This kinship between Dewey and psychodynamic perspectives is found in its rejection of atomistic experience and its emphasis on the felt dimensions of experience. Although the recent revival of interest in Dewey has most often linked him with a more linguistic pragmatism and epistemology, Henning moves away from that trend to re-engage with Dewey's "cultural naturalism," returns to the question of what Dewey means by "experience," and advocates for the value of the non-linguistic, non-cognitive portion therein.It is through Dewey's theory of quality that Henning finds a clear connection to the unconscious. Dewey holds that we live in a qualitative world, that we experience the world as affectively charged, and he claims that things come together only insofar as they are pervaded by a single unifying quality. The process of knowing anything begins first in an immediate, sensuous, and affective experience, a dimension that eludes linguistic symbols. That is, there is an ineffable portion of experience that supports our discursive practices and can never be exhausted by them. Responding to comments on “Imre Lakatos and the Inexhaustible Atom: The Hidden Marxist Roots of History and Philosophy of Science,” an argument is made for reviving a missed opportunity for integrating sociological and normative approaches to science. Lakatos’ mature philosophy of science, though jettisoning a political commitment to Marxism, retains a dialectical approach developed during his Hungarian career. Through his carefully crafted debate with Feyerabend, Lakatos continued to promote a dialectical approach that offers a useful model for integrating the history (...) of science and normative assessments focused on the viability of approaches that challenge dominant perspectives. Bloomington and Indianapolis: Indiana University Press, 2003, 167 pp., $19.95 paper.The resurgence of interest in pragmatism, especially in regard to the work of John Dewey, has been ongoing for several decades now. In addition to the development of neo-pragmatism with its appreciation of the deconstructive side of Dewey, there have also been numerous books (...) written on the constructive side of pragmatism, including pragmatist aesthetics, metaphysics, politics, and education. An interest in pragmatist ethics, though later coming, seems to be picking up some steam at last, and Steven Fesmire's book, John Dewey & Moral Imagination, is an important contribution to that burgeoning area of inquiry.While Fesmire's book is not a full-blown account of a Deweyan moral theory, a fact he makes clear from the [End Page 107] outset, it is an insightful and important development of the role of aesthetics, inquiry, and imagination within a Deweyan framework. Fesmire is not interested in simply explicating Dewey's view of imagination, but in further developing Dewey's sometimes cryptic comments on the subject. But even more than that, Fesmire explicitly notes that he is going beyond Dewey, though Dewey is his starting point (p. 4). And in this enterprise, the book is successful, as Fesmire's development is very much in the spirit of Dewey's empiricism. That having been said, however, there are some elements of Dewey's ethics that I believe are important to Fesmire's interpretation, but do not receive enough attention in his book. In addition, the centrality of imagination seems somewhat overstated, sometimes to the detriment of other central notions. I will address these concerns later.In the Introduction, Fesmire states three interrelated theses that he builds a case for: "(1) Moral character, belief, and reasoning are inherently social, embodied, and historically situated; (2) Moral deliberation is fundamentally imaginative and historically situated; (3) Moral conduct is helpfully conceived on the model of aesthetic perception and artistic creation" (p. 4). He goes on to note that the first two are clearly and articulately defended by Dewey, and the third is "inspired" by him, but, clearly, this latter one he sees as a further development of Dewey's ethics.In order to build his case, Fesmire spends Part I of the book elaborating the "pragmatic turn" and its conception of "character, belief, inquiry, and intelligence" (p. 4). This first part is necessary in order to keep the second, more developmental part from seeming a piecemeal dialogue with traditional ethical theories. In other words, Part I contextualizes Part II.In the opening chapter, "Habit and Character," Fesmire contrasts the Deweyan notion of character with the traditional atomistic conception of the individual. As Dewey points out, it isn't that moral conduct ought to be social; rather it is social by its very nature (p. 13). Indeed, character and habits are socially derived from our cultural context. Moral inquiry is, then, social at its very base. Using the example of Studs Lonigan, Fesmire continues to develop these notions through a fascinating discussion of the James T. Farrell character. The application of the Deweyan notion of character and habit is a natural fit here, given that Farrell wrote his trilogy as an explicit exploration of Dewey's notion of habit. Through this discussion, we see the ongoing struggle of the individual and the environment, with the ultimate lesson learned being that one cannot be separated from the other, though either can be destructive of the other. Fesmire then applies this same essential idea to nature and culture. As Fesmire notes, "Dewey's goal was to break down the barriers that separate nature from culture, to show that biological drives are transmuted by social life, that neither impulse nor culture simply trumps the other, and that culture lends itself as much to intelligent conservation and critical redirection as to transmission" (p. 23). The lesson to learn from all of this is that the individual is not, as much traditional moral theory has supposed, a detached decision maker who can, by a simple act of will, follow some categorical imperative. In _The __Critical Advantage_, noted scholar and early childhood expert William T. Gormley, Jr. takes a wide-ranging look at the important role of critical thinking in preparing students for college, careers, and civic life. Drawing on research from psychology, philosophy, business, political science, neuroscience, and other disciplines, he offers a contemporary definition of critical thinking and its relationship to other forms of thinking, including creative thinking and problem solving. When defined broadly and taught early, he argues, critical thinking is (...) a “potential cure for some of the biggest problems we face as a nation,” including education deficits, employment deficits, and the recent surge of partisanship in democratic politics. While there are encouraging signs—the Common Core State Standards have drawn attention to the importance of critical thinking—recent efforts have been too narrowly focused on improving textual analysis in high school. Those who might benefit the most from curricula prioritizing critical thinking, including disadvantaged students, are less likely to be represented in courses and other activities that encourage this skill. Gormley argues for prioritizing critical thinking skills in PreK–12. He takes readers into innovative classrooms around the country, including schools in Pennsylvania, Oklahoma, and Virginia, and offers specific recommendations for promoting critical thinking and embedding it across the curriculum. _The Critical Advantage_ is an insightful and fascinating account of an intellectual journey culminating in a fresh vision for the future of US schooling. The attempt to utilize the methods of science to justify one ethical code as opposed to another has the advantage of avoiding the dogmatism and question-begging techniques characteristic of many traditional ethical theories. However, such attempts are invariably involved in value reductionism, leaving normative terms bereft of their normative import. Science is related to ethics in a number of important ways, but not in the sense that inductive evidence can justify one standard of right conduct as opposed to others.

This article is part of a Symposium that examines the legal and policy issues raised by the Schwarzenegger bobblehead doll litigation, in which a Hollywood star-turned-governor sued under California's right of publicity laws and under federal copyright law to stop a small Ohio company from selling a bobblehead doll depicting Schwarzenegger in a business suit, with a bandolier of bullets, and brandishing an assault rifle. The article contends that defendants' unauthorized use of the Schwarzenegger image on dolls and their accompanying (...) packaging was permissible as First Amendment-protected free speech under California's right of publicity laws and also constituted fair use under federal copyright law. The article rejects the argument that a First Amendment defense to plaintiff's right of publicity claims was unavailable because a bobblehead doll is not a "traditional" medium of expression for ideas. The article recognizes that overly expansive assertions of rights of publicity and other intellectual property rights threaten to stifle creative expression and diminish the cultural commons. The article also calls for clearer and more consistent recognition of defenses to right of publicity claims, particularly for cases where a defendant's unauthorized appropriation of another's image or likeness is for purposes of caricature, parody, or satire¿especially where the image is that of a politician. It concludes that the settlement of the Schwarzenegger bobblehead doll case illustrates how "strategic" assertions of even objectively non-meritorious rights of publicity can allow powerful plaintiffs to censor unflattering depictions of them and to unduly expand intellectual property rights without full adjudication on the merits of such claims.This insight is critical, because while other scholars have suggested that the "over-protection" of intellectual property rights (including rights of publicity) has a deleterious effect on freedom of expression and the public domain, these criticisms focus almost exclusively on published appellate cases. Yet, as this article reminds us, most cases settle and never become litigated cases, much less published appellate decisions. And most disputes - including intellectual property disputes - never result in formal litigation in the first instance. As with most other areas of the civil disputing process, intellectual property disputes are processed in the "shadow of the law", where repeat players have strategic advantages to shape the outcomes of disputes in their favor. Thus, if we want to know whether intellectual property rights are over-protected, we need to know what happens (and why) in the shadow of intellectual property law. This insight is the basis for the author's empirical research-in-progress focusing on "strategic intellectual property enforcement" by owners of trademarks, copyrights, and patents, including enforcement that never results in litigation and is thus under the radar of what most legal scholars in this area of law examine. A set of eight criteria for a satisfactory theory of educational aims at the primary level is proposed. The concept of neutrality is developed with respect to educational aims and with respect to the justification of those aims, and the criteria of content and justificatory neutrality are defended. An early theory of education aimed at autonomy is evaluated in order to introduce the concept of autonomy and the idea of education aimed at autonomy. A version of the theory of education (...) aimed at democracy is also evaluated. Both of these theories are ultimately dismissed, however, because it is demonstrated that they do not fulfill the criteria for a satisfactory theory. ;The concept of paternalism is extensively developed as a neutral justification for a satisfactory theory of educational aims. And the concepts of full voluntariness, and autonomy are extensively developed as satisfactory neutral aims. Paternalism and autonomy are then viewed in a developmental context, and the autonomy continuum and a paternalism continuum are introduced and developed. ;In conclusion, the theory of primary education aimed at autonomy is evaluated in light of the criteria of a satisfactory theory originally proposed. . Two aspects of the problem of interpreting Michael Polanyi’s outlook on religion are discussed. First, various ways of relating to reality beyond the objective perception of factuality must be considered, including the shift from I-It to I-Thou relations, and the self-giving mode of surrender to a symbolized reality. Second, the active use of the imagination in perception involves a commitment that the image is of something real, transcending the person. I believe that Polanyi understands both religious rituals and works (...) of art to point to realities that can be met again in new ways. After this discussion reasons for Polanyi’s reticence to speak about his own religion are suggested and, finally, some known facts about his personal religion are given. (shrink)

Recent work on Imre Lakatos’s missing Hungarian dissertation on the historical sociology of science sheds new light on his mature philosophy of science. Remembered primarily as an “internalist” defender of the autonomy of science, and a Cold Warrior in poli­tics, commentators have mistaken his contribution as primarily a rearguard action against the followers of Thomas Kuhn and the “externalists” influenced by Boris Hessen. It comes as a surprise, then, to find that he developed and retained a fully general soci­ology of (...) scientific knowledge, with Marxist roots that articulated Lenin’s “inexhaustible atom.” He carried forward this emphasis on the fallible, changing, and incomplete nature of our engagement with the natural world by a dialectical account of how research programs advance and recede historically. In his effort to develop a synthesis of Popper and Kuhn, and via his engagement with Paul Feyerabend, he continued to develop a distinctly dialectical ap­proach to science. (shrink)

Michael Polanyi was one of the great figures of European intellectual life in the 20th century. A highly acclaimed physical chemist in the first period of his career who became a celebrated philosopher after World War II, Polanyi taught in Germany, England, and the United States and associated with many of the leading intellects of his time. His biography has remained unwritten partly because his many and scattered interests in a wide variety of fields, including six subfields of physical chemistry, (...) epistemology, economics, patent law, social and political theory, aesthetics, and theology. The science of ecology has sensitized us to the intricate causal chains in nature and to the threat to the life system posed by environmental misuse. Responding to the data provided by environmental science, some philosophers have called for fundamentally new ethical principles—a recognition of nonhuman values and an extension of rights not only to animals but to inanimate parts of nature. These attempts to develop an ecological ethic call for radical conceptual revision of the way in which most persons (...) perceive man and the world. This paper explicates those revisions and points to some philosophical difficulties which confront them. (shrink)

Remedios and Dusek have provided a useful contextualization of Steve Fuller’s recent work in social epistemology. While they have provided some good criticisms of some of Fuller’s new ideas, they fail to provide a systematic critique of Fuller’s retreat from a naturalistic and materialist social epistemology for one embracing transhumanism, intelligent design, and the proactionary imperative. An alternative approach is developed, drawing on Fuller’s early work and incorporating recent work on our biological and cultural evolution as a species.
