Law, Person, and Community: Philosophical, Theological, and Comparative Perspectives on Canon Law takes up the fundamental question "What is law?" through a consideration of the interrelation of the concepts of law, person, and community. As with the concept of law described by secular legal theorists, canon law aims to set a societal order that harmonizes the interests of individuals and communities, secures peace, guarantees freedom, and establishes justice. At the same time, canon law rests upon a traditional understanding of (...) the spiritual end of the human person and religious nature of community.The comparison of one of the world's ancient systems of religious law with contemporary conceptions of law rooted in secular theory raises questions about the law's power to bind individuals and communities. Professor John J. Coughlin employs comparative methodology in an attempt to reveal the differing concepts of the human person reflected in both canon law and secular legal theory. Contrasting the contemporary positivistic view of law with the classical view reflected in canon law, Law, Person, and Community discusses the relationship between canon law, theology, and natural law. It also probes the interplay between the metaphysical and historical in the theory of law by an examination of canonical equity, papal authority, and the canon law of marriage. It juxtaposes the assumptions of canon law about church-state relations with those of the modern liberal state as exemplified by U.S. first amendment jurisprudence. No scholarly work has yet addressed this question of how the principles and substance of canon law, both past and present, relate to current issues in legal theory, such as the foundation of human rights and in particular the right of religious freedom for individuals and communities. In this engaging and provocative study, John Peter Kenney examines the emergence of monotheism within Greco-Roman philosophical theology by tracing the changing character of ancient realism from Plato through Plotinus. Besides acknowledging the philosophical and theological significance of such ancient thinkers as Plutarch, Numenius, Alcinous, and Atticus, he demonstrates the central importance of Plotinus in clarifying the relation of the intelligible world to divinity. Kenney focuses especially on Plotinus's novel concept of deity, arguing that it (...) constitutes a type of mystical monotheism based upon an ultimate and inclusive divine One beyond description or discursive knowledge. Presenting difficult material with grace and clarity, Kenney takes a wide-ranging view of the development of ancient Platonic theology from a philosophical perspective and synthesizes familiar elements in a new way. His is a revisionist thesis with significant implications for the study of Greco-Roman, Jewish, and Christian thought in this period and for the history of Western religious thought in general. Hermeneutics as we understand it today is an essentially modern phenomenon. The chapter presents observations that illustrate some of the central ways in which the modern and late modern phenomena of philosophical hermeneutics relate to the ancient philosophical legacy. First, the roots of hermeneutics are traced to ancient views on linguistic, textual, and sacral interpretation. The chapter then looks at certain fundamentally unhermeneutic elements of the Platonic, Aristotelian, and Augustinian “logocentric” theory of meaning that philosophical (...) hermeneutics and its heirs sought to call into question, reconsider, and deconstruct. Augustine's De doctrina christiana, can be regarded as an epitome and culmination of the ancient protohermeneutic heritage, theological as well as philological. Finally, Aristotle's practical philosophy, particularly the notion of phronesis, “practical insight”, is designated as an implicit ancient prototype of hermeneutic thinking, the reappropriation of which lay at the core of the Heideggerian and Gadamerian philosophical projects. This chapter is about personhood in relation to ethics and to conciliar Christian theology, and how concepts of personhood may discriminate against profoundly cognitively disabled human beings. (By ‘conciliar Christian theology’ I mean the Christian theology that is articulated in, or endorsed by, the first seven ecumenical councils.) -/- I believe we can learn several things about personhood by looking at these two topics together. By examining ancient and medieval concepts of personhood and some modern conceptions (...) of personhood we gain a better grasp of the variety of concepts and what substantive work they were intended to do. By becoming familiar with (part of) the history of concepts of personhood we are better situated to appreciate and judge the theoretical work that these concepts were intended to do and what consequences they have in ethical and theological theorizing. -/- In the first section I tell a select history of moral philosophers theorizing about personhood and discuss these in relation to human beings with profound cognitive disability. I focus on John Locke, Immanuel Kant, and Mary Anne Warren. In the “When Personhood Is Discriminatory” section I argue that concepts of personhood, especially modern concepts of personhood, are typically used in a manner that discriminates against human beings with profound cognitive disabilities. I give two arguments against discriminatory uses of personhood, the Moral Shift Argument and the Argument against Exclusive Personhood. Although the Moral Shift Argument is deductively valid, it probably has little persuasive power over those who do not share the moral belief that profoundly cognitively disabled human beings are equal members of the moral community. However, the Argument against Exclusive Personhood has more argumentative force because it denies the claims that personhood is “self-evident” and that it is “obvious” to everyone. In the following section I survey a select history of concepts of personhood in order to establish the claims that concepts of personhood are not self-evident and are not obvious to everyone. This history of personhood goes back to ancient and medieval Christian theorizing and debating about personhood. It shows that concepts of personhood are not “self-evident” but rather are theoretical posits that are posited in theory construction in order to explain certain putative theological facts. Given that personhood is a theoretical posit and is not “self-evident,” moral philosophers who aim to determine the extent of the moral community on the basis of a supposedly “self-evident” concept of personhood are not justified in doing so. Moreover, given the Argument against Exclusive Personhood, philosophical theologians who wish to articulate models of the Trinity or Incarnation that are consistent with the seven ecumenical councils will find that they, like moral philosophers, are not justified to assume, or to insist on, modern personhood for their models of the Trinity or Incarnation. Each professional researcher of the religious and philosophical tradition of Ukraine XI-XIV centuries. convinced of the glow of theoretical understanding of the manuscript corpus of texts of a certain period, realizes that 90% of the monuments of that time are waiting for study, knows that the subject-based, scientific sources are aimed at reconstructing how the beginning and the end were presented, stages, goals, the factors, essence and meaning of world history in the culture of are still in the embryonic (...) phase, and the problem of understanding the role of the Holy Cross in the historical process has not been raised or analyzed yet by the bearers of this culture. These facts lead to an attempt to fill the existing lacuna. (shrink)

God providentially guided the ancient classical authors into the perception of truths and the unmasking of errors. Even the errors they never caught are instructive. For Calvin, the only proper response to this rich intellectual heritage for a devout Christian people called to love God with their minds as well as with their hearts must always remain profound gratitude.

As an exercise in comparative philosophical theology, our approach is more concerned with conceptual strategies than with historical “influences,” although the animadversions of those versed in the history of each period will assist in reading the texts of each thinker. We need historians to make us aware of the questions to which thinkers of other ages and cultures were directing their energies, as well as the forms of thought available to them in making their response; but we philosophers (...) hope to be able to proceed without having to arm ourselves with extensive knowledge of the surrounding milieu, trusting that others more knowledgeable will correct and extend our efforts. Our contribution should then be one of offering perspectives within which further discourse may profitably proceed, suitably challenged and amended in the course of a common inquiry. Since my familiarity is with Aquinas, and since he comes chronologically first, I shall begin with him, though there is no discernible connection between the two thinkers other than their preoccupation with establishing the primacy of existing in a metaphysical discourse which had hitherto obscured its significance. This second collection of studies by Peter Golden continues his explorations of the Türk Empire (mid-sixth to mid-eighth centuries), the stateless polities that appeared after its collapse, and of the Khazar Qaghanate (mid-seventh century to ca. 965-969), its imperial successor state in the western Eurasian steppes. Building on earlier traditions, the Türks created a paradigm for state building in the Eurasian steppes that persisted into the early modern era. Examined here are issues relating to the rise of the Türks and (...) their systems of governance, the institution of slavery and its role in Turkic nomadic societies, and the cultural interactions between the Turkic nomads of Pre-Chinggisid Eurasia and neighbouring settled societies such as the Kievan Rus', Georgia and the Islamic world. Particular studies deal with the hitherto neglected role of Khazars in the Islamic ghulâm (slave soldier) system, the unique traditions of sacral rulership among the Khazars, and their conversion to Judaism set within a larger Eurasian context. What, at this historical moment "after Auschwitz," still remains of the questions traditionally asked by theology? What now is theology's minimal degree? This magisterial study, the first extended comparison of the writings of Theodor W. Adorno and Emmanuel Levinas, explores remnants and echoes of religious forms in these thinkers' critiques of secular reason, finding in the work of both a "theology in pianissimo" constituted by the trace of a transcendent other. The author analyzes, systematizes, and formalizes this (...) idea of an other of reason. In addition, he frames these thinkers' innovative projects within the arguments of such intellectual heirs as Jürgen Habermas and Jacques Derrida, defending their work against later accusations of "performative contradiction" (by Habermas) or "empiricism" (by Derrida) and in the process casting important new light on those later writers as well. Attentive to rhetorical and rational features of Adorno's and Levinas's texts, his investigations of the concepts of history, subjectivity, and language in their writings provide a radical interpretation of their paradoxical modes of thought and reveal remarkable and hitherto unsuspected parallels between their philosophical methods, parallels that amount to a plausible way of overcoming certain impasses in contemporary philosophical thinking. In Adorno, this takes the form of a dialectical critique of dialectics in Levinas, that of a phenomenological critique of phenomenology, each of which sheds new light on ancient and modern questions of metaphysics, ethics, and aesthetics. Based on a philosophical interpretation of the Ancient concepts, philia and agape, the present contribution offers a comparative study of the ancient Greek ethics of friendship and the Christian theology of love. While the former tradition understands philia as a finite relationship between human selves within a sociopolitical context, agape is regarded by the latter tradition as the bond of love which God grants all humans who believe in Jesus Christ as the Messiah. Despite the fundamental (...) differences between the two conceptions of love, they converge at one point, namely in the caring concern for the stranger, who humans are called upon to receive in hospitality. The article is devoted to the analysis of research on the philosophical heritage of the Kyiv Theological Academy of the early twentieth century at the National University of Kyiv-Mohyla Academy. The experience of this particular institution in studying the philosophical heritage of the Kyiv Theological Academy of the early twentieth century, which began to be comprehended in Ukraine only in the 1990s due to the taboo of this issue in the Soviet period, is interesting both for its systematic (...) nature (it goes back about 30 years) and for the wide range of research, due to the novelty of the subject of historical and philosophical research and the large source base that needed to be processed (books, journal and newspaper publications, archival materials). The article also focuses on the fact that the study of philosophy at the Kyiv Theological Academy of the early twentieth century takes place at the Department of Philosophy and Religious Studies, which simultaneously studies the theological heritage of the Kyiv Theological Academy of this period and, in particular, the history of ancient and German classical philosophy, which were the focus of the scientific interests of the professors of the Kyiv Theological Academy. The analysis of the corpus of historical and philosophical publications by the specialists of the National University of Kyiv-Mohyla Academy allows us to represent the main spectrum of directions of their study of the philosophical heritage of the Kyiv Theological Academy of the early twentieth century, namely comprehension and articulation of the basic methodological principles of research (in particular, cultural, biographical and source studies approaches); reconstruction of the peculiarities of teaching philosophical disciplines at the Kyiv Theological Academy; analysis of the topics and specifics of philosophical research at the KTA; study of the philosophical heritage of individual personalities, taking into account biographical, institutional, cultural and historical contexts. In addition to a substantive analysis of the scientific achievements of the NaUKMA specialists, highlighting the main directions of their study of the philosophical heritage of the Kyiv Theological Academy of the early twentieth century, the article also examines the fundamental two-volume encyclopedia ‘Kyiv Theological Academy in Names: 1819-1924’. Christians affirm that Scripture alone reveals truths about God which cannot be known by mere reason, such as the Trinity or the Gospel itself. But how do we account for Scripture’s apparent talk of a knowledge of God possible solely from creation? Or for our own sense of the divine in nature? The so-called "Theology of Aristotle" is a translation of the Enneads of Plotinus, the most important representative of late ancient Platonism. It was produced in the 9th century CE within the circle of al-Kindī, one of the most important groups for the early reception of Greek thought in Arabic. In part because the "Theology" was erroneously transmitted under Aristotle's authorship, it became the single most important conduit by which Neoplatonism reached the Islamic world. It is referred to (...) by such thinkers as al-Fārābī, in an attempt to demonstrate the agreement between Platonism and Aristotelianism, Avicenna, who wrote a set of comments on the text, and later on thinkers of Safavid Persia including Mullā Ṣadrā. Yet the "Theology" is not just a translation. It may in fact more accurately be described as a creative paraphrase, which takes frequent liberties with the source text and even includes whole paragraphs' worth of new material. Adamson's book offers a philosophical interpretation of the changes introduced in the Arabic version. It is argued that these changes were in part intended to show the relevance of Plotinus' thought for contemporary Islamic culture, for instance by connecting the Neoplatonist theory of the First Principle to theological disputes within Islam over the status of God's attributes. At the same time the paraphrase reflects a tendency to harmonize the various strands of Greek thought, so that a critique by Plotinus of Aristotle's theory of the soul is subtly changed into a defense of Aristotle's theory against a possible misinterpretation. The upshot, or so Adamson argues, is that the "Theology" needs to be read as an original philosophical work in its own right, and understood within the context of the ʿAbbāsid era. (shrink)

The author proves the inadequacy of previous studies of Maximus the Confessor’s theological system. These studies paid little attention to the originality of transformation of Cappadocian Fathers’ teaching by this thinker. The paper demonstrates that Maximus turned out to be ahead of his time in his ontological reinterpretation of the previous patristic tradition. A revolutionary version of Christian Platonism created by Maximus the Confessor, requires new stu-dies, especially in comparison with the ancient philosophers.

This book examines the work of the Czech Philosopher Jan Patočka from the largely neglected perspective of religion. Patočka is known primarily for his work in phenomenology and ancient Greek philosophy, and also as a civil rights activist and a critic of modernity. He also maintained a persistent and increasing interest in Christianity, Martin Koci shows, and indeed his first and last publications concerned religion and theology. This book examines the theological motifs in Patočka's work, and brings his (...) thought into discussion with recent developments in phenomenology, making a case for Patočka as a forerunner to what has become known as the theological turn in continental philosophy. Koci systematically examines his thoughts on the relationship between theology and philosophy, and his perennial struggle with the idea of crisis. For Patočka, modernity, metaphysics, and Christianity were all in different kinds of crises, and Koci demonstrates how his work responded to those crises theologically. Thinking Faith after Christianity thus provides new insights on theology understood as the task of thinking and living transcendence in a problematic world. It perceives the un-thought element of Christianity - what Patočka identified as its greatest resource and potential - not as a weakness, but as a credible way to ponder Christian faith and the Christian mode of existence after the proclaimed death of God and the end of metaphysics. The Cambridge Platonists are modern thinkers and the context of seventeenth-century Cambridge science is an inalienable and decisive part of their thought. Cudworth’s interest in ancient theology, however, seems to conflict with the progressive aspect of his philosophy. The problem of the nature, however, of this ‘Platonism’ is unavoidable. Even in his complex and recondite ancient theology Cudworth is motivated by philosophical considerations, and his legacy among philosophers in the eighteenth and nineteenth centuries should not (...) be overlooked. In particular we will draw on the scholarship of the German Egyptologist Jan Assmann in order to reassess the significance of Cudworth’s theory of religion for later philosophical developments. Cosmogonic myths, also referred to as creation myths, are theological and philosophical explanations of ancient myths of creation within a religious Homo sapien hamlet. In the context of this article, the word myth is attributed to the extravagant quixotic interpretation in anecdote of what is accomplished or ceased as a key or essential phenomenon. The terms or language concepts of cosmogonic or creation invoke the start of things, whether by the desire and action of a surpass Actuality, by (...) emergence from some eventful Actuality or by an additional alternative process. Mystics, scientists, philosophers and theologians of today set forward a method, to my mind, of pluralistic interpretation of the whole understanding and interpretation of a cosmogonic and creation myth that includes a variety of Actualities, in the world, according to basic Western and Eastern religious and rational classifications. These rational classifications have a phenomenological epistemic impact and even a certain righteousness of whoever wants to believe whatever of creation. Let it be …, as it should be ontological and epistemological and be positive for theologians as objects and religious sapiens as subjects. (shrink)

The Primacy of God, the notion of justice toward God is seldom considered and often foreign. Far more discussed is how God might either undermine or motivate social justice. The Primacy of God by R. Jared Staudt offers an important intervention. With the aid of St. Thomas Aquinas, Staudt argues that it is vital for both contemporary society and contemporary Catholic theology to return to the traditional view of God as the one to whom all human and social action (...) must be ordered and to recover the virtue of religion as the virtue which orders all other virtues to God. Not only does Staudt helpfully remind readers of the ancient philosophical and biblical notion of worship as a dictate of the natural law, he also illuminates the way in which Christian liturgy, as an enactment of Christ's high priesthood, is the great fulfillment of natural and biblical worship. Accordingly, Staudt secures religion as essential for the virtue of love. This brings Staudt to criticize modern theologians like Karl Barth, who claimed that religion is inherently idolatrous, as well as Karl Rahner, who claimed that love of neighbor is the highest moral act. Staudt also considers the question of religious truth in light of the plurality of religions, soliciting the assistance of Hans Urs von Balthasar and Joseph Ratzinger, as well as the way in which religion relates to the development of culture, engaging the great Catholic social historian Christopher Dawson. The Primacy of God is a much-needed work that ought to set the agenda for Catholic theology in the twenty-first century. (shrink)

In the ancient conversation between Western philosophy and Christian theology, powerful contemporary voices are arguing for monologue rather than dialogue. It offers something of a (...) consolidation of Schumacher's recent work, particularly on the Summa Halensis, where she and others have sought to clarify and establish the sources behind many of the fundamental philosophical and theological positions articulated by prominent members of the early Franciscan Order and faculty at the University of Paris in the first decades of the thirteenth century. Success in this endeavor has afforded scholars a more accurate sense of both the diverse array of auctoritates, particularly non-Christian, from whom these theologians freely drew, as well as the subsequent influence of their work upon the later medieval intellectual tradition. Indeed, Ian Barbour's well-known typology defining four canonical modes of the science-religion relationship—conflict, independence, dialogue, and integration—has played an organizing role but has not satisfied everyone.3 Although our purpose here is not to recapitulate these discussions, it might be helpful to mention an issue that frequently arises within them: whether Barbour's classification is necessarily exhaustive, and in particular, if what he understands by "integration" is really the perfect culmination of a link that could connect science and faith. Thus, some authors prefer to speak of [End Page 71] "interaction," "compatibility," or "articulation" to describe this relationship, either replacing or superimposed upon Barbour's integration modality.4We believe that at least part of this series of controversies results from the lack of fundamental definitions and distinctions. "Science" is not univocal but an analogous term, since it can be predicated both from extremely diverse disciplines and also from a cognitive act, a habit, or a corpus of knowledge.5 On the other hand, "faith," "religion," and "theology" have neither identical meanings nor even an analogous epistemic scope in different religious traditions. All this outlines a problem whose many edges cannot be enclosed within the margins of a categorization, however nuanced.This article aims to illustrate the complexity of the relationship between science, philosophy, and theology, using as a case study the contribution of contemporary embryology and developmental biology to theological reflection on the Incarnation of Jesus Christ. We begin by examining some theological hypotheses that, using the biological knowledge and speculations of their time, attempt to deepen our understanding of the mystery of the incarnate Word. Next, we propose an interpretation of the conception of Jesus Christ, in which the facts contributed by biology could enrich, and perhaps illuminate, certain aspects of theological reflection. It is a time when theology becomes a field of philosophical and theoretical reflection on myth and an area of its artistic and aesthetic experience. First, we will examine the ancient sources of the concept of the two-level will (Plato and Augustine). Then, we will focus on the views of John Duns Scotus on the types of acts of will, with particular emphasis on the concept of non velle and its application in philosophical and theological issues. It is only recently that this field has gained a few notable entries in philosophical (...) works of reference like the Routledge Encyclopedia or the Oxford Dictionary—but still it cannot make its way into the histories of medieval philosophy, not to mention the general histories of philosophy. Byzantine Philosophy aims at providing good reasons for changing that tendency and seeks to "persuade [us] that Byzantine Philosophy is worth investigating" (13).The book contains eleven articles, plus Ierodiakonou's introduction and Linos Benakis's review of the current research, read in part at a Conference held in Thessaloniki, Greece in 1997, but it is more than a mere collection of conference papers. Written both by well-established and younger scholars from diverse disciplines, the volume focuses on the explicit or implicit dialogue of Byzantine thinkers with ancient Greek philosophy, one of the two ingredients of Byzantine Philosophy (the other being patristic thought).Ierodiakonou in her introduction prefers to make a few—but penetrating—remarks on the nature of Byzantine Philosophy and its proper study. Her arguments are presented in a non-conclusive form and they are intended to serve as guidelines to further research. While a longer discussion of the issues involved would be welcome by the less-specialized reader, her choice seems reasonable as long as one thinks—rightly in my opinion—that it is premature to embark on general methodological suggestions about how to investigate Byzantine Philosophy, or believes that scrutinizing the texts themselves is a more promising approach at this relatively early stage of research (as perhaps always).With one exception, each article deals at length with a special issue spanning from metaphysics to political philosophy and concentrates on individual thinkers from the patristic era to the Renaissance; the absence of philosophical theology is surprising. Expectedly the presence of Aristotle can be traced in logic: in an eleventh-century humble handbook (thoroughly analyzed by Jonathan Barnes); in Psellos's Paraphrase on Aristotle's De Interpretationeand in the anti-logical movement in the fourteenth century (Ierodiakonou); as well as in John of Damascus's discussion of will (Michael Frede). On the Christian-neoplatonic tradition are founded a nominalistic position of Basil of Caesarea concerning the semantics of proper names (Paul Kalligas); a sixth-century treatise On Political Science (Dominic O'Meara); Psellos's conception of philosophy (John Duffy); and the peculiar case of Chaldaean Oracles and their commentators (Polymnia Athanassiadi). The last article on the Renaissance controversy between Plethon and Scholarios over the primacy of Plato or Aristotle (George Karamanolis) brings the volume appropriately to an end.That Platonism and Aristotelianism nearly monopolize the contributors' concerns is justified but this must not give the simplified impression that Byzantine Philosophy can be exclusively explained against this background. Other Greek philosophical traditions, such as Stoicism, are mentioned as well, and the fourteenth-century interest in skepticism is densely discussed (Börje Bydén on Metochites). The first essay is an informative outline of the Greek-Latin Philosophical Interaction (Sten Ebbesen), whose inclusion in the volume makes a similar survey of ancient Greek-Byzantine philosophical interaction more warranted.The contributors do not confine themselves to resolving specific problems of a Quellenforschung, by identifying parallel texts or recurring arguments in order to establish the obvious dependence of Byzantine thought on Greek Philosophy. In fact, as many articles show, it is the very analysis of patristic and Byzantine texts that makes us return to their ancient sources and also makes clear how this revisiting can deepen our understanding of the texts and the philosophical problems they are trying to present or to solve.
