The extent to which the legal doctrine addresses manifestations of constitutionalism has been constantly growing. However, the majority of research in constitutionalism focuses on the analysis of the power of the Constitution and the fundamental principles entrenched in it whereas ordinary branches of law, including civil procedure, affected by the constitutional law remains outside the scope of a deeper analysis. The author of the present paper is convinced that certain aspects of the impact of constitutional justice on such branches as, (...) in particular, civil procedure deserve deeper interest. The modest scope of the paper precludes an extensive analysis of the role of the Constitution as a fundamental binding Act and today’s abundant doctrine of Lithuania’s Constitutional Court in civil procedure. Therefore, the present paper is confined to an analysis of individual aspects of direct application of the Constitution and the doctrine of the Constitutional Court. The article analyses the power of the Constitution and its impact on the civil procedure as an Act laying down the fundamental principles binding the legislator in adopting procedural instruments and principles to be followed by courts and as a remedy for violations of rights or a tool to address loopholes and collisions of law. Courts of general jurisdiction perform the control of legitimacy of legal Acts by checking their compliance with the Constitution in individual cases and by applying to the Constitutional Court for repeal of anticonstitutional norms or by applying the Constitution as an Act of direct effect to eliminate loopholes, interpret statutes and deal with collisions of legal norms. The author believes that the fact that the courts of general jurisdiction frequently raise questions of incompliance of legal Acts with the Constitution and decisively apply to the Constitutional Court evidences a high level of legal culture and legal consciousness of the judges. That fact may also serve as a precondition for the growth of confidence in the judiciary as judicial procedures may contain no uncertainties as to the constitutionality of the statutes to be followed in litigation. The article deals with the constitutional right of a person to apply to court. While construing this constitutionally entrenched right of a person, one analyses the doctrine of the right of a person to apply to court, which was formed in the jurisprudence of the Constitutional Court of the Republic of Lithuania. The right of a person to court is entrenched expressis verbis in Paragraph 1 of Article 30 of the Constitution whereby the person whose constitutional rights or freedoms are (...) violated shall have the right to apply to court. The doctrine of the Constitutional Court derives this right also from the constitutional principle of a state under the rule of law. The right of a person to court is inseparable from other norms and principles of the Constitution, which are equality of rights, the right to compensation of damage, the right to a proper court process, etc. (shrink)

Under Article 74 of the Constitution, for gross violation of the Constitution or breach of oath, or if it transpires that a crime has been committed, the President of the Republic may be removed from office under procedure for impeachment proceedings. In the article the content of the constitutional delict is analysed. The President of the Republic may be brought to constitutional responsibility only for the actions which he committed while in office of the President of the Republic. The President (...) of the Republic may be removed from office not for any violation of the Constitution, but only for gross violation thereof. While implementing the powers established to him in the Constitution and laws, the President of the Republic may not breach the oath. Under Article 74 of the Constitution, the President of the Republic may be removed from office “if it transpires that a crime has been committed” – this provision means that the Constitution provides for the right of the Seimas to remove the President of the Republic from office in the absence of a court judgement recognising that the President of the Republic is guilty of commission of a crime. The Constitution commissions only the Constitutional Court to establish the fact of violation of the Constitution – whether there has been a gross violation of the Constitution and breach of oath by actions of the person. The Seimas may not change or question the conclusion of the Constitutional Court. On the grounds of the conclusion of the Constitutional Court that the actions of the President of the Republic are in conflict with the Constitution, it is only the Seimas that decides whether to remove the President of the Republic from office. The removal of the President of the Republic from office under procedure of impeachment proceedings due to a suspicion that the crime has been committed is not binding upon a court of general jurisdiction which considers the criminal case. From the perception of the peak of the spiritual quest and the decline of organized religion, I seek to understand the causes of this process, as well as providing keys that allow us to approach it in a lucid manner. What actually is changing radically relates to mode of knowing which affects all areas. We have witnessed, in different fields of knowledge, the passage of mental mode (dual) to the non-dual mode of knowledge. I propose what I consider a decisive (...) factor for this: take the non-dual knowledge model as a means to escape the traps that induces the mental model (dual). Hence, it seems coherent to affirm that we are directing us to a trans-religious and post-theist spirituality, laden with riches. I will offer, from the non-dual perspective, a brief reflection on the relationship between spirituality (non-dual) and commitment. (shrink)

El objetivo del trabajo consiste en analizar la interpretación de la teología de Epicteto propuesta recientemente por Keimpe Algra, la cual sugiere interpretar el lenguaje personalista de ciertos pasajes de las Disertaciones como una herramienta pedagógica bajo la cual se esconde un núcleo ortodoxo. Señalaré algunas dificultades importantes que presenta la interpretación de Algra, dificultades que obligan a concluir que la interpretación tradicional (la cual interpreta el personalismo de dichos pasajes en sentido literal, i.e., como expresión de una concepción teísta (...) y personalista de la divinidad) permanece en pie. Suvremeni svijet izražava veliku potrebu za etikom u financijskim, gospodarskim, političkim i općenito socijalnim sferama. U tom kontekstu teorija društvenog izbora A. Sena, indijskoga ekonomista, filozofa i dobitnika Nobelove nagrade za osobite doprinose na području ekonomije, predstavlja važan čimbenik u ostvarivanju društvenih ciljeva, a ima i ključnu ulogu u formiranju zdravog društvenopolitičkog poretka. U ovom članku u središtu našeg interesa bit će implementacija skupa sposobnosti u sfere društva, te kritika utilitarističkih pristupa ekonomskom razvoju. Govorit ćemo o slobodama koje se trebaju (...) razumjeti kao obveze koje uključuju odgovornost za druge, kroz racionalan društveni izbor, tako da se na taj način formira razumski čvrsta etička podloga, iz koje se formira koherentan sustav vrijednosti koji se zasniva na povjerenju, spremnosti na suradnju te se na taj način i pojedinac samoostvaruje. Time zapravo dolaze do izražaja individualna i komunitarna razina morala.Contemporary world expresses a great need for a code of ethics in the financial, political and in the social spheres in general. In this context the theory of social choice of A. Sen, the Indian economist, philosopher and winner of the Nobel prize for his personal contribution in the field of economy, represents an important factor in the realization of social goods and also plays a key role in the formation of a sound socio-political order. The implementation of capabilities into the social spheres and the critique of utilitarianism will be in the focus of our interest in this article. At that context we’ll mention freedoms that have to be understood as commitments which include responsibility for other people through rational social choice which is the rational solid ethical base from which we form coherent system of values based on trust, willingness for cooperation, so on that way the individual also fulfils himself/herself. Visuotinė globalizacija paspartino darbo ir kapitalo mainus, suteikė tautoms socialinės pažangos ir ekonominės gerovės viltį. Ji paskatino ir spartesnius kultūrinius mainus, o kartu ir efektyvios tarpkultūrinės komunikacijos poreikį. Jei ekonominiai mainai, perdavimas ir įsisavinimas įgūdžių, kompetencijų, nauja ekonominė mąstysena bei praktika didesnių sunkumų nesukėlė, tai kultūros pagrindų perdavimas ir įsisavinimas (inkultūrizacija), užtikrinantis visavertį bendravimą ir bendradarbiavimą, vyksta kur kas sunkiau. Aiškėja, kad ne visos vertybės gali būti adekvačiai perduotos ir ne visos lengvai priimtos. Kita vertus, pati kultūra yra tarpdalykinio tyrimo (...) objektas. Egzistuojantys įvairūs metodologiniai požiūriai į tai, kas yra kultūra, viena vertus, padeda geriau suprasti šį fenomeną, kita vertus, aiškiau apibrėžti inkultūrizacijos raiškos galimybes. Straipsnyje aptariama kultūros samprata, jos aiškinimų įvairovė, analizuojamas kultūros perėmimo ir įsisavinimo procesas bei kultūrinių determinantų vaidmuo tarpkultūrinėje komunikacijoje. (shrink)

Nel breve spazio del presente lavoro, intendo dar conto dell’“habitus teologico” che caratterizza lo stile filosofico di Alasdair MacIntyre : “religiously musical” è infatti — a mio avviso — il più insolito, e allo stesso tempo il più suadente, epiteto attribuito al filosofo scozzese dai teologi James Gustafson e Stanley Hauerwas. Tale habitus è altresì esaltato dalla diffusa propensione a saldare insieme — senza apparente soluzione di continuità — il modus philosophandi macintyriano e alcune recenti figure della teologia cristiana post–liberale (...) e post–moderna, di cui ci occuperemo in seguito: soprattutto la “teologia narrativa” di Hans Frei, George Lindbeck, et. al., ma anche la “radical orthodoxy” di John Milbank, Catherine Pickstock, Graham Ward, et. al. Sebbene MacIntyre non abbia replicato direttamente a simili tentativi di “appropriazione teologica” del suo pensiero, ritengo, comunque, che i tempi siano maturi per riconoscere — a lui e al “tomismo analitico” — un ruolo sui generis nell’evoluzione della tradizione aristotelico–tomista del XX secolo : ruolo distinto, ma non separato, rispetto a quello coevo di quanti — in ambito continentale — hanno tenacemente proseguito la ricerca filosofica e teologica nel solco di Tommaso, come ad esempio Marie–Dominique Chenu, Yves Congar, Cornelio Fabro, Etienne Gilson, Jacques Maritain, Edith Stein, et al. [Theism and Theology in Classical Yoga] .

Os fenómenos religiosos ocupam um lugar central na vida dos crentes, na dinâmica dos grupos, na coesão das comunidades locais e na ordenação global das sociedades nacionais e transnacionais. Incidindo sobre a dimensão ideológica da religiosidade, o presente artigo pretende contribuir para um entendimento mais alargado da secularização, seus contornos sociais e consequências individuais nas sociedades ocidentais contemporâneas. Nele se revisita a tese weberiana da Secularização e seus efeitos ao nível da significação religiosa, dos estatutos/papéis religiosos e da extensão pela (...) qual se vive o religioso. Discute-se a privatização da religião e a consolidação numa religião mais transferida para a privacidade de cada um. A regressão ocorrida ao nível do efeito global e totalizante da religião assiste à procura de novas formas/rumos espirituais. A secularização vê-se transfigurada em pós-secularização, momento oportuno para a reformulação das teorias sociológicas da religião. O mundo contemporâneo é plural e secularizado, desenvolvendo-se crenças fora dos contextos institucionais, associadas a uma atitude religiosa mais pragmática. Espelho das sociedades ocidentais contemporâneas, a realidade portuguesa aproxima-se de uma posição pluralista em matérias religiosas. A relação do cristão leigo com a Igreja transformou-se, passando-se de uma fé de obrigação para uma fé de convicção. (shrink)

The Author proposes to describe the possible foundations of a Trinitarian theism that may be a philosophically adequate translation of the Johannine declaration: “God is love”, introduced by some contemporary thinkers as a key to resolving some aporias within classic theism. This is done by way of analysis of Trinitarian ontology and relational ontology, for which there is an attempt to provide a shareable phenomenological basis. The paper then goes on to questions of epistemology (hyperphatic theology) linked to the ability (...) of human reason and human language to express the categories introduced in this analysis, categories that are nothing else but a renewed philosophical appreciation of the terminology proper to Trinitarian speculation. Alasdair MacIntyre ao realizar uma série de críticas à moralidade e filosofia moral modernas e contemporâneas defende a tese de que o desacordo moral e a ausência de justificação racional para a moralidade é fruto do abandono do elemento teleológico da ética, especialmente do abandono da ética aristotélica, o que o leva a propor a retomada da ética teleológica de Aristóteles. Essa retomada é justificada com a teoria da racionalidade das tradições, por meio da afirmação de que o modo tradicional (...) de investigação é o melhor e que a tradição aristotélico-tomista corresponde a uma tradição moral superior às suas rivais. Com sua adesão a essa tradição MacIntyre vai apontar Tomás de Aquino como o teórico que conseguiu reunir todas as características do modo tradicional de investigação moral, integrando a tradição aristotélica e a agostiniana, o que fez com que o próprio MacIntyre se aproximasse e se apropriasse cada vez de elementos fundamentais do Tomismo. O Tomismo de MacIntyre, por sua vez, sofre uma série de críticas e objeções, especialmente em relação às tensões que se estabelecem no interior do pensamento do autor, que em After Virtue prometia um pensamento secular e pragmático. Este trabalho tratará dessa tensão e de algumas críticas direcionadas ao Tomismo de MacIntyre. (shrink)

En el presente artículo se analizan los tres ejes del debate en la polémica que hace unos años han mantenido Antonio Diéguez Lucena y Francisco José Soler Gil: i) la causación mental y su posible explicación en clave naturalista, ii) los méritos y límites explicativos de una posible alternativa teísta y iii) la conveniencia o no de una metodología naturalista en filosofía.

The aim of this paper is to answer the question of whether the two evolutionary debunking arguments (EDA) which, in my interpretation, can be developed from memetics (the argument of contagion and the argument of belief in belief) successfully undermine both the internalist and the externalist rationality of theism. The EDA against the rationality of religious belief try to prove that if such belief is caused by processes that do not track the truth, then this belief is unwarranted or even (...) false. I will argue that the contagion argument is not valid due to the theoretical weakness of memetics, while the argument of belief in belief may be partly valid, since it is logically independent of the memetic approach. Finally, I will examine a possible refutation of that argument based on the thesis that the propositional belief in God is not decisive for the adaptive explanation of the complex system of religion. I will show, briefly, that this does not save theism from another EDA based on the adaptive nature of religion. (shrink)

The philosophical thought of Massimo Cacciari and the conceptual issues of « open theism » are two speculative routes apparently very distant from each other. This contribution highlights the common goal in their going to the root of philosophic problems in order to seek an answer: they think of a divine way of becoming explaining the reason of both the reality of the world and the paradoxical reality of human freedom. The two routes tend to converge and recover concepts pertaining (...) to the Trinitarian speculation whose philosophical « translation » in philosophy passes, today, through the relational and trinitarian ontology, and also the « iperphatic » theology. In this convergence there is ground for thinking not only a truly Trinitarian theism, but also a Trinitarian philosophy, which considers Trinity as the essential summit of a good metaphysics. From Analytic Philosophy to Theism: Antony Flew After the great idealistic systems, the advent of nihilism and the formulation of pragmatism, philosophy restarts again creatively. To understand this rise, I will argue about the essential relationship that philosophy should have with science. Then I will delineate, in line with Antony Flew’s history, the main philosophical arguments atheists present in analytic philosophy, and the characteristics that take the old arguments. Civil proceedings do not terminate after adoption of a court decision. The enforcement of a material subjective right requires the second stage of legal defence, i.e., compulsory enforcement of a court decision. State courts are authorised to adopt decisions on behalf of the state and to ensure compulsory enforcement of an adopted court decision. Although enforcement proceedings constitute the final stage of civil procedure, it has some specific features, e.g., the representation in enforcement proceedings is distinctive. The article analyzes application (...) of this institute in enforcement proceedings: the subjects eligible to act as representatives in enforcement proceedings, the order of execution of their powers, and the problems of adjudicating remuneration for representation in enforcement proceedings. The Article presents a study of opportunities and problems related to the procedural actions taken by bailiffs electronically. In the opinion of the authors, the digitalisation of the enforcement procedure seeks to ensure the maximum use of electronic documents: enforcement and procedural documents should function only in the electronic format and thereby should create an effective, transparent and easily accessible information system of electronic enforcement files, which will not only increase the effectiveness of performance of bailiffs and save costs, but (...) will also ensure the protection of the rights of claimants and debtors in enforcement proceedings through reliable and prompt service of procedural documents by electronic means, access to information about the course of the enforcement proceedings by using information technologies, and transfer of certain procedural actions taken by bailiffs into the electronic environment. Section one of the Article discusses the EU regulation in the area of unification and digitalisation of the enforcement procedure. Section two deals with the possibilities of issuing electronic enforcement orders, issuance of an enforcement order, technical measures to enable bailiffs access the information systems of the institutions issuing enforcement orders by safe electronic channels and thereby electronic enforcement orders would be transferred from the issuing institution to bailiffs electronically, without using any hard copy enforcement orders. In the opinion of the authors, considering that the majority of enforcement orders are issued by courts, it would be expedient, first of all, to take advantage of the existing information system LITEKO, making it possible to keep not only court judgments but also enforcement orders there as well as providing bailiffs with technical possibilities of access to the LITEKO system and acceptance of the electronic enforcement orders from the system. A similar principle should be followed for designing integrated information systems of bailiffs and other institutions that issue enforcement orders. Section three focuses on the main procedural documents – arrangements given by bailiffs and property attachment deeds – and on their electronic service on the participants involved in the enforcement procedure. The last section of the Article offers a study of the measures to secure the rights of participants of the enforcement procedure, namely access of the participants of the enforcement procedure to the enforcement file, possibilities for courts to obtain electronic enforcement files promptly, etc. (shrink)

The present article is aimed at dealing with certain questions of compensation for damage, caused by the criminally insane person. Disposal of a civil action on compensation for damage, caused by the criminally insane person, in the criminal procedure is analyzed in the first part of the article. The subjects, who are responsible for compensating for damage, caused by the criminally insane person’s deed, are dealt with in the second part. Not only the respective rules of law, stated in the (...) Civil Code of the Republic of Lithuania and in the Criminal Process Code of the Republic of Lithuania, are systemically analyzed in the present article, but the court practice is considered from the aspect of the items, which are relevant to the theme under investigation, and is systematized. Straipsnyje atskleidžiu tam tikrą pragmatizmo ir egzistencializmo suderinamumą tiesos sampratos aspektu. Siekdamas pagrįsti šį suartėjimą, tyrinėju Jameso pragmatinį metodą ir Nietzschės kritinį požiūrį į „valią tiesai“. Abu mąstytojai stoja prieš absoliučios, fiksuotos ir praktinių individo poreikių nepaisančios tiesos idėją. Atitinkamai, abu jie teigia, kad tiesa, suprantama ikiteoriškai, yra procesas, imanentiškas konkrečiai subjektų gyvenimo patirčiai. Pasitelkdamas pragmatinius ir egzistencialistinius svarstymus, aš kritiškai tyrinėju, kaip šie filosofai kvestionavo tiesą individo kaip veikėjo egzistencijos kontekste.

Prema Epikurovoj epistemologiji svi su opažaji istiniti. Ta teza podrazumijeva da naša osjetila nikada ne griješe, te da nam opažaji uvijek daju točne izvještaje o vanjskom svijetu. Iako se na prvi pogled čini vrlo neuvjerljivom, podrobnija analiza Epikurovih tekstova pokazuje da je ona potkrijepljena zanimljivim argumentima. Pokazuje se da je jasna motivacija Epikura za obranu te teze leži u prihvaćanju radikalnog empirizma i težnji da izbjegne skeptičke opasnosti u koje je zapao Demokrit. Nadalje, opravdanje te teze leži u Epikurovu objašnjenju (...) samog opažajnog procesa, tj. u fizikalnom objašnjenju mehanizma opažanja, koje se uklapa u atomističku sliku svijeta. Opažajni proces pokazuje da su opažaji sirovi podaci koji ne mogu biti lažni, budući da su samo puke reakcije osjetilnog organa na vanjske podražaje, te kao takvi ne mogu biti neistiniti.According to Epicurean epistemology all perceptions are true. The thesis implies that our senses do not ever err and that perceptions give us always correct report of the external world. Although it seems very problematic and counterintuitive, careful investigation of the main sources shows us that Epicurus ’ claim for the truth of perceptions is not so hasty but supported with some serious arguments. Epicurus ’ main concern was to show that we can attain knowledge about the external world. In order to secure the possibility of knowledge Epicurus proposed to rely on perceptions as incorrigible foundation of our knowledge and argue that all perceptions are true. The defense of the thesis and explanation how can it be the case that all perceptions are true is provided by the theory of what happens in the process of perceiving a physical object. In this paper I try to show that his epistemological remarks on infallibility of the senses become more convincing and plausible if properly placed within Epicurus ’ general physical theory. His theory explains perceptions as a raw material which cannot be false since it is a mere response of a sense organ on the impact from the outside, namely from g*T8. Because g*T8 are true and secure reports of external objects, truthfulness of all perceptions is guaranteed. The truth of all perceptions simply follows from the mechanical explanation of the way they are produced, so the truthfulness of perceptions must be accepted on the basis of their origin. (shrink)

Las pretensiones del autor son: (i) Describir la versión modal de la prueba ontológica propuesta por Charles Hartshorne, una versión que enfatiza la anomalía modal del concepto de Dios, que demuestra que las dos únicas alternativas metafísicas coherentes son el positivismo y un teísmo basado en la noción de “necesidad bajo condiciones tautológicas”, y que vindica esta última opción apelando a una filosofía del proceso inspirada en Whitehead y cuya herramienta conceptual básica es la distinción entre existencia y actualidad. Evaluar la propuesta de Hartshorne, defendiéndola frente a equivocaciones frecuentes y desarrollándola en al menos dos aspectos, incluyendo un análisis del proyecto de Russell de reducir las proposiciones modales a enunciados de alcance, y proponiendo una concepción iterativa de la modalidad. Dvesta dvadeset godina nakon Francuske revolucije, problem odredjenja pojma prosvetiteljstva i dalje istrajava. U radu ce se pokazati da odredjenje ovog pojma nikada i nije bilo sasvim jasno. Stoga se predlaze pravljenje distinkcije izmedju prosvecenosti i prosvetiteljstva. Prosvetiteljstvo kao period koji se vezuje za Evropu XVIII veka, moze se tumaciti kao deo sireg procesa prosvecenosti, ili, bolje, prosvecivanja. Videcemo da se prosvetiteljstvo ne moze posmatrati kao homogen, jedinstven proces, vec da bi ga pre trebalo videti kao tkivo, koje i dalje (...) utice na misao i kulturu Zapada. Medjutim, utvrdice se i da optuzbe na racun?naknadnog projektovanja prosvetiteljstva? nisu narocito korisne, buduci da osujecuju mogucnost razumevanja jednog slozenog fenomena i veoma znacajnog pokreta u evropskoj povesti. Polazeci od prve krivulje u izradi koncepta 'postajanja-manjinom' Deleza i Gatarija ispitujemo odnos koji postoji izmedju dva pravca problematizacije tog koncepta: analize istorijskih antagonizama cije su drustvene manjine danas 'nad-odredjeno' mesto; identifikacije jednog tipa pozicije unutar kolektivnih nacina iskaza. Time razmatramo, isto tako, i problem onoga sto bi moglo da znaci politicko zauzimanje manjinske pozicije u diskursu. Upravo na taj nacin suocavamo borbe manjina shemi borbe klasa, ispitujemo odredjene veze izmedju procesa 'proleterizacije' i 'minorizacije' te na toj osnovi zasnivamo pitanje (...) novog internacionalizma. Com base na crítica que Hume faz ao argumento do desígnio, especialmente nas partes 10 e 11 dos Diálogos sobre a Religião Natural, meu objetivo neste artigo é, a partir de uma análise da relação entre a existência do mal no mundo e a suposta existência de uma divindade possuidora dos atributos tradicionais do teísmo, defender a tese segundo a qual o tratamento que Hume dá ao problema do mal corresponde, digamos assim, à cartada final – o último e decisivo (...) recurso que Philo personagem que articula essa crítica) aciona para mostrar que o argumento do desígnio não fornece bases suficientemente sólidas e consistentes para dar suporte à crença na existência de um Deus maximamente poderoso, justo e benevolente; e que, portanto, a existência do mal no mundo tem uma força argumentativa tal que a improbabilidade da existência de Deus é maior do que com base nos argumentos apresentados nas partes 2 a 8 dos Diálogos. Isso significa que eu tomo aqui o problema do mal como o maior problema para o teísta experimental – cuja argumentação pretende provar a existência de Deus a partir da observação dos fenômenos do mundo. Ovaj rad opisuje promene naucne paradigme u demografiji do kojih je doslo u kontekstu drustveno-politickih procesa tokom zadnje dve decenije dvadesetog veka. Promena se posmatra u domenu analize reproduktivnog ponasanja gde je, kako tvrdi autorka, teorija demografske tranzicije ostala dominantan okvir analize ali je prednost dobila njena modifikovana verzija koja primat daje idejnim u odnosu na struktrualne varijable u objasnjavanju reproduktivnog ponasanja; i u domenu socijalne politike, gde je, po recima autorke, napusten koncept planiranja porodice a na njegovo mesto stupio (...) koncept populacione politike. Autorka, medjutim, tvrdi da alarmirajuca upozorenja i ostra retorika o populacionim problemima nisu doveli do formulisanja specificnih mera populacione politike te da su demografski diskursi koji su u to vreme prepravili javni prostor bili mnogo znacajniji za politiku identiteta - nacionalnog i rodnog - nego za socijalnu politiku. El sufrimiento de los animales constituye el mayor escollo para la teodicea. Ni la defensa de los bienes de orden superior ni el recurso a la escatología, justificaciones estándar para el sufrimiento humano, sirven aquí. El teísmo necesita una reforma profunda que explore nuevas vías. Aquí examinamos las hipótesis de un cielo o paraíso para los animales y de la trasmigración de sus almas, junto con la cuestión ligada de la conciencia e ipseidad de los animales superiores. Tras rechazar las (...) ideas de un cielo específico para los animales y de que los animales sean almas humanas transmigradas expiando sus pecados, concluimos que los animales superiores son personas, y conjeturamos que, si poseyeran una esencia espiritual, una haecceitas, podrían madurar intelectual y moralmente a lo largo del proceso evolutivo a través de sucesivos organismos biológicos de complejidad creciente, hasta devenir racionales y dignos de alcanzar un estado celestial.
