Ten years after they were set up, the Italian regions have fallen into general discredit. They are discredited by the central government who regards them as a source of support for the opposing Communist Party and has sought to undermine this reform by depriving the regions of all true autonomy. The regions are discredited by the public opinion by not fulfilling the expectations placed in them. Such an assessment does not stand up to a close examination of regional practices (...) : some geographical differences rapidly become obvious, but especially evident are the political differences. In fact, the regions are the product of an apparent agreement between the political parties and have always suffered from political bargaining which explains the national scale of the issues raised at the last elections. Strengthened by the favorable results obtained in certain regions, the Communist Party was quick to turn this statement of the electoral opinion into a « referendum » about the newly formed Cossiga government. The federal government indirectly subsidizes the pharmaceutical industry by funding basic research, various tax credits and deductions, patent rules, grants of market exclusivity, and other means, in order to spur drug development, promote public health, and improve medical care. But today, the pharmaceutical industry often neglects these goals and sometimes even undermines them, due to what Lawrence Lessig refers to as institutional corruption — that is, widespread or systemic practices, usually legal, that undermine an institution’s objectives or integrity. A key (...) source of institutional corruption is improper dependence by the institution or its key actors on the actions of third parties that have fundamentally different interests. The failure of the UN Security Council to adequately and effectively address the Syrian crisis has brought renewed scrutiny to the veto and its capricious use during mass atrocity situations. In response to these concerns, the idea of a code of conduct to regulate the exercise of the veto during humanitarian situations is now being increasingly advanced by several states, including France and the United Kingdom. This paper disputes the utility of such a code and argues that it would not (...) make any significant difference to the way mass atrocity crimes are addressed. I examine three core arguments often extended to justify the merit and the utility of the norm: the circumvention argument, the naming and shaming argument, and the Charter reform argument. I show how each of these arguments is undermined by mistaken notions about the norm's procedural effectiveness, and the role the veto plays in cases of what Simon Chesterman calls “inhumanitarian noninterventions.” Additionally, drawing on interviews conducted with diplomats at the United Nations in New York, I present evidence that resistance to a code of conduct comes not only from the permanent five members of the Council but also from the nonpermanent members, further imperiling the idea's capacity to effect change. Ultimately, I contend that the current global effort to curtail the influence of the veto is nothing more than a journey down the rabbit hole: exciting, but ultimately distracting. (shrink)

Résumé Partant d’un ouvrage collectif qui pose un regard critique sur les projets qui ont mené à la fondation de l’Université de Bielefeld à la fin des années soixante, l’article revient sur les conditions d’émergence de la première Reformuniversität dans l’Allemagne fédérale. Conçue comme un ensemble transdisciplinaire d’enseignement et de recherche selon le modèle esquissé par Wilhelm von Humboldt, l’université de Bielefeld va devoir très vite s’adapter au pragmatisme dominant dans les années 1970, se soumettre à une modernisation adaptative et (...) de ce fait subir un échec par rapport à la conception initiale. Un secteur cependant échappe à ce que l’on a appelé le ‘Bielefelder Syndrom’ : celui des Sciences sociales et historiques et son centre interdisciplinaire de recherches (ZiF) constituant l’ ‘Ecole de Bielefeld’ autour de figures marquantes, diverses mais complémentaires, comme les historiens Reinhart Koselleck, Hans-Ulrich Wehler, Jürgen Kocka et des sociologues comme Niklas Luhmann. Lü-shih ch'un-ch'iu [Spring and Autumn of the House of Lü] appeared on the scene in 239 B.C. This was the latter part of the Warring States period. Our country's transition from slavery to feudalism had already been basically completed, but chaotic wars of secession among the feudal princes still occurred. Remnant forces of the slave system were still quite strong, and the restoration-counterrestoration struggle between the declining slave-owning class and the newly emerging landlord class was proceeding violently. Lü Pu-wei was (...) a careerist and plotter of the declining slave-owning class and a representative of the Confucians. In response to the needs of the slave-owning class's counterrevolutionary restoration, Lü adopted the tactic of "attacking the mind." He sneaked into the government of the newly emerging landlord class in the state of Ch'in and played the role of an ardent vanguard for restoration. This big commercial slave owner, who had originally run around among Ch'in, Chao, and other states, had amassed thousands of gold pieces at home and possessed more than ten thousand slaves. He played around with political conspiracies and became chancellor of the state of Ch'in. Before King Ying Cheng of Ch'in personally took power in 238 B.C., political power fell for a time into Lü's hands. Lü Pu-wei worked in collusion with Lao Ai, a eunuch he sponsored, and joined the industrial and commercial slave owners and the aristocratic slave owners to form a frenzied restorationist force. On the one hand, they formed factions to strengthen private interests, expanded their power, and prepared for an armed coup d'état. On the other hand, they took in riff-raff [literally, people who had surrendered and rebelled], assembled Confucian scholars, set to work on ideology, and grandly created public opinion for the restoration of the slave system. At that time, a reactionary adverse current favoring the restoration of the slave system hung over the state of Ch'in. Lü-shih ch'un-ch'iu, which was compiled under Lü's direction by his retainers, was the product of this adverse current. (shrink)

People in Belgium want to simplify the electoral laws. The responsible department has a project which is presented as being neutral, having no political implications. The authors compare the results of the last elections computed according to several systems, including the new project. Their conclusion is that the new project is politically oriented : it favours the big parties.The authors propose a new system of ballot which is really neutral, and they show it by a simulation on the results of (...) the elections since 1954.Their system is simple and easily treated by computer. La réparation du dommage corporel est omniprésente dans le projet de réforme du droit de la responsabilité civile présenté par la Chancellerie le 13 mars 2017, manifestant ainsi nettement la volonté de ses auteurs de conférer un statut juridique particulier à cette catégorie de dommage. Un tel souci se manifeste de deux manières. Il s’agit d’une part d’infléchir, dans un sens généralement plus favorable aux victimes, les règles de la responsabilité civile, pour assurer une indemnisation moins aléatoire et plus large (...) des préjudices consécutifs à une atteinte à la personne. Ainsi en est-il notamment de la dérogation au droit commun de la preuve, s’agissant d’établir la causalité en cas de dommage occasionné par le membre indéterminé d’un groupe. Ainsi en est-il également de la soustraction du dommage corporel de l’obligation faite à la victime dans le projet, de minimiser son préjudice. Il s’agit d’autre part de préciser les modalités de la réparation du dommage corporel. Le projet reprend à son compte certaines innovations intervenues ces dernières années (mise en place d’une nomenclature, d’un barème médical unique), et consacre aussi des solutions inédites, telles que le recours de principe à la rente (plutôt qu’à une indemnisation en capital) pour certains chefs de préjudices comme le besoin en tierce personne ou les pertes de gains professionnels) ou l’affirmation du principe de libre disposition des dommages et intérêts. ABSTRACT: This article analyzes the relation between Godwin (1756-1836), Republican and author of Politcal lustice (1793), and French philosophers, particularly Helvetius. Both Godwin and Helvetius were in favour of a political understanding of the theory of knowledge as opposed to an intellectual treatment of policy. They continually questioned the links between policy, history of the human understanding, and moral science from the perspective of the question of education. After the September Massacres (1792), Godwin’s thought changed radically and began to revolve (...) around the notion of perfectibility. The final disagreement marked a distinction between French reformers, who advocated state control, and English writers, influenced by dissent and reformation, who held the idea of perfectibility.RÉSUMÉ: Cet article examine le rapport de Godwin (1756-1836), écrivain anglais «jacobin», auteur de Political Justice (1793), aux philosophes français, Helvétius en particulier. Partisans d’une politisation de la théorie de la connaissance plutôt que d’une intellectualisation de la politique, ils interrogent sans cesse, via la question de l’education, les liens du pouvoir politique, de l’histoire de l’entendement humain etde la science morale. Après les massacres de septembre (1792), la position de Godwin évolue considérablement et met en scène la perfectibilité. Le différend final marque la distinction entre un courant des Lumières françaises, réformatrices et étatistes, et un courant des Lumières anglaises, aux sources religieuses dissidentes ou réformées, porteuses, elles, de l’idée de perfectibilité. Le XVIIIe siècle avait mis à l'honneur l'histoire des systèmes; sans doute parce qu'en cette période, le philosophe voyait toute une partie du savoir échapper à l'ordre systématique. Si la raison prescrit encore une organisation discursive de la science dans le domaine de la géométrie et de la mécanique, elle entre en conflit avec sa propre rationalité dans le champ d'un savoir descriptif, qui se veut histoire de la Nature. L'empirisme des nouveaux théoriciens de la connaissance propose une conception de (...) l'entendement qui le réduit à la passivité de l'intuition sur le donné de l'expérience. L'instinct, la Nature, la vie, la présence de Dieu, l'économie de la création: autant d'Idées de la raison, par lesquelles la raison se définit négativement quant à son propre pouvoir régulateur et constitutif. Quelle peut être dans ces conditions la visée de la critique philosophique? S'agit-il d'une réflexion en vue de dévoiler les fondements des concepts de l'entendement? Et alors, la métaphysique deviant cette invention de l'intelligible que Leibniz symbolisait par l'entr'expression monadique. Ou plutôt s'agit-il de déterminer au lieu de réfléchir, et ainsi de délimiter la raison par l'effectuation de son pouvoir? Pour citer la seconde préface de la Critique de la Raison Pure, alors qu'il s'agit de l'ordre copernicien du savoir certain, «la raison ne perçoit que ce qu'elle produit, elle-même, selon son plan». This contribution aims to understand the process of renormalisation operated at the level of internship tutors by the management team in a French physiotherapy training institute, faced with the implementation of a reform of the studies. The study is based on the concepts of corporate social responsibility (CSR) and leadership and on a three-year interview survey with the management. The results highlight the issues encountered in the first year and the training dynamics implemented in the third year. The article goes on to describe the radicalization of the HET-Pro and the terrain in which it operates, a radicalization that concerns the relationship to truth and its relationship to the outside (...) world. Finally, the article takes this as a starting point for formulating questions addressed to everyone. Plus exceptionnel encore, il fait partie des rares lecteurs assidus de Husserl à s’être aperçu que la phé-noménologie poursuivait un projet de réforme de la logique formelle. L’article propose d’attester l’existence d’un tel projet chez Husserl ; d’en examiner (...) la réappropriation et les prolongements chez Rota.Gian-Carlo Rota is among the few great mathematicians of the second-half of the XXth century whose interest in formal logic is openly declared and has never flagged, since his training as a student in Princeton up to his last writings. This paper propose to testify to the existence of such a project in Husserl; to examine how it is taken over and continued by Rota. L’hypothèse défendue consiste à montrer que cette injonction s’enracine dans certains aspects de l’histoire coloniale. Ce sont des conseillers de l’Empire français qui considéraient une réforme laïque de l’islam comme la condition sine qua non de l’acquisition de la citoyenneté. La réforme de l’islam était alors censée rendre l’indigène digne d’être citoyen. Il saggio discute la lettura proposta da Francesco Novati della figura di san Francesco d’Assisi, a partire dalla interpretazione di quelle di Dante e Giotto. Alla luce dei rapporti con Gabriele d’Annunzio, la lettura novatiana di Francesco rivela una prospettiva che tende a offrire una visione estetizzante, dannunziana e decadente, immagine della modernità e non sempre aderente al messaggio originario. In questo modo Francesco diviene sostenitore di un progetto di riforma interno alla Chiesa che, con spirito dannunziano, supera il dualismo (...) tra materia e spirito per arrivare quasi a un elogio dell’immanenza. Attraverso una sorta di mitizzazione della figura di Francesco, Novati parla del proprio tempo più che di un personaggio vissuto nel passato. The essay discusses Francesco Novati’s reading of the figure of St. Francis of Assisi, starting from the interpretation of those of Dante and Giotto. In the light of the relationship with Gabriele d’Annunzio, the Novati’s reading of St. Francis reveals a perspective that tends to offer an aestheticising view, which is “dannuntian” and decadent, image of modernity that not always adheres to the original message. In this way, St. Francis purposes an inside reform project of the Church, which, with a “dannuntian” spirit, goes beyond the matter-spirit dualism in order to arrive almost to a praise of the immanence. Through such a mythologisation of the figure of St. Francis, Novati talks about his own time more than about a man who lived in the past. (shrink)

Elles portent principalement sur le rapport de (...) l’Église catholique au monde moderne. À Vatican II, si les Pères conciliaires ont été d’accord pour généraliser et accélérer l’effort de mise à jour de l’Église entamée depuis quelques décennies, quelques-uns ont refusé le discernement opéré par l’Église catholique sur l’enseignement des papes, depuis Pie IX, sur le rapport de l’Église avec le monde moderne. Les évêques appartenant à la majorité ont estimé qu’il fallait re-recevoir ces enseignements portés dans des circonstances historiques différentes, et les apprécier à la lumière des situations nouvelles dans lesquelles évoluait désormais l’Église catholique. These tensions relate mainly to the relationship of the Catholic Church with the modern world. If the Fathers of the Second Vatican agreed to upgrade the Church, after a few decades some priests refused to follow the teachings of the Popes about the relationship of the Church with the modern world. Most bishops felt that they should return to those teachings used in different historical circumstances, and evaluate them in light of the context of the new changes in the world. La création d’un système de santé public a été l’un des éléments clés de la Révolution tranquille dans les années 1960 au Québec. Toutefois, le développement de nouveaux traitements et de nouvelles technologies, en particulier des produits pharmaceutiques, ont fait naître un nouveau débat sur la gestion de notre système de santé. En se basant sur une analyse récente des valeurs libérales dans la société québécoise par Claude Ryan, l’auteur souligne l’importance que le gouvernement doit accorder à ces valeurs dans (...) la modernisation de notre système de santé. À la lumière des recommandations présentées par la commission Clair au provincial et par la commission Romanow au fédéral, la situation se prête bien à une modernisation du système de soins au Québec. Les valeurs libérales ont fourni une base au système de santé public ; elles sont plus pertinentes qu’elles ne l’ont jamais été alors que le débat sur notre système de santé est engagé. (shrink)

Bien que John Stuart Mill et Jeremy Bentham aient été considérés comme d’illustres exemples de « Philosophes radicaux », leurs exigences en matière de réforme sociale et politique étaient basées sur des points de vue différents. Comparée à celle de Bentham, l’analyse de Mill concernant le principe d’utilité et de démocratie représentative présente certains traits « perfectionnistes » et « élitistes ». La présente étude se propose d’examiner ceci à la lumière de la réception et de la réponse de Mill (...) aux idées de Bentham sur la politique. Bien que Mill fût, en partie, un partisan enthousiaste de Bentham, et qu’il lui attribuât le mérite de promouvoir les réformes juridiques et politiques, il semble avoir commencé, à partir de 1833, à évaluer ouvertement Bentham de façon critique. One type of change that has lurked at the edges of scholarly discussions of international politics—often assumed, invoked, and alluded to, but rarely interrogated—is learning. Learning entails a very particular type of change. It is deliberate, internal, transformative, and peaceful. In this contribution to the roundtable “International Institutions and Peaceful Change,” I ask whether intergovernmental organizations can learn in a way that is comparable to the paradigmatic learning of individual human beings. In addressing this question, I take three steps. First, (...) I explore references to corporate entities “learning” within the discipline of international relations and ask whether what is being proposed is, in fact, genuine learning by the organizations themselves. Second, I attempt to construct a robust account of institutional learning that departs from these conceptions and acknowledges instead the self-reflection and structural transformation that I argue learning at the corporate level requires. Third, for the purpose of illustration, I turn briefly to the UN following the 1994 genocide in Rwanda and the slaughter of more than eight thousand men and boys outside Srebrenica in 1995 to identify examples of each stage of institutional learning. Finally, I offer three provisional claims about my proposed conception of institutional learning that warrant attention in future work. Namely, I suggest that institutional learning: cannot be equated with moral progress; is possible despite formal organizations being incapable of emotional responses such as shame or regret; and, perhaps most controversially, can occur at the level of the IGO without prior or parallel learning taking place at the level of the state or individual human actor. Aussi a-t-elle été l'objet d'incessants conflits d'interprétation, commencés déjà de son temps. Elle ne paraissait pas d'accord, en effet, avec les consignes d'orthodoxie données aux artistes par les théologiens de la Contre-Réforme, et clairement rappelées à Caravage dans le contrat qui lui avait été fixé en 1565 (...) pour représenter les scènes de la vie de S. Matthieu dans l'église S. Louis des Français à Rome. Il interpréta ce contrat selon des critères tout nouveaux et personnels. Ce monde n'est pas vide de Dieu, mais Dieu ne fait qu'y passer ; il se retire, pour laisser le monde à son autonomie, et l'homme à la conscience de sa liberté.Caravaggio's painting holds a strategic position between the religions art of the sixteenth century, the naturalism of which is pervaded by divine presence – e.g. in Carracci's art –, and the secularized realism which is to flourish in the nineteenth century. It has therefore been the subject of unceasing controversies in its interpretation, beginning in Caravaggio’s times already. Indeed, Caravaggio’s painting did not seem in line with the instructions given to the artists by Counter-Reformation’s theologians, urging them to follow the Orthodox line. Caravaggio had been clearly reminded of those instructions in the contract he had signed in 1565 to portray the scenes of Saint Matthew’s life in Saint Louis des Français’Church in Roma. He interpretated this contract according to very innovative and personal criteria. The composition of space and light, the layout of characters and chiaroscuros are revealing of the modern vision of the world and of the man that was emerging in those times. The light ray that crosses a scene devoid of nobleness and plunged into darkness, immobilises a moment of truth and choice : the event of Jesus meeting Matthew, the instant of an oral communication between God and man, the time when everyone is called to decide his of her personal existence in the triviality of his or her daily life, without God intervening in the process. This world is not void of God’s presence, but God only passes through it. He withdraws to let the world face its autonomy, and man face the awareness of his freedom. (shrink)

In the war which the centres of concentrated power, whether statist or private, are waging against the entire population of the world, the pretexts change, the policy remains the same. Yesterday it was communism or drugs, today it’s terrorism. Through intimidation and the manipulation of information, the exponents of such warfare are reducing the entire world to silence. The only thing that matters is their interests, and to defend these they are ready to confiscate and militarise the entire planet and (...) outer space as well. They ruin lives and communities and call the whole business « reform », « commerce », or « free-trade ». Despite this, it is to the freaks of Porto Alegre that the future belongs. For his services, he is hailed as Mujaddid Alf-I-Thani. The Muslim society had degenerated when Mujaddid Alf-I-Thani appeared on the horizon. A number of Hindu customs and practices had become the (...) part of their creed. The commandments of Shariat and Sunnah were being floated. Moreover, the Mughal emperor Akbar had adopted controversial policies detrimental to the very existence of Muslim society. Mujaddid Alf -Thani made strenuous and constant efforts to turn the tide. When Mujadded-Alf-Thani started his social reform movement, he found that the Muslim society was embracing un-Islamic practices such as widespread belief in Karamat had developed under the influence of Hindu thinking. Moreover, the Islamic teachings had been vitiated by adopting customs and practices of other religions such as inter marriages between Hindus and Muslims and ban on cow slaughter etc. Shaykh Ahmad Sirhindi never entered into any political conflict directly. He endeavored to restore pure doctrine to Islamic thought and to compel the Muslims to follow Shariat and Sunnah in letter and spirit. He was a social reformer, great Alim, Sufi and Mujaddid. He initiated a process of social change, inspired by Islamic Ideal, in an age, which was becoming secular. This research paper is an attempt to mention the role of Shaykh Ahmad Sirhindi for saving the society from un-Islamic values and customs in the sub-continent and its impact on society. I examine the new defense of the principle of sufficient reason, offered by Michael Della Rocca (_The Journal of Philosophy_, 120 (2023): 220-227). I first identify a crucial premise of Della Rocca’s argument, and argue that it is not justified. I then reformulate his argument, this time with the corresponding crucial premise justified. Finally, although I think the reformed argument is valid, I express some doubts about the propriety of the un-Leibnizian requisite suggested in that paper.

While National Human Rights Institutions are widely regarded as particularly promising tools in the emerging transnational regime for the regulation of business and human rights, we still know little about their potential and actual contribution to this field. This article bridges the gap between business and human rights research and NHRI scholarship, proceeding in three steps: Firstly, I analyze the structural conditions for NHRIs to tackle business-related human rights abuses effectively, focusing on the key conditions of legitimacy and competences. Secondly, (...) I examine the envisaged role and functions of NHRIs in business and human rights regulation according to the Paris Principles and the UN Guiding Principles. Thirdly, I reconstruct and critically assess NHRIs’ mandates and powers to address corporate human rights abuse, based on the analysis of surveys and reports. I argue that there is a significant mismatch between the essential structural conditions for effective NHRI engagement with business and human rights, the expected contribution of NHRIs to the prevention and remedy of corporate human rights abuses, and the limitations of their mandates and powers in practice. To overcome that misalignment and unlock NHRIs’ full potential, this article proposes a reform of the Paris Principles which would provide these institutions with a robust source of international legitimacy and increase the pressure on state governments to extend their powers. This article explores Max Weber’s ideas about a «successful peace» that he exposed during World War I. For Weber, a successful peace depended essentially on important domestic reforms and a fundamental reorganisation of the German Reich, more than on the foreign policy dimension. Analysing Weber’s “ideas of 1918” – opposed to the so-called “ideas of 1914” – this paper focuses on three aspects: nation and citizenship, Prussia, German tradition, history and political culture.
