This textbook by Martin Hollis offers an exceptionally clear and concise introduction to the philosophy of social science. It examines questions which give rise to fundamental philosophical issues. Are social structures better conceived of as systems of laws and forces, or as webs of meanings and practices? Is social action better viewed as rational behaviour, or as self-expression? By exploring such questions, the reader is led to reflect upon the nature of scientific method in social science. Recently two distinct forms of rule-utilitarianism have been introduced that differ on how to measure the consequences of rules. Brad Hooker advocates fixed-rate rule-utilitarianism, while Michael Ridge advocates variable-rate rule-utilitarianism. I argue that both of these are inferior to a new proposal, optimum-rate rule-utilitarianism. According to optimum-rate rule-utilitarianism, an ideal code is the code whose optimum acceptance level is no lower than that of any alternative code. I then argue that all three forms of rule-utilitarianism fall prey to two fatal (...) problems that leave us without any viable form of rule-utilitarianism. (shrink)

I argue for two main points in historiography of physics regarding the significance of Du Châtelet's Foundations of Physics in the development of mechanics. The first is that, despite Du Châtelet calling it a textbook in the Preface, it should not be understood as 'merely' a textbook. Instead, it fits in a tradition of women involved in natural philosophy in that era using liminal publication opportunities, and to reduce some of the resistance to their publication. Even these liminal opportunities were (...) rare and mostly available to women of very high social standing and wealth, who also happened to have supportive families or spouses, and were usually associated with some other well-known male thinker. The second point is that, even if we treat Foundations as a textbook, the way in which it synthesizes and refines work by Newton, Leibniz, Descartes, and others, meets the criteria given by Kuhn for the establishment of a first paradigm, which is not complete without such a definitive statement that enables the mop-up work characteristic of normal science. I conclude that by Kuhn's own criteria, he ought to have identified Du Châtelet as a key part of establishing the first paradigm in physics. She blazed a trail for others to follow. (shrink)

What should we do if we cannot figure what morality requires of us? Holly M. Smith argues that the best moral codes solve this problem by offering two tiers, one of which tells us what makes acts right and wrong, and the other of which provides user-friendly decision guides. She opens a path towards resolving a deep problem of moral life.

Patterns and pattern ontologies are a powerful way for pragmatists to address metaphysical issues by rejecting a false dichotomy between pluralism and realism. However, there is a common misconception about patterns that I call the philosophically perverse patterns (PPP) problem. Here, critics of patterns invent perverse examples that meet the metaphysical criteria to count as patterns. I defuse this concern by showing how PPP misunderstands what the pragmatist metaphysics of patterns is supposed to accomplish: the bare definition should not rule (...) out, or in, substantive examples of patterns that instead should involve methodological considerations. I use this response to the PPP problem to show how the metaphysical definition of 'pattern' allows the pragmatist to capture the rich intricacies of ontologies in the sciences and yields two illustrative norms by which methodology can be guided in developing or refining ontologies: cohesion and coherence. Within the cognitive sciences, most researchers assume that it is the job of linguists to investigate how language is represented, and that they do so largely by building theories based on explicit judgments about patterns of acceptability – whereas it is the task of psychologists to determine how language is processed, and that in doing so, they do not typically question the linguists' representational assumptions. We challenge this division of labor by arguing that structural priming provides an implicit method of (...) investigating linguistic representations that should end the current reliance on acceptability judgments. Moreover, structural priming has now reached sufficient methodological maturity to provide substantial evidence about such representations. We argue that evidence from speakers' tendency to repeat their own and others' structural choices supports a linguistic architecture involving a single shallow level of syntax connected to a semantic level containing information about quantification, thematic relations, and information structure, as well as to a phonological level. Many of the linguistic distinctions often used to support complex (or multilevel) syntactic structure are instead captured by semantics; however, the syntactic level includes some specification of “missing” elements that are not realized at the phonological level. We also show that structural priming provides evidence about the consistency of representations across languages and about language development. In sum, we propose that structural priming provides a new basis for understanding the nature of language. (shrink)

The revised Common Rule includes a new option for the conduct of secondary research with identifiable data and biospecimens: regulatory broad consent. Motivated by concerns regarding autonomy and trust in the research enterprise, regulators had initially proposed broad consent in a manner that would have rendered it the exclusive approach to secondary research with all biospecimens, regardless of identifiability. Based on public comments from both researchers and patients concerned that this approach would hinder important medical advances, however, regulators decided to (...) largely preserve the status quo approach to secondary research with biospecimens and data. The Final Rule therefore allows such research to proceed without specific informed consent in a number of circumstances, but it also offers regulatory broad consent as a new, optional pathway for secondary research with identifiable data and biospecimens. In this article, we describe the parameters of regulatory broad consent under the new rule, explain why researchers and research institutions are unlikely to utilize it, outline recommendations for regulatory broad consent issued by the Secretary's Advisory Committee on Human Research Protections, and sketch an empirical research agenda for the sorts of questions about regulatory broad consent that remain to be answered as the research community embarks on Final Rule implementation. With growth in the quantity of business ethics journals in recent years, assessments of journal quality are helpful to ethics researchers and administrators, as researchers consider available publication venues, and administrators consider the value of faculty research. The few published evaluations of business ethics journals have predominantly utilized two methods of journal quality determination: citation analysis and surveys of active researchers. This study employs a novel method to assess business ethics journals: 83 Association to Advance Collegiate Schools of Business business (...) schools provided their internally developed journal lists that were used to evaluate faculty research, and the submitted lists were then analyzed for the presence and assessment of business ethics journals. This analysis yielded a ranking of 24 business-ethics-centric journals, and this ranking reflects the collective judgments of AACSB business school faculties. The results of this study are pragmatic in that the journal evaluation data employed metrics actually used by business schools to determine the quality of business ethics journals. These findings also provide additional impetus for the recognition of business ethics as a distinct business discipline and business ethics research as a unique field of scholarly endeavor. While studies of business ethics may be influential when they are published in non-BEC journals, such studies may be more powerfully impactful when published in BEC journals. (shrink)

Although justice is a central principle in clinical ethics, work that centers social justice is often marginalized in clinical ethics. In addition to institutional barriers that may be preventing clinical ethicists from becoming the activists that Meyers argues we should be, we must also recognize the barriers embedded in the field of clinical ethics itself. As clinical ethicists, we have an opportunity to support anti‐racism work in particular by altering our own organizational structures to be more inclusive and reflective of (...) the Black, Indigenous, and other communities of color we serve, enhancing clinical ethics education and training by making critical theories foundational, and decolonizing our clinical ethics consultation tools and practices. Did Adam and Eve act rationally in eating the fruit of the forbidden tree? That can seem to depend solely on whether they had found the best means to their ends, in the spirit of the 'economic' theories of rationality. In this 1995 book, Martin Hollis respects the elegance and power of these theories but judges their paradoxes endemic. He argues that social action cannot be understood by viewing human beings as abstract individuals with preferences in search of satisfaction, nor (...) by divorcing practical reason from questions of the rationality of norms, principles, practices and ends. Institutional Review Boards have substantial power and authority over research with human subjects, and in turn, their decisions have substantial implications for those subjects, investigators, and the public at large. However, there is little transparency about IRB processes and decisions. This article provides the first comprehensive taxonomy of what transparency means for IRBs — answering the questions “to whom, about what, and by what mechanisms?” It also explains why the status quo of nontransparency is problematic, and presents arguments for greater (...) transparency from the perspective of a variety of stakeholders. IRB transparency will make boards more accountable, improve the quality of their decision-making, facilitate consistency in board decisions, permit empirical study of IRBs, promote research efficiency, and advance trust in the research enterprise, among a variety of other benefits. Regulators should promote IRB transparency, IRBs themselves should commit to sharing as much information as they can within the confines of confidentiality requirements, and investigators can endeavor to take matters into their own hands by sharing IRB correspondence and IRB-approved protocols and consent materials. Structural priming offers a powerful method for experimentally investigating the mental representation of linguistic structure. We clarify the nature of our proposal, justify the versatility of priming, consider alternative approaches, and discuss how our specific account can be extended to new questions as part of an interdisciplinary programme integrating linguistics and psychology as part of the cognitive sciences of language.

We use the U.S. Supreme Court’s decision in Citizens United v. Federal Election Commission to assess the reputational risks created by political investment opportunities that allow managers to spend unlimited and potentially undisclosed firm resources on independent political expenditures. This new opportunity raises important ethical questions, as it is difficult, and perhaps impossible, under current law for shareholders to hold managers accountable for this investment choice and the reputational risks it entails. Using firms’ known political activity as a proxy for (...) managers’ likely future use of independent political expenditures, we examine how market participants reacted to Citizens United, conditional on this prior activity and corporate governance attributes related to the concentration of decision rights in senior management and blockholders. The results of our analyses document that firms with both a high level of known political activity and CEO-chairperson of the board duality experienced negative abnormal returns in reaction to Citizens United. In contrast, firms with concentrated ownership experienced positive abnormal returns; however, as known political activity increased, investors discounted the benefits of concentrated ownership. These findings suggest that investors expect this expansion of firms’ political investment opportunities to amplify principal-agent problems inherent in corporate political activity. Additionally, our findings provide evidence for those deliberating the mandatory disclosure of firms’ investments in politics as a means of increasing managerial accountability to both shareholders and the public. Some philosophers hold that trust grows fragile when people become too rational. They advocate a retreat from reason and a return to local, traditional values. Others hold that truly rational people are both trusting and trustworthy. Everything hinges on what we mean by 'reason' and 'rational'. If these are understood in an egocentric, instrumental fashion, then they are indeed incompatible with trust. With the help of game theory, Martin Hollis argues against that narrow definition and in favour of a richer, (...) deeper notion of reason founded on reciprocity and the pursuit of the common good. Within that framework he reconstructs the Enlightenment idea of citizens of the world, rationally encountering, and at the same time finding their identity in, their multiple commitments to communities both local and universal. Pushing back on policies favored by dying patients is a challenging endeavor, requiring tact, engagement, openness to bidirectional learning, and willingness to offer alternative solutions. It's easy to make missteps, especially in the age of social media. Holly Fernandez Lynch shares her experience learning with and from the amyotrophic lateral sclerosis (ALS) community, first as a caricature of an ivory tower bioethicist and more recently as a trusted advisor, at least for some. Patient‐engaged bioethics doesn't mean taking the view (...) that patients are always right, but even when disagreement continues, progress is possible if academics and patients recognize the unique expertise each has to offer. Economics is probably the most subtle, precise and powerful of the social sciences and its theories have deep philosophical import. Yet the dominant alliance between economics and philosophy has long been cheerfully simple. This is the textbook alliance of neo-Classicism and Positivism, so crucial to the defence of orthodox economics against by now familiar objections. This is an unusual book and a deliberately controversial one. The authors cast doubt on assumptions which neo-Classicists often find too obvious to defend or, indeed, (...) to mention. They set out to disturb an influential concensus and to champion an unpopular cause. Although they go deeper into both philosophy and economics than is usual in interdisciplinary works, they start from first principles and the text is provokingly clear. This will be a stimulating book for all economic theorists and philosophers interested in the philosophy of science and social science. (shrink)

There is a simple joy in finding that the emperor has positively no clothes and especially when the finger is pointed in ribald good English. Donald McCloskey does this service in “The Rhetoric of Economics”, where he argues with force and wit that “modernism” (meaning, roughly, positivism, as in “Positive Economics”) will do as an account neither of what economists do nor of what it makes philosophical sense for them to attempt. Instead they should recognize that models are always metaphors (...) and should make a virtue of the literary devices, which they in fact rely on. Armed with the craft of rhetoric and a new “poetics of economics,” they will achieve better writing, better teaching, better foreign relations, better science and better dispositions. (shrink)

Two Greek myths attest to the power of music to blur distinctions between humans and nonhumans: Orpheus made music that inspired human-like attention in animals, trees, and stones, while the Sirens reduced passing sailors to the level of animals incapable of resisting their song. Recast in terms employed by Lacan, these myths portray music as calling forth a response in creatures thought merely able to react and, contrariwise, stripping away the capacity for response in humans, leaving nothing but reaction in (...) its place. Critiquing Lacan’s dogmatic distinction between human and animal behavior, Derrida questioned the “purity and indivisibility” of reaction and response and recommended that critics explore the involvement of both in “the whole differentiated field of experience and of a world of life-forms.” In this essay, I take up Derrida’s challenge with regard to music as it has been understood in the European aesthetic tradition. While music has long been considered capable of provoking highly refined cognitive and emotional responses, it also acts upon the body in a wide variety of ways, many of them involuntary – a fact that has struck music’s advocates as alternately promising and disturbing. Revisiting eighteenth- and nineteenth-century commentaries by the philosophers and critics Johann Georg Sulzer, Johann Gottfried Herder, and Eduard Hanslick, I first illuminate persistent anxieties over the admixture of reaction and response in musical listening. I then turn to recent ethological studies in order to argue against any decisive separation of the human from the nonhuman in the arena of musical aesthetics. (shrink)

Geoengineering has been broadly and helpfully defined as “the intentional manipulation of the earth's climate to counteract anthropogenic climate change or its warming effects” (Corner and Pidgeon , 26). Although there exists a rapidly growing literature on the ethics of geoengineering, very little has been written about its gender dimensions. The authors consider four contexts in which geoengineering appears to have important gender dimensions: (1) the demographics of those pushing the current agenda, (2) the overall vision of control it involves, (...) (3) the design of the particular technologies, and (4) whom geoengineering will most affect and benefit. After detailing these four gender dimensions, we consider three ways in which the geoengineering discourse could be enriched if it became more sensitive to issues of gender. These include increasing the focus on the concrete other, recognizing the socially transformative potential of geoengineering technologies, and engaging in value-sensitive design. Although ultimately remaining agnostic on the desirability of geoengineering, the paper brings gender considerations into a discussion from which they have been conspicuously absent. (shrink)

Antibiotic resistance presents a classic example of the “tragedy of the commons.” In this eponymous tragedy, the commons — shared, public access lands — are overgrazed because farmers can send their livestock onto the land at a zero price. The “tragedy” occurs because overgrazing destroys the land and reduces its ability to provide fodder. The application to antibiotics is obvious: the use of antibiotics creates selection pressure leading to increased proportions of resistant bacteria in the patient and the environment. The (...) increase in frequency of resistant organisms diminishes the effectiveness of antibiotics in treating future infections; thus, the long-term value of the antimicrobial resource is reduced. In Living with Uncertainty Michael Zimmerman argues against the Objective view and for the Prospective view of morality. He claims that the conscientious agent would always choose the act that maximizes projected value, and that this is incompatible with Objectivism. Peter Graham defends Objectivism against Zimmerman’s attack. He argues that a conscientious agent must balance fulfilling obligations against avoiding the worst wrong-doings, and that this stance is consistent with Objectivism and with the agent’s choosing an act she believes to be (...) Objectively wrong. In Ignorance and Moral Obligation Zimmerman argues that Graham’s “Objectivism” is only terminologically distinct from his Prospectivism. I argue that Graham faces a dilemma: if his theory delivers different prescriptions from Zimmerman’s, those prescriptions are implausible. On the other hand, if his theory avoids such implausible recommendations, it now generates exactly the same recommendations as Zimmerman’s theory, and so does not constitute a serious challenge to it. This article uses the methods that Locke advocated in his Essay Concerning Human Understanding to evaluate manuscript evidence from five different schemes and two drafts of the Fundamental Constitutions of Carolina, to thereby determine what role, if any, John Locke had in writing it, and in advocating for slavery and absolutism. It focuses on the influential claims put forward by David Armitage 20 years ago, that Locke was responsible for actively promoting slavery in Carolina’s Fundamental Constitutions. It enables the reader (...) to view, and judge, the relevant evidence. The author concludes, and invites the reader to conclude, that Armitage’s main claims lack foundation in the manuscript evidence. That evidence instead points towards the legal power of those who owned Carolina, the Lords Proprietors, and to the crown, which granted Carolina’s charter, and to the logic of a different theory of government, patriarchalism, for the rationale behind both slavery and absolutism. The central ideas behind slavery and colonization were epitomized, as Locke understood, by Sir Robert Filmer, who wrote the book to which Locke responded in his Two Treatises of Government. Filmer’s ally, Sir Henry Spelman, like Filmer a deeply committed royalist who believed in the king’s unlimited prerogatives, composed the original 1629 Carolina charter that shaped the Fundamental Constitutions. Misattributing the authorship of particular clauses to Locke is a symptom of a larger failure to distinguish the impact of momentous debates over authority and race in the seventeenth century. Locke’s theories did, in practice as well as principle, reject the theory of domination put forward by Filmer, and argued instead for human rights and democracy that were inclusive and capacious. The manuscript evidence has the potential to reshape how modern democratic theory is understood in the present. (shrink)
