The study of expertise is difficult to do in a laboratory environment due to the challenge of finding people at different skill levels and the lack of time for participants to acquire mastery. In this paper, we report on two studies that analyze naturalistic gameplay data using cohort analysis to better understand how skill relates to practice and habit. Two cohorts are analyzed, each from two different games. Our work follows skill progression through 7 months of Halo matches for a (...) holistic perspective, but also explores low-level in-game habits when controlling game units in StarCraft 2. Players who played moderately frequently without long breaks were able to gain skill the most efficiently. What set the highest performers apart was their ability to gain skill more rapidly and without dips compared to other players. At the beginning of matches, top players habitually warmed up by selecting and re-selecting groups of units repeatedly in a meaningless cycle. They exhibited unique routines during their play that aided them when under pressure. (shrink)

This study examines the degrees of corporate disclosure and transparency of publicly listed companies in two emerging markets and analyzes corporatedisclosure practices as a function of specific firm characteristics. The analysis uses the disclosure and transparency scores extracted from a survey instrument designed to rate disclosure practices of publicly listed companies by using the OECD Corporate Governance Principles as an implicit benchmark. Empirical results show that financial characteristics explain some of the variation in the degrees of corporate disclosure for firms (...) in Hong Kong but not for firms in Thailand. Further, corporate governance characteristics, such as board size and board composition, show more significant associations with the degrees of corporate disclosure inThailand than in Hong Kong. The results are broadly consistent with the notion that good corporate governance leads to better corporate disclosure and transparency in less developed markets. (shrink)

Jahrhundert abseits des konfuzianischen Mainstreams eine verstarkte Hinwendung zur konkreten Wirklichkeit und eine Dekonstruktion der dominierenden konfuzianischen Denksysteme auf verschiedene Weise Ausdruck. Das Denken des Qing-zeitlichen Konfuzianers Yan Yuan ist exemplarisch fur diesen geistigen Neuorientierungsprozess.Im Mittelpunkt seiner Philosophie steht ein Modell individueller und gesamtgesellschaftlicher Kultivierung, das sich durch Korperzentriertheit und Praxisorientiertheit auszeichnet und gegen die Leibfeindlichkeit und metaphysische Abgehobenheit Song- und Ming-zeitlichen Philosophierens gerichtet ist. Der Autor bezieht in dieser Studie Yan Yuans anthropologische, kosmologische, (...) handlungstheoretische und kulturphilosophische Positionen systematisch aufeinander, ordnet sie geistesgeschichtlich ein und berucksichtigt dabei die Geschichte ihrer Rezeption. RESUMO O presente artigo pretende explorar um tema ainda incipiente na literatura secundária referente ao estatuto do direito em Giorgio Agamben e ao peso do direito romano em seus trabalhos. Para isso lançamos mão do debate entre Agamben e Yan Thomas, um importante historiador do direito romano com quem Agamben teve um contato bastante intenso. Ao longo do artigo pretenderemos mostrar três coisas: em primeiro lugar, a relação de Agamben com a biopolítica, destacando, sobretudo, o aspecto articulatório da noção (...) de dispositivo que subjaz suas investigações. Em segundo lugar, a importância do ensaio Vita necisque potestas de Yan Thomas, que servirá para Agamben introduzir diferenças em relação a Hannah Arendt e Michel Foucault. Por fim, lançaremos luz sobre o estatuto do direito no pensamento de Agamben, que, é a nossa hipótese, comunga da visão thomasiana: o direito não seria uma realidade metafísica ou substancial, mas funcionaria por meio de artifícios e ficções, o que nos permite pensar o direito enquanto um autêntico dispositivo biopolítico. ABSTRACT This article intends to explore a still incipient theme in the secondary literature regarding the status of the law in Giorgio Agamben and the weight of Roman law in his works. To this end, we have used the debate between Agamben and Yan Thomas, an important historian of Roman law with whom Agamben had a very intense contact. Throughout the article we will show three things: firstly, the relationship between Agamben and biopolitics, emphasising the articulatory aspect of the notion of apparatus which underlies his investigations. Then we will point out the importance of the essay Vita necisque potestas by Yan Thomas, which will serve for Agamben to introduce differences in relation to Hannah Arendt and Michel Foucault. Finally, we will shed light on the statute of law in Agamben’s thought, which is our hypothesis, communes with the Thomasian view: law would not be a metaphysical or substantial reality, but would work through artifice and fiction, which enables us to think the law as an authentic biopolitical apparatus. Using the Epicurean position on death as a starting point, this article re-examines the basic assumptions of philosophers regarding their views on whether death should be seen as a bad. It questions the positions of philosophers such as Thomas Nagel and Derek Parfit by applying Wittgenstein’s notion of grammar as developed by G. P. Baker and P. M. S. Hacker. While philosophers may characterize questions such as ‘What is the nature of death?’ and ‘Is death a bad?’ as metaphysical, (...) I propose that such questions can be better characterized as grammatical. The failure to understand the grammatical character of such questions creates the illusion that questions concerning the nature of death can be adequately tackled with reference to empirical or metaphysical ‘facts’. If the arguments in this article are substantiated, some philosophical puzzles about death can be dissolved. (shrink)

Alvin Plantinga, analitik felsefe düşüncesi içerisinde yetişmiş ve bu gelenek içinde teistik din felsefesinin oluşumuna katkıda bulunmuş bir filozoftur. Ayrıca teizmin savunusu için yaptığı çalışmalarla, çeşitli üniversitelerden aldığı onur ödülleri ve 2017 yılında kazandığı Templeton Prize ödülüyle, haklı bir üne kavuşmuş bir şahsiyettir. Bu çalışmayı yapmamızdaki en önemli amaç, Plantinga’nın dini epistemoloji üzerine yaptığı çalışmaları analiz edip bu düşüncelerinin ardalanına dair bir tespitte bulunmaktır. Bu çalışmada yararlandığımız öncelikli kaynaklar, Plantinga’nın Nicholas Wolterstorff ile birlikte kaleme aldığı “Faith and Rationality” adlı eser (...) ile birlikte son dönem epistemik fikirlerinin çerçevesini belirleyen üç ciltlik “Warrant and Proper Function”, “Warrant: The Current Debate”, “Warranted: Christian Belief” isimli eserler olmuştur. Plantinga’nın ilk dönem epistemoloji çalışmalarının gayesini bir tür olumsuzlama diyebileceğimiz klasik temelciliğin ve evidentializmin eleştirisi oluştururken, ikinci döneminde bu eleştirilerden yola çıkarak Tanrı inancının haklı bir temelde ve güvenceye sahip olduğunu gösterme amacına yönelmiştir. Plantinga’nın teolojik fikirlerini oluşturan Kalvinci ekol, onun dini epistemolojisinin de özünü oluşturmaktadır. Plantinga’nın dini epistemolojisini iki boyutlu olarak değerlendirdiğimizde, içe dönük olarak Hristiyan inancıyla ilgilense de çalışmalarının dışsal yönünü daha genel olarak teizmin Tanrı’sı ve onun rasyonelliği oluşturmaktadır. Açıkçası Plantinga’nın epistemolojik külliyatı bir tür kavram zenginliğini de beraberinde getirmektedir. Çalışmamız içerisinde ele aldığımız kadarıyla uygun işlevsellik, tasarım planı, güvence (warrant) gibi kavramlar onun Tanrı inancının epistemik mahiyetini ortaya koymak için ne derece kararlı olduğunu göstermektedir. Netice itibariyle Tanrı inancının ve onun bilgisinin rasyonel olabileceğini ifade eden Plantinga, her ne kadar Hristiyan inancının belli bir koluna mensup olsa da diğer mezhepleri dışlamaz. Ayrıca Plantinga, birçok çalışmasında belirttiği üzere projesinin Yahudilik, İslam gibi diğer teistik dinlere yönelik olduğunu da belirtmektedir. (shrink)

Bir şey, Tanrı onu emrettiği için mi iyidir ya da kötüdür? sorusunu merkeze alarak oluşturulan ve yakın dönem içerisinde gerek din felsefesi ve gerekse ahlak felsefesi içerisinde tartışılan konulardan biriside “İlahi Buyruk Teorisi”dir. Bu teori kısaca, ahlaki değerlerin kaynağının, Tanrı’nın buyruklarında, yani onun emir ve yasaklarında belirlendiğini açıklamaya çalışmaktadır. Eylemlerimizin iyi ya da kötü olarak nitelendirilmesinin Tanrı’nın buyruklarıyla mı, yoksa onların Tanrı’dan bağımsız, yani, kendi doğalarından mı kaynaklandığı tartışması, ilk olarak ahlak felsefesi içerisinde Platon’un “Euthyphro” diyaloğunda kendisine yer bulmuştur. Bununla (...) beraber Hristiyan teolojisi içerisinde Aziz Augustinus, Duns Scotus ve Thomas Aquinas isimler; İslam düşüncesi içerisinde ise, “Hüsün ve Kubuh” meselesi adı altında Mu’tezile, Eş’ariyye ve Matüridiyye gibi ekoller konuya dair yaklaşımlarını ortaya koymaya çalışmıştır. Thomas Kuhn had little to say about scientific change in biological science, and biologists are ambivalent about how applicable his framework is for their disciplines. We apply Kuhn’s account of paradigm change to evolutionary microbiology, where key Darwinian tenets are being challenged by two decades of findings from molecular phylogenetics. The chief culprit is lateral gene transfer, which undermines the role of vertical descent and the representation of evolutionary history as a tree of life. To assess Kuhn’s relevance to (...) this controversy, we add a social analysis of the scientists involved to the historical and philosophical debates. We conclude that while Kuhn’s account may capture aspects of the pattern of an episode of scientific change, he has little to say about how the process of generating new understandings is occurring in evolutionary microbiology. Once Kuhn’s application is limited to that of an initial investigative probe into how scientific problem-solving occurs, his disciplinary scope becomes broader. (shrink)

Yan Fu was the first Chinese person to introduce the teachings of the West to China systematically. Since returning to China from Britain, to which he had been sent to study in 1879, he held an office at the Beiyang Naval College until leaving the institution in 1900. These twenty-some years were precisely the direst moment in the intensifying of China's social crisis, when the imperialists were pressing their aggression toward China and China was being brought to the brink of (...) being partitioned outright. At the time, all the progressive intellectuals in China were worried for the future of the motherland, and pressed on to find what they considered to be the truth of national salvation. The bourgeois reformist faction of the day, with Kang Youwei as its leader, advocated political and legal reform and was tremendously enthusiatic and active in pleading its case throughout China, calling on the intellectuals to respond. Yan Fu, too, at this time, did a large amount of propaganda work for the cause of reform, using the thought of Lao Zi and Zhuang Zi as his foundation and employing his own exceptional knowledge of Western things and Western learning, and his understanding of the capitalist world. He founded the Guowen bao and published a number of important political essays, including "Lun shibian zhi ji" , "Yuan qiang" , "Pi Han" and "Jiu wang jue lun" . He also translated a number of the works of Western bourgeois social science, including [Thomas Huxley's] Evolution and Ethics , [Adam Smith's] The Wealth of Nations , [Herbert Spencer's] A Study of Sociology , [John Stuart Mill's] Logic , and Montesquieu's De l'esprit des lois . Furthermore, he carried out an annotated and evaluative reading of Lao Zi and Zhuang Zi, and in so doing he assimilated Western learning and ideas into the Chinese interpretation of Lao-Zhuang's thought. Thomas Aquinas Orta Çağın en üretken filozoflarından biridir ve onun felsefi görüşleri kendi döneminin yanı sıra birçok çağdaş düşünürü de etkilemiştir. Aquinas’ın düşünce erdemleri ve ahlak erdemleri konusundaki görüşlerinin Aristotelesçi temelleri sıklıkla tartışılmasına karşın ilahi erdemler sınıfında yer verdiği erdemlerin incelenmesi göz ardı edilmiştir. Çağdaş erdem tartışmalarında kural temelli erdem anlayışını savunanlar Aquinas’ı kaynak göstermezler. Oysa bu çalışmada göstereceğimiz gibi, kural temelli erdem yaklaşımının en açık, ayrıntılı ve tutarlı biçimini Aquinas’ta görmekteyiz. Çalışmada ilkin Aquinas’ta erdemin özü, tanımı ve nedenleri (...) incelenerek genel eylem kuramı çerçevesinde ahlaki eylem olarak erdemin ortaya çıkışı gösterilecektir. İkinci olarak, düşünce ve ahlak erdemleri ile ilahi erdemlerin kaynağı ortaya konacaktır. Bu inceleme ile Aquinas’ın erdem anlayışının Aristoteles’in anlayışından farkı ortaya konarak kural temelli erdem anlayışının temelleri gösterilecektir. (shrink)

Fen eğitimi ve öğretiminin anahtar unsurlarından bir tanesi bilimin doğasının ve özelliklerinin doğru bir şekilde tespit edilmesidir. Bilimin doğasına yönelik tespitler fen eğitimi yöntemlerini birçok açıdan etkilemektedir. Fen eğitimi ve fen öğretimi ile ilgili olan kişiler bilimin doğasının açık bir şekilde öğretilmesi gerektiğini kabul etmektedir. Thomas Kuhn’un bilim tarihi, bilim felsefesi ve bilim sosyolojisi alanlarını içeren incelemeleri neticesinde ileri sürdüğü bilimin yapısına, işleyişine ve doğasına yönelik tezleri (paradigma, olağan bilim, bilimsel devrimler, eşölçülemezlik, bulmaca çözme, kuram seçimi, keşif ve gerekçelendirme (...) ayrımı) fen eğitimi ve öğretimi alanında sıklıkla başvurulan kaynaklar olmuştur. Bu doğrultuda makalede mantıkçı pozitivist bilim anlayışının bilimin nesnel, evrensel, kesin gerçekleri ortaya çıkaran, sosyal-kültürel değerlerden ve ön yargılardan bağımsız, bilimsel bilginin birikimsel bir şekilde ilerlediği yönündeki iddiası bilimin gerçek doğasını yansıtamadığı düşüncesiyle Kuhn’un görüşleri çerçevesinde tartışılmaktadır. Makalenin temel savı Kuhn’un bilime ve bilimin doğasına yönelik tespitlerinin bilimin gelişen, dönüşen ve değişen yapıdaki gerçek doğasına vurgu yaptığı ve böylece fen eğitiminde sıklıkla başvurulan bilimin doğasına yönelik kavrayışı dönüştürdüğüdür. Thomas Kuhn’un ufuk açıcı eseri Bilimsel Devrimlerin Yapısı’nda yer verdiği bilimin yapısı ve işleyişi konusundaki tespitleri ve bilimin gerçek doğasını anlama yönündeki girişimleri bilime yönelik sergilenen pozitivist bakış açısını değiştirerek eğitici ve öğrencilerin modern bilim anlayışının özelliklerini daha iyi anlamalarında ve eğitim alanında yeni düzenlemelerin yapılmasında giderek etkili olmaktadır. Başta fen eğitimi araştırmacıları olmak üzere her geçen yıl eğitimciler tarafından Kuhn’un çalışmalarına yönelik artan ilgi ve başvuru bu durumu destekler niteliktedir (Loving ve Cobern, 2000, s. 187). Eğitim araştırmalarında Kuhn’un (...) görüşlerinin etkisinin en çok hissedildiği alanlar kavramsal değişim araştırmaları, yapılandırmacı öğrenme yaklaşımı, Bilim, Teknoloji ve Toplum çalışmaları ile bilime ilişkin kültürel çalışmalar gösterilebilir (Matthews, 2022: 38). Fen eğitimi araştırmalarında ise kavramsal değişim kuramları ile yapılandırmacı öğrenme kuramlarında bu etki görülmektedir (Loving ve Cobern, 2000, s. 187). Fen eğitimi ve öğrenimi konusundaki mevcut yaklaşımlar göz önüne alındığında Kuhn’un düşüncelerinin eğitim alanındaki yansımaları yapılandırmacı öğrenme kuramının temel kaynaklarından birisi olarak değerlendirilmekte (Hodson, 1988, s. 32), bilimsel ilerleme kapsamında paradigma, paradigma değişimi ve paradigmaların eşölçülemezliği gibi bilimin işleyişine yönelik belirlemeleri ise kavramsal değişim kuramında sıklıkla başvurulan görüşler olarak karşımıza çıkmaktadır. Kavramsal değişim kuramlarını desteklemek amacıyla birçok eğitimci (Loving ve Cobern, 2000; Songer ve Linn, 1991; Duschl ve Gitomer, 1991; Metz, 1991) tarafından Kuhn’un bilimsel ilerlemeyi örneklendirmek üzere başvurduğu fizik gibi bilimlerde görülen gelişim ve değişim ile bilimlerde meydana gelen paradigma değişiklerine yönelik düşünceleri, eğitimde gerçekleşen bireysel gelişim ve değişim sonucunda insan zihninde meydana gelen bilişsel değişimler ve kavramsal değişimlerle ilişkilendirilerek öğrencilerin eğitilmesine yönelik araştırmalarda kullanılmaktadır. Fen eğitimi özelinde kavramsal değişim araştırmaları bireysel öğrenme sırasında ya da sonucunda zihinde gerçekleşen kavramsal değişim ve bilişsel gelişim aşamaları ile bilimsel devrimler sonucunda bilim insanları ve bilim topluluğunda meydana gelen kavramsal değişim ve bilimin gelişim aşamaları arasında benzerlik kurularak öğrencilerin fen öğrenimi sırasındaki zihinsel durumlarının araştırmacılar tarafından daha iyi anlaşılabilmesi amacıyla ileri sürülmektedir (Hewson, 1981, s. 383). Kavramsal değişim araştırmaları, Piaget’nin (1969) çocukların bilişsel gelişimi konusundaki görüşleri ile Thomas Kuhn'un (1970a) bilimsel bilginin tarihsel gelişimi hakkındaki çalışmalarının ilişkilendirilmeye başlanmasından yola çıkılarak inşa edilmekle birlikte kavramsal değişim kuramı ya da yaklaşımı fen eğitimi araştırmalarında ön plana çıkan bir yöntem ya da paradigma haline gelmeye başlamıştır (Abell, Appleton, ve Hanuscin, 2013, s. 7; 59). Kavramsal değişim konusunda araştırma yapanlar Kuhn’un bilimin yapısı hakkındaki görüşlerinden hareketle öğrencilerin eğitim alırken karşılaştıkları yeni bilgiler ile zihinlerindeki mevcut ön kabuller ve bilgiler arasındaki uyum ya da uyumsuzluk durumunu belirtmek amacıyla yararlanmaktadırlar (Abimbola 1987, Duit 1991, Villani, 1992). Bu kapsamda çalışmada ilk olarak fen eğitimi alanında kavramsal değişim yaklaşımının temel unsurlarına öncülük eden Kuhn’un bilim anlayışı çerçevesinde bilimsel ilerleme, paradigma değişimi ve farklı paradigmaların eşölçülmezliğine yönelik görüşlerinin detaylarına yer verilerek kavramsal değişim yaklaşımını hangi açılardan etkilediğinin tespiti yapılmaktadır. Ardından Kuhn’un fen eğitimine yönelik görüşleri doğrultusunda ileri sürdüğü öğrencilerin zihninde paradigma gibi önceden bir kabul olduğu düşüncesi sonucunda eğitim araştırmalarında öğrenci merkezli anlayışın ön plana çıkması ile kavramsal değişim yaklaşımının detaylarına yer verilmektedir. Son olarak Margaret Masterman’ın belirlemeleri ile Kuhn’un Bilimsel Devrimlerin Yapısı’nda paradigma kavramını çeşitli anlamlarda kullanmasının kavramsal değişim yaklaşımının temel öğretilerine hangi açılardan kaynaklık ettiği vurgulanmaktadır. Böylelikle bilim tarihinde ya da bilimsel ilerleme süreçlerinde görülen kavramsal değişim ile eğitimcilerin yararlandığı bireylerin zihinlerinde gerçekleşen kavramsal değişime yönelik kurulan benzerlik ilişkisinde öğrencilerin bilişsel ve zihinsel durumlarını daha iyi anlamak için başvurulan kavramsal değişim yaklaşımına ilişkin öğeler derinleştirilerek Kuhn’un görüşlerinin bu öğelerle nasıl ilişkilendirildiği ortaya konulmaktadır. Tianyan is a fundamental concept for understanding Yan Fu’s (1854–1921) distinctive approach to modernization. Departing from the pragmatic focus of earlier reformers, he envisioned a path of spiritual and ethical renewal informed by evolutionary science. This paper examines how Yan Fu manipulated the evolutionary ideas of Thomas Huxley (1825–1895) and Herbert Spencer (1820–1903) and integrated them with traditional Chinese metaphysics to conceptualize a new cultural ideology, or the new Way (Dao), against a historical backdrop defined by shifting dynamics between (...) diverse philosophies and worldviews. By examining his tianyan cosmology, the study illuminates Yan’s development of a modern ethical paradigm focused on individual and national character-building amidst historical transformations and cultural dialogues. Yan’s work reveals pathways for cultivating a modern identity and ethical structure within a globalizing context, making his intellectual legacy especially relevant to contemporary reflections on modernity and cross-cultural ethical evolution. Bu makalede, bilim felsefecisi kimliğiyle tanınan Thomas Kuhn’un eğitim ve özellikle fen eğitimi alanındaki görüşlerine değinilmektedir. Fen eğitimi, bilim, bilimin doğası ve bilim uygulamaları hakkında düşünceler geliştirmeye odaklanarak fen öğrenimi için gerekli olan beceri ve anlayışın geliştirilmesini amaçlamaktadır. Fen eğitiminin temel amaçlarından biri bilimin gerçek doğasının tespit edilmesi ve bu doğrultuda bir eğitim modelinin belirlenmesidir. Bu çerçevede Kuhn’un bilim tarihine yönelik incelemeleri neticesinde ileri sürdüğü paradigma kavramı bilimin doğası ve fen eğitimi konusundaki görüşlerin değişimine yol açmıştır. Kuhn açısından fen (...) eğitimi yürürlükteki bilim yapma tarzının temelinde yatan paradigma ve öğretilerinin bilim insanlarına ve öğrencilere aktarılması sürecidir, bu nedenle fen eğitimi yalnızca olağan bilim döneminde mümkündür. Kuhn’un eğitim modeli, mevcut paradigmayla ilişkili olarak karşılaşılan bulmaca ya da sorunları çeşitli örneklerden hareketle tekrar tekrar çözmeye çalışan öğrenciler aracılığıyla gerçekleştirilir. Kuhn’un olağan bilimin sınırları içerisinde kalarak değerlendirdiği fen eğitimi anlayışı eleştirel düşünceyi engellediği iddiasıyla Karl Popper, John Watkins ve Richard Bailey tarafından katı, tutucu, dogmatik ve endoktrinasyonu vurgulayan bir eğitim anlayışı olarak görülmektedir. Bu çerçevede makalede, öncelikli olarak Kuhn’un bilimin doğası ve bilimin gelişim tarzına yönelik belirlemeleri doğrultusunda fen eğitimine yönelik düşünceleri ve bu düşüncelerin eğitim alanındaki yansımaları incelenmektedir. Ardından, Kuhn’un fen eğitimi üzerine görüşlerinin iddia edildiği gibi dogmatik bir yapıda olmadığı, endoktrinasyonu ya da zorla öğretimi vurgulamadığı, bu tür yorumların radikal bir yaklaşımdan öteye gidemediği ileri sürülmektedir. Son olarak makalede, Kuhn’un fen eğitimi anlayışının yalnızca bir durum tespiti ya da bir fen eğitimi tasviri olarak değerlendirilmesi gerektiği düşüncesi ön plana çıkarılmaktadır. -/- In this article, Thomas Kuhn’s impact, who is known as a philosopher of science, on science education are mentioned. Science education aims to develop the skills and understanding necessary for science learning, with a focus on developing ideas about science and the nature of science. One of the main purposes of science education is to determine the true nature of science and to determine an education model in this direction. In this context, the concept of paradigm, which Kuhn put forward as a result of his studies on the history of science, has led to a change in views on the nature of science and science education. For Kuhn, science education is the process of conveying the paradigm underlying the current way of doing science to scientists and students because science education is possible only in the normal science period. Kuhn’s educational model is carried out through students who repeatedly try to solve puzzles or problems encountered in relation to the current paradigm. Kuhn’s understanding of science education is seen by Karl Popper, John Watkins and Richard Bailey as a rigid, conservative, dogmatic and indoctrinational education approach with the claim that it prevents critical thinking. In this context, the article primarily examines Kuhn’s thoughts on science education and the reflections of these thoughts in the field of education. Then, it is argued that Kuhn’s views on science education are not dogmatic as claimed, he does not emphasize indoctrination, and that such interpretations cannot go beyond a radical approach. Finally, in the article, it is emphasized that Kuhn’s understanding of science education should be evaluated only as a description of science education. (shrink)

Anthropological scholarship after Marilyn Strathern does something that might surprise lawyers schooled in the tradition of ‘law and society’, or ‘law in context’. Instead of construing law as an instrument of social forces, or as an expression of processes by which society maintains and reproduces itself, a new mode of anthropological enquiry focuses sharply on ‘law itself’, on what Annelise Riles calls the ‘technicalities’ of law. How might the legal scholar be inspired by this approach? In this article, I explore (...) one possible way of approaching law after anthropology, which is to find within law’s own archive a set of resources for an analogous representation of law itself. Drawing on the historical scholarship of Yan Thomas, I suggest that the Roman conception of law as object offers an engaging counterpart to the anthropological take on law as a specific set of tools or, technicalities, or as a particular art of making relations. El propósito de este texto es proponer el sintagma vitam destituere como un concepto paradigmático para la interpretación del pensamiento de Giorgio Agamben, especialmente en lo que respecta a su propuesta ontológico-mesiánico-política. A diferencia de su antítesis, vitam instituere, el sintagma vitam destituere se formula aquí con la intención de exponer lo que distingue el pensamiento de Agamben en el discurso de la filosofía política contemporánea, particularmente en relación con la crítica y profanación del legado romano de la ontología del (...) officium. Para lograrlo: (i) presento los puntos centrales de la tetralogía Homo sacer contra los cuales se rebela el proyecto destituyente de Agamben; (ii) introduzco el fundamento del tratamiento del concepto de vitam instituere en la obra de Agamben basado en una afiliación con Yan Thomas; (iii) propongo una comparación entre el pensamiento de Agamben y el de Roberto Esposito, el primero como pensador de vitam instituere y el segundo de vitam destituere; (iv) sugiero que el pensamiento de Spinoza es esencial para comprender la divergencia entre Agamben y Esposito. This article explores the concept of institution as the legal performance par excellence. It starts by giving an account of the perspective that Merleau-Ponty opens on the notion of institution and aims to show the connection with the concept of passivity. The central focus is on the dynamics of instituting: in order to deal with this concept and to see its implications in the field of philosophy, it will proceed by making Merleau-Ponty’s speculations dialogue with the research conducted in the (...) same year by Deleuze: Instincts et institutions. In passing, it will be necessary to show what is at stake in the debate on the concept of institution, and the short-circuits that can be avoided through a better conceptualisation. To this end, a brief reference will be made to the main anti-institutionalist currents that have left deep traces in the contemporary debate, and to the idea of institution that, more or less explicitly, is still at the heart of social sciences. Given these preliminary foundations, the project is to make the fundamental questions inherent to the concept of institution—its relationship with temporality, with history, as well as the “classic” contractualist alternative to the institution that is still at the heart of political philosophy—react with the research of Yan Thomas on the origin of ius and on law as the quintessential instituting technique. Finally, we will return to Merleau-Ponty to take his insights a bit further and show their potential in the contemporary debate on instituting praxis. (shrink)

Thomas Nagel addresses the conflict between the claims of the group and those of the individual. Nagel attempts to clarify the nature of the conflict – one of the most fundamental problems in moral and political theory – and argues that its reconciliation is the essential task of any legitimate political system.

It is generally believed that two rival non-relativistic quantum theories, the realist interpretation of quantum mechanics and Bohmian mechanics, are empirically equivalent. In this paper, I use these two quantum theories to show that it is possible to offer a solution to underdetermination in some local cases, by specifying what counts as relevant empirical evidence in empirical equivalence and underdetermination. I argue for a _domain-sensitive_ approach to underdetermination. Domain sensitivity on theories’ predictions plays a role in determining whether two or (...) more theories are empirically equivalent and underdetermined. To support my argument for the denial of the empirical equivalence between Bohmian mechanics and the realist interpretation of quantum mechanics, I argue that they are not empirically equivalent when we consider their predictions for domains outside their application, using the relativistic domain as an example. This paper defends what I call the ‘wellbeing conception of harm’, according to which the relevant criterion for determining whether one has suffered harm is whether they have been made worse off in terms of their wellbeing. Firstly, I explain why it is that one might find the wellbeing conception of harm appealing to begin with. Then, I respond to two sets of concerns that have been levied against the wellbeing conception of harm. The first set of concerns relate to (...) the implausible moral/political consequences that would allegedly follow from adopting the wellbeing conception of harm. The second set of concerns challenge the practical significance of adopting the wellbeing conception of harm. I conclude with some remarks on how the wellbeing conception of harm can help to answer, or at least navigate, some controversial issues related to harm. (shrink)

Public welfare fundraising has been used to collect donations for medical supplies and has played an important role in the fight against the COVID-19 pandemic. This paper studies online crowdfunding donations from the Alumni Association of Wuhan University to North American alumni; donation data are used to investigate how individuals' donation behavior is affected by the previous donation amount and information provided by the fundraising platform. First, our results show that one's donation amount is positively affected by the previous donation (...) amount. Second, the donor's positive sentiment in the message that he or she leaves, as measured by either natural language processing or a manual rating, can affect the subsequent anonymity and messages but not the subsequent donation amount. Third, anonymous donations are much smaller than non-anonymous donations. (shrink)

This study’s purpose was to determine the prevalence of suicidality among adolescents in a city in Northeast China and identify the correlational factors among adolescents with suicidality. A total of 69,519 adolescents from grades 5 to 12 in a city in Northeast China participated in the online investigation. Students completed a structured questionnaire to report their demographic information, psychological characteristics, and suicidality. Univariable and multivariable logistic regressions were applied to determine significant correlational factors associated with suicidal ideation and suicide attempts. (...) The prevalence of SI and SA among adolescents in the past 12 months was 13 and 4.8%, respectively. Multivariable logistic regression analyses found that the potential risk factors for SI and SA included female, non-nuclear family, higher subjective socioeconomic status, meaningless in life, depression, bullying perpetrator, negative parental rearing styles, lower self-esteem scores, hopelessness, and stressful life events. In order to improve the accuracy of suicide risk identification, a cumulative risk index was used. With the increase in the number of cumulative risks, the risk of SI and SA also increased. So the cumulative risk index was very valuable. The total prevalence of SI and SA among primary and middle school students was high. Preventive measures could be implemented according to the risk factors. (shrink)

Role ethics, broadly speaking, is a normative ethical theory that has a prominent emphasis on roles. Although it was prominent in ancient cultures, such as in China and Greece, role ethics waned during the Enlightenment era. Not until very recently has role ethics been articulated in its own terms. Among current discussions on roles, the most systematic role ethics are Confucian role ethics, Epictetus’ role ethics, Sarah Harper’s rolecentered morality and Jeremy Evans’ role ethics. They are my primary interlocutors as (...) I develop and defend an alternative approach to understanding, examining and guiding our ethical life. By arguing that our ethical life is pervasively structured by roles, and drawing on the lights that my primary interlocutors have shed, I propose a role-structured ethics or role ethics that addresses some central issues regarding the nature of roles, the self, role identification, role fulfillment, role conflicts, and changing roles. Importantly, I emphasize the place of traditions in constructing a complete normative role ethics. So throughout the dissertation, I outline and defend the basic structure of any plausible specific role ethics, which is neutral among various traditions. I call such a structure “Role Ethics.” In particular, I investigate the nature of roles and its relation to the self, role fulfillment and its relation to the concept of duties, virtues and skills, as well as the nature of role conflicts and how to approach them. Along these lines of exploration, I also argue that they have important implications on the dignity of persons, moral education, and the notion of practical wisdom. Last but not the least, due to the universality of roles in various traditions, I propose that Role Ethics can serve as a platform to bring various traditions into meaningful dialogue. (shrink)

Based on the theory of commitment and trust, this paper constructs an online consumer purchase decision model, empirically studies the common values, online trust, commitment and purchase decision, and explores the influence mechanism and path of online consumer purchase decision. The results show that common values of shopping platforms and online consumers have a significant positive impact on trust and commitment, among which the common value orientation of mutual trust and commitment compliance has the most significant impact, which reflects the (...) core content of common values. Secondly, the confidentiality of buyer information, common value of ethics, accurate disclosure of information, and finally the attitude to solve problem;The establishment of online trust has a significant positive impact on commitment, and both online trust and commitment are positively related to purchase decision. In terms of research methods, the theory of commitment and trust is introduced into the study of online consumption on Chinese shopping platforms, which expands the scope of application of the theory of commitment and trust. The trust of online consumers is generated by their own shopping experience. The conclusion of this study provides a decision-making basis for the innovation of marketing model and has theoretical reference value. (shrink)

Die Dynamik und Radikalität insbesondere des malignen Hasses resultiert, so die These des Autors, aus einer Affektretention, die durch die selbst empfundene Schwäche oder Ohnmacht des Hassenden bedingt ist. Durch diesen Rückstau wird der Hass demnach in der Latenzphase immer weiter genährt, bis er schließlich in (...) akute destruktive Handlungen umschlagen kann. Als charakteristische Struktur des Hasses wird dabei eine Dialektik von Selbststeigerung und Selbstdestruktivität mit fortschreitender Entleerung des Selbst herausgearbeitet. Systems with human-centered artificial intelligence are always as good as their ability to consider their users’ context when making decisions. Research on identifying people’s everyday activities has evolved rapidly, but little attention has been paid to recognizing both the activities themselves and the motions they make during those tasks. Automated monitoring, human-to-computer interaction, and sports analysis all benefit from Web 4.0. Every sport has gotten its move, and every move is not known to everyone. In ice hockey, every move cannot (...) be monitored by the referee. Here, Convolution Neural Network-based Real-Time Image Processing Framework (CNN-RTIPF) is introduced to classify every move in Ice Hockey. CNN-RTIPF can reduce the challenges in monitoring the player’s move individually. The image of every move is captured and compared with the trained data in CNN. These real-time captured images are processed using a human-centered artificial intelligence system. They compared images predicted by probability calculation of the trained set of images for effective classification. Simulation analysis shows that the proposed CNN-RTIPF can classify real-time images with improved classification ratio, sensitivity, and error rate. The proposed CNN-RTIPF has been validated based on the optimization parameter for reliability. To improve the algorithm for movement identification and train the system for many other everyday activities, human-centered artificial intelligence-based Web 4.0 will continue to develop. (shrink)

Green housing is a new type of building that advocates energy saving and environmental protection. How to stimulate buyers to buy green housing under the background of high cost is the key problem to guide green consumption. First of all, based on the existing literature, the comment of homebuyers was divided into comment quantity, comment quality, comment titer and evaluator credibility. The psychological distance mediation variable was introduced, and three dimensions of time distance, social distance, and space distance were selected (...) to construct the influence model of homebuyer comment on green housing purchase intention. Meanwhile, the concept model was built, and questionnaires were adopted for empirical analysis. On this basis, considering the long-term purchase behavior of buyers, the influence model of homebuyers' second comment on green housing purchase intention with the Hotelling model was established. The results show that comment quality, comment titer, and the credit rating of the evaluator have a positive effect on green housing purchase intention while comment quantity has no significant effect. Psychological distance plays a mediation role between comment quality, comment titer, the credit rating of the evaluator, and green housing purchase intention while having a mediation effect between comment quantity and green housing purchase intention. In the long-term purchase behavior of green housing, psychological distance plays a greater role than price. At last, some suggestions were proposed. (shrink)

In recent years, there has been a remarkable resurgence of interest in classical conceptions of what it means for human beings to lead a good life. Although the primary focus of the return to classical thought has been Aristotle's account of virtue, the ethics of Aquinas has also received much attention. Our understanding of the integrity of Aquinas's thought has clearly benefited from the recovery of the ethics of virtue.Understood from either a natural or a supernatural perspective, the good life (...) according to Aquinas involves the exercise not just of the moral virtues, but also of the intellectual virtues. Following Aristotle, Aquinas divides the intellectual virtues into the practical, which have either doing (prudence) or making (art) as an end, and the theoretical or speculative, which are ordered to knowing for its own sake (understanding, knowledge, and wisdom). One of the intellectual virtues, namely, prudence has received much recent attention. With few exceptions, however, contemporary discussions of Aquinas ignore the complex and nuanced relationships among, and comparisons between, the different sorts of intellectual virtue. Even more striking is the general neglect of the speculative, intellectual virtues and the role of contemplation in the good life.In Virtue's Splendor Professor Hibbs seeks to overcome this neglect, approaching the ethical thought of Thomas Aquinas in terms of the great debate of antiquity and the Middle Ages concerning the rivalry between the active and the contemplative lives, between prudence and wisdom as virtues perfective of human nature. Darwinian ideas were developed and radically transformed when they were transmitted to the alien intellectual background of late nineteenth- and early twentieth-century China. The earliest references to Darwin in China appeared in the 1870s through the writings of Western missionaries who provided the Chinese with the earliest information on evolutionary doctrines. Meanwhile, Chinese ambassadors, literati and overseas students contributed to the dissemination of evolutionary ideas, with modest effect. The ‘evolutionary sensation’ in China was generated by the Chinese Spencerian Yan Fu’s (...) paraphrased translation and reformulation of Thomas Huxley’s 1893 Romanes Lecture ‘Evolution and ethics’ and his ‘Prolegomena’. It was from this source that ‘Darwin’ became well known in China – although it was Darwin’s name, rather than his theories, that reached Chinese literati’s households. The Origin of Species itself began to receive attention only at the turn of the twentieth century. The translator, Ma Junwu (1881–1940), incorporated non-Darwinian doctrines, particularly Lamarckian and Spencerian principles, into his edition of the Chinese Origin. This partially reflected the importance of the pre-existing Chinese intellectual background as well as Yan Fu’s progressive ‘evolutionary paradigm’. In this paper, I will elucidate Ma Junwu’s culturally conditioned reinterpretation of the Origin before 1906 by investigating his transformation of Darwin’s principal concepts. (shrink)

This article considers what can be learned regarding the ethical acceptability of intrusive interventions intended to halt the spread of infectious disease (‘Infection Control’ measures) from existing ethical discussion of intrusive interventions used to prevent criminal conduct (‘Crime Control’ measures). The main body of the article identifies and briefly describes six objections that have been advanced against Crime Control, and considers how these might apply to Infection Control. Tax haven investment has become an increasingly important topic in business ethics. Given the considerable tax haven investments from emerging market firms, understanding how home-country institutions shape their investments in tax havens is theoretically intriguing and practically crucial. By integrating resource dependence and institutional theories, we hypothesize the existence of a negative relationship between firms’ home-country political status and tax haven investment. State-owned enterprises controlled by the central government dominate the political hierarchy. Compared with other types of enterprises, central SOEs (...) receive the strongest institutional support and are the most prone to institutional oversight, thereby exhibiting the weakest tendency to invest in tax havens. This top group is followed by SOEs controlled by local governments, politically connected private firms, and private firms without political connections. These groups exhibit an increasing tendency to invest in overseas tax havens. The empirical analysis of Chinese listed firms during 2003–2013 supports our hypotheses. This research contributes to the business ethics literature by identifying institutional drivers of overseas tax haven investment by emerging market firms, thereby adding to the ethical debate on international tax avoidance. This paper investigates the relationship between technological finance, high-quality economic growth, and financial stability. Based on data of 30 provinces collected between 2004 and 2017, this paper adopts the method of factor analysis to construct comprehensive indexes of technological finance and financial stability before calculating green total factor productivity as the index of high-quality development, using the CRS Multiplicative Model. Then it constructs the spatial SAC model and PVAR model for analyses of the just-mentioned relationship based on the total sample (...) of the nation and regional samples in eastern, middle, and western China, respectively. The results reveal that All samples, whether the total national samples or regional samples of eastern, middle, and western China demonstrate the positive influence of technological finance on high-quality economic development, with an obvious spatial spillover effect. The impact factor is the highest in the eastern region, while the western region holds the lowest factor among the three. Judging by the general national sample, technological finance has an obvious negative shock effect on financial stability within a short period, but the effect gradually dwindles as time goes by. This rule applies to the sample of the eastern region, as its technological finance poses a short-time negative shock effect on financial stability, before gradually diminishing to 0. Neither western nor middle regions have displayed an obvious shock impact on financial stability. (shrink)
