본 논문은 가다머의 ‘해석학적 언어론’을 구체적으로 해명해 보는 것을 기본목적으로 삼고 있다. 주지하다시피 가다머는 진리와 방법 제3부에서 ‘해석학적 경험 매체로서의 언어’와 ‘해석학적 존재론의 지평으로서의 언어’에 대해 다루면서 자신의 언어론을 구체적 으로 제시하고 있다. 이러한 그의 해석학적 언어론을 해명하기 위해, 본 논문에서는 다음 과 같은 순서로 논의를 전개하였다. 먼저, 2장에서는 언어와 사유의 관계 문제에 있어서 가장 중요하게 부각된 단일설적 입장의 사상가, 즉 훔볼트, 카시러, 하이데거 등의 입장을 소개하면서 이에 대한 가다머의 비판에 대해 살펴보았다. 이것은 이들 사상가들이 단일설 적 입장을 동일하게 취하면서도 (...) 그 근본 언어사상에서는 다소 차이가 있음을 밝히기 위함 이다. 이어서 3장에서는 가다머의 해석학적 언어론에 대해 구체적으로 해명해 보았다. 여 기서는 크게 세 가지 접근주제, 즉 ‘해석학적 경험 매체로의 언어’와 ‘이해와 언어성의 관 계’ 그리고 ‘언어의 사변성’으로 구분하여 그 본질적 의미를 해명하였다. 끝으로, 4장에서 는 가다머의 해석학적 언어론에서 드러나는 몇 가지 문제점을 비판적으로 검토해 보면서 본 논의를 맺고자 하였다. What should we teach our children about the creation of the world? What should we teach them about religion? The characters Demea, Cleanthes, and Philo passionately present and defend different answers to that question. Demea opens the dialogue with a position derived from René Descartes and Father Malebranche — God's nature is a mystery, but God's (...) existence can be proved logically. Cleanthes attacks that view, both because it leads to mysticsm and because it attempts the impossible task of trying to establish existence on the basis of pure reason, without appeal to sense experience. As an alternative, he offers a proof of both God's existence and God's nature based on the same kind of scientific reasoning established by Copernicus, Galileo, and Newton. Taking a skeptical approach, Philo presents a series of arguments that question any attempt to use reason as a basis for religious faith. He suggests that human beings might be better off without religion. The dialolgue ends without genuine agreement among the characters, justifying Hume's choice of dialogue as the form of presentation. (shrink)

It is commonly assumed, at least by continental philosophers, that epistemological hermeneutics and foundationalism are incompatible. I argue that this assumption is mistaken. If I am correct, the analytic and continental traditions may be closer than is commonly supposed. Hermeneutics, as I will argue, is a descriptive claim about human cognition, and foundationalism is a normative claim about how beliefs ought to be related to one another. Once the positions are stated in this way, their putative incompatibility vanishes. (...) This paper defends a novel view of hermeneutical epistemic injustice. To this effect, it starts by arguing that Miranda Fricker’s account is too restrictive: hermeneutical epistemic injustice is more ubiquitous than her account allows. That is because, contra Fricker, conceptual ignorance is not necessary for HEI: hermeneutical epistemic injustice essentially involves a failure in concept application rather than in concept possession. Further on, I unpack hermeneutical epistemic injustice as unjustly brought about basing failure. Last, I show that, if this view (...) right, HEI is a form of distributive injustice, and affords the corresponding traditional normative theorising. (shrink)

Listening is crucial to reaching multicultural understanding. Borrowing from the work of Hans-Georg Gadamer we develop a hermeneutics of listening. To listen we must risk our prejudices, but these prejudices constitute our very identity. In this paper we attempt to answer the question, “Why Listen?” if listening is such a potentially dangerous activity.

I argue that patients who suffer genital surgery to ‘disambiguate’ their sexual anatomy, a practice labelled ‘intersex genital mutilation’ (IGM) by intersex advocates, can be understood as victims of hermeneutical injustice in the sense elaborated by Miranda Fricker. This claim is clarified and defended from two objections. I further argue that a particular subset of cases of IGM-based hermeneutical injustice instantiate a novel form of hermeneutical injustice, which I call deception-based hermeneutical injustice. According to two critics, Georgia Warnke and John Caputo, Gadamer's hermeneutics is inherently "conservative" insofar as he appeals to tradition as a constituent in understanding. They insist that he simply preserves the ideals, norms and values of the Western metaphysical tradition without critically examining them. I do not agree and will argue that views like this depend upon several false assumptions -- for example, that Gadamer reifies the text as a "thing-in-itself" and remains trapped in subjectivism. Process hermeneutics attempts to solve the philosophical problem of the destructive effect of relativism in order to establish a common ground on which our metaphysical and ethical dialogue can be possible. In the postmodern context, we confront a very different hermeneutic task from that of modern hermeneutics. As Jean-François Lyotard characterizes postmodernity as “a war on totality,” postmodern hermeneutics criticizes the modern triumphalist rationality that claims such absolutisms as scientific objectivism, epistemological foundationalism, and moral universalism. Process (...) class='Hi'>hermeneutics welcomes this postmodern iconoclastic urge against modern absolutism. However, it suspects the postmodern transition from meta-narrative to local-narrative that causes a difficulty for apossible common scholarship. In the postmodern relativization, an astute thinker asks whose interpretation, whose authority, whose criteria counts, and why. This paper proposes that process hermeneutics offer an alternative understanding to our postmodern studies and dialogues. (shrink)

The Statements on Responsibilities in Tax Practice (SRTPs) provide guidance to the CPA when making decisions in tax practice. Many of these decisions are ethical in nature and have implications for tax compliance. In this study, a survey methodology is used to test whether the SRTPs affect decisions that CPAs make. The findings suggest that a clear majority of CPAs follow the SRTPs when making ethical decisions relating to tax return preparation and that CPAs follow the SRTPs more often than (...) unlicensed preparers on half the issues tested. However, a statistically significant number of CPAs do not follow the SRTPs and, CPAs do not follow the SRTPs any more often than unlicensed tax preparers on three issues. (shrink)

This article explores and attempts to resolve some issues that arise when at stake is the incommensurability between the concepts of reality developed by philosophical hermeneutics, on the one hand, and realist branches of analytical philosophy, on the other. The view of hermeneutic realism is suggested not as a remedy against this incommensurability, but as a vehicle for revising those aspects of both hermeneutics and ontological realism which impede the dialogue between them. It is a view that opposes (...) epistemological foundationalism, Cartesian dualism, essentialism about theoretical objects, and cognitive relativism. This book covers new ground in the English scholarship on Gadamer's work. In Gadamer's Hermeneutics, Joel Weinsheimer gives a detailed reading of Gadamer's major text, Truth and Method, and in Gadamer, Georgia Warnke offers a more general interpretation of Gadamer's work, but neither of these works deals specifically with the early Gadamer, with Gadamer the philologist at work trying to understand Plato and Aristotle.

Performance theorists have identified a central problem in live artistic performances— sometimes a performance is transcendently good, but more often it is not. Even the best performers give uneven performances over time, and educators are frequently at a loss as to what teaching methods will counteract this phenomenon. So how can we provide a useful approach for educators to reduce inconsistency, without sacrificing quality, in the performing arts? In this little volume, Anthony Thiselton makes an impassioned appeal for closer attention to the philosophy of hermeneutics. Emilio Betti provocatively observes that hermeneutics ought to constitute an obligatory course for most degrees in the humanities. Hermeneutics, he insists, teaches patience, tolerance, respect for other views, understanding, and humility, while holding one's own views with firmness and generosity. Yet many teaching institutions do not yet recognize this. With this in mind, Thiselton first considers and responds to those (...) who argue that hermeneutics is not necessary. Then he considers anew more sophisticated thinkers on the subject. Types of texts and hermeneutical models, he argues, are almost infinite, a fact many biblical scholars do not recognize. In the field of biblical hermeneutics, too many view the Bible as one thing, or as a monochrome landscape--it is not. The culmination of Thiselton's case consists in a sustained reflection on the impressive work of Paul Ricoeur, selecting thirteen points of genuine advance his work makes. In this article, we suggest an alternate approach to interpreting the US Constitution, using founding-era translations. We demonstrate how both symmetries and asymmetries in structure and vocabulary of the languages involved can help in deciding nowadays’ problems of constitutional interpretation. We select seven controversial passages of the US constitution to illustrate our approach: Art. I, § 8, cl. 3 ; Art. II, § 1, cl. 5 ; Art. II, § 2, cl. 3 ; Art. I, § 6, cl. 1/Art. I, (...) § 8, cl. 10/Art. IV, § 2 ; and Art. IV, § 2, cl. 1. Since these passages have recently been debated by constitutional scholars, reassessing them using our method can establish the additional value of our approach to constitutional practice. We presume that our approach is not limited to interpreting the US constitution, but suggest that constitutional hermeneutics in general could profit from adding a translation approach to the toolkit.
