In his new book, Lewis D. Sargentich shows how two different kinds of legal argument - rule-based reasoning and reasoning based on principles and policies - share a surprising kinship and serve the same aspiration. He starts with the study of the rule of law in life, a condition of law that serves liberty - here called liberal legality. In pursuit of liberal legality, courts work to uphold people's legal entitlements and to confer evenhanded legal justice. Judges try to (...) achieve the control of reason in law, which is manifest in law's coherence, and to avoid forms of arbitrariness, such as personal moral judgment. Sargentich offers a unified theory of the diverse ways of doing law, and shows that they all arise from the same root, which is a commitment to liberal legality. (shrink)

In this book, which is both a philosophical and historiographical study, the author investigates the fallibility and the rationality of mathematics by means of rational reconstructions of developments in mathematics. The initial chapters are devoted to a critical discussion of Lakatos' philosophy of mathematics. In the remaining chapters several episodes in the history of mathematics are discussed, such as the appearance of deduction in Greek mathematics and the transition from Eighteenth-Century to Nineteenth-Century analysis. The author aims at developing a notion (...) of mathematical rationality that agrees with the historical facts. A modified version of Lakatos' methodology is proposed. The resulting constructions show that mathematical knowledge is fallible, but that its fallibility is remarkably weak. (shrink)

Tennenbaum's Theorem yields an elegant characterisation of the standard model of arithmetic. Several authors have recently claimed that this result has important philosophical consequences: in particular, it offers us a way of responding to model-theoretic worries about how we manage to grasp the standard model. We disagree. If there ever was such a problem about how we come to grasp the standard model, then Tennenbaum's Theorem does not help. We show this by examining a parallel argument, from a simpler model-theoretic (...) result. (shrink)

In this paper we examine C. I. Lewis's view on the roleof coherence – what he calls ''congruence'' – in thejustification of beliefs based on memory ortestimony. Lewis has two main theses on the subject. His negativethesis states that coherence of independent items ofevidence has no impact on the probability of a conclusionunless each item has some credibility of its own. Thepositive thesis says, roughly speaking, that coherenceof independently obtained items of evidence – such asconverging memories or testimonies – raises (...) the probabilityof a conclusion to the extent sufficient for epistemicjustification, or, to use Lewis's expression, ''rationaland practical reliance''.It turns out that, while thenegative thesis is essentially correct, astrong positive connection between congruence andprobability – a connection of the kind Lewis ultimatelyneeds in his validation of memory – is contingent on thePrinciple of Indifference. In the final section we assess therepercussions of the latter fact for Lewis's theory in particularand for coherence justification in general. (shrink)

Many Greek moralists are eudaemonists; they assume that happiness is the ultimate end of rational human action. Socrates, Plato, Aristotle, and most of their successors treat this assumption as the basis of their ethical argument. But not all Greek moralists agree; and since the eudaemonist assumption may not seem as obviously correct to us as it seems to many Greek moralists, it is worth considering the views of those Greeks who dissent from it.

Constructive Neutral Evolution is an evolutionary mechanism that can explain much molecular inter-dependence and organismal complexity without assuming positive selection favoring such dependency or complexity, either directly or as a byproduct of adaptation. It differs from but complements other non-selective explanations for complexity, such as genetic drift and the Zero Force Evolutionary Law, by being ratchet-like in character. With CNE, purifying selection maintains dependencies or complexities that were neutrally evolved. Preliminary treatments use it to explain specific genetic and molecular structures (...) or processes, such as retained gene duplications, the spliceosome, and RNA editing. Here we aim to expand the scope of such explanation beyond the molecular level, integrating CNE with Multi-Level Selection theory, and arguing that several popular higher-level selection scenarios are in fact instances of CNE. Suitably contextualized, CNE occurs at any level in the biological hierarchy at which natural selection as normally construed occurs. As examples, we focus on modularity in protein–protein interaction networks or “interactomes,” the origin of eukaryotic cells and the evolution of co-dependence in microbial communities—a variant of the “Black Queen Hypothesis” which we call the “Gray Queen Hypothesis”. In this paper I want to suggest that, while the argued philosophical distinction between logic, epistemolgoy and ontology is one of the many achievements of Aristotle, his predecessor Parmenides was in fact already operating with a theory of knowledge and an elementary propositional logic that are of abiding philosophical interest. As part of the thesis I shall be obliged to reject a number of interpretations of particular passages in his poem, including one or two currently fashionable ones. Since so much (...) turns on points of translation, I note for purposes of comparison what seem to be significant alternatives to my own in any particular instance. We present here solutions of a non-linear Schrödinger equation in presence of an arbitrary linear external potential. The non-linearity expresses a self-focusing interaction. These solutions are the product of the pilot wave with peaked solitons the velocity of which obeys the guidance equation derived by Louis de Broglie in 1926. The degree of validity of our approximations increases when the size of the soliton decreases and becomes negligible compared to the typical size over which the pilot wave varies. We discuss (...) the possibility to reveal their existence by implementing a humpty-dumpty Stern-Gerlach interferometer in the mesoscopic regime. (shrink)

This paper demonstrates the undecidability of a number of logics with quantification over public announcements: arbitrary public announcement logic, group announcement logic, and coalition announcement logic. In APAL we consider the informative consequences of any announcement, in GAL we consider the informative consequences of a group of agents all of which are simultaneously making known announcements. So this is more restrictive than APAL. Finally, CAL is as GAL except that we now quantify over anything the agents not in that group (...) may announce simultaneously as well. The logic CAL therefore has some features of game logic and of ATL. We show that when there are multiple agents in the language, the satisfiability problem is undecidable for APAL, GAL, and CAL. In the single agent case, the satisfiability problem is decidable for all three logics. (shrink)

Ayahuasca, a hallucinogen with profound consciousness- altering properties, has been increasingly utilized in recent studies (e.g., Strassman, 2001; Shanon, 2002a,b). However, other than Shanon's recent work, there has been little attempt to examine the effects of ayahuasca on perceptual, affective and cognitive experience, its relation to fringe consciousness or to pertinent personality variables. Twenty-one volunteers attending a seminar on ayahuasca were administered personality measures and a semi-structured interview about phenomenal qualities of their experience. Ayahuasca ingestion was associated with profound alterations (...) of temporal- spatial experiences including expansive space and slowed time. Ayahuasca use was also associated with positive emotional states, higher levels of fantasy proneness and psychological absorption and a greater openness to mystical experiences. Conversely, quickened time was associated with negative emotionality. The results are discussed within a multi-faceted model of fringe consciousness with a particular emphasis on Hunt's (1995) models of cross-modal translation as the basis for higher-order symbolic cognition and support James' (1890/1950) contention that fringe consciousness is essential to human cognition. ABSTRACT Twenty years ago Leif Lewin made the case that altruistic motives are more common than selfish motives among voters, politicians, and bureaucrats. We propose that motives and beliefs emerge as reactions to immediate feedback from technical-causal, material-economic, and moral-social aspects of the political task environment. In the absence of certain kinds of technical-causal and material-economic feedback, moral-social feedback leads individuals to the altruism Lewin documents, but also to righteousness (moralized regard for the in-group and disregard for the out-group) and (...) myopia (disregard for distant consequences). The mix of altruism, righteousness, and myopia increases the focus on winning the next high-stakes election rather than on discovering or enforcing socially productive institutions. (shrink)

We discuss our surgical philosophy concerning the subtle interplay between the size of the surgical margin taken and the resultant morbidity from ablative oncological. procedures, which is ever more evident in the treatment of head and neck malignancy. The extent of tissue resection is determined by the "trade off" between cancer control and the perioperative, functional and aesthetic morbidity and mortality of the surgery. We also discuss our dilemmas concerning recent minimally invasive endoscopic microsurgical. techniques for the trans-oral laser removal. (...) or co-ablation of aero-digestive tract tumours, which result in a minimal. surgical margin of oncological clearance. By a process of inductive argument as to the nature of the surgical margin, we consider whether the risks of taking a lesser margin with adjuvant therapy is justified by the attendant gain in reduced surgical morbidity and the possible costs in tumour control. The paper defends an Aristotelian notion of indeterminism, as rigorously formulated in the framework of branching space-times (BST) of Belnap (1992), against the model-theoretic characterization of indeterminism that Montague (1962) introduced into the philosophy of science. It delineates BST branching against the background provided by Earman's (2008) distinction between individual vs. ensemble branching. It describes a construction of physically-motivated BST models, in which histories are isomorphic to Minkowski spacetime. Finally it responds to criticism leveled against BST by addressing some semantical (...) questions, a topological issue, and the past/future asymmetry. (shrink)

Aquinas’s eudaimonism is normally interpreted as twofold in that it divides into the imperfect natural happiness of Aristotle and the perfect supernatural happiness of Augustine. I argue that Aquinas is logically committed to a third type of happiness that, in light of the standard view, renders his eudaimonism threefold. The paper begins with an overview of the standard twofold model of Aquinas’s eudaimonism; it then turns to the model’s logical problem whose solution requires the postulation of a third type of (...) happiness. In the second part of the paper, two clarificatory issues are addressed and several objections are considered. In closing, I explain why Aquinas’s commitment to a third type of happiness offers the Christian wayfarer grounds for a new optimism. (shrink)

Philosophical reflection on transparency, including group transparency, is beginning to gain steam. This paper contributes to this work by developing a conceptualization of transparency as an intellectual character trait that groups can possess, and by presenting a novel argument for thinking that such transparency should be understood along non-summativist lines. According to the account offered, a group’s being intellectually transparent consists in the group’s tending to attend well to its perspective and to share its perspective faithfully with others in order (...) to promote their epistemic goods. It is argued that this kind of group intellectual transparency, pace summativism, does not always consist merely in group members possessing intellectual transparency. The argument given for this conclusion works differently from existing arguments for non-summativism about group character traits, and it retains persuasive power even if summativist views of most group phenomena, including other group character traits, are correct. Opaqueness of pp collisions is evaluated at three CERN-ISR energies. Comparisons with predictions of the factorizable eikonal models and the scaling hypothesis are made. It appears that results are in favor of the factorizable models.
