Martin Buber is considered one of the 20th centuryes greatest thinkers and his contributions to philosophy, theology and education are testimony to this. His thought is founded on the idea that people are capable of two kinds of relations, namely I-Thou and I-It, emphasising the centrality of dialogue in all spheres of human life. For this reason, Buber is considered by many to be the philosopher of dialogue par excellence. After Buberes death the appreciation of his considerable legacy to the (...) various disciplines in which he had worked became rather muted, but was never completely forgotten. There is now a renewed and growing interest in Buberes thought, especially in his philosophy of education. This book brings together aspects of Buberes philosophy and educational practice, and explains their significance for peace dialogue and for conflict resolution, both between individuals and communities. Buber's philosophy of dialogue and views on education are pivotal in demonstrating the personal and social benefits of dialogical education as well as the dangers of non-dialogical education. This paper argues that a strong thesis of divine providence, whereby God is understood as in complete control of all things, entails pantheism, the thesis that the universe is not ontologically distinct from God. In normal discourse, we distinguish a plan from, on the one hand, the state of affairs which realizes that plan—its execution or expression—and, on the other hand, the person or group whose plan it is. However, with respect to an omnipotent God who displays complete providence, neither (...) of these two distinctions holds. We cannot separate person from plan, or plan from world, and in consequence, neither can we separate person from world, ergo pantheism. Accordingly, the argument of this paper comes in two parts maintaining, first, the impossibility of distinguishing between God’s plan and its execution and, second, the impossibility of distinguishing God himself from his plan. The genetically-modified-organism (GMO) experience has been prominent in motivating science, industry, and regulatory communities to address the social and ethical dimensions of nanotechnology. However, there are some significant problems with the GMO-nanotech analogy. First, it overstates the likelihood of a GMO-like backlash against nanotechnology. Second, it invites misconceptions about the reasons for public engagement and social and ethical issues research as well as their appropriate roles in nanotech research, development, application, commercialization, and regulatory processes. Until about thirty years ago, the extent of disclosure about and consent-seeking for medical interventions was influenced by a beneficence model of professional behaviour. Informed consent shifted attention to a duty to respect the autonomy of patients. The new requirement arrived on the American scene in two separate contexts: for daily practice in 1957, and for clinical study in 1966. A confusing double standard has been established. 'Daily consent' is reviewed, if at all, only in retrospect. Doctors are merely exhorted (...) to obtain informed consent; they often minimise uncertainties about 'best' treatment and they feel duty-bound to provide patients with an unequivocal recommendation for action. 'Study consent' in a clinical trial is reviewed prospectively, and doctors are compelled by regulation to point out that there is insufficient evidence to make a rational choice between two compared treatments. It has been impossible to devise informed consent practices that satisfy, in full, the competing moral imperatives of respect for autonomy, concern for beneficence with emphasis on the value of health, and a vigil for justice. A way must be found to experiment with various discretionary approaches that would strike a realistic balance among competing interests. (shrink)

In debates about genetic testing of children, as well as about disclosing unsolicited findings (UFs) of pediatric exome sequencing, respect for future autonomy should be regarded as a prima facie consideration for not taking steps that would entail denying the future adult the opportunity to decide for herself about what to know about her own genome. While the argument can be overridden when other, morally more weighty considerations are at stake, whether this is the case can only be determined in (...) concrete cases. Importantly, when children grow into adolescents, respect for future autonomy will have to give way to respecting their emerging autonomy. When pediatric exome sequencing is done for complex conditions not involving developmental delay, respect for the child’s future or emerging autonomy should be a primary consideration for those charged with deciding on behalf of the child. Building on what Emanuel and Emanuel have termed the ‘deliberative model’ of shared decision making, we argue that if parents fail to give these considerations their due, professionals should actively invite them to do so. Taking a directive stance may be needed in order to make sure that the future or emerging autonomy of the child are duly considered in the decision-making process, but also to help the parents and themselves to shape their respective roles as responsible care-givers. Models of the EPR-Bohm experiment usually consider just two times, an initial time, and the time of measurement. Within such analyses, it has been argued that locality is equivalent to determinism, given the strict correlations of quantum mechanics. However, an analysis based on such models is only a preliminary to an analysis based on a complete dynamical model. The latter analysis is carried out, and it is shown that, given certain definitions of locality and determinism for completely dynamical models, locality (...) implies, but is not implied by, determinism. Further, it is suggested that a local deterministic model has not been ruled out by Bell's theorem. It is suggested that such a model could naturally deny the independence of initial complete states from the settings of the apparatuses (a crucial assumption in the derivation of Bell's inequality). This paper deals with four ethical issues in the development and application of business and management knowledge. The issues examined are: (1) failure to adopt or disclose knowledge with proven value that could benefit individuals, organizations, and society; (2) inappropriate implementation or incomplete disclosure of knowledge with proven potential; (3) use of knowledge for the exclusive benefit of a selected interest group even if harm is done to others; and (4) intentional falsification or misrepresentation of knowledge as something other than (...) what it is known to be. Each of these issues are illustrated with actual case histories and are examined using frequently accepted ethical concepts. (shrink)

Even lawyers who obey the law often seem to act unethically--interfering with the discovery of truth, subverting justice, and inflicting harm on innocent people. Standard arguments within legal ethics attempt to show why it is permissible to do something as a lawyer that it would be wrong to do as an ordinary person. But in the view of most critics these arguments fail to turn wrongs into rights. Even many lawyers think legal ethics is flawed because it does not accurately (...) describe the considerable moral value of their work. In Lawyers and Fidelity to Law, Bradley Wendel introduces a new conception of legal ethics that addresses the concerns of lawyers and their critics alike.Wendel proposes an ethics grounded on the political value of law as a collective achievement that settles intractable conflicts, allowing people who disagree profoundly to live together in a peaceful, stable society. Lawyers must be loyal and competent client representatives, Wendel argues, but these obligations must always be exercised within the law that constitutes their own roles and confers rights and duties upon their clients. Lawyers act unethically when they treat the law as an inconvenient obstacle to be worked around and when they twist and distort it to help their clients do what they are not legally entitled to do. Lawyers and Fidelity to Law challenges lawyers and their critics to reconsider the nature and value of ethical representation. (shrink)

What are the limits of Left Wittgensteinianism's point- and need-based account of conceptual change? Based upon Wittgenstein's account of certainty and the riverbed analogy for conceptual change in On Certainty, the question is raised whether Queloz and Cueni's redevelopment of Left Wittgensteinianism can account for the multiplicitous forms of change these concepts are subject to. I argue that Left Wittgensteinianism can only partially do so, because it overemphasises the role of criticism-driven conceptual change, due to its focus on the reason-based (...) contingency of the practices of a local ‘we’. In response, it is argued that Left Wittgensteinianism should be fortified with (i) gradual changes to concepts' sociocultural constraints that concept-users are unaware of and (ii) evolutionary and environmental changes to the biological determinants of natural constraints of conceptual cores. In the end, there are conceptual practices like holding for certain that are generally, and fully contingent, but simultaneously inevitable not only for ‘us’ but also for many other delimitations of ‘we’. Subsequently, the compatibility of this Wittgensteinian account of conceptual change with pragmatic genealogy is discussed. It is concluded that thinking about conceptual changes to practices cannot be about the possibility of criticism alone nor succeed without the inclusion thereof. (shrink)
