BackgroundMedical assistance in dying (MAID) has been legal in Québec since December 2015 and in the rest of Canada since July 2016. Since then, more than 60 people have donated their organs after MAID. Such donations raise ethical issues about respect of patients’ autonomy, potential pressure to choose MAID, the information given to potential donors, the acceptability of directed donations in such a context and the possibility of death by donation. The objective of this study was to explore (...) class='Hi'>Québec professionals’ perspectives on the ethical issues related to organ donation after MAID.MethodsWe conducted semi-directed interviews with 21 health care professionals involved in organ donation such as intensivists and intensive care nurses, operating room nurses, organ donation nurses and coordinators.ResultsThe participants were all favourable to organ donation after MAID in order to respect patients’ autonomy. They also favoured informing all potential donors of the possibility of donating organs. They highlighted the importance of assessing donors’ reasons for requesting MAID during the assessment. They were divided on directed donation, living donation before MAID and death by donation.ConclusionOrgan donation after MAID was widely accepted among the participants, based on the principle of respect for the donor’s autonomy. The findings of this study only provide the perspectives of Québec health care professionals involved in organ donation. Future studies are needed to gather other stakeholders’ perspectives on this issue as well as patients’ and families’ experiences of organ donation after MAID. (shrink)

In Is Quebec Nationalism Just? contributors explore Quebec's relationship with the rest of Canada from a normative perspective. The case of Quebec is interesting, both politically and philosophically, because it epitomizes the puzzle of liberal nationalism. While nationalism is often assumed to be inherently illiberal and regressive, the authors of these essays argue that Quebecers' desire to control their own political destiny is not fuelled by hostility to liberalism. As philosophers such as Fendler, Bauman and Young have shown, the concept of community poses significant challenges for diversity by reinforcing similarity, necessarily bracketing that which is viewed as outside, other or strange. In this paper, I interrogate the concept of community as it applies to Québec's intercultural context. I explore how intercultural dialogue, a mechanism to promote intercultural community building has, through a number of public displays of xenophobia, reinforced a discourse of intolerance in Québec's public sphere. Québec's Geography, History, and Citizenship education course is aimed at creating an intercultural ‘micro-society’ in which students practice the demands of intercultural citizenship, such as dialogue. The endless waves of migrants that have swept across Europe and North America have led several countries to tighten border controls and tighten immigration criteria. How, moreover, can we ignore the human distress of millions of migrants fleeing war, persecution or food insecurity? How can we reconcile the compelling obligation to help strangers in need with the legitimate and essential need to build a " place to call home "? Therein lies the paradox of hospitality. While in the majority of English-speaking territories the dominant legal tradition is common law, in Louisiana and Quebec the native language is English and the legal system stems from continental civil law. Both the Louisiana Civil Code and the Civil Code of Quebec take root in the European codification movement, following Code Napoleon. Bearing in mind the link between law and language, these jurisdictions provide a unique source of English civil law terminology with well-founded conceptual background. The civil codes of (...) Louisiana and Quebec seem to be potentially useful for the translation of Polish private law into English. Yet there are some reservations which should be considered. By comparing two different translations of Article 292 of the Polish Civil Code, this paper is intended to contribute to the debate on the use of Quebec and Louisiana terminology in Polish-English legal translation. Gilles Deleuze is a contemporary French thinker who shows the greatest awareness to Québec culture by integrating into his philosophical work some of its revolutionary forces. By way of illustration, the first part of this article attends to the contributions of prominent cultural figures — all discussed by Deleuze — namely, Jack Kérouac, Pierre Perrault, Michèle Lalonde, Norman McLaren, and Alexis the Trotter. The second part of this article explores the reception of Deleuze in Québec in and outside (...) of academia. La Francophonie panaméricaine est-elle à la hauteur de cette épreuve? Il serait prétentieux de prétendre apporter une réponse ferme et définitive à ces vastes questions, mais la réflexion qui suit propose quelques pistes d'analyse, disons, prospective...This article explores the challenges faced by Panamerican Francophony in order to ensure its integration within the FTAA. The meeting of two Americas, one Francophone and centred on the Province of Québec, the other Creole and centered on the Caribbean, is not the least of the challenges. It also essential that Panamerican Francophony transcends the apparent contradiction which exists between, on the one hand, the need for its cultural distinctiveness to be recognised in order to be better protected and, on the other, the acceptation of the process of creolisation and métissage of language and culture. Is the Panamerican Francophony capable of rising to the challenge? It would be pretentious to say one can provide an unequivocal answer to these broad-ranging questions, but the following discussion suggests a few lines of thought and, perhaps, possible outcomes.. Cet article porte sur la reconstruction des relations entre Hydro-Québec et la Nation crie de 1994 à 2015. En 1994, le report sine die du projet hydroélectrique de Grande-Baleine par le premier ministre Jacques Parizeau marque à la fois une « victoire » pour les Cris opposés à ce projet et le paroxysme du conflit entre ces derniers et Hydro-Québec. Par contraste, deux décennies plus tard, en 2015, les deux parties s’accordent à décrire comme excellentes et constructives les (...) relations entre la société d’État et la Nation crie. L’intérêt distinctif de cette contribution qui vise à analyser le processus de transition de rapport conflictuel à partenariat réside dans le fait qu’elle a été coécrite par deux des protagonistes, l’un d’Hydro-Québec, l’autre du gouvernement de la Nation crie, et par deux chercheurs, dans le but de favoriser une compréhension commune de ces événements. Cet effort « d’écrire l’histoire à plusieurs mains », au-delà des clivages passés et présents, représente un effort de synthèse qui vise à enrichir notre compréhension des processus et des démarches d’acceptabilité sociale. ABSTRACT I argue that people have a right to self‐determination when they are plainly predominant in a certain territory and do not violate the civil liberties of minorities. But there is no self‐determination without the preservation of self‐identity and the cultural preservation that goes with its secure existence. So to preserve autonomy and self‐determination people must preserve their cultural identity and this cannot be securely sustained in modern conditions without a nation‐state concerned to nourish that identity. Such considerations support a (...) right to secession when certain conditions are met. The conditions are that the people in question have a cultural identity, live in a distinct territory which they have inhabited for a long time, form an extensive majority, and respect the civil liberties of the minorities living in that territory (as well as elsewhere). Where they are such a group they have a right to secede from a larger state to which they are historically attached. These conditions, I argue, are met in Quebec. (shrink)

Le Canada et le Québec, à l'instar des Pays-Bas, de la France et de l'Angleterre, réfléchissent sur leurs politiques publiques, face aux défis que pose la diversité ethno-religieuse. À ce titre, la notion juridique d'« accommodement raisonnable », fondamentale pour les débats canadiens, est ici explicitée, car elle constitue une clé de compréhension de cet enjeu. On compare ensuite les situations québécoises et canadiennes, à la lumière de la distinction classique entre la sécularisation et la laïcité. Dans la réaction (...) à la diversité religieuse, on peut tenir compte de certaines caractéristiques du Québec francophone, qui se rapportent à son origine franco-catholique. L'usage qu'on y fait du concept de « laïcité ouverte » mérite à cet égard un examen sérieux: il s'y dégage une conception de l'égalité à la fois réfractaire aux « privilèges » acquis des groupes religieux majoritaires et favorable à la protection des expressions religieuses individuelles brimées par les normes générales.Canada and Quebec, like the Netherlands, France and England, reflect on their public policy challenges posed by ethno-religious. As such, the legal concept of "reasonable accommodation" fundamental to Canadian debates, is explained here, because it is a key to understanding this issue. It then compares the situation in Quebec and Canada, in the light of the classical distinction between secularization and secularism. In reaction to religious diversity, one can take into account certain characteristics of Quebec French, which relate to the Franco-Catholic. The use that it makes of the concept of "open secularism" in this regard deserves serious consideration: there is always emerges a conception of equality both refractory acquired "privileges" of majority religious groups and pro- the protection of individual religious expressions bullied by general standards. This article presents the results of a research that aimed to examine the phenomenon of student cheating on exams in faculties of education in Quebec universities. A total of 573 preservice teachers completed an online survey in 2018. The questionnaire consisted of 28 questions with a Likert scale related to individual and contextual factors associated with the propensity to cheat on exams as well as two yes/no items on the arguments for cheating. Descriptive and hierarchical linear regression analyses highlighted the (...) existence of cheating but also how three factors influenced the students’ propensity to cheat: influence of peers, methods of cheating, and institutional context. Cet article s'intéresse à la manière avec laquelle les résultats aux référendums français et néerlandais sur la Constitution européenne sont interprétés dans la presse anglo-canadienne et franco-québécoise à l'aune des récentes crises constitutionnelles. The notion of utopia in Quebec culture has been a formal and thematic constant since the origins of its literature and indeed French Canadian history. Québec's complaint examination system has devoted considerable effort to supporting dissatisfied users who may wish to register complaints. It is open to question, however, whether this level of effort has, in fact, aided users in filing their complaints, and whether, once filed, the intake and processing of complaints has been rigorous and fair. Has the intake and handling of complaints at least improved? This is the question we shall attempt to answer here by presenting the results of our study (...) concerning the impact of the Complaint Assistance and Support Centers (CAAPs) on the intake of complaints. The results show that the Québec complaint examination system and its Complaint Assistance and Support Centers help make complaints more admissible and ensure that each complaint is examined. However, the system is also hindered by differences and conflicting interpretations among the various stakeholders regarding the legitimacy of complaints, respect for users’ rights, and the mission of the system. Although complaint examination systems seek to encourage users to express their points of view, users’ voices are still only partly audible. (shrink)

The judgment of the Supreme Court of Canada in the Quebec Secession Reference has produced a torrent of public commentary. Given the fundamental issues about the relationship between law and politics raised by the judgment, what is remarkable is that that commentary has remained almost entirely in a pragmatic perspective, which asks how positive politics entered into the motivations and justifications of the Court, and looks at the results in terms of their political consequences, without deep or sustained reflection on (...) the ultimate grounds for the role the Court took upon itself, or on the normative sources of its reasoning. In this article, we explore the Quebec Secession Reference through the lens of constitutional theory. In particular, we highlight three unconventional aspects of the Court’s reasoning: (a) the supplementation of the written constitution through an explicit process of amendment-like interpretation to craft a new legal framework governing the secession of a province from Canada, (b) the vesting by the Court of substantial, if not exclusive responsibility for interpreting the constitutional rules on secession in particular situations or contexts with political organs, not the courts, and (c) the ascent by the court to abstract normativity, in articulating a normative vision of the Canadian constitutional order, whence it derived the legal framework governing secession. In addition to drawing attention to these unusual aspects of the judgment, we articulate the theoretical justifications that both explain and justify those features of the judgment, and identify issues for future discussion. This article examines the 2008 report of the Quebec Government’s Consultation Commission on Accommodation Practices Related to Cultural Differences which was co-authored by Charles Taylor. Summarizing its main themes, it identifies points of intersection with Taylor’s political thought. Issues of citizen equality, including gender equality, secularism, integration and interculturalism, receive special attention.

The purpose of this paper is twofold. First, it offers a critique of the normative foundations of the 2019 Quebec Act respecting the laicity of the State. This is primarily based on the theses we developed in La nation pluraliste. Repenser la diversité religieuse au Québec (Presses de l’Université de Montréal, 2018), and elaborates a suitable diversity management model for Quebec using the republican liberalism described in Rawls’ later work. This discussion draws attention to certain pitfalls in the concept (...) of secularism as defended by the Coalition Avenir Québec government. Second, we present a methodological discussion on how political philosophy can contribute to the formation of law, by examining how our criticism of Act respecting the laicity of the State corresponds to an exercise in implementing Rawls’ own method of thoughtful balance. Background The prioritization protocols for accessing adult critical care in the extreme pandemic context contain tiebreaker criteria to facilitate decision-making in the allocation of resources between patients with a similar survival prognosis. Besides being controversial, little is known about the public acceptability of these tiebreakers. In order to better understand the public opinion, Quebec and Ontario’s protocols were presented to the public in a democratic deliberation during the summer of 2022. Objectives (1) To explore the perspectives of Quebec and Ontario (...) citizens regarding tiebreakers, identifying the most acceptable ones and their underlying values. (2) To analyze these results considering other public consultations held during the pandemic on these criteria. Methods This was an exploratory qualitative study. The design involved an online democratic deliberation that took place over two days, simultaneously in Quebec and Ontario. Public participants were selected from a community sample which excluded healthcare workers. Participants were first presented the essential components of prioritization protocols and their related issues (training session day 1). They subsequently deliberated on the acceptability of these criteria (deliberation session day 2). The deliberation was then subject to thematic analysis. Results A total of 47 participants from the provinces of Quebec (n = 20) and Ontario (n = 27) took part in the online deliberation. A diverse audience participated excluding members of the healthcare workforce. Four themes were identified: (1) Priority to young patients - the life cycle - a preferred tiebreaker; (2) Randomization - a tiebreaker of last resort; (3) Multiplier effect of most exposed healthcare workers - a median acceptability tiebreaker, and (4) Social value – a less acceptable tiebreaker. Conclusion Life cycle was the preferred tiebreaker as this criterion respects intergenerational equity, which was considered relevant when allocating scarce resources to adult patients in a context of extreme pandemic. Priority to young patients is in line with other consultations conducted around the world. Additional studies are needed to further investigate the public acceptability of tiebreaker criteria. Patients in Quebec can legally obtain medical assistance in dying (MAID) if they are able to give informed consent, have a serious and incurable illness, are at the end of their lives and are in a situation of unbearable suffering. Since the Supreme Court of Canada’s 2015 Carter decision, access to MAID, under certain conditions, has become a constitutional right. Quebec physicians are now likely to receive requests for MAID from their patients. The Quebec and Canadian laws recognize a physician’s (...) right to conscientious objection, but this right is contested both in the medical ethics literature and in the public sphere. This paper presents the results of a qualitative study conducted with twenty Quebec physicians who did not integrate MAID into their medical practice, either because they were opposed to or deeply ambivalent about MAID. The interviews aimed to explore the reasons – religious and secular – for opposition to or ambivalence towards MAID. The secular reasons given by participants were grouped into four main categories: 1) the ends of medicine and professional identity, 2) the philosophy of palliative medicine and resource allocation in palliative care, 3) benevolent paternalism, the “good death”, and the interests of future selves, 4) the risk of a slippery slope and the protection of vulnerable people. Dans les sociétés préindustrielles, l’exercice du pouvoir au sein de la famille est étroitement lié aux contingences juridiques et aux normes patriarcales. La connaissance du rôle joué par les femmes dans les activités économiques de la famille, en particulier les femmes mariées, échappe le plus souvent aux historiens. L’étude des procuratrices à Québec, capitale de la Nouvelle-France au xviiie siècle, permet de mieux comprendre le fonctionnement du couple dans un contexte colonial marqué par l’absentéisme masculin. L’analyse des actes de (...) procurations octroyés aux femmes, combinée à une étude prosopographique de nature sociodémographique, révèle les enjeux et les circonstances de ce transfert circonstanciel de pouvoir. Cette voie montre qu’il est possible de contourner partiellement le silence entourant les activités des épouses pour éclairer la délicate question de la complémentarité et de la confiance au sein du couple. At the practical level, Professor Buchanan develops a coherent theory of the conditions under which secession is morally justifiable. He then applies it to historical and contemporary examples, including the U.S. Civil War and more recent events in Bangladesh, Katanga, and Biafra, the Baltic states, South Africa, and Quebec. What does it mean when calls to reconciliation come from dominant social groups? Whom do these calls address? What effects do they have? I take up these questions through a case study of the public discourse on “reasonable accommodation” in Québec. When the Consultation Commission on Accommodation Practices Related to Cultural Differences concluded its tour of the regions and cities of Québec and, in the spring of 2008, the commissioners (philosopher Charles Taylor and sociologist Gérard Bouchard) issued their (...) report on the state of ethnocultural relations, their titular emphasis was on reconciliation. Their report, "Building the Future: A Time for Reconciliation," urged the francophone Québécois majority and immigrant or immigrant-descended cultural and religious minorities in Québec – the two groups between whom the conflict was staged in the discourse of “reasonable accommodation” – each to take its respective responsibility to rebuild Québec interculturalism in the aftermath of its public “crisis.” My case study indicates that when performed by the dominant group, calls to reconciliation can function in a complicated way to reproduce, rather than to transform, existing relations of power. Specifically, in the context of a nation-building project of a white settler society they may bolster, rather than undermine, the social bases of power that characterize such societies. To demonstrate how the discourse of “reasonable accommodation” dissimulates as to its material effects, I invoke Sara Ahmed’s concept of “nonperformativity.”. (shrink)

Les analyses des parcours de vie s’intéressent surtout au repérage des régularités du cycle de vie ou, tout au plus, aux écarts aux modèles types, en termes de retard des événements ou d’allongement des transitions sur les calendriers scolaires, professionnels, résidentiels ou familiaux. Les études empiriques suggèrent pourtant la présence de dynamiques non linéaires évoquant la possibilité que les parcours comportent des « bifurcations » où tout peut être remis en question, pouvant entraîner des changements durables de situation. Ce phénomène (...) est plus souvent interprété en référence à la capacité des individus de faire leurs propres choix qu’en fonction de l’influence possible des cadres institutionnels. L’étude de parcours scolaires et professionnels de jeunes Québécois dans les années 1990 constitue la base de cette réflexion sur la place des bifurcations dans les parcours de vie qui met l’accent sur le rôle des dispositifs institutionnels dans la création d’une flexibilité des structures, sur les phénomènes d’appropriation par les individus des opportunités offertes par cette flexibilité et sur le mouvement des réversibilités et irréversibilités construites à travers ce processus. L’analyse suggère que les individus peuvent s’engager dans des actions en évaluant les possibilités offertes par les institutions qui encadrent la vie sociale, qu’ils sont capables de percevoir les irréversibilités associées aux choix offerts et ainsi, de les prévenir, les exploiter ou s’y adapter. La croissance du nombre de personnes adoptant les mêmes comportements dans une situation donnée accroît ainsi la possibilité que ce choix se transforme en une convention sociale et que les bifurcations s’institutionnalisent.Life course analyses are mainly interested in identifying regularities in the life cycle or, at most, in deviations from typical patterns in terms of a postponing of events or of transitions within educational, career, residential or family trajectories. However, empirical studies point to the existence of non-linear dynamics and suggest the possibility that life paths may also include « bifurcations », where everything is placed in question, and that may lead to lasting changes in situations. This phenomenon is more often interpreted in reference to the individual’s capacity to make personal choices rather than in terms of the potential influence of institutional frameworks. This study is based on an analysis of the educational and career trajectories of Québec youth during the 1990s : it looks at the role of bifurcations in the life course, in emphasizing how institutional arrangements may help to create a flexibility of structures, and explores the phenomena of individuals seizing the opportunities offered by this flexibility. The study suggests that individuals may undertake actions after evaluating the opportunities presented by social institutions, and that they are able to grasp the irreversibility of certain choices and anticipate them, use them to their advantage or adjust their actions accordingly. An increase in the number of persons adopting the same behaviours in a given situation thus also increases the possibility that such a choice may evolve into a social convention and that these bifurcations may become institutionalized. Advocates for re-localizing food systems often encourage consumers to support local farmers and strengthen local food economies. Yet, local food systems hinge not only on consumers’ willingness to buy local food but also on whether farmers have the social support networks to address diverse challenges during food production and distribution. This study characterizes the challenges and support systems of farmers selling to local markets in Québec, Canada, across multiple growing seasons using a mixed-methods research design. We sent an online (...) questionnaire to 1046 farmers and conducted follow-up interviews with 15 of the 133 respondents. Our findings show that farmers relied on an average of four support actor groups, particularly employees, customers, and other farmers. Actors played distinct roles in terms of the importance, frequency, and formality of interactions, providing immediate and long-term support through formal and informal relationships across multiple spatial scales (farm, local community, and regional/international). Our thematic analysis showed that support actors helped farmers in four key domains: (1) Knowledge sharing and emotional support; (2) Labour and workforce; (3) Material and financial aid; and (4) Consumer education and business promotion. Farmer associations provided resources to tackle various challenges, acting as bridges across multiple support actor groups. Yet, our results suggest that political desires to encourage local food systems are in some cases poorly matched with resources to address specific types of challenges farmers face. Specifically, overlooking the role of diverse social support actors in helping farmers build food production and distribution capacity could undermine efforts to foster localization. (shrink)

En mars 2020, les mesures prises autour du monde pour contenir le virus du Covid-19 bouleversent simultanément, et de manière majeure, les rythmes et activités de la vie quotidienne. Cette période est celle durant laquelle la rupture produite par la pandémie a été la plus forte, tant elle était soudaine et inimaginable. Au Québec, les migrants avec un statut de résidence temporaire sont affectés de manière spécifique : ils sont nombreux à travailler dans l’hôtellerie-restauration, secteur contraint de fermer temporairement (...) ses portes, font face à la fermeture des frontières internationales et sont incertains de leur droit à des dispositifs d’aide financière. Affectés simultanément dans plusieurs sphères de leur vie, ils pourraient voir leur parcours bifurquer rapidement. L’analyse de la manière dont la pandémie les affecte, lors de ce premier mois, dégage les multiples temporalités qui articulent l’événement historique macrosocial et les parcours biographiques, pouvant produire des bifurcations futures. Le but général de cette formation est d’éviter que les enfants concernés évoluent à l’âge adulte vers une situation d’exclusion sociale, d’errance, d’internement psychiatrique, ou de violence. Les outils utilisés pour l’évaluation initiale et l’intervention qui peut s’en suivre, reposent sur la même théorie. Une comparaison est effectuée avec le dispositif français.

Par son rôle déterminant dans la réussite scolaire et professionnelle, ainsi que dans l’insertion sociale, l’apprentissage de l’orthographe lexicale représente un défi majeur pour les élèves du primaire. Dans ce contexte, nombreux sont les enseignants, orthophonistes et chercheurs à s’intéresser à la question des outils utiles à son enseignement et à son apprentissage, et à avoir recours notamment à des bases de données lexicales. Bien qu’elles constituent un apport considérable pour le domaine, les ressources existantes souffrent de plusieurs insuffisances. D’une (...) part, elles s’appuient sur des corpus de référence peu représentatifs du lexique scolaire auquel les élèves sont exposés au primaire, et d’autre part, elles ne permettent pas aux utilisateurs de déterminer la façon dont se développe l’acquisition de l’orthographe lexicale. À la lumière de ces constats, nous avons élaboré une ressource lexicale hybride, rendant compte à la fois de la fréquence et des caractéristiques linguistiques du lexique scolaire présent dans les manuels du primaire au Québec et, pour une partie des mots de ce lexique, de la capacité des élèves à les orthographier à chaque niveau du primaire. Dans cet article, nous revenons dans un premier temps sur la méthodologie d’élaboration de cette nouvelle base de données - nommée ÉQOL - dotée d’une Échelle Québécoise d’acquisition de l’Orthographe Lexicale, à l’origine de la création de la base de données. Dans un deuxième temps, nous évaluons l’apport de cet outil. La comparaison de notre base de données (Stanké, Royle, Rezzonico, Moreau, Dumais & Le Mené 2018) à des outils existants (trois bases de données et une échelle d’acquisition lexicale) témoigne de la pertinence de la création d’un outil propre au lexique scolaire adressé aux élèves du primaire et de la nécessité d’utiliser une nouvelle échelle d’acquisition de l’orthographe lexicale, spécifique aux compétences orthographiques des élèves québécois. In order to promote better practices and communication around end-of-life decision-making, several Canadian hospitals in the province of Quebec have developed a tool called “Levels of Intervention”. No work to date has been published demonstrating improvement since these forms were implemented. The purpose of the present study was to obtain information about the use of LOI forms across Quebec hospitals and to identify gaps in practice as well as areas for improvement. A retrospective study was undertaken of 299 charts of (...) patients who had died in three Quebec hospitals with a LOI ordered. Results were analysed through a principlism ethical framework. High compliance with the level of intervention ordered at the time of death was recorded, as well as high involvement of patient and/or family, demonstrating the efficiency of LOI in promoting respect for autonomy. Other results show delays in end-of-life care discussions in the course of the hospitalization. Only a small proportion of patients who died had a palliative care consultation, which may reflect equity issues in access to care. This study highlights the importance of the LOI in Quebec and the role it is playing in respect for end-of-life preferences as well as in the involvement of patients and families in the decision-making process. Training specific to end-of-life decision-making conversations would help support the LOI form’s use, as would developing provincial or national guidelines on the use of LOI to standardize organizational policies and practice around end-of-life care.
