Intensive professional testing of children with disabilities is becoming increasingly prominent within the field of children’s rehabilitation. In this paper we question the high quality ascribed to standardized assessment procedures. We explore testing practices using a hermeneutic-phenomenological approach analyzing data from interviews and participant observations among 20 children with disabilities and their parents. All the participating children have extensive experience from being tested. This study reveals that the practices of testing have certain limitations when confronted with the lived experience of (...) those who are being tested. Testing seems to transmit the experts’ view of what is important, correct and admirable, and the way in which an individual child fulfills such requirements and fits in with the predetermined standard. Regular testing may result in insecurity on the part of the tested individual, and possibly to a lack of confidence in their body and the way it functions. For the individual being tested the meaning of testing is primarily related to passing or not passing the test requirements. Given the meaning of testing, children with disabilities may experience repeated testing as an ordeal that they are expected to put up with. By illuminating the experiences of the ones exposed to testing, this paper offers new insight for professionals to gauge more accurately the quality of contemporary testing practice. (shrink)

It has been quite a year so far(!) and as the wenches we are, we have been taking our time to collect our thoughts and reflections before sharing them at the start of this issue of the journal. In this editorial we think through the COVID-19 pandemic and its devastating effects on the world, on our lives and on our editorial processes. We renew our commitment to improving our operations as a journal and its health along with our own as (...) we deploy wench tactics to restore, sustain and slow down to negotiate this new reality, this new world. We conclude with an introduction to the fascinating contents of this issue along with a collaborative statement of values on open access as part of a collective of intersectional feminist and social justice editors. Through all of the pain and suffering we focus our gaze on hope: hope that we can come through this global crisis together engaging in critical conversations about how we can be better and do better as editors, academics and individuals for ourselves, our colleagues and our journal. Picking up the question of what FLaK might be, this editorial considers the relationship between openness and closure in feminist legal studies. How do we draw on feminist struggles for openness in common resources, from security to knowledge, as we inhabit a compromised space in commercial publishing? We think about this first in relation to the content of this issue: on image-based abuse continuums, asylum struggles, trials of protestors, customary justice, and not-so-timely reparations. Our thoughts take us through the different (...) ways that openness and closure work in struggles against violence, cruel welcomes, and re-arrangements of code and custom. Secondly, we share some reflections on methodological openness and closure as the roundtable conversation on asylum, and the interview with Riles, remind us of #FLaK2016 and its method of scattering sources as we think about how best to mix knowledges. Thirdly, prompted by the FLaK kitchen table conversations on openness, publishing and ‘getting the word out’, we respond to Kember’s call to ‘open up open access’. We explain the different current arrangements for opening up FLS content and how green open access, the sharedit initiative, author request and publisher discretion present alternatives to gold open access. Finally drawing on Franklin and Spade, we show how there are a range of ‘wench tactics’—adapting gifts, stalling and resting—which we deploy as academic editors who are trying to have an impact on the access, use and circulation of our journal, even though we do not own the journal we edit. These wench tactics are alternatives to the more obvious or reported tactic of resignation, or withdrawing academic labour from editing and reviewing altogether. They help us think about brewing editorial time, what ambivalence over our 25th birthday might mean, and how to inhabit painful places. In this, we respond in our own impure, compromised way to da Silva’s call not to forget the native and slave as we do FLaK, and repurpose shrapnel, in our common commitments. (shrink)

Catherine Hoffmann's Free Lunch with the Stench Wench is a performance of abjection and self-abjection through poverty with an apotropaic aspiration: to shed the shame through sharing, and to create opportunities for a common social subjectivity that refuses to be silent about the struggle of its own creation and maintenance. Despite its title, Free Lunch does not come with a free lunch for the audience but creates an olfactory situation, through the onstage cooking of hot chocolate and the presence of (...) a dead rat, which complements Hoffmann's narration and stage presence into a synaesthetic portrait of poverty and its psychosocial fallout. Drawing on the psychological foundations of shame studies, sociological approaches and social-theoretical responses to austerity and social division, I propose to examine the gendered embodiment of shame and its exorcism in Hoffmann's performance, focusing on its physical codification in and beyond the visual. I explore the potential of shame to be re-weaponized against those who originally inflict it, and consider the shame that haunts every creative act, especially those with high political stakes: the failure to make a connection, the fear of being misunderstood. David Gauthier in his article, Maximization constrained: the rationality of cooperation, tries to defend of the joint strategy in situations which no outcome is both equilibrium and optimal. Prisoner’s Dilemma is the most familiar example of these situations. He first starts with some quotes by Hobbes in Leviathan; Hobbes, in chapter 15 discusses an objection by someone is called Foole, and then will reject his view. In response to Foole, Hobbes presents two strategies (i.e. joint and individual) and two kinds (...) of agents in such problems including Prisoner’s Dilemma – i.e. straightforward maximizer (SM) and constrained maximizer(CM). Then he considers two arguments respectively for SM and CM, and he will show that why in an ideal and transparent situation, the first argument fails and the second one would be the only valid argument. likewise, in the following part of his article, he considers more realistic situations with translucency and he concludes that under some conditions, joint strategy would be still the rational decision. In 1896 William James published an essay entitled The Will to Believe, in which he defended the legitimacy of religious faith against the attacks of such champions of scientific method as W.K. Clifford and Thomas Huxley. James's work quickly became one of the most important writings in the philosophy of religious belief. James Wernham analyses James's arguments, discusses his relation to Pascal and Renouvier, and considers the interpretations, and misinterpretations, of James's major critics. Wernham shows convincingly that James was unaware (...) of many destructive ambiguitities in his own doctrines and arguments, although clear and consistent in his view that our obligation to believe in theism is not a moral but a prudential obligation -- a foolish-not-to-believe doctrine, rather than a not-immoral-to-believe one. Wernham also shows that the doctrine is best read as affirming the wisdom of gambling that God exists, a notion which James failed to distinguish from believing and which, among other things, he explicitly identified with faith. James's pragmatism, a theory concerning the meaning of truth, is shown to be quite distinct from the doctrine of The Will to Believe. In concentrating on a careful analysis of this doctrine of the will-to-believe, Wernham not only makes a major contribution to understanding James's philosophy, but also clarifies issues in the philosophy of religion and in the analysis of belief and faith. Gilligan’s (1982) refinement of Kohlberg’s theory on moral development operates on two theses: (1) females, more so than males, reach moral decisions based on the personalities of the relevant individuals; and (2) female behaviors stemming from moral decisions are based upon “care” and “responsibility for others.” This article accepts the first thesis but argues that the second is incorrect. That is, self-interest—i.e., aiding “blood” kin and/or carefully monitoring reciprocity—rather than “altruism” is argued to be the operant dynamic in forging distaff (...) morality and resultant behavior. Six empirical examples are presented as contraindicative of Gilligan’s second thesis. Finally, it is suggested that selection for the psychological traits of independence and the mastery of subtle social chess yielded ancestral females who had more descendants—us—than did females with alternative profiles. This article delineates the core concerns and motivations of the ontological work of Gilles Deleuze, and is intended as a programmatic statement for a general philosophical audience. The article consists of two main parts. In the first, two early writings by Deleuze are analysed in order to clarify his understanding of ontology broadly, and to specify the precise aim of his understanding of being in terms of difference. The second part of the article looks at the work of Heidegger and (...) Derrida in order to distinguish Deleuze's conceptions of ontology and difference from theirs. A final section clarifies Deleuze's efforts to undertake the construction of an ontology divergent from the dominant tradition and in contrast to the emphasis on the closure of metaphysics in the thought of Heidegger and Derrida. In lieu of an abstract, here is a brief excerpt of the content:167. ON McRAE' S HUME Professor McRae's interesting paper may be rather naturally divided into two parts. In the first part he explains what he takes Hume's account of time to be; in the second he advances the bold thesis that Hume's account of time, or perhaps of duration, provides a basis or foundation for his more widely discussed remarks on identity, substance, the self, the necessary connections. In (...) what follows I first reconstruct Professor McRae' s paper, and then I raise some problems, perhaps puzzles, about Hume's view on duration, time and fictions. According to McRae, some philosophers (Descartes, Spinoza, Leibniz) distinguish between time and duration, both of which are taken to be perfectly legitimate notions. Hume, by contrast, takes time and duration to be the same, viz., a succession of moments. What philosophers and the vulgar call 'duration' is something quite different, namely a single unbroken stretch of time which is not composed of successive parts. Of duration taken in this latter way, McRae says, Hume has four things to say, all of them negative: (1) we have no idea of duration; (2) no object has duration; (3) there is no such thing as duration; and (4) duration is a fiction. Properly understood as a succession of moments, however, time certainly exists and is thus not a fiction. Moreover, we have the or at least an idea of time, despite the fact that it is obtained without derivation from a precedent impression. And, while no object can be said to have time, Hume will nonetheless allow that objects exist at certain times and perhaps across a time span. In the second part of his paper, Professor McRae distinguishes two types of Humean fictions. The first arises when one idea is confused with another and mis-applied to some object. The second arises when the imagination creates an "idea" in the attempt to resolve a 168. contradiction which comes up when the first fiction is applied to an object. What I have called McRae' s "bold thesis" in the second part of his paper can now be stated. Duration, or the putative idea thereof, is a fiction of the first type, one that is attributed to what Hume calls "steadfast objects." However, such an object can be considered in two ways. One might consider the object at two stages of this duration and, McRae says, "...this will give us the idea of number" (p. 126); or, one might consider in turn a series of objects, each of them supposedly "steadfast," all along supposing that though time is changing, the objects are not, and "...in this way- we get the idea of unity" (Ibid.). But no object is both a unity and a multiplicity. So, to reconcile these conflicting considerations, the "idea" or fiction of identity is invented. As McRae says: "The idea of identity is a pure product of the imagination invented to mediate between unity and number" (Ibid. ). This invented "idea" is then mis-applied (a fiction of type one) to interrupted appearances of an object. To reconcile the supposed identity of an object with successive appearances of it, the fiction of substance is invented. Quoting both McRae and Hume, In order to reconcile the contradiction between identity and diversity, the imagination is apt to feign something unknown and invisible, which it supposes to continue the same under all these variations ; 2 and this unintelligible something it calls a substance... (p. 128). Related needs to resolve contradictions, on McRae' s account, lead to the fictions of the self (p. 128) and of necessary connections (p. 130), though the latter fiction is of type one. Hence, McRae' s "bold thesis" amounts to this: Duration is a fiction. In the attempt to apply this fiction, one is led to, logically led to, most, if not all, of the other famous Humean fictions. And, if we allow that there are mental acts, for Hume, as well as impressions and ideas, "...then a fictitious duration will be attributed to 169. objects and by a progressive compounding of fictitious mental actions will give the world the ontological structure which it has for the vulgar belief we all share.
