This paper examines the link between political liberties and social equality, and contends that the former are constitutive of, i.e. necessary to secure, the latter. Although this constitutive link is often assumed in the literature on political liberties, the reasons why it holds true remain largely unexplored. Three such reasons are examined here. First, political liberties are constitutive of social equality because they bestow political power on their holders, leaving disenfranchised individuals excluded from (...) decisions that are particularly pervasive, coercively enforced, hard to avoid, monopolistic, and final. Second, they are constitutive of social equality due to their positional value, such that those who are denied such liberties are socially downgraded because and to the extent that others enjoy them. Third, they are constitutive of social equality due to their expressive value, in the sense that, by disenfranchising some individuals, the state publicly fails to recognize their equal moral agency. While unpacking these reasons, we address some criticisms of this constitutive link recently raised by Steven Wall and Jason Brennan. (shrink)

This essay draws attention to the importance of Montesquieu’s earliest and unpublished writings on liberty for our understanding of the famous eleventh book of the Spirit of the Laws. Montesquieu’s investigation of the nature and preconditions of liberty, the author argues, was much more polemical than it is usually assumed. As an analysis of his notebooks shows, Montesquieu set out to wrest control over the concept of liberty from the republican admirers of classical antiquity, a faction that he believed to (...) be dangerously populist and revolutionary. In order to do so, Montesquieu came up with a redefinition of the concept of liberty that allowed him to argue that monarchical subjects could be just as free as republican citizens. This conclusion has important implications not just for our understanding of Montesquieu’s writings but also and more broadly for our understanding of the intellectual history of liberalism. Formal guarantees of political equality are compatible with inequalities in the value of political liberties, as individuals may convert their socioeconomic advantages into political advantages. Perhaps the predominant strategy for limiting substantive political inequalities recommends limiting inequalities in the means of acquiring political power for private gain – most notably, economic means. I express a worry that measures instituted to restrict economic inequalities may do more to frustrate the cause of political equality than (...) to further it. I argue that attempts to decrease individuals' means to capture political power will systematically increase their motives to capture political power. (shrink)

The distinction between negative and positive liberty is familiar to political philosophers. The negative variety is freedom as noninterference. The positive variety is freedom as self-mastery. However, recently there has been an attempt on the part of a growing number of philosophers, historians, and legal scholars to recapture a third concept of political liberty uncovered from within the rich tradition of civic republicanism. Republican political liberty is freedom as nondomination. I argue that features that distinguish it from (...) noninterference and self-mastery highlight the theoretical and practical advantages of liberty as nondomination. It is, among these candidates, best-suited to serve as the guiding principle for the State's basic institutions and rules. Rawls famously argues that the parties in the original position would agree upon the two principles of justice. Among other things, these principles guarantee equal political liberty—that is, democracy—as a requirement of justice. We argue on the contrary that the parties have reason to reject this requirement. As we show, by Rawls’ own lights, the parties would be greatly concerned to mitigate existential risk. But it is doubtful whether democracy always minimizes such risk. Indeed, no one currently knows which (...) political systems would. Consequently, the parties—and we ourselves—have reason to reject democracy as a requirement of justice in favor of political experimentalism, a general approach to political justice which rules in at least some non-democratic political systems which might minimize existential risk. This work is a classic dialogue between two philosophers, with the unusual twist that it was actually conducted, not fabricated, by two different philosophers. It presents in a conversational tone the various crucial and not so crucial aspects of the topic of political liberty and what if any value it has for us.

Rousseau is considered to be at once the most modern political thinker of the 18th century and the most ancient in his allegiance to classical republicanism. These essays address the place of liberty in his moral and political philosophy, and the origins, meaning, strength, weakness and significance of his argument.

The canonical image of John Locke as one of the first philosophes is so deeply engrained that we could forget that he belonged to a very different historico-political context. His influence on Enlightenment thought, not least that of his theories of political liberty, has been the subject of widespread debate. In Locke's political liberty: readings and misreadings a team of renowned international scholars re-evaluates Locke's heritage in the eighteenth century and the ways it was used. Moving beyond (...) reductive conceptions of Locke as either central or peripheral to the development of Enlightenment thought, historians and philosophers explore how his writings are invoked, exploited or distorted in eighteenth-century reflections on liberty. Analyses of his reception in England and France bring out underlying conceptual differences between the two nations, and extend an ongoing debate about the difficulty of characterising national political epistemologies. The traditional Anglocentric view of Locke and his influence is demystified, and what emerges is a new, more diverse vision of the reception of his political thinking throughout Europe. Of interest to political philosophers and historians, Locke's political liberty: readings and misreadings reveals how the issues identified by Locke recur in our own debates about difference, identity and property - his work is as resonant today as it has ever been. The equal political liberties are among the basic first-principle liberties in John Rawls’s theory of Justice as fairness. Rawls insists, further, that the “fair value” of the political liberties must be guaranteed. Disavowing an interest in fair value is what disqualifies welfare-state capitalism as a possible realizer of Justice as fairness. Yet Rawls never gives a perspicuous statement of the reasoning in the original position for the fair-value guarantee. This article gathers up two distinct strands (...) of Rawls’s argument, and presents it in a straightforward sequence. Justice as fairness is contrasted to a competitor political conception of justice that is just like it but without the fair-value guarantee. Cases of akratic behavior are generally seen as paradigmatic depictions of the knowledge-action gap (Darnell et al 2019): we know what we should do, we judge that we should do it, yet we often fail to act according to our knowledge. In recent decades attention has been given to a particular instance of akratic behavior, which is that of “inverse akrasia”, where the agent possesses faulty moral knowledge but fails to act accordingly, thus ending up doing the right thing. In (...) particular, two literary examples are considered as exemplifying this kind of akratic situation: Huckleberry Finn (Arpaly & Schroeder 1999, Arpaly 2000, Hursthouse 1999, Kleist 2009, Holton manuscript) and Neoptolemus as understood by Aristotle (NE; Arpaly & Schroeder 1999). In this paper I will argue that those of Neoptolemus and Huck Finn are not cases of inverse akrasia (Holton manuscript) but are much better explained as instances of what Williams (1993) called “moral incapacity”. In particular, the reason why they fail to act according to their original judgments is due to a lack of motivation to act accordingly, which is grounded in their moral self-identities (Blasi 1984; Vigani 2016). The paper will unfold as follows: I will, first, argue that neither Neoptolemus nor Huck Finn show akratic behavior; thus, they cannot be legitimately labeled as “inverse akratics” (par 1.); then, I will argue that they act the way they do notwithstanding their faulty judgments because they are effectively motivated to do so. Such motivation originates in their moral self-identities and is experienced through the threat of self-betrayal (par 2); finally, I will argue that when an agent is motivated to act in a way that is integral with her moral self-identity, acting otherwise is experienced as something one cannot ultimately do; that is, as a moral incapacity (par 3). This “cannot” is neither a metaphor for an “I shouldn’t”, nor an instance of what has been recently labeled a “moral impossibility” (Caprioglio Panizza 2020, 2021), since it does not arise from the normative force of deontic judgments, and it is neither physically nor psychologically impossible for the agent to act otherwise. Economic disparities often translate into disparities in political influence, rendering political liberties less worthy to poor citizens than to wealthier ones. Concerned with this, Rawls advocated that a guarantee of the fair value of political liberties be included in the first principle of justice as fairness, with significant regulatory and distributive implications. He nonetheless supplied little examination of the content and grounding of such guarantee, which we here offer. After examining three uncompelling arguments in its (...) favor, we complete a more promising yet less explored argument that builds on the value of self-respect. We first inspect the conditions and duties that securing self-respect entails. We then look into how uneven allocations of the value of political liberties bear, expressively and due to the power imbalances they yield, on such conditions and duties. (shrink)

Despite the vast literature on Rawls's work, few have discussed his arguments for the value of democracy. When his arguments have been discussed, they have received staunch criticism. Some critics have charged that Rawls's arguments are not deeply democratic. Others have gone further, claiming that Rawls's arguments denigrate democracy. These criticisms are unsurprising, since Rawls's arguments, as arguments that the principle of equal basic liberty needs to include democratic liberties, are incomplete. In contrast to his trenchant remarks about core (...) civil liberties, Rawls does not say much about the inclusion of political liberties of a democratic sort – such as the right to vote – among the basic liberties. -/- In this paper, I complete some of Rawls's arguments and show that he has grounds for including political liberties, particularly those of a democratic nature, in the principle of equal basic liberty. In doing so, I make some beginning steps toward illustrating the genuinely democratic nature of Rawls's arguments. Rawls believes that a few different arguments can be given for democratic institutions and that these arguments work together to support the value of democracy. In this paper, I focus on Rawls's arguments relating to self-respect. I focus on this set of arguments because they are among the strongest of Rawls's arguments for equal political liberty and its fair value. (shrink)

Confucianism, traditionally affiliated with authoritarianism, is now credited with a strong allegiance to liberal values. But by centring on moral freedom, the liberal reinterpretation of Confucianism has paid less attention to the value of political liberty in it. If anything, it tends to treat political liberty merely as a derivative of moral freedom. Notwithstanding a dialectical relation between moral freedom and political liberty in Confucianism, however, Confucian political liberty cannot be properly understood without considering kingship as (...) the political backdrop. This article argues that in the Confucian tradition, Mencius first theorized political liberty while wrestling with the problem of realpolitik of his time. In order to make Mencius' claim more intelligible, it first examines the psychological origin and the essential characteristics of realpolitik by analysing Nietzsche's concept of 'the higher man' and shows how Mencius judiciously transvaluated realpolitik in terms of tyranny and justified political liberty as a moral weapon against it. The visibility of environmental problems and the increasing awareness of associated consequences have made environmental issues salient in Zambia. The purpose of this study was to investigate correlations between the social and psychological influences affecting college students in Zambia, and the behaviours perceived by them to be appropriately environmentally friendly. The underlying social and psychological factors that would determine individuals’ attitudinal responses toward appropriate environmental behaviour were assessed. The study attempted to measure behavioural tendencies towards environmental conservation. Behaviour involving energy (...) and water conservation (EW) was consistently rated as the most important, and appropriate category of environmental behaviour, whereas social and political action (SP) was viewed as the least favourable behaviour according to the respondents in Zambia. The respondents who were older in the graduate level of the study and had frequently contact with environmental education activities and courses were more likely to hold positive behavioural tendencies toward environmental conservation in general. There are many East and West debates on human rights. One of them is whether all civil and political rights are human rights. On one hand, scholars generally agree that rights to physical security are human rights. On the other hand, some scholars argue that rights to political liberty are only Western rights but not human rights because political liberty conflicts with some East Asian cultural factors, especially the Confucian tradition. I argue that physical security also conflicts (...) with some parts of the Confucian tradition, but rights to physical security are still human rights because physical security is a minimal value. I then argue that political liberty, similar to physical security, is also a minimal value. Therefore, similar to rights to physical security, rights to political liberty are also human rights, even though political liberty also conflicts with some parts of the Confucian tradition. In his late work, Rawls makes strong claims about the status of political liberty. These claims, if accepted, would have significant implications for the content of "justice as fairness." I discuss the nature of these claims, clarifying Rawls's fair value guarantee of the political liberties and critically discussing the arguments that he and others have given for assigning special importance to the political liberties. I conclude that justice as fairness, properly understood, is not a deeply (...) democratic conception of justice. (shrink)

This essay concerns Constant’s classic text The Liberty of the Ancients Compared with that of the Moderns. Although this is a frequently quoted text, what makes reading it still something of an effort is that it contains a baffling shift from the complete exaltation of modern liberty in its first part to the recognition of the significance of political participation in safeguarding modern liberty in its final part. The text is also replete with additional treasures, including Constant’s famous distinction (...) between the liberty of the ancients and that of the moderns and his turn to the basic human capacity of self-development to support his stubborn insistence on the irreducibility of political participation. With regard to the aforementioned shift in the 1819 text, some have argued that in order to reveal the richness of the text we must be aware that its two parts were written under different historical circumstances. Accepting this claim, I argue that the basic tone of the text is Constant’s attempt to combine modern liberty and political participation and that deciphering the argumentative thrust inherent in the text helps reveal its richness. I focus on the centrality of the representative system, which, I argue, plays an important role in Constant’s endeavour to unify the liberty of the moderns and political liberty throughout the text. To see how he defends both the enjoyment of individual interests and the practice of political liberty, it is necessary to recognize the nature of representative assemblies in Constant’s constitutionalism and to characterize his appeal to self-development as a justification of the practice of political liberty. The object of this research is gentleness, a construct maybe not treated enough in the literature, but just in the area of the so called Positive Psychology. And precisely from his representative Martin Seligman, the inspiration for the construction of a questionnaire and of a specific hypothesis has been born, including the use of a precise terminology. In general terms, maybe the most interesting result lies in the fact of having found a correlation between the various items, therefore between the (...) various constructs, in accordance with the idea of gentleness proposed as a synergy of “quality”. This idea has also been supported from recent research in which has emerged a very tight bond between optimism and a particular character trait that is extroversion. Being placed at a higher, transcendental level, the “gift of oneself” could become the “jump of quality” to fulfil ourselves in the relation with the other. (shrink)

This is because his arguments, as arguments that the principle of equal basic liberty should include democratic liberties, are incomplete. Rawls says little about the inclusion of political liberties of a democratic sort – such as the right to vote – among the basic liberties. And, at times, what he does say is unconvincing. My aim is to complete and, where they fail, to reconceive Rawls's arguments (...) and to show that a principle requiring equal political liberty and its fair value is an appropriate component of his theory of justice. By freedom, classical liberals meant non-interference, independence from the state, the personal and proprietary liberty of the governed. It is negative freedom as the antithesis both to absolutism and anarchy. In the republican interpretations, the freedom of a free political community is made possible and guaranteed by the institutionalization of the liberty of the political community. Political liberty is the medium, stage and precondition for the freedom of its members. That, in turn, is conditional upon the readiness (...) of its members to protect the liberty of their community and themselves, i.e. upon the virtue of the free citizen. When offering constructions of political values, it is common to generally strive for unity, i.e., to aim at principled definitions and the reduction of normative conflict. In this article, by contrast, I argue that we should aim to construct broad and conflicting concepts of the central liberal democratic values of liberty and equality. Taking my cue from an under-appreciated debate between Ronald Dworkin and Bernard Williams, I suggest that the demand for unity derives its appeal from a juridical model (...) of political value construction, which assumes the unified perspective of public decision-making. But while this model may be apt for constructing institutional rights, the construction of the political values liberty and equality had better operate according to a political model, which focuses on the perspective of citizens that live in a relationship of political opposition. Not only is there no demand for unity from that perspective, but there is a positive demand for political plurality: we need to draw on broad and conflicting concepts of liberty and equality if we are to respect the claims of fellow citizens with whom we have value-based political disagreements. This study of the political philosophy of William Ernest Hocking be gan as a doctoral dissertation at Tulane University. Hocking (1873- 1966) was for many years Alford Professor of Natural Religion, Moral Philosophy, and Civil Polity at Harvard University. Although he is relatively well-known among American philosophers, particularly by students of metaphysics and the philosophy of religion, very little atten tion has been given to his political philosophy. Some general studies of his thought summarize his political writings (...) in a very cursory fashion, but they do not discuss his contributions in detail or relate them to significant issues in political philosophy. Most important general works on modern political philosophy or American political thought do not even mention Hocking; a few note his name in passing. Because he is almost completely unknown in the social sciences, the original purpose of this study was to explore, systematize, and present his extensive writings in political philosophy. It then became apparent that his entire political philosophy is oriented around the concepts of liberty and community. When his thought is analyzed in terms of these themes, its unity and coherence are more obvious. Moreover, his writings become more significant when they are related to liberty and community, for these are focal concepts for important problems in modern political philosophy. This study of Hocking's political philosophy will, it is hoped, help us to see how liberty and community can be more understandable, attainable, and compatible with one another. (shrink)

The themes explored include political liberty, "legal tyranny," defences of influence in government, recognition of the Opposition, and the development of organic categories of political analysis - the latter in a chapter that explodes the association often presumed between organicism and conservative modes of thought. A chapter on the "Fourth Estate" examines the gradual process of legitimation of "interests," culminating in the influence of the press. Central to the account of new political forces and their recognition is (...) the idea of public opinion, which evolved during this period from the notion of public spirit. Chapters on the classical legacy of the century and on the High-Tories examine two backward-looking aspects of the political cultrure. Tracing the persistent influence of High-Toryism, Gunn questions the conventional wisdom about eighteenth-century ideological consensus in general and Whig solidarity in particular. He demonstrates that theories of government from the seventeenth century survived to a degree not previously admitted by modern scholarship. (shrink)

This study locates the philosophical origins of the Anglo-American political and constitutional tradition in the philosophical, theological, and political controversies in seventeenth-century England. By examining the quarrel it identifies the source of modern liberal, republican and conservative ideas about natural rights and government in the seminal works of the Exclusion Whigs Locke, Sidney, and Tyrrell and their philosophical forebears Hobbes, Grotius, Spinoza, and Pufendorf. This study illuminates how these first Whigs and their diverse eighteenth-century intellectual heirs such as (...) Bolingbroke, Montesquieu, Hume, Blackstone, Otis, Jefferson, Burke, and Paine contributed to the formation of Anglo-American political and constitutional theory in the crucial period from the Glorious Revolution through to the American Revolution and the creation of a distinctly American understanding of rights and government in the first state constitutions. John Locke is widely perceived as a foundational figure within the liberal tradition. This book investigates the competing purposes that informed Locke's political philosophy, not all of which resulted in outcomes consistent with what we today understand as "liberal" ideals. Locke himself was unaware that he belonged to a "liberal" tradition. Traditions only acquire meaning in retrospect. But many have perceived the development of Locke's political philosophy as involving a smooth evolution from "authoritarian" origins to "liberal" conclusions, beginning (...) with Locke's Two Tracts on Government (1660-62) and culminating in his later political works, the Two Treatises of Government (1689) and A Letter Concerning Toleration (1689). This book advances an interpretation of this development which reveals how, by the time of his mature political writings, Locke sought to advance three competing imperatives within his political philosophy, only two of which were consistent with ideals of individual liberty. The other imperative sustained purposes much more aligned with the "authoritarianism" with which Locke's political philosophy began. The result is a much more complex and variegated understanding of Locke's political philosophy, focusing on its competing purposes. Catharine Macaulay was one of the most significant republican writers of her generation. Although there has been a revival of interest in Macaulay amongst feminists and intellectual historians, neo-republican writers have yet to examine the theoretical content of her work in any depth. Since she anticipates and addresses a number of themes that still preoccupy republicans, this neglect represents a serious loss to the discipline. I examine Macaulay’s conception of freedom, showing how she uses the often misunderstood notion of virtue (...) to reconcile the individual and collective elements inherent in the republican model. In her own analysis of the deep-rooted social obstacles that stand in the way of women becoming free, Macaulay identifies a serious problem that confronts all republicans, namely how to secure freedom in the face of entrenched structural imbalances that systematically disadvantage certain classes of person. In the end, I conclude that Macaulay herself cannot overcome the issues she raises. This in no way diminishes the importance of her work since her diagnosis is as relevant today as in her own time. Contemporary political theories have made significant progress toward identifying the principles for an egalitarian society. From this perspective, Edward Bellamy's radical and pluralistic egalitarianism can be read not only as a relevant precedent but as a source of sophisticated arguments capable of enriching current debates. Although unfairly overlooked as theoretical works, Bellamy's utopias can be read today as offering insights that bring together and combine key modern ideals of liberty, equality, and fraternity. Therefore, this article argues that Bellamy's conception (...) of equality involves several dimensions and functions as a background condition for effective freedoms; that these liberties are not at odds with voluntary equality; and that fraternity—understood in Rawlsian terms—makes sense in a free and equal soci- ety, as it is guaranteed both by institutional means and by personal decisions. Twentieth-century French philosophers Jacques Maritain and Yves R. Simon pioneered new approaches to understanding and defending political democracy in the wake of two world wars. Rather than break from a religious tradition that seemed to struggle against modernity and certain forms of democratic theory and practice, these thinkers instead looked back to the philosophy of Aristotle and Thomas Aquinas to propel Catholic political philosophy forward. The profound influence of Maritain and Simon is manifest in the dramatic achievements of (...) Vatican II and in the work of the scholars of political philosophy who learned from them. John P. Hittinger, one of the finest of these scholars, provides in Liberty, Wisdom, and Grace a comprehensive survey of the Thomists' contributions to contemporary political thought as well as a detailed analysis of their approach to democracy. Hittinger treats criticism of Maritain, including the work of Catholic political writer Aurel Kolnai, and discusses the alternative democratic visions of John Locke and David Richards. His portraits of thinkers who have wrestled with democracy in the Thomist tradition, such as Leo Strauss and John Paul II, are sensitive and engaging. Bernard Williams articulated his later political philosophy notably in response to Ronald Dworkin, who, striving for coherence or integrity among our political concepts, sought to immunize the concepts of liberty and equality against conflict. Williams, doubtful that we either could or should eliminate the conflict, resisted the pursuit of conceptual integrity. Here, I reconstruct this Dworkin–Williams debate with an eye to drawing out ideas of ongoing philosophical and political importance. The debate not only exemplifies Williams's political (...) realism and its connection to his critique of the morality system. It also illustrates the virtues and hazards of contemporary efforts to ameliorate or engineer our concepts; it indicates what political philosophy might look to in appraising political concepts; it adverts to the different needs these concepts have to meet if they are to sustain a politics of pluralism, deal with polarization, and secure the consent of those who end up on the losing side of political decisions; and it presents us with two starkly contrasting conceptions of politics itself, of the place of political values within it, and of our prospects of reducing the uncomfortably conflictual character of those values through philosophy.
