In three studies, factors influencing the incidence of fraudulent financial reporting were assessed. We examined (1) the effects of personal values and (2) codes of corporate conduct, on whether managers misrepresented financial reports. In these studies, executives and controllers were asked to respond to hypothetical situations involving fraudulent financial reporting procedures. The occurrence of fraudulent reporting was found to be high; however, neither personal values, codes of conduct, nor the interaction of the two factors played a significant role in fraudulent (...) financial reporting. In this discussion I shall argue that some fairly widely held views about human habits are mistaken. These misconceptions are important because of the pervasiveness of the habitual in human behavior and because it is the concept of habit that has served as the prototype of various conceptions of conditioned response which are used in psychological explanation. One major task of this analysis is to show that accounts in which actions are explained by reference to rules are not incompatible with (...) accounts in which the same behavior is seen as the product of habit. Sociologists increasingly draw on dual-process models of cognition to account for the ways context, cognition, and action interrelate. Drawing from 40 interviews with improvisers and observations from improvisational theater, I find that dual-process model scholarship is limited in three respects: It does not consider how cognition operates in situations where order and disruption are concurrent, it fails to realize there is interindividual variation in cognitive processing, and it underestimates the creativity emerging through automatic processes. Interactions in improv contain elements of (...) both order and disruption, and they place demands on automatic and deliberate cognition simultaneously. Improvisers respond to these competing demands through either automatic or deliberate thinking dispositions, which are engendered through explicit instruction, practical experience, and artistic commitments. These dispositions, in turn, shape creative decision-making, predicting interindividual differences in how improvisers respond to contingencies on stage. I conclude by discussing the implications for culture, cognition, and action. (shrink)

The thinkers he discusses range from Aristotle, Democritus, Socrates, Plato, and Xenocrates to Proclus, the Arabian teachers, Magnus, Duns Scotus, and Ockham from Galileo, Descartes, Gassendi, and Cudworth to Locke, Berkeley, Condillac, and Kant from Reid, Stewart, Herbart, and Schopenhauer to Bain, Spencer, Mill and Darwin. Surprisingly clear and easy to read, Brett's account succeeds in illuminating the nature of psychology as well as its history. Previous analyses of descriptively defined psychotic phenomena have concluded that they can occur in benign spiritual experiences as well as pathological states. Attempts to forge a distinction between psychotic experiences in spiritual and pathological contexts on the basis of the form or content of the experience (broadly described) can be disproved by counterexample; distinguishing on the basis of negative or positive consequences of the phenomena for the individual can be seen to beg the question. In the present paper, it is (...) argued that examining the fundamental conceptual organization of psychotic and mystical mental states not only elucidates the observed similarities between them, but can highlight the differences, and the processes by which negatively evaluated pathological features can be seen to emerge. Oriental philosophical systems such as Tibetan and Zen Buddhism, and Tantric Hinduism, provide conceptualizations of mystical states of mind, from which a model can be drawn, while the epistemologies of these systems provide an illuminating metaphysical perspective on both psychotic and mystical experiences. It is concluded that mystical and psychotic experiences can be distinguished not only by emotional and behavioral consequences, but by real differences in the states themselves; certain features, such as loss of subject/object boundaries and loss of the relative dimensional structure of perception, are common to both processes. This is a book about the theory of the city or commonwealth, what would come to be called the state, in early modern natural law discourse. Annabel Brett takes a fresh approach by looking at this political entity from the perspective of its boundaries and those who crossed them. She begins with a classic debate from the Spanish sixteenth century over the political treatment of mendicants, showing how cosmopolitan ideals of porous boundaries could simultaneously justify the freedoms of itinerant beggars (...) and the activities of European colonists in the Indies. She goes on to examine the boundaries of the state in multiple senses, including the fundamental barrier between human beings and animals and the limits of the state in the face of the natural lives of its subjects, as well as territorial frontiers. Drawing on a wide range of authors, Brett reveals how early modern political space was constructed from a complex dynamic of inclusion and exclusion. Throughout, she shows that early modern debates about political boundaries displayed unheralded creativity and virtuosity but were nevertheless vulnerable to innumerable paradoxes, contradictions, and loose ends.Changes of State is a major work of intellectual history that resonates with modern debates about globalization and the transformation of the nation-state. Hobbes's relation to the later Aristotelian tradition, in both its scholastic and its humanists variants, has been increasingly explored by scholars. However, on two fundamental points (the naturalness of the city and the use of the matter/form distinction in the political works), there is more to be said in this connection. A close examination of a range of late Renaissance commentaries on Aristotle's Politics shows that they elucidate a picture of pre-civic human nature that had (contrary to Hobbes's implication) much (...) in common with that of Hobbes. Moreover, they deployed the matter-form distinction in their analysis of the city or civitas in ways that are in important respects similar to Hobbes's procedure in De cive and Leviathan . The paper concludes that Hobbes drew on this tradition in multiple ways while at the same time undermining some of its principal conclusions; Hobbes was in no sense an 'Aristotelian' even if his philosophy has substantial debts to Aristotelianism. In an examination of Ryle's distinction between knowing how and knowing that D. G. Brown is led to the conclusion that “All knowing how is knowing that.” The distinction is improper, and these tags should be dropped. All knowledge is propositional, after all, though there is a legitimate way of retaining the essentials of Ryle's account. Knowledge for which the primary evidence is a person's performance replaces the category of knowing how in this reformulated version of the distinction. The proportion of the world’s population living in urban areas is increasing rapidly, with the vast majority of this growth in developing countries. As growing populations in urban areas demand greater food supplies, coupled with a rise in rural to urban migration and the need to create livelihood options, there has been an increase in urban agriculture worldwide. Urban agriculture is commonly discussed as a sustainable solution for dealing with gaps in the local food system, and proponents often highlight the (...) many social, environmental, and economic benefits. We argue that the sustainability of urban agriculture should not be assumed. There is a need for research to take a bottom-up approach, exploring the influence that city-level conditions have on livelihood decisions by farmers and how this shapes the practice of urban agriculture. This paper uses a case study for an in-depth look at urban agriculture in Delhi, India to understand from the farmers’ perspective how urban agriculture is practiced and what factors influence farmers’ livelihood decisions. Using a team-based, multi-method Rapid Assessment Process, data were collected through preliminary key informant interviews, field observations, semi-structured interviews with urban farmers, and geographic information systems mapping. This research provides an in-depth description of market-oriented urban agriculture in a developing country, explores how farmers’ livelihood decisions are embedded in the urban context, and discusses the potential of urban agriculture as a sustainable city-system. Caroline Brett Keywords: mysticism, psychosis, values, phenomenology, spiritual emergence. THE PURPOSE OF Marzanski and Bratton's paper is to challenge Jackson and Fulford's (1997) treatment of the area of spiritual experience and psychosis, specifically the perspective of discriminating pathological from spiritual experiences on the basis of action enhancement in contrast to action failure. (...) In my opinion, they are partially successful in this aim, and in their analysis they further the discussion of this complex and controversial area in an interesting and potentially fruitful way. What the paper does not offer, or attempt to suggest, is an alternative way of making a distinction, and in the following discussion I intend to explain why I think that, on the one hand, the status of specific experiences is of practical importance, and on the other hand any distinction should not be conceptualized as mutually exclusive. I also hope to clarify those issues which I perceive as being raised by both Jackson and Fulford's and Marzanski and Bratton's papers. The Critique Marzanski and Bratton's first, and in my opinion strongest, point is to argue that "values and actions alone cannot always discriminate between religious experience and psychopathology." They demonstrate convincingly that the fact that an individual positively evaluates a certain anomalous experience and shows enhanced function as a result of it, does not in itself mean that the experience should be viewed as "spiritual." Their second and third points relate to the way spirituality ought to be regarded, suggesting that Jackson and Fulford are in error to identify spirituality with experience, and moreover that any judgment of genuine spiritual content or value requires reference to an individual's personal history, and also some spiritual tradition or authority. I believe that the former point, although certainly relevant to the issue, is in danger of broadening the debate too far from the consideration of particular anomalous experiences: namely, those that are phemenologically similar or identical to psychotic symptomatology. Marzanski and Bratton also mount an objection to the psychologization of spiritual experience by Jackson and Fulford, although I am not convinced that they represent these authors' opinions fairly. Whose Values? Action or Ethics? The first point, the refutation of the thesis that a spiritual experience can be distinguished from [End Page 373] psychopathology on the basis of a positive evaluation and preservation of functionality, succeeds in that it is shown both that (1) experiences accepted as spiritual within major religious traditions may actually be distressing and/or disabling; and (2) anomalous experiences that are both positively evaluated by the experient and action enhancing nevertheless may not have genuine spiritual characteristics. The argument proceeds through the use of counterexamples, and it is indeed a problem for the Jackson and Fulford account that suffering and periods of social withdrawal or distress do appear to be historically, anthropologically, and theologically associated with the spiritual journey. Bratton and Marzanski use, among other examples, the "dark night of the soul" of mystics, raising the very interesting point that a person may have experiences that, at least at the time of experiencing, are profoundly disturbing or even disabling, socially or functionally, and yet those same experiences may in some way set the scene for a profound transformation or spiritual renewal. To my mind this concept can be seen reflected in the "terrible" forms of the Wisdom Goddess in Advaita Vedanta (as expressed in my own paper), and can be related to the concept of "breaking down to break through" espoused by transpersonal psychologists such as Grof and Grof (1992).Therefore, on closer examination, it appears that Jackson and Fulford's notion of preserved functionality may play some role after all, even if it does require supplementation: if the breaking through aspect of the process is necessary to distinguish from simply breaking down, then action enhancement may remain a criterion determining the spiritual value of an experience. HUME'S DEBT TO KANT Various commentators on Hume's work have argued that his examination of our causal reasoning is not fundamentally at odds with the claims made by Kant in his supposed "answer to Hume". One way of making the connection, suggested by Wolff for example, is to emphasize the ways in which Humean epistemology depends upon a theory of mental activity. If this activity itself can only (...) be understood in terms of built-in "propensities" of the mind, these dispositions can be interpreted as psychological descriptions of a mind operating in accordance with something quite like Kantian categories. Another way of arguing for this compatibility between Hume and Kant is to bring out central principles (e.g., relating to causation ) which Hume's account depends upon, but which are such that they cannot be given an experiential foundation. Lewis White Beck has offered such a Kantianization of Hume, arguing that beneath the surface of the official Empiricist Hume (and just outside Hume's view of what he was doing) there is a commitment to principles that have 2 an a priori status in his theory. If Beck is right about this, we might speak with tongue only partially in cheek, of Hume's debt to Kant, for the Kantian categories could be taken as the systematic working out of the underpinnings of Hume's theory. In this paper I shall consider this problem only insofar as it relates to causal reasoning. I focus on Professor Wilson's defense of the Empiricist Hume, in which it is denied that our causal reasoning rests upon a priori principles. The principles in question are that (1) Every event has some cause, and (2) That like causes have like effects, and like effects like causes. Wilson argues that these are both empirical generalizations within an account that is both plausible and Humean. I shall 60. argue briefly that, contrary to Wilson's claim, the Humean account of causation makes the second of these an a priori truth because it is analytic. The first is certainly not an analytic truth, but it could not have been derived from experience, at least as Hume depicts our experience. It thus seems to be a claim that is functioning as synthetic and a priori in Hume's account of our beliefs. Except in the general way that this phrase implies, this paper is not really about Kant, who will barely be mentioned again. In my discussion of Wilson's argument I will not deal with the formalizations which he has introduced, but will attempt to capture the main lines of argument in more or less ordinary language. In proceeding thus, I am siding with Hume in siding with the vulgar. Having listed the eight rules of causal judgment which are under discussion here, Hume says Here is all the LOGIC I think proper to employ in my reasoning; and perhaps even this was not very necessary, but might have been supply 'd by the natural principles of our understanding. Our scholastic headpieces and logicians shew no such superiority above the mere vulgar in their reason and ability, as to give us an inclination to imitate them in delivering a long system of rules and precepts to direct our judgment, in philosophy. The basic problem is whether or not Hume's explanation of our causal reasoning depends upon the assumption that all events have causes, and depends upon it in a way that makes this assumption a priori. Beck (and Wolff) have argued that this is the case, and hence that Hume is much closer to Kant than is commonly supposed. This Wilson denies. The argument revolves around the cases in which we fail to observe the causes we have come to associate with certain effects (or, in principle, vice versa) so that the conjunction of events is not "constant". The Humean account of what happens in such circumstances is that the imagination supplies the deficiency; we feign unobserved events to 4 fill the gap. This paper focuses on Quebec language legislation which has the effect of prohibiting the use of the use of English on signs. The controversial “Frenchonly” sign law is considered in spelling out an argument for collective rights and assessing some of the obstacles which a collective rights thesis must overcome. No attempt is made in this discussion to resolve the question of the relative weight of the collective and individual rights which come into conflict in this situation. No doubt this (...) latter is itself a difficult task. If the argument of this paper is sound, however, a solution phrased wholly in terms of individual rights and the public good is simpler only because it omits important dimensions of the problem. Recent findings regarding the cellular biology and immunology of BST‐2 (also known as tetherin) indicate that its function could be exploited as a universal replication inhibitor of enveloped respiratory viruses (e.g., influenza, respiratory syncytial virus, etc.). BST‐2 inhibits viral replication by preventing virus budding from the plasma membrane and by inducing an antiviral state in cells adjacent to infection via unique inflammatory signaling mechanisms. This review presents the first comprehensive summary of what is currently known about BST‐2 anti‐viral function against (...) respiratory viruses, how these viruses construct countermeasures to antagonize BST‐2, and how BST‐2 function might be targeted to develop therapies to treat respiratory virus infections. The authors address the current gaps in knowledge, including the need for mechanistic understanding of BST‐2 antagonism by respiratory viruses, that should be bridged to achieve that goal. (shrink)

Ben Rich, J.D., Ph.D., presents a scholarly, passionate view of the ethics of the “barriers to effective pain management.” His manuscript is detailed, analytical, and compassionate. No reasonable sensitive person, especially a physician committed to caring for patients, can disagree with the proposal that human beings should have their physical, emotional, and spiritual pain tended to aggressively, meticulously, and compassionately. Similarly, the same individuals advocating for such pain management would agree that no one should go to jail unless he or (...) she is guilty of a serious crime, that decent people should not be robbed or murdered, that children should not be hungry or homeless, and that all citizens of the United States deserve healthcare. Our society attempts to achieve these goals. Laws are written, discussed, and approved by state and federal congresses, voted on by citizens, and theoretically upheld by the courts, churches, and decent individuals. But, unless the world suddenly becomes inhabited by virtuous, ethical humans who can unfailingly differentiate “good” from “bad,” then, in spite of an abundance of laws and lawyers, doctors, and nurses, this world will continue to have pain and suffering. And, although we want to hold our doctors, politicians, educators, champion athletes, and others to “higher standards” than the average citizen, it is best to remind ourselves frequently that all humans can be weak and are bound to make imprecise judgments, that there is not a homogenous definition of “good,” that values and religious beliefs are variable. In the Principles of Philosophy the first positive claim that Descartes makes after he has established his skeptical starting point is not the claim of the cogito. It is, rather, the claim that “we possess a free will.”.

It would be difficult to find a major figure in the history of European political thought who would not have attempted to say something about how authority emerges, or is justified and critiqued, in the world beyond the single polity. Quite frequently, that effort would have involved some idea about a legal order, or at least a set of rules or regularities applicable in that world. Thomas Hobbes was neither the first nor the last major thinker who believed that the (...) 'international' realm was characterised by the independence of states existing 'in the state and posture of gladiators', thus apparently denying that legal rules or practices or legal thinking could have much relevance therein. Yet others believed, as Immanuel Kant did, that without a constitutional vocabulary not much that was meaningful could be said about the human pursuit of freedom, and that silence about the latter would not only constitute a moral failure but an intellectual and perhaps political mistake. For a long time, the idiom of natural law claimed to offer a universally valid frame for thinking about the nature of the political, as well as providing authority for lawyers' speculations about the rules and principles governing the conduct of individuals and corporate bodies wherever they might move. The name of the relevant discipline at German universities from the late seventeenth century onwards-ius naturae et gentium, the law of nature and of nations-revealed the full scope of its ambition. That discipline may have died away (although that is a debatable proposition) but any political thinking worth its salt will today (perhaps especially in the twenty-first century) aim to say something about how authority emerges, is maintained or critiqued not only within but also outside the single state. The world of 'nations' or even 'humanity' is established as an important theme of political and legal speculation. (shrink)
