Use of argumentation methods applied to legal reasoning is a relatively new field of study. The book provides a survey of the leading problems, and outlines how future research using argumentation-based methods show great promise of leading to useful solutions. The problems studied include not only these of argument evaluation and argument invention, but also analysis of specific kinds of evidence commonly used in law, like witness testimony, circumstantial evidence, forensic evidence and character evidence. Recent work in artificial intelligence has increasingly turned to argumentation as a rich, interdisciplinary area of research that can provide new methods related to evidence and reasoning in the area of law. Douglas Walton provides an introduction to basic concepts, tools and methods in argumentation theory and artificial intelligence as applied to the analysis and evaluation of witness testimony. He shows how witness testimony is by its nature inherently fallible and sometimes subject to disastrous failures. At the same time (...) such testimony can provide evidence that is not only necessary but inherently reasonable for logically guiding legal experts to accept or reject a claim. Walton shows how to overcome the traditional disdain for witness testimony as a type of evidence shown by logical positivists, and the views of trial sceptics who doubt that trial rules deal with witness testimony in a way that yields a rational decision-making process. This paper presents a model for the structure of universal frameworks in logic, mathematics, and physics that are closed to logical conclusion by the mechanism of paradox across a dualism of elements. The prohibition takes different forms defined by the framework of observation inherent to the structure. Forms include either prohibition to conclusion on the logical relationship of internal elements or prohibition to conclusion based on the existence of an element not included in the framework of a first element. The (...) model is applied to logical arguments in philosophy, mathematics, and physics and is initially a geometrical analysis of quantum theory and its application in experiment. Conclusion from the analysis is extended to give insight into the complexity of infinities above the two-dimensional boundary of the model. (shrink)

This article seeks to answer why there are two different versions of Meno’s Paradox. I argue that the dilemma contained in Socrates’s version is a pre-existing puzzle, familiar to both Meno and Socrates before their discussion. The two versions of the paradox are thus different because Meno’s version is a mistaken attempt to remember the puzzle contained in Socrates’s version. Although Meno’s version is a mistaken attempt to state Socrates’s version, it is a philosophically richer puzzle that makes three interesting (...) points about inquiry and recognition. After arguing that Socrates’s version is unsound and that Meno’s version is an attempt to recollect or remember it, I analyze Meno’s version in detail. In closing, I consider the relationship between the notion of recognition, which figures prominently in Meno’s version, and the theory of recollection, suggesting that the latter may have arisen as an attempt to explain the origin of moral intuitions. This article considers what can be learned regarding the ethical acceptability of intrusive interventions intended to halt the spread of infectious disease (‘Infection Control’ measures) from existing ethical discussion of intrusive interventions used to prevent criminal conduct (‘Crime Control’ measures). The main body of the article identifies and briefly describes six objections that have been advanced against Crime Control, and considers how these might apply to Infection Control. The final section then draws out some more general lessons from the foregoing (...) analysis for the ethical acceptability of different kinds of Infection Control. (shrink)

The sexological research questionnaire, which became a central research tool in twentieth-century sexology, has a methodological-developmental history stretching back into mid-nineteenth century Germany. It was the product of a prolonged, disruptive encounter between sexual scientists constructing sexual case studies along with newly assertive homosexual men supplying self-penned sexual autobiographies. Homosexual autobiographies were intensely interesting to these men of science but lacked the brevity, structure, and discipline of a formal clinical case study. In the closing decades of the century, efforts to (...) harness and regularize this self-penned material resulted in a series of methodological adaptations. By the turn of the century this process had resulted in the first use of a formal sexual research questionnaire. (shrink)

Understanding is not of the same kind in all contexts. Children learn the kind of understanding that is appropriate in particular contexts largely through a process of enculturation. This study examines some aspects of 10-year-old children's conceptions of understanding. There was evidence that they had admissible conceptions of understanding in general but may be unable to distinguish unaided between the kinds of understanding that are relevant in different disciplines. In this volume, Mark Douglas offers a new vision of the history of Christian pacifism within the context of a warming world. He narrates this story in a way that recognizes the complexities of the tradition and aligns it with a coherent theological vision, one that shapes the tradition to encompass the new causes and types of wars fought during the Anthropocene. Along the way, Douglas draws from research in historical climatology to recover the overlooked role that climate (...) changes have always played in shaping not only the Christian pacifist tradition but also the movement of traditions through western history. Parental confidence in vaccines is waning. To sustain and improve childhood vaccine coverage rates, insights from multiple disciplines are needed to understand and address the socio-cultural factors contributing to decreased vaccine confidence and uptake.

Moral foundations theory (MFT) proposes the existence of innate psychological systems, which would have been subjected to selective forces over the course of evolution. One approach for evaluating MFT, therefore, is to consider the proposed psychological foundations in relation to the reconstructed Environment of Evolutionary Adaptedness. This study draws upon ethnographic data on nomadic forager societies to evaluate MFT. Moral foundations theory receives support only regarding the Caring/harm and Fairness/cheating foundations but not regarding the proposed Loyalty/betrayal and Authority/subversion foundations. These (...) latter two proposed foundations would seem to reflect the historical classic assumptions of modernity, involving self-interest, competition, individualism, hierarchy, authority and so forth. Studying the ethical dimensions of nomadic forager societies can highlight our biases about the foundations of morality, some of which may be steeped in particularist Western political and social traditions. Some recent developments from cosmopolitanism are discussed as an alternative evolving worldview that parallels nomadic forager ethos. (shrink)

This chapter explores some implications of the view that the woman in the rubella case has a reason to defer conception. It considers its implications for the ethics of genetic selection. Genetic selection involves choosing to bring one child into existence rather than another, based in part on the genetic characteristics of the alternative possible children. The chapter argues that potential parents have reason to pursue genetic selection to avoid having a child with a disposition to a wellbeing-reducing disease or (...) disability, a disposition to other wellbeing-reducing traits, and dispositions that tend to reduce the wellbeing of others. It considers several objections that might be raised against genetic selection. Some people would advance these objections only against the more controversial forms of genetic selection mentioned earlier: selection against non-medical traits, and selection for the benefit of third parties. Others would advance these objections even against the least controversial kind of genetic selection: selection to avoid disease or disability. (shrink)
