The Draft Common Frame of Reference is just published. Now the creation of the final Common Frame of Reference is one of the most important issues in the field of European Private Law. The volume discusses the key question as to what extent the CFR can and should reflect existing EC Contract Law, and to what extent the DCFR has already incorporated the acquis communautaire. The contributions to this volume try to provide answers to this question (...) by analyzing different controversial areas such as the conclusion and content of the contract, non-performance, remedies, damages and the relation to International Private Law. Various annoyingly incorrect statements of Stoffregen & Bardy are corrected, for example, that perception researchers commonly use the term to denote motion without any frame of reference, confuse earth-relative and gravity-relative motion, err with respect to the frame of reference implied by their subject is motion responses, believe in sense specific motion percepts, and do not investigate sensory interactions at neurophysiological levels. In addition, much of the target article seems to concern metaphysics rather than empirical science.

The problem for the CNS in any particular movement task is to coordinate the various frames of reference appropriate to the task. Control variables are determined by this coordination. The coordination problem varies greatly from task to task, and so no single set of control variables is likely to account for a broad range of movement tasks.

While geocentric and relative frames of reference have figured prominently in the literature on spatial language and cognition, the intrinsic frame of reference has received less attention, though various subtypes of the intrinsic frame have been proposed. This paper presents a revised classification of the intrinsic frame, distinguishing between three subtypes: a ‘direct’ subtype, an ‘object-centered’ subtype and a ‘figure-anchored’ subtype, with a cross-cutting distinction between ‘function-based’ and ‘shape-based’ systems. In addition, the ‘FIBO’ system in (...) Dhivehi is analyzed as an example of a borderline case, with some important features of the intrinsic frame but also some differences, presenting a challenge for existing frame of reference classifications. The rotational properties of these various systems are also considered. The analysis underscores the considerable diversity within intrinsic systems but also points to a closer relationship between intrinsic and extrinsic frames than has previously been appreciated. This may have implications for broader theoretical issues including how frames of reference are acquired, how speech communities come to use different frames and whether patterns of frame use in discourse shape patterns of non-verbal frame use. Models of central control variables (CVs) that are expressed in positional reference frames and rely on proprioception as the dominant specifier of muscle activation patterns have not yet been shown to be adequate for the description of fast, voluntary movement, even of single joints. An alternative model with illustrative data is proposed.

The Aymara of the Andes use absolute (cardinal) frames of reference for describing the relative position of ordinary objects. However, rather than encoding them in available absolute lexemes, they do it in lexemes that are intrinsic to the body: nayra (“front”) and qhipa (“back”), denoting east and west, respectively. Why? We use different but complementary ethnographic methods to investigate the nature of this encoding: (a) linguistic expressions and speech–gesture co-production, (b) linguistic patterns in the distinct regional Spanish-based variety Castellano (...) Andino (CA), (c) metaphorical extensions of CA’s spatial patterns to temporal ones, and (d) layouts of traditional houses. Findings indicate that, following fundamental principles of Aymara cosmology, people, objects, and land—as a whole—are conceived as having an implicit canonical orientation facing east, a primary landmark determined by the sunrise. The above bodily based lexicalizations are thus linguistic manifestations of a broader macro-cultural worldview and its psycho-cognitive reality. (shrink)

Using various official sources, the article explores competing conceptions of the 'under- achieving ' school which have been operationalised in recent years. It suggests that there have been multiple, potentially conflicting definitions in policy discourse to which recent innovations have merely added a further layer of complexity. Using a simple conceptual framework comparing judgements made within 'standards' and 'progress' frameworks for evaluating schools' performance, it highlights the very limited range of conditions where judgements made within one tradition would complement those (...) made within the other. As the educational system begins to turn increasingly to use of so-called 'value-added' approaches as a way forward, the implications of these analyses for policy development, particularly in relation to the alleviation of social and educational disadvantage, are considered. The paper investigates the ethical decisions of Millennials, who are not only part of an expanding cohort of the workforce, but also represent potential future managers with a growing influence on work practices and employment relationships. In the conceptual model, we propose that three ethical frames of reference, represented by perceived organisational ethics, perceived employee ethics and reflective moral attentiveness, antecede ethical judgements, which further influence the ethical intentions of Millennials. Using structural equation modelling, we test the model for (...) three different business ethics scenarios: paying a consulting fee, dumping hazardous waste, and running an offensive advertising campaign. The findings confirm the link between ethical judgements and intentions across the board, while the influence of the ethical frames of reference varies among the scenarios. We propose that the differences in the predictive ability of the ethical frames of reference depend on the nature of the ethical issue, which holds important implications for today's managers in their attempts to encourage ethical behaviour of Millennial employees. How is mindreading affected by social context? It is often implicitly assumed that there is one single way to understand others, whatever the situation or the identity of the person. In contrast, I emphasize the duality of functions of mindreading (social interaction and social observation), as well as the duality of social frames of reference (egocentric and allocentric). I argue in favour of a functional distinction between knowledge-oriented mindreading and interaction-oriented mindreading. They both aim at understanding other people’s behaviour. (...) But they do so using different strategies. However, to say that mindreading has two functions does not suffice to show that there are two kinds of mindreading. One and the same ability could accomplish different functions. Unfortunately, there has been almost no experimental data on a possible dissociation between two kinds of mindreading abilities. Nonetheless, I discuss a few results that point towards a dual ability. (shrink)

Speakers of many languages prefer allocentric frames of reference (FoRs) when talking about small‐scale space, using words like “east” or “downhill.” Ethnographic work has suggested that this preference is also reflected in how such speakers gesture. Here, we investigate this possibility with a field experiment in Juchitán, Mexico. In Juchitán, a preferentially allocentric language (Isthmus Zapotec) coexists with a preferentially egocentric one (Spanish). Using a novel task, we elicited spontaneous co‐speech gestures about small‐scale motion events (e.g., toppling blocks) in (...) Zapotec‐dominant speakers and in balanced Zapotec‐Spanish bilinguals. Consistent with prior claims, speakers’ spontaneous gestures reliably reflected either an egocentric or allocentric FoR. The use of the egocentric FoR was predicted—not by speakers’ dominant language or the language they used in the task—but by mastery of words for “right” and “left,” as well as by properties of the event they were describing. Additionally, use of the egocentric FoR in gesture predicted its use in a separate nonlinguistic memory task, suggesting a cohesive cognitive style. Our results show that the use of spatial FoRs in gesture is pervasive, systematic, and shaped by several factors. Spatial gestures, like other forms of spatial conceptualization, are thus best understood within broader ecologies of communication and cognition. (shrink)

A hypothesis about sensorimotor integration (the λ model) is described and applied to movement control and kinesthesia. The central idea is that the nervous system organizes positional frames of reference for the sensorimotor apparatus and produces active movements by shifting the frames in terms of spatial coordinates. Kinematic and electromyographic patterns are not programmed, but emerge from the dynamic interaction among the system s components, including external forces within the designated frame of reference. Motoneuronal threshold properties and (...) proprioceptive inputs to motoneurons may be cardinal components of the physiological mechanism that produces positional frames of reference. The hypothesis that intentional movements are produced by shifting the frame of reference is extended to multi-muscle and multi-degrees-of-freedom systems with a solution of the redundancy problem that allows the control of a joint alone or in combination with other joints to produce any desired limb configuration and movement trajectory. The model also implies that for each motor behavior, the nervous system uses a strategy that minimizes the number of changeable control variables and keeps the parameters of these changes invariant. Examples are provided of simulated kinematic and electromyographic signals from single- and multi-joint arm movements produced by suggested patterns of control variables. Empirical support is provided and additional tests of the model are suggested. The model is contrasted with others based on the ideas of programming of motoneuronal activity, muscle forces, stiffness, or movement kinematics. (shrink)

Previous studies have shown that language contributes to humans' ability to orient using landmarks and shapes their use of frames of reference for memory. However, the role of environmental experience in shaping spatial cognition has not been investigated. This study addresses such a possibility by examining the use of FoRs in a nonverbal spatial memory task among residents of an Andean community in Peru. Participants consisted of 97 individuals from Ancash Quechua-speaking households who spoke Quechua and/or Spanish and varied (...) considerably with respect to the extent of their experience in the surrounding landscape. The results demonstrated that environmental experience was the only factor significantly related to the preference for allocentric FoRs. The study thus shows that environmental experience can play a role alongside language in shaping habits of spatial representation, and it suggests a new direction of inquiry into the relationships among language, thought, and experience. Many members of the public think of the General Medical Council (GMC) as the body which tries doctors: the doctors' law courts, as it were. And, except in the more sober of newspapers and news reports, the 'offences ' which receive the most publicity are those concerning alleged improper relations between doctors and patients. Professor Sir Denis Hill, in the following paper, which he read in the spring of this year to the annual conference of the London Medical Group devoted (...) to a discussion of human sexuality, chose to examine the whole function of the General Medical Council as a frame of moral reference for doctors. Judging allegations of professional misconduct by doctors is the function of the Council's Disciplinary Committee. Judging sexual misconduct forms only a small part of their work. The GMC's responsibility covers the whole notion of morals and morality as it concerns doctors in their professional work. Sir Denis Hill stresses the modern thinking that morality must be learned and that attitudes are always shifting as society alters its norms of what is moral conduct. That is not to say that all that was previously considered not to be moral has now become acceptable but rather that other concepts have entered the field of moral debate. Therefore the GMC must constantly review the frame of reference it offers to doctors and the public may be surprised to learn that that process is never static. Sir Denis Hill in this paper is speaking personally and not as a member of the General Medical Council or of any of that body's special committees. (shrink)

At the beginning of the year, the Draft Common Frame of Reference (DCFR) was published. The text is the result of the work of a broad range of private law scholars from the Member States of the European Union, and it presents itself as an ‘academic’ document, committed to the precepts of scholarship rather than politics. Notwithstanding its unwieldy name, the text is nothing less than the draft of the central components of a European Civil Code. The following (...) article aims to inform the reader about this potentially important document and to initiate further academic debate about it. Following an overview of the genesis and content of the DCFR (Part 1), the discussion focuses on whether, and to what extent, it is based upon consistent and convincing core aims and values (Part 2). The article then proceeds to address, more specifically, the significance of private autonomy, and it examines the extent to which the proposed rules satisfy the requirements of legal certainty and legal clarity (Part 3). Thereafter, the DCFR is measured against the criteria of internal consistency and systematic integrity (Part 4). Also (Part 5) the question is asked whether the Draft critically reflects and convincingly integrates the sources on which it is based (that is the Lando Commission's Principles of European Contract Law and the Acquis Principles, as well as the private law traditions of the Member States). Also deserving of attention is the inclusion of more than 120 definitions of central concepts of private law, which are not to be found in this form or level of detail in either the Lando Principles or the national private laws (Part 6). Flexibility in conceptual projection constitutes one of the most challenging issues in the embodiment and conceptual metaphor literatures. We sketch a theoretical proposal that places the burden of the explanation on attentional dynamics in interaction with mental models in working memory that are constrained to be maximally coherent. A test of this theory is provided in the context of the conceptual projection of time onto the domain of space. Participants categorized words presented at different spatial locations (back–front, left–right) as referring (...) to the past or to the future. Responses were faster when the irrelevant word location was congruent with the back–past, front–future metaphoric mapping. Moreover, when a new highly task-relevant spatial frame of reference was introduced, it changed the projection of past and future onto space in a way that was congruent with the new frame (past was now projected to left space and future to right space), as predicted by the theory. This study shows that there is substantial flexibility in conceptual projection and opens a venue to study metaphoric variation across tasks, individuals, and cultures as the result of attentional dynamics. The cerebellum probably obeys the rules of sensorimotor integration common in the nervous system. One such a rule is formulated: the nervous system organizes spatial frames of reference for the sensorimotor apparatus and produces voluntary movements by shifting their origin points. We give examples of spatial frames of reference for different single- and multi-joint movements including locomotion and also illustrate that the process of motor development and learning may depend critically on the formation of appropriate frames of (...) class='Hi'>reference and the organism's ability to manage them. We suggest that a solution to the problem of sensorimotor integration may not be trivial and may actually change the mental and experimental paradigms used in the understanding of the cerebellum and other brain structures, [HOUK et al.; SIMPSON et al.; SMITH; TIIACH]. The demonstration that slow transport of clocks can be used to define simultaneity in inertial frames of reference leads to the question of whether clock transport can similarly be used in noninertial frames. It is shown that there are certain types of reference frames in which the clock-transport method cannot be used in a self-consistent manner. It is also shown that there are other types of noninertial frames in which the clock-transport method will succeed. The discussion includes noninertial (...) frames in flat space-time as well as the case of curved space-times. (shrink)

This article reviews existing approaches to defining and distinguishing communication styles and proposes a common frame of reference for future research. The literature review yields two schools of thought: the behavior-centered perspective and the personality-oriented perspective. Although these lines of research differ in their ways of defining communication styles, they show considerable similarities with respect to their classification. Many researchers build their taxonomies on two key dimensions: assertiveness and responsiveness. We propose embedding communication styles into the Five-Factor Theory (...) and defining them as characteristic adaptations of personality. We also suggest the Interpersonal Circumplex as a reference model for distinguishing communication styles as it is able to integrate substantial dimensions and facets of existing taxonomies in a parsimonious way.
