The analysis of 'mixed acts' in Nicomachean Ethics III, 1 has led scholars to attribute a theory of 'dirty hands' and 'impossible oughts' to Aristode. Michael Stocker argues that Aristode recognizes particular acts that are simultaneously 'right, even obligatory', but nevertheless 'wrong, shameful and the like'. And Martha Nussbaum commends Aristotle for not sympathizing 'with those who, in politics or in private affairs, would so shrink from blame and from unacceptable action that they would be unable to (...) take a necessary decision for the best'. In this paper I reexamine Aristotle's analysis of putatively 'mixed acts' in Nicomachean Ethics III, 1, maintaining that Aristode denies that there are acts that are (i) voluntary under the circumstances, (ii) right, all things considered, under the circumstances, but nevertheless (iii) shameful or wrong for moral or prudential reasons under the circumstances. The paper defends this interpretation with reference to Aristode's discussion of shame in EN IV, 9 and Rhetoric II, 6, as well as his overall meta-ethical commitment to a position I call 'mitigated circumstantial relativism'. By focusing on Aristotle's analysis of putatively 'mixed acts', we come closer to a true appreciation of Aristode's ethical theory, even though 'mixed act' is not, I argue, a category in Aristode's considered ontology of action. BackgroundRandom acts of kindness can improve wellbeing. However, less is known about the impacts of giving and receiving acts of kindness with strangers on wellbeing and loneliness. Therefore, this study’s objectives were to evaluate a participatory public mental health project involving sending and receiving a card with goodwill messages, to understand how such acts of kindness influence wellbeing and loneliness, and to investigate the potential mechanisms underlying the project’s impacts.Materials and MethodsThis study was an analysis of anonymized (...) service evaluation data collected in the ‘Kindness by Post’ project in 2020. It used a mixed-methods single-group design and data from 289 participants. Changes in wellbeing, loneliness, sense of belonging and hope from baseline to follow-up were analyzed using linear or multinomial logistic regression. Regression models also examined the associations between changes in wellbeing and baseline loneliness or participation level. Free text responses about experiences and suggestions for the project were analyzed using thematic analysis.ResultsParticipants had a small, but statistically significant improvement, in wellbeing equating to 0.21 standard deviations after taking part in the project, as well as improvements in loneliness, sense of belonging and hope. How lonely a participant was at baseline and whether participants both sent and received a kindness card were not associated with improvements in wellbeing. In the qualitative analysis, a desire to help others emerged as the main motivator to take part in the card exchange. Participants reported enhanced personal fulfillment, leading to improvements in wellbeing. Receiving a card could make people feel special and cherished, which was reported to establish a sense of connection with others, with potential benefits for reducing loneliness.ConclusionThis study provided preliminary evidence that the KBP project might improve wellbeing, loneliness, sense of belonging and hope. Sending a kindness card in this project played a predominant role in wellbeing enhancement, and receiving a kindness card could reduce loneliness. This study suggests that the KBP project can be replicated in more contexts in the future, and might improve wellbeing and loneliness in large communities. (shrink)

Two-tiered mixed theories of punishment hold that legislatures should act according to consequentialism, but the judiciary should act according to retributivism. A major motivation for these theories is wanting to preserve the idea that punishment is ultimately justified on consequentialist grounds, without falling prey to the Punishing the Innocent objection. Yet this benefit is illusory. While two-tiered mixed theories successfully avoid the Punishing the Innocent objection narrowly construed, they do not successfully escape the point behind it. People often act from both motives that are good and motives that are not. How should we assess the moral worth or value of these actions from mixed motives? Having neglected these actions, the recent literature leaves us with no obvious answer. In this paper, I develop an answer. A mixed action, I argue, can be morally worthy even if it is done neither purely from good motives nor partly from good motives that suffice in some relevant sense (...) to prompt it. Whether the action is morally worthy, and if so, to what degree it is, I argue, should be settled by weighing the total goodness of its motives against the total badness of its motives. And two properties of each motive, its intentional object and its motivational strength, together determine the degree of goodness or badness that it contributes to the action’s net worth. (shrink)

This article analyses Ukraine’s language policies from 2002 to 2022 within a framework of liberalism, while avoiding making normative judgements or recommendations, updating the discussion raised in Kymlicka and Opalski’s Can Liberal Pluralism be Exported? The analysis takes into consideration Ukraine’s present and historic position, including the challenge that postcolonial nation building can pose for achieving liberalism and linguistic justice. The paper focuses on three main areas of language policy: education, businesses and media, and assesses if they can be described (...) as liberal orthodox, pluralist or illiberal. The article begins by defining liberalism and illiberalism, discussing the context of Ukraine’s linguistic diversity and postcolonial context, before outlining the language situation until EuroMaidan. Then, the main issue of language policy in the areas of education, business and media is analysed, before considering whether Ukrainian language laws might be considered liberal or illiberal. The thought that creativity is a kind of virtue is an attractive one. Virtues are valuable traits that are praised and admired, and creativity is a widely celebrated trait in our society. In philosophical ethics, epistemology, and increasingly aesthetics, virtue-theoretical approaches are influential, so an account of creativity as a virtue can draw on well-established theories. Several philosophers, including Linda Zagzebski, Christine Swanton and Matthew Kieran, have argued for the claim that creativity is a virtue, locating this claim within a (...) broader picture of intellectual, ethical and aesthetic virtues respectively. Moreover, a prominent research programme in psychology, led by Teresa Amabile, holds that people have an intrinsic motivation when they are creative, and this seems seamlessly to fit with the view that creativity is a virtue, for it is often held that a requirement for a trait to be a virtue is that the virtuous agent acts from an intrinsic motivation. The study of illiberal constitutions has recently generated enormous scholarly interests. Few, however, have focused on whether democracies may still embrace constitutionalism mixed with illiberal elements. This article explores mixed constitutions of South Korea and Taiwan, the two democracies with vibrant civil societies in East Asia. Three distinctive features in both constitutions have demonstrated illiberal elements, including duty clauses imposed upon citizens, directives requiring the State to enact laws to fulfill the goals of governance, and constitutional cultures that (...) exhibit high deference to political elites based on the Confucian tradition. This article further examines the impacts of such mixed constitutions on three challenging issues: managing pandemic crisis, applying artificial intelligence, and combating fake news. This article finds mixed features of illiberal and democratic constitutions in the two countries by giving their governments more space in managing urgent crises, showing higher deference to experts who are generally trusted by the public, and making compromises to individual rights for greater public good. However, this does not imply that the government is not made democratically accountable, or rights and freedoms are not asserted or valued by individuals. To the contrary, nongovernmental organizations and courts in the two countries continue to act as a counterbalancing force, challenging the government’s policies and decisions if not reasonably balanced, weakening the tendency of power concentration that has been seen in other countries where democratic backsliding or authoritarian governance is gradually revived. MMA fighting in a competition is not necessarily wrong and is often, as far as we can tell, permissible. Our argument has two premises. First, if an act does not infringe on anyone’s moral right or violate another side-constraint, then it is morally permissible. Second, MMA-violence does not infringe on anyone’s moral right or violate another side-constraint. The first premise rested on two assumptions. First, if a person does a wrong act, then he wrongs someone. Second, if one person wrongs (...) a second, then the first infringes on the second’s right. My aim in this paper is, by process of elimination, to elucidate and defend an account of how ordinary people act on their values. I will be making both a descriptive claim about our psychology and a further claim about its effectiveness and rational status. I want to suggest that the way in which most of us in fact put our values into practice is, over time, preferable to the ways which initially seem required or at least desirable.

This discussion concentrates on the meaning of Nausicaa's words in lines 286–8, in particular on the force of the phrase κα δ' λλ κτλ. and the sense of the verb μσγηται. On the latter Hainsworth comments, ‘In later usage the simple verb in such a context is used as a euphemism for the sexual act. The line must have sounded most odd to the classical age.’ Thus he translates ‘associate with’, citing Odyssey 7.247 as an exact parallel; since, in that (...) place, the verb refers to nothing more than ordinary human intercourse , with no further connotations, one must conclude that Hainsworth sees no innuendo whatever in 6.288. Cette écrivaine, engagée dans la dénonciation des inégalités entre femmes et hommes, y interroge la notion d’identité à travers l’exploration de différentes images hybrides des corps — l’altérité y tenant une place prépondérante. Refuser le clivage identitaire apparaît dans ses productions romanesques comme un acte fécond, car cela permet d’échapper à l’enfermement dans les (...) clichés et les stéréotypes, en amenant à la création d’identités nomades et plurielles. This paper wishes to study the cultural, social and linguistic interbreeding which forms women’s identities in Malika Mokeddem’s books, a French-speaking Algerian author. Committed to the denunciation of inequalities between men and women, this author question the notion of identity through the exploration of several hybrid images of bodies—where otherness occupies an important place. In her fictional productions, to refuse the identity division seems a fertile action: it allows to escape from an imprisonment of clichés and stereotypes, by creating nomadic and plural identities. From then on, we can’t speak of a “woman body” but only of women bodies, in its plural form. The various hybridations build a reflection about the bodies of women: the singularity of an essentializing identity is refuted in favour of a “body-text” becoming the medium of women’s plural identities. Cognitive architectures have often been applied to data from individual experiments. In this paper, I develop an ACT-R reader that can model a much larger set of data, eye-tracking corpus data. It is shown that the resulting model has a good fit to the data for the considered low-level processes. Unlike previous related works, the model achieves the fit by estimating free parameters of ACT-R using Bayesian estimation and Markov-Chain Monte Carlo techniques, rather than by relying on the mix of (...) manual selection + default values. The method used in the paper is generalizable beyond this particular model and data set and could be used on other ACT-R models. (shrink)

The relationship between libertarianism and state is a contested one. Despite pressing full and strict ownership of one’s person and any justly acquired goods, many libertarians have suggested ways in which a state, albeit limited, can be regarded as just. Peter Vallentyne has proposed that all plausible versions of libertarianism are compatible with what he calls ‘private-law states’. His proposal is underpinned by a particular conception of rights, which brings Interest Theory of rights and Will Theory of rights together. If (...) convincing, Vallentyne’s theory of rights enables libertarians to accommodate a limited but nevertheless coercive state that can act without the full consent of the affected citizen. In this paper, it is argued that Vallentyne’s hybrid theory of rights is implausible from a libertarian perspective as well as fails to align itself with common and deeply held moral intuitions. Hence the conflict between mainstream libertarianism and the state is not solved by Vallentyne’s proposal. (shrink)

I here discuss two problems facing Russellian act-type theories of propositions, and argue that Fregean act-type theories are better equipped to deal with them. The first relates to complex singular terms like '2+2', which turn out not to pose any special problem for Fregeans at all, whereas Soames' theory currently has no satisfactory way of dealing with them (particularly, with such "mixed" propositions as the proposition that 2+2 is greater than 3). Admittedly, one possibility stands out as the most (...) promising one, but it requires that the Russellian treat complex properties as constituents of propositions. This leads to the second major problem for Russellians: that of proliferating propositions. I show how the most direct solution to this problem, that of rejecting complex predicative propositional constituents is available to Fregeans but very implausible for Russellians, since this virtually means rejecting complex properties. This contribution reconstructs and assesses Gideon Yaffe’s claims in his book Attempts about what constitutes an attempt, what can count as evidence that an attempt has been made, whether abandonment is a genuine defense, and whether attempts should be punished less severely than completed crimes. I contrast Yaffe’s account of being motivated by an intention and the completion of an attempt in terms of the truth of the completion counterfactual with an alternative picture of attempts as temporally extended decision trees (...) that are complete insofar as the agent has progressed toward the final act in the tree. I suggest that this alternative scalar conception of attempt may provide a more plausible account of the defense of abandonment. I also raise questions about whether Yaffe has provided an adequate justification of his mix of luck skepticism about censure and luck realism about punishment. (shrink)

Over the years, ethylene-diamine-tetra-acetate (EDTA) has been widely used for many purposes. However, there are inadequate phytoassessment studies conducted using EDTA in Vetiver grass. Hence, this study evaluates the phytoassessment (growth performance, accumulation trends, and proficiency of metal uptake) of Vetiver grass, Vetiveria zizanioides (Linn.) Nash in both single and mixed heavy metal (Cd, Pb, Cu, and Zn)—disodium EDTA-enhanced contaminated soil. The plant growth, metal accumulation, and overall efficiency of metal uptake by different plant parts (lower root, upper root, (...) lower tiller, and upper tiller) were thoroughly examined. The relative growth performance, metal tolerance, and phytoassessment of heavy metal in roots and tillers of Vetiver grass were examined. Metals in plants were measured using the flame atomic absorption spectrometry (F-AAS) after acid digestion. The root-tiller (R/T) ratio, biological concentration factor (BCF), biological accumulation coefficient (BAC), tolerance index (TI), translocation factor (TF), and metal uptake efficacy were used to estimate the potential of metal accumulation and translocation in Vetiver grass. All accumulation of heavy metals were significantly higher (p < 0.05) in both lower and upper roots and tillers of Vetiver grass for Cd + Pb + Cu + Zn + EDTA treatments as compared with the control. The single Zn + EDTA treatment accumulated the highest overall total amount of Zn (8068 ± 407 mg/kg) while the highest accumulation for Cu (1977 ± 293 mg/kg) and Pb (1096 ± 75 mg/kg) were recorded in the mixed Cd + Pb + Cu + Zn + EDTA treatment, respectively. Generally, the overall heavy metal accumulation trends of Vetiver grass were in the order of Zn >>> Cu > Pb >> Cd for all treatments. Furthermore, both upper roots and tillers of Vetiver grass recorded high tendency of accumulation for appreciably greater amounts of all heavy metals, regardless of single and/or mixed metal treatments. Thus, Vetiver grass can be recommended as a potential phytoextractor for all types of heavy metals, whereby its tillers will act as the sink for heavy metal accumulation in the presence of EDTA for all treatments. This study develops an internal–external institutional framework that explains why firms act in socially responsible ways in the emerging country context of China. Utilizing a mixed method of in-depth interviews and a survey study of 225 Chinese firms, the author found that internal institutional factors, including ethical corporate culture and top management commitment, and external institutional factors, including globalization pressure, political embeddedness, and normative social pressure, will affect the likelihood of firms to act in socially responsible ways. In particular, (...) implicit ethical corporate culture plays a key role in predicting different aspects of corporate social responsibility, while external institutional mechanisms mainly predict market-oriented CSR initiatives. This study contributes to the research on CSR antecedents by showing that in the emerging economy of China, CSR toward nonmarket stakeholders is more closely intertwined with corporate tradition and values, while legitimacy-seeking CSR activities are still limitedly rewarded. This is also the main reason why we enjoy non-beautiful art: in the artistic rendering of an unpleasant ‘object’ we focus on (...) the artistic act itself, on its formal features, and its effects on us as the perceiver. Thus, a representation that evokes the mixed feelings of pleasure, appreciation, and rejection is superior to ‘pure’ beauty, in that it better refers us to higher forms of perfection: the perfection of the perceiving and creative subject. The paper introduces a new model of argumentation, the Mixed Game Model, that no longer separates rule-governed competence from actual performance but starts from human beings and their ability of competence-in-performance. Human beings are able to orientate themselves in ever-changing surroundings and to negotiate diverging views in argumentative action games. Argumentation is thus described as a mixed game played by human beings according to principles of probability. These principles include constitutive, regulative and executive principles. Constitutive Principles focus on (...) the basic components of the game, that is, action, dialogue, and coherence as the interplay of different communicative means. Regulative Principles mediate between correlated human abilities and interests. Executive Principles guide the sequencing of action according to cognitive strategies. The mixed game no longer rests on pre-established harmony but describes performance as a non-equilibrial process of negotiation that mediates between order and disorder and is based on the integration of various parameters such as rationality, reason, persuasion and emotion. In an adaptive clinical trial , key trial characteristics may be altered during the course of the trial according to predefined rules in response to information that accumulates within the trial itself. In addition to having distinguishing scientific features, adaptive trials also may involve ethical considerations that differ from more traditional randomized trials. Better understanding of clinical trial experts’ views about the ethical aspects of adaptive designs could assist those planning ACTs. We present a graduate science ethics course that connects cases from the historical record to present realities and practices in the areas of social responsibility, authorship, and human/animal experimentation. This content is delivered with mixed methods, including films, debates, blogging, and practicum; even the instructional team is mixed, including a historian of science and a research scientist. What really unites all of the course’s components is the experiential aspect: from acting in historical debates to participating in the current (...) scientific enterprise. The course aims to change the students’ culture into one deeply devoted to the science ethics cause. To measure the sought after cultural change, we developed and validated a relevant questionnaire. Results of this questionnaire from students who took the course, demonstrate that the course had the intended effect on them. Furthermore, results of this questionnaire from controls indicate the need for cultural change in that cohort. All these quantitative results are reinforced by qualitative outcomes. (shrink)

We investigated the contribution of bilingual experience to the development of cognitive reserve when compared with other, traditionally more researched, CR proxies, in a sample of cognitively healthy senior bilingual speakers. Participants performed in an online study where, in addition to a wide inventory of factors known to promote CR, we assessed several factors related to their second language use. In addition, participants’ inhibitory executive control was measured via the Flanker Task. We used Structural Equation Modeling to derive a latent (...) composite measure of CR informed by traditional CR proxies. We examined whether bilingualism may act as a mediator of the effects of such proxies on cognitive performance therefore assessing the unique contribution of dual language use to CR. First, our analyses revealed facilitatory effects of both L2 age of acquisition and L2 proficiency on the executive performance. Second, our analyses confirmed the moderating role of bilingual experience on the relationship between other factors known to promote CR and cognitive integrity, revealing a strong contribution by bilingualism to CR development. Our findings provide further support to the notion that bilingualism plays an important role in mitigating cognitive decline and promoting successful aging. (shrink)

The present study used quantitative and qualitative measures to examine Iranian applied linguists’ (mis-) conceptions of ethical issues in research. For this purpose, one hundred and twelve applied linguists completed a research ethics questionnaire constructed and validated by the researchers. In the follow-up qualitative phase, 15 applied linguists who were faculty members participated in semi-instructed interviews. Data were analyzed using exploratory factors analyses for the first phase and theme analyses for the second phase. Quantitative results showed that the most important (...) misconceptions among Iranian applied linguists lingered on working with data (data collection and data analyses). For example, removing an outlier was a prevalent act conducted by applied linguists in the present study. Teachers using their students as participants of their own research as well as how they treated those students after a study were other controversial issues. The qualitative results revealed several themes including _lack of knowledge, conflict with real-world practices, a product-oriented approach to education and a publish or perish mentality_ as the reasons for misconceptions of ethics in applied linguistics among Iranian researchers. On general terms, there was an implicit agreement regarding the lack of training on research ethics among Iranian applied linguists. (shrink)

The most prominent — and certainly the most controversial — feature of the Patient Protection and Affordable Care Act is the so-called “individual mandate,” which attempts to address the problem of 50 million uninsured by requiring nearly all Americans, beginning in 2014, to obtain health insurance. While expanded access to health insurance has been both the cornerstone and the lightening rod of the ACA, the Act also contains significant public health provisions focusing on, among other things, promoting the availability of (...) prevention and wellness services. Although these public health provisions have been greeted with mixed reviews, there has been very little discussion of what may be the ACA’s most significant public health feature: the preventive services mandate. In a bold stroke, the ACA changes the way evidence-based preventive services will be provided and paid for by private health insurance plans, Medicare, and Medicaid. By requiring these health plans to provide evidence-based preventive services with no out-of-pocket costs, the ACA transforms the U.S.’s public and private health care financing systems into vehicles for promoting public health. This book puts forward a new theoretical concept of the juridical act, this concept is not described from the perspective of a specific national legal system, but instead represents the commonalities and ideas that stem from the Western legal tradition. Since the concept is system-independent, it does not rely on national or state laws. The book begins by detailing those characteristics that distinguish juridical acts from the general group of acts. It offers clear distinctions between the different aspects (...) of juridical acts, such as the power and the competence needed in order to perform the act, the fact that juridical acts are constitutive speech acts, and the rules that connect the act with its consequences. In the process, the book dispels much of the haziness currently surrounding juridical acts. Developed with a mix of theory and practice, this new concept is better equipped to deal with modern trends and practices. Further, since the author has freed the idea of the juridical act from the bonds of history and geography, it is also more suited to facilitating a better understanding of and explaining changes in the legal landscape, such as the rise of computer technology. Accordingly, it offers scholars and practitioners alike a valuable new tool for explaining and theorizing about the law. (shrink)

It is common practice within primary classrooms for teachers to spilt children into different ability groups so that children of similar level are taught together. Whilst this practice is used across the globe, research is mixed on the benefits of such grouping strategy. This paper presents data collected from mixed methods research which investigated teachers use of grouping strategies and social comparison, the act of comparing oneself with others. It focuses on when, why and with whom children from (...) different ability groups compare themselves and the impact this has on their self-perceptions. Drawing upon data from children aged between 10 and 11 years from 12 primary schools, social comparison was found to play a significant role in daily classroom life for some children. The study identified different strands of the social comparison process including acknowledgment, topic, target, and direction, and it revealed positive and negative effects of social comparison. A difference by ability group was identified. Children within the low ability group were particularly vulnerable to the negative effects of social comparison and found to engage in more frequent and intentional social comparisons which were heavily relied upon for self-evaluation and performance evaluation. The paper discusses the educational implications of social comparison regarding pupil ability grouping strategies, motivation, engagement, and academic performance. The Gamer’s Dilemma challenges us to justify the moral difference between enacting virtual murder and virtual child molestation in video games. The Dilemma relies for its argumentative force on the claim that there is an intuitive moral difference between these acts, with the former intuited as morally acceptable and the latter as morally unacceptable. However, there has been no empirical investigation of these claims. To explore these issues, we developed an experimental survey study in which participants were asked to (...) reflect on imaginary video game scenarios as part of a 2 (undertake virtual murder or molestation) X 2 (against an adult or child) X 2 (in a high or low realism virtual environment) factorial design. We found that there was a significant difference between people’s views about virtual murder and virtual molestation. Whether the virtual act was performed against an adult or child was non-significant in most conditions, whereas whether it was performed in a high or low realism virtual environment was significant in most conditions. Gender did not impact these results, whereas perceived gaming experience, hours of video game play per week, and integrity did. These results provide an empirical grounding for future discussions of the Gamer's Dilemma. (shrink)

Background Professional ethics in nursing exist to guide care and allow for decision-making to be patient-centered. In the current medicolegal landscape post-Roe and in light of bans on gender-affirming care, the decision-making processes of emergency nurses in the clinical environment of care as informed by both professional and personal ethics are an important area of inquiry. Aim The aim of this study was to examine the contribution of moral courage to decision-making by emergency nurses. Research Design A mixed-methods exploratory (...) sequential approach was used, using a standard demographics form and the Nurses Moral Courage Scale to collect quantitative data. These data were used to inform an interview guide for qualitative data collection. Situational analysis was used to analyze the interview data. Ethical Considerations Prior to recruitment, this study was reviewed and approved by the University of Massachusetts IRB (#00003909). Participants were provided with an informed consent document at the time of registration and at the time of interview; participants provided both signed consent and verbal assent. Participants were assigned study codes to maintain anonymity and data were maintained in a secure University cloud. Participants and Research Context US-based emergency nurses working in environments with care limitations. Results 70% of respondents reported that they would speak up if they were aware of a situation that was ethically challenging. Respondents reported that it was fairly easy or very easy to defend their values when addressing ancillary staff, coworkers, authorities outside the organization, patients, and patient families. Respondents reported challenges in defending their professional values to charge nurses, physicians, or administrators. In response to a serious ethical problem, 65.8% of respondents answered that they would bring up the problem for discussion, 21.1% would file an internal report, and 13.2% would report externally. Interview participants reported significant social and professional barriers to acting in response to an ethical violation. Willingness to act centered on personal values and not professional codes of ethics. Conclusions While emergency nurses in this study reported high perceived levels of moral courage, they also reported low willingness to act directly, citing burnout and significant social and professional barriers. Adherence to professional codes of ethics is not the primary driver of moral courage. (shrink)

Emotions play a significant role in human relations, decision-making, and the motivation to act on those decisions. There are ongoing attempts to use artificial intelligence (AI) to read human emotions, and to predict human behavior or actions that may follow those emotions. However, a person’s emotions cannot be easily identified, measured, and evaluated by others, including automated machines and algorithms run by AI. The ethics of emotional AI is under research and this study has examined the emotional variables as well (...) as the perception of emotional AI in two large random groups of college students in an international university in Japan, with a heavy representation of Japanese, Indonesian, Korean, Chinese, Thai, Vietnamese, and other Asian nationalities. Surveys with multiple close-ended questions and an open-ended essay question regarding emotional AI were administered for quantitative and qualitative analysis, respectively. The results demonstrate how ethically questionable results may be obtained through affective computing and by searching for correlations in a variety of factors in collected data to classify individuals into certain categories and thus aggravate bias and discrimination. Nevertheless, the qualitative study of students’ essays shows a rather optimistic view over the use of emotional AI, which helps underscore the need to increase awareness about the ethical pitfalls of AI technologies in the complex field of human emotions. This means that while competent minors may consent to treatment their refusal of consent does not act as an effective veto of treatment and treatment remains lawful if given with parental consent. This approach has been heavily criticized as inconsistent with the House of Lords decision in the Gillick case and damned as ‘palpable nonsense’. In this article, (...) I examine these criticisms and conclude that, far from being illogical, it is entirely consistent with the essential asymmetry between consent to treatment and refusal of treatment. I examine the two metaphors of keyholders and flak jackets used to explain this approach and I suggest that both have value but only when used in combination. I also explain why, contrary to the criticism, it is consistent with Gillick. (shrink)

Background Assisted death, including euthanasia and physician-assisted suicide (PAS), is under debate worldwide, and these practices are adopted in many Western countries. Physicians’ attitudes toward assisted death vary across the globe, but little is known about physicians’ actual reactions when facing a request for assisted death. There is a clear gap in evidence on how physicians act and respond to patients’ requests for assisted death in countries where these actions are not legal. Methods A survey including statements concerning euthanasia and (...) PAS and an open question about their actions when facing a request for assisted death was sent to all Finnish physicians. Quantitative data are presented as numbers and percentages. Statistical significance was tested by using the Pearson chi-square test, when appropriate. The qualitative analysis was performed by using an inductive content analysis approach, where categories emerge from the data. Results Altogether, 6889 physicians or medical students answered the survey, yielding a response rate of 26%. One-third of participants agreed or partly agreed that they could assist a patient in a suicide. The majority (69%) of the participants fully or partly agreed that euthanasia should only be accepted due to difficult physical symptoms, while 12% fully or partly agreed that life turning into a burden should be an acceptable reason for euthanasia. Of the participants, 16% had faced a request for euthanasia or PAS, and 3033 answers from 2565 respondents were achieved to the open questions concerning their actions regarding the request and ethical aspects of assisted death. In the qualitative analysis, six main categories, including 22 subcategories, were formed regarding the phenomenon of how physicians act when facing this request. The six main categories were as follows: providing an alternative to the request, enabling care and support, ignoring the request, giving a reasoned refusal, complying with the request, and seeing the request as a possibility. Conclusions Finnish physicians’ actions regarding the requests for assisted death, and attitudes toward euthanasia and PAS vary substantially. Open discussion, education, and recommendations concerning a request for assisted death and ethics around it are also highly needed in countries where euthanasia and PAS are not legal. (shrink)

Leibniz construit, teste et vérifie sans cesse la pertinence et la cohérence de sa philosophie en la rapportant aux conclusions des autres disciplines. Cette méthode heuristique nourrit son dialogue avec les sciences mathématiques et physiques; moins connus, les enjeux révélés par la réforme moderne de la médecine et la chimie suscitent une interrogation sur la vie et la qualité. Ces sciences expérimentales s'avèrent en effet cruciales pour une philosophie de la nature qui cherche à concilier le mécanisme et le finalisme (...) à travers les concepts d'entéléchie et de monade. Elles obligent en outre à préciser la logique de l'expérience, la fonction de la raison, le statut des principes explicatifs (loi, cause, éléments, analogie). Enfin, elles exigent un fondement qui permette de rapporter les phénomènes organiques à leur véritable origine: la vie. Ce programme se réalise de façon systématique dans la controverse qu'entretiennent Leibniz et Stahl au sujet d'une philosophie de la nature capable de prendre acte des découvertes modernes de la médecine et de la chimie, tout en fondant ces connaissances sur une théorie générale de la substance et de la vie. In several of his works, Immanuel Kant insists on the transcendental role of imagination in perception. In the Kantian scholarship, this claim has been interpreted in at least three ways: it is believed that the imagination is necessary to solve the riddle of the amodal character of perception, to justify the possibility of perceptual identity across time, and to explain the possibility of perceiving particular objects as such, viz. as belonging to a specific class of objects. The paper aims to (...) show how E. Husserl inherited these sets problems without however having recourse to the imagination at all. In the last section, I will briefly analyse two types of mixed acts where perception and imagination unite, namely image consciousness (Bildbewusstsein) and what Husserl calls perceptual phantasy (perzeptive Phantasie). I here argue that these analyses do not contradict, but rather strengthen the argument defended throughout the paper, namely that in Husserl's phenomenology, and contrary to Kant's, the imagination does not assume a synthetic or transcendental function in perception. The interpretation of Eth. Nic. C 1, and particularly of the notion of ``voluntariness'' and ``involuntariness'' is often distorted by the inappropriate overlap of questions deriving from modern moral philosophy. Firstly, this paper presents the scholarly debate on the topics frequently connected with the Aristotelian concepts of ἑκούσιον/ἀκούσιον (determinism/indeterminism, mixed acts and dirty hands theory, mixed acts vs. instrumental acts, role of circumstances, etc.). The next step is the analysis of the relevant passages of Eth. (...) Nic. through a close examination of the relationship between the notions of ``choice'' and ``voluntariness'': what is crucial for the voluntariness of an action is the individuation of the efficient cause. On this basis it is possible to clarify the role and the significance of mixed acts and of other kinds of actions described by Aristotle. Finally, the topics previously displayed are re-examined in order to shed some light on the distortions arising from the adoption of inadequate lens in interpreting ancient texts. (shrink)

A dynamic context model of interactive behavior was developed to explain results from two experiments that tested the effects of interaction costs on encoding strategies, cognitive representations, and response selection processes in a decision-making and a judgment task. The model assumes that the dynamic context defined by the mixes of internal and external representations and processes are sensitive to the interaction cost imposed by the task environment. The model predicts that changes in the dynamic context may lead to systematic biases (...) in cognitive representations and processes that eventually influence decision-making and judgment outcomes. Consistent with the predictions by the model, results from the experiments showed that as interaction costs increased, encoding strategies and cognitive representations shifted from perception-based to memory-based. Memory-based comparisons of the stimuli enhanced the similarity and dominance effects, and led to stronger systematic biases in response outcomes in a choice task. However, in a judgment task, memory-based representations enhanced only the dominance effects. Results suggested that systematic response biases in the dominance context were caused by biases in the cognitive representations of the stimuli, but response biases in the similarity context were caused by biases in the comparison process induced by the choice task. Results suggest that changes in interaction costs not only change whether information was assessed from the external world or from memory but also introduce systematic biases in the cognitive representation of the information, which act as biased inputs to the subsequent decision-making and judgment processes. Results are consistent with the idea of interactive cognition, which proposes that representations and processes are contingent on the dynamic context defined by the information flow between the external task environment and internal cognition. Acts of helping others are often based on mixed motivations. Based on this claim, it has been argued that the use of a financial reward to incentivize organ donation is compatible with promoting altruism in organ donation. In its report Human Bodies: Donation for Medicine and Research, the Nuffield Council on Bioethics uses this argument to justify its suggestion to pilot a funeral payment scheme to incentivize people to register for deceased organ donation in the UK. In this (...) article, I cast a sceptical eye on the above Nuffield report's argument that its proposed funeral payment scheme would prompt deceased organ donations that remain altruistic . Specifically, I illustrate how this scheme may prompt various forms of mixed motivations which would not satisfy the report's definition of altruism. Insofar as the scheme produces an expectation of the reward, it stands diametrical to promoting an ‘altruistic perspective’. My minimal goal in this article is to argue that altruism is not motivationally compatible with reward as an incentive for donation. My broader goal is to argue that if a financial reward is used to incentivize organ donation, then we should recognize that the donation system is no longer aiming to promote altruism. Rewarded donation would not be altruistic but it may be ethical given a persistent organ shortage situation. (shrink)

Unlike other classical arguments for the existence of God, Pascal’s Wager provides a pragmatic rationale for theistic belief. Its most popular version says that it is rationally mandatory to choose a way of life that seeks to cultivate belief in God because this is the option of maximum expected utility. Despite its initial attractiveness, this long-standing argument has been subject to various criticisms by many philosophers. What is less discussed, however, is the rationality of this choice in situations where the (...) decision-makers are confronted with greater uncertainty. In this paper, I examine the imprecise version of Pascal’s Wager: those scenarios where an agent’s credence that God exists is imprecise or vague rather than precise. After introducing some technical background on imprecise probabilities, I apply five different principles for decision-making to two cases of state uncertainty. In the final part of the paper, I argue that it is not rationally permitted to include zero as the lower probability of God’s existence. Although the conditions for what makes an act uniquely optimal vary significantly across those principles, I also show how the option of wagering for God can defeat any mixed strategy under two distinct interpretations of salvation. A private property right is a collection of particular rights that relate to the control of an object. The ground for such moral rights rests on the value of project pursuit. It does so because the individual ownership of particular objects is intimately related to the formation and application of a coherent set of projects that are the major parts of a self-shaped life. Problems arise in explaining how unowned property is appropriated. Unilateral acts with regard to an object, (...) e.g., mixing in one’s labor into it, probably don’t ground particular rights to private property. Nor do bilateral contracts since a stable pre-institutional contract with regard to appropriation is not likely to form. However, a conventional method of appropriation can allow for such appropriation while at the same time preserving the pre-institutional nature of such rights. This theory can also account for a person’s property rights in her own body. However, the value of project formation requires that persons have at least some private property that is to serve as the object of their projects. These positive rights to property undermine the libertarian claim that all non-commitment-based rights are negative. However, a further empirical argument is needed in order to justify protecting these positive moral rights to private property by positive legal rights. (shrink)

According to the pragma-dialectical ideal of reasonableness, in case of a difference of opinion the protagonist and the antagonist of a standpoint should attempt to find out by means of a critical discussion whether the protagonist's standpoint is capable of withstanding the antagonist's criticism. In this paper, the authors formulate the latest version of their basic rules for the performance of speech acts in the various stages that can beanalytically distinguished in a critical discussion that can lead to the (...) resolution of a single and non-mixed difference opinion. Examining the nature of teachers’ emotions and how they are managed and regulated in the act of teaching is crucial to assess the quality of teachers’ instruction. Despite the essential role emotions play in teachers’ lives and instruction, research on teachers’ emotions has not paid much attention on teachers’ emotions in the context of daily teaching. This paper explored elementary teachers’ emotions while preparing for teaching and during teaching mathematics, reasons that underlie these emotions, and the relationship between their emotions (...) and the quality of their mathematics instruction. Participants were seven elementary teachers working in the U.S. who participated in Holistic Individualized Coaching (HIC) professional development that consisted of five cycles of coaching over an year. For each coaching cycle, pre-coaching conversation and post-coaching conversation data were collected regarding emotions teachers felt in anticipation of teaching and during teaching retrospectively. In order to compare teachers’ emotions with instructional quality, coaching sessions were video recorded and analyzed to determine the quality of instruction. Findings of this study showed that teachers reported six categories of emotions (positive, negative, neutral, blended-positive, blended-negative, and mixed), described emotions often in non-typical ways (e.g., “not nervous”, “anxious but in a positive way”), and experienced mixed emotions (co-occcurence of positive and negative emotions) as the most dominant emotion. Teachers also had more positive emotions anticipating teaching than actually teaching the lesson. The reason teachers felt mixed emotions reflected the complex and context-specific nature of teaching, a phenonemenon not currently described in the teacher emotion literature. There were no clear relationships between emotional experiences and instructional quality. This study allowed participants to freely describe their authentic, complex, overlapping, and ambiguous emotions in the context of active teaching, which contributes opening up the possibilities of diversifying teacher emotion research and shows the significance and usefulness of understanding teachers’ emotions related to active instruction. We assume that a hypothesis is justified if there is at least a scintilla of evidence for the truth of its propositional content, while an assertion is justified when there is conclusive evidence that its propositional content is true. Here we extend the logical treatment for assertions given by Dalla Pozza and Garola by outlining a pragmatic logic for assertions and hypotheses. On (...) the basis of this extension we analyse the standard logical opposition relations for assertions and hypotheses. We formulate a pragmatic square of oppositions for assertions and a hexagon of oppositions for hypotheses. Finally, we give a mixed hexagon of oppositions to point out the opposition relations for assertions and hypotheses. (shrink)

El presente trabajo aborda la temática de la temporalidad ligada a la producción de relatos de memoria en la antigua Grecia, cuando esta tarea era encomendada a la creación de palabra en boca de los poetas. Mediante un estudio de las odas y de los epinicios de Píndaro -tanto en el contexto de su surgimiento como a través de interpretaciones filosóficas posteriores-, los relatos plausibles de conformar una memoria aparecen ligados a un acto de composición selectivo, donde el poeta decidirá (...) qué acontecimientos serán dignos de Elogio y cuáles, en cambio, de Vituperio. En un contexto que se asume complejo, constituido por fuerzas ambivalentes, las producciones de palabra al servicio de un sostenimiento de la memoria deberán sortear siempre la opacidad de las circunstancias que la confunden, la ironizan, la amenazan de olvido. La palabra, así, en boca de los poetas, tendrá la eficacia capaz de dar cuenta de una economía de lo verdadero que ya va trazando la memoria de las paradojas de su propia historia. This paper addresses the issue of temporality linked to the production of memory narratives in ancient Greece, when this task was entrusted to poets and their creation of words. Through a study of Pindar Odes and Epinicia - both, in the context of its emergence as through further philosophical interpretations- plausible stories to form a memory appear linked to a selective act of composition, where the poet decides what events will be worthy of Praise, and which, instead, of Shame. In a context that is assumed complex, consisting of mixed forces, word productions serving a sustaining memory must always overcome the opacity of the confusing circumstances, the irony, and the threat of oblivion. Words, in the voice of the poets, will become the efficacy marks of some kind of economy of the ruth that is already mapping the paradoxal memory of its own history. (shrink)
