We use evidence from cognitive psychology and the history of science to examine the issue of the theory-ladenness of perceptual observation. This evidence shows that perception is theory-laden, but that it is only strongly theory-laden when the perceptual evidence is ambiguous or degraded, or when it requires a difficult perceptual judgment. We argue that debates about the theory-ladenness issue have focused too narrowly on the issue of perceptual experience, and that a full account of (...) the scientific process requires an examination of theory-ladenness in attention, perception, data interpretation, data production, memory, and scientific communication. We conclude that the evidence for theory-ladenness does not lead to a relativist account of scientific knowledge. (shrink)

Critics have challenged agricultural scientists to address concerns for environmental quality, farm size and structure, international justice, and the health and welfare of consumers and farm labor in research planning. The goal of this research was to determine what is and what could be done to consider value-laden knowledge relevant to these concerns in research planning. Descriptions of a state agricultural experiment station and of a hierarchy of inquiry that included applied systems analysis and reductionist approaches to science revealed the (...) goal-seeking and expert-centered nature of agricultural research. Value-laden and value-free knowledge of agricultural scientists and administrators were heavily represented in broad research goals such as increased productivity and efficiency. In addition, these goals were not evaluated at the levels of inquiry typically practiced by agricultural scientists. A soft systems methodology provided a more holistic level of inquiry that could facilitate consideration of value-laden and value-free knowledge of world views more diverse than those of agricultural scientists and administrators. Scientists could function as co-learners with other participants to identify issues and to conceptualize systems that are relevant to improving research planning. Moreover, researching the practice of soft systems offers opportunities for exploring systems ideas and holistic value theory in relation to agricultural research. (shrink)

The received view in Chomskian linguistics is that linguistic intuitions are the product of a linguistic competence residing in a sub-central module of the mind. In Ignorance of Language I rejected this “Voice of Competence” view, and gave an answer of my own. I argued that intuitions are empirical theory-laden central-processor responses to phenomena. This led to an exchange with Nenad Miščević in which he defended VoC. Miščević has since returned to the issue, criticizing my sort of view, which (...) he labels “ordinarism”. Dunja Jutronić has already given an excellent response to these criticisms. I focus on revising and developing my view further. I emphasize that a person’s linguistic intuitions can be immediate perceptual judgments that do not arise from any conscious and deliberate exercise of her own competence. Should she feel the need for such an exercise, she is likely to begin with an understanding test not a production one. The mental processes involved in these deliberate tests are not aptly described as “simulations” of linguistic usage. (shrink)

A lot of attention has been devoted to the study of discoveries in high energy physics, but less on measurements aiming at improving an existing theory like the standard model of particle physics, getting more precise values for the parameters of the theory or establishing relationships between them. This paper provides a detailed and critical study of how measurements are performed in recent HEP experiments, taking examples from differential cross section measurements with the ATLAS detector at the LHC. (...) This study will be used to provide an elucidation of the concept of event used in HEP, in order to determine what constitutes an observation and what does not. It will highlight the essential place taken by theory-ladenness in order to produce observational facts, and will show how uncertainty and sensitivity estimates constitute an operational approach to robustness, inside the practice of science, avoiding potential circularity problem traditionally implied by theory-ladenness. This is in contrast to robustness analyses typically considered in the literature. A careful analysis of systematic uncertainty estimates and of statistical tests used to set empirical conclusions from the observations will however demonstrate that quantitative statements obtained from these statistical tests cannot be more than simple guiding arguments for the production of knowledge, but do not determine it. This indicates that the frontier between theory and observation is blurry and that the dichotomy theory-experiment should be revised. (shrink)

The thesis of relation between observation and theory is one of the basic important issues in philosophy of science and scientific epistemology. However, the mechanistic processes of theory- ladenness of observation have rarely been discussed. Current research in cognitive science on thought processes provides powerful analytical tools and empirical support for this problem. In the light of the perception-based knowledge representation of Barsolou, this paper attempts to give a representation-based explanation for theory- laden mechanism in virtue (...) of constraints on production and explanation of representation. If representational mechanism in observation is not an absolutely subjective but a constraint construction, it will give the reliability of observation a rational support. (shrink)

Are conspiracy theory beliefs pathological? That depends on what is meant by "pathological." This paper begins by unpacking that ill-defined and value-laden term before making the case that widespread conspiracy theory belief should not be conceptualized through the “othering’ perspective of individual psychopathology. In doing so, it adopts a phenomenological perspective to argue that conspiracy theory beliefs can be reliably distinguished from paranoid delusions based on falsity, belief conviction, idiosyncrasy, and self-referentiality. A socio-epistemic model is then presented (...) that characterizes the broader phenomenon of conspiracy theory belief as a product of a sick society plagued by epistemic mistrust and vulnerability to misinformation that is ubiquitous in today’s post-truth world. Finally, it is proposed that for individuals, the harmfulness of conspiracy theory belief is less related to belief content as it is to belief conviction and degree of self-relevant consequentiality. Staging conspiracy theory belief in terms of ideological commitment offers a conceptual framework to estimate behavioral risks and test hypotheses about the effectiveness of interventions along a continuum of belief conviction and associated socio-epistemic dynamics. Interventions should target not only individuals, but the dysfunctional social conditions that give rise to the pervasive and enduring phenomenon of conspiracy theory belief. (shrink)

Traditional approaches in philosophy of biology focus attention on biological concepts, explanations, and theories, on evidential support and inter-theoretical relations. Newer approaches shift attention from concepts to conceptual practices, from theories to practices of theorizing, and from theoretical reduction to reductive retooling. In this article, I describe the shift from theory-focused to practice-centered philosophy of science and explain how it is leading philosophers to abandon fundamentalist assumptions associated with traditional approaches in philosophy of science and to embrace scientific pluralism. (...) This article comes in three parts, each illustrating the shift from theory-focused to practice-centered epistemology. The first illustration shows how shifting philosophical attention to conceptual practice reveals how molecular biologists succeed in identifying coherent causal strands within systems of bewildering complexity. The second illustration suggests that analyzing how a multiplicity of alternative models function in practice provides an illuminating approach for understanding the nature of theoretical knowledge in evolutionary biology. The third illustration demonstrates how framing reductionism in terms of the reductive retooling of practice offers an informative perspective for understanding why putting DNA at the center of biological research has been incredibly productive throughout much of biology. Each illustration begins by describing how traditional theory-focused philosophical approaches are laden with fundamentalist assumptions and then proceeds to show that shifting attention to practice undermines these assumptions and motivates a philosophy of scientific pluralism. This chapter takes a naturalized approach to the philosophy of science using evidence from cognitive psychology and from the history of science. It first describes the problem of the theory ladenness of perception. Then it provides a general top-down/bottom-up framework from cognitive psychology that is used to organize and evaluate the evidence for theory ladenness throughout the process of carrying out science (perception, attention, thinking, experimenting, memory, and communication). The chapter highlights both the facilitatory and inhibitory (...) role of theory in the scientific process. Both the historical record and the evidence from cognitive psychology suggest that the top-down factors have their greatest impact when the bottom-up information is weak or degraded. There is a short discussion of the normative implications of the material in the chapter for carrying out science. (shrink)

While most of healthcare research and practice fully endorses evidence-based healthcare, a minority view borrows popular themes from philosophy of science like underdetermination and value-ladenness to question the legitimacy of the evidence-based movement’s philosophical underpinnings. While the feminist origins go unacknowledged, those critics adopt a feminist reading of the “gap argument” to challenge the perceived objectivism of evidence-based practice. From there, the critics seem to despair over the “subjective elements” that values introduce to clinical reasoning, demonstrating that they do (...) not subscribe to feminist science studies’ normative program——where contextual values can enable good science and justified decisions. In this paper, I investigate why it is that the critics of evidence-based medicine adopt feminist science’s characterization of the problem but resist the productive solutions offered by those same theorists. I suggest that the common feminist empiricist appeal to idealized epistemic communities is impractical for those working within the current biomedical context and instead offer an alternate stream of feminist research into the empirical content of values (found in the work of Elizabeth Anderson and Sharyn Clough) as a more helpful recourse for facilitating the important task of legitimate and justified clinical decision-making. Theory-ladenness is the view that observation cannot function in an unbiased way in the testing of theories because observational judgments are affected by the theoretical beliefs of the observer. Its more radical cousin, incommensurability, argues that because there is no theory-neutral language, paradigms, or worldviews, cannot be compared because in different paradigms the meaning of observational terms is different, even when the word used is the same. There are both philosophical and practical components to these problems. I (...) argue, using a procedurally-defined, theory-neutral experiment that paradigms are indeed commensurable. The practical problems of theory ladenness include experimental design, failure to interpret observations correctly, possible experimenter bias, and difficulties in data acquisition. I suggest that there are methods to deal with these problems, although sometimes they cannot be dealt with completely. I believe that the philosophical problems of theory-ladenness have been solved, although the practical problems remain. (shrink)

By using case studies from the history of science as evidence for its claims, the philosophy of science can develop a more productive relation to its subject matter, the history of science. As might be expected, many problems involving the relation between theory and evidence in science reappear here as methodological problems about the relation between the philosophy of science and the history of science. For example, the most important of these difficulties involves the "contamination" of historical evidence (...) by philosophical theories. The difficulty may be resolved as follows: the history of science is "theory-laden", but not necessarily with the solutions to the problems it poses for philosophers. As a result, case studies can be used to test our explanatory theories about science as long as those case studies have not yet been reconstructed by the theory they are meant to test. Furthermore, once an explanatory theory has been " well -supported", we can, using that theory, go on to reconstruct case studies. Such a theory would thereby take on the force of a normative claim about science, bypassing what has been viewed as a fundamental disjunction between the descriptive and normative function of theory. From this point of view, insistence on a single criterion of demarcation as a "ground" for philosophical claims is misguided, since it prejudges a still -open question--is science homogeneous?--that can only be answered by further investigation of science. Since the late 1950s one of the most important and influential views of post-positivist philosophy of science has been the theory-ladenness of observation. It comes in at least two forms: either as a psychological law pertaining to human perception (whether scientific or not) or as conceptual insight concerning the nature and functioning of scientific language and its meaning. According to its psychological form, perceptions of scientists, as perceptions of humans generally, are guided by prior beliefs and expectations, and (...) perception has a peculiar holist character. In its conceptual form it maintains that scientists’ observations rest on the theories they accept and that the meaning of the observational terms involved depends upon the theoretical context in which they occur. Frequently, these two versions are combined with each other and give rise to a constructivist view of scientific knowledge (I shall use the term “constructivism” roughly in the same way as Golinski [1998, chap. 1]). According to this outlook, our experience is categorized and preconditioned by prior belief since the process of gaining knowledge through science always involves the use of concepts from some theory or other. This view can easily be strengthened to serve as the cornerstone of a constructivist and anti-empiricist account of science: The categories in terms of which we carve up our experience are not read off from the external world but follow from prior theoretical commitments. This paper is a response to Nenad Miščević’s “Reply to Michael Devitt”, the latest in an exchange on the source of linguistic intuitions. Miščević defends a modified version (“MoVoC”) of the received view that these intuitions are the product of a linguistic competence. I have earlier rejected all versions of the received view urging instead that intuitions are, like perceptual judgments, empirical theory-laden central-processor responses to phenomena. (1) I emphasize here, against Miščević, that this claim about a speaker’s intuitions (...) about strings is not to be conflated with a claim about her understanding of strings. (2) I develop my claim, addressed by Miščević, that MoVoC is implausible in three ways. But these are not the main problems for MoVoC. The thesis of theory-ladenness of observations, in its various guises, is widely considered as either ill-conceived or harmless to the rationality of science. The latter view rests partly on the work of the proponents of New Experimentalism who have argued, among other things, that experimental practices are efficient in guarding against any epistemological threat posed by theory-ladenness. In this paper I show that one can generate a thesis of theory-ladenness for experimental practices from an (...) influential New Experimentalist account. The notion I introduce for this purpose is the concept of ‘theory-driven data reliability judgments’, according to which theories which are sought to be tested with a particular set of data guide reliability judgments about those very same data. I provide various prominent historical examples to show that TDRs are used by scientists to resolve data conflicts. I argue that the rationality of the practices which employ TDRs can be saved if the independent support of the theories driving TDRs is construed in a particular way. (shrink)

Many decades ago Patrick Suppes argued rather convincingly that theoretical hypotheses are not confronted with the direct, raw results of an experiment, rather, they are typically compared with models of data. What exactly is a data model however? And how do the interactions of particles at the subatomic scale give rise to the huge volumes of data that are then moulded into a polished data model? The aim of this paper is to answer these questions by presenting a detailed case (...) study of the construction of data models at the LHCb for testing Lepton Flavour Universality in rare decays of B-mesons. The close examination of the scientific practice at the LHCb leads to the following four main conclusions: raw data in their pure form are practically useless for the comparison of experimental results with theory, and processed data are in some cases epistemically more reliable, real and simulated data are involved in the co-production of the final data model and cannot be easily distinguished, theory-ladenness emerges at three different levels depending on the scope and the purpose for which background theory guides the overall experimental process and the overall process of acquiring and analysing data in high energy physics is too complicated to be fully captured by a generic methodological description of the experimental practice. The concept of the cortical column refers to vertical cell bands with similar response properties, which were initially observed by Vernon Mountcastle’s mapping of single cell recordings in the cat somatic cortex. It has subsequently guided over 50 years of neuroscientific research, in which fundamental questions about the modularity of the cortex and basic principles of sensory information processing were empirically investigated. Nevertheless, the status of the column remains controversial today, as skeptical commentators proclaim that the vertical cell bands are (...) a functionally insignificant by-product of ontogenetic development. This paper inquires how the column came to be viewed as an elementary unit of the cortex from Mountcastle’s discovery in 1955 until David Hubel and Torsten Wiesel’s reception of the Nobel Prize in 1981. I first argue that Mountcastle’s vertical electrode recordings served as criteria for applying the column concept to electrophysiological data. In contrast to previous authors, I claim that this move from electrophysiological data to the phenomenon of columnar responses was concept-laden, but not theory-laden. In the second part of the paper, I argue that Mountcastle’s criteria provided Hubel Wiesel with a conceptual outlook, i.e. it allowed them to anticipate columnar patterns in the cat and macaque visual cortex. I argue that in the late 1970s, this outlook only briefly took a form that one could call a ‘theory’ of the cerebral cortex, before new experimental techniques started to diversify column research. I end by showing how this account of early column research fits into a larger project that follows the conceptual development of the column into the present. (shrink)

Bas van Fraassen’s recent book Scientific Representation: Paradoxes of Perspective modifies and refines the “constructive empiricism” of The Scientific Image in a number of ways. This paper investigates the changes concerning one of the most controversial aspects of the overall position, that is, van Fraassen’s agnosticism concerning the veridicality of microscopic observation. The paper tries to make plausible that the new formulation of this agnosticism is an advance over the older rendering. The central part of this investigation is an attempt (...) to answer Marc Alspector-Kelly’s 2004-criticism of an early version of van Fraassen’s new position. Alspector-Kelly’s contribution it is to date the most extensive attack on van Fraassen’s twenty-first-century work on the topic of microscopic observation. One of the central ideas emerging from the present discussion is a link between the debate over the veridicality of microscopic observation and the issue of the theory-ladenness of experience. Linguistic intuitions are a central source of evidence across a variety of linguistic domains. They have also long been a source of controversy. This chapter aims to illuminate the etiology and evidential status of at least some linguistic intuitions by relating them to error signals of the sort posited by accounts of on-line monitoring of speech production and comprehension. The suggestion is framed as a novel reply to Michael Devitt’s claim that linguistic intuitions are theory-laden “central systems” responses, rather (...) than endorsed outputs of a modularized language faculty (the “Voice of Competence”). Along the way, it is argued that linguistic intuitions may not constitute a natural kind with a common etiology; and that, for a range of cases, the process by which intuitions used in linguistics are generated amounts to little more than comprehension. In this paper, I investigate two potential ways to experimentally test the thesis that observation is theory-laden. One is a proposal due to Schurz (J Gen Philos Sci 46:139–153, 2015) and the other my own. The two are compared and found to have some features in common. One such feature is that both proposals seek to create conditions that compel test subjects with diverse theoretical backgrounds to resort to bare (or at least as bare as possible) observational judgments. Thus, (...) if judgments made under those conditions are convergent across test subjects, the said convergence would lend credibility to the view that theory-neutral observations are feasible. This still leaves the question of why any such convergence exists unanswered. Towards the end of the paper, it is argued that the best explanation for observational judgment convergence is the veridicality of those judgments. (shrink)

In Devitt’s view, linguistic intuitions are opinions about linguistic production of products, most often one’s own. They result frorn ordinary empirical investigation, so “they are immediate and fairly unreflectiveernpirical central-processor responses to linguistic phenomena”, which reactions are, moreover, theory-laden, where the ‘theory’ encompasses all sorts of speaker’s beliefs. The paper reconstructs his arguments, places his view on a map of alternative approaches to intuitions, and offers a defense of a minimalistic “voice-of-competence” view. First, intuitions are to be identified (...) with the data, the minimal “products” of tentative linguistic production of naïve speaker-listeners, and not with their opinions about the data. Second, the data involve no theory and very little prototheory. Third, although there might be admixtures of guesswork in the conscious production of data, these are routinely weaned out by linguists. Finally, mere acceptance of the “voice of competence” does not land us in any objectionable Cartesianism: it is cornpatible with naturalism and with distrust of a priori philosophy. (shrink)

In this essay, I offer several claims about how postmodern preoccupation with DIFFERENCE may be reread, pragmatically. The claims are based on the following, creatively interpretive model of the pragmatic maxim, as applied to what Peirce calls "intellectual concepts." According to the model, the maxim may have a variety of uses, but it can be proven only in so far as it is applied to the one species of "intellectual concepts" that results when real doubts are misrepresented as paper doubts. (...) These concepts are the products of theoretical inquiries that represent themselves as merely theoretical, when in fact they are stimulated by urgent concerns. The pragmatic maxim offers a rule for converting this species of what appear to be merely intellectual concepts into symbols of some theoretically minded inquirer's attempt to respond to these urgent concerns. But what kind of urgent concern would tend to be misrepresented in this way? According to the model, these are not concerns about failed rules of everyday conduct — or about concrete cases of flesh-and-blood suffering; they are, instead, concerns about failed rules for repairing everyday suffering. The attempt to repair such rules of repair is both theory-laden and urgent (urgent because failed rules of repair are ultimately sources of suffering; theory-laden because they are not immediately so). According to the model, Peirce's name for the practice of urgent theorizing is philosophy, or coenoscopy: not a science of common or everyday practices, but of rules for repairing everyday practices. It is philosophy that is most prone to misrepresenting what is urgent AS what is merely theoretical, because both theory and urgency are proper to it. The pragmatic maxim is, in this view, a rule specifically for repairing urgent philosophy that presents itself as merely paper philosophy. (shrink)

Most philosophers of science now believe that scientific data are theory laden, i.e., the evaluation of data is influenced by prior theoretical beliefs. Although there is historical and psychological evidence that is consistent with the theory-laden position, experimental evidence is needed to directly test whether prior beliefs influence the evaluation of scientific data. In a fully counterbalanced design, one group of subjects received evidence that dinosaurs were cold-blooded, and another group of subjects received evidence that dinosaurs were warm-blooded. (...) The subjects reported a strong belief in whichever theory they had read about. Then subjects were presented with a piece of data that supported one theory and contradicted the other theory. The identical piece of data was rated as more believable when it was consistent with the subject's theory than when it was inconsistent. These results provide clear support for the position that scientific data are theory laden. (shrink)

Are sensory experiences, perceptual beliefs and observation reports faithful encoders of truthful information about the world? The theory-ladenness thesis poses an important challenge to answering this question in the affirmative. Roughly the thesis holds that theoretical factors affect the content of those experiences, beliefs and reports. In other words, it holds that their content is laden with theory. Theoretical factors here are construed broadly so as to include scientific theories, beliefs and cognitive processes. Two crucial questions arise (...) in relation to the theory-ladenness thesis. First, how pervasive is theory-ladenness? And, second, what is the extent of the distortion theory-ladenness has on the content of experiences, perceptual beliefs and observation reports? If theory-ladenness is not only pervasive, i.e. if it affects the majority of experiences, perceptual beliefs and observation reports, but also highly distortive way then those experiences, beliefs and reports can .. This paper attempts to argue for the theory-ladenness of evidence. It does so by employing and analysing an episode from the history of eighteenth century chemistry. It delineates attempts by Joseph Priestley and Antoine Lavoisier to construct entirely different kinds of evidence for and against a particular hypothesis from a set of agreed upon observations or (raw) data. Based on an augmented version of a distinction, drawn by J. Bogen and J. Woodward, between data and phenomena it is (...) shown that the role of theoretical auxiliary assumptions is very important in constructing evidence for (or against) a theory from observation or (raw) data. In revolutionary situations, rival groups hold radically different theories and theoretical auxiliary assumptions. These are employed to construct very different evidence from the agreed upon set of observations or (raw) data. Hence, theory resolution becomes difficult. It is argued that evidence construction is a multi-layered exercise and can be disputed at any level. What counts as unproblematic observation or (raw) data at one level may become problematic at another level. The contingency of these constructions and the (un)problematic nature of evidence are shown to be partially dependent upon the scientific knowledge that the scientific community possesses. (shrink)

Anthony Simon Laden explores the kind of reasoning we engage in when we live together: when we are responsive to others and neither commanding nor deferring to them. He argues for a new, social picture of the activity of reasoning, in which reasoning is a species of conversation--social, ongoing, and governed by a set of characteristic norms.

The Thesis of Theory-Laden [TTL] holds that is not possible a neutral observation. From this thesis, some philosophers have inferred that the facts, i.e., the subject’s independent reality, do not exist or that they are social constructions only. The aim of this paper is assess if TTL necessarily implies a constructivist point of view or if, conversely, we can still speak about the reality. In order to do this, we will clarify these terms: "the theory-ladenness of observation" (...) and "constructivism". Then, we will argue that although TTL is possible, we are not committed to constructivism, and on the contrary, TTL can be an interesting frame to the realistic thesis. Finally, we will point out the impact this had has when evaluating many epistemological proposals. La tesis de la carga teórica de la observación [CTO] sostiene que no es posible una observación neutral. A partir de esta tesis, algunos filósofos han derivado que los hechos, o mejor, la realidad independiente del sujeto, no existen o que son solo construcciones sociales. El objetivo de este artículo es evaluar si CTO implica necesariamente una visión constructivista o si, por el contrario, permite seguir hablando de realidad. Theories of rational choice focus on the question of how to choose what to do. They are, that is, concerned with the selection of one among a set of possible actions. Furthermore, they tell us how to make such a choice rationally. They accomplish this aspect of their task by telling us how to choose ‘in order to achieve our aims as well as possible.’Theories of reasonable deliberation, as I describe them in this paper, analyze a different domain of reasoning (...) in the service of action. First, their subject matter is the deliberation that leads to action, rather than the final selection of the action itself. Second, they ask about the intrinsic character of a deliberative path, rather than its likely outcome. That is, they are theories of the reasonableness of deliberation, rather than its rationality. To see the distinctiveness of this theoretical domain, it helps to approach it by backing away from the domain of rational choice theories one step at a time. (shrink)

The article based on Kuhn’s paradigmatic approach and Lakatos’ methodology of scientific research programmes, analyses certain aspects of selected cognitive functions of religous beliefs. Our approach is based on the search for angalogy between scientific theories on one hand and systems of religious beliefs on the other hand. Contemporary philosophy of science demonstrates that scientific models are the products of creative analogous immagination, data are theory-laden, theories as a whole are resistent to falsification and it is hard (if at (...) all) to find reliable criterions for the selection of a paradigm. These «subjective features» are more evident within religion, since a wider range of models, greater impact of interpretations on data, greater arduousness in regard to the commitment to a paradigm and more ambiguity in the process of the selection of a paradigm, exist in this area. However, with each of these features, I see the difference between science and religion in their degree and not in absolute contrast. (shrink)

Abstract During the last decades it has become widely accepted that scientific observations are ?theory?laden?. Scientists ?see? the world with their theories or theoretical presuppositions. In the present paper it is argued that they ?see? with their scientific instruments as well, as the uses of scientific instruments is an important characteristic of modern natural science. It is further argued that Euclidean geometry is intimately linked to technology, and hence that it plays a fundamental part in the construction and operation (...) of scientific instruments. Finally, Euclidean geometry is compared to fractal geometry, and the question of its a priori status is raised. Although the position that Euclidean geometry is a priori in the original Kantian sense is untenable, the paper concludes that in some restricted sense Euclidean geometry may be said to be a priori. Recent claims, mainly from computer scientists, concerning a largely automated and model-free data-intensive science have been countered by critical reactions from a number of philosophers of science. The debate suffers from a lack of detail in two respects, regarding the actual methods used in data-intensive science and the specific ways in which these methods presuppose theoretical assumptions. I examine two widely-used algorithms, classificatory trees and non-parametric regression, and argue that these are theory-laden in an external sense, regarding the framing (...) of research questions, but not in an internal sense concerning the causal structure of the examined phenomenon. With respect to the novelty of data-intensive science, I draw an analogy to exploratory as opposed to theory-directed experimentation. (shrink)

Kuhn 's contribution should be viewed as posing a number of important problems, not as a full-fledged theory of the structure of science. Kuhn 's alleged theory-ladenness of observations is examined as a test case in the light of Hintikka's interrogative model of inquiry. A certain superficial theory-ladenness is built into that model. Moreover, the model provides a deeper analysis of theory-ladenness via the two-levelled character of experimental science. A higher-level and a lower-level (...) inquiry rely on different kinds of initial premises and operate with different kinds of "answers" by nature. The theory-ladenness of perception argument is not an argument at all. It is two clusters of arguments. The first cluster is empirical. These arguments typically begin with a discussion of one or more of the following psychological phenomena: (a) the conceptual penetrability of the visual system, (b) voluntary perceptual reversal of ambiguous figures, (c) adaptation to distorting lenses, or (d) expectation effects. From this evidence, proponents of theory-ladenness typically conclude that perception is in some sense "laden" (...) with theory. The second cluster attempts to extract deep epistemological lessons from this putative fact. Some philosophers conclude that science is not (in any traditional sense) a rational activity, while others conclude that we must radically reconceptualize what scientific rationality involves. Once we understand the structure of these arguments, much conventional wisdom about the significance of the psychological data turns out to be false. (shrink)

In the past generation, restitution law has emerged as a global phenomenon. From its Oxbridge home, restitution migrated to the rest of the Commonwealth, and ongoing Europeanization projects have brought the common law of restitution into contact with the Romanist concept of unjust enrichment, further internationalizing this movement. In contrast, in the United States, scholarly interest in restitution, in terms of books, articles, treatises, symposia and courses on restitution, is meager. Similarly, while restitution, equity and tracing cases receive considerable treatment (...) at the highest levels of the English judiciary, US courts seem uninterested in these issues, rarely producing the theory-laden opinions that have become quite common in the House of Lords. The situation is particularly curious because restitution is generally thought to be the invention of late nineteenth-century American scholars. This article explains this divergence. I argue that the Commonwealth restitution discourse is largely a product of pre- or anti-realist legal thought which generates scepticism within the American academic-legal establishment. The article identifies the two dominant camps in American private law thought—left-leaning redistributionalists and the centre-right legal economists—and shows that neither has any use for the Commonwealth's discourse. I conclude by analysing the emerging drafts of the Restatement of Restitution and forecast the future of American restitution law. (shrink)

Focusing on the discovery of weak currents, the current debate on the theory-ladenness of observation in modern physics might be too narrow, as it concerns only the last stage of a complex experimental process and statistical methods required to analyze data. The scope of the debate should be extended to include broader experimental conditions that concern the design of the apparatus and different levels of the detection process. These neglected conditions often decisively delimit experiments long before the last (...) stage has been reached, thus predetermining the extent of the dependence of data production on the theory. I explain the nature of these conditions and the theory-ladenness tendencies they produce, noting how they affect the last stage of the data analysis and providing some relevant examples. (shrink)

The author argues that the distinctive aspects of political liberalism have historical roots in the republican tradition that is often described as “neo-roman,” and recently given articulation in the work of Q. Skinner and P. Pettit. The primary task of this paper will be to layout these correlations, to provide, as it were, a mapping between the vocabulary of the neo-roman theory and that of political liberalism. By tracing the genealogy of political liberalism, the author argues that we ought (...) to rethink the history, the vocabulary, and conceptual framework of contemporary political philosophy. In particular, seeing political liberalism as a form of republican theory as well as a form of liberal theory changes how we understand it: it brings out certain distinctive features of the structure of the view that are often overlooked, such as its stress on certain civic duties and its conception of freedom as a freedom of the city. If leading republican and liberal thinkers turn out to have much in common, then we will have to rethink also our intellectual geography: we will have to sketch in some land-bridges between the continents. Feyerabend claims that what is perceived depends upon what is believed ; and he maintains that among really efficient alternative theories "each theory will possess its own experience, and there will be no overlap between these experiences". According to Feyerabend "scientific theories are ways of looking at the world; and their adoption affects our general beliefs and expectations, and thereby also our experiences...". Toulmin, Hanson, and Kuhn concur with this view. Toulmin claims that men who accept different "ideals" and (...) "paradigms" will see different phenomena. He thinks theories not only give significance to facts, but also determine what facts are for us at all. Like Feyerabend, Toulmin asserts that "we see the world through" our fundamental concepts of science "to such an extent that we forget what it would look like without them". Indeed, both Feyerabend and Toulmin would have previous thinkers "live in an observational world very different from our own". Kuhn expresses quite similar views. He feels that. (shrink)

In a series of articles, the most extensive of which are [9] and [10], Carl R. Kordig has attacked the "new empiricism" of the late Norwood R. Hanson, P. K. Feyerabend, Thomas S. Kuhn, and Stephen E. Toulmin. While there are differ- ences among the views of these philosophers, they agree at least on the following claims: (1) scientific method does not proceed inductively from neutral observations because (a) observations are not free of interpretation; and (b) scientists, as a matter (...) of history, have not used induction as the means of arriving at scientific laws; and (2) the key to scientific progress is the discovery of theories, hypotheses, or paradigms which order phenomena and influence the ways in which data are experienced. While Kordig admits that the new empiricism has the valuable effect of underscoring the truth that scientific revolutions do not consist merely in finding new facts or in paying closer attention to already known facts, contrary to the new view, he maintains that observations must be and are neutral ([9], pp. 478-479). Kordig contends against the new empiricists that if observations are not neutral but theory-laden, then it is impossible to test, compare and verify theories. Conse- quently, Kordig concludes that the new empiricist view implies that scientific progress is impossible ([9], pp. 470-471; [10j, p. 470). In opposition to their view, Kordig maintains that observations are neutral and independent of theories (and this was the insight of the logical empiricists) ([10], p. 468); and moreover, observa- tions must be neutral to and independent of theory in order that (a) differing theories may be truly said to compete and (b) the observations may be the basis of testing and deciding between competing theories. The brain is involved in theory-laden cognitive processes. But there are two different theory-laden processes. In cases where the theory is based on facts, more facts can either falsify or confirm a theory. In cases where the theory is about the choice of a benchmark or a standard, more facts can only make a theory either more or less warranted. Clark offers a review of a view of the brain where the brain pro- cesses (...) input information in a way that confirms its priors or its pre- dictions. This does not mean that the brain creates its own reality. The brain, rather, processes input data, but it does so in light of its own priors. The brain is a bidirectional hierarchical structure. While the top layers generate priors, the lower layers process input data. The brain amounts to the dynamics of image- making, where the top-down process generates unified images, while the bottom-up process, which takes data, corrects the images. (shrink)

This paper attempts to argue for the theory-ladenness of evidence. It does so by employing and analysing an episode from the history of eighteenth century chemistry. It delineates attempts by Joseph Priestley and Antoine Lavoisier to construct entirely different kinds of evidence for and against a particular hypothesis from a set of agreed upon observations or data. Based on an augmented version of a distinction, drawn by J. Bogen and J. Woodward, between data and phenomena it is shown (...) that the role of theoretical auxiliary assumptions is very important in constructing evidence for a theory from observation or data. In revolutionary situations, rival groups hold radically different theories and theoretical auxiliary assumptions. These are employed to construct very different evidence from the agreed upon set of observations or data. Hence, theory resolution becomes difficult. It is argued that evidence construction is a multi-layered exercise and can be disputed at any level. What counts as unproblematic observation or data at one level may become problematic at another level. Theory-ladenness of perception and cognition is pervasive and variable. Emerging maturationally natural perception and cognition, which are on-line, fast, automatic, unconscious, and, by virtue of their selectivity, theoretical in import, if not in form, define normal development. They contrast with off-line, slow, deliberate, conscious perceptual and cognitive judgments that reflective theories, including scientific ones, inform. Although culture tunes MN systems, their emergence and operation do not rely on culturally distinctive inputs. The sciences advance radically counter-intuitive representations that depart (...) drastically from MN systems’ deliverances. Extensive experience with RCI scientific theories can result in a practiced naturalness with their perceptual and cognitive consequences; nevertheless, automatic MN verdicts persistently intrude. Fodor suggests that the uniformity of the biases MN systems introduce can serve as a theory-neutral means for adjudicating scientific disputes. Findings about vision challenge Fodor’s proposal for circumventing problems that MN theory-ladenness presents. These considerations indicate that RCI scientific ideas are difficult to learn, master, and deploy; consequently, the corrective import of science’s social and institutional arrangements plays a critical role in its epistemic stature. In his book Economics as a Moral Science , Bernard Hodgson argues that economics is not value neutral as is often claimed, but is a value-laden discipline. In the long argument for this in his book, Hodgson never discusses or even mentions corporations. This article explains that corporations are absent from Hodgson’s discussion because he considers only the consumption side of general equilibrium theory (GET), and it shows that if Hodgson had included corporations and the production side, his overall (...) argument would have been more complete and convincing. This article shows that Hodgson’s methodology, when applied to the production side of GET, has value implications for CEOs of large corporations, for shareholders and members of Boards of Directors, and for legislators and regulators of business. Hodgson’s claim that economics must consider the ability of economic agents to create or change the institutional, cultural, and organizational conditions of their own economic actions is supported and expanded.
