The study of law and information technology comes with an inherent contradiction in that while technology develops rapidly and embraces notions such as internationalization and globalization, traditional law, for the most part, can be slow to react to technological developments and is also predominantly confined to national borders. However, the notion of the rule of law defies the phenomenon of law being bound to national borders and enjoys global recognition. However, a serious threat to the rule of law is looming (...) in the form of an assault by technological developments within artificial intelligence (AI). As large strides are made in the academic discipline of AI, this technology is starting to make its way into digital decision-making systems and is in effect replacing human decision-makers. A prime example of this development is the use of AI to assist judges in making judicial decisions. However, in many circumstances this technology is a ‘black box’ due mainly to its complexity but also because it is protected by law. This lack of transparency and the diminished ability to understand the operation of these systems increasingly being used by the structures of governance is challenging traditional notions underpinning the rule of law. This is especially so in relation to concepts especially associated with the rule of law, such as transparency, fairness and explainability. This article examines the technology of AI in relation to the rule of law, highlighting the rule of law as a mechanism for human flourishing. It investigates the extent to which the rule of law is being diminished as AI is becoming entrenched within society and questions the extent to which it can survive in the technocratic society. The restructuring of global capital and computer-mediated work leads to unemployment, underemployment, decreasingly skilled work, and relatively lower wages. In the 1970s, an estimated 38 million jobs were destroyed because of the decline in both manufacturing and nonmanufacturing sectors—a direct result of plant, store, and office shutdowns. Sci-tech transformations of the labor process have disrupted the workplace and worker’s community and culture, causing a proliferation of part-time and temporary jobs (...) that displaces permanent regular jobs. Computerized machines employ very little direct labor because control over it is now built into the machines by computer processes such as numerical controls, lasers, and robotics. S. Pockett and G. Gomes discuss a possible bias in the method by which Libet's subjects estimated the time at which they became aware of their intent to move their hands. The bias, caused by sensory delay processing the clock information, would be sufficient to alter Trevena and Miller's conclusions regarding the timing of the lateralized readiness potential. I show that the flash-lag effect would compensate for that bias. In the last part of my commentary I note that the other (...) target articles do not examine the most interesting aspect of Libet's unfashionable views on free will. Ralph Rader's model of literary activity is built up from a theory of intention. A literary work, he believes, embodies a "cognitive act,"1 an act variously characterized as a "positive constructive intention" , "an overall creative intention" . To read a literary work is to perform an answering "act of cognition" , which is in effect the comprehension of this comprehensive intention, the assigning to the work of a "single coherent meaning" . Both acts—the embodying and the assigning —are one-time, (...) single-shot performances. They are "ends" in two senses; the overall intention is the end to which everything in the work must be contributory, and its comprehension is something the reader does at the end . Rader offers this model as if it were descriptive, as if it made explicit rules of behavior we unerringly follow, rules which underlie our "tacit or intuitive capacity" of intention producing and intention retrieving; but the model is, in fact, prescriptive since it quite arbitrarily limits this same capacity: authors are limited to no more than one positive constructive intention per unit, while readers or interpreters are limited to its discovery; whatever cannot be related to that discovery or interferes with it will either be declared not to exist or, if its existence cannot be denied, it will be labeled a defect, an "unintended and unavoidable negative consequence of the artist's positive constructive intention" . · 1. After a Guatemalan migrant worker living in northern California was killed by a hit-and-run driver while crossing a highway one night, his family requested that his body be sent back to his native village in southwestern Guatemala to be mourned and buried according to traditional Catholic custom. But the County morgue confused this deceased individual with another Latino and cremated his body before it could be shipped. This article analyzes the cultural, psychological and economic ramifications of this accidental cremation. Although (...) permissible within the Catholic Church, the cremation caused enormous suffering to the family of the deceased as well as to the dead man's soul. The paradox that individually rational actions collectively can lead to irrational outcomes is exemplified in human appropriation of a class of goods known as "common-pool resources" : natural or humanly created resource systems which are large enough to make it costly to exclude potential beneficiaries. Appropriations of common-pool resources for private use tend toward abusive practices that lead to the loss of the resource in question: the tragedy of thecommons. Prescriptions for escape from tragedy have involved two institutions, each applied (...) largely in isolation from the other: private markets and government coercion . Yet examples exist of local institutions that have utilized mixtures of public and private practices and have survived for hundreds of years.Two problems further exacerbate efforts to avoid the tragic nature of common-pool resource use. One, given the current level of knowledge, the role of the resource is not recognized for what it is. It is, thus, in a fundamental, epistemological sense invisible. Two, if the resource is recognized, it may not be considered scarce, thus placing it outside the scrutiny of economic theory. Both types of error are addressed by the emerging field of ecological economics.This paper discusses common pool resources, locates the ambiguities that make their identification difficult, and argues that avoidance of a CPR loss is inadequately addressed by sharply separated market and state institutions. When the resource is recognized for what it is, a common-pool good, which is subject to overexploitation, it may be possible to identify creative combinations of public and private institutions that can combine to save that resource. Disparate examples of self-organized enterprises, public/private utilities, and "green" taxes, to name a few, provide empirical content for developing theories of self-organized collective action. The target article's use of core concepts is confused and excessively broad. Two main types of experiences have been described in relation to shamanism: magical flight and mediumship/possession. The first refers to visual and remembered experiences of events in other realms, the second to embodied experiences of ceding mental control and personality to a preternatural entity. These experiences grossly correspond to two main experience modalities exhibited by highly hypnotizable individuals in a secular setting.

Contemporary U.S. policy makers often characterize the U.S. counterinsurgency experience in El Salvador as a successful model to be followed in other contexts. This article argues that these characterizations significantly overstate the positive lessons of El Salvador, and ignore important cautionary implications. During the first part of the conflict, neither the Armed Forces of El Salvador nor the U.S. followed the tenets of counterinsurgency doctrine. The FAES killed tens of thousands of non-combatants in 1979 and 1980, before the civil war (...) even began. This repression may have preempted an incipient popular insurrection, but it also locked in a determined social base that enabled the armed left to build a highly effective and sustained insurgency. In 1984, the U.S. had to save the FAES from likely defeat through a major increase in military aid, especially airpower. When the Farabundo Martí National Liberation Front switched to a classical guerrilla strategy, the FAES, despite considerable U.S. aid, seldom followed best practices in counterinsurgency. Democratization and redistributional reforms were partial and flawed in implementation. The war settled into a stalemate that would likely have continued indefinitely had it not been for the collapse of the socialist bloc and significant changes in the interests of Salvadoran elites that were largely incidental to U.S. policies.The most important cautionary lesson is that indiscriminate violence against civilians early in a conflict can create dynamics that are very difficult to overcome in subsequent stages.
