When is an indirect report of what a speaker meant correct? The question arises in the law. The Contract Law case of Spaulding v. Morse is a good example. Following their 1932 divorce, George Morse and Ruth Morse entered into a trust agreement in 1937 for the support of their minor son Richard. In that agreement, George promised to “pay to [Spaulding as] trustee in trust for his said minor son Richard the sum of twelve hundred dollars (...) per year, payable in equal monthly installments on the first day of each month until the entrance of Richard D. Morse into some college, university or higher institution of learning beyond the completion of the high school grades, and thereupon, instead of said payments, amounting to twelve hundred dollars yearly, he shall and will then pay to the trustee payments in the sum of twenty-two hundred dollars per year for a period of said higher education but not more than four years.” Richard graduated from high school on February 5, 1946 and, in the post-WWII continuation of the draft, was inducted into the army the following day. The question in the case is whether George, by the words of the trust agreement, meant that he would pay $1,200 per year for Richard’s support while he was in the army. Is that a correct indirect report of what George meant?The explanation I offer assumes Gricean analysis of speaker meaning, and it emphasizes the role of speaker meaning typically plays in solving coordination problems. A coordination problem is a situation “in which each person wants to participate in a group action but only if others also participate.” A classic example is a political protest: “each person might want to take part in an antigovernment protest but only if there are enough total protesters to make arrests and police repression unlikely.” Coordination problems arise in more mundane settings as well – in Spaulding v. Morse, for example. Ruth and George want to mutually agree on Richard’s support: Ruth wants to commit to an arrangement only if George does, and vice versa for George. In 1937, George and Ruth solved the problem through speaker meaning. By signing the trust agreement, George, with Ruth as his audience, meant that he obligated himself to a particular support agreement. When Ruth signed, she, with George as her audience, meant that she accepted the agreement. In general, parties often solve coordination problems through speaker meaning. If, for example, enough people can communicate their commitment to participate in the protest to enough people, the protest will take place.The account assigns a central role to the fact that speaker meaning facilitates coordination by creating relevant common knowledge. Common knowledge is “the recursive belief state in which A knows X, B knows X, A knows that B knows X, B knows that A knows X, ad infinitum.” Common knowledge facilitates coordination: “Actors coordinate when they have evidence for common knowledge, and refrain from coordinating when they do not.”. Moreover, as this autobiography relates at a fast-moving pace, Morse has also been involved in the high-pressure concerns of war research, scientific administration and consultation, policy formation, the education of key groups and wider publics beyond the classroom, and the real-world utilization of scientific techniques and discoveries. For all these accomplishments, Morse writes that his experience as a scientist and as a participant in the affairs of his time "has been at the second, rather than at the top, level." It may be that this circumstance of being neat, rather than at, the top makes this autobiography more, rather than less, relevant to other and younger scientists, to those considering a life in science, and to general readers curious as to what such a life is really like. Only a miniscule few reach, say. Einsteinian levels, and their lives and work tend to be unique unto themselves; what Morse reports is truer to the experience of the great majority of the members of the scientific community. While his actual accomplishments, his range, and his eminence certainly far exceed those of a "typical" scientist, they do so more in degree than in kind. The authors of the articles in this special section discuss an array of psychological perspectives on emotion. The articles provide only a limited consideration of status and power processes, however, which play a larger role in sociological theories of emotion than in psychological ones. Here, I examine the ways in which the theories account for status and power and suggest opportunities for greater inclusion of these key facets of social structure.

An ongoing challenge facing emotion researchers is finding appropriate measurement tools. Many of our theories focus on emotion in the context of dynamic interaction, yet many of our most relied-upon measures either interrupt or alter interaction. New research suggests that infrared thermography may be useful as a nonintrusive way to measure emotion. Here we discuss the viability of thermography for studying emotion response and advancing emotion theory.

In this article a case is made for the importance of a previously overlooked phenomenon, physical empathy orcompathy,defined as the physical manifestation of caregiver distress that occurs in the presence of a patient in physical pain or distress. According to the similarity of a caregiver's response to the original symptoms, there can be four types of compathetic response: identical, initiated, transferred, and converted. Controlling for the compathetic response may involve narrowing one's focus and/or changing caregiver attitudes. The late William Righter's fine and discriminating intelligence helps us to think this (...) through. This is no standard monograph on Henry James. While well-aware of the critical traditions of Jamesian scholarship (and the knowledgeable will be able to detect in his sensitive and often enlightening readings of the texts his engagement with those traditions), Righter sits lightly to this scholarship, ploughing his own furrow, using the later work of Henry James as a lens to question "void and value" in twentieth-century and, by extension, contemporary culture. American Memory in Henry James is elegantly, and indeed sometimes elusively, written, as befits a work on a man whose own stylistic stringency is, alas, so often not emulated by academic writings on his work. The flipside of this, of course, is that a reasonably educated background, including some acquaintance with James's texts, is assumed.Righter is concerned to explore the capacity of the novel form as represented by James to apprehend, through formal arrangement, the apparent incommensurability of the forces that drive history, culture, and human psychology on the one hand, and the frameworks of intelligibility and value within which we seek to live and by means of which we seek to exercise some control over them, on the other. James is apt for this purpose since he focuses on cultural dislocations, between America and Europe, and between past and present. America, for James, represents the overcoming of a late nineteenth-century tradition of civility (primarily, in his case, transcendentalist and Unitarian) by big business and the criteria of capitalism. This precipitates a split between "wasp" culture and an alienated, urban culture, both in danger of losing touch with their roots. Europe, of course, stands for continuity, in this specifically cultural sense, rather than rupture, and the project of importing European culture into America through museums (The Golden Bowl is very much in point here) is one of the ambiguities to which the text recurs.The first part, "America Deconstructed," sets the stage, using James's The [End Page 447] American Scene to analyze his notions of historical change and progression, and their implications for a sense of stable American identity. How is a society so committed to change and progress to honor its past creatively? Part two, "The Note of Europe," engages with The Ambassadors, seeing the victory of Wollett as an indication of the insubstantiality of a certain type of expatriate community, of Americans seeking to take on European culture. The main weight of the text is taken by the engagement with The Golden Bowl, to which the next two parts are dedicated. "Amerigo in American Nowhere" explores the way in which the central characters operate in a sort of void, with social context stripped away to reveal the dynamics of their failed equilibrium. In this, "America" and "England" have become virtually typological symbols. In the light of this reading of the text, Part four, "A Dark Fable of Love and Power," explores the implications for our shaping intelligence, especially ethical intelligence. In suggestive dialogue with Putnam and Nussbaum, Righter points to the difficulty of seeing the relevance of anything like the Categorical Imperative to The Golden Bowl. Rather, in this novel "the language of morality has been examined, picked up, turned over, taken to pieces. But this very process has in the end indicated its unsuitability as an ultimate explanatory scheme." He argues that James poses the possibility that the novel "adds up to a total story which is intelligible beyond the possibilities of a conceptual sorting out" (pp. 154-55).But this raises the question of what the criteria for intelligibility could be in such a case, if beyond the conceptual lies the imaginative. In this paper the principle that the boundary of a boundary is identically zero (∂○∂≡0) is applied to a skeleton geometry. It is shown that the left-hand side of the Regge equation may be interpreted geometrically as the sum of the moments of rotation associated with the faces of a polyhedral domain. Here the polyhedron, warped though it may be, is located in a lattice dual to the original skeleton manifold. This sum is related to the amount of energy-momentum (E-p) (...) associated to the edge in question. In the establishment of this equation the ordinary Bianchi identity is rederived by applying the principle that the (∂○∂≡0) in its (1–2–3)-dimensional formulation to polyhedral domain. Steps toward the derivation of the contracted Bianchi identity using this principle in its (2–3–4)-dimensional form are discussed. Preliminary results in this direction indicate that there should be one vector identity per vertex of the skeleton geometry. “Space acts on matter, telling it how to move. While it is generally agreed that companies need to manage their relationships with their stakeholders, the way in which they choose to do so varies considerably. In this paper, it is argued that when companies want to communicate with stakeholders about their CSR initiatives, they need to involve those stakeholders in a two-way communication process, defined as an ongoing iterative sense-giving and sense-making process. The paper also argues that companies need to communicate through carefully crafted and increasingly sophisticated processes. Three (...) CSR communication strategies are developed. Based on empirical illustrations and prior research, the authors argue that managers need to move from ‘informing’ and ‘responding’ to ‘involving’ stakeholders in CSR communication itself. They conclude that managers need to expand the role of stakeholders in corporate CSR communication processes if they want to improve their efforts to build legitimacy, a positive reputation and lasting stakeholder relationships. AI-driven decisions can draw data from virtually any area of your life to make a decision about virtually any other area of your life. That creates fairness issues. Effective regulation to ensure fairness requires that AI systems be transparent. That is, regulators must have sufficient access to the factors that explain and justify the decisions. One approach to transparency is to require that systems be explainable, as that concept is understood in computer science. A system is explainable if one can (...) provide a human-understandable explanation of why it makes any particular prediction. Explainability should not be equated with transparency. To address transparency and characterize its relation to explainability, we define transparency for a regulatory purpose. A system is transparent for a regulatory purpose (r-transparent) when and only when regulators have an explanation, adequate for that purpose, of why it yields the predictions it does. Explainability remains relevant to transparency but turns out to be neither necessary nor sufficient for it. The concepts of explainability and r-transparency combine to yield four possibilities: explainable and either r-transparent or not; and not explainable and either not r-transparent or r-transparent. Combining r-transparency with ideas from the Harvard computer scientist Cynthia Dwork, we propose four requirements on AI systems. (shrink)

Background: Many people participating in dementia research may lack capacity to give informed consent and the relationship between cognitive function and capacity remains unclear. Recent changes in the law reinforce the need for robust and reproducible methods of assessing capacity when recruiting people for research.Aims: To identify numbers of capacitous participants in a pragmatic randomised trial of dementia treatment; to assess characteristics associated with capacity; to describe a legally acceptable consent process for research.Methods: As part of a pragmatic randomised controlled (...) trial of Ginkgo biloba for mild-moderate dementia, we used a consenting algorithm that met the requirements of existing case law and the exigencies of the new Mental Capacity Act. We decided who had capacity to give informed consent for participation in the trial using this algorithm and sought predictors of capacity.Results: Most participants with mild-moderate dementia in this trial were unable to give informed consent according to the legal criteria. When adjusted for confounding, the Mini Mental State examination did not predict the presence of capacity.Conclusion: Cognitive testing alone is insufficient to assess the presence of capacity. Researchers and clinicians need to be aware of the challenging processes regarding capacity assessment. We outline a procedure which we believe meets the ethical and legal requirements. (shrink)

Argument and imagination are often interdependent. The Aesthetics of Argument is concerned with how this relationship may bear on argument's concern with truth, not just persuasion, and with the enhancement of understanding such interdependence may bring. The rationality of argument, conceived as the advancement of reasons for or against a claim, is not simply a matter of deductive validity. Whether arguments are relevant, have force, or look foolish cannot always be assessed in these terms. We develop a framework for understanding how lack of clarity in business press coverage of corporate social responsibility functions as a mediated and emergent form of strategic ambiguity. Many stakeholders expect CSR to exhibit clarity, consistency, and discursive closure. But stakeholders also expect CSR to conform to varying degrees of both formal and substantive rationality. These diverse expectations conflict with each other and change over time. A content analysis of press coverage in Denmark suggests that the business media reflect and (...) amplify the ambiguity generated by these shifting demands. We propose that this very public lack of discursive closure provides strategic advantages to CSR stakeholders by rendering the concept of CSR adaptable, resilient, and meaningful to diverse interests. From this perspective, strategic ambiguity emerges from a relational and mediated process, not from the direct intentions of individual stakeholders. Our framework suggests that CSR is best understood not as a clear or consistent agenda, but rather as a forum for sensemaking, diversity of opinion, and debate over the conflicting social norms and expectations attached to corporate activity. This Essay examines the elegantly simple idea that consent to medical treatment or participation in human research must be “informed” to be valid. It does so by using as a case study the controversial clinical research trial known as the Surfactant, Positive Pressure, and Oxygenation Randomized Trial. The Essay begins by charting, through case law and the adoption of the common rule, the evolution of duties to secure fully informed consent in both research and treatment. The Essay then utilizes the (...) SUPPORT study, which sought to pinpoint the level of saturated oxygen that should be provided to extremely low birth weight infants to demonstrate modern complexities and shortcomings of the duty to secure informed consent. This Essay shows how the duty is measured by foreseeability of risks and benefits in human research and why federal regulators believed the tradeoffs in risk and benefits from differing oxygen levels administered in the support study were foreseeable. It then explores the contours of the duty to secure informed consent when applied to researchers who also serve as treating physicians, highlighting how common law duties differ in jurisdictions that apply the professional standard and those that apply the patient-centered material risk standard. This Essay provides new insight into what the law must do to make real the notion that [e]very human being of adult years and sound mind has a right to determine what shall be done with his body.”. This article considers whether psychopaths should be held criminally responsible. After describing the positive law of criminal responsibility in general and as it applies to psychopaths, it suggests that psychopaths lack moral rationality and that severe psychopaths should be excused from crimes that violate the moral rights of others. Alternative forms of social control for dangerous psychopaths, such as involuntary civil commitment, are considered, and the potential legal implications of future scientific understanding of psychopathy are addressed.
