Humean reductionism about laws of nature appears to leave a central aspect of scientific practice unmotivated: If the world’s fundamental structure is exhausted by the actual distribution of non-modal properties and the laws of nature are merely efficient summaries of this distribution, then why does science posit laws that cover a wide range of non-actual circumstances? In this paper, we develop a new version of the Humean best systems account of laws based on the idea that laws need to organize (...) information in a way that maximizes their cognitive usefulness for creature like us. Humean Laws for Human Agents presents cutting-edge research by leading experts on the Humean account of laws, chance, possibility, and necessity. A central question in metaphysics and philosophy of science is: What are laws of nature? Humeans hold that laws are not sui generis metaphysical entities but merely particularly effective summaries of what actually happens. The most discussed recent work on Humeanism emphasizes the laws' usefulness for limited agents and uses pragmatic considerations to address fundamental and long-standing problems. Humean reductionism about laws of nature is the view that the laws reduce to the total distribution of non-modal or categorical properties in spacetime. A worry about Humean reductionism is that it cannot motivate the characteristic modal resilience of laws under counterfactual suppositions and that it thus generates wrong verdicts about certain nested counterfactuals. In this paper, we defend Humean reductionism by motivating an account of the modal resilience of Humean laws that gets nested counterfactuals right.

Our ordinary causal concept seems to fit poorly with how our best physics describes the world. We think of causation as a time-asymmetric dependence relation between relatively local events. Yet fundamental physics describes the world in terms of dynamical laws that are, possible small exceptions aside, time symmetric and that relate global time slices. My goal in this paper is to show why we are successful at using local, time-asymmetric models in causal explanations despite this apparent mismatch with fundamental physics. (...) In particular, I will argue that there is an important connection between time asymmetry and locality, namely: understanding the locality of our causal models is the key to understanding why the physical time asymmetries in our universe give rise to time asymmetry in causal explanation. My theory thus provides a unified account of why causation is local and time asymmetric and thereby enables a reply to Russell’s famous attack on causation. (shrink)

Humeans about laws maintain that laws of nature are nothing over and above the complete distribution of non-modal, categorical properties in spacetime. ‘Humean compatibilists’ argue that if Humeanism about laws is true, then agents in a deterministic world can do otherwise than they are lawfully determined to do because of the distinctive nature of Humean laws. More specifically, they reject a central premise of the Consequence argument by maintaining that deterministic laws of nature are ‘up to us’. In this paper, (...) we present a new argument for Humean compatibilism. We argue that Humeans about laws indeed have resources for defending compatibilism that non-Humeans lack. Moreover, we show that utilizing these resources does not lead to objectionable consequences. Humeans about laws should thus embrace Humean compatibilism. (shrink)

The distribution of matter in our universe is strikingly time asymmetric. Most famously, the Second Law of Thermodynamics says that entropy tends to increase toward the future but not toward the past. But what explains this time-asymmetric distribution of matter? In this paper, I explore the idea that time itself has a direction by drawing from recent work on grounding and metaphysical fundamentality. I will argue that positing such a direction of time, in addition to time-asymmetric boundary conditions, enables a (...) better explanation of the thermodynamic asymmetry than is available otherwise. The Humean best systems account identifies laws of nature with the regularities in a system of truths that, as a whole, best conforms to scientific standards for theory-choice. A principled problem for the BSA is that it returns the wrong verdicts about laws in cases where multiple systems, containing different regularities, satisfy these standards equally well. This problem affects every version of the BSA because it arises regardless of which standards for theory-choice Humeans adopt. In this paper, we propose a (...) Humean response to the problem. We invoke pragmatic aspects of Humean laws to show that the BSA, despite violating some of our intuitive judgements, can capture everything that is relevant for scientific practice. (shrink)

It is natural to think of causes as difference-makers. What exact difference causes make, however, is an open question. In this paper, I argue that the right way of understanding difference-making is in terms of causal processes: causes make a difference to a causal process that leads to the effect. I will show that this way of understanding difference-making nicely captures the distinction between causing an outcome and helping determine how the outcome happens and, thus, explains why causation is not (...) transitive. Moreover, the theory handles tricky cases that are problematic for competing accounts of difference-making. (shrink)

An influential version of the Consequence argument, the most famous argument for the incompatibility of free will and determinism, goes as follows: For an agent to be able to do otherwise, there has to be a possible world with the same laws and the same past as her actual world in which she does otherwise. However, if the actual world is deterministic, there is no such world. Hence, no agent in a deterministic world can ever do otherwise. In this paper, (...) I discuss a recent version of this argument due to Christopher Franklin: the ‘No Opportunity argument’. I argue that the No Opportunity argument overgeneralizes. If its premises were true, things would be obstacles to doing otherwise that have nothing to do with determinism and that intuitively are not obstacles. (shrink)

The assumption that a system described as ‘Confucianism’ formulated by Dong Zhongshu became accepted as the norm during the Western Han dynasty (202 BCE – 9 CE) is challenged and his supposed authorship of the Chunqiu fanlu examined.

In this book, Camila Loew analyzes four women's testimonial literary writings on the Holocaust to examine and question some of the tenets of the fields of Holocaust studies, gender studies, and testimony. Through a close reading of the works of Charlotte Delbo, Margarete Buber-Neumann, Ruth Klüger, and Marguerite Duras, Loew foregrounds these authors' search for a written form to engage with their experiences of the extreme. Although each chapter contains its individual focus and features, the book possesses a (...) unity in intention, concerns, and consequences. In the theoretical introduction that unites the four chapters, Loew eschews essentialism and revises the emergence of the field of Women and Holocaust studies from the early 1980s on, and signals some of its shortcomings. In response, and in accordance with a recent turn in various disciplines of the Humanities, Loew highlights the ethical dimension of testimony and its responsible commitment to the other. In dealing with the texts as literary testimonies—a complex genre, between literature and history—, testimony is freed from the obligation to respond to the requirements of factual truth, and becomes a privileged form to voice the traumatic event, and to symbolically explore the role of excess. El artículo defiende la tesis de que el liberalismo igualitario nos lleva a una teoría de justicia global y, como parte de ésta, a un derecho de inmigración. Así, el peso de la prueba contra la justicia global y la inmigración se desplaza hacia aquéllos que las desean limitar. Un argumento corriente es que las obligaciones especiales hacia nuestros conciudadanos tienen prioridad sobre las obligaciones generales de justicia. El artículo examina argumentos particularistas y reduccionistas a favor de estas obligaciones especiales, (...) y sostiene que éstos no justifican la restricción de la justicia hacia nuestros conciudadanos y tampoco la discrecionalidad total de los estados en el control de sus fronteras. Neste texto, investiga-se a extensão diacrônica da comuni- dade moral no âmbito de teorias contratualistas. Para isso, examinam-se críticas à possibilidade lógica de sustentar obrigações em relação a gerações futuras e se abordam modelos argumentativos contratualistas de justificação dessas obrigações que se baseiam no interesse próprio e na imparcialidade. De acordo com essa pesquisa, a melhor defesa dessas obrigações se pode articular recorrendo a esse último tipo de contratualismo.

Studies in historical theology. v. 6. Petersham, Mass.: St. Bede's Publications, 1990. Pp. xxiv + 214. $14.95 (paper). The Godly Image presents a retouched version of the author's dissertation, first published in 1982 as Christian Satisfaction in Aquinas: Towards a Personalist Understanding (Washington, DC: University Press of America). Seeking (...) a broader audience, the author has dropped the dissertation's numerous Latin footnotes, shortened and enlivened the chapter titles, and streamlined some of his arguments (e.g., pp. 9395 ). He has as well corrected (e.g., on Pannenberg, p. xxii; on Anselm, p. 157) or toned down (e.g., the description of monastic theology, p. 1) earlier statements. Reference to the possibility that Aquinas suffered a nervous breakdown disappears (p. 18). Still, the work remains substantially the same, reproducing even some typos (e.g., William of St. Armour [sic], p. 3) from the original. The new subtitle, Christ and Salvation in Catholic Thought from Anselm to Aquinas, is unfortunate. First, it leads one to expect a survey of the major soteriological positions articulated in the period between the two, hut such is not forthcoming. The work remains what the original title indicated, a study in the thought of Aquinas. Second, in that work Anselm plays hut a perfunctory role, serving as the foil from whose mercantile model (p. 73) or juridical mentality (p. 91) Thomas can advance to a more appropriately interpersonal grasp of the mode of our salvation. This reading of Anselm, however, leaves him in the hands of liberal Protestant historians of doctrine of the nineteenth century, and, as the bibliography indicates, it ignores more recent literature which rightly stresses the metaphysical and religious depth of Anselm's key concept of iustitia. For a precise rendering of the relation between Anselm and Aquinas, one may wish to place greater emphasis on ST III, q.14, a.I, ad 1. In that text Aquinas accomplishes two things. First, he integrates Anselm's concept of satis· faction with the traditional religious insight that, in some sense, Christ suffered what sinners deserve to suffer. At the same time he deepens the concept by rendering explicit the place of love and obedience as the formal element in satisfaction and thus rejoins Anselm in rejecting any strict notion of penal substitution. These reservations aside, the author's thorough, comprehensive, and competent investigation into Aquinas fills a lacuna in the history of soteriology, a lacuna, one regrets to say, still left open by the work of his immediate predecessor, B. Catao. At the same time the scope 148 BOOK REVIEWS of the author's work offers a further and important contribution. By researching Thomas's thought on satisfaction in the context of penance as well as soteriology, the author manages to suggest, and explicitly, that the generative matrix for Thomas's theoretic work in both areas lies in the cruciform dynamics of Christian conversion, the life of grace. Anglin, a Post-Doctoral Research Fellow in Mathematics at McGill University, has produced a highly compact and compelling volume which attempts in just 218 pages to prove God's existence, to argue for personal immortality, to defend the coherence of theism against the problem of evil, to provide cogent analyses of both omnipotence and omniscience, and to examine criteria for distinguishing divine revelation from other forms of communication. The thread holding these rather motley swatches of cloth together is the author's concentration on libertarian freedom which weaves throughout the above issues in one way or another. It shows up in the expected places (e.g., in the so-called 'free will defense' of the problem of evil) but also in places hitherto unexpected (Anglin nicely argues that if humans are truly free in the libertarian sense, then it is appropriate and necessary that the Scriptures take the... Einfühlung wird ideengeschichtlich an das Konzept der Selbstperfektionierung geknüpft und insofern im Modus der Defizienz verhandelt. Dabei fungieren antike und mittelalterliche Diskurse um Gotteserkenntnis als historisch-konzeptionelle Vorläufer neuzeitlichmoderner Erklärungsfolien zwischenmenschlicher Alterität, mithin als semantische Vorform der zeitgenössischen Einfühlungs-Idee. In diesem Kontext ist eine ethisch-epistemologische Asymmetrie zu konstatieren, die Gott einerseits als den All-Empathischen beschreibt und zugleich die Erkenntnisbemühungen des Menschen als unabgeschlossen und prozessual vorstellt. Einfühlung produziert sich als regulative Idee im doppelten Sinne: Während Gott als empathische Transzendenz erscheint, bedarf (...) es unendlicher Annäherungsbewegungen, damit der Mensch sich in einem Akt transzendenter Empathie in Gott einfühlen kann. En este artículo se critican aquellas posiciones que defienden la discrecionalidad de los Estados en relación al acceso de inmigrantes en el territorio de su soberanía y se investiga si desde la perspectiva de la justicia global se desprende un derecho a la movilidad libre y/o obligaciones de justicia distributiva global. Se argumenta que si lo que está en la base de la justicia global es exclusivamente la preocupación por la desigualdad de oportunidades y la pobreza, entonces existen buenas razones (...) a favor de la justicia distributiva global. Sin embargo, aun en este caso deben reconocerse restricciones importantes a la discrecionalidad estatal en temas de inmigración. (shrink)

What, exactly, is the difference between words such as ‘dead’ and ‘deceased’? In this paper, I argue that such differences in register, or style, ought to be construed as genuine differences in non-truth-conditional meaning. I also show that register cannot plausibly accounted for in terms of either presupposition or conventional implicature. Register is, rather, an instance of what I call pure use-conditional meaning. In the case of register, a difference in meaning does not correspond to a difference in the contents (...) speakers intend to convey. (shrink)

Plausible assumptions from Cosmology and Statistical Mechanics entail that it is overwhelmingly likely that there will be exact duplicates of us in the distant future long after our deaths. Call such persons “Boltzmann duplicates,” after the great pioneer of Statistical Mechanics. In this paper, I argue that if survival of death is possible at all, then we almost surely will survive our deaths because there almost surely will be Boltzmann duplicates of us in the distant future that stand in appropriate (...) relations to us to guarantee our survival. Many scholars claim that Frege's theory of colouring is committed to a radical form of subjectivism or emotivism. Some other scholars claim that Frege's concept of colouring is a precursor to Grice's notion of conventional implicature. I argue that both of these claims are mistaken. Finally, I propose a taxonomy of Fregean colourings: for Frege, there are purely aesthetic colourings, communicative colourings or hints, non-communicative colourings.

The author argues that there is no such thing as a unique and general taxonomy of non-at-issue contents. Accordingly, we ought to shun large categories such as “conventional implicature”, “F-implicature”, “CI”, “Class B” or the like. As an alternative, we may, first, describe the “semantic profile” of linguistic devices as accurately as possible. Second, we may explicitly tailor our categories to particular theoretical purposes.

This paper offers a detailed reconstruction of Frege’s theory of side-thoughts and its relation to other parts of his pragmatics, most notably to the notion of colouring, to the notion of presupposition, and to his implicit notion of multi-propositionality. I also highlight some important differences between the subsemantic categories employed by Frege and those used in contemporary pragmatics.

A moral Kantian approach can be developed to deal with the nonidentity problem with regard to environmental intergenerationl justice—at least in cases of depletion or risky policy. Being a duty-oriented moral theory, this approach allows both that people coming into existence in a nonidentity situation can be glad to exist while simultaneously taking into account depletion or risky policy, to which their existence is causally related, as possibly being morally wrong because of a violation of moral duties.

En este texto se investigan críticamente intentos de justificación de derechos culturales diferenciados dentro del marco teórico de las teorías igualitarias liberales que definen la justicia de acuerdo a alguna concepción de igualdad de oportunidades. El resultado de esta investigación es que esta justificación no es posible ni dentro de la teoría de Rawls ni dentro de la teoría de Dworkin. En el marco de teorías que se orientan al bienestar, como la de Cohen, es posible realizar esta justificación. Sin (...) embargo, estas teorías no son atractivas desde una perspectiva liberal. This paper is partly exegetical, partly systematic. I argue that Frege's account of what he called “colouring” contains some important insights on how communication is related to mental states such as mental images or emotions. I also show that the Fregean perspective is supported by current research in psycholinguistics and that a full understanding of some linguistic phenomena that scholars have accounted for in terms of either semantics or pragmatics need involve psycholinguistic elements.

A certain type of counterfactual is thought to be intimately related to causation, control, and explanation. The time asymmetry of these phenomena therefore plausibly arises from a time asymmetry of counterfactual dependence. But why is counterfactual dependence time asymmetric? The most influential account of the time asymmetry of counterfactual dependence is David Albert’s account, which posits a new, time-asymmetric fundamental physical law, the so-called “past hypothesis.” Albert argues that the time asymmetry of counterfactual dependence arises from holding fixed the past (...) hypothesis when evaluating counterfactuals. In this paper, I argue that Albert’s account misconstrues the time asymmetry of counterfactual dependence. (shrink)

On the basis of Waldron’s supersession thesis, this article discusses the historical injustice argument and contends that in order to evaluate moral claims for restitution of territorial titles it is important to consider the legitimate expectations of citizens that have been formed historically and have been sanctioned by the state through institutional mechanisms of stabilization of expectations. The legitimate expectations of citizens form normative demands that cannot be disregarded when rectifying historical injustices. In his arguments in favour of the supersession (...) thesis, Waldron does not give sufficient attention to the concept of ‘legitimate expectation’, even though the thesis is reinforced by this reference. Unlike exclusively restitutive and rectificatory measures, this paper relies on _present considerations_ of the consequences of past injustices, all within the framework of a theory of justice. In this sense, compensation deals with the past, but in a forward-looking way. (shrink)

De acuerdo a este artículo, la extensión realizada por Rawls de su concepción de justicia doméstica al contexto de las relaciones internacionales contradice premisas básicas de su propia teoría de justicia. Una extensión de la teoría doméstica consistente con sus propias premisas debería llevar a considerar una clase mayor de demandas como derechos humanos y a aceptar algún principio de distribución global.

The article analyzes and criticizes the political use of hive psychology proposed by Jonathan Haidt who appeals to the “nudges” of libertarian paternalism. The article introduces paternalism and discusses the nudge theory, and on the basis of that discussion examines the political use of hive psychology and holds that (i) nudges do not respect people as autonomous beings, and that (ii) hive politics are dangerous. Instead, a cosmopolitan perspective would be well worth pursuing.

O artigo apresenta algumas estratégias recorrentes para justificar os direitos culturais (tais como comunidade justificativa, o valor da diversidade, as teorias do reconhecimento da diferença cultural, o valor da autonomia, a justificação de igualdade) e as examina criticamente à luz de seus próprios méritos, a partir da perspectiva do liberalismo enquanto doutrina política. De acordo com o artigo, todas essas justificativas são fadadas ao fracasso.

O artigo mostra que muitos dos casos geralmente discutidos em debates multiculturais são erroneamente entendidos como conflitos culturais que seriam supostamente resolvidos através de direitos culturais. Ao contrário, o que temos em sua base é a aspiração universalista liberal de uma igualdade de oportunidades. Desde um ponto de vista igualitário liberal, a implementação de políticas antidiscriminatórias efetivas é a estratégia correta para lidar com tais casos . The article examines four principles of cost allocation (cost of mitigation, of adaptation, and of compensation) for environmental policies that aim to address climate change: “the polluter pays”, “who benefits pays”, “who is able to pay, pays”, and “the equal per capita”. It shows that they are all problematic. A better case can be built by the joint work of only the two principles of “the polluter pays” and “who benefits pays”.

En su ética de la responsabilidad argumenta Jonas a favor de un imperativo categórico, pero heterónomo: que la humanidad sea. Según este, habría un deber procreativo de la humanidad. Este deber ya incluiría las condiciones de una vida genuinamente humana. En primer lugar, el artículo sostiene que este imperativo no es capaz de lidiar satisfactoriamente con el desafío impuesto por el problema de la no-identidad, popularizado de Parfit. Si la elección entre dos políticas hoy, implica la no existencia de generaciones (...) en el futuro, o una existencia en malas condiciones o incluso en condiciones de un infierno terrenal, el imperativo de Jonas debiese llevar a escoger la segunda política. Esto es contraintuitivo. En segundo lugar, el artículo sostiene que la integración de los intereses de las generaciones futuras en la ética sí se puede realizar desde una interpretación kantiana. Y finalmente el artículo sostiene que el cumplimiento del deber de que la humanidad sea, puede llevar a violar la autonomía de las personas en el presente en pos de la generación de valor en el futuro.
