This paper takes an ontological approach to the subject of promising. Setting aside the typical concern over promissory obligations, I draw on recent work from the field of social ontology and develop a promissory schema that characterizes the functional role the practice of promising plays in our lives. This schema, put in terms of one agent’s voluntary and intentional attempts to provide another agent with a specific kind of assurance, helps explain what we are doing when we make a promise, (...) and what we desire when we ask that a promise be made. The promissory schema is explanatorily beneficial as it can help us understand why certain actions may be interpreted as promises, thereby reminding us that we need to be sensitive to the ways our actions can give rise to expectations in others. This book addresses the retributive and "orthodox subjectivist" theories that dominate criminal justice theory alongside recent "revisionist" and "postmodern" approaches. Norrie argues that all these approaches, together with their faults and contradictions, stem from their orientation to themes in Kantian moral philosophy. He explores an alternative relational or dialectical approach; examines the work of Ashworth, Duff, Fletcher, Moore, Smith, and Williams; and considers key doctrinal issues.

It is commonly recognized that Jean-Luc Nancy’s efforts to elaborate a conception of ‘the political’ are based upon Heidegger’s thinking of die Tecknik , even as they seek to overcome the difficulties that beset Heidegger’s own politics. But few have noted that Nancy also seeks to critically engage Carl Schmitt’s conception of das Politische , according to which there is a metaphysical and practical need for a sovereign decision on friends and enemies if effective political community and law are to (...) be possible. This article argues that recognizing that Nancy seeks to overcome Schmitt’s conception of the political throws into high relief his failure to address the actual subject matter of politics. We invited five Cavell scholars to write on this topic. What follows is a vibrant exchange among Paola Marrati, Andrew Norris, Jörg Volbers, Cary Wolfe and Thomas Dumm addressing the question whether, in the contemporary political context, Cavell’s skepticism and his Emersonian perfectionism amount to a politics at all.

W. Norris Clarke's metaphysics of the universe as a journey rests on six major positions: the unrestricted dynamism of the mind, the primacy of the act of existence, the participation structure of reality, and the person, considered as both the starting point of philosophy and the source of the categories needed for a flexible contemporary metaphysics. Reflecting on his conscious life and the universe around him, the finite person mounts by a two-fold path to its Infinite source, who, though (...) immutable in His natural being, is mutable in the intentional being of His personal knowledge and love. The personal God is the efficient cause from whom the universe comes and the final cause to whom it returns.Less optimistic than Norris Clarke, John Caputo wonders about his metaphysics of the person. In a hermeneutical interpretation of the human face, the person through whom Being "sounds" discloses an ambiguous Being that both reveals and conceals itself. Far from grounding a casual ascent to God, hermeneutical phenomenology allows us no more than the right to interpret the world and its transcendent source through our own free decision.Although impressed by Norris Clarke's attempt to introduce mutability into God, Lewis Ford still finds Clarke's Thomistic God unacceptable. As a Whiteheadian, he proposes in place of Thomas' God, whose perfection consists in static unity, a God whose perfection consists in a never-ending process of unification. John Smith argues against the traditional dichotomy made between the ontological and cosmological arguments. Rather than opposed methods of proving God's existence, they should be taken as complementary journeys to the divine presence which discloses itself, although diversely, in the soul and in the world. There are parallels between Smith's historical study of two arguments and Clarke's two-fold path to God. Yet Smith is critical of Thomas' cosmological journey to God and does not share Clarke's confidence in its validity. Significant studies in their own right, the three essays as a group challenge Clarke's whole metaphysics of the universe as a journey. We show in this paper that some expressions indicating source of evidence are part of propositional content and are best analyzed as special kind of epistemic modal. Our evidence comes from the Japanese evidential system. We consider six evidentials in Japanese, showing that they can be embedded in conditionals and under modals and that their properties with respect to modal subordination are similar to those of ordinary modals. We show that these facts are difficult for existing theories of evidentials, which (...) assign evidentials necessarily widest scope, to explain. We then provide an analysis using a logical system designed to account for evidential reasoning; this logic is the first developed system of probabilistic dynamic predicate logic. : In the Aristotelian tradition, politics is a matter of public deliberation over questions of justice and injustice. The Bush administration's response to the terrorist attacks of September 11, 2001, has been uniformly hostile to this notion, and it has instead promoted a jingoistic politics of self‐assertion by an America largely identified with the executive branch of its government. This is doubly disturbing, as the executive branch has sought to free itself from international law, multinational commitments, and domestic judicial regulation, (...) even as it has sought to validate itself by demonizing its enemies. This essay draws out the disturbing echoes here of Carl Schmitt's work of the 1920s, in particular of Schmitt's conception of the sovereign as the ungrounded ground of the law and the political as the site of mortal conflict between friend and enemy. The essay argues that Schmitt's position in the twenties, for all of its evident problems, is superior to that of Bush, Wolfowitz, and Ashcroft in at least two senses: Schmitt condemns the idea of waging war for profit and recognizes that such wars will often be disguised as moral crusades waged against the “inhuman”; and he acknowledges that claiming to fight a war for humanity denies one's enemies their humanity, leaving them open to torture and even extermination. Metaphysicians go on busily doing metaphysical thinking all over the world, and apparently with a modicum of self-assurance that they are not talking nonsense or pursuing an illusory will-of-the-wisp. Yet other philosophers of empirical, analytical, phenomenological, or other turns of mind seem to have more and more difficulty in understanding just how metaphysicians give meaning and positive content to the vast abstract concepts by which they seek to describe and explain the entire spectrum of reality extending far beyond present or (...) perhaps even possible human experience. Since there is no way of gaining direct insight into dimensions of reality beyond human experience, and since in order to be applied to the whole range of reality these concepts must abstract from purely human experience, it is hard for them to see—and it is a serious problem in itself—how these all-embracing terms can be anything more than empty, formal, verbal symbols or conceptual constructions, with no positive existential content describing reality itself across its whole spectrum. Even the metaphysician himself, though when left alone he may have a sure sense of how to do metaphysical thinking fruitfully, when questioned to explain and justify what he is doing, and is convinced is worth doing, can feel embarrassed and struck dumb as to how to articulate and justify the principles behind the procedures he is following. Hilary Putnam has famously undergone some radical changes of mind with regard to the issue of scientific realism and its wider epistemological bearings. In this paper I defend the arguments put forward by early Putnam in his essays on the causal theory of reference as applied to natural-kind terms, despite his own later view that those arguments amounted to a form of 'metaphysical' realism which could not be sustained against various lines of sceptical attack. I discuss some of the reasons (...) for Putnam's retreat, first to the theory of 'internal (or framework-relative) realism proposed in his middle-period writings, and then to a commonsensepragmatist stance which claims to resituate this whole discussion on ground that has not been trorldden into ruts by the contending philosophical schools. In particular I examine his protracted engagement with various forms of anti-realist doctrine (Michael Dummett's most prominent among them), with Wittgenstein's thinking about language-games or meaning-as-use, and with a range of sceptical- relativist positions adopted in the wake of Quine's influential attack on the two last 'dogmas' of logical empiricism. My paper seeks to show that Putnam has been over-impressed by some of the arguments — from these and other sources — which he takes to constitute a knock-down case against the kind of extemalist and causal-realist approach developed in his early essays. It concludes by re-stating that position in summary form and relating it to other, more recent defences of causal realism in epistemology and philosophy of science. (shrink)
