We note an increasing consciousness of weakness of legal methodology taught to law students today: The students get neither real idea nor feeling of legal decision-making as mixture of legal matters, issue of facts, personal inputs, diverging interests, and the interplay with other actors. For minimize these defects it is necessary that law students learn in legal studies the following points: (1) Legal decision-making is a special kind of decision-making and is embedded in all problems of this process. (2) Jurisprudence (...) is a hybrid science: It deals with facts of issue as well with legal matter. (3) Jurisprudence will be understood as transnational science and requires greater cooperation between law schools all over the world. (4) Legal education should focus on general principles and legal tools rather than on detailed rules. (5) Legal theory should demonstrate students our lack of understanding legal decision-making. (6) A realistic legal methodology has to take into account the impossibility of absolute certainty of the correctness of legal decision. (7) It is important to point out that analysis of facts of the case as crucial part of legal methodology requires teaching systems to introduce students in the respective techniques in practice like case studies, projects as well as legal clinics or SASLA-system. Būtų netikslu Konstitucijos taikymą apibūdinti vien kaip elementarų loginį silogizmą, jos teksto prasmės interpretavimas moksle yra aiškinamas įvairiais kompleksiniais modeliais. Vienas iš veiksnių, kuris į tuos modelius Lietuvos moksle nėra adekvačiai inkorporuotas, yra kontekstas. Šiame straipsnyje pristatomas konteksto vaidmuo Konstitucinio Teismo jurisprudencijoje aiškinant Konstitucijos tekstą. Tyrimo rezultatai rodo, kad šis vaidmuo nėra mažareikšmis ir net gali lemti tokį Konstitucijos išaiškinimą, kuris prasilenkia su tuo, kurį gautume pažodžiui vadovaudamiesi Konstitucijos tekstu. Tikimasi, kad šio fenomeno pažinimas padės tiksliau suprasti ir išartikuliuoti Konstitucinio (...) Teismo sprendimų priėmimo metodologiją bei patikimiau prognozuoti galimų konstitucinių ginčų baigtį. Lietuvos, kaip ir kitų Europos valstybių, teisės aktai numato bendrovės visuotinio akcininkų susirinkimo sprendimų teisėtumo užtikrinimo priemonę – tokių sprendimų pripažinimo negaliojančiais institutą. Civiliniame kodekse išvardijami teisiniai šio instituto taikymo pagrindai. Kita vertus, visuotinio akcininkų susirinkimo sprendimų pripažinimo negaliojančiais pagrindų sistemos skirtingose valstybėse skiriasi. Šiame straipsnyje siekiama pateikti bendrą įstatymo numatytų bendrovės visuotinio akcininkų susirinkimo sprendimų pripažinimo negaliojančiais pagrindų Lietuvos teisėje apžvalgą, minėtų pagrindų sistemą lyginant su užsienio valstybių teisiniu reglamentavimu.

Lawyers pretend as if the process of application of laws, as well as its outcome, could be an analytic-deductive derivation; especially law students learn that legal decision-making is primarily a logic process. But we know that application of laws depends on analytic-logical as well as on voluntaristic (wilful) elements. Exact relations between these components are unknown and will be unknown. At most German law schools students as the most important imperative tool learn the so called “Auslegung” through the use of (...) theoretical instruments, which do not reflect the interpretation of law practice. These mentioned causes result in irrationality of legal decision-making. In order to achieve more rationality in the process and result of legal decision-making, the contribution makes four suggestions regarding legal methodology and legal education. These proposals consist of few long-term pragmatic approaches to more rationality of legal decision-making. (shrink)

The two grand theories of judging – legal realism and legal formalism - have their differences set around the importance of legal rules. For formalists, judging is a rule-bound activity. In its more extreme versions, a judge is seen as an operator of a giant syllogism machine. Legal realists, in contrast, argue that legal rules, at least formal legal rules, do not determine outcomes of cases. Legal realism has been misunderstood almost everywhere outside its birthplace – the United States. Continental (...) legal theory, for one, views legal realism as practical, down-to-earth, hard-nosed school of thought which is opposed to the more “scientific” theories. The purpose of this article is two-fold. First, to show what legal realists really stood for - that contrary to the popular myth, they did not maintain that formal legal rules do not matter at all; that most of them considered legal rules to be important, only many of those rules are informal rules. Second, contrary to the popular understanding in Continental legal theory, legal realism by its nature was not an antiscientific theory of judging - in fact, it was either a first scientific theory of judging or at least its prototype. Straipsnyje pateikiama transnacionalinės socialinės erdvės koncepcijų apžvalga ir socialinio mobilumo analizė transnacionalizmo kontekste gydytojų profesijos atveju. Kadangi ilgainiui teritorinį mobilumą keičia socialinis mobilumas, svarbu įvertinti migracijos kaip socialinio mobilumo kanalo reikšmę strategiškai svarbiai gydytojo profesijai. Taikant grafinę empirinių duomenų analizę buvo nustatyti reikšmingi šalių skirtumai gydytojų išsilavinimo, įgyto kitoje valstybėje, ar užsienio kilmės gydytojų atžvilgiu, todėl nepakanka kalbėti apie socialinį mobilumą vienos valstybės ribose. Transnacionalinės socialinės erdvės reikšmė auga dėl įvairių veiksnių: greičio įveikiant geografinius atstumus pokyčių, politinių sprendimų, ryškėjančių (...) ekonominių skirtumų tarp valstybių, socialinių tinklų plėtros ir kt. This is the first complete English translation of the Jami al-hikmatayn, written in Persian, the final, and crowning, work of the great poet, philosopher, and Ismaili missionary Nasir-i Khusraw (1004-1077). Twin Wisdoms Reconciled was written at the request of the emir of Badakhshan 'Abu al-Ma'ali 'Ali ibn Asad' who was perplexed by the questions in a long philosophical ode written a century earlier by Abu al-Haytham Jurjani, an obscure Ismaili author. The ode consists of a series of some 90 questions (...) on a wide range of subjects, from logic and metaphysics to medicine, cosmology, and physics, as well as esoteric Ismaili doctrine. Nasir-i Khusraw's text takes the form of a commentary on certain astutely selected lines. Twin Wisdoms Reconciled represents yet another example of the author's lifelong endeavour to transform Persian philosophical prose into a deft and nuanced instrument of expression. The work has not been as extensively studied as Nasir-i Khusraw's other major theological and philosophical treatises, all written in his final exile in Badakhshan, in part perhaps because of its textual difficulties. Twin Wisdoms Reconciled survives in a single manuscript of dubious accuracy in the Aya Sofya collection, Suleymaniyye Library, Istanbul. The present translation is based on the critical edition of the text produced by Henry Corbin and Mohammed Mo'in in 1953, but with frequent reference to the unique original manuscript. Twin Wisdoms Reconciled represents an endeavour to reconcile two apparently opposed forms of knowledge: the knowledge accorded by revelation and exegesis and the knowledge gained by reason. Seeing that "the bazaar of wisdom" stands empty because of the mutual incomprehension of traditional theologians and Aristotelian philosophers, Nasir-i Khusraw stepped boldly forward to reinvigorate that desolate marketplace. His final work, written in 1070, is thus a testimony as well as an exposition of his mature thought. (shrink)
