In The idea of justice (2009), Amartya Sen builds on his previous work on capabilities to develop a theory of comparative justice which he contrasts to the contractarian approach. The theory has two parts: the proper materials of justice (capabilities); and, a procedure for assessing those materials. The procedure that Sen advocates is one of open impartial deliberation operationalised through Adam Smith's impartial spectator, which he contends is superior to contractarian view operationalised by Rawls’ original position. In this paper we (...) argue that Sen's open impartiality is too open and defend a more bounded version as more workable regardless of the operationalising device used. Moreover, we demonstrate that Sen's own arguments against the possibility of agreement, though aimed at the contractarian tradition, undermine his own attempts to generate a contentful account of justice by driving a wedge between the materials and procedures. Sen's attempt to provide an alternative approach to political philosophy, we conclude, fails. (shrink)

Gratitude, the proper or fitting response to benevolence, has often been conceptualized as a virtue—a temporally stable disposition to perceive, think, feel, and act in certain characteristic ways in certain situations. Many accounts of gratitude as a virtue, however, have not analyzed this disposition accurately, and as a result, they have not revealed the rich variety of ways in which someone can fail to be a grateful person. In this article, I consider the claim that we ought to be grateful to nature and argue that this claim is unjustified. I proceed by arguing against the two most plausible lines of reasoning for the claim that we ought to be grateful to nature: 1) that nature is a fitting or appropriate object of our gratitude, and 2) that we ought to be grateful to nature insofar as gratitude to nature enhances, preserves or indicates in us the virtue of (...) gratitude, a character trait we morally ought to have. My arguments against the first line of reasoning show it to be unsound, and my arguments against the second reveal that we actually have reasons to avoid being grateful to nature. If we have reasons to treat nature well, I show, those may be rooted in the appropriateness of attitudes like praise, appreciation or compassion, but not gratitude. I conclude by highlighting several implications my arguments entail about gratitude to entities other than nature and about environmental virtues other than gratitude. (shrink)

On 26 February 2020, the German Constitutional Court rejected a law from 2015 that prohibited any form of ‘business-like’ assisted suicide as unconstitutional. The landmark ruling of the highest federal court emphasised the high priority given to the rights of autonomy and free personal development, both of which constitute the principle of human dignity, the first principle of the German constitution. The ruling echoes particularities of post-war Germany’s end-of-life debate focusing on patient self-determination while rejecting any discussion of active assistance (...) to die through a lethal injection administered by a doctor. This brief report discusses the ruling in the light of the broader sociopolitical and historical context of the German end-of-life debate. (shrink)

Is there a duty to prosecute grave international crimes? Many have thought so, even if they recognize the obligation to be defeasible. However, the theoretical literature frequently leaves the grounds for such a duty inadequately specified, or unsystematically amalgamated, leaving it unclear which considerations should drive and shape processes of criminal accountability. Further, the circumstance leaves calls to end impunity vulnerable to skeptical worries concerning the risks and costs of punishing perpetrators. I argue that a qualified duty to prosecute can (...) be substantiated on the basis of a single class of reasons, though also that standard justifications of international criminal law (as currently conceived) are not up to the task. The account exploits the expressive dimension of punishment, but locates the central good of criminal accountability in its capacity to appropriately enable an agential stance on the part of subjects in transitional circumstances. It can legitimate, in a way to be specified, hope. The approach also displays the cynicism of an anti‐impunity ethos in the absence of a robust commitment to securing basic human rights in transitional circumstances. (shrink)

In this short response, I agree with Cavaliere’s recent invitation to consider ectogenesis, the process of gestation occurring outside the body, as a political perspective and provocation to building a world in which reproductive and care labour are more justly distributed. But I argue that much of the literature Cavaliere addresses in which scholars argue that artificial wombs may produce greater gender equality has the limitation of taking a fixed, binary and biological approach to sex and gender. I argue that (...) in taking steps toward the possibility of more just practices of caregiving and family making, we must look first not to artificial womb technologies but to addressing the ways that contemporary legal and social practices that enforce essentialising, binary ways of thinking about reproductive bodies inhibit this goal. This paper presents the results of a qualitative interview study exploring English and French physicians’ moral perspectives and attitudes towards end-of-life decisions when patients lack capacity to make decisions for themselves. The paper aims to examine the importance physicians from different contexts accord to patient preferences and to explore the role of advance directives in each context. The interviews focus on problems that emerge when deciding to withdraw/-hold life-sustaining treatment from both conscious and unconscious patients; decision-making procedures and the participation (...) of proxies/relatives; previous experience with ADs and views on their usefulness; and perspectives on ways in which the decision-making processes in question might be improved. The analysis reveals differences in the way patient preferences are taken into consideration and shows how these differences influence the reasons physicians in each country invoke to justify their reluctance to adhering to ADs. Identifying cultural differences that complicate efforts to develop the practical implementation of ADs can help to inform national policies governing ADs and to better adapt them to practice. To take the idea of a non-anthropocentric ethic of nature seriously is to abandon morality itself. The idea of humanity is not an optional extra for moral seriousness. Non-anthropocentric environmental ethicists mistake the kind of value non-human entities may bear. It is not moral value, but aesthetic value.

South Africa has the highest rate of foetal alcohol syndrome (FAS) in the world. The problem of alcohol abuse in pregnancy has very deep historical roots that are intertwined with the injustices of both apartheid and pre-apartheid colonialism. Much of the research that is being done in these communities is focused on identifying the epidemiological variables associated with these patterns of alcohol abuse. The underlying reasons as to why these patterns continue seem to remain largely obscured from view. In this (...) article, I apply the theory proposed by Powers and Faden of social justice as a ‘moral foundation for public health and health policy’ to the problem of FAS in South Africa. The objective of this application is two-fold: first, to critically explore the additional insights and alternative perspectives to the problem of FAS that this approach may provide and second, to assess the utility of the theory when applied directly to a specific public health problem. I conclude by noting that although this approach could result in the kind of ‘public health scope creep’ that has been criticized by various authors, it does provide fresh insights to the problem of FAS in South Africa. Much can be learned from burgeoning climate action movements in thousands of majority world rural communities. Land degradation has increased the vulnerability of over three billion people to famine, food insecurity, water shortages, and increasingly severe weather events, trapping climate-vulnerable communities in vicious cycles of impoverishment. Yet, many communities are learning through local climate action how to escape these cycles. We offer the case of Farmer-Managed Natural Regeneration (FMNR) as one example to understand the conditions under which impoverished rural communities (...) address ecological degradation. Combining simple reforestation action with a community engagement approach enables farming households using FMNR to regreen their landscapes, increase food security, reduce poverty, increase resilience to climate change and transform rural development. Communities in at least 29 countries are practising FMNR, reforesting tens of millions of hectares of land, strengthening communities, and restoring landscapes. Synergies between FMNR and faith-based moral principles help boost its embrace. Across the majority world, moral imagination and reasoning help motivate emotions that sustain farmers’ local action through their hope of a better future and scale up globally important community-based agricultural movements. Such collective action movements harness synergies between climate justice, poverty reduction, and human flourishing. (shrink)

For sexual purposes, animals are off limits. But if we regard attributions of species membership as unimportant in familiar ethical contexts, then it may be difficult to explain why this is the case. Someone who is unimpressed by appeals to species membership as a basis for favoring humans over non-humans may remain similarly unimpressed by such appeals when sex becomes an issue. Species barriers may seem to be beside the point. Peter Singer’s attitude toward human sexual relations with non-humans leans (...) heavily in this direction. In a notorious book review where more was perhaps implied than said, Singer advanced the claim that, in the absence of any cruelty or physical harm, sexual relations with non-human animals would not be “an offence to our status and dignity.” And, insofar as we do not regard status and dignity as the main issue here, we may be inclined to agree. However, what follows will lean in the opposite direction to Singer and will argue that once we have set aside any consideration of status and dignity, we will still have significant grounds for ruling out familiar forms of sex with familiar, terrestrial, non-human animals under ordinary circumstances that fall short of the fictionally-extreme. However, the grounds in question turn out to concern something other than species membership simpliciter. (shrink)

Horn discusses some of the difficulties that researchers have encountered in analyzing the neural basis of memory and describes ways in which these difficulties have been overcome through the analysis of memories underlying habituation and imprinting. Trenton Merricks has recently argued that substance dualist accounts of embodiment and humanness do not cohere well with the Incarnation. He has also claimed that physicalism about human persons avoids this problem, which should lead Christians to be physicalists. In this paper, I argue that there are plausible dualist accounts of embodiment and humanness that avoid his objections. Furthermore, I argue that physicalism is inconsistent with the Incarnation.

Many find it plausible that for a given beneficiary, Y, benefactor, R, and action, ϕ, Y’s being grateful to R for ϕ-ing implies Y’s being grateful that R ϕ-ed. According to some philosophers who hold this view, all instances of gratitude to, or “prepositional gratitude,” are also instances of gratitude that, or “propositional gratitude.” These philosophers believe there is a single unified concept of gratitude, a phenomenon that is essentially gratitude that, and whose manifestations sometimes have additional features that make (...) them instances of gratitude to as well. In this article, I show that view to be mistaken. I base my argument on two hypothetical cases, in each of which a beneficiary, Y, is grateful to a benefactor, R, for ϕ-ing, but not grateful that R ϕ-ed. Generalizing from those cases and other cases of gratitude, I argue that prepositional gratitude is the proper response to benevolence-motivated action and propositional gratitude consists in a beneficiary’s judging a state of affairs to be valuable for himself and welcoming that state of affairs. Because not every instance of a benefactor’s acting benevolently toward a beneficiary is something that beneficiary finds valuable for himself and welcomes, it is possible to be grateful to a benefactor for ϕ-ing but not grateful that she ϕ-ed. Prepositional gratitude and propositional gratitude can each occur without the other and are thus two distinct phenomena. I conclude by explaining the importance of accurately understanding the relationship between prepositional gratitude and propositional gratitude. (shrink)

In recent publications Paolo Virno and Carlo Vercellone have called attention to Marx’s category of the general intellect in theGrundrisse, and to the unprecedented role its diffusion plays in contemporary capitalism. According to Virno, the flourishing of the general intellect, which Marx thought could only take place within communism, characterises post-Fordist capitalism. Vercellone adds that Marx’s account of the real subsumption of living labour under capital is obsolete in contemporary cognitive capitalism. Both authors regard Marx’s value theory as historically obsolete. (...) I argue that these views rest on a confusion of value and wealth, a neglect of Marx’s account of the role of ‘free gifts’ to capital, an underestimation of the role of the general intellect in the period prior to the rise of post-Fordism/cognitive capitalism, and an underestimation of the restrictions on the diffusion of the general intellect in contemporary capitalism. Adultery is a dominant feature in chivalric literature; it becomes a major concern in Shakespeare's last plays; and it forms the central plot of novels from Anna Karenina to Couples. Tony Tanner proposes that transgressions of the marriage contract take on a special significance in the "bourgeois novels" of the eighteenth and nineteenth centuries. His interpretation begins with the general topic of adultery in literature and then zeroes in on three works—Rousseau's La Nouvelle Héloïse, Goethe's (...) Gratitude to others is typically understood as a response to good things people give to us or do for us. Occasionally, though, we thank people for things other than gifts or actions. We sometimes thank people for being there for us, for instance, or for loving us, or for being good parents or teachers, or for believing in us. In this article, I develop a set of considerations to help determine whether gratitude to others for being, loving, or believing can (...) be fitting in any of these cases. I begin by arguing that when it is appropriate for a beneficiary thank a benefactor for ϕ-ing, the beneficiary’s gratitude to the benefactor for ϕ-ing is fitting only insofar as the benefactor ϕ-ed out of benevolence, care or concern for the beneficiary. I then show that thanking can express attitudes other than gratitude, thereby highlighting the thanks-gratitude fallacy: the mistake of inferring the fittingness of one person’s gratitude to another from the fact that it would be reasonable for the former to thank the latter. These considerations imply that gratitude for being there for us, gratitude for believing in us, and gratitude for being a good professional can sometimes be fitting, while gratitude for loving us and gratitude for being a good intimate generally are not. This article attempts to challenge those contemporary philosophical approaches to justice (and this is the majority of them) which ascribe to the notion of justice a dominant role within ethics and political philosophy. In the first section, this overestimation of justice is traced back to J.S. Mill (and to John Rawls). After having pointed out some of the essential features of the Millian (and Rawlsian) concept, I show how far these attributes are away from what we (in our everyday language) (...) mean by the word ‚justice’. Finally, I try to spell out what might be more plausibly seen as the focus of our shared moral intuition, and to highlight to which extent there is an overlap with our common idea of justice. In Norway, priority for health interventions is assigned on the basis of three official criteria: health benefit, resources, and severity. Responses to the COVID-19 pandemic have mainly happened through intersectoral public health efforts such as lockdowns, quarantines, information campaigns, social distancing and, more recently, vaccine distribution. The aim of this article is to evaluate potential priority setting criteria for public health interventions. We argue in favour of the following three criteria for public health priority setting: benefit, resources and improving the (...) well-being of the worse off. We argue that benefits and priority to the worse off may reasonably be understood in terms of individual well-being, rather than only health, for public health priority setting.
