This essay explores some moral problems raised by experimentation involving the human fetus. In the first part of the essay three examples of fetal experimentation from the medical literature are described in some detail. Next, the ethical and legal arguments employed in the two major existing public policy-documents on fetal experimentation are analyzed. Finally, the author seeks to identify four fundamental presuppositions which underlie divergent normative positions on the problem of fetal experimentation.

The author investigates the content of the notion of subject from the evolutionary-epistemological point of view. She claims that evolutionary epistemology does not clarify this problem by itself and argues that this state of affairs raises a number of problems such as absolutization of adaptationism, biologism in knowledge, lack of a clear demarcation between animal cognition and human cognitive activity. It is argued that a man is the only subject of cognition in evolutionary epistemology. Inasmuch as person constructs and (...) enriches the environment he becomes a pressure factor by himself. This claim is argued to counter the thesis of adaptation. So adaptationist interpretation of the evolution of human cognitive activity is insufficient. The phenomenon of environmental change through the development of cognitive abilities by the person is represented in society, communication and culture. Cognition is determined by anticipating the result of purpose. In this connection, the constructive activity of the cognitive person confronted with the limitations of her own cognitive capabilities and environmental restricting factors. Thus, the evolution of man is considered as self-development, which is carried out through the creative overcoming external and internal constraints through the constructive activity of the agent of cognition. The study of Kant’s anthropology, proposed by Viktor Kozlovskyi in its original and thorough monograph, is an entirely new interpretation of Kant’s answer to the fundamental question “What is man?”. On the basis of the philosopher’s heritage and taking into account the large body of research lit-erature, Kozlovskyi reconstructs five conceptual “human models” in Kant’s anthropological discourse. However, this study contains a number of problematic statements and conclusions. I argue first, that there is some inconsistency between Kant’s understanding of (...) the concept of “anthropology” and Ko-zlovskyi’s explanation. Second, the model of man as intelligible being, made explicit through the con-cepts of “freedom” and “spontaneity”, is a justified construction within the limits of criticism, but not quite correct with regard to the place and function of “anthropology” in it. Third, we can see a disso-nance between Kozlovskyi’s explanation of the constellations as “chronotopes-events” and interpreta-tion of this concept by Dieter Henrich’s school, where the methodology of “research constellations” was used to elucidate the early phase of German idealism. However, this leads to the cardinal question of how far this methodology is applicable for the analysis of Kant’s philosophy. (shrink)

The performance of a non-task-oriented conversational dialogue system greatly depends on whether it can generate high involvement during conversation with users. In this paper, we clarify the types of utterances concerning involvement in human-human conversational dialogue. First, we define Dialogue Acts and Rhetorical Relations, and propose a method for measuring ``Involvement''. Next, we show that the inter-annotator agreement on these tag schemes is quite high. Finally, we investigate the relationship between DAs/RRs and Involvement. We found that affective utterances (...) and cooperative utterances are significant to generate high involvement in conversational dialogue. (shrink)

This article interrogates the bureaucratization of war, incarnate in the covert lethal drone. Bureaucracies are criticized typically for their complexity, inefficiency, and inflexibility. This article is concerned with their moral indifference. It explores killing, which is so highly administered, so morally remote, and of such scale, that we acknowledge a covert lethal program. This is a bureaucratized program of assassination in contravention of critical human rights. In this article, this program is seen to compromise the advance of global justice. (...) Moreover, the bureaucratization of lethal force is seen to dissolve democratic ideals from within. The bureaucracy isolates the citizens from lethal force applied in their name. People are killed, in the name of the State, but without conspicuous justification, or judicial review, and without informed public debate. This article gives an account of the risk associated with the bureaucratization of the State’s lethal power. Exemplified by the covert drone, this is power with formidable reach. It is power as well, which requires great moral sensitivity. Considering the drone program, this article identifies challenges, which will become more prominent and pressing, as technology advances. This article takes Heidegger's design distinctions for human being [Dasein] including affectivity, understanding, and speech, and, using these distinctions, generates a Heideggerian definition of empathy [Einfuehlung]. This article distinguishes empathic receptivity, empathic understanding, empathic interpretation, and empathic speech (or responsiveness). It also looks at characteristic breakdowns.

The precarious rights of senior citizens, especially those who are highly educated and who are expected to counsel and guide the younger generations, has stimulated the creation internationally of advocacy associations and opinion leader groups. The strength of these groups, however, varies from country to country. In some countries, they are supported and are the focus of intense interest; in others, they are practically ignored. For this is reason we believe that the creation of a network of all these associations (...) is essential. The proposed network would act as a support for the already-existing policies of the United Nations’ High Commission for Human Rights, of independent experts, and of the Global Alliance for the Rights of Older People. All three have long ago recommended the creation of a recognized instrument for uniting presently scattered efforts. The proposed network, therefore, will seek to promote the international exchange of relevant expertise, and it will reinforce the commitments and actions that single countries are currently taking to meet these objectives. For example, informative public events can be organised to promote particular support initiatives and to provide an opportunity for new members of the network to be presented. The network will promote health for senior citizens, disease prevention, senior mobility, safe free time for seniors, alimentary education, protection against new risks and dangers, as well as equity in the services necessary for seniors to adopt new information and communication technologies. In the case of retired academic members, the network will promote equality with respect to continuing use of digital technologies (particularly email), continuing access to research libraries, and the guaranteed ability for seniors to fund their own research programs and to deliver free seminars. Informed consent is an essential step in helping patients be aware of consequences of their treatment decisions. With surgery, it is vitally important for patients to understand the risks and benefits of the procedure and decide accordingly. We explored whether a written IC form was provided to patients; whether they read and signed it; whether they communicated orally with the physician; whether these communications influenced patient decisions. Adult postsurgical patients in nine general hospitals of Italy’s Campania Region were interviewed via (...) a structured questionnaire between the second and seventh day after the surgery at the end of the first surgical follow up visit. Physicians who were independent from the surgical team administered the questionnaire. The written IC form was given to 84.5% of those interviewed. All recipients of the form signed it, either personally or through a delegate; however, 13.9% did not know/remember having done so; 51.8% said that they read it thoroughly. Of those who reported to have read it, 90.9% judged it to be clear. Of those receiving the written consent form, 52.0% had gotten it the day before the surgery at the earliest 41.1% received it some hours or immediately before the procedure. The written IC form was explained to 65.6% of the patients, and 93.9% of them received further oral information that deemed understandable. Most attention was given to the diagnosis and the type of surgical procedure, which was communicated respectively to 92.8 and 88.2% of the patients. Almost one in two patients believed that the information provided some emotional relief, while 23.2% experienced increased anxiety. Younger patients and patients with higher levels of education were more likely to read the written IC form. The written IC form is not sufficient in assuring patients and making them fully aware of choices they made for their health; pre-operative information that was delivered orally better served the patients’ needs. To improve the quality of communication we suggest enhancing physicians’ communication skills and for them to use structured conversation to ensure that individuals are completely informed before undergoing their procedures. The distinction between “empathy” and “sympathy” in the context of ethics is a dynamic and challenging one. The eighteenth century texts of David Hume and Adam Smith used the word "sympathy," but not "empathy," although the conceptual distinction marked by empathy was doing essential work in their writings. After discussing the early uses of these terms, this article is organized historically. Two traditions are distinguished. The first is the Anglo-American tradition, and it extends from Hume and Smith to the twenty-first (...) century work of Michael Slote. Stephen Darwall’s contribution is applied in engaging Hume and Smith. Finally, the interrelation of empathy, sympathy and altruism is explored in the work of John Rawls and Thomas Nagel. The second tradition is the Continental one. It extends from the spirituality of Johann Herder to the phenomenological movement of Edmund Husserl, Martin Heidegger, Max Scheler, and Edith Stein. The intentional analysis of empathy is directly relevant to the constitution of the social community in a broad, normative relationship with the "Other.". (shrink)

Recent work by Keyser in applied epistemology of experiment has focused on the iterative ‘production’ of knowledge: knowledge stabilizes within a given physical context and it is iteratively tested within that context to meet standards of reliability. This implies that in a given physical context (e.g., laboratory), the inferences, methods/techniques, and physical products form coherence relations with one another. We apply this epistemological stabilization account to the martial arts in order to argue that the context of stabilization dictates the training (...) methods, techniques, and even the philosophical concepts of a given martial arts system. We describe key elements of stabilization pertaining to rules, training methodology, warrior philosophy, and spectator/media tropes. The account of stabilization requires a case study that shows how a dynamic system is stabilized. We describe the stabilization of modern mixed martial arts by tracking it on a time scale, but also in different contexts (e.g., Pancrase, Pride, UFC). (shrink)

The implicit activities of the living body in sports (such as heart rate, involuntary gestures, stress, reflex, emotional regulation and interaction expressions) emerge in the consciousness of the lived body without our voluntary control. We demonstrate physiological emersion, and how, including in dramaturgical perception, physiological flows and processes collide with the image of a whole body. In this paper, we introduce corporeal non-property as the missing (?) link between phenomenology and neuroscience, renewed by research on the cerebral unconscious and the (...) perception of their lived body. Rather than mindfulness, physical activity obliges the subject to learn the unconscious and his motor skills from his living body: a new psychoanalysis of sport is thus established by studying what emerges from the activity of the living body up to the level of the conscious description of motor action. In this paper, we explain why that awareness occurs, and why it matters for the understanding of unconscious activity of the athlete’s living body. This is potentially interesting, although it needs, as a theory, to overcome the obvious reliance of the body on unconscious or habitual/automated physiological processes. But the incorporation of body techniques forms a habitus. (shrink)

We defend in this essay Paul Ricœur’s hermeneutics of suspicion against Toril Moi’s debunking of it as a misguided interpretation of the practice of critical inquiry, and we relate the practice of a rigorous and critical empathy to the hermeneutics of suspicion. For Ricœur, empathy would not be a mere psychological mechanism by which one subject transiently identifies with another, but the ontological presence of the self with the Other as a way of being —listening as a human action (...) that is a fundamental way of being with the Other in which “hermeneutics can stand on the authority of the resources of past ontologies.” In a rational reconstruction of what a Ricœur-friendly approach to empathy would entail, a logical space can be made for empathy to avoid the epistemological paradoxes of Husserl and the ethical enthusiasms of Levinas. How this reconstruction of empathy would apply to empathic understanding, empathic responsiveness, empathic interpretation, and empathic receptivity is elaborated from a Ricœurian perspective. There was, however, a communal or social dimension to this even in ancient Greece. In the unfolding process of time, this latter dimension assumed greater intensity and expanded systematically into all aspects of human relations. The centrality of money in these relations speaks to the transition from “man is the measure of all things” to money is the measure of all things. (...) Vision is known to improve human postural responses to external perturbations. This study investigates the role of vision for the responses to continuous pseudorandom support surface translations in the body sagittal plane in three visual conditions: with the eyes closed, in stroboscopic illumination and with eyes open in continuous illumination with the room as static visual scene. In the frequency spectrum of the translation stimulus we distinguished on the basis of the response patterns between a low-frequency, mid-frequency, and high-frequency (...) range. With EC, subjects’ mean sway response gain was very low in the LFR. On average it increased with EO/SI and more so with EO/CI. In contrast, the average gain in the MFR decreased from EC to EO/SI and further to EO/CI. In the HFR, all three visual conditions produced, similarly, high gain levels. A single inverted pendulum model controlling center of mass balancing about the ankle joints formally described the EC response as being strongly shaped by a resonance phenomenon arising primarily from the control’s proprioceptive feedback loop. The effect of adding visual information in these simulations lies in a reduction of the resonance, similar as in the experiments. Extending the model to a double inverted pendulum suggested in addition a biomechanical damping effective from trunk sway in the hip joints on the resonance. (shrink)

Background: The importance of trust between patients and healthcare personnel is emphasised in nurses’ and physicians’ ethical codes. Trust is crucial for an effective healthcare personnel–patient relationship and thus for treatment and treatment outcomes. Cultural and linguistic differences may make building a trusting and positive relationship with ethnic minority patients particularly challenging. Although there is a great deal of research on cultural competence, there is a conspicuous lack of focus on the concepts of trust and distrust concerning ethnic minority patients, (...) particularly in relation to the concept of ‘othering’. Aim: To study which factors help build trust or create distrust in encounters between healthcare professionals and hospitalised ethnic minority patients, as well as study the dynamic complexities inherent within the process of ‘othering’. Research design: Qualitative design, in-depth interviews and hermeneutic analysis. Participants and research context: The interviewees were 10 immigrant patients (six women and four men – eight Asians, two Africans – ages 32–85 years) recruited from a south-eastern Norwegian hospital. Ethical considerations: Study approval was obtained from the hospital’s Privacy Ombudsman for Research and the hospital’s leadership. Participation was voluntary and participants signed an informed consent form. Conclusion: Distrust and othering may be caused by differences in belief systems, values, perceptions, expectations, and style of expression and behaviour. Othering is a reciprocal phenomenon in minority ethnic patient–healthcare personnel encounters, and it influences trust building negatively. Besides demonstrating general professional skill and competence, healthcare personnel require cultural competence to create trust. (shrink)

Shortages in the number of donated organs after death and the growing number of end-stage organ failure patients on waiting lists call for looking at alternatives to increase the number of organs that could be used for transplantation purposes. One option that has led to a legal and ethical debate is to have regulated markets in human organs. Opponents of a market in human organs offer different arguments that are mostly founded on contingent factors that can be adjusted. (...) However, some authors have asked the question whether we still have a reason to believe that there is something wrong with offering human organs for sale for transplantation purposes, even if the circumstances under which the practice takes place are improved. One prominent argument regarding this appeals to the notion of human dignity. It is argued that organ selling violates human dignity. This paper presents a systematic discussion of dignity-based arguments in the organ selling debate, and then develops a social account of dignity. It is argued that allowing the practice of organ selling inherently runs the risk of promoting the notion that some persons have less worth than others and that persons have a price, which is incompatible with dignity. The approach is defended against possible objections and it is shown that it can capture the notion that autonomy is linked to human dignity in important ways, while dignity at the same time can constrain the autonomous choices of persons with regards to certain practices. As a consequence of the problems caused by genetic discrimination, federal and state law makers are being pressured to pass a legislative remedy. A primary question is whether the Americans with Disabilities Act of 1990 applies to individuals with a potentially disabling genetic disorder who are pre-symptomatic or asymptomatic and may never become ill and to healthy individuals who are carriers of genetic conditions. At present, this question has relevance principally for individuals with the genotype for single gene disorders, like (...) Huntington disease and hemochromatosis, and to asymptomatic carriers of single gene disorders such as cystic fibrosis. Although many such single gene conditions exist, the total incidence of these conditions in the U.S. population is less than 0.4 percent. However, the question concerning the applicability of the ADA will become increasingly important because genetic tests will almost certainly be developed in the near future for common multifactorial diseases like diabetes, heart disease, and certain forms of cancer. Richard Price is remembered mainly for his work in moral philosophy, A Review of the Principal Questions and Difficulties in Morals. He also wrote widely and effectively on the political and economic problems of his time; he contributed with rare distinction to the polemical pamphlet literature which surrounded the America revolution. He was devoted to the American cause, and he analyzed and attacked British policies not only on grounds of utility but also in consideration of rationally apprehended natural rights. In (...) this regard, his most famous pamphlets are his Observations on the Nature of Civil Liberty, Additional Observations on the Nature and Value of Civil Liberty, and Observations on the Importance of the American Revolution. The so-called epistemological turn of the Descartes-Locke-Kant tradition is a hallmark of modern philosophy. The broad family of normativism constitutes one major response to the Cartesian heritage building upon some version of the idea that human knowledge, action and sociality build fundamentally upon some form of social agreement and standards. Representationalism and the Cartesian picture more generally have been challenged by normativists but this paper argues that, even where these challenges by normativism have been taken to heart, our intellectual (...) culture remains fundamentally epistemic in certain problematic senses. Two problems are highlighted: first, normativism remains functionally Cartesian, for human action and sociality appear as processes driven by the shared understandings by competent contributors, and second, normativism is unable to account for forms of human action and sociality other than those occurring in the relatively small worlds of normatively regulated conceptual spaces of mutual access and listening. These points are illustrated by an applied discussion of the blind spots of normativist accounts of the emerging environmental and the on-going economic crises. (shrink)

In July 1940, Simone de Beauvoir began a routine of going to the Bibliothèque Nationale most days from 2.00 to 5.00 p.m. to read G. W. F. Hegel's Phenomenology of Spirit. Hitler's armies had invaded and occupied Paris earlier, on June 14, 1940. She was teaching philosophy classes at a girls' lycée and living in her grandmother's empty apartment. Her close companion, Jean-Paul Sartre, who had been a soldier in a meteorological unit of the French Army, had been captured and (...) was now being held in a German prisoner-of-war camp. Beauvoir was relieved to receive a note from him sent on July 2 saying he was being well treated, but life in Paris was dismal. Food was scarce, and the German troops were grim reminders of Parisians' lack of political freedom. Her reading routine helped soothe the dread, isolation, and alienation she felt. Beauvoir had always been a very earnest student. She had passed the demanding aggregation exam in philosophy at the young age of twenty-one. To supplement her knowledge of classical philosophical texts, she learned German and read texts in phenomenology. In 1935 she had read Edmund Husserl's The Phenomenology of Internal Time-Consciousness “without too much difficulty.” She also read Heidegger and translated long passages into French for Sartre. Back when she was in college, her prodigious work habits had earned her a special nickname among her friends: Castor, or the beaver. Poring over a difficult philosophical text in a foreign language for three hours a day might seem a strange way to get through such times, but with her it made sense. (shrink)

London and New York: Routledge, 1998. As this special volume attests, there has been a recent resurgence of interest in Simone de Beauvoir. A number of books on her have been published in the last several years. However, Elizabeth Fallaize's book, Simone de Beauvoir: A Critical Reader (1998), occupies (...) a special niche. Many of its essays are excerpts from studies done of Beauvoir's work before this latest renaissance. Some of these studies are not in print in the United States. Some are perhaps unfamiliar to present-day readers or those from different disciplines. In addition, the articles reprinted here are otherwise not easily accessible. Fallaize has performed an important service by gathering them all in one place and by carefully editing, presenting, and, in some cases, translating them. -/- The book is divided into three sections, the first entitled "Readings of The Second Sex." Aside from Judith Okely's piece that assesses Beauvoir's chapter on myths from an anthropological standpoint, the essays mainly address the philosophical aspects of this work. Beauvoir herself of course swore that she was not a philosopher and that Jean-Paul Sartre's Being and Nothingness (1953) was the sole philosophical foundation for all her work. Some recent analyses have attempted to turn this picture on its head by arguing that Beauvoir was a central influence on, or even the origin of, the philosophical doctrines put forward in Being and Nothingness. None of the writers in this book addresses this issue. But two emphasize Beauvoir's intellectual independence from Sartre. -/- The Swedish scholar Eva Lundgren-Gothlin argues that Beauvoir turned to G. W. F. Hegel to find a satisfactory theoretical model with which to explain the subjugation of women (Lundgren-Gothlin's essay is taken from her book [End Page 186] Sex and Existence [1996]) . In opposition to other scholars, she argues that the French Hegelian Alexandre Kojève, not Sartre, influenced Beauvoir's interpretation of Hegel. Following Hegel and Kojève, Beauvoir envisioned a possible resolution to the struggle for recognition—reciprocal recognition—whereas Sartre's view of self-other relations in Being and Nothingness rules such reciprocity out. However, Lundgren-Gothlin judges, Beauvoir was not critical enough of the sexist presuppositions of Hegel's thought, citing the same pronouncements Beauvoir makes that subsequent feminists have criticized. -/- Another piece that stresses Beauvoir's philosophical originality is "Beauvoir: The Weight of Situation," taken from Sonia Kruks's book Situation and Human Existence (1990). For some time, Kruks has been doing excellent work placing Beauvoir within the wider phenomenological tradition. In this piece, she argues that, starting with the early essay Pyrrhus et Cinéas (1944) and culminating in The Second Sex (1989), Beauvoir elaborated a more nuanced position on the nature and extent of human freedom than Sartre did in Being and Nothingness. According to Beauvoir, human freedom, which Sartre dramatically proclaims is absolute, can under some conditions, notably conditions of severe oppression, "be reduced to no more than a suppressed potentiality" (Fallaize 1998, 57). In The Second Sex, Beauvoir definitively breaks with the philosophical framework of Being and Nothingness by implying that a woman's situation is a general one, not individually self-constituted, and one that she cannot transcend by an act of free choice. The phenomenology of Maurice Merleau-Ponty provides a better foundation for Beauvoir's conception of subjectivity as socially mediated and embodied than does Sartre's philosophy, Kruks suggests. -/- Another piece in this section, Judith Butler's landmark essay "Sex and Gender in Simone de Beauvoir's Second Sex" (1986), highlights Beauvoir's philosophical originality in a different way. In her introduction, Fallaize points out how this essay served as a foundation for Butler's own subsequent work on a performative theory of gender. Butler argues that Beauvoir's claim that one is not born but becomes a woman implies that gender is socially constructed and not natural, as people have insisted for centuries. Theoretical and practical deliberation are voluntary activities, and like all voluntary activities, they are performed for reasons. To hold that all voluntary activities are performed for reasons in virtue of their relations to past, present, or even merely possible acts of deliberation thus leads to infinite regresses and related problems. As a consequence, there must be processes that are nondeliberative and nonvoluntary but that nonetheless allow us to think and act for reasons, and these processes must be the ones that (...) generate the voluntary activities making up ordinary deliberation. These nondeliberative, nonvoluntary processes by means of which we are able to deliberate for reasons are the fundamental processes by means of which we can think or do anything for a reason: once it has been seen that they must exist, it can be recognized that they are ubiquitous. As a result, the usefulness of deliberation to rational belief and action is intermittent, contingent, and modest. Deliberation is a tremendously valuable tool for increasing human capacities to think and act for good reasons in challenging contexts, but in the end it is merely a tool, wielded by people through the same nondeliberative, nonvoluntary capacities to think and act for reasons that they are enhancing the effectiveness of by deliberating. We contribute to the exploration of diversity in interdisciplinary science by elaborating the notion of epistemic commitments to address researchers’ different views of knowledge that matters and how these views are embedded in research practices and networks. Based on previous science and technology studies and science-policy literature, we define epistemic commitments as reflexive commitments to regimes of relevant research. Drawing on an in-depth enquiry in the case of biodiversity studies in France, we describe four regimes of research, each of them (...) bringing together certain disciplinary approaches and technologies, certain scenarios about environmental changes and certain contributions to decision making and management. We distinguish between an environmentalist regime, a management-oriented regime, a function-based regime, and an ecoengineering regime. We give insights into how researchers’ commitments to these regimes are shaped, stabilized, and maintained over time, suggesting the coevolution of research practices, practical contributions, and environmental scenarios. We emphasize pluralism rather than hegemony of a type of knowledge over the others. Our results show that environmental research’s diversity does not result only from the complexity of reality itself but is also embedded in various views of scientific advancement, future scenarios, and useful contributions to environmental governance. Many psychiatrists tell their clients that any mental disorder is ‘‘a disease, just like diabetes’’. This slogan appears to suggest that mental states and behavior that are classified ‘‘mental disorders’’ are somehow radically different from other mental states and behaviors—both when it comes to simply understanding people and when it comes to moral assessments of mental states and of actions. After all, mental illness is just like diabetes, while other human conditions are not. That sounds like a huge difference. (...) I think this suggestion is misleading. (shrink)

While Neo-Aristotelians argue quite plausibly that it is hard to get to eudaemonia if one is wicked, I argue that they fail to show that the seeker of flourishing has a reason to become virtuous (as opposed to morally mediocre).

It is widely agreed that benevolence is not the whole of the moral life, but it is not as widely appreciated that benevolence is an irreducible part of that life. This paper argues that Kantian efforts to characterize benevolence, or something like it, in terms of reverence for rational agency fall short. Such reverence, while credibly an important part of the moral life, is no more the whole of it than benevolence.

Bertrand Russell claimed in the Analysis of Matter that physics is purely structural or relational and so leaves out intrinsic properties of matter, properties that, he said, are evident to us at least in one case: as the internal states of our brains. Russell's hypothesis has figured in recent discussions of physicalism and the mind body problem, by Chalmers, Strawson and Stoljar, among others, but I want to reject two popular interpretations: 1. a conception of intrinsic properties of matter as (...) categorical properties and 2. a fallacious line of descent argument that attributes pan-psychist or proto-experientialist properties to matter by analogy with human minds. Instead, I think Russell's hypothesis points us toward 1. a doctrine of concretely instantiated dispositions in matter and 2. selectively instantiated relations. (shrink)
