This article emphasizes the necessity of finding new ideas of elders’ active social participation. Furthermore it points out the conceptions of creating city areas that favor development and integration of all age groups. Zapewnienie środków realizacji tak rozumianego dobra wspólnego stanowi zasadniczą rację bytu społeczeństwa i państwa. Wszelki byt społeczny jest bowiem — jako rzeczywistość relacyjna — ontycznie „słabszy” niż istniejąca w (...) sposób podmiotowy osoba ludzka. Dobro wspólne rozumiane personalistycznie stanowi jedyne dobro w pełni nieantagonistyczne: rozwój osobowy poszczególnych ludzi nikogo nie uszczupla, a wszystkich ubogaca. Zatem nie stanowi ono podporządkowania jednostki dobru całości rozumianej w sposób kolektywny. Jednocześnie pozwala na wskazanie racjonalnych podstaw dla konieczności istnienia rozmaitych społeczności, bez których rozwój osobowy nie mógłby się dokonać. Zaproponowana w artykule koncepcja M.A. Krąpca, akcentując prymat osoby względem bytu społecznego, jednocześnie wskazuje na fakt konieczności istnienia różnorakich społeczności jako ugruntowanych w ludzkiej spotencjalizowanej naturze środowisk umożliwiających rozwój osobowy człowieka. Recognized in his day as a man of letters equaling Rousseau and Voltaire in France and rivaling Samuel Johnson, David Hume passed from favor in the Victorian age--his work, it seemed, did not pursue Truth but rather indulged in popularization. Although Hume is once more considered as one of the greatest British philosophers, scholars now tend to focus on his thought rather than his writing. To round out our understanding of Hume, M. A. Box in this book charts the interrelated (...) development of Hume's literary ambitions, theories of style, and compositional practice from his Treatise in 1739 through the Enquiries. In so doing, Box makes the case for Hume's career-long concern with the presentational modes of reaching an audience for his philosophical writings. Hume reacted to the popular failure of his masterpiece, A Treatise of Human Nature, Box suggests, by self-consciously exploring strategies in his subsequent works for agreeably bringing his readership to participate in the act of philosophizing. Combining a sensitive grasp of the ways Restoration period and eighteenth-century writers conceived the relations between rhetoric and philosophy with sound readings of particular texts, Box shows how Hume's literary concerns went beyond matters of style to involve persona, structure, and doctrine. While this book helps explain long-standing ambiguities surrounding Hume, especially by pointing out the tension between his created persona and his own voice, it also serves as an excellent introduction to his philosophy. Two and a half thousand years ago Greek philosophers "looked up at the sky and formed a theory of everything." Though their solutions are little credited today, the questions remain fresh. Early Greek thinkers struggled to come to terms with and explain the totality of their surroundings, to identitify an original substance from which the universe was compounded, and to reconcile the presence of balance and proportion with the apparent disorder of the cosmos. It is extraordinary, when one thinks about it, how little attention has been paid by theorists of the nature and justification of punishment to the idea that punishment is essentially a matter of self-defense. H. L. A. Hart, for example, in his famous “Prolegomenon to the Principles of Punishment,” is clearly committed to the view that, at bottom, there are just three directions in which a plausible theory of punishment can go: we can try to justify punishment on purely consequentialist (...) grounds, which for Hart, I think, would be to try to construct a purely utilitarian justification of punishment; we can try to justify punishment on purely retributive grounds; or we can try to justify punishment on grounds that are some sort of shrewd combination of consequentialist and retributive considerations. Entirely absent from Hart's discussion is any consideration of the possibility that punishment might be neither a matter of maximizing the good, nor of exacting retribution for a wrongful act, nor of some imaginative combination of these things, but, rather, of something altogether different from either of them: namely, the exercise of a fundamental right of self-protection. Similarly, but much more recently, R. A. Duff, despite the fact that he himself introduces and defends an extremely interesting fourth possibility, begins his discussion by writing as though, apart from his contribution, there are available to us essentially just the options previously sketched by Hart. Again, there is no mention here, any more than in Hart's or any number of other recent discussions, of the possibility that we might be able to justify the institution of punishment on grounds that are indeed forward-looking, to use Hart's famous term, but that are not at all consequentialist in any ordinary sense of the word. A detailed attempt to ground the topological properties of time in the laws of micro- and macro-physical processes. The reversible processes of mechanics are used to define an order among temporally separated events, which is invariant under reversals of time direction. So long as consideration is limited to a single isolated system, a time ensemble, the transfer of the reversibility of the constituent processes of such a system to the system as a whole makes it impossible to define time direction (...) by means of the entropy curve. The directionality of time, accordingly, can only be defined as the direction of the entropy increase of multiple systems, of a space ensemble. A macrostatistical definition of time direction is then based upon the causal relation. The author's view of causation is non-deterministic: the conjunction of two events is caused if they occur together more frequently than can be expected from their chance coincidence. The present study seeks to lay out the most basic elements of the ontology of classical Aš‘arite theology. In several cases this requires a careful examination of the traditional and the formal lexicography of certain key expressions. The topics primarily treated are: how they understood “Being/ existence” and “being/existent” and essential natures; the systematic exploitation of the equivocities of certain expressions within a general context in which other than words there are no universals proves to be elegant as well as (...) insightful; the basic categories of primary entities: independant beings and nonindependant beings, created and uncreated, the equivocity of “being/existent” as predicated of contingent entities on the one hand and of God and His attributes on the other, and certain problems that arise because of the rigid application of the system's underlying analytic principles. Television medical dramas sometimes depict medical professionalism and bioethical issues, but their nature and extent are unclear. The authors systematically analysed the bioethical and professionalism content of one season each of Grey's Anatomy and House M.D., two of the most popular current television medical dramas. The results indicate that these programmes are rife with powerful portrayals of bioethical issues and egregious deviations from the norms of professionalism and contain exemplary depictions of professionalism to a much lesser degree.

Special groups [M. Dickmann, F. Miraglia, Special Groups : Boolean-Theoretic Methods in the Theory of Quadratic Forms, Memoirs Amer. Math. Soc., vol. 689, Amer. Math. Soc., Providence, RI, 2000] are a first-order axiomatization of the theory of quadratic forms. In Section 2 we investigate reduced special groups which are a lattice under their natural representation partial order ; we show that this lattice property is preserved under most of the standard constructions on RSGs; in particular finite RSGs and RSGs of (...) finite chain length are lattice ordered. We prove that the lattice property fails for the RSGs of function fields of real algebraic varieties over a uniquely ordered field dense in its real closure, unless their stability index is 1 . We show that Open Problem 1 has a positive answer for the RSG of the field Q . In the final section we explore the meaning of Open Problem 1 for formally real fields, in terms of their orders and real valuations; we introduce the notion of “parameter-rank” of a positive-primitive first-order formula of the language for special groups. Shah O.P.Recent trends in Catholic theology emphasize the category of "mystery." But "problems," which can seem distinct from and even opposed to mysteries, have a constitutive role in the work of theology as well. If the object of faith is God, and if theology's goal is typically defined as "faith seeking understanding," then the object of theology must include the (...) seeking's problematical quotient. At the very least, problems condition the faith-and-reason labor of theological enquiry. This essay claims that problems philosophically orient and index the theological articulation of mysteries—not the mysteries themselves—particularly in a modern key, and that they require explicit attention in theological methodology and pedagogy.First, I explain my concern with the "return to mystery" in conciliar-era Catholic theology. This explanation entails, second, describing the special attention to "problems" in neo-Kantianism, which bequeaths the tension between the empirical world and transcendental freedom to modern theology. These two historiographical matters in methodology set up the tension between problems and mysteries for Catholic thinking. Third, I briefly return to Aristotle's thoughts on the matter, which are a lodestone for the tradition. Fourth, I evaluate the positions of Jacques Maritain and Gabriel Marcel, the most important conciliar-era thinkers who thematized the relationship between problems and mysteries. My treatment will show how both ontological (Maritain) and existential (Marcel) dynamics of mystery are necessarily linked to metaphysical and spiritual problems. If the teaching of theology would invite students to embark upon the via inventionis and not merely yield to the via doctrinae, there must be fundamental advertence to ontological and existential problems as the theologically constitutive point of departure.1 Theologians do well to think in correlative terms of problems and mysteries. As a fifth and final point, then, I suggest that the quintessential starting point for (fundamental) theology today is the problem and mystery of the human person.Historical Context 1: The Return to MysteryContemporary Church life and theology have witnessed a "return to mystery."2 "Mystery" refers to some range or dynamic of reality that is essentially inaccessible apart from some feature of religious or spiritual practice. It is my intention in this paper to highlight the dangers which arise when people appeal to moral intuitions to settle questions in political, and in general in applied, philosophy. But first I want to ask why all or nearly all of us are in favour both of liberty and of equality – why all our intuitions are on their side. In the case of liberty it is easy to understand why. Although philosophers have held diverse theories about the concept (...) of liberty – theories which have been drawn together into two main groups in a famous lecture by Sir Isaiah Berlin – there cannot be much doubt that in the mind of the ordinary man to have liberty is to be under no constraint in doing what one wants to do. This, at any rate, is a main constituent of the concept of liberty as all of us understand it. Since, therefore, it seems self-evidently true that we want to be able to do what we want, we are bound to want liberty and, in general, to be in favour of it. We want it for ourselves; if we universalize our prescriptions, this constrains us to be in favour of it for others as well. That explains why, if any politician can claim that he is fighting for liberty, he is likely to win a large following. In the case of equality the matter is not so clear cut. (shrink)

Henberg GEORGE ELIOT'S MORAL REALISM No moment in the history of ethics could be more propitious than the present for a comprehensive restudy of George Eliot's moral realism. Analysis of the "logic" of moral language has proved barren, prescriptivism is in full flight, and schematic divisions of moral theories into descriptive versus normative, deontological versus teleological, or substantive versus meta-ethical have promised much but delivered little. Such (...) distinctions dominate maps to the modern moral terrain, but awanderer in the land ofchoice itselfstill finds himselfwithout signposts. A particularly unhealthy bias in contemporary ethics has been the belief that moral principles ought to withstand all counterexamples, however plausible or implausible, whether concocted from a sense of men's actual capacities or from a fondness for outrageous possibilities, many of them lifted from the pages of science fiction. If moral rules do not govern in hard cases, it is thought, they do not govern at all. Few philosophers have bothered to distinguish between the hard cases common to men's actual choices and the hard cases confronted by one man in a million or by the imagined inhabitants of some future world. (Witness, for example, the present preoccupation with "lifeboat ethics" and ask yourself how many actual moral choices are so starkly dramatic.) Any logically possible circumstance is too often assumed to qualify as a fruitful area for moral investigation; and any conceivable counterexample, achieved by whatever stretch of the imagination, is assumed to be fair ammunition in the debate over principles. Closely related to this first bad tendency in modern philosophical ethics is another, equally bad. Too often the examples used are of little moral significance, obviously conceived to make a point rather than to direct attention to commonplace but nonetheless important circumstances where informed choice is essential. Philosophy journals have treated us to discussions about whether failing to wear tennis whites is or is not "rude" and about whether a first sinner's crossing of a patch of lawn does or does not have a "threshold-related effect" 20 M. C. Henberg21 which must be considered in assessing later consequences (a bare path ultimately worn in the grass). Such examples rightly earn a contemptuous snort from anyone who expects philosophy to increase our understanding in matters of serious consequence. Whatever her other accomplishments as a moralist and philosophical thinker, George Eliot never commits either of the preceding crimes. Her moral realism constitutes first and foremost an ethics aimed at the bulk of her fellow men. She yields to the theoretic impulse solely in criticizing other theories. When it comes to providing answers, she depicts fictional characters whose struggles, failings, and passions are ultimately akin to what we ourselves are likely to experience. Her ethical precepts are not aimed at proving themselves in every conceivable situation. They are instead precepts which are sometimes susceptible to ruin, just as are the changeable creatures who profess them. To know the natural boundaries of a moral rule, Eliot tells us, is as difficult and important as knowing the rule itself. Moral realism requires a combination of clear-eyed perception and imaginative sympathy—faculties ill-served by lectures on abstract principles. Eliot reminds us that our best moral judgments must be "checked and enlightened by a perpetual reference to the special circumstances that mark the individual lot" (The Mill on the Floss, Book VII, chap. 3). This emphasis in particular—found both in her early essays and early fiction—makes Eliot's moral realism a welcome anodyne to the worst tendencies of modern ethics. The discussion which follows will be confined to early works, including Scenes of Clerical Life, Adam Bede, and The Mill on the Floss. The ruminations of her authorial voice in these novels may conveniently be juxtaposed with her essays, for the works are near to one another both temporally and thematically. Later novels such as Middlemarch and Daniel Deronda—however interesting from an ethical perspective— do not lend themselves to this mode of analysis. To what extent Eliot's views are modified in these later novels constitutes a separate topic whose omission here does not reflect upon its intrinsic interest or importance. Relativistic mean field theory with mesons σ, ω, π and ρ mediating interactions and nucleons as basic fermions has been very successful in describing nuclear matter and finite nuclei. However, in heavy-ion collisions, where the c. m. energy of two colliding nucleons will be in the hundreds of GeV region, nucleons are not expected to behave as point-like particles. Analyses of elastic pp and ¯pp scattering data in the relevant c. m. energy range show that the nucleon is a composite (...) object—a topological soliton or Skyrmion embedded in a condensed quark-antiquark ground state. Against this backdrop, we formulate an effective field theory model of nuclear matter based on the gauged linear σ-model where quarks are the basic fermions, but the mesons still mediate the interactions. The model describes the nucleon as a Skyrmion and produces a q¯q ground state analogous to a superconducting ground state. Quarks are quasi-particles in this ground state. When the temperature exceeds a critical value, the scalar field in the ground state vanishes, quarks become massless, and a chiral phase transition occurs leading to chiral symmetry restoration. We explore the possibility of a first order phase transition in this model by introducing suitable self-interactions of the scalar field. B. The Court also upheld the Missouri statute's provision requiring a. doctor to perform viability tests before aborting a fetus the doctor believes is of 20 or more weeks gestational age. In the plurality opinion (of less precedential value than an opinion -0f the Court, since it is not joined by a majority of the justices), Chief Justice Rehnquist, Justice White, and Justice Kennedy argued that since most fetuses are not viable at twenty weeks, the provision would impose substantial restrictions unrelated to the health of the mother upon what are, in fact, simply sec-0nd trimester abortions. Because they believed such restrictions to be in tension with Roe's trimester system, the plurality decided to abandon that system, along with its stipulation that the state's interest in unborn life became compelling only at viability. The plurality contended, however, that Webster presented no occasion for reconsidering Roe's holding, which deemed unconstitutional a statute prohibiting all abortions except those necessary to save the life of the mother. In a concurring opinion, Justice Scalia went further, arguing that the Court should explicitly overrule Roe v. Wade. On the other hand, Justice O'Connor, 848 344 M. CAT'HLEEN KAVENY dieted that this would exaicerbate a dangerously bitter social·struggle. In its 1973 decision Roe v. Yet important 1as this issue is, thorough ethicaJ ana:lysis of Webster must address severa1l additional fac~ tors. The ethiicatl aidequacy of positive law, induding judicial interpretations of faw siuch as Webster, must he ev1alruated in terms of whetheir it aidvanices or impedes the common good. The common good requires not only that we consider the moml substance of legal requirements but tha:t we ailso attend to the manner in which law is made, promulgated, ml!d interpreted. Such an analysis is,sorely needed; it should. specify the severa1l factors involved in determining whether any given legal also concurring in the plurality's judgment, maintained that this provision of the statute could be upheld without any reconsideration of Roe, since it co· hered with that decision's recognition of the compelling state interest in viable fetal life. C. Justice Blackmun authored an opinion dissenting from the majority on the issues discussed above, and he was joined by Justices Brennan and Mar· shall. The thrust of his opposition is directed against the plurality's treatment of the viability testing,provisions. If T has only countably many complete types, yet has a type of infinite multiplicity then there is a c.c.c. forcing notion Q such that, in any Q-generic extension of the universe, there are non-isomorphic models M 1 and M 2 of T that can be forced isomorphic by a c.c.c. forcing. We give examples showing that the hypothesis on the number of complete types is necessary and what happens if `c.c.c.' is replaced by other cardinal-preserving adjectives. The great Franciscan theologian St. Bonaventure engaged in philosophy as well as theology, and the relation between the two in Bonaventure's work has long been debated. Yet, few studies have been devoted to Bonaventure's thought as a whole. In this survey, Christopher M. Cullen reveals Bonaventure as a great synthesizer, whose system of thought bridged the gap between theology and philosophy. Was there a second legion in Palestine at all ? Mommsen has raised a doubt. In his note on C.I.L. iii 6641 ‘M. Iunio Maximo Leg. Augg. Leg. X Fr….’ he says ‘Quo tempore titulus positus est provinciam Palaestinam una sola legio obtinuerit necesse est X Fretensis; nam Augustorum vocabulum legatis legionis non solet addi nisi simul provinciae praesunt. Legio VI Ferrata quamquam a Dione in Iudaea collocatur, vide ne castra habuerit in Batanaea quae fuit sub legato Syriae Phoenices.’ On (...) C.I.L. iii 6703 similarly he says ‘legatus legionis Augusti vocabulum raro adsumit’ But the title ‘leg. Aug.’ does seem to be used with sufficient frequency of a simple ‘legatus legionis’ to invalidate Mommsen's argument: e.g. Dessau 1026 ‘leg. Aug. leg. xi C. p. f.’; 1036, 1055, 1070, 1141 etc: and the soldiers of Capitolias might just as easily have served across the border in Palestine. Zangemeister, who first published the inscription of Iunius Maximus {Zeitschrift des deutschen Palästina-Vereins x 1887, 49–53) took the same view as Mommsen, that he was the provincial legatus; but later he admitted that in that case the words ‘pro praetore’ would have been added.
