Tychastic viability is defined in an uncertain dynamical framework and used for providing a “viability risk eradication measure”, first, by delineating the set of initial conditions from which all evolutions satisfy viability constraints, second, for the other “risky” initial states, by introducing their duration index. This approach provides an alternative to the stochastic representation of chance and these two measures replace the statistical measures (expectation, variance, etc).

In this paper, I explore how viability, meaning the ability of the fetus to survive post-delivery, features in the law regulating abortion provision in England and Wales and the USA. I demonstrate that viability is formalized differently in the criminal law in England and Wales and the USA, such that it is quantified and defined differently. I consider how the law might be applied to the examples of artificial womb technology and anencephalic fetuses. I conclude that there is (...) incoherence in the meaning of viability and argue that it is thus a conceptually illegitimate basis on which to ground abortion regulation. This is both because of the fluidity of the concept and because how it has been thus far understood in the law is unsupported by medical realities. Furthermore, it has the effect of heavily diluting pregnant people’s rights with overly moralistic limitations on access to healthcare. (shrink)

We study the viability domains of bio-economic constraints for fishing model of hermaphrodite population, displaying three stages, juvenile, female and male. The dynamic of this model is subject to two constraints: an ecological constraint ensuring the stock perennity, and an economic constraint ensuring a minimum revenue for fishermen. Using viability kernel, we find out a viability domain which simultaneously guarantees a minimum stock level and a minimum income for fleets.

This article deals with a type of functional explanation, viability explanation, that has been overlooked in recent philosophy of science. Viability explanations relate traits of organisms and their environments in terms of what an individual needs to survive and reproduce. I show that viability explanations are neither causal nor historical and that, therefore, they should be accounted for as a distinct type of explanation.

This article examines the ethical validity of using viability as the cutoff point for abortion in the Netherlands, in view of potential changes to the Dutch perinatal care guideline. According to the Dutch Penal Code, abortion is permitted until viability: the point at which a fetus can survive outside the womb with technological assistance. Since the law was enacted in 1984, viability has been set at 24 weeks gestational age. Currently, in the Netherlands, the treatment limit for (...) extreme prematurity is also set at 24 weeks. The potential revision of the guideline could lower this threshold. Such a change could have implications for abortion in the Netherlands. We critically evaluate the use of viability within the Dutch context and offer recommendations for modifying the legal framework concerning abortion. We conclude that relying on any interpretation of viability is morally problematic for abortion regulation, as it is too indeterminate a concept to establish a threshold in a morally relevant way. The emergence of new obstetrical and neonatal technologies, as well as more aggressive clinical management, has significantly improved the survival of extremely low birth weight infants. This development has heightened concerns about the limits of viability. ELBW infants, weighing less than 1,000 grams and no larger than the palm of one's hand, are often described as of late twentieth century technology. Improved survivability of ELBW infants has provided opportunities for long-term follow-up. This work presents a stock/effort model describing both harvested fish population and fishing effort dynamics. The fishing effort dynamic is controlled by investment which corresponds to the revenue proportion generated by the activity. The dynamics are subject to a set of economic and biological state constraints. The analytical study focuses on the compatibility between state constraints and controlled dynamics. By using the mathematical concept of viability kernel, we reveal situations and management options that guarantee a sustainable system.

On the basis of three empirical assumptions about the rhythm method and the viability of embryos, Bovens concludes that the pro-life position regarding empbryos implies that it is prima facie wrong to use the rhythm method. Pruss objects to Bovens's philosophical presuppositions and Kennedy to his empirical premises. This essay defends two revised versions of Bovens's argument. These arguments revise Bovens's empirical assumptions in response to Kennedy and, in response to Pruss, supplement Bovens's argument with what I call ‘the (...) principle of parental care’. (shrink)

This essay deals critically with Nietzsche’s anthropological typology of the “free spirit par excellence”, “we spirits”, persons endowed with positive as against negative power patterns, and the ideal of the Übermensch. The conclusions are twofold. The first is that actually it was not Nietzsche’s ideal of the Overman that was the pinnacle of his anthropological philosophy, but the even more ideal type of the “free spirit par excellence”. The second conclusion is that it is impossible to envisage a society consisting (...) of such “free spirits”. This thesis is highlighted by contrasting the society of Übermenchen, who, according to Nietzsche, might live in society and even need it as a sine qua non for their cultivation, with free spirits par excellence, who are by definition free from any social ethos, and hence impossible within its framework. However, I argue that, on Nietzsche’s terms, the ideal of the Übermench is also not viable in society. Hence this essay points to an inherent flaw ofNietzsche’s existential philosophy -- thenon-viability of its most sublime ideals. (shrink)

If we cannot directly empirically test the claims of particular scientific theory, then it would be nice to have some other criteria with which to assess its viability. In his 2013 book, String Theory and the Scientific Method, Richard Dawid aims to develop such criteria, with an eye to vindicating research programs in disciplines where direct empirical data is scant or non-existent. In an accompanying paper, Dawid, Hartmann and Sprenger formalise Dawid’s so-called ‘No Alternatives Argument’ using a generalised Bayesian (...) framework, as a first step towards formalising Dawid’s entire re- search programme. In this paper, I argue that the formalisation of the NAA cannot play the central role in Dawid’s programme as intended. This is based on the observation that not all confirmation is non-negligible confirmation. For Dawid’s programme to be useful, it must demonstrate the viability not just of non-empirical theory confirmation, but of non-negligible non-empirical theory confirmation. I argue that Dawid et al.’s appeal to Bayesian confirmation theory to formalise his NAA cannot guarantee non-negligible confirmation. As a result, I conclude that if Dawid’s overall project is to succeed, it must do so without the NAA formalised in this way. (shrink)

Weiming’s notion of transcendence in terms both of its legitimacy as an interpretation of Confucianism and of its viability as an answer to modern challenges. An examination of Tu’s hermeneutical assumptions in his Zhongyong commentary leads to a discussion of his locating transcendence in the subjectivity of the junzi, the profound person. Calling the self-cultivation self-knowledge, Tu makes explicit the religious character of the xin, the basis of self-cultivation, and its transcendent character, because it is endowed from heaven. However, (...) because the xin is irreducibly human, this transcendence is also immanentized. From the xin a fiduciary community is formed, hence the covenantal nature of Confucian religiousness. The essay ends with the question: Because Tu does not elaborate on cultivating a community’s intersubjectivity, does it make the realization of the transcendent xin a deferred potentiality, without mooring in the actual formation of human community? The aim of this study is to provide a feedback control, called the Chemotherapy Protocol Law, with the purpose to keep the density of tumor cells that are treated by chemotherapy below a “tolerance level” L_c, while retaining the density of normal cells above a “healthy level” N_c. The mathematical model is a controlled dynamical system involving three nonlinear differential equations, based on a Gompertzian law of cell growth. By evoking viability and set-valued theories, we derive sufficient conditions for (...) the existence of a Chemotherapy Protocol Law. Thereafter, on a suitable viability domain, we build a multifunction whose selections are the required Chemotherapy Protocol Laws. Motivation: There is an ongoing search for definitive and reliable biomarkers to forecast or predict imminent seizure onset, but to date most research has been limited to EEG with sampling rates <1,000 Hz. High-frequency oscillations have gained acceptance as an indicator of epileptic tissue, but few have investigated the temporal properties of HFOs or their potential role as a predictor in seizure prediction. Here we evaluate time-varying trends in preictal HFO rates as a potential biomarker of seizure prediction.Methods: HFOs were (...) identified for all interictal and preictal periods with a validated automated detector in 27 patients who underwent intracranial EEG monitoring. We used LASSO logistic regression with several features of the HFO rate to distinguish preictal from interictal periods in each individual. We then tested these models with held-out data and evaluated their performance with the area-under-the-curve of their receiver-operating curve. Finally, we assessed the significance of these results using non-parametric statistical tests.Results: There was variability in the ability of HFOs to discern preictal from interictal states across our cohort. We identified a subset of 10 patients in whom the presence of the preictal state could be successfully predicted better than chance. For some of these individuals, average AUC in the held-out data reached higher than 0.80, which suggests that HFO rates can significantly differentiate preictal and interictal periods for certain patients.Significance: These findings show that temporal trends in HFO rate can predict the preictal state better than random chance in some individuals. Such promising results indicate that future prediction efforts would benefit from the inclusion of high-frequency information in their predictive models and technological architecture. (shrink)

It has been argued that Thomson's defense of abortion, if successful, implies that abortion is permissible only until the point of viability. After that point, if one wanted to end a pregnancy, one must do so by birthing the fetus through induction or cesarean. In this paper, I argue that Thomson's defense of abortion does, in fact, imply that abortion after the point of viability is sometimes permissible. To show this, I point out that the process of birthing (...) a fetus makes use of the body of the pregnant person in significant ways. Indeed, the body of the pregnant person is as much a part of this process as it is a part of the process of carrying a fetus during pregnancy. Thus, just as it is sometimes morally permissible to choose to have an abortion rather than continue a pregnancy, it is sometimes morally permissible to choose to have an abortion rather than undergo an induction or cesarean. Those who support Thomson's defense of abortion, then, have reason not to support the view that induction or cesarean are the only permissible procedures for ending an unwanted pregnancy with a viable fetus. I then use this discussion to suggest that autonomy rights are more complicated than initially thought. Given the extent to which the body is involved in detaching the fetus, it is not merely that one has a right to detach a fetus, but also a right to actualize one's reasonable preferences over the method of detachment. Open peer commentary on the article “Homeostats for the 21st Century? Simulating Ashby Simulating the Brain” by Stefano Franchi. Upshot: The target article proposes that Ashby’s investigations of the homeostat and ultrastability lead to a view of living systems as heteronomous, passive “sleeping” machines and thus are in fundamental conflict with concepts of autonomy developed by Jonas, Varela and others. I disagree, arguing that (1) the maintenance of essential variables within viability limits is not a passive process for living (...) systems and (2) the purpose of Ashby’s investigations of the homeostat was to investigate adaptivity, a subject that is related to, but clearly distinct from, autonomy. As such, I find Ashby’s work on adaptivity to be neither in opposition to nor in direct support of modern concepts of biological autonomy and suggest that a productive way forward involves the investigation of the intersection between these two fundamental properties of living systems. Attempts have been made to analyse features in mathematics within a social constructivist context. In this paper we critically examine some of those attempts recently made with focus on problems of the objectivity, ontology, necessity, and atemporality of mathematics. Our conclusion is that these attempts fare no better than traditional alternatives, and that they, furthermore, create new problems of their own.

This article begins by asking if the project to write a philosophical novel is not inherently flawed; it would seem that the novelist must either write an ambiguous text, which would not create a strong enough argument to count as philosophy, or she must write a text with a clear argument, which would not be ambiguous enough to count as good fiction. The only other option available would be to exemplify a preexisting abstract philosophical system in the concrete literary world. (...) To move beyond such an impasse, this article turns to the work of Simone de Beauvoir. Beauvoir's unique aesthetic theory in “Literature and Metaphysics” envisions philosophy as an integral part of the literary text and sees the novel not as an argument but as something called a “philosophical appeal”. In her first novel, She Came to Stay, such a concept of the philosophical novel allows Beauvoir to make an original contribution to the philosophical tradition—one in which Beauvoir rethinks the problem of solipsism—while still creating a stunning literary work. A study of the theory and the novel together thus provides a solid understanding of what philosophers stand to gain from the philosophical novel. (shrink)

I explore the viability of a Galilean relational theory of space-time—a theory that includes a three-place collinearity relation among its stock of basic relations. Two formal results are established. First, I prove the existence of a class of dynamically possible models of Newtonian mechanics in which collinearity is uninstantiated. Second, I prove that the dynamical properties of Newtonian systems fail to supervene on their Galilean relations. On the basis of these two results, I argue that Galilean relational space-time is (...) too weak of a structure to support a relational interpretation of classical mechanics. (shrink)

What role does birth play in the debate about elective abortion? Does the wrongness of infanticide imply the wrongness of late-term abortion? In this paper, I argue that the same or similar factors that make birth morally significant with regard to abortion make meaningful viability morally significant due to the relatively arbitrary time of birth. I do this by considering the positions of Mary Anne Warren and José Luis Bermúdez who argue that birth is significant enough that the wrongness (...) of infanticide does not imply the wrongness of late-term abortion. On the basis of the relatively arbitrary timing of birth, I argue that meaningful viability is the point at which elective abortion is prima facie morally wrong. (shrink)

The subjective Everettian approach to quantum mechanics presented by Deutsch and Wallace fails to constitute an empirically viable theory of quantum phenomena. The decision theoretic implementation of the Born rule realized in this approach provides no basis for rejecting Everettian quantum mechanics in the face of empirical data that contradicts the Born rule. The approach of Greaves and Myrvold, which provides a subjective implementation of the Born rule as well but derives it from empirical data rather than decision theoretic arguments, (...) avoids the problem faced by Deutsch and Wallace and is empirically viable. The analysis of different theoretical approaches to the structure of the notion "viability" is presented in the article. Basing on the analysis the author attempted to reveal the interrelation of viability and hardiness, adaption, social competence and coping strategies. It is shown that viability is an integrated property system including the abovementioned personality resources. It is concluded that viability is a model of the adaptive personality behavior. Viability forms the basis for coping the dependent personality (...) behavior and obtains the status of the basic category of preventive pedagogic. (shrink)

Food Sovereignty is a vibrant discourse in academic and activist circles, yet despite the many shared characteristics between issues surrounding food and public health, the two are often analysed in separate frameworks and the insights from Food Sovereignty are not sufficiently brought to bear on the problems in the public health discourse. In this paper, I will introduce the concept of 'self-organised community viability' as a way to link food and health, and to argue that what I call the (...) In the last few years there has been intense debate in Italy on administration of life-prolonging treatment to premature babies at the edge of viability. In 2006, a group of experts based in Florence drafted recommendations known as Carta di Firenze (CdF) for responsible use of intensive care for premature infants between 22 and 25 weeks of gestational age (GA). The CdF was later endorsed by several medicoprofessional associations, but was followed by recommendations by the Ministry of Health mandating (...) resuscitation for all premature babies regardless of GA and parental consent. Recent statements from medicoprofessional bodies seem to show that the ‘always resuscitate rule’ is not supported by many Italian doctors. We argue that ethically sensitive issues in medicine should be regulated with, and not against, the medical profession and its representative bodies. (shrink)

This article is a thoughtful and well written examination of some of the complex issues that have emerged as a result of recent improvements in the treatment of extremely low birth weight (ELBW) infants, including those who weigh 500 to 600 grams or who are believed to be 23 to 24 weeks gestation. The authors argue that the 23 to 24 week gestation period is filled with ambiguity and flexibility in practice relative to active resuscitation. However, such ambiguity and flexibility (...) is likely to prevail whatever the boundary conditions of viability happen to be. Thus moral guidelines that inform the rescue of an infant believed to be 500 to 600 grams or 23 or 24 weeks gestation are likely to be relevant whatever the boundary conditions are. (shrink)

Team reasoning gives a simple, coherent, and rational explanation for human cooperative behavior. This paper investigates the robustness of team reasoning as an explanation for cooperative behavior, by assessing its long-run viability. We consider an evolutionary game theoretic model in which the population consists of team reasoners and ‘conventional’ individual reasoners. We find that changes in the ludic environment can affect evolutionary outcomes, and that in many circumstances, team reasoning may thrive, even under conditions that, at first glance, may (...) seem unfavorable. We also pursue several extensions that augment the basic account, and conclude that team reasoning is an evolutionarily viable mechanism with the potential to explain behavior in a range of human interactions. The present paper argues that there is ample corpus evidence of statistical preemption for learners to make use of. In the case of argument structure constructions, a verbi is preempted from appearing in a construction A, CxA, if and only if the following probability is high: P(CxB|context that would be suitable for CxA and verbi). For example, the probability of hearing a preemptive construction, given a context that would otherwise be well-suited for the ditransitive is high for verbs like explain (...) that overwhelmingly appear in the dative, and low for verbs like tell that readily appear in the ditransitive. Strength of statistical preemption is determined both by this probability, and by the frequency (ln (F)) of a verb in a preemptive construction when the context is at least as well suited to the preempted construction. The critiques of preemption by Stefanowitsch (Cognitive Linguistics 19: 513–531, 2008, this volume) are countered by arguing that the relevant probabilities were not considered. Moreover, we find evidence that constructions are somewhat less constrained when yoked to non-alternating verbs, as Stefanowitsch (cf. this volume) suggests should be the case. (shrink)

On December 7,1999, a divided Oklahoma Supreme Court held in Nealis v. Baird that a claim may be brought under Oklahoma's wrongful death statute on behalf of a nonviable fetus born alive. The decision represents a departure from the traditional notion that “viability”—the ability of a fetus to sustain life outside the womb with or without medical assistance—is the standard for wrongful death recovery. In replacing the “viability” standard with a “live birth” standard, the majority maintained that live (...) birth is the “unassailable point at which legal rights must be said to attach to the human person. “ By holding a nonviable fetus a legal “person” for the purpose of a wrongful death claim, the court's decision emphasizes the limited application of the United States Supreme Court's holding in Roe v. We provide a philosophical reconstruction and analysis of the debate on the scientific status of cosmic inflation that has played out in recent years. In a series of critical papers, Ijjas et al. have questioned the scientificality of the current views on cosmic inflation. Proponents of cosmic inflation have in turn defended the scientific credentials of their approach. We argue that, while this defense, narrowly construed, is successful against Ijjas et al., the latter's reasoning does point to a significant epistemic (...) issue that arises with respect to inflation. A broadening of the concept of theory assessment is needed to address that issue in an adequate way. (shrink)

This paper examines the resilience of farmers markets in Michigan to the system shock of the global COVID-19 pandemic, questioning how the response fits into market goals of food sovereignty. Adapting to shifting public health recommendations and uncertainty, managers implemented new policies to create a safe shopping experience and expand food access. As consumers directed their shopping to farmers markets looking for safer outdoor shopping, local products, and foods in short supply at grocery stores, market sales skyrocketed with vendors reporting (...) selling more than ever before, but the longevity of this change remains unclear. Our data collected via semi-structured interviews with market managers and vendors, and survey data from customers from 2020 to 21, suggest that despite the widespread impact of COVID-19, there is not sufficient evidence consumers will continue to shop at farmers markets at the rates they did in 2020-21. Furthermore, reasons consumers flocked to farmers markets do not align with market priorities for increased food sovereignty, as increased sales alone are not a sufficient driver for this goal. We question how markets can contribute to broader sustainability goals or serve as alternatives to capitalist and industrial modes of agricultural production, problematizing the role of markets in the food sovereignty movement.
