The man on the Clapham omnibus, as common lawyers know, was a late nineteenth and early twentieth century image of the ordinary reasonable man who played an important part in fixing common law standards. As a lawyer with a continuing but general interest in medicine, biotechnology, ethics, and the law, I offer the following comments on the conference's topic of “Health Resource Allocation” from what may approximate the standpoint of an ordinary reasonable man.How much “health” can a society afford? I (...) do not think that it is possible to maintain that there is a right to health, expressed as an unqualified right to treatment—though I understand that the argument has been raised in the United States that there is a constitutional basis for a claim of entitlement to treatment for civilly committed mental health patients. So far as English law is concerned, the answer to this question is clear. In 1980 the English Court of Appeal dealt with a case in which four people in Staffordshire argued that the health services were insufficient in their area. (shrink)

ABSTRACT“Evidence-based” methods, which most prominently include randomized controlled trials, have gained increasing purchase as the “gold standard” for assessing the effect of public policies. But the enthusiasm for evidence-based research overlooks questions about the reliability and applicability of experimental findings to diverse real-world settings. Perhaps surprisingly, a qualitative study of British educators suggests that they are aware of these limitations and therefore take evidence-based findings with a much larger grain of salt than do policy makers. Evidence-based medicine, with its evidence hierarchies and emphasis on RCTs, meta-analyses and systematic reviews, sets the model for evidence-based policy almost everywhere, policing no exception. But how closely should policing follow this model? We argue that RCTs can tell you little about what you need to know for real-world practice: will this policy work where and when you implement it? Defending that it will do so takes good theory. For RCTs to play a role in theory development, they must be (...) set into a larger body of knowledge, including local knowledge about the sites of implementation. Unfortunately the standard EBM model generally ignores the other kinds of knowledge needed. An alternative model for evidence-based policing, similar to that of the new movement for ‘EBM+’ and immanent in the practice of realist synthesis, focuses on the arguments that proposed policing policies will work where and when they are implemented and looks for the evidence needed to support those arguments. “Perhaps the most common objection to consequentialism is this: it is impossible to know the future…This means that you will never be absolutely certain as to what all the consequences of your act will be…there may be long term bad effects from your act, side effects that were unforeseen and indeed unforeseeable…So how can we tell which act will lead to the best results overall – counting all the results? This seems to mean that consequentialism will be unusable as a (...) moral guide to action. All the evidence available at the time of acting may have pointed to the conclusion that a given act was the right act to perform – and yet it may still turn out that what you did had horrible results, and so in fact was morally wrong. Indeed, if will never be possible to say for sure that any given act was right or wrong, since any event can continue to have further unseen effects down through history. On one thing the whole world seems to agree: Globalization is homogenizing cultures. At least, a lot of countries are acting as if that’s the case. In the name of containing what the Canadian novelist Margaret Atwood calls “the Great Star-Spangled Them,” the Canadian government subsidizes the nation’s film industry and requires radio stations to devote a percentage of their airtime to home-grown music, carving out extra airplay for stars such as Celine Dion and Barenaked Ladies. Ottawa also discouraged Borders, (...) the American book superstore, from entering the Canadian market out of fear that it would not carry enough Canadian literature. The French government spends some US $3 billion annually on culture and employs 12,000 cultural bureaucrats in an effort to preserve its vision of a uniquely French culture. Spain, South Korea and Brazil place binding domestic-content requirements on their cinemas; France and Spain do the same for television. Until recently, India barred the sale of Coca-Cola. (shrink)

Various writers in the Western liberal and libertarian tradition have challenged the argument that enforcement of law and protection of property rights are public goods that must be provided by governments. Many of these writers argue explicitly for the provision of law enforcement services through private market relations.

Individuals frequently give gifts or make transfers to others for altruistic reasons. Parents devote time to raising their children, spouses make sacrifices on each other's behalf, and friends do favors for friends. We are also linked to many people indirectly because we care for someone who cares for them.

The expressive power of 2-cnfs, conjunctive normal forms with two literals per clause, is shown to be severely limited compared to 3-cnfs.

How should we define the “feasible set”? What does it mean to assert that a policy is the “best feasible option”? Feasibility is most plausibly a matter of degree rather than of kind. We therefore must think about how to do normative economics with a fuzzy social budget constraint. I consider a number of ways of proceeding, including a twodimensional social welfare function, weighting both desirability and feasibility. Focusing on the difficulties in the feasibility concept may help us resolve some (...) outstanding policy disagreements. (shrink)

This dissertation presents evidence that a number of the great traditional Western metaphysicians based their metaphysical systems upon their experiences of altered states of consciousness . It poses the question: what state of consciousness would be necessary for the metaphysician to actually experience "reality" in the way that he describes it? It specifically discusses evidence in the philosophical writings of Plato, Berkeley, Schopenhauer and Hegel which strongly suggests that they experienced various non-ordinary planes of "reality" during certain ASCs. ;Four different (...) metaphysical planes or levels of "reality" are presented: the everyday material world , the eternal soul , the archetypal Platonic Ideas or essences and the Divine Mind of God , which is identified with the mystical godhead. ;It is argued that Plato directly experienced the non-ordinary realm of the eternal Ideas . Berkeley's metaphysical claims about the unreality of matter and the dependence of the entities in the everyday world upon the mind or soul for their existence are grounded in his direct experience of the soul during a worldless ASC. Schopenhauer's description of the aesthetic experience of the Platonic Ideas is discussed as a perceptual form of concentrative meditation. Hegel's fundamental metaphysical concept of the Universal Mind of God or Absolute Spirit is rooted in his mystical experiences of Level Four. His non-Aristotelian form of logic is described as a "state-specific logic," i.e., a form of logic which is rooted in the experience of a specific ASC. ;It is argued that "analytic" philosophers have misunderstood the experiential nature of traditional metaphysical language. Some of the implications of this experiential approach to philosophy are explored in terms of the notion of "state-specific metaphysical systems.". (shrink)

How sexuality should be regulated in a liberal political community is an important, controversial theoretical and empirical question—as shown by the recent criminalization of possession of some adult pornography in the United Kingdom. Supporters of criminalization argue that Mill, often considered a staunch opponent of censorship, would support prohibition due to his feminist commitments. I argue that this account underestimates the strengths of the Millian account of private conduct and free expression, and the consistency of Millian anticensorship with feminist values. (...) A Millian contextual defense of liberty, however, suggests several other policy approaches to addressing the harms of pornography. (shrink)

The so-called Turing test, as it is usually interpreted, sets a benchmark standard for determining when we might call a machine intelligent. We can call a machine intelligent if the following is satisfied: if a group of wise observers were conversing with a machine through an exchange of typed messages, those observers could not tell whether they were talking to a human being or to a machine. To pass the test, the machine has to be intelligent but it also should (...) be responsive in a manner which cannot be distinguished from a human being. This standard interpretation presents the Turing test as a criterion for demarcating intelligent from non-intelligent entities. For a long time proponents of artificial intelligence have taken the Turing test as a goalpost for measuring progress. (shrink)

I consider models of political failure based on self-deception. Individuals discard free information when that information damages their self-image and thus lowers their utility. More specifically, individuals prefer to feel good about their previously chosen affiliations and shape their worldviews accordingly. This model helps explain the relative robustness of political failure in light of extensive free information, and it helps to explain the rarity of truth-seeking behavior in political debate. The comparative statics predictions differ from models of either Downsian or (...) expressive voting. For instance, an increased probability of voter decisiveness does not necessarily yield a better result. I also consider political parties as institutions and whether political errors cancel in the aggregate. I find that political failure based on self-deception is very difficult to eliminate. (shrink)

Evidence based-policy (EBP) is a popular research paradigm in the applied social sciences and within government agencies. Informally, EBP represents an explicit commitment to applying scientific methods to public affairs, in contrast to ideologically-driven or merely intuitive “common-sense” approaches to public policy. More specifically, the EBP paradigm places great weight on the results of experimental research designs, especially randomised controlled trials (RCTs), and systematic literature reviews that place evidential weight on experimental results. One hope is that such research designs and (...) approaches to analysing the scientific literature are sufficiently robust that they can settle what really ‘works’ in public policy. Can EBP succeed in displacing reliance on domain-specific expertise? On our account, this is seldom, if ever, the case. The key reason for this is that underlying this approach is generally an appeal to argument by induction, which always requires further assumptions to underwrite its validity, and if not induction, some other argument form that also requires assumptions that are very often not validated for the case at hand. Utility, rights, and holistic standards all point toward some modest steps to limit or check the predatory activity of carnivores relative to their victims. At the very least, we should limit current subsidies to nature’s carnivores. Policing nature need not be absurdly costly or violate common-sense intuitions.

It is commonly claimed that rule consequentialism (utilitarianism) collapses into act consequentialism, because sometimes there are benefits from breaking the rules. I suggest this argument is less powerful than has been believed. The argument requires a commitment to a very particular (usually implicit) account of feasibility and constraints. It requires the presupposition that thinking of rules as the relevant constraint is incorrect. Supposedly we should look at a smaller unit of choice—the single act—as the relevant choice variable. But once we (...) see feasibility as a matter of degree, there is no obvious cut-off point for how broadly we should think about the constraints on our choices. Treating “a bundle of choices” as a relevant free variable is no less defensible than treating “a single act” as the relevant free variable. Rule utilitarianism, rule consequentialism, and other rules-based approaches are stronger than their current reputation. (shrink)

Definitions of human nature have preoccupied philosophers, politicians, anthropologists and social scientists for centuries. Our conceptions of ourselves - what we perceive to be 'human nature' - have taken many forms from the abstract to the biologically determined. In The Human Nature Debate, Harry Cowen describes the diversity of ideas about human nature and demonstrates the extent to which all such ideas are socially and politically grounded, reflecting the prevailing concerns and priorities of their times, from the classical Greek (...) conceptions of 'rational man' to the behaviourist explanations that did so much to bolster and justify fascism and Stalinism in the twentieth century. Cowen's admirably clear introduction to the history of ideas about human nature goes beyond the theorising to the ways in which concepts of human nature have both informed and reflected policy and practice. Drawing on a wealth of evidence and example, he demonstrates the political significance of the human nature debate, and looks at the vital interactions between theory and practice in the social sciences, social policy and social practice. The Repugnant Conclusion is closer to infinity-based arguments, such as Pascal’s Wager, than it at first appears. Both rely on an unbounded set of payoff comparisons. It is possible to restructure Pascal’s Wager to resemble the Repugnant Conclusion more closely, as the use of infinity is not central to the former. I then consider settings in which the set of comparisons is bounded, so as to differentiate Parfit’s problem from the more general issues involved with very large numbers. We then (...) find the Repugnant Conclusion no longer necessarily arises as a matter of logic rather is an empirical contingency. I then present some plausible intuitions under which the Repugnant Conclusion never arises. The paradoxical nature of Parfit’s Repugnant Conclusion is traced to the simultaneous application of two inconsistent outside observer constructs: one to judge the Repugnant Conclusion as repugnant, and another to define the utility scale for a marginally worthwhile life. Abstract:Why hasn’t economic progress lowered work hours more? One of Keynes’s most famous essays is his “Economic Possibilities for Our Grandchildren.” Keynes predicts that within one hundred years — which would bring us to 2030 — most scarcity will have disappeared and most individuals will work no more than fifteen hours a week. My question is a simple one: Why wasn’t Keynes right? Why have working hours remained as long as they have? Why hasn’t progress taken a more leisurely and (...) less material form than what we have observed? Investigating that issue will help us get at the question of just how much progress has occurred. Under one view, Western life has been caught in a kind of rat race, and a lot of the gains of progress are illusory. For instance there is the argument that higher incomes are largely consumed as part of a futile race to win relative status, and living standards aren’t nearly as high as they might appear. Under some alternative scenarios, people haven’t moved to Keynes’s scenario for some good reasons, such as enjoying work more than we might think, or other hypotheses, as I will outline. In that case the observed changes in real income are robust, and measured correctly, or progress may even be greater than income measurements would indicate. I hope that addressing Keynes’s paradox can help us better understand this longstanding debate on the nature of modern progress. (shrink)

Defenders of laissez?faire have not successfully explained the historical experience of the Great Depression. Unemployment was widespread and persistent and cannot be ascribed to government intervention. Legal restrictions offer at best a partial explanation of why real wages did not fall. The Keynesian world view is also supported by experience with investment and equity market volatility, the conversion of Lionel Robbins, the wartime recovery, and the success of postwar macroeconomic performance. Some concluding remarks address how the case for laissez?faire might (...) be revived. (shrink)

I have several obsessions actually, but today we talk about food. When I get home, my wife will ask me, “how did it go?”, and my answer will be, “the breakfast was excellent!” So I travel a great deal, I cook a great deal, and I write an on-line dining guide. I’m one of those people (...) who lives to eat. For a long time now, I have been writing about culture, and creativity, and diversity, and now I am writing about food. And my interest in food really stems from my life, and that is from my obsessive nature. I wanted to be going out there, eating in the best places possible. With this attitude every meal counts.
