The article proposes a new solution to the long-standing problem of the universality of essences in Spinoza's ontology. It argues that, according to Spinoza, particular things in nature possess unique essences, but that these essences coexist with more general, mind-dependent species-essences, constructed by finite minds on the basis of similarities that obtain among the properties of formally-real particulars. This account provides the best fit both with the textual evidence and with Spinoza's other metaphysical and epistemological commitments. The prospective introduction of autonomous cars into public traffic raises the question of how such systems should behave when an accident is inevitable. Due to concerns with self-interest and liberal legitimacy that have become paramount in the emerging debate, a contractarian framework seems to provide a particularly attractive means of approaching this problem. We examine one such attempt, which derives a harm minimisation rule from the assumptions of rational self-interest and ignorance of one’s position in a future accident. We contend, (...) however, that both contractarian approaches and harm minimisation standards are flawed, due to a failure to account for the fundamental difference between those ‘involved’ and ‘uninvolved’ in an impending crash. Drawing from classical works on the trolley problem, we show how this notion can be substantiated by reference to either the distinction between negative and positive rights, or to differences in people’s claims. By supplementing harm minimisation with corresponding constraints, we can develop crash algorithms for autonomous cars which are both ethically adequate and promise to overcome certain significant practical barriers to implementation. Recent developments in neuroscience have inspired proposals to perform deep brain stimulation on psychopathic detainees. We contend that these proposals cannot meet important ethical requirements that hold for both medical research and therapy. After providing a rough overview of key aspects of psychopathy and the prospects of tackling this condition via deep brain stimulation, we proceed to an ethical assessment of such measures, referring closely to the distinctive features of psychopathic personality, particularly the absence of subjective suffering and a lack (...) of moral motivation. Scrutiny of these factors reveals that two essential bioethical criteria, individual medical benefit and voluntary informed consent, cannot be met in performing neurosurgical experiments or treatments on psychopathic inmates. The burgeoning field of biomedical research involving the mixture of human and animal materials has attracted significant ethical controversy. Due to the many dimensions of potential ethical conflict involved in this type of research, and the wide variety of research projects under discussion, it is difficult to obtain an overview of the ethical debate. This paper attempts to remedy this by providing a systematic review of ethical reasons in academic publications on human-animal chimera research. We conducted a systematic review of (...) the ethical literature concerning human-animal chimeras based on the research question: “What ethical reasons have been given for or against conducting human-animal chimera research, and how have these reasons been treated in the ongoing debate?” Our search extends until the end of the year 2017, including MEDLINE, Embase, PhilPapers and EthxWeb databases, restricted to peer-reviewed journal publications in English. Papers containing ethical reasons were analyzed, and the reasons were coded according to whether they were endorsed, mentioned or rejected. Four hundred and thirty-one articles were retrieved by our search, and 88 were ultimately included and analyzed. Within these articles, we found 464 passages containing reasons for and against conducting human-animal chimera research. We classified these reasons into five categories and, within these, identified 12 broad and 31 narrow reason types.15% of the retrieved passages contained reasons in favor of conducting chimera research, while 85% of the passages contained reasons against it. The reasons against conducting chimera research fell into four further categories: reasons concerning the creation of a chimera, its treatment, reasons referring to metaphysical or social issues resulting from its existence and to potential downstream effects of chimera research. A significant proportion of identified passages fell under Category C. We hope that our results, in revealing the conceptual and argumentative structure of the debate and highlighting some its most notable tendencies and prominent positions, will facilitate continued discussion and provide a basis for the development of relevant policy and legislation. The paper examines a relatively neglected element of Spinoza's theory of mind-body relations: the intentional relation between human minds and bodies, which for Spinoza constitutes their “union”. Prima facie textual evidence suggests, and many readers agree, that because for Spinoza human minds are essentially ideas of bodies, Spinoza is also committed to an ontological and explanatory dependence of certain properties of human minds on properties of bodies, and thus to a version of materialism. The paper argues that such dependence would (...) contradict Spinoza's key epistemological commitments, including the explanatory closure of mental and physical realms, and Spinoza’s claim that all knowledge is knowledge of a thing's causes. The paper argues that Spinoza's dual-reality theory of representation allows us to interpret the intentional relation between human minds and bodies in a way that does not commit Spinoza to a problematic dependence of minds on bodies. This is possible if we take Spinoza's references to properties of bodies in his account of the human mind as references to objectively real bodies, that is as references to the immanent representational content of human minds. The article explores the idea that according to Spinoza finite thought and substantial thought represent reality in different ways. It challenges “acosmic” readings of Spinoza's metaphysics, put forth by readers like Hegel, according to which only an infinite, undifferentiated substance genuinely exists, and all representations of finite things are illusory. Such representations essentially involve negation with respect to a more general kind. The article shows that several common responses to the charge of acosmism fail. It then argues that we must (...) distinguish the well-founded ideality of representations of finite things from mere illusoriness, insofar as for Spinoza we can have true knowledge of what is known only abstractly. Finite things can be seen as well-founded beings of reason. The article also proposes that within Spinoza's framework it is possible to represent a finite thing without drawing on representations of mind-dependent entities. (shrink)

The prospect of creating and using human–animal chimeras and hybrids that are significantly human-like in their composition, phenotype, cognition, or behavior meets with divergent moral judgments: on the one side, it is claimed that such beings might be candidates for human-analogous rights to protection and care; on the other side, it is supposed that their existence might disturb fundamental natural and social orders. This paper tries to show that both positions are paradoxically intertwined: they rely on two kinds of species (...) arguments, “individual species arguments” and “group species arguments,” which formulate opposing demands but are conceptually interdependent. As a consequence, the existence of HACHs may challenge exactly those normative standards on which the protection of HACHs may eventually be based. This ethical paradox could constitute the ultimate source of the “moral confusion” that some authors have suspected HACHs to provoke. (shrink)

The paper offers a new account of Spinoza's conception of “substance”, the fundamental building block of reality. It shows that it can be demonstrated apriori within Spinoza's metaphysical framework that (i) contrary to Idealist readings, for Spinoza there can be no substance that is not determined or modified by some other entity produced by substance; and that (ii) there can be no substance (and hence no being) that is not a thinking substance.

Background The significance of medical implants goes beyond technical functioning and reaches into everyday life, with consequences for individuals as well as society. Ethical aspects associated with the everyday use of implants are relevant for individuals’ lifeworlds and need to be considered in implant care and in the course of technical developments. Methods This scoping review aimed to provide a synthesis of the existing evidence regarding ethically relevant psychosocial and cultural aspects in cochlear, glaucoma and cardiovascular implants in patient-centered empirical (...) research. Systematic literature searches were conducted in EBSCOhost, Philpapers, PsycNET, Pubmed, Web of Science and BELIT databases. Eligible studies were articles in German or English language published since 2000 dealing with ethically relevant aspects of cochlear, glaucoma and passive cardiovascular implants based on empirical findings from the perspective of (prospective) implant-wearers and their significant others. Following a descriptive-analytical approach, a data extraction form was developed and relevant data were extracted accordingly. We combined a basic numerical analysis of study characteristics with a thematically organized narrative synthesis of the data. Results Sixty-nine studies were included in the present analysis. Fifty were in the field of cochlear implants, sixteen in the field of passive cardiovascular implants and three in the field of glaucoma implants. Implant-related aspects were mainly found in connection with autonomy, freedom, identity, participation and justice, whereas little to no data was found with regards to ethical principles of privacy, safety or sustainability. Conclusions Empirical research on ethical aspects of implant use in everyday life is highly relevant, but marked by ambiguity and unclarity in the operationalization of ethical terms and contextualization. A transparent orientation framework for the exploration and acknowledgment of ethical aspects in “lived experiences” may contribute to the improvement of individual care, healthcare programs and research quality in this area. Ethics-sensitive care requires creating awareness for cultural and identity-related issues, promoting health literacy to strengthen patient autonomy as well as adjusting healthcare programs accordingly. More consideration needs to be given to sustainability issues in implant development and care according to an approach of ethics-by-design. (shrink)

John Rawls’ “reflective equilibrium” ranges amongst the most popular conceptions in contemporary ethics when it comes to the basic methodological question of how to justify and trade off different normative positions and attitudes. Even where Rawls’ specific contractualist account is not adhered to, “reflective equilibrium” is readily adopted as the guiding idea of coherentist approaches, seeking moral justification not in a purely deductive or inductive manner, but in some balancing procedure that will eventually procure a stable adjustment of relevant doctrines (...) and standpoints. However, it appears that the widespread use of this idea has led to some considerable deviations from its meaning within Rawls’ original framework and to a critical loss of conceptual cogency as an ethico-hermeneutical tool. This contribution identifies three kinds of “balancing” constellations that are frequently, but inadequately brought forth under the heading of Rawlsian “reflective equilibrium”: (a) balancing theoretical accounts against intuitive convictions; (b) balancing general principles against particular judgements; (c) balancing opposite ethical conceptions or divergent moral statements, respectively. It is argued that each of these applications departs from Rawls’ original construction of “reflective equilibrium” and also deprives the idea of its reliability in clarifying and weighing moral stances. A systematic critique of the notion that natural science is the sovereign domain of truth, Critique of Scientific Reason uses an extensive and detailed investigation of physics—and in particular of Einstein's theory of relativity—to argue that the positivistic notion of rationality is not only wrongheaded but false. Kurt Hübner contends that positivism ignores both the historical dimension of science and the basic structures common to scientific theory, myth, and so-called subjective symbolic systems. Spinoza claims both that a thing’s essence is identical to power, and that emotions are fundamentally variations in this power. The conjunction of these two theses creates difficulties for his metaphysics and ethics alike. The three main worries concern the coherence of Spinoza’s accounts of essence, diachronic identity, and emotional “bondage,” and put in question his ability to derive ethical and psychological doctrines from his metaphysical claims. In response to these difficulties, this paper offers a new interpretation of Spinoza’s account (...) of affects and his doctrine of the identity of power and essence. It shows that what is fundamental to his ontology of affects is the relation of modification or determination, a relation central to his ontology more generally. The paper argues that we cannot simply identify power and essence but should instead take affects to modify or determine essences as particular exercises of power (particular desires, appetites, and volitions). That is, Spinozistic essences should be viewed as intrinsically determinable, with affects supplying the determinations, and as consisting not in rigid sets of determinate properties, but in ranges of variable properties. The aim of this paper is to present a logical framework in which the concepts of trust and reputation can be formally characterized and their properties studied. We start from the definition of trust proposed by Castelfranchi & Falcone . We formalize this definition in a logic of time, action, beliefs and choices. Then, we provide a refinement of C&F’s definition by distinguishing two general types of trust: occurrent trust and dispositional trust. In the second part of the paper we (...) present a definition of reputation that is structurally similar to the definition of trust but moves the basic concept of belief to a collective dimension of group belief. Commentators standardly ascribe to Spinoza a belief in an exceptionless conceptual closure of mental and physical realms: no intention can allow us to understand a bodily movement, no bodily injury can make intelligible a sensation of pain. This counterintuitive doctrine, most often now referred to as Spinoza's 'attribute barrier', has weighty repercussions for his views on intelligibility, nature of the mind, identity, and causality. I argue against the standard reading of the doctrine, by showing that it produces an inconsistent epistemological (...) picture, contradicting Spinoza's theory of mind and his commitment to universal intelligibility. The alternative account I propose is also philosophically more compelling and plausible as an account of thought in its essential intentionality. (shrink)

The problem of universals is one of the oldest problems in philosophy. One of the oddities of Spinoza's view of universals is that he endorses both Realism and Nominalism. An analogous Realist account can be given for all thinking things: all ideas, really do have something in common, intrinsically, constitutively, and mind‐independently: namely, thought as a determinable, qualitative, essential substantial nature. Spinoza's accounts of the nature of the human mind and of human emotions both can be read as accounts of (...) such relative common properties. Spinoza's most detailed case study of a mind‐dependent universal whose idea is constructed through abstraction and comparison can be found in his account of the will. Spinoza also often implies that ideas of universals and abstractions have a lower epistemic value than thought that deals with particulars alone. (shrink)

Das Wiskott-Aldrich-Syndrom (WAS), ein genetisch bedingter Immundefekt mit klinischer Manifestation im Kleinkindalter, wird voraussichtlich in näherer Zukunft erstmals versuchsweise durch eine somatische Gentherapie behandelt werden. Im vor- liegenden Beitrag werden die wichtigsten medizinisch-naturwissenschaftlichen Fakten dieses Krankheitsbildes sowie die bisherigen Erfahrungen mit somatischen Gentherapien bei anderen Immunmangelsyndromen ausführlich dargestellt. Sodann erfolgt eine ethische Analyse eines möglichen gentherapeutischen Eingriffs bei WAS-Patienten, bei der die spezifischen Aspekte des Wiskott-Aldrich-Syndroms – insbesondere die fast ausschließliche Betroffenheit von Kindern sowie die unterschiedlich aussichtsreiche Alter- nativoption einer (...) allogenen Knochenmarktransplantation–wesentliche Aspekte der Beurteilung sind. Im Ergebnis zeigt sich, dass ein gentherapeutischer Eingriff im vorliegenden Fall nicht im Rahmen einer Forschungsstudie, d.h. als Humanexperiment, gerechtfertigt werden kann, sondern allein als individueller Heilversuch. Gleichwohl las- sen die besonderen Risiken und die Innovativität eines solchen Eingriffs es notwendig erscheinen, diesen Heilversuch – anders als andere Heilbehandlungen mit bislang unerprobten Mitteln – in streng kontrollierter Form durchzuführen. Der neuartige Gedanke eines kontrollierten individuellen Heilversuchs zeichnet sich daher für den vorliegenden Fall, und womöglich auch für vergleichbare risikoreiche Behandlungsansätze namentlich im Bereich der Gentherapie, als geeignetes Instrument der Konzeption und Beurteilung ab. Die naive Idee des wissenschaftlichen Fortschritts beruht auf der irrtümlichen Annahme, daß es absolute Tatsachen und Grundsätze gibt, auf denen aufbauend die Wissenschaft ein ständig verbessertes Bild der Wirklichkeit liefert und sich mehr und mehr einer absoluten Wahrheit nähert. Im Gegensatz dazu wird gezeigt, daß wissenschaftliche Tatsachen und Grundsätze nur innerhalb der Interpretationsschemata von "Systemmengen" vermittelt werden können, von denen die jeweiligen "historischen Situationen" bestimmt werden. Die Entwicklung der Wissenschaften wird durch Unstimmigkeiten innerhalb solcher Systemmengen und durch den darin begründeten (...) Wandel hervorgerufen. Dabei liegt ein historischer Relativismus bloßer Fatalität oder Willkür nicht vor, weil nicht nur Kriterien für die Wahrheit von Aussagen innerhalb von Systemen logisch, sondern weil auch die Systeme selbst samt ihren Veränderungen, und zwar situationslogisch begründet werden können. Ist nun Wissenschaftsgeschichte "Systemgeschichte", so kommen nur zwei Bewegungsformen in Frage, in denen Fortschritte erzielt werden können: Nämlich erstens "Systemexplikation" und zweitens "Systemmutation". Entsprechend ist ein Fortschritt I von einem Fortschritt II zu unterscheiden. Beide werden mit Hilfe des Begriffs "Harmonisierung einer Systemmenge" genauer definiert. (shrink)

Natürlichkeitsargumente haben allgemein in der Bioethik und speziell in der Debatte um Enhancement und Anthropotechnik keinen guten Ruf. Neben dem formalen Vorwurf, einen naturalistischen Fehlschluss zu begehen, werden sie mit dem inhaltli-chen Einwand konfrontiert, eine falsche Auffassung von menschlicher Natur zugrunde zu legen: Recht verstanden definiere sich diese menschliche Natur nicht durch eine biologische Substanz, die durch biotechnische Eingriffe korrumpiert werden könnte, sondern durch kulturelle Vollzüge, zu denen gerade auch der Einsatz biotechnischer Verfahren zähle und die daher durch biotechnische Manipulationen (...) am Menschen keineswegs beeinträchtigt, sondern eher noch bestätigt würden. Der vorliegende Beitrag unterzieht diese Argumentation einer kritischen Prüfung. Dabei zeigt sich, dass der Ansatz, den Menschen von seiner ‚Kultürlichkeit‘ statt von seiner ‚Natürlichkeit‘ her zu begreifen, tatsächlich keine glaubhafte Rechtfertigung von Anthropotechniken liefert, sondern im Gegenteil ein neues Argument gegen sie begründet: Anthropotechniken untergraben bei genauerem Hinsehen auch und gerade den Status des Menschen als Kulturwesen. This paper offers a new interpretation of Spinoza's doctrine of parallelism. It argues Spinoza reinterprets the ancient doctrine of metaphysical sympathy among ostensibly disconnected and distant beings in terms of fully intelligible relations of 1) identity between formal and objective reality, and in terms of 2) "real identity," grounded in Spinoza's substance-monism. Finally, the paper argues against the standard reading of mind-body pairs as "numerically identical".

Recent literature on Spinoza has emphasized his commitment to universal intelligibility, understood as the claim that there are no brute facts. We draw attention to an important but overlooked element of Spinoza's commitment to intelligibility, and thereby question its most prominent interpretation, on which this commitment results in the priority of conceptual relations. We argue that such readings are both incomplete in their account of Spinozistic intelligibility and mistaken in their identification of the most fundamental relation. We argue that Spinoza (...) is one of the first moderns to address the problem of conditions of intelligibility, and show that, in his metaphysics, expressive relations are best understood as relations of dependence for intelligibility: what a thing ‘expresses’ is its condition of intelligibility, that which determines how, through what concepts, it can be conceived. However, the classical concepts of power, potestas and auctoritas, can be widened to more comprehensive perspectives that eventually promise to embrace modern societal places of power such as the market or the media in their (...) respective peculiarities. Educational reformers all around the globe are continuously searching for ways to make schools more effective and efficient. In Germany, this movement has led to reforms that reduced overall school time of high track secondary schools from 9 to 8 years, which was compensated for by increasing average instruction time per week in lower secondary school. Based on prior research, we assumed that this reform might increase gender disparities in STEM-related outcomes, stress, and health because it required students to learn (...) similar content in less amount of time. Therefore, we investigated how the school time reform affected gender disparities at the end of upper secondary school between 2011 and 2013. Specifically, we considered representative data of the last two cohorts who completed lower secondary school before the reform and the first two cohorts after the reform from the National Educational Panel Study. Potential differences in gender disparities were investigated for upper secondary school outcomes of subject-specific standardized test performance, self-concept, and interest in mathematics, biology and physics, as well as outcomes of school-related stress and health. Overall, we found substantial disparities between girls and boys, which seemed to change little after the reform. Exceptions were the statistically significant gender × reform interactions for one stress dimension and two health dimensions which increased for both boys and girls, but more strongly for girls. Arguments against the possible use of genetic test results in private health and life insurance predominantly refer to the problem of certain gene carriers failing to obtain affordable insurance cover. However, some moral intuitions speaking against this practice seem to be more fundamental than mere concerns about adverse distributional effects. In their perspective, the central ethical problem is not that some people might fail to get insurance cover because of their ‘bad genes’, but rather that some people would manage to (...) get insurance cover because of their ‘good genes’. This paper tries to highlight the ethical background of these intuitions. Their guiding idea appears to be that, by pointing to his favourable test results, a customer might make an attempt to ‘sell his body’. The rationale of this concept is developed and its applicability to the case at issue is critically investigated. The aim is to clarify an essential objection against the use of genetic information in private insurance which has not yet been openly addressed in the academic debate of the topic. (shrink)

Escalation is commonly understood as the constant aggravation of mutual sanctions between two conflicting parties. While escalations have been intensively explored within the empirical sciences, philosophy and ethics have scarcely touched upon the issue up to now. This paper tries to fill this gap by analysing the normative structure that underlies escalations and determines their psychosocial dynamics. The experience of injustice suffered by the opponent and a resulting desire to perform unjust acts of one’s own are highlighted as the essential (...) ingredients of escalations. Against this background, the remarkable stability of escalating conflicts as well as certain paradoxical phenomena in escalating behaviour can both be satisfactorily reconstructed. Additionally, familiar aspects in the realisation of escalations can be better understood and new options for terminating escalations may be developed. (shrink)

English summary: Philosophy of history is a comparatively young discipline. Beginning with the Enlightenment the historical is viewed as a philosophic topic. Through German Idealism it is emphatically placed at the centre of attention. The idealistic perspective on history was important for further development. The author presents the integral components of Kant's, Fichte's, Schelling's and Hegel's philosophy of history. He explains Kant's regulative idea on advancement, Fichte's model of the development of reason in five main eras, Schelling's three steps in (...) the absolute, speculative and revelation and Hegel's historical conception of a comprehensive Weltgeist. The most important opposing positions to an idealistic philosophy of history are described in the final chapter - reaching from new Kantianism, hermeneutics and science theory to the recent narratological approaches. German description: Geschichtsphilosophie, d. h. die bewusste Reflexion des Historischen als eines besonderen Gegenstands fur das menschliche Erkennen und Handeln, ist eine vergleichsweise junge Disziplin. Erst mit der Aufklarung wird Geschichte ernsthaft als eigenstandiges Thema wahrgenommen, und erst im deutschen Idealismus ruckt sie nachdrucklich ins Zentrum des philosophischen Interesses. Dabei ist die idealistische Sicht auf das Historische fur die weitere Entwicklung der Geschichtsphilosophie uberaus pragend gewesen - sei es indem ihre spekulativen Fortschrittsszenarien ubernommen und fur ahnlich umfassende Geschichtsbilder zugrunde gelegt wurden, sei es indem abweichende Geschichtsauffassungen in ihr das wesentliche Gegenkonzept fanden.
