Physicians make some medical decisions without disclosure to their patients. Nondisclosure is possible because these are silent decisions to refrain from screening, diagnostic or therapeutic interventions. Nondisclosure is ethically permissible when the usual presumption that the patient should be involved in decisions is defeated by considerations of clinical utility or patient emotional and physical well-being. Some silent decisions—not all—are ethically justified by this standard. Justified silent decisions are typically dependent on the physician's professional judgment, experience and knowledge, and are not (...) likely to be changed by patient preferences. We condemn the inappropriate exclusion of the patient from the decision-making process. However, if a test or treatment is unlikely to yield a net benefit, disclosure and discussion are at times unnecessary. Appropriate silent decisions are ethically justified by such considerations as patient benefit or economy of time. (shrink)

[Peter Simons] Commonsense ontology contains both continuants and occurrents, but are continuants necessary? I argue that they are neither occurrents nor easily replaceable by them. The worst problem for continuants is the question in virtue of what a given continuant exists at a given time. For such truthmakers we must have recourse to occurrents, those vital to the continuant at that time. Continuants are, like abstract objects, invariants under equivalences over occurrents. But they are not abstract, and their being invariants (...) enables us to infer both their lack of temporal parts and that non-invariant predications about them must be relativized to times. \\\ [Joseph Melia] In this paper I try to eliminate occurrents from our ontology. I argue against Simons' position that occurrents are needed to supply truthmakers for existential claims about continuants. Nevertheless, those who would eliminate occurrents still need some account of our willingness to assert sentences that logically entail their existence. Though it turns out to be impossible to paraphrase away our reference to occurrents, I show that the truthmakers for such sentences are facts that involve only continuants. This is enough to allow us to regard our ordinary talk about occurrents as fictional. Finally, I argue that a proper conception of the underlying temporal facts about continuants can both avoid the problematic tensed theory of time and the problem of temporary intrinsics. (shrink)

Simone Weil (1909-1943) was a defining figure of the twentieth century; a philosopher, Christian, resistance fighter, anarchist, feminist, labor activist and teacher. She was described by T. S. Eliot as "a woman of genius, of a kind of genius akin to that of the saints," and by Albert Camus as "the only great spirit of our time." Originally published posthumously in two volumes, these newly reissued notebooks, are among the very few unedited personal writings of Weil's that still survive (...) today. Containing her thoughts on art, love, science, God and the meaning of life, they give context and meaning to Weil's famous works, revealing a unique philosophy in development and offering a rare private glimpse of her singular personality. In 1971, Ivan Illich wrote that school had become the world religion of a modernized proletariat. Without undoing the power of human interaction undergirding it, understanding how we learn is thus vital to undoing the institutional power of the West – of ‘deschooling’ society. Responding to the conflict between secular and religious schemes of education, the article investigates the ways in which the ‘atheist’ Gilles Deleuze and the ‘mystic’ Simone Weil both employed related stratagems from Stoic philosophy to critique (...) ‘schooling’ construed as the acquisition of, rather than participation in, knowledge. Through a critical reading of the differences between Deleuze's and Weil’s ideas of education, the argument suggests that these differences run aground on the fundamental opposition to a common adversary: that normative pedagogy which trivializes the need to re-school, as well as de-school, society. Cambridge professor Simon Blackburn is best known to the general public as the author of several books of popular philosophy such as  ink, Being Good andTruth: a Guide for the Perplexed. Academic philosophers also know him as the author of one of the most important books of contemporary moral philosophy, Ruling Passions, and as a former editor of the leading journal Mind.

Simon J. Evnine explores the view that some objects have matter from which they are distinct but that this distinctness is not due to the existence of anything like a form. He draws on Aristotle's insight that such objects must be understood in terms of an account that links what they are essentially with how they come to exist and what their functions are. Artifacts are the most prominent kind of objects where these three features coincide, and Evnine develops a (...) detailed account of the existence and identity conditions of artifacts, and the origins of their functions, in terms of how they come into existence. He then extends this account to organisms, where evolution accomplishes what is effected by intentional making in the case of artifacts, and to actions, which are seen as artifactual events. I consider the ‘normative relevance’ argument and the idea of grounding. I diagnose why there appears to be a tension between the conclusion that we are tempted to reach and the intuition that the normative is grounded in or by the non‐normative. Much of what I say turns on the idea of the normative itself. In short, I think that concentrating on this idea can help us see how the tension arises. My aim is to encourage people to reconceptualize the (...) debate so as to begin to offer additional insight. To that end, I spend some time contrasting normativity with evaluation, and then think how the debate may alter if we run it with the latter. I doubt that doing so will solve any problem, and I suspect that what I say will be controversial anyway. But there is some value to changing matters nonetheless. The idea that runs through this paper is that the whole issue is so complex and deep that we should not narrowly construe it with reference only to normativity. (shrink)

Graham Harman describes the allure of art as the tension and fusion of a real object to sensual qualities so that it makes it seem that the inwardness of reality is opened to us. Yet real objects are withdrawn; how are we aware of their fusion? Since Harman’s ontology mandates that contact between real objects occurs only through sensual objects, this essay explores the idea that art’s allure must be a tension between sensual objects that draw the experiencer to believe, (...) or alieve, they are in contact with the withdrawn real. By looking at the examples in representational painting and sleight of hand magic, we see that ontographic art objects use at least four, carefully separated sensual objects to produce their aesthetic effect. The conclusion summarises allure as a sensual object process, speculates on art’s dialetheic confusion of sensual and real objects giving an enduring allure to idealism, and notes potential motifs of an infra-realist resistance. The metaphysics of relations is still in its infancy. We use the idea of truthmaking to gain purchase on this metaphysics. Assuming a modest supervenience conception of truthmaking, where true relational predications require multiply dependent truthmakers, these are indispensable relations. Though some such relations are required, none are needed for internal relatedness, nor for several other kinds of relational predication. Discerning the metaphysically basic kinds of relations is fraught with uncertainties, but must be tackled if progress is to be made.

In 1850, Jacob Frerichs produced the first and until now the only edition of Friedrich Schleiermacher’s important lectures on Practical Theology. It is a mix and compilation of students’ transcripts from six different semesters, redundant and at times contradictory, which doesn’t correspond to Schleiermacher’s actual lectures. Most of the transcripts used by Frerichs are still preserved and have now been evaluated for a new edition of Schleiermacher’s Practical Theology. In this paper, we develop the notion of a natural convention, and illustrate its usefulness in a detailed examination of indirect requests in English. Our treatment of convention is grounded in Lewis’s seminal account; we do not here redefine convention, but rather explore the space of possibilities within Lewis’s definition, highlighting certain types of variation that Lewis de-emphasized. Applied to the case of indirect requests, which we view through a Searlean lens, the notion of natural convention allows us to give (...) a nuanced answer to the question: Are indirect requests conventional? In conclusion, we reflect on the consequences of our view for the understanding of the semantics/pragmatics divide. (shrink)

A Life in Letters is an English translation of philosopher Simone Weil's letters to her parents and brother, mathematician André Weil. The letters, pulled from the original French correspondence, provide a road map to Weil's life and an unparalleled view into Weil's work and her relationship with the three people who had the greatest impact on her.

In this essay from 1933, Simone Weil—only 24 at the time—offers her analysis of war, particularly as it appears in leftist discourse and revolutionary movements, and set in the context of a brewing war with Germany. In Marxism, and in leftist theory more generally, Weil finds no consistent attitude towards armed conflict, and certainly no principled opposition to it. Through certain historical falsifications and philosophical feints, leftists—of which Weil counted herself—end up propagating the very forms of oppression to which (...) they declare themselves opposed. For Weil, “la guerre révolutionnaire est la tombe de la revolution” [revolutionary war is the tomb of the revolution], as long as workers are denied the means of waging it without a state machine controlling them, without military courts, and without execution for desertion. The conventional attitude towards (and the means of) revolutionary war threatens, in the words of Marx, to perfect the state apparatus rather than to overthrow it. (shrink)

Simon Keller's The Limits of Loyalty makes an important and valuable contribution to a neglected area of moral psychology, both in presenting a clear and subtle account of loyalty in its various manifestations, and in challenging some assumptions about the role of loyalty in a morally decent life. Loyalty's domain is that of special relationships, and for some relationship types, Keller argues that these relationships rightly carry some motivational force, as in his analysis of filial duties. In other cases, such (...) as patriotism, ‘there is always something unfortunate about such loyalties’, for example, that they involve dispositions to ‘fall into bad faith’ or other confusions.Keller begins by examining diverse particular loyalties, then moves to more general questions about loyalty. He considers friendship patriotism, and the obligations of grown children to parents. This article draws upon the work of contemporary French feminist philosopher Luce Irigaray in developing a post‐structuralist analysis of travel within the autobiographies of the second wave feminist philosopher Simone de Beauvoir. Travel and the experience of wonder at the otherness of the world figure as important self shaping experiences within the four volumes of Beauvoir's life narrative. Travel has a metonymic relation to the passage of Beauvoir's life, in which the existential extremes of anguish and ecstasy are played (...) out in a quest for self knowledge. Through a close reading of Beauvoir's writing I analyse the different formations of desire that structure the experience of wonder in relation to the otherness of the world and death. I also draw upon debates within feminist philosophy about the nature of subjectivity and knowledge that were, in Beauvoir's time, ordered around an Hegelian opposition between immanence and transcendence. I take up Irigaray's notion of the sensible transcendental to explore another way of conceptualising the feminine subject's desire to know and value the world differently. (shrink)

The pathologies of the democratic public sphere, first articulated by Plato in his attack on rhetoric, have pushed much of deliberative theory out of the mass public and into the study and design of small scale deliberative venues. The move away from the mass public can be seen in a growing split in deliberative theory between theories of democratic deliberation (on the ascendancy) which focus on discrete deliberative initiatives within democracies and theories of deliberative democracy (on the decline) that attempt (...) to tackle the large questions of how the public, or civil society in general, relates to the state. Using rhetoric as the lens through which to view mass democracy, this essay argues that the key to understanding the deliberative potential of the mass public is in the distinction between deliberative and plebiscitary rhetoric. ArgumentEarly modern Europeans routinely compared nature to a theater or spectacle, so it makes sense to examine the practices of observing real spectacles and performances in order to better comprehend acts of witnessing nature. Using examples from the history of fireworks, this essay explores acts of observing natural and artificial spectacles between the sixteenth and late eighteenth centuries and suggests these acts of observation were mutually constitutive and entailed ongoing and diverse exchanges. The essay follows the changing ways in which (...) audiences were imagined or expected to react to fireworks and shows how these also shaped experiences of natural phenomena. Both natural and artificial spectacles were intended to teach morals about the state and nature, yet audiences rarely seemed to take away what they were expected to learn. The essay examines how performers thus sought to discipline audience observation, before exploring, in conclusion, how spectacle provided a vocabulary for discerning and articulating new natural phenomena, and sites for the pursuit of novel experiments.
