The paper discusses the Anglo-American philosophy of law of the 20th century, more specifically the philosophy of law of Ronald Myles Dworkin and his criticism of the legal positivism of Herbert Lionel Adolphus Hart. The author presents the history of the criticism of legal positivism in Ronald Dworkin’s philosophy of law and distinguishes historical stages. The subject of the study is the critique of legal positivism but not the Hart-Dworkin debate itself, well known in Western philosophy of (...) law. The reason is that the discussion was conducted between Dworkin and Hart’s supporters but not between Dworkin and Hart by himself. The latter responded to the criticism only after twenty seven years. The article explains why Dworkin chose for his criticism Herbert Hart’s version of legal positivism. This is due to the fact that Dworkin highly appreciated Hart’s positivist theory of law and characterized it as the “most clear.” The article presents the methodological foundations of criticism of Hart’s legal positivism in Dworkin’s philosophy of law. It reveals a methodological divergence between the two legal theories, which directly affects the understanding of the concept of law and its content. Therefore, we can assume that the legal theories of Hart and Dworkin are two competing models of law: Dworkin’s model considers law as a set of rules and principles and Hart’s model acknowledges only rules and court decisions as a source of law. The article also presents the key principles of positivism criticized by Dworkin. These principles, firstly, interpret law as a set of legal rules determined through a special legal criterion, secondly, provide the judge with an opportunity to make a decision “at his own discretion” in a situation not regulated by law, and, thirdly, recognize only legal rights and obligations enshrined in legal regulations. It is important to note that in this article the author describes criticism as an independent phenomenon of legal philosophy with a particular focus on the history and foundations of this phenomenon. This article shows how sixteenth- and seventeenth-century arguments about historical evidence and elite humanist traditions of textual criticism and historical method evolved into the secular political theory of the eighteenth century. It shows how the French crown sponsored scholars who worked on empirical, source-based history as a tool for political prudence, but as this critical historical methodology became public, the crown realized it could be used against its interests, as in the case of the Affaire de Thou. In (...) the mid-seventeenth century, Colbert sought to suppress the old royal humanist historical tradition; however a number of political critics such as Amelot de La Houssaye and Pierre Bayle worked to publicize the tools of historical, political criticism, setting the stage for Enlightenment critics of absolutism such as Durey de Meinières and ultimately Montesquieu and Gibbon. Indagamos de qué forma estas categorías involucran la legitimidad del discurso filosófico, decisiones en torno del problema del sujeto y de la verdad y modos de entender la historia. Mostramos cómo Roig opera una ruptura, en el marco de lo que él denomina una ampliación metodológica en el campo del (...) quehacer filosófico, al imbricar conceptualizaciones epistemológicas con ejercicios reflexivos en los que el filosofar explora la experiencia vital, construye sus propias fuentes y se abre a una dimensión axiológica. We evaluate how these categories involve the legitimacy of philosophical discourse, and the decisions taken on the subject´s problem, the truth and the possible ways to understand history. We also show how Roig, in the framework of what he identifies as methodological amplification within the field of philosophy´s task, fixes a rupture when interweaving epistemological concepts with reflective exercises in which the art of philosophy explores the vital experience, builds and rebuilds its own sources and opens up to an axiological dimension. In this framework, Roig revises the "legacy", adds other voices, handles critically the axiological structure of discourses and analyzes its ways of recognition. We aim to present the theoretical and critical tools of this book, especially to discuss the conditions and possibilities of the philosophical knowledge taken as practical, social, established and as liberator; and to discuss the terms of humanisms that the philosophical knowledge presents or interpellates. Many years ago Degas said "Il faut décourager les arts." I am far from agreeing, but I am ready to say that critics of a certain kind are in need of active discouragement. Too much is written about matters that should be taken in by the beholder as he hears or scans the work. It is not desirable that his conscious mind should entertain - or be prepared to entertain - clear statements of what he experiences under the spell of (...) a masterpiece. The very reason why art is finer when it shows rather than tells is that comprehension is then immediate, not discursive. Ideally, the spectator must absorb - in order to be absorbed; and this means that the critic should shut up until he is wanted. We have no need of a study of "Punctuality in Thomas Hardy." I am making up the subject, but everybody can think of dozens of comparable works of pseudo-scholarship and pseudo-criticism. Their only excuse is that the authors wrote them under Ph.Duress and cannot be blamed for being coerced. Jacques Barzun is University Professor at Columbia University. The debate about secularization in recent decades has challenged long-held assumptions about Western modernity and the purported decline of religion in modern societies. However, the impact of this criticism on the idea of history has so far not received as much attention as it deserves. Jayne Svenungsson’s analysis of the influence of biblical motives on contemporary political theology illustrates one way in which the concept of history might be rethought in the wake of the crisis of the (...) secularization thesis. In dialogue with Karl Löwith’s classical argument that modern philosophy of history and the idea of historical progress are secularized versions of Christian eschatology, she argues that the prophetic vision of history as a struggle for a justice that supersedes every current law or moral system is a viable and promising alternative that ought to be considered in contemporary discussions of politics and history. The article focuses on an analysis of Hart Crane’s essay “Note on the Paintings of David Siqueiros.” One of Crane’s few art-historical texts, the critical piece in question is first of all a tribute to the American poet’s friend, the Mexican painter David Siqueiros. The author of a portrait of Crane, Siqueiros is a major artist, one of the leading figures that marked the history of Mexican painting in the first half of the twentieth century. While it is interesting (...) to delve into the way Crane approaches painting in general and Siqueiros’ œuvre in particular, an analysis of the essay with which the present article is concerned is also worthwhile for another reason. Like many examples of art criticism—and literary criticism, for that matter—”Note on the Paintings of David Siqueiros” reveals a lot not only about the artist it revolves around, but also about its author, an artist in his own right. In a text written in the last year of his life, Hart Crane therefore voices concerns which have preoccupied him as a poet and which, more importantly, are central to modernist art and literature. The focus of this essay will be on Freud, although my approach is informed by certain aspects of “post-Freudian” analysis. In the works of Freud, however, history in the ordinary sense often seems lost in the shuffle between ontogeny and phylogeny. When Freud, in the latter part of his life, turned to cultural history, he was primarily concerned with showing how the evolution of civilization on a macrological level might be understood through—or even seen as an enactment of—psychoanalytic (...) principles and processes. And he openly acknowledged the speculative nature of his inquiry into prehistory, “archaic” society, and their putative relation to the civilizing process.One might nonetheless argue that throughout Freud’s work there are theoretical bases and fruitful leads for a more delimited investigation of specific historical processes for which documentation is, to a greater or lesser extent, available. This kind of investigation is, moreover, required to test the pertinence of Freud’s speculative and at times quasi-mythological initiatives. At present one can perhaps do little more than tentatively suggest how such an investigation might proceed and the sorts of issues it might conceivably illuminate. For its elaboration has been relatively underdeveloped in the research of those who looks to Freud for guidance. While I liked his style, the vocabulary seemed awkward. His finite idealism confused me. I had problems with his ontology, and his tendency towards historicism seemed odd. I even wrote an essay critical of The Midworld (New York: W. W. Norton, 1982), though I never made an aggressive effort to publish it. McGandy's The Active Life: Miller's Metaphysics of Democracy, and the new edited collection of Miller's writings entitled The Task of Criticism, do an excellent job of revealing the contemporary significance of Miller's work. Collectively, they have convinced this skeptic that the midworld and its ontology of functioning objects are an important contribution to contemporary American philosophy.The Task of Criticism faces several challenges. First, George P. Brockway supervised the publication of five volumes of Miller's collected works, and Fell himself edited a 1990 volume on Miller's philosophy (The Philosophy of John William Miller, Lewisburg: Bucknell University Press), followed by Stephen Tyman's Decrying the Ideal (Carbondale: Southern Illinois University Press, 1993). Colapietro published Fateful Shapes of Human Freedom: John William Miller and the Crises of Modernity (Nashville: Vanderbilt University Press) in 2003. Do we really need another volume? Second, Miller's brand of idealism is not very fashionable these days. Is there any hope that pragmatic idealism can inform contemporary social theory, and make a contribution to the very real and concrete problems faced by modern democratic institutions?I believe that the answer to both of these questions is "yes." Recognizing the importance of previous volumes devoted to Miller's philosophy, the editors present The Task of Criticism as the first comprehensive introduction to Miller's philosophy, and it attempts to cut a middle ground between a complete collection of essays and a "best of" anthology. Nikolai Lossky is key to the history of the Husserl-Rezeption in Russia. He was the first to publish a review of the Russian translation of Husserl’s first volume of the Logische Untersuchungen that appeared in 1909. He also published a presentation and criticism of Husserl’s transcendental idealism in 1939. An English translation of both of Lossky’s publications is offered in this volume for the first time. The present paper, which is intended as an introduction to these documents, situates (...) Lossky within the Rezeptionsgeschichte of Husserl in Russia and explains why he is central to it. It also explains what Lossky principally found in Husserl: he saw in the latter’s critique of psychologism support for his own ontology, epistemology, and axiology. Lossky characterizes his ontology as an ideal-realism. According to ideal-realism, both the realm of ideal beings and the realm of real beings are mind-independent. Per his epistemology, which he calls “intuitivism,” real beings are intuited by sensual intuition and ideal beings by intellectual intuition. The realm of ideal beings includes the subrealm of values, which is intuited by axiological intuition. This thoroughly realist conception contrasted sharply with the subjectivist tendencies of the time. So, when Lossky took cognizance of Husserl’s critique of psychologism, he thereupon found an ally in his battle against the various subjectivisms. But, when Husserl took the transcendental idealist turn, Lossky was at the forefront of the backlash against the new direction Husserl wanted to give to phenomenology. (shrink)

This article takes its shape from a recent conference at the School of Visual Arts in NYC on the theme, 'Tradition and the New: Educating the Artist for the Millennium'. Central to the way the conference was advertised and described was an implicit tendency to view tradition as wholly separate from the new. While the conference did not itself make a theoretical argument for the opposition of tradition and the new, Arthur Danto's recent elaboration of a thesis of the 'end (...) of art' does provide such a theoretical underpinning for the opposition that the conference seemed to presuppose. Danto's thesis of the end of art offers a compelling view of 'what' and 'where' art is today, but it also has troubling implications for how our relation to the past is configured and, in Danto's view of art's having come to an end, for what it means that we are now living in 'post-historical' times. That is, as a compelling contemporary reading of the history of art, Danto's thesis seems to be more implicated in the very modernist project that he, in other ways, seeks to move effectively beyond. This article, then, explores the problem of counterposing tradition and the new, specifically, in Danto's thesis, but also more generally. In the first part of the article, I present Danto's end of art thesis. Next, I will offer a counterweight to this tendency to separate tradition and the new by examining the concept of 'effective history', focussing here on the writing of Hans-Georg Gadamer. Gadamer's insights, which I will link to Nietzsche, provide a way of moving beyond some of the problematic implications of Danto's thesis, and also illuminate some of the ethical dimensions at stake. In concluding, I will look at some contemporary examples where the notion of effective history can be productively applied. In this paper I discuss a prehistory of the recent metaphilosophical research and provide an overview of its most important areas. I review the ways of understanding of philosophy by the authors of the Early Modernity and contemporary continental philosophers and outline a trajectory of metaphilosophical discussions in analytic philosophy of 20th century. I try to show that the recent surge of metaphilosophy research in it could be explained by a search for a new identity of analytic philosophy after wide (...) disappointment in the “linguistic turn,” as well as after criticism of Quine and his followers of various aspects of the common method of conceptual analysis, and expansion of the field of inquiry. I argue that contemporary analytic philosophy is much closer to the classical and modern tradition than to the early analytic philosophy. And the most important question for contemporary metaphilosophers seems to be a question about possible substitutes of an old-fashioned conceptual analysis. Some authors propose to get rid of armchair methods at all and follow experimental line of research. This, however, could be destructive to the philosophy as a separate discipline. That’s why it is important to pay utmost attention to those philosophers who try to save armchair philosophy. As Timothy Williamson is one of the most interesting authors working in this vein, I asses his role in the recent metaphilosophical research. I give a brief review of his book “Doing Philosophy” (2018) and draw attention to the fact that its main ideas are briefly expressed in his paper “Armchair Philosophy”, published in this issue of the journal. I claim that the importance of Timothy Williamson’s work is best explained by its role in realizing that philosophers now have to make a hard choice between dissolving philosophical methodology in methods of experimental sciences and trying to find way of justification of armchair philosophy. The category of the meaning of history has long existed in European philosophy as one of its fundamental themes, which has undergone many collisions during its development. The last century has been marked by a radical revision of approaches to this theme both in the philosophy of history and in the tradition of intellectual history. In the twentieth century, Kant’s historical criticism was taken by German thought to its logical conclusion in such a way that the (...) assertion of the meaning of history has actually suffered a fiasco in the field of rationalist philosophy. The purpose of this article is to attempt to show how the Russian philosopher Nikolai Berdyaev, witnessing the spiritual and political crisis of European and Russian culture, seeks a solution to this problem within the philosophy of history, reformulating the problem of the meaning of history in a metaphysical way. To do this, he investigates theologically the foundations on which the historiosophic projects of the New Age are built, and tries to resolve the contradictions in the understanding of Christian revelation that are revealed in them. Returning the question of the meaning of history to its theological source allows Berdyaev to reconcile the contradictory hopes of philosophers of history for the realization of the personal freedom of its subjects with the existence of a universally meaningful sense in it. This thesis sets out to show that a philosophical reflection on history is, in the strongest possible way, an essential feature of Hume's project of a science of human nature: a philosophical investigation of human nature, for Hume, cannot be successful independently of an understanding of the relation of human beings to their history. Hume intended to criticize traditional metaphysics by referring all knowledge to experience. But it is almost always assumed that Hume means by "experience" the result (...) of an individual's past sense perception or personal observation. Accordingly, Hume's criticism of traditional metaphysics is taken to lead to an individualistic conception of knowledge and human nature. In this thesis I claim that this picture of Hume's "empiricism" is simply wrong. He is not a philosopher who reduces "experience" to the merely private happenings within a personal psychology. On the contrary, Hume has a wider notion of experience, one that includes not only personal observation and memory, but, fundamentally, one that includes implicit knowledge of human history. Experience, so understood, brings about what I term a historical point of view, namely, the point of view of someone who seeks to extend his experience as far as it is possible in order to acquire the capacity to produce more nuanced and impartial judgments in any given practice. It is precisely this historical point of view that enables us to depart from the individualistic perspective that we would otherwise be bound to adopt not only in epistemology but, most significantly, in politics, in social life, in religion, etc. ;Chapter 1 presents the historical background against which Hume elaborates his views of history's role in philosophy. Chapter 2 discusses and criticizes the individualist reading of Hume by showing that he had a satisfactory account of beliefs formed via human testimony. Chapter 3 presents a view of Hume on explanation that underscores his interest in practical and informal explanations as those of history. Chapter 4 provides a discussion of Hume's notion of historical experience in relation both to his theory of perception and to his project of a "science of man.". (shrink)

I begin by asking an engagingly naive question that a layman would have every right to put to us - and often has. Why should we interest ourselves seriously in the once-upon-a-time worlds of fiction - these unreal stories about unreal individuals? It has been a persistent question in the history of criticism - ever since Plato called the poet a liar - and it is a question at once obvious and embarrassing. It is obvious because, for the (...) apologist for imaginative literature, it becomes a prolegomenon to all further questions; and it is embarrassing because merely to ask it threatens to put literature out of business and, with it, all those who treat it as a serious and world-affecting art. Why, then, should we interest ourselves seriously in fictions? However elementary, it is a question that is more easily asked than answered. Murray Krieger is the author of The Tragic Vision and The Classic Vision, which have recently been reprinted in the two-volume paperback Visions of Extremity in Modern Literature. The article, taking its inspiration from Enrique Dussel’s ethics of liberation and particular moments of Latin American history, develops the notion of the proximity of history, phenomenologically critiquing Emmanuel Levinas’s own reduction of history to consciousness, his reading of (...) history as a synchronizing betrayal of diachronic events. It thus reads Levinas against his own texts, arguing that historical memory and historical encounters function much as the face does in Levinas’s own ethics, not only giving rise to irrecusable responsibilities, but also demanding the work of a critical, conscious appropriation of that history. Scholars often turn to Livy’s famous digression on Aulus Cossus and the spolia opima (4.17–20) to shed light on his larger political inclinations. These readings generally regard Livy as either an Augustan (or at least a patriotic Roman) or an apolitical skeptic. Yet neither view, I argue, fully explains the Cossus affair. What is needed is an interpretation that recognizes the political nature of the Cossus digression and its skepticism toward Augustus. Attending to Livy’s rhetorical strategy in the digression allows (...) us to see it as an instance of oblique criticism of Augustus and his control over Roman life. The explanatory power of this reading extends to episodes from the life of Romulus as well. I argue Livy uses these stories to make a theoretical argument about the nature of despotism, namely, that it seeks to control narratives of the past just as much as it aims for political domination. Wittgenstein's `language-games' constitute a forceful post-Cartesian, anti-foundationalist account of linguistic activity with meaning sustained across a network of customary practices or forms of life. This is a fertile picture of language but it depends upon a rigid, synchronic notion of linguistic rules and fails to account for the developmental and transformative dimensions to language. I suggest that Wittgenstein is unable to connect past to present language-games. Despite an obvious proximity of Gadamer to Wittgenstein (on the pragmatics of language) I argue (...) that Gadamer's work on tradition, with its hermeneutical understanding of the indeterminacy of linguistic rules, exposes Wittgenstein's apparent blindness to the historical aspect of language. It is important for the materialist historian, in the most rigorous way possible, to differentiate the construction of a historical state of affairs from what one customarily calls its "reconstruction." The "reconstruction" in empathy is one- dimensional. "Construction" presupposes "destruction." Almost fourteen years after the death of Jacques Derrida, the least one can say is that his inheritance is as contested and fraught with rivalries, rejections, and appropriations as at the time of the flowering of Deconstruction in American universities in (...) the seventies and eighties. A halt was observed in 1988-89 after the posthumous revelations about Paul de Man's past in Belgium and Derrida's embattled defense of his friend. Today, in France, one often hears that "Derrida a fait l'Ecole mais n'a pas fait ecole," meaning that Derrida passed the entrance examination of the prestigious Ecole Normale Superieure where he taught for a long time, where he met Paul Celan, Louis Althusser, Michel Foucault and many other luminaries, whereas he never had a real "school" in France-no real institutional backing beyond the various Parisian places at which he taught later, or those that he founded like the College de Philosophie; his following constituted of young philosophers, only a few of whom became university professors in their turn and disseminated his teachings. However, the mechanisms of power within the French university remained closed to Derrida until the end; besides, he wanted to prevent the stereotyped reproduction currently observed from master to disciple.
