This article proposes to analyse some aspects of the appropriation of New School thinking in Brazil, particularly Deweyan pragmatism, in the 1950s and 1960s. The analysis is based on the assumption that the developmentalist ideology that punctuated the debate on the economic, political and social restructuring of the country in these two decades constituted fertile ground for the return and expansion of pragmatist thinking amongst Brazilian educators, articulating itself, sometimes in contradictory ways, with this ideology. The focus of the analysis (...) will be on the writings of the group of educators which circulated around the figure of Anísio Teixeira, at the time director of the National Institute for Pedagogic Studies, an organ linked to the Ministry of Education and Culture, which set itself the task of producing research that would support public policy in the field of education, as well as constituting itself as a center for teacher education and the stimulus and development of innovative experiences in the public school system. The appropriation of Deweyan pragmatism, in this context, had a triple perspective: pragmatism as scientific method, implying a specific conception of science, particularly the social sciences, with emphasis on the application of scientific knowledge in the solution of practical problems; as a way of democratic life; and as a synonym for experimentalism, in the sphere of schooling. Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

Although Chinese law imposes informed consent for medical treatments, the Chinese understanding of this requirement is very different from the European one, mostly due to the influence of Confucianism. Chinese doctors and relatives are primarily interested in protecting the patient, even from the truth; thus, patients are commonly uninformed of their medical conditions, often at the family’s request. The family plays an important role in health care decisions, even substituting their decisions for the patient’s. Accordingly, instead of personal informed consent, (...) what actually exists is ‘family informed consent’. From a Western perspective, these features of Chinese law and Chinese culture might seem strange, contradicting our understanding of doctor-patient relationship and even the very essence of self-determination and fundamental rights. However, we cannot forget the huge influence of cultural factors in these domains, and that ‘Western’ informed consent is grounded on the individualistic nature of Western culture. This article will underline the differences between the Western and the Chinese perspectives, clarifying how each of them must be understood in its own cultural environment. But, while still respecting Chinese particularities, this paper advocates that China adopt patient individual informed consent because this is the only solution compatible with human dignity and human rights. The events surrounding COVID-19, combined with the mandatory quarantines widely imposed in Asia and Europe since the virus outbreak, have reignited discussion of the balance between individual rights and liberties and public health during epidemics and pandemics. This article analyses this issue from the perspectives of precaution and necessity. There is a difficult relationship between these two seemingly opposite principles, both of which are frequently invoked in this domain. Although the precautionary principle encourages the use of quarantines, including mandatory quarantines, (...) and associated restrictive measures, the principle of necessity puts a break on such measures. The COVID-19 pandemic reveals once again the different interrelations between these two principles. However, the alleged conflict between the PN and the PP is based on a superficial analysis. The relation between these two principles is far more complex, as this article will demonstrate. (shrink)

The Director-General of the WHO has suggested that China’s approach to the COVID-19 crisis could be the standard of care for global epidemics. However, as remarkable as the Chinese strategy might be, it cannot be replicated in other countries and certainly not in Europe. In Europe, there is a distribution of power between the European Union and its member states. In contrast, China’s political power is concentrated in the central government. This enables it to take immediate measures that affect the (...) entire country, such as massive quarantines or closing borders. Moreover, the Chinese legal framework includes restrictions on privacy and other human rights that are unknown in Europe. In addition, China has the technological power to easily impose such restrictions. In most European countries, that would be science fiction. These conditions have enabled China to combat epidemics like no other country can. However, the WHO might have been overoptimistic. The Chinese standard of care for treating COVID-19 also raises problematic issues for human rights, and the real consequences of these actions remain to be seen. (shrink)

Most courts around the world have been refusing wrongful life actions. The main argument invoked is that the supposed compensable injury cannot be classified as such, since life is always a blessing no matter how hard and painful it is.In opposition to mainstream scholars and the dominant case law, this article sustains that life must be distinguished from living conditions, the former being the real injury at stake, since some living conditions are so intolerable that in themselves they justify a (...) compensation within wrongful life actions. The use of reproductive techniques and the eventual reproductive negligence from the provider of reproductive services gave rise to situations in which the intended parents are deprived of raising a child genetically connected to them. Courts have been dealing with cases of those for years, but have systemically denied claimants compensation, failing to recognise as damage the loss of genetic connection. In 2017, for the first time, the Singapore High Court provided compensation for that damage, labelled “loss of genetic affinity”. (...) This paper will argue that the damage in question is the loss of genetic connection and results from a violation of reproductive rights because a key element of reproductive rights is to have children with whom we keep a genetic bond and raise them. The paper will explain why the arguments classically argued against such compensation are unfounded and it will argue for a compensation covering both patrimonial and non-patrimonial damages. Facial recognition is an artificial intelligence-based technology that, like many other forms of artificial intelligence, suffers from an accuracy deficit. This paper focuses on one particular use of facial recognition, namely identification, both as authentication and as recognition. Despite technological advances, facial recognition technology can still produce erroneous identifications. This paper addresses algorithmic identification failures from an upstream perspective by identifying the main causes of misidentifications (in particular, the probabilistic character of this technology, its ‘black box’ nature and its algorithmic (...) bias) and from a downstream perspective, highlighting the possible legal consequences of such failures in various scenarios (namely liability lawsuits). In addition to presenting the causes and effects of such errors, the paper also presents measures that can be deployed to reduce errors and avoid liabilities. (shrink)

This text is a narrative that shows the fluid border between religion and culture, from my own observation at the Islamic community in Portugal. Despite the differences and complexities found in the group of Muslims in Portugal, due to its origins, to Islamic movements and strands, the Guinean Muslims will be the protagonists in this article, especially because it is a case of continuing migration in that country, which results in increase of that population in Portugal. In a way, this (...) finding helps illustrate the fluidity of relationships religion / culture, by the very practices from their particular cultures. In addition, as a Muslim majority, which comes from the same geographical region, reproducing ethnic traits, undergo a process of segregation, not only by the wider host society but also by the Islamic religious group based in Portugal, which is generating a conflict situation. Under Chinese law, the juridical status of the embryo and the foetus is unclear, mainly because the existing legislation can be subject to diverse interpretations due to its ambiguous language. Lack of clarity with the law has led to different understandings amongst Chinese legal scholars. However, although there has been no consensus, there has been a clear tendency to deprive embryos and foetuses of legal status or personhood, thereby excluding them from entitlement to fundamental rights, an understanding reinforced by the (...) Confucian view of the beginning of life. It is expected that in the near future the Chinese courts will face issues involving embryos and foetuses more often, such as disputes over in vitro embryos. The lack of legal precedent could result in contradictory resolutions, therefore, the law should clarify the legal status of embryos and foetuses and accord to prenatal life special respect and treatment. In March 2020, the Portuguese Government issued a remarkable regulation by which irregular migrants who had previously started the regularization procedure were temporarily regularized and thus allowed full access to all social benefits, including healthcare. The Portuguese constitutional and legal framework is particularly generous regarding the right to healthcare to irregular migrants. Nevertheless, until now, several practical barriers prevented full access to healthcare services provided by the national health service, even in situations in which it was legally granted. This decision (...) is not only remarkable in light of the fulfilling of migrants’ rights to health, as imposed by international commitments assumed by, but also in view of the fight against COVID-19. The decision is grounded both on human rights and in public health reasons. The paper is divided in two main parts. In the first one, it analyzes national State obligations with regard to healthcare provision to migrants in irregular situation. In the second part, it analyzes the Portuguese solution, using this case study to discuss the possible mechanisms to comply with such obligations. (shrink)

Nas obras literárias da autora é evidente sua angústia e, através do pincel, a escritora também deixou transparecer todo seu sentimento em relação à existência em-si.

A distinguishing characteristic of the biomedical model is its compartmentalized view of man. This way of seeing human beings has its origin in Greek thought; it was stated by Descartes and to this day it still considers humans as beings composed of distinct entities combined into a certain form. Because of this observation, one began to believe that the focus of a health treatment could be exclusively on the affected area of the body, without the need to pay attention to (...) patient’s subjectivity. By seeing pain as a merely sensory response, this model was not capable of encompassing chronic pain, since the latter is a complex process that can occur independently of tissue damage. As of the second half of the twentieth century, when it became impossible to deny the relationship between psyche and soma, the current understanding of chronic pain emerges: that of chronic pain as an individual experience, the result of a sum of physical, psychological, and social factors that, for this reason, cannot be approached separately from the individual who expresses pain. This understanding has allowed a significant improvement in perspective, emphasizing the characteristic of pain as an individual experience. However, the understanding of chronic pain as a sum of factors corresponds to the current way of seeing the process of falling ill, for its conception holds a Cartesian duality and the positivist premise of a single reality. For phenomenology, on the other hand, the individual in his/her unity is more than a simple sum of parts. Phenomenology sees a human being as an intending entity, in which body, mind, and the world are intertwined and constitute each other mutually, thus establishing the human being’s integral functioning. Therefore, a real understanding of the chronic pain process would only be possible from a phenomenological point of view at the experience lived by the individual who expresses and communicates pain. É o teórico mais acabado do positivismo e do capitalismo em sua fase imperial, escrevendo uma obra vastíssima, que vai da História e da Filosofia à Educação e à Sociologia, merecendo destaque: A Divisão do Trabalho Social (...) Desde o 11 de setembro de 2001, debates sobre o Islã foram intensificados, em busca de explicações plausíveis sobre os ataques terroristas ao World Trade Center. Foram colocadas em pauta, sobretudo nas mídias, nacional e internacional, hoje, uma das mais importantes fontes de informação e de construção dos nossos mundos cognitivos, questões sobre o que são os muçulmanos e o Islã. Motivada por esse cenário e pelo crescimento do número de muçulmanos no mundo, praticamente um quarto da população mundial, no (...) qual os muçulmanos por conversão também são parte, decidi observar e comparar os dois campos, Brasil e em Portugal, tomando nota das ricas relações entre religião e cultura, entre tradição e modernidade. Dois campos com diferentes procedências, vertentes religiosas, escolas de pensamento, movimentos religiosos, que resultaram não somente em diversidade, mas igualmente em semelhança, em conflito e em dilema. De onde se observa que também a diferença une todos os muçulmanos do mundo. Inspired by the scenario as well as by the growing number of Muslims in the world, almost a quarter of the population, included converted Muslims, I decided to observe and compare two fields, Brazil and Portugal, taking note about the richly relations between religion and culture, tradition and modernity. They are two fields with different origins, religious tendencies, schools of thought, religious movements, which have resulted not only in diversity, but also in similarity, conflict and dilemma. O artigo apresenta as lutas dos trabalhadores rurais boias frias no Brasil, valorizando sua riqueza e protagonismo em momentos históricos em que elas eram invisibilizadas tanto pela ditadura como por visões pré-concebidas de quem seriam os sujeitos das lutas por reforma agrária. O universo empírico da pesquisa é a região de Ribeirão Preto e Araraquara, no estado de São Paulo, representativa das contradições entre uma agricultura produtivista e a proletarização de um amplo contingente de trabalhadores. No momento em que oposições seculares – tais como real versus imaginário, razão versus mito, inteligível versus sensível, vida mental versus vida material – se encurtam e o poder passa a ser exercido não só pela coerção material, mas também pela dominação simbólica, percebe-se que, cada vez mais, procura-se conciliar razão e imaginário. Entende-se, assim, que a tradição é mantida através dos mitos e das lendas. O que se deseja, realmente, é manter-se o passado dentro do futuro. A sociedade tem, (...) como objetivo, o futuro. Entretanto, ela se mantém sob as regras do passado. O imaginário é sempre, em certa medida, imitação do passado, mas é uma imitação deformada pelo próprio mecanismo de projeção, que mais não pode fazer a não ser transformar os preceitos, as estruturas adquiridas pelas aprendizagens adaptativas, suprimindo-lhes outros preceitos e outras estruturas, condicionando-os a tornarem-se, sem apelo nem agravo, diferentes daquilo que são. A criança não está livre desse processo. Constantemente ela é bombardeada pelas imagens publicitárias, cinematográficas e televisionada, além das várias modalidades de Literatura que permeiam o seu cotidiano. ABSTRACT In a moment when secular oppositions curtail (such as the real versus the imaginary, reason versus myth, the intelligible versus the sensitive, mental life versus material life) and power comes to be exerted not only through material coercion but also through symbolical domination, one notices a growing tendency towards conciliating reason and the imaginary. Thus, tradition is kept through myths and legends, as the aim is really to hold the past inside the future. Society aims at the future. However, it keeps the rules of the past. In a way, the imaginary is always an imitation of the past, but an imitation deformed by its own projection mechanism, which cannot but transform precepts and frameworks acquired through adaptive learning, suppressing other precepts and frameworks and conditioning them to become different from what they are. The child is not free from that process, being constantly exposed to publicity, cinema and television images, besides the various kinds of literature that permeate his daily life. The concept of dignity is proliferating in ethical, legal, and policy discussions of AI, yet dignity is an elusive term with multiple philosophical interpretations. The authors argue that the unspecific and uncritical employment of the notion of dignity can be counterproductive for AI ethics.

O ato de amamentar apresenta diversos benefícios tanto à mãe quanto ao bebê. No entanto, amamentar um bebê com cardiopatia requer inúmeros desafios. Este estudo tem o propósito de compreender a vivência do aleitamento materno de bebês com cardiopatia congênita e as propostas dos serviços de saúde à paciente com essas condições. Estudo descritivo, qualitativo, realizado por meio de entrevista semiestruturada com mães de bebês internados em hospital de referência em cardiopediatria. Utilizou-se a técnica de análise de conteúdo de Minayo, (...) com referencial teórico específico para embasamento da discussão. Os resultados encontrados apontam para a dura realidade dessas mães que se deparam com inúmeras dificuldades diante do enfrentamento da doença e das repercussões emocionais e físicas advindas dela. O impacto emocional e inviabilização dos cuidados com a amamentação exige uma equipe de saúde especializada para oferecer suporte afetivo, fortalecer vínculo mãe-bebê e minimizar prejuízos que a doença pode ocasionar. O presente trabalho analisa o itinerário do ensino de filosofia no Brasil, analisando o percurso da ausência desta disciplina nos currículos escolares, até a recente obrigatoriedade legal, que fundamenta a criação de propostas tais como a do Programa Institucional de Bolsas de Iniciação à Docência (PIBID). Abordamos os objetivos e os resultados do programa desenvolvido na Universidade Federal da Bahia (UFBA), contextualizando as ações empreendidas na escola pública, desde 2010, tendo como enfoque o projeto Filosofia na Cozinha.

In Brazil, induced abortion in adolescents has been frequent in less-advantaged socioeconomic classes, and the vulnerability of these adolescents has not been addressed. Given this context, the present study sought to investigate the relationship between the practice of abortion and vulnerability in adolescents. This was a descriptive cross-sectional study of 201 adolescents who completed a structured questionnaire that allowed the analysis of variables with respect to intent to abort. The profile of the pregnant adolescents in the sample studied was the (...) following: average age, 16.1 years; stable partner; mulatas; did not use condoms during sexual relations; precocious with respect to their first sexual relations; and did not plan the pregnancy. According to the classification of the World Health Organization, 81.59% of the subjects‘ abortions were known to be induced. Twenty-one were vulnerable to induced abortion; of these, 13 reported forced sexual intercourse, of whom 8 reported that they had suffered associated violence. These results indicate that sexual violence and unwanted pregnancy subject adolescents to a context of greater vulnerability to induced abortion. Thus, it is suggested that this relationship should be considered from the perspective of bioethics and human rights, but always respecting the cultural values of the society in which the adolescents live, as well as their human dignity. Background: A short version of the Posttraumatic Diagnostic Scale comprising only re-experiencing symptom items has been recently validated on Japanese adults. This short-version-PDS had good psychometric properties among Japanese adults with and without posttraumatic stress disorder. The aim of this study was to translate and culturally validate the short-version-PDS for the Brazilian sociolinguistic context.Methods: A translation of the short-version-PDS was performed based on established guidelines. We enrolled 53 patients with PTSD as a potential comorbidity. The translation and cross-cultural adaptation of (...) the short-version-PDS included forward and back-translation by a Japanese Brazilian researcher and a certified translator; synthesis was achieved by consensus, backward translation, pilot test, and finalization. Content validity coefficient was used to assess quality of adaptation. Internal consistency was calculated using Cronbach's alpha coefficient. Spearman correlations were between the new short-version-PDS and the Brazilian version of the posttraumatic Stress Disorder Checklist for DSM-5, and a receiver operating characteristic curve was used to determine the best cut-off values for the short-version-PDS.Results: The short-version-PDS was well accepted by all subjects, none of the questions were experienced as inappropriate, and all questions of the 3 items were judged important. Item 1 presented CVCt = 0.92; item 2 had a CVCt = 0.87 and item 3 had a CVCt = 0.95. The internal consistency of the final version as measured by Cronbach's alpha was 0.78. The short-version-PDS scale correlated positively with the DSM-5 scale with a Spearman rho of 0.64 (95%CI [0.4-0.8], p 31.0 with sensitivity and specificity are 86.4 and 93.5%, respectively.Conclusions: This Brazilian Portuguese version of the short-version-PDS had good psychometric properties among Brazilian adults with and without PTSD. Transferability and generalizability of the cut-off scores should be further analyzed. (shrink)

The aim of this article is to know the role of learning tasks within the pedagogical content knowledge of novel sports coaches in initial stages of sports training of children/young people and their impact on their daily work. Participants are two coaches in their first or second working year. A mixed methodology was used by means of polar coordinates analysis. The results agree with previous studies that established that PCK of novel coaches presents deficits in task selection and modification, motivation (...) is the key factor determining tasks selection process, and they do not know how much time they should dedicate to each task. Even so, better development was found in the PCK of the coaches. (shrink)

Background Second victim is the name given to the healthcare personnel—most often a nursing professional—involved with the error that led to the adverse event to a patient and who, as a result, have experienced negative psychological effects. Research with second victims has increased over the years, however concerns exist with regards to the ethical risks imposed upon these individuals. Aim To explore the extent to which research with second victims of adverse events in healthcare settings adhere to ethical requirements. Methods (...) A scoping review was conducted following Arksey and O’Malley’s methodological framework and using the following databases: PUBMED, Web of Science, and SCOPUS. Original research of any study design focused on second victims and published in English, Spanish, or Portuguese in 2014–2023 were included. A critical narrative approach was used to discuss the findings. Ethical considerations The review followed ethical guidelines emphasizing accurate authorship attribution and truthful data reporting. Results Fifteen studies using qualitative ( n = 2), quantitative ( n = 10), and mixed-method ( n = 3) designs were included. Over half were not assessed by a research ethics committee, with questionable reasons given by the authors. One-third did not refer to having used an informed consent. In two studies, participants were recruited by their workplace superiors, which could potentially right to autonomy and voluntary participation. Conclusion Over half of the included studies with second victims did not comply with fundamental ethical aspects, with risk to inflict respect for individual autonomy, confidentiality, and of not causing any harm to participants. Implications for nursing research Healthcare personnel involved in adverse events are most often nursing professionals; therefore, any breach of ethics in research with this population is likely to directly affect their rights as research participants. We provide recommendations to promote better research practices with second victims towards safeguarding their rights as research participants. (shrink)

Neste artigo analisamos a arte na perspectiva de Jean-Paul Sartre. A partir de sua obra Que é a literatura? demonstramos como as artes se distinguem e porque o escritor pode ser mais engajado que os demais artistas. Para o filósofo francês é possível dizer de arte significante e arte não-significante. A poesia, a pintura e a escultura são não-significantes enquanto que a literatura, por lidar com signos, é significante. Existe uma escolha comum a todos os artistas, contudo, a opção pela (...) arte significante como forma de desvelar o mundo tem um sentido mais profundo que Sartre procurou esclarecer. Além disso, procuramos mostrar o que faz de uma obra de arte um objeto estético. (shrink)

Por meio da análise da consciência e da formação do imaginário, Jean-Paul Sartre faz um percurso que demonstra como acontece a formação da obra de arte, isto é, do objeto passível de apreciação estética. Explica que existem diferentes motivações que desencadeiam a atuação da consciência imaginária assim como há diferença entre as obras de arte. Além disso, por meio do movimento fenomenológico, explica como o para-si percebe-se como um nada e, dessa forma, tem a compreensão da própria realidade.

O Bem-Estar Psicológico (BEP) de estudantes universitários da gradução tem sido objeto de crescente interesse na pesquisa científica por ser reconhecido como uma dimensão multifacetada e central da saúde mental. Nesse sentido, este trabalho propôs-se a apresentar os fatores de risco e os fatores de proteção que influenciam nos índices do BEP, de modo a evidenciar as estratégias eficazes de cuidado em saúde mental para o referido segmento populacional. Metodologicamente, trata-se de uma pesquisa com abordagem qualitativa, a partir de uma (...) revisão integrativa de artigos publicados em português e inglês, disponíveis na íntegra nas bases BVS-Psi e PubMed. Foram utilizados os descritores “bem-estar psicológico”, “universidades” e “saúde mental” ou “bem-estar psicológico”, “fatores de risco” e “fatores de proteção” para BVS-Psi e para PubMed, respectivamente, sendo selecionados e analisados 19 estudos. Os resultados ressaltaram que a sobrecarga de trabalho acadêmico, as expectativas elevadas, a competição intensa e a incerteza em relação ao futuro profissional são fatores de risco. Evidencia-se, ainda, que a criação de relações sociais fortes e de estratégias de gerenciamento do tempo aliadas à orientação profissional eficaz são fatores de proteção que auxiliam na promoção da saúde mental nesta população. The purpose of the article was to determine the relationship between the organizational culture and the institutional management of the "Enrique López Albújar" Educational Institution, Piura. Work is worked under a quantitative approach, descriptive and correlational scope, 40 teachers participated as a sample. Among the results, it was found that there is no significant relationship between organizational culture and institutional management, which did not allow validating the research hypothesis; However, a significant relationship between norms and customs with institutional management was (...) found; which concludes in compliance with the norms and good customs based on values. Breastfeeding policies and the production of motherhood: a historical–cultural approach This paper revisits some of the aspects that allow us to situate historically the process that has been called the ‘politicization of women's breasts’. It is part of a broader research project being undertaken in Rio Grande do Sul, Brazil, which is studying information from the educational material used in the National Campaign for the Incentive of Breastfeeding. The methodological approach used is cultural analysis, and its theoretical basis is informed (...) by feminist studies and cultural studies, from a poststructuralist perspective. Knowledges and practices that produce notions of maternity are problematized to argue that current political and economic arrangements have necessitated a redefinition of motherhood. This re‐signification of motherhood has transferred to women the duty of solving an array of problems that were previously considered government's responsibility, in particular those related to the physical and emotional development of infants. Introduction: Empathy is a complex human experience that involves the subjective intersection of different individuals. In the context of nursing care in the geriatric setting, the benefits of empathetic relationships are directly related to the quality of the practice of nursing. Objective: Analyze scientific production on the benefits of empathy in the nurse–patient relationship in the geriatric care setting. Methods: An integrative review of the literature was performed using the PubMed, Cochrane, CINAHL, Scopus, PsycINFO, and Web of Science databases. The (...) articles retrieved were organized, evaluated, and classified based on the level of scientific evidence. Results: Relationships of empathy between nurses and older people were analyzed in quasi-experimental studies using different assessment tools, the majority of which had moderate levels of validity and reliability. Studies with a qualitative approach discussed the meaning of empathy in terms of the quality of care offered, compassion, and vulnerability. Discussion: Levels of empathy increase when activities are developed with the aim of teaching, sensitization, and training for relational care between nursing staff and older people. The analysis of empathetic relationships is important to the evaluation of the quality of care provided to older people. Conclusion: Empathy in the nurse–patient relationship in the geriatric care setting is an important ethical aspect that contributes to the quality of the practice of nursing. The present findings indicate the need for more robust assessment tools with adequate psychometric properties and the descriptive analysis of empathy. (shrink)
