This paper reflects on the problem of endowing Artificial Intelligence with legal subjectivity, especially with regard to civil law. It is necessary to reject the myth that the criteria of legal subjectivity are sentience and reason. Arguing that AI may have potential legal subjectivity based on an analogy to animals or juristic persons suggests the existence of a single hierarchy or sequence of entities, organized according to their degree of similarity to human beings; also, that the place of an entity (...) in this hierarchy determines the scope of subjectivity attributed to it. Rather, it is participation or presence in social life, whatever the role, that is the true criterion of subjectivity. In addition, it is clear that even if AI is not currently a significant participant in social life, it will be in the nearest future. Despite the potential dangers associated with endowing AI with some kind of subjectivity, such a course is inescapable, and should be considered sooner rather than later. (shrink)

This article probes the usefulness of selected theories from Cognitive Linguistics in the context of statutory interpretation. The presumption of legal language is a well-established rule of statutory construction in Polish legal practice that comes from the internationally recognised theory by Jerzy Wróblewski. It rests on a controversial assumption that there are different levels of generality in legal language (i.e. the language of statutes) and a single term may be given different meanings depending on the level of generality that is (...) referred to. The authors use the notion of basic level categorisation from the cognitive theory of prototypes to explain this mechanism. Legal concepts, not unlike ordinary concepts, form hierarchical taxonomies. A single term may denote concepts that are situated at different levels in different conceptual taxonomies. In the absence of special circumstances, a legal term should be given the meaning that resides at a higher level of categorisation in the respective legal taxonomy. This way, the presumption of legal language is found to be justified on both linguistic and psychological grounds. (shrink)

It is a (...) masterful achievement by Michael Hunter and Ted Davis, informed as it is by a total of approximately forty years of experience with the Boyle archive housed at the Royal Society of London. What began in 1980 as an attempt to catalogue the archive has led to this new, and most welcome, edition—one that includes not only Boyle's published work, but also two volumes of previously unpublished archival material. Despite its many defects, Birch's 1772 edition, in its reprint of edition of 1965 , has been popular with scholars living far from access to large collections of seventeenth-century works. Implications of the Level of Dogmatism and Selected Psychosocial Conditions for a Propensity for Risky Behaviour among the Soldiers of the Polish Army Land Forces The article presents the results of a study concerning a propensity for risky behaviour, conducted on regular soldiers of the Polish Army Land Forces. Its aim was to verify whether a level of dogmatism and selected psychosocial conditions were related to a propensity for risky behaviour among the soldiers. The research partially confirmed the hypothesis of (...) psychosocial determinants of a propensity for such behaviour. Young and shortserving soldiers appeared to be more inclined to undertake risky behaviour than older and long-serving ones. A tendency to avoid risky behaviour was displayed by soldiers from small towns as compared to groups of respondents from larger towns. The results of the research did not indicate a significant relationship between the propensity for risky behaviour and the level of dogmatism, education, personal corps, professional position. The article concentrates on the analysis of the Enlightenment periods vision of science by Josef Sołtykowicz. His theories are examples of philosophical reflection of the Cracow Science Society. The starting point was the outline of the political and scientific situation from the second part of the XVII century to the first part of the XIX century also referring to the author’s biography. The main part of the article is the analysis of two Dissertations by Sołtykowicz published by the Cracow Science (...) Society their yearly publication, in 1818 and 1820. The following points were taken into account: The roots of the society’s activities, the relationship between science and faith, popularizing knowledge, criticism of Rousseau and anthropological analysis of the roots, of the negative view of knowledge. These theories are worth analysing, unfortunately so far the philosophical thought of the members of CSS, has not encouraged work on them as they deserved. At the same time we can expect that the work of the scientists from the CSS significantly impacted on the progress of the philosophical reflection in Cracow, and also the wider picture of modern polish scientific culture. When Robert Boyle returned from his studies abroad in 1644, he found an England splintered into religious sects, each claiming to have attained a uniquely true understanding of the Christian religion. While trying to formulate an appropriate response to these various claims to truth, Boyle first expressed his views on the limits of human understanding. ;The members of one of these sects, the Socinians, claimed, specifically, that human reason is the criterion against which alternative and conflicting interpretations of disputed scriptural (...) passages should be judged. During the 1650s, 1660s, and 1670s, arguments for the limits of human understanding evolved from being used to oppose Socinianism to being used to protect the mysteries of strict Calvinism from the rational scrutiny of its Anglican opponents. ;In 1681 Boyle developed and published his own arguments for the limits of human understanding, not in order to protect the mysteries of strict Calvinism from rational scrutiny, but instead to show that one cannot legitimately claim both that the mysteries of Christianity are "above reason" and that one has reached a uniquely correct understanding of those views. ;In "Robert Boyle and the Limits of Reason: A Study in the Relationship between Science and Religion in Seventeenth-Century England," I show that there is a close parallel between Boyle's views on the limits of human understanding in the context of theology and his views on the limits of understanding in the context of natural philosophy, and argue that Boyle's views on reason's limits affected his conception of the proper goals and methodology of the new natural philosophy. Further, I argue that Boyle's views on the limits of human understanding in the context of theology were logically prior to his views on reason's limits in the context of natural philosophy. Boyle believed that God, in creating human beings, deliberately limited reason's power and extent; it is this starting-point from which Boyle's arguments concerning the limits of reason's competence flow. The promise of genomic medicine lies in the opportunity to improve health outcomes via a personalized approach to management, grounded in genetic and genomic variation unique to an individual. However, disparities and inequities mar this remarkable landscape of genomic innovation. Prior efforts to understand these inequities have focused on populations for which genetic testing is relatively protocolized or where test utility varies greatly by ancestry groups, where equitable outcomes are more clearly defined. We therefore consider the current landscape of rare (...) disease genomics, in which diagnostic approaches vary widely and utility remains to be fully understood, and suggest a path forward: how ecosocial theory may be used to guide novel equity‐focused initiatives that incorporate illness narratives to improve population health. We present examples of narrative medicine in rare disease and reimagine the role this discipline may play in genomic sequencing studies, toward incorporation of the unique illness narrative into clinical genetics and genomics practice. Approaches that broaden the definitions of disease and of outcomes of interest will force the field to grapple with its racist history and begin to advance health equity and promote justice so that genomic medicine may truly deliver on its promise. The subject of agnosticism about the existence of God has emerged in many of the major conversations within analytic philosophy of religion, such as the debate on the nature of evidence for and against religious beliefs. In this article, I outline a map of the debate on agnosticism in religious epistemology—especially in relation to evidentialism—highlighting the significance of the problem of the ambiguity of evidence and connecting said problem to discussions of religious language and peer disagreement.

In this rich cultural history, Pamela Robertson Wojcik examines America's ambivalent and shifting attitude toward homelessness through a close study of film cycles from five distinct historical moments that show characters as unhomed and placeless, mobile rather than fixed: failing, resisting, or opting out of the mandate for a home of one's own. From the tramp films of the Silent Era to the Oscar-winning Nomadland in 2021, Wojcik shows how film cycles reveal a tension in the American imaginary between viewing (...) homelessness as, on the one hand, deviant or threatening, and, on the other, emblematic of freedom and independence. Blending social history with insights drawn from a complex array of films, both canonical and fringe, Wojcik effectively 'unhomes' dominant narratives that cast aspirations for success and social mobility as the focus of American cinema, reminding us that genres of precarity have been central to the American cinema (and American story) all along. Researchers have theoretically proposed that humans decode other individuals' emotions or elementary cognitive appraisals from particular sets of facial action units (AUs). However, only a few empirical studies have systematically tested the relationships between the decoding of emotions/appraisals and sets of AUs, and the results are mixed. Furthermore, the previous studies relied on facial expressions of actors and no study used spontaneous and dynamic facial expressions in naturalistic settings. We investigated this issue using video recordings of facial expressions filmed unobtrusively (...) in a real-life emotional situation, specifically loss of luggage at an airport. The AUs observed in the videos were annotated using the Facial Action Coding System. Male participants ( n = 98) were asked to decode emotions (e.g., anger) and appraisals (e.g., suddenness) from facial expressions. We explored the relationships between the emotion/appraisal decoding and AUs using stepwise multiple regression analyses. The results revealed that all the rated emotions and appraisals were associated with sets of AUs. The profiles of regression equations showed AUs both consistent and inconsistent with those in theoretical proposals. The results suggest that (1) the decoding of emotions and appraisals in facial expressions is implemented by the perception of set of AUs, and (2) the profiles of such AU sets could be different from previous theories. Atypical emotion interpretation has been widely reported in individuals with borderline personality disorder ; however, empirical studies reported mixed results so far. We suggest that discrepancies in observations of emotion interpretation by iBPD can be explained by biases related to their fear of rejection and abandonment, i.e., the three moral emotions of anger, disgust, and contempt. In this study, we hypothesized that iBPD would show a higher tendency to correctly interpret these three displays of social rejection and attribute more negative (...) valence. A total of 28 inpatient iBPDs and 28 healthy controls were asked to judge static and dynamic facial expressions in terms of emotions, valence, and self-reported arousal evoked by the observed faces. Our results partially confirmed our expectations. The iBPD correctly interpreted the three unambiguous moral emotions. Contempt, a complex emotion with a difficulty in recognizing facial expressions, was recognized better by iBPD than by healthy controls. All negative emotions were judged more negatively by iBPD than by controls, but no difference was observed in the neutral or positive emotion. Alexithymia and anxiety trait and state levels were controlled in all analyses. (shrink)

Edited by Michael Hunter, Antonio Clericuzio, and Lawrence M. Principe. London: Pickering & Chatto, 2001. Cloth, $795.00. A complete edition of Boyle's correspondence has long been needed. Up until now, scholars who have attempted to incorporate Boyle's correspondence into their work have been thwarted by (inter alia) illegible (...) handwriting, foreign languages in the seventeenth-century versions, and scattered correspondence across a number of different countries on at least two continents. Michael Hunter and his co-editors, Antonio Clericuzio and Lawrence Principe, along with help from a staff of translators and editorial assistants, have succeeded brilliantly in creating order out of chaos.Given the length of time that Hunter et al. have been working on this edition and the extent to which cooperation has been sought and given by Boyle scholars worldwide, this Correspondence is as complete as is humanly possible. It is likely that in coming years stray letters will be found (most likely in private collections), but such finds will not be due to these editors' having failed to search assiduously for all extant correspondence. Next to completeness, the editorial methods and scholarly apparatus determine the usefulness of such an edition, and here again, Hunter and his co-editors have performed faultlessly. Hunter's introduction explains fully the decisions that were made concerning editorial choices (such as the choice of copy texts, etc.). In the letters themselves, the editorial annotations are easy to follow and arranged in such a way as to present a relatively uncluttered text (with textual variants being consigned to a section at the end of each volume). Editorial footnotes have been clearly distinguished from authorial footnotes. The editors have been quite successful in identifying correspondents and have provided useful cross-references in the footnotes to other relevant materials. In addition, each volume contains a section of brief biographical entries for those correspondents whose letters occur frequently in that volume.The editors' annotations are detailed and helpful and reflect years of dedication to the search for relevant information concerning Boyle's interests and his contemporaries. Throughout the entire Boyle Project, Hunter has elicited input from Boyle scholars on various people, topics, and references, and (as is the case with Boyle's Works) the result is an amazing amount of complementary information.Correspondence in a foreign language appears in both the original and in translation. This makes it possible for a scholar without competence in, for example, early modern Latin to have access to the content of the correspondence while allowing other scholars to check the accuracy of translations for themselves.Perhaps most useful of all the scholarly apparati is the glossary that appears at the end of each volume. Here one may find the meanings of the many seventeenth-century terms that are opaque to the typical twenty-first-century reader. Given the extent of Boyle's involvement in alchemy, without this glossary and its identification of the many alchemical terms it would be virtually impossible for a modern reader (even one who has studied chemistry) to make sense of many of the letters. Credit in this case goes to Lawrence Principe, who has contributed the fruit of his years devoted to the study of medieval and early modern alchemy. Within contemporary philosophy, practical consequences of agnosticism about the existence of God have mostly been discussed on the margins of other topics—such as the nature of faith or the problem of divine hiddenness. The aim of this article is to present the existing views on the practical upshots of suspending one's judgment on God's existence, briefly discussing the way in which agnosticism relates to practical atheism, non‐doxastic faith, fictionalism, apophaticism, and spiritual inquiry.

ABSTRACT In response to Katherine Dormandy’s argument for the superiority of the kind of faith which respects the evidence against retaining faith, I argue that the necessity of deciding which way of weighting evidence for and against retaining faith is preferable leads to Pascal’s wager for evidentialists: the choice between closed and open faith based on the calculation of epistemic and non-epistemic losses and gains, disclosing the tension between the kind of faith grounded in God’s reality and the kind which (...) is grounded in God’s goodness. The highly evocative title and the bogus quotation are bound to evoke associations which become the subject of minute examination in the novel. Its result turns out to be as astounding as the uncommon aphoristic trap laid for the readers. (...) The studies of health care systems are conducted intensively on various levels. They are important because the systems suffer from numerous pathologies. The health care is analyzed, first of all, in economic aspects but their functionality in the framework of systems theory is studied, as well. There are also attempts to work out some general values on which health care systems should be based. Nevertheless, the aforementioned studies, however, are fragmentary ones. In this paper holistic approach to the philosophical basis (...) of health care is presented. The levels on which the problem can be considered are specified explicitly and relations between them are analyzed, as well. The philosophical basis on which the national health care systems could be based is proposed. Personalism is the basis for the proposal. First of all, the values, that are derived from the personalistic philosophy, are specified as the basic ones for health care systems. Then, general organizational and functional properties of the system are derived from the assumed values. The possibility of adaptation of solutions from other fields of social experiences are also mentioned. The existing health care systems are analyzed within the frame of the introduced proposal.
