Using the massive 2,500-page report of the Intergovernmental Panel on Climate Change as their guide, these photographers and writers pinpointed nine locales around the world in which global warming has had a measureable impact. In Climate Refugees, they take us to these places—from the dust bowl that was once Lake Chad to the melting permafrost in Alaska—offering a first-hand look in words and photographs at the devastating effects of rising global temperatures on the daily lives of ordinary people. Climate Refugees shows us damage wrought to homes and livelihoods by rapid warming near the Arctic; rising sea levels that threaten the island nations of Tuvulu, the Maldives, and Halligen; farmers displaced by the desert's advance in Chad and China; floods that wash away life in Bangladesh; and Hurricane Katrina evacuees in shelters far away from their New Orleans neighborhoods. One of the most influential of the Victorian philosophers, Henry Sidgwick also made important contributions to fields such as economics, political theory and classics. A proponent of the utilitarianism of Jeremy Bentham and John Stuart Mill, which he analysed in his classic work The Methods of Ethics , he later turned to the practical side of politics in this work, published in 1891. His aim was to have a 'rational discussion of political questions in modern states', and he offers (...) a thorough examination of Victorian politics, beginning with a discussion of political theory before moving on to more concrete matters such as property and law. The later chapters discuss the function of government through themes such as procedural matters, international affairs, war, political parties, and public participation, giving a comprehensive account of both ideas about and the functioning of late-nineteenth-century government. Most people will grant that we bear special moral obligations toward at least some nonhuman animals that we do not bear toward inanimate objects like stones, mountains, or works of art. These moral obligations are plausibly grounded in the fact that many if not all nonhuman animals share important psychological states and capacities with us, such as consciousness, suffering, and goal-directed behavior. But which of these states and capacities are really critical for a creature’s possessing moral status, and how can (...) we determine which animals do in fact have them? In this paper, I examine three main approaches to answering these questions. First are what I term consciousness-based approaches that tackles these questions by first asking which animals are conscious. Second are affective-state approaches that focus on identifying behavioural and physiological signatures of states like pain, fear, and stress. Finally, I consider what I call preference-based approaches whose focus is on the question of which organisms have robust motivational states. I examine the prospects and challenges—both theoretical and empirical—faced by these seemingly contrasting methodologies. I go on to suggest that there are reasons why, despite challenges, we should be robustly committed to the project of identifying psychological grounds of moral status. I conclude by suggesting we should also take seriously the idea of pluralism about moral status, according to which each of these approaches might be capable of providing independent grounds for moral consideration. This paper reviews the history of AI & Law research from the perspective of argument schemes. It starts with the observation that logic, although very well applicable to legal reasoning when there is uncertainty, vagueness and disagreement, is too abstract to give a fully satisfactory classification of legal argument types. It therefore needs to be supplemented with an argument-scheme approach, which classifies arguments not according to their logical form but according to their content, in particular, according to the roles that (...) the various elements of an argument can play. This approach is then applied to legal reasoning, to identify some of the main legal argument schemes. It is also argued that much AI & Law research in fact employs the argument-scheme approach, although it usually is not presented as such. Finally, it is argued that the argument-scheme approach and the way it has been employed in AI & Law respects some of the main lessons to be learnt from Toulmin’s The Uses of Argument. (shrink)

Some have argued that panpsychism offers the most simple view of reality. The most prominent advocate of this argument is Philip Goff. In this paper, I examine Goff’s position and argue that considerations of simplicity and parsimony do not support panpsychism. Quite the reverse: they give us good reason to reject it.

Moral reasoning is individual or collective practical reasoning about what, morally, one ought to do. Philosophical examination of moral reasoning faces both distinctive puzzles — about how we recognize moral considerations and cope with conflicts among them and about how they move us to act — and distinctive opportunities for gleaning insight about what we ought to do from how we reason about what we ought to do.

Raz's method is as unusual, and as admirable, as the substance of his sometimes rather unfortunately labeled "perfectionist liberalism"—unfortunate because "it is not perfectionist in the more ordinary sense of the term" in that it recognizes that "imperfect ways of life may be the best which is possible for people" and "is strongly pluralistic", while understanding its fundamental value of well-being as the active and autonomous making of a life of one's own. Raz's approach is simultaneously alert to the complexity (...) of argument, to a degree that practitioners of practical ethics sometimes are not, and aware of the limits of theorizing, as devotees of theoretical ethics rarely are. Thus, while scorning "supermarket liberalism" and rejecting, in company with Rawls, "hand-to-mouth piecemeal intuitionism", Raz also doubts whether ideal theory in the Rawlsian mode is "a meaningful enterprise", emphasizing wisely, in my judgment, that "not everything we know can be exhaustively stated in the abstract". The "dense webs of complex actions and interactions" that give meaning to our lives "defy explicit learning or comprehensive articulation. They are available only to those who have or can acquire practical knowledge of them, that is, knowledge embodied in social practices and transmitted by habituation". (shrink)

The current debate regarding the suitability of anencephalics as organ donors is due primarily to misunderstandings. The anatomical and neurophysiological literature shows that the anencephalic lacks a cerebrum because of the failure of neuralplate fusion. However, even the incomplete function of an atrophic brain stem is currently accepted at law in most if not all countries as sufficient for brain life: which is to say, cessation of breathing is currently required in order to make the diagnosis of brain death. Because (...) of the extensive incompleteness of the anencephalic's brain, it is not possible to postpone death significantly by mechanical ventilation and intravenous feeding. It is acceptable to maintain life for a short period of time in order to allow organ transplantation subsequent to the declaration of death at the point of cessation of the capacity for spontaneous respiration. The most important issue is not transplantation, but the issue of brain life raised by the case of anencephalics. Since brain life in any significant sense begins only after the closure of the neural tube on the 30th day after conception, it is reasonable to take this as the point at which brain life begins. Laws should be amended in all countries to allow the abortion of anencephalics at any time, in that they do not at any time possess brain life. (shrink)

This brief, but tightly argued, work advances a dual thesis: Kant’s compatibilist solution to the free will problem is best understood in terms of Davidson’s anomalous monism; so understood, it constitutes a viable position, defensible in contemporary terms. The text consists of a short introduction followed by four substantive chapters dealing, respectively, with: Kant’s theory of compatibilism ; Kant and contemporary metaphysics ; Kant’s theory of causal determinism ; and Kant’s theory of free will. Because of the range of topics (...) covered and the thoroughness of its argumentation, this book should be of interest not only to Kantians, but to philosophers concerned with the more general issues regarding compatibilism. Despite the spectacular contributions to knowledge made by molecular biology during the last half century, cancer research has not delivered an agreed explanation of how malignant tumours originate. The models assiduously investigated in molecular terms largely reflect waves of fashion, and time has revealed their inadequacy: cancer is (1) not caused by the direct action of oncogenes, (2) not fully explained by the impairment of tumour suppressor genes, (3) not set in motion by mutations controlling the cell cycle, (4) not (...) governed by the dependence of malignant tumours on an adequate blood supply and (5) not triggered by a failure of programmed cell death. But there is now strong evidence that cancers may have their origin in mutations that block the execution of critical steps in the process of normal differentiation. Cancer, thus seen, is not initially a disease of cell multiplication, but a disease of differentiation. The evidence for this point of view should now be explored. The way of science is to try to deduce the answer to many such questions from a few well defined assumptions. Much about nature can be explained in terms of the principles of classical mechanics. He translated into Latin all he knew of Plato and Aristotle, and was profoundly interested in the issues of theology and philosophy. The Consolations were written while he awaited the execution of a tyrannical death sentence. The Consolations of Philosophy have been translated into English by King Alfred, Geoffrey Chaucer, and Queen Elizabeth I. One of the great merits ofOn Complicity and Compromiseis that it wades into specific swamps where ordinary theorists fear to slog. It is persuasive that in general it can be right sometimes to be complicit in wrongdoing by others through causally contributing to the wrongdoing, but not sharing its purpose, if by being involved one can reasonably expect to lessen the extent of the wrong that would otherwise be suffered by the victims. I focus on whether the book's general thesis (...) is applicable to torture, which depends on what torture and the torture situation are in fact like. I focus on the case to which the chapter several times refers: the innovative CIA paradigm of torture. First, to the extent that the paradigm, which is predominantly mental, or psychological, torture succeeds in its goal of producing regression to a compliant state, the physician would be unable to rely on the torture victim's expressions of preferences or interests as authentically his own. Second, since disorientation plays such a large role in the CIA's style of torture (adopted at Guantanamo by the military), the authorities would refuse to allow a stable relationship to be built up with any one doctor by any victim, making comprehension of the victim's preferences difficult. Third, even if the doctor could somehow judge what the victim's genuine interests were, the control of the situation is much too totalistic to allow the physician any action independent of what the torture regime requires. This paper is the forerunner of an extensive logical analysis of the relativity idea, in which an axiomatic structure based upon the principles of topology is developed. It is meant to expose the manner in which relativity stretches from the pole of pure conception to that of factual observation, from the a priori to the a posteriori. We take pains to show, in connection with special relativity, precisely which elements are postulational and which are verifiable empirically. Our attempt can be (...) somewhat naively characterized as an effort to show how misguided it is to "derive" relativity from such experimental facts as the Michelson-Morley experiment--as so many textbooks profess to do. With the development of the various natural sciences, however, a variety of perspectives on human nature have emerged, most of which are monistic, not dualistic, in character. In (...) contemporary Christian thought, the label 'nonreductive physicalism' has been coined to describe a particular form of monism that represents a concerted effort to bring Christianity into constructive dialogue with scientists and philosophers. 'Physicalism' denotes a basic agreement with scientists and philosophers who maintain that there is no need to postulate a second metaphysical entity (that is, a spiritual soul) to account for the 'higher' human capacities, while 'non-reductive' indicates a rejection of the position that regards the human person as 'nothing but' a physical body.
