Iranian Armenians) from various private and governmental hospital settings was chosen. Ethical considerations: This study was approved by the ethics committee of Tehran University of Medical Sciences. All the participants were provided with information about the purpose and the nature of the study, the voluntary condition of their participation in this study, and the anonymous reporting of recorded interviews. Findings: The common experiences of Christian and Muslim patients regarding dignity preservation emerged as “exigency of respecting human nobility” and “providing person-centered care.” Discussion and conclusion: It is essential to recognize the humanness and individuality of each patient to preserve and promote human dignity in diverse cross-cultural settings. The findings support and expand current understanding about the objective and subjective nature of dignity preservation in cross-cultural nursing. (shrink)

This article is concerned with ‘how’ newsworthiness is constructed linguistically/discursively in a sample of Iranian crime and misbehaviour reports. This is new as both linguistic analysis of ‘crime reports’ and the context of ‘Iranian journalism’ are among under-researched areas. One-month worth editions of two Iranian/farsi language newspapers were collected, and the data were analysed both quantitatively and qualitatively with reference to the analytical framework of Bednarek and Caple. While the quantitative analysis showed the construction of Eliteness as the most frequent (...) news value in both newspapers, there were differences in the construction of news values between the newspapers. Qualitative analysis of the data also showed the construction of news values in line with the sociocultural values prevalent in the society as well as the possible role of state and political authorities. The study contributes to building an understanding of the impact of political forces on the information environment of listed firms in a developing economy. Specifically, it investigates the tensions between politico-institutional factors and accounting regulation on the prolonged and incomplete implementation of the International Financial Reporting Standards in Bangladesh from 1998 to 2010. Two phases of interviews were conducted in 2010–2011 and IFRS-related enforcement documents from 1998 to 2010 were evaluated. The study contributes that IFRSs are being diffused to developing (...) countries like Bangladesh, but they invariably interact with local institutions, with variable outcomes. Coercive, normative and mimetic isomorphisms are low in Bangladesh. Notably, political forces have been undermining mimetic isomorphism because of the high level of government intervention and the high level of political lobbying. Political institutional pressures stand in the way of mimetic isomorphism and constitute negative forces that add further tension to accounting regulation in Bangladesh. Regarding the low level of normative isomorphism, there is evidence of a ‘blame culture’, with state institutions and professional accountancy institutions in the country blaming each other for the poor progress in IFRS implementation. Although the study focuses on Bangladesh, its results have implications for international policy makers, as well as the governments and regulators of other developing economies facing similar challenges in implementing IFRS. Inspired by Williamson’s knowledge-first epistemology, I propose a position on practical knowledge that can be called the ‘know-how-first view’; yet whereas Williamson is one of the pioneers of the new intellectualism about know-how, I employ the know-how-first view to argue against intellectualism and instead develop a know-how-first version of anti-intellectualism. Williamson argues that propositional knowledge is a sui generis unanalyzable mental state that comes first in the epistemic realm; in parallel, I propose that know-how is a sui generis unanalyzable power (...) that comes first in the practical realm. To motivate this suggestion, I put forward two arguments: drawing on dispositionalist ideas, I argue that the practical component of know-how is unanalyzable; based on an investigation of the natures of intentionality and intelligence, I argue that know-how is prior to intentional and intelligent abilities in the order of explanation of agential action. Deploying this know-how-first anti-intellectualism, I then set out know-how-first solutions to two challenging problems for anti-intellectualism: the sufficiency problem and the necessary condition problem. In this paper I focus on one very influential argument for open borders, the freedom of movement argument, which says that if we value freedom of movement we must demand open borders. I begin the paper the paper by discussing Joseph Carens’ well known version of the argument. I then consider, and reject, David Miller’s response to that argument. Finally, I develop my own reply to Carens. Both Carens and Miller, I argue, are mistaken about the proper grounds for freedom (...) of movement. Purpose The purpose of this study is to examine the respondents’ evaluation of the pervasiveness of fake news through various SM platforms in Kuwait. The authors also examined the respondents’ attitudes toward most fake news on SM. A total of 1,539 Kuwaitis were selected. Design/methodology/approach The questionnaire was the major tool for this study. The respondents, from whom demographic information was obtained, were asked about which SM platforms most frequently spread fake news, their attitudes toward the subjects most frequently involved (...) in spreading fake news, their degree of use of the six SM platforms and interest in various subjects, and the attitudes toward the negative nature of SM news. SPSS was used for the data analysis. Findings The results showed that WhatsApp was the most likely to be used to disseminate fake news; Twitter and Instagram ranked second. The younger subjects were affected more by text and voice clips than the older ones. Originality/value The study, hopefully, produces new knowledge on the subject of fake news in social media, especially in the Arab world, since there are few studies conducted in the region. The study showed that WhatsApp was the SM tool most likely to be responsible for disseminating fake news in Kuwait, which may shed light on the usage of this application to be a news tool, rather than merely an interpersonal communication medium. In light of the Fourth Industrial Revolution, the intervention of artificial intelligence in commercial transactions has expanded, and it has not remained a mere subject or subject of the contract, whether it is a material or moral product, but has gone beyond that to have a fundamental and effective role in concluding the contract as an electronic agent that makes the contract automated and concluded in whole or in part in an automated manner without human intervention. The UAE legislator was (...) interested in regulating its use, whether under the Electronic Transactions Law of 2006 and the current one of 2021, and referred to this possibility under the Trade through Modern Technology Law of 2023; It considers it an information program that represents the original principal and bears the effects of the transaction concluded with the intervention of artificial intelligence despite not granting the electronic agent legal personality. The integration of artificial intelligence and modern technology into commercial transactions has profoundly transformed the landscape of commercial law. Artificial intelligence techs, including natural language processing and machine learning algorithms, are increasingly utilized for contract formation, risk assessment, and dispute resolution. Such technologies enhance efficiency, decreases human error, and advance transactional processes, offering substantial advantages for businesses and consumers. Modern technology, consists of digital currencies, smart contracts, and blockchain, has further revolutionized commercial transactions through offering unprecedented levels of security, transparency, and automation. Blockchain technology warrants irreversible and provable records, while smart contracts perform automatically when predefined conditions are met. This minimizes the need for intermediaries and enhancing integrity of the transactions carried out. Additionally, this paper addresses the legal and regulatory responses to these technological advancements. Jurisdictions across the world are grappling with the need to update existing laws or come up with new ones in order to address the challenges posed by AI and modern tech in commerce. The dynamic nature of technology calls for a flexible and adaptive legal approach in order to make sure that commercial laws remains to be relevant and effective. (shrink)

The doing/allowing distinction plays an important role in our thinking about a number of legal issues, such as the need for criminal process protections, prohibitions on torture, the permissibility of the death penalty and so on. These are areas where, at least initially, there seem to be distinctions between harms that the state inflicts and harms that it merely allows. In this paper I will argue for the importance of the doing/allowing distinction as applied to state action. Sunstein, Holmes, Vermeule (...) and others have presented influential arguments for the claim that where the state is concerned the doing/allowing distinction has no moral significance, even if it does elsewhere. I show that these arguments can be resisted. In doing so, I defend some important distinctions and principles that help us understand the state’s role in protecting people from harm. (shrink)

The present article analyzes and compares the idea of divine revelation to justify religious beliefs from the viewpoints of Paul Moser and Mulla Sadra. Moser suggests a kind of moral transformation experience that includes direct cognition and internal experience of self-revelation and God’s unselfish love while he considers mere theoretical reason to be inefficient and emphasizes God’s authority and His attributes and goals as well as the axis of divine revelation. Knowledge-by-presence and direct experience of God in Mulla Sadra’s philosophy (...) which is the only way to access true recognition of God is close to divine revelation. The present article shows that, considering the relationship between love and salvation, and knowledge-by-presence and the practical intellect, in Sadrian belief in God, Moser’s approach is close to Mulla Sadra’s even though the method of argumentation of these two philosophers in representing this type of cognition is not completely the same. Considering the commonalities and differences between Moser and Mulla Sadra in justifying belief in God, it seems possible to revise Moser’s approach with a Sadrian reading with a combination of innate nature arguments and self-knowledge.
