Les signifiants fonctionneraient comme des attracteurs dans le lien. Les signifiants inconscients sont véhiculés par le transgénérationnel et«s’accrochent » au corps du sujet. Ils se révèlent donc via le rêve, en image d’abord et par la perlaboration groupale. Ils peuvent se « désagripper du corps », de (...) la sensation, et redeviennent mobiles, circulent plus librement et se complexifient, dans le cadre de la cure familiale, grâce à la dynamique transféro-contretransférentielle. Recent empirical research demonstrates that cross-holding engenders significant anti-competitive effect even though it confers no decisive influence on the target firm. This research has obtained wide attention, which leads to both calls for and actual changes in antitrust policy. However, the effects of cross-holding on competition are not well established. This paper examines the collusive effect of cross-holding with asymmetry in cost functions across firms in an infinitely repeated Cournot duopoly game. The two firms have a different share of capital (...) that affects marginal costs. We find that cross-holding facilitates collusion when a small firm (i.e., a firm with a small capital capacity) increases its passive ownership in a big firm (i.e., a firm with a large capital capacity), and the size of initial ownership is relatively small. Unexpectedly, collusion becomes more difficult to be sustained when a big firm increases ownership in a small firm, or when a small firm increases ownership in a big firm but the initial ownership is relatively large. Our result that cross-holding may either facilitate or hinder collusion, under certain circumstances, generates important implications for antitrust policy. (shrink)

We study a first-price auction preceded by a negotiation stage with complete information, during which bidders may form a bidding ring. We prove that in the absence of externalities, the grand cartel forms in equilibrium, allowing ring members to gain the auctioned object for a minimal price. However, identity-dependent externalities may lead to the formation of small rings, as often observed in practice. Potential ring members may condition their participation on high transfer payments as a compensation for their expected externalities (...) if the ring forms. The cartel may therefore profitably exclude these bidders, although risking tougher competition in the auction. We also analyze ring efficiency in the presence of externalities, showing that a ring may prefer sending an inefficient member to the auction, if the efficient member exerts threatening externalities on bidders outside the ring, which in turn leads to a higher winning price. This paper explores ethical questions arising from the work of health practitioners in immigration detention centres in Australia. It raises questions about the roles of professional disciplines and the ways in which they confront dual loyalty issues. The exploration is guided by interviews conducted with health professionals who have worked in asylum seeker detention and an examination of the outsider advocacy role undertaken by the social work profession. The paper discusses the stance taken by individuals and professional associations on participation (...) in controlled settings, including as participant, bystander and advocate, and asks when the provision of care becomes collusion with oppression. The morality of tendering practices is an issue of economic and social significance, especially when large government contracts are involved. Criticisms are mostly concentrated around collusive tendering: illegal agreements between tenderers that result in seemingly competitive bids, price fixing or market distribution schemes that circumvent the spirit of free competition and defraud clients. Although collusion has been identified as an endemic malaise of tendering, its behavioural and moral dimensions have not been systematically studied before. This essay provides an analytic review of Jasbir Puar’s book, Terrorist Assemblages (2007), situating her discussion and analysis of “homonationalism” within the context of recent developments in queer theory in the USA, and specifically, critiques of queer liberalism and gay imperialism; racial analyses of hetero- and homo-normative formations; and challenges to identity politics and representational frameworks that dominate LGBT studies. It takes up Puar’s interest in finding new methods and ‘reading’ practices to track certain shifts in LGBT politics and to (...) account for alignments between (white) queerness and normative, nationalist and imperial interests. Engaging with and expanding on her analysis, this paper discusses the challenge that Terrorist Assemblage poses to the identity categories that undergird human rights campaigns, and addresses the racist and nationalist sentiments that she locates within them. It is shown here that injustices due to racial discrimination are best identified in light of the deleterious effects they have upon their victims, rather than the beliefs and attitudes of their perpetrators. For among participants who cooperate clandestinely to bring about racial injustice there may be broad disagreement about what it is they are doing collectively, and why; or they may disagree in principle about whether what they are doing is morally right. I employ the notion of ‘nomotropic’ behaviour (...) to replace the oversimplified notion of ‘rule-following’ in order to explain how duplicity and hypocrisy fall shy of being regarded as irrational in social climates where implicit norms reinforce racial privileging while explicit norms denounce it. Further, examining the ‘collective utility’ of dogmatic beliefs and norms comprising part of the social architecture that covertly reinforces racial injustice may help to explain why it often seems to make so little diffe... The following article has its basis in the respective chapter of my book entitled Work, Death, and Life Itself . In the present article I intend to elaborate the working hypothesis that the attempt to increase and extend participation in contemporary work enterprises can be understood more than ever before as a collusive quarrel between managers and workers about immortality. The quarrel has its roots in the widespread experience of the discrepancy between the vigour with which participation in organisations is (...) demanded and offered on the one hand and the inadequacy and limitations of its actual realisation on the other. Attempts to increase participation in a work enterprise are often confronted at an early stage with insoluble difficulties which too often lead to termination of the participation project.Although participation in general, and in work enterprises in particular, is generally seen as a paradigm for integration, co operation and democratisation among more or less equal partners, I propose the hypothesis that any attempt to practice participation will most probably lead to a situation in which management and workers get entangled in a collusive quarrel concerning the preconditions, content and range of said participation. Sustained by the predominant myth that management means the management of people, workers tend to become infantilised. The deep contempt and mistrust that so often characterise relations between managers and workers and/or their respective representatives thus poisons any simultaneous desire for trust and cooperation.In an analogy with ancient Greek mythology and its inherent quarrel between the immortal gods and the mortal ephemerals, the collusion between management and workers in contemporary work enterprises can be understood as a quarrel about participating in immortality. Since immortality is a limited resource, it is only available to the happy few. The collusive quarrel and the underlying split between managers and workers can only be overcome if both parties recognise that as human beings they can neither escape mortality nor relieve the other of it. In what sense might the authoritarian practices and suspension of legal norms as means to combat the supposed threat of “terrorism,” within and by contemporary western democratic states, be understood as a problem of and not for democracy? That question lies at the heart of this article. It will be explored through the theoretical frame offered in the work of Giorgio Agamben on the state of exception and the example of British state collusion in non-state violence in the North (...) of Ireland. The North of Ireland provides a particularly illuminating case study to explore how the state of exception—the suspension of law and of legal norms and the exercise of arbitrary decision—has increasingly become a paradigm of contemporary governance. In so doing it brings into question not only the traditional conceptualization of the “democratic dilemma” of liberal democratic states “confronting terrorism” but also challenge dominant paradigms of transitional justice that generally fail to problematize the liberal democratic order. After outlining Agamben’s understanding of the state of exception the article will chart the development of “exceptional measures” and the creation of a permanent state of emergency in the North, before critically exploring the role of collusion as an aspect of counter-insurgency during the recent conflict. The paper will argue that the normalization of exceptional measures, combined with the need to delimit the explicitness of constitutional provision for the same, provided a context for the emergence of collusion as a paradigm case for the increasing replication of colonial practices into the core activity of the contemporary democratic state. Different areas of child welfare work call for psychometric measurement to replace professionals’ judgements with objective numbers. Using data from a national Swedish evaluation of interventions for abused children, the present article investigates child interviewees’ resistance to constraints in psychometric questions. The article contributes to studies of how psychology operates in institutional settings; it looks into the discursive production of the interviewee’s position in the struggle between the principle of recordability and ‘sensitive’ interviewing. The findings suggest that interviewees resist questions’ (...) structural restrictions in the service of telling the interviewer about their lives. Thus, the function of their misalignment is affiliative; it cooperates both with the institutional goal of eliciting information and with the interviewer’s interest in them. However, the interviewer’s solutions to children’s problem presentations remain focused on generating recordable answers. The article concludes that the narrow focus on recordability neglects important opportunities to talk about children’s experiences. (shrink)

In The Ambivalent State Javier Auyero and Katherine Sobering examine the fascinating world of clandestine relationships between police officers and drug dealers in Argentina. Drawing on a unique combination of ethnographic research and hundreds of pages of wiretapped phone conversations, they analyze the inner-workings of police-criminal collusion and how they shape drug markets, policing in poor urban areas, and daily life at the urban margins.

Recent history reveals a series of rogue traders, jeopardizing their employers’ assets and reputation. There have been instances of unauthorized acting in concert between traders, their supervisors and/or firms’ decision makers and executives, resulting in collusive rogue trading. We explore organizational misbehaviour theory and explain three major collusive rogue trading events at National Australia Bank, JPMorgan with its London Whale and the interest reference rate manipulation/LIBOR scandal through a descriptive model of organizational/structural, individual and group forces. Medical collaboration with authoritarian regimes historically has served to facilitate the use of torture as a tool of repression and to justify atrocities with the language of public health. Because scholarship on medicalized killing and biomedicalist rhetoric and ideology is heavily focused on Nazi Germany, this article seeks to expand the discourse to include other periods in which medicalized torture occurred, specifically in Argentina from 1976 to 1983, when the country was ruled by the Proceso de Reorganización Nacional military regime. (...) The extent to which medical personnel embedded themselves within the Proceso regime’s killing apparatus has escaped full recognition by both scholars and human rights activists. This article reconstructs the narrative of the Proceso’s human rights abuses to argue that health professionals knowingly and often enthusiastically facilitated, oversaw, and participated in every phase of the “disappearance,” torture, and mass murder process. Most people hold overly (though not excessively) positive self-views of themselves, their ability to shape environmental events, and their future. These positive illusions are generally (though not always) beneficial, promoting achievement, psychological adjustment, and physical well-being. Social processes conspire to produce these illusions, suggesting that affiliation patterns may have evolved to nurture and sustain them.

Trust has traditionally been regarded as conducive to ethical decision making. However, empirical studies on the relationship between trust and ethical decision making are rare, especially those concerning the negative effects of trust. Therefore, our study aimed to provide empirical evidence in this area. An experiment was designed to investigate whether trusted parties are more likely than non-trusted parties to enter into a collusion that will have unfair consequences for a third party. The results showed that trusted parties are (...) significantly more likely to collude than are non-trusted parties. Furthermore, an ancillary analysis revealed the mechanism of trust. First, participants with a stronger need to collude were the most likely to collude in the trust group. Second, experimental and hypothetical settings generated different results, and we suspect that real harm plays a vital role. Overall, we conclude that the absence of trust serves as an impediment to collusion. (shrink)

The classification of collusion behaviors of government-invested project tenderers is one of the important methods to describe the characteristics and laws of collusion behaviors and strengthen the governance of collusion. Firstly, the variables that affect the type of collusion behavior are selected and cluster analysis is carried out on the cases of collusion in government investment project bidding. Then use the social network to mine the types and characteristics of the collusion behavior of the (...) tenderee. Finally, a BP neural network automatic identification model is established to quickly discriminate the types of collusion, which can effectively overcome the subjectivity of traditional methods. As a result, three typical types of collusion of tenderees can be obtained: intervention type, opportunity type, and cooperation type. The study found that the three types of collusion behavior have their own characteristics and laws, and the relationship between the variables that affect the type of collusion behavior is complex and affects each other. Anxieties stemming from rising inequalities have led significant sections of the world’s population to reject democratic practices and place their trust in politicians with fascist tendencies who promise to wrest control of their destinies from elites. Ironically, elite interests, far from being threatened, are bolstered by the rise of fascism, as discredited democratic institutions can be dismantled with impunity. The emerging alliance between the neoliberal project and fascist politics is a phenomenon that the business and society scholarship is ill-equipped to (...) confront as it remains trapped in the same neoliberal pro-elite paradigms that neglect meaningful attention to material equality and focus instead on ensuring a minimum floor of rights required for subsistence. Neglecting the concentration of wealth among the elite, particularly in countries with historic legacies of inequalities based on race, caste, ethnicity, and religion, creates ideal conditions for the eruption of fascisms premised upon programmatic denial of the full range of civil rights to one or more sections of the population, so that even the floor minimum becomes impossible to achieve for all. This paper argues that corporate collusions with fascism can be challenged only by a commitment to redistribution of wealth and creating critical citizens and by generating knowledge that can question authority: in other words, scholarship must become a subversive activity. Objective: To determine whether the marks in the third year Objective Structured Clinical Examination were affected by the collusion reported by the students themselves on an electronic discussion board.Design: A review of the student discussion, examiners’ feedback and a comparison of the marks obtained on the 2 days of the OSCE.Participants: 255 third year medical students.Setting: An OSCE consisting of 15 stations, administered on three sites over 2 days at a UK medical school.Results: 40 students contributed to the discussion (...) on the electronic discussion board. The main points raised were perceived inequity between students who did, or did not, have prior knowledge of the station content, and the lack of honesty and professionalism of their peers. Most contributors claimed to have received, or knew of others receiving, prior knowledge, but none confessed to passing on information. No significant difference was observed in the overall mark for the OSCE on day 1 ) and day 2 ). On day 2, marks were considerably greater for four stations and markedly lower for three stations. It was not obvious why collusion should affect these station marks. A clear indication of the effects of collusion could only be obtained from a single subsection of an individual station where 82 students on day 2 incorrectly gave the diagnosis from day 1.Conclusion: Marks do not provide a sound inference of student collusion in an OSCE and may mask the aspects of professional development of students. The surge of the conquest of black African women grows rapidly as indicated by the multifaceted oppressions experienced by black African women today. Although coloniality is supposed to be a thing of the past, its stench still wreaks havoc for the present-day black African woman whose reality of experience is that of 'triple pain' (Vellem 2017). Colluding with the church, colonisers reinforced and justified the centralisation of the west in Africa, which was established through violence and consequently led to the (...) conquest of black humanity. However, womanism has argued that it was black African women who, in addition to being conquered based on their race, were rigorously subjected to patriarchal violence. Today, the church has a prominent role in the lives of many black African women; thus the church has an integral responsibility of pursuing liberation of black African women and ultimately all humanity (Kobo 2018). Nevertheless, the church cannot move towards liberation without critiquing the toxic relationship between church and coloniality and its legacy of the conquest of black African women through patriarchal violence. Undoubtedly, many black African women continue to experience patriarchal violence to this day, and the church has many a time become the source of their suffering. This calls for a serious engagement within the liberation discourse to uproot colonial legacy of the conquest of black African women. CONTRIBUTION: The purpose of this article is to explore the relationship between the church and coloniality, and how this relationship has impacted the lives of black African women. Employing womanism as the primary framework, this article seeks to offer a womanist critique that seeks to disrupt the collusion of church and coloniality in its legacy of the perpetuation of patriarchal violence which leads to the conquest of many black African women today. This study investigates the impact of cheap talk on price and participant profits using a repeated Bertrand oligopoly experiment. During the first 10 rounds, participants are not allowed to communicate with each other. Twenty additional rounds are then played in which the participants can text with one another using an instant message system. Some groups are allowed to text before every round, some before every other round, some every third round, some every fourth round, and others only every fifth round. (...) On average, when texting is allowed, groups attempt to collude to raise the price after being allowed to text. In summary, success in collusion with cheap talk is correlated with a combination of how often participants can text, the subject of their texts, and whether participants actually text when they can. The heavy drinking of alcohol remains primarily a hegemonically masculine ritual worldwide. Yet scholarship has undertheorized women’s practices in shaping the boundaries of masculine rituals, including drinking. Drawing on 12 months of ethnographic fieldwork and 151 interviews with single mothers, married mothers, nonresident fathers, and grandmothers from diverse class backgrounds, I demonstrate that Russian women perform extensive invisible management labor in attempting to produce responsible men. Constrained by a starkly unequal gender division of domestic labor, wives and mothers engage in (...) varied “patriarchal bargains” as they shape men’s drinking practices, co-producing hegemonic masculinity. Whereas in the Soviet period women also managed men’s drinking, today new gender strategies have emerged. More women are held accountable to a collusive femininity involving both accommodation and resistance, upholding men’s drinking privileges only if breadwinning occurs. As women perform invisible labor, they end up reproducing the conditions that demand this labor from them in the first place. Some women embrace an alternative femininity by becoming single mothers and refusing to manage men’s drinking, especially when men fail as breadwinners. Theorizing collusive and alternative femininities, as well as women’s invisible labor, advances our knowledge of how multiple femininities shape, and may in time change, hegemonic masculinity. Physician‐investigators face the daunting task of enrolling desperate patients into Phase I cancer trials that are not meant to be therapeutic. Patients doggedly regard the trials as therapeutic, and researchers tend to collaborate in their confusion by glossing the trials’ true purposes and noting the occasional benefit that subjects accidentally receive. The disparity between hope and fact must be redressed by degrees, from many angles at once.

The Corporate Manslaughter and Corporate Homicide Act 2007 establishes the statutory offence of corporate manslaughter, replacing the previous common law corporate liability for manslaughter. Health-care providers are potentially liable. This includes, but is not restricted to, National Health Service bodies. This paper considers the hypothetical liability of the various bodies involved in a well-known case of death arising from medical error, had the Act been in force when it occurred. The discussion illustrates the likelihood of difficulty in establishing liability. This (...) difficulty arises not only from the requirements of the Act but also the involvement of several different bodies in the facts and circumstances of the fatal mistake. There are implications for a National Health Service whose future is likely to include greater fragmentation of service provision, with a greater number of corporate providers. Successful prosecutions for corporate manslaughter are expected to remain rare. (shrink)

This paper is presented as a performance between the two authors who are discussing the notion of daydreaming as a transitional space between their research interests in dreams and the semantic associations of conscious thought. The first half concerns the logical, rational awake mind when applied to an understanding of daydreaming as a bridge between one state and another. It investigates the idea of the interactive interface as a parallel with the daydream where both enable a middle ground, or safe (...) space for crossing-over. The difficulty highlighted through the performative reading of the paper is to keep focus without slipping into the interstitial state of a daydream. The paper gently drifts towards the second half, which explores understanding of dreamstates and the neuroscientific models of the unconscious brain. (shrink)

Transcription is a fundamental cellular process and the first step in gene regulation. Although RNA polymerase (RNAP) is highly processive, in growing cells the progression of transcription can be hindered by obstacles on the DNA template, such as damaged DNA. The authors recent findings highlight a trade‐off between transcription fidelity and DNA break repair. While a lot of work has focused on the interaction between transcription and nucleotide excision repair, less is known about how transcription influences the repair of DNA (...) breaks. The authors suggest that when the cell experiences stress from DNA breaks, the control of RNAP processivity affects the balance between preserving transcription integrity and DNA repair. Here, how the conflict between transcription and DNA double‐strand break (DSB) repair threatens the integrity of both RNA and DNA are discussed. In reviewing this field, the authors speculate on cellular paradigms where this equilibrium is well sustained, and instances where the maintenance of transcription fidelity is favored over genome stability. This paper aims to elucidate some dysfunctional aspects of health care utilisation by combining concepts from modern systems theory and from psychoanalysis. Contemporary health care in industrialised countries can be conceived as a social system in terms of modern systems theory. According to this theory, social systems are operating on the basis of a ‘guiding difference,’ which in the case of health care is the distinction between ‘healthy’ and ‘ill.’ Its rigidity in adhering to the healthy-ill dichotomy exposes health care (...) to being collusively entangled in the interpersonal defence arrangements of patients. In the psychoanalytic view, individual conflicts can be warded off from consciousness not only by intrapsychic defence, but also by interpersonal defence mechanisms. These mechanisms involve the patients’ close social environment, often including doctors and hospitals. The functioning and the motivational structure of health care itself shows features of neurotic defence: Not only its representatives, but health care as a whole act in a rigid, obsessive manner in order to separate the healthy from the ill and to battle against (presumed) diseases. This obsession sometimes results in excessive diagnostic activism and in inconsiderate application of aggressive medical treatments. Both are inappropriate with regard to the salient problem of modern medicine: the increase of chronic nonfatal diseases like depression and chronic pain. The described defence mechanisms are unconscious not only to patients but also to health care professionals (let alone health politicians), and are contributing to dysfunctional health care overuse. In this study we argue that there is an interconnection between; the mechanistic worldview and competition, and the organic worldview and cooperation. To illustrate our main thesis we introduce two cases; first, Max Havelaar, a paradigmatic case of how business might function in an economy based upon solidarity and sustainability. Second, TINE, a Norwegian grocery corporation engaged in collusion in order to force a small competitor out of the market. On the one hand, in order to encourage market behaviour (...) that integrates economic, societal and environmental values we find that transparent cooperation within a context of an organic worldview takes care of important intrinsic as well as instrumental values. On the other hand, we find evidence for asserting that cooperation based upon a mechanistic worldview, typically leads to group egotistical consequences undermining the long term common good. The collusive relationship between the U.S. Forest Service and the lumber industry substantially harms the public interest, and inspires Congressional clearcutting and stumping policies. An anthropocentric1 (or homocentric) culture milieu fosters destruction of America''s old growth forests which results in ethically-relevant questions. It is proposed that corporate moral responsibility be extended to indirect stakeholders and that a transcendent environmental ethic, biocentrism2 (or deep ecology), oblige management to expand the sphere of external stakeholders to include environment objects such as animals, trees, (...) and biotic communities. Despite criticism's collusion with Eliot, there are a number of incongruities between Wordsworth's ideas and Eliot's texts that do not seem to be simply differences, scenes and passages that Eliot invites her readers to find Wordsworthian while she indicates a significant pattern of divergence from Wordsworthian prototypes. The brotherly instructions that Eliot is most generally concerned at once to follow and to deny are contained in Wordsworth's wish, in the verse "Prospectus" to The Recluse, to see "Paradise, and groves/Elysian" (...) be "A simple produce of the common day" . But when she follows this wish literally, her "common day," the intensely social world of her novels, tests far more strenuously the adaptability of the paradisal vision than does anything Wordsworth wrote. The generic incompatibility between a poet's vision and the form of the novel may account for some of the obvious differences, yet, as I will try to suggest later, it may be that Eliot's choice of the realistic novel as the form for her vision is in part an effect, not a cause of her ambivalent divergences from Wordsworth .Margaret Homans, an assistant professor of English at Yale University, is the author of Women Writers and Poetic Identity: Dorothy Wordsworth, Emily Bronte, and Emily Dickinson. Harm minimisation has been proposed as a means of supporting people who self-injure. When adopting this approach, rather than trying to stop self-injury immediately the person is allowed to injure safely whilst developing more appropriate ways of dealing with distress. The approach is controversial as the health care professional actively allows harm to occur. This paper will consider a specific objection to harm minimisation. That is, it is a misguided collaboration between the health care professional and the person who self-injures (...) that is morally and clinically questionable. The objection has two components. The first component is moral in nature and asserts that the health care professional is complicit in any harm that occurs and as a result they can be held morally responsible and subject to moral blame. The second component is clinical in nature and suggests that harm minimisation involves the health care professional in colluding in the perpetuation of self-injury. This study examines the influence of underwriter–auditor relationship on pre-initial public offering earnings management. Using a sample of Chinese to-be-listed firms, we find that a close UAR, as reflected in repeated collaborations between an underwriter and an audit firm in IPOs, is positively associated with pre-IPO earnings management. This association is more pronounced for firms with politically connected auditors/underwriters, firms with less reputable auditors/underwriters, firms located in provinces with weak legal environment, firms to-be-listed on boards with lax listing requirements, and (...) firms whose auditors are with low industry specialization, and legal liability exposures. We provide further evidence that UAR is associated with greater likelihood of irregular activities in post-IPO period and poorer post-IPO financial performance. To the extent that we control for alternative explanations and potential endogeneity, our results suggest that the collusion incentive is likely to drive repeated collaborations between underwriters and auditors in the Chinese IPO market. Our findings provide interesting implications for auditors, investors, and regulators seeking to understand the Chinese IPO market. (shrink)

An increase in Academic Integrity (AI) breaches has resulted in higher education institutions implementing solutions to improve AI competence. It has been argued that to improve students’ AI understanding, concepts and skills should be taught at the classroom level and contextual factors should be considered. This article presents an investigation on how AI is taught at the classroom level across a range of disciplines, how contextual factors inform approaches to AI education, and how the approaches align with evidence-based recommendations. Purposeful (...) sampling procedures were employed to select units of study from disciplines at two Australian universities. Qualitative data collection methods were used to capture ways AI education was approached and the collected data were analysed through grounded theory methods. The findings show that AI was primarily taught through explicit instruction and personal storytelling and assessed through summative assessment. Such approaches appear to be influenced by personal philosophies, institutional mandates and student backgrounds. While the approaches align with the notion that best practice includes an educative approach, other facets of best practice that have been promoted to combat the rise in AI breaches such as collusion, assessment outsourcing and cheating in exams were not evident. Guided by the concept of bullshit, broadly defined as a deceptive form of rhetoric intended to distract and/or persuade, we examine how fabrications and false statements— when crafted and distributed by the president of the United States—impact not only foreign policy making and implementation but also erode democratic norms. Unconstrained by reality, and seemingly driven more by celebrity and showmanship than a genuine desire to govern, we argue that President Trump’s penchant for bullshit is part of a concerted strategy to (...) sideline critics while simultaneously undermining the ongoing investigations into the Trump campaign’s alleged collusion with the Russian government. The article analyses information exchange agreements between competitors. The article aims to reveal the cases where the exchange of information between competitors might be considered as a prohibited agreement, violating Article 101 of the Treaty on the Functioning of the European Union or Article 5 of the Law of the Republic of Lithuania on Competition. The article analyses the legal nature of the information exchange agreements between competitors, with utmost regard to the criteria, according to which an agreement on the (...) exchange of information could be acknowledged as prohibited or violating the rules of competition law. In the article it is presumed that information exchange agreements do not aim at restricting competition, however in certain cases they might have the effect of restriction of competition. (shrink)

The views on plagiarism of 574 students at four Australian universities operating in Singapore were investigated through a survey and interviews. Analysis of students’ responses to different plagiarism scenarios revealed misconceptions and uncertainties about many aspects of plagiarism. Self-plagiarism and reuse of a friend’s work were acceptable to more than one quarter of the students, and nearly half considered collusion to be a legitimate form of collaboration. One quarter of the students also indicated that they would knowingly plagiarize. This (...) should serve as a wake-up call regarding plagiarism in transnational higher education. Seven measures are recommended to curb plagiarism and foster academic integrity. (shrink)

Contemporary republicans have adopted a less-than-charitable attitude toward private beneficence, especially when it is directed to the poor, worrying that rich patrons may be in a position to exercise arbitrary power over their impoverished clients. These concerns have led them to support impartial public provision by way of state welfare programs, including an unconditional basic income (UBI). In contrast to this administrative model of public welfare, I will propose a competitive model in which the state regulates and subsidizes a decentralized (...) and nonstatist provision of support for the poor. This model will fix the historically objectionable features of private provision by having the state prevent collusion among private charities, deliver information to recipients about alternative sources of assistance, and give substantial grants to charities as well as tax incentives and vouchers to donors. I will contend that such an approach would do a better job of minimizing domination of the poor than traditional welfare states and may prove more politically feasible than a UBI, at least in the near term in certain national contexts. This paper describes the UK Research Ethics Committee’s (REC) preparations and review of the global first SARS-CoV-2 human infection challenge studies. To frame our review, we used the WHO guidance and our UK Health Research Authority ethical review framework. The WHO criteria covered most issues we were concerned about, but we would recommend one further criterion directing RECs to consider alternative research designs. Could research questions be equally well answered by less intrusive studies? The committee met virtually, ensuring broad representation (...) across the UK nations and also ensuring applicants could attend easily. We worked in collaboration with the applicants but while we recognise that such proximity might raise the accusation of ‘collusion’, we made every effort to maintain ‘moral distance’ and all decisions were made by the committee alone. Prior existing processes and policy facilitated training and review but even with this preparation, review took time and this could have hindered a rapid response to the emergency. Review for the various follow-on studies will now be speedier and once the pandemic has subsided, our group could be reconvened in future emergencies. In conclusion, we have tried to make decisions in good faith. We know there is controversy and disagreement and reasonable people may feel we have made the wrong decision. L’intervention que reprend cet article porte sur un cadre-dispositif singulier de thérapie familiale basé sur l’épistémologie psychanalytique groupale. Ce cadre est singulier dans la mesure où il a été tenté d’articuler un travail entre groupe de thérapeutes et néo-groupe. La réflexion développée ici s’origine dans la clinique des auteurs : lorsqu’ils parlent en groupe d’une famille, la règle d’association libre les amène fréquemment à évoquer une autre famille rencontrée précédemment en séance. Quelle est la nature et la fonction de cette (...) résonance? L’article pose l’hypothèse d’un nouveau contre-transfert : le contre-transfert transfamilial. Academic dishonesty presents in different forms, including fabrication of data, falsifying references, multiple submissions, collusion, and sabotage, with two forms haunting academia, namely plagiarism and contract cheating or ghost writing. These latter forms have received considerable attention and have been subjects for research. This interview-based study provides some further insight into the problem of ghost writing through presenting the attitudes, justifications and networking practices of some hired ‘ghost-writers’ from a developing country and discusses the depth of this emerging threat (...) to the academic community.Initially, through simple internet searches using specific keywords, an array of professional advertisements selling contract writing services were identified. Some of these promotional advertisements were found in Facebook® posts, and/or Twitter® feeds. The second part of this study presents a summary of findings from interviews of a group of ghost-writers including their background, attitude and justifications for setting up this new business. The study identifies several high calibre post-graduates who have come to understand the Western (European/north American/australian) ways of scientific writing and have produced a network of ‘consultancy’ services. Although the birth of their business was ad-hoc, they have established a good network and are now able to share projects and practices. Many of them offer services to home and foreign students with varied levels of customer focus. Some of them are even using Turnitin© software to identify text matching issues. This study suggests that these paper mills have widely been subscribed to by students. The article finally discusses wider issues arising from these interviews and proposes some ways of tackling this new threat to academia. (shrink)
