There is a need for empirically based research on social and ethical challenges related to informed consent processes, particularly in studies focusing on adolescent sexual and reproductive health. In a pilot study of a school-based pregnancy prevention intervention in rural Zambia, the majority of the guardians who were asked to consent to their daughters’ participation, refused. In this paper we explore the reasons behind the low participation in the pilot with particular attention to challenges related to the community engagement (...) and informed consent process. The pilot was implemented in two schools and examined the acceptability of a package of interventions including economic support to families to keep their girls in school, pocket money for girls, youth club meetings on reproductive health, and community meetings to sensitize the community. Focus group discussions were conducted with girls who participated in the pilot, boys in their class and with parents. Individual semi-structured interviews were conducted with teachers, peer educators and community health workers involved in the coordination of the intervention as well as with religious and traditional leaders. Data were analyzed through thematic analysis. The findings indicate that inadequate use of recognized community communication channels during the community engagement process and dissemination of information about the pilot resulted in limited understanding of the pilot concept by the community. This surfaced through uncertainty and fear that the intervention may result in loss of control over daughters, worries about why money was provided unconditionally to girls, and suspicion of links to satanism. The sense of insecurity appeared to be exacerbated by low literacy levels, poverty, fear of loss of bride wealth, perceived disregard for local perceptions of social status, and scanty trust in the actors implementing the pilot. Inadequate use of locally appropriate channels in the dissemination of information created room for interpretation and facilitated development of mistrust, undermining the conditions for community engagement and actual informed consent. A key lesson learnt is the importance of taking seriously the complexity of local values and structures that may impact people’s capability to consent or not consent to a study in an informed manner. Cognitive neuroscience constitutes the third phase of development of the field of cognitive psychophysiology since it was established about half a century ago. A critical historical overview is given of this development, focusing on recurring problems that keep frustrating great expectations. It is argued that psychology has to regain its independent status with respect to cognitive neuroscience and should take psychophysical dualism seriously. A constructive quantum physical model for psychophysical interaction is presented, based on a new stochastic (...) class='Hi'>interpretation of the quantum potential in the de Broglie–Bohm theory. This model can be applied to analyze cognitive information processing in psychological experiments. As a result of their blistering assault, religious ethicists and philosophers now (...) find themselves operating within a discursive milieu that is almost the photo negative of the one they previously inhabited. For what has followed After Virtue and After Christendom is a situation in which compliance with liberal democratic norms is now perceived as actively inveighing against justice rather than as an integral prerequisite to its pursuit.There are cracks, however, beginning to emerge in the MacIntyre/Hauerwas edifice. For what is becoming disputed and increasingly so among a growing chorus of religious ethicists and philosophers is whether their critical reading of liberal democracy offers the most [End Page 155] helpful or even the most biblical way to think through its own moral dimensions as well as those undergirding its relationship with justice.It is the emergence of these criticisms that forms the basis for this essay. For what they discover upon a more careful probing of its moral and epistemological underpinnings is a pursuit of transcendence not dissimilar to Gnostic metaphysics. In the case of liberalism, however, the existential encumbrances to be excised are not corporeal and carnal in nature, but historical and social. In this essay, I attempt to portray those elements crucial to the teaching and learning process of art education using Disneyland as a structural as well as a functional metaphor. The Happiest Place on Earth? Disneyland is depicted as "a dream world" and "the happiest place on earth." As described in various incisive essays, Disneyland is a symbol of modern American culture, an ultimate form of the consumer society or the hegemony of entertainment. 1 To start with, the structural elements of this epitome of Walt Disney's vision are outlined.Walt Disney created Main Street USA (the World Bazaar) to make all visitors feel as if they are the leading character in a Disney film, walking through the main street of life. Woolfolk Keywords borderline personality disorder, values, psychotherapy, diagnosis IT IS A PLEASURE to comment on Nancy Potter's elegantly written, provocative paper. Professor Potter raises important and intriguing issues that have not only clinical implications for practitioners, but also are of theoretical significance for those (...) who ponder the conceptual status of mental illnesses and their manifestations.Borderline personality disorder (BPD) is the mental health professional's bête noire. In the diagnostic context, borderline is an adjective that is evocative, albeit imprecise. Persons with BPD tend to the worst of multiple pathological worlds, to fall through the diagnostic cracks, to occupy the boundaries of decorum and safety. Even such intrepid and astute folk as Marsha Linnehan and Otto Kernberg, who have devoted careers to understanding and treating those with BPD, have acknowledged the limited state of current knowledge. Justice Stewart's theory of natural concepts seems to apply to patients to whom we give the label borderline personality disorder: we cannot define the disorder readily, but we know one when we see one. And when we see such a patient it is costly in time and stress and corrosive of one's sense of professional efficacy. So with these patients, any assistance in conceptualizing the problem or in modification of therapeutics is welcome.Professor Potter's phenomenological formulation of self-injury is cogent and helpful in a number of ways. Self-injurious behavior is, when conventionally interpreted, a prototype for irrationality and affliction. It is also dramatic, graphic, and often repugnant. Professor Potter's analysis brings us face to face with what most of us know but sometimes forget or fail to apply: Psychotherapy is a value-laden endeavor. Early on, both Max Weber and Carl Jung were eloquent on this point and we have been reminded often enough of it in the last four decades (Rieff 1966; Woolfolk 1998; Woolfolk and Murphy, in press). Usually it is the moral values residing in the underlying ideologies of treatment and diagnosis that are brought to our attention. The axiological underpinnings of psychotherapy, however, are aesthetic as well as ethical. Professor Potter successfully argues that, as therapists, we may be in the thrall of a parochial aesthetic that produces [End Page 29] a kind of tunnel vision inimical to therapeutic effectiveness and to the ethical treatment of the human beings who are our patients. She has impeccable advice for therapists on this topic: Although none of us can step outside of culture altogether, we can evaluate our attitudes, beliefs, and values from a second-order level (Taylor 1989; Frankfurt 1971). Complete objectivity is an unlikely ideal. But clinicians can, and should, think critically about ways in which prevailing norms and values may be influencing their understanding of the world and their ways of being in it. (Potter 2003, 11) Professor Potter also quite effectively persuades that a comprehensive understanding of disorders that occur mostly in women (e.g., somatization disorder) must effectively comprehend feminist scholarship and the sociocultural realities of gender. The concept of the commodification of the female body has been informative in both the epidemiology and treatment of yet another woman's disorder, anorexia nervosa. And although the linkages of somatic commodification to self-injurious behavior may not appear to be so straightforward, the paper points the way to deeper and possibly richer explanations of phenomena that seem at first glance to be inexplicable.The introduction of the concept of uptake into clinical contexts is also a valuable contribution. Those of us familiar with the traditions of psychotherapy recognize a concept both familiar and central. Uptake has family resemblance to the empathic attitude so extensively discussed by both Rogers and Kohut. Those with hermeneutic leanings will recognize affinities with Verstehen and the Gadamerian anticipation of completeness (Vorgriff der Vollkommenheit). Several contemporary interpretations of quantum mechanics use the concept of information as a tool for addressing and explaining the quantum world. In the article, I focus on Zeilinger-Brukner's informational foundations of quantum theory. I propose that with a phenomenological approach—which, unlike most of the contemporary interpretations of quantum mechanics, exceeds the mere dichotomy between realism and anti-realism—we can address the epistemological questions re-opened by IFQT and the parts of the interpretation that are recognized as problematic by its (...) critics. After the phenomenological supplementation IFQT can provide both, ontic and epistemic answer to the question "Why quantum?" As we apply Husserl's concept of the world as our common objective ground to the IFQT explanation, we can make a justifiable step away from the solipsism/subjectivism, which is, according to the critics, the main problem of IFQT. Thus, I propose in conclusion, a phenomenological approach to quantum physics can offer a background for the much needed dialog between realists and anti-realists as well as for a comprehensive contemporary interpretation of the quantum world. This paper reflects my address as IAAIL president at ICAIL 2021. It is aimed to give my vision of the status of the AI and Law discipline, and possible future perspectives. In this respect, I go through different seasons of AI research : from the Winter of AI, namely a period of mistrust in AI, to the Summer of AI, namely the current period of great interest in the discipline with lots of expectations. One of the results (...) of the first decades of AI research is that “intelligence requires knowledge”. Since its inception the Web proved to be an extraordinary vehicle for knowledge creation and sharing, therefore it’s not a surprise if the evolution of AI has followed the evolution of the Web. I argue that a bottom-up approach, in terms of machine/deep learning and NLP to extract knowledge from raw data, combined with a top-down approach, in terms of legal knowledge representation and models for legal reasoning and argumentation, may represent a promotion for the development of the Semantic Web, as well as of AI systems. Finally, I provide my insight in the potential of AI development, which takes into account technological opportunities and theoretical limits. (shrink)

Can a country with a free press and a robust political debate provide its citizens with actionable information so that they can protect themselves from a threat to their health or safety? By actionable information, I mean accurate facts and reasonable interpretations of those facts upon which an individual should rely in making reason-based decisions. In the context of public health, this includes information that allows an individual to weigh the risk to one’s self, (...) family, and community before deciding to act in an uncertain environment under threatening conditions. The recent H1N1 pandemic, and in particular the government’s campaign for public acceptance of the vaccine, highlights the challenges in ensuring that individuals receive accurate information and perceive that such information should be the basis on which to make potential life-saving decisions. How did my dream of a populist marketplace turn into a nightmare?—Richard Posner, Artist vs. PublicLike Posner, many faculty members enter the academy as idealists, optimistic that their goals for and the promise of higher education will be fulfilled and their quest for knowledge inspired, (...) only to discover years later that they have become pragmatist realists.1 For many, change is necessary for survival, career success, and fulfilling dreams. At what point, however, might otherwise idealistic, visionary, and highly capable people become oppressed, disillusioned, and/or marginalized as professors? Under what conditions do professional dreams of transforming education and critical pedagogy become frustrated by rigid adherence to the status quo? How might initial aspirations of achieving a higher education become politicized and racialized as seemingly inescapable nightmares?For some faculty—particularly those of color and, especially, women working in historically white institutions—the assault on dreams occurs not only in nightmares during sleep but as monochrome, white-mares while awake.2 So, what does it mean just to be a professor in an environment where the simple quest to teach, conduct research, and serve can be frustrated by faulty, stereotypical, and often hostile assumptions, attitudes, and reactions to gender and skin? How might professors in these circumstances [End Page 83] respond to social constructions that manifest as body politics and racialized consciousness while simultaneously celebrating their identity, inner spirit, and cultural self—their ideals and visions? How do professors in these situations respond to institutional policies and practices and the social, cultural, and political nuances of place? Further, how can professors learn from their experiences and strive for meaningful transformation without the risk of being viewed as an "other," "unorthodox," an "activist," or worse?In this article "teacher as public art" is used as a metaphor to describe and explain the all-too-common perceptions and experiences of professors of color, especially women, within the academy. More specifically, this article reports findings from a qualitative study focused on what it means to be a woman of color in the academy. The findings presented are consistent with those encountered in a growing body of literature on the topic. Like other work in this area, an analysis of historical contexts can provide a critical link to understanding the cultural nuances framing the formation of professors' work identities. Triangulated data for this study included a visual art exhibition, personal reflections on the experiences of teaching in higher education, and formal research involving women faculty of color. Data were analyzed and interpreted based on literature defining the three worlds of professorship (scholarship, teaching, and service). The presentation of results and findings included here is intended to encourage further conversation regarding the retention, promotion, and tenure of faculty of color.Information and PerspectiveHighlighted throughout this discussion are (1) the relevance of locating self within the context of people and place; and (2) the importance of bringing meaning, authenticity, and credibility to teaching and research through continued reflection, self-assessment, and inquiry. The case presented is essentially a first attempt to accomplish these goals using self-study, personal experience, and public knowledge as an integrated vehicle for professional transformation. As both the researcher and a participant, the process required that I be simultaneously subjective and objective in order to examine the multiplicity of dialogues related to the professional self. In other words, the process required that I honor the voice of the person within—for example, artist, professor, woman, person of color—while, as a researcher, at the same time honoring the voices of those who participated in the study. As someone who came late to the academy (I was forty when I received my first tenure-track position), I drew for this study not only upon my prior experience and identity as a professor and educational researcher but also upon a myriad of pre-academy experiences and identities as, for example, an artist, art educator, administrator, and aspiring social reformer. The Byzantine dreambook known in the tradition as The Oneirocriticon of Achmet has had a long and influential history both in its field and in scholarship. It is the longest of the eight surviving Byzantine books on dream interpretation, and most likely also the oldest. It was compiled during the Macedonian renaissance—specifically, the two termini of 843 and 1075 can be established—possibly in the reign of Leo VI (r. 886–912), to whom it may have been dedicated, and possibly through (...) the influence of his Arab minister Samonas. It was translated early into Latin, in 1176 (by contrast, the famous ancient dreambook of Artemidorus was not translated until 1539), and “through this translation found its way into several European and vernacular languages from the late thirteenth century onward” (p. 4). The scholarly study of the work began in 1577, with the preface Johann Loewenklau wrote for his Latin translation of the Greek text, and continued apace to this day. The book by Maria Mavroudi under review here, from which this information is taken (chapter 1), is the latest in a long series of studies. It is also the most exhaustive and meticulous in its research and the first fully to take into account, in a professional and exemplary manner, the Arabic sources of the work. Exhaustive, but perhaps also exhausting—one may object that 471 pages of text (exclusive of prefatory material and bibliographies and indices) for a study of a mere dreambook may be too many, though apparently necessary, for Mavroudi's book contends against the weight of previous scholarship and offers much needed correctives. The subject of this study is the problem of the failure of attempts by the scientific community to come to a common understanding of what exactly information can be as something encoded into material structures and moved along with them. At the same time, the following aspects of this problem are considered in detail: what is the immediate cause of the information problem; what are the objective and subjective prerequisites for its appearance; why the unresolved nature of (...) this problem does not interfere with the creation and development of communication systems, control and other "smart" devices; is there any general guideline for finding solutions to such problems, and what is it; what role did the philosophy of information play in turning the problem of information from a private scientific problem into a problem of the ideological level. The main results of the conducted research are as follows: the immediate cause of the information problem has been identified and a comprehensively substantiated solution to this problem has been given; it has been revealed that the incompleteness of the materialistic theory of cognition has become a fertile ground for the appearance of this problem; the circumstances that prevented its completion have been identified; the natural mechanism of control and cognition has been revealed, as a result of which the materialistic theory of cognition has been further developed the source of the ideal in the material world is revealed; it is shown that the mechanistic idea of information coding made the concept of information incompatible with the presence of any objective content; it is revealed what is actually hidden behind the words about information coding and its measurement; the nature of signals and signs is revealed; a kind of bias of the philosophy of information and a general error is revealed all known concepts of information. The authors of the article with reference to the discussions about the status of knowledge in the postmodernism discourse and the "crisis of the intellectual" presented in the works by J.F. Lyotard and Z. Bauman, consider these issues in the context of other social challenges. Interpreting the conducted empirical research results, the research also focuses on the multidisciplinary theoretical analysis of philosophical, psychological and pedagogical literature. The authors note that in the absence of metanarratives, the phenomenon of intellectuals (...) and intellectual work is transformed: postmodern epistemology has changed the opportunities of mass education about how things should stand / what to have / how to act into the multiple / polyphonic / variable / fragmentary / collage dissemination of knowledge. As an argument in the "crisis of intellectuals" discussion, the authors analyze the educators` need and motivation sphere emphasizing constant knowledge enhancement to be a priority for them, which logically affects professional identity reconstruction carried out through self-reference. The paper presents an opinion that intellectuals lack self-perception as a reference social group. We conclude that in the information society, public interaction with the media affecting the reconsideration of the intellectual`s role and status serves as a basis for their legitimation. The results of the conducted survey enable us to conclude that raising educators` intellectual level affects their competences in professional practices. The status of the intellectual-educator is legitimized by their activity in training sessions, discussions, meet-ups and other events. The study presents an algorithm for constructing the intellectual-educator in the conditions of social reality challenges. The research substantiates demand for the intellectual-educator who is IT literate, capable of professional reflection, open to change, motivated for continuous self-development, ready for the reconstruction of professional identity from a knowledge transmitter to an erudite, a creative coach, a supervisor and a moderator. One can see, comparing the translations, howLiu recast Jāmī's work in Chinese philosophic language, paraphrased some difficult passages, summarized others, and added his own commentaries.Interestingly, Liu eliminated Jāmī's Persian poetry. Murata thinks this is because Liu wanted to focus on the hard ideas; I suspect that it was because Liu realized that Persian prosody and imagery were too far from Chinese poetry to please his audience.Both Wang and Liu belonged to what must have been a rather loose but some-how connected circle of Chinese Islamic scholars. Both, also, almost necessarily used language fairly widespread in Chinese philosophy. Terms such as "emptiness" and "transformation" had many Chinese resonances, some most un-Islamic (Neo Confucian and Buddhist, for instance).Neither Chittick nor Murata give any glosses for key philosophical terms in either source language. Their philosophical and religious provenance, Chinese or Muslim, is correspondingly unclear.What is clear is that Neo-Confucianism had a strong influence on these scholars. Haqiqa "reality" is often translated as li "principle." Pen-jan "root nature" is used for the Arabic compound "essence and attributes." These examples are discussed in the introduction (p. 19). "Annihilation" becomes "conquering" (pp. 148-149). This is strange, because "Annihilation" (fana') is a technical term in Sufism for the disappearance of the self in God; it is an Arabic term, and literally means something like. "passing away." It signifies the forgetting or loss of self, such that only contemplation of the Divine remains. It is as close to the Divine as humans can get since, in Islam, humans cannot be absorbed into Allah (as, in Buddhism, they can be absorbed into Nirvāṇa or the Buddha-nature). "Conquering" seems a rather strange way to express this in Chinese. Perhaps Chinese Muslim readers of the time had developed this specialized sense for it.There are, of course, debatable translations here to contend with (both from Persian and Arabic to Chinese and from Persian and Chinese into English), but it appears that real incommensurability is involved. In inclusive dance settings, where people with different abilities and talents come together, the role of facilitators is essential in guiding the process of inclusion. Their behavior gives sensitive information to the individual about one’s status within the own-group affiliation. Even today, very little research on the motivation for facilitating inclusivity in dance contexts exists. This case study will examine the facilitator’s motivation by juxtaposing current theory next to experiences of seven experts of contemporary dance facilitation in (...) Europe. Good opportunities for meaningful interactions can be created in a dance setting: it promotes a deeper sense of community, gives us the feeling of belonging, generates respect and inclusion, and helps to prevent the feeling of loneliness. This research report sheds light on the motivation of being the facilitator of dance for heterogeneous groups and reveals three factors from the data. First, to be led by an artistic motivation, second, to have a vision in terms of changing the society, and third, to have another personal motivation. The motivation of the facilitator is regarded as highly important for inclusive work, as the person who facilitates plays a key role in these successful processes of inclusion. (shrink)

The experience of the use of applied containerized biomedical software tools in cloud environment is summarized. The reproducibility of scientific computing in relation with modern technologies of scientific calculations is discussed. The main approaches to biomedical data preprocessing and integration in the framework of the intelligent analytical system are described. At the conditions of pandemic, the success of health care system depends significantly on the regular implementation of effective research tools and population monitoring. The earlier the risks of disease (...) can be identified, the more effective process of preventive measures or treatments can be. This publication is about the creation of a prototype for such a tool within the project «Development of methods, algorithms and intelligent analytical system for processing and analysis of heterogeneous clinical and biomedical data to improve the diagnosis of complex diseases», implementted by the V.M. Glushkov Institute of Cybernetics, National Academy of Sciences of Ukraine, together with the United Institute of Informatics Problems, National Academy of Sciences of Belarus. The insurers, entering the market, can insure mostly low risks by facilitating more frequent changes of insurers by consumers and mixing the overall health insurance market. Socio-demographic variables can be risk adjusters. Since age and gender have a relatively small explanatory power, other socio-demographic variables were studied – marital status, retirement status, disability status, educational level, income level. Because insurers have an interest in beneficial diagnoses for their policyholders, they are also interested in the ability to interpret relevant information – upcoding: insurers can encourage their policyholders to consult with doctors more often to select as many diagnoses as possible. Many countries and health care systems use diagnostic information to determine the reimbursement to a service provider, revealing the necessary data. For processing and analysis of these data, software implementations of construction for classifiers, allocation of informative features, processing of heterogeneous medical and biological variables for carrying out scientific research in the field of clinical medicine are developed. The experience of the use of applied containerized biomedical software tools in cloud environment is summarized. The reproducibility of scientific computing in relation with modern technologies of scientific calculations is discussed. Particularly, attention is paid to containerization of biomedical applications, this permits to get reproducibility of the conditions in which the calculations took place, technologies of software pipelining of calculations, that allows to organize flow calculations, and technologies for parameterization of software environment, that allows to reproduce, if necessary, an identical computing environment. The main approaches to biomedical data preprocessing and integration in the framework of the intelligent analytical system are described. The experience of using the developed linear classifier, gained during its testing on artificial and real data, allows us to conclude about several advantages provided by the containerized form of the created application: it permits to provide access to real data located in cloud environment; it is possible to perform calculations to solve research problems on cloud resources both with the help of developed tools and with the help of cloud services; such a form of research organization makes numerical experiments reproducible, i.e. any other researcher can compare the results of their developments on specific data that have already been studied by others, in order to verify the conclusions and technical feasibility of new results; there exists a universal opportunity to use the developed tools on technical devices of various classes from a personal computer to powerful cluster. In light of the ramifications for Spenserian hermeneutics in the Proems to Books Two (“unseen” reality) and Three (“living art”) of The Faerie Queene, this essay reads Prince Arthur’s account of his dream-vision of Gloriana (1.9) as an allegory for how the reader ideally should encounter and make meaning from the poet’s text. Spenser’s concept of “living art” echoes Dante’s “living language,” and both show the influence of Augustine, especially as regards the readerly agency called for in the Christian (...) Doctrine and the Confessions. Places of textual obscurity (the “unseen”) mark opportunities for the reader to exercise and develop the capacity to generate interpretations, a process both the effect and the cause of virtue. This process is figured in Arthur’s memory of his dream of the Faerie Queen and how it inspires him to pursue her. (shrink)

In an online, participatory class, we interpreted The Dream of the White House knowing nothing of the dreamer and having none of the dreamer’s associations. Our interpretation included a series of falsifiable predictions about the dreamer. When it was complete, we asked the bringer of the dream (who had until then been silent and was not visible to us) to give us more information about the dreamer. Of 17 predictions 15 were confirmed. The dreamer suffers dislocation and loss (...) until she asks a female manager for help. This record is another iteration of an experiment that will be described more fully in the paper 'The Dream of the Six-Legged Dog: An Experimental System to Test Meaning,' soon to be published. This iteration repeats and confirms the evidence given in that paper. More than any of the other iterations, it details how talk therapy promotes personality reorganization. It then supports these observations with experimental evidence. Because it demonstrates how talk therapy works, this iteration supports talk therapy against pressure from the drug and insurance corporations. This interdisciplinary article takes a philosophical approach to The Interpretation of Dreams, connecting Freud to one of the few philosophers with whom he sometimes identified - Immanuel Kant. It aims to show that Freud's theory of dreams has more in common with Bion's later thoughts on dreaming than is usually recognized. Distinguishing, via a discussion of Kant, between the conflicting 'epistemological' and 'anthropological' aspects of The Interpretation of Dreams, it shows that one specific contradiction in the (...) book - concerning the relation between dream-work and waking thought - can be understood in terms of the tension between these conflicting aspects. Freud reaches the explicit conclusion that the dream-work and waking thought differ from each other absolutely; but the implicit conclusion of The Interpretation of Dreams is quite the opposite. This article argues that the explicit conclusion is the result of the epistemological aspects of the book; the implicit conclusion, which brings Freud much closer to Bion, the result of the anthropological approach. Bringing philosophy and psychoanalysis together this paper thus argues for an interpretation of The Interpretation of Dreams that is in some ways at odds with the standard view of the book, while also suggesting that aspects of Kant's 'anthropological' works might legitimately be seen as a precursor of psychoanalysis. The United States Constitution embodies both the real and the ideal. It is a concrete written text that uses particular words, has a history, and possesses certain limits; it is also a statement of the aspirations and dreams of a society. This dual identity requires that the Constitution be understood both as written positive law, and as an expression of a national vision and set of ideals. ;I argue for a conceptual theory of law that is positivistic in the sense (...) that it relies for the identification of law on social conventions that form the foundations for determining what counts as law. My view is drawn from H. L. A. Hart's legal positivist view, but it departs from this view to argue that judicial custom can be, along with Hart's rule of recognition, an additional social custom that provides criteria for identifying and creating law. Judicial custom involves the acceptance over time by judges of certain principles as authoritative in the context of adjudicative decisionmaking. I contend that both rules and principles can be part of law, and that principles attain the status of law through judicial custom. ;I rely on this understanding of law to argue for a theory of constitutional adjudication that is an alternative to both originalism and traditional non-originalist theories. Originalism is the view that judges can decide constitutional cases exclusively on the basis of two grounds: the text or the original intentions or understanding of its framers. The theory of law that I defend accepts that these grounds are important for any constitutional decision, but holds that constitutional decisions can also legitimately be made on the basis of constitutional theories. Such theories explain the often broad and abstract language of constitutional provisions by articulating hypotheses about the principles that underlie the text. I argue that the central constitutional commitment is to each individual's right to self-determination. This requires protection of an aspect of personal liberty that involves the deeply personal and unique nature of each person's aspirations, ideas, and initiatives. (shrink)

This article traces the roots of transhumanism's soteriology and eschatology and then examines the underlying anthropological problems that drive the hoped-for salvation through digital immortality. Unfortunately, the admirable desire to extend life sacrifices an (...) appreciation for the integral harmony of the human person's animal and spiritual dimensions. Since human actions manifest the person's intrinsic corporeality, attempts to detach the human personality from the body through digitalization would produce replicas of the dead without achieving true immortality. The surprising quasi-religious thrust of contemporary transhumanism's secular eschatology presents an opportunity to rediscover the Catholic patrimony's reflection on authentic divinization through the transhumanizing effects of divine grace. The article thus concludes with a Thomistic theosis-centered reorientation of secular transhumanism's eschatological aspirations for immanent immortality toward true human flourishing. [End Page 841]The Secular Eschatology of Contemporary TranshumanismThe leading transhumanist philosopher, Oxford University professor Nick Bostrom, thinks that his movement will provide real solutions to the perennial problems of humanity that traditional religions have tried and failed to address:While not a religion, transhumanism might serve a few of the same functions that people have traditionally sought in religion. It offers a sense of direction and purpose and suggests a vision that humans can achieve something greater than our present condition. Unlike most religious believers, however, transhumanists seek to make their dreams come true in this world, by relying not on supernatural powers or divine intervention but on rational thinking and empiricism, through continued scientific, technological, economic, and human development.1Yet, for all its protests against antiquated creeds, secular transhumanism frequently tends toward quasi-religious expressions. For instance, Meghan O'Gieblyn finds striking parallels between the evangelical and transhumanist worldviews she has embraced and abandoned during her life.2 Her writing explores her harrowing transition from Christian fundamentalism to trans-humanism and her eventual disillusionment with the techno-movement. Bible school had taught her about the various epochs of salvation history and her position within the "dispensation of grace" that marked the final preparation for the longed-for "millennial kingdom." As an adult, she spurned the false promises of organized religion and sought a more rational organization for her life. Later, a book recommendation plunged her into the thought of Google guru Ray Kurzweil and his narrative of evolutionary eras pointing toward an imminent "singularity" in which intelligent machines would emerge from an informational explosion. Such advanced robots would bring digital immortality through mind uploads and a nanotech new earth [End Page 842] that would put Eden to shame. Through his projects, Kurzweil purports to continue the Enlightenment tradition of empirical science and rational rigor. Similarly, many transhumanists tend to follow their Enlightenment predecessors in chiding traditional religion for obscurantist opposition to scientific progress. Nonetheless, O'Gieblyn discovered that the very movement that pretends to supplant the superstitions of the old-time religion is itself "a secular outgrowth of Christian eschatology."3The Christian-trained author could not help but detect familiar religious themes in the technocentric movement. Before it spread through the offices of Silicon Valley, the term "transhuman" first appeared in Henry Francis Carey's 1814 version of Dante's Paradiso, where the poet pilgrim recognizes that not even his own genius can describe the joy of risen life when he writes, "words may not tell of that transhuman change."4 Recent efforts to substitute supernatural resurrection with technological advancement find antecedents in the thirteenth-century friar Roger Bacon's quest for an elixir of life. Later, the nineteenth-century Russian Orthodox philosopher Nikolai Fedorov claims humans should use technology to control Darwin's unguided evolutionary process. The aim of this article is to determine how can new interpretations of old institutes change the status of the taxpayers and tax administrators and to suggest what can the Ministry of Finance do to solve the problem – it can try setting a uniform interpretation of tax institutes. It deals with two findings of the Constitutional Court of the Czech Republic concerning two institutes described in Tax Administration Act: time-limits for tax assessment and tax inspection; and (...) one finding of the Highest Administrative Court concerning local taxes. Court interpretation is only one of several possibilities of interpretation. This report concerns the fragmented visual percepts in a woman, TR, following a right entorhinal–perirhinal infarct. In a previous report, Weddell [Weddell, R. A. . A visual disorder producing highly selective deletion of recurring letters. Cortex, 41, 471–485] linked TR’s highly selective tendency to delete recurrent letters with her fragmented percepts. The conflation of same-identity form elements was attributed to anterior extrastriate damage, which reduced the amount of information sustainable in fully resolved visual percepts, and the present experimental (...) investigation of her subjective account of segment formation and resolution completes the story. She said that complex objects and long words first appeared as blurred regions, which sometimes included form elements. It is argued that figure-centred attentional mechanisms subdivided this blurred region into up to 3–4 parts. String length, lexical status , and background colour and/or luminance determined fragment length. Two rules described the fragment resolution sequence: largest segments usually resolved first, left-to-right resolution accounting for a few sequences. This resolution sequence occurred when stimuli were exposed too briefly for saccadic exploration, implicating endogenous attentional shifts. Experiment 4 confirmed TR’s assertion that spatial, orthographic, and phonological information were stored during the fragment resolution process. Moreover, TR exerted considerable voluntarily control over the fragment resolution sequence and some influence over fragment length. Finally, these findings were interpreted in terms of an extended version of a neural network model of vision largely derived from nonhuman primate studies. (shrink)

The article considers the problem of images and the role they play in our reflection turning to evidence provided by two seemingly very distant theories of mind together with two sorts of corresponding visions: dreams as analyzed by Freud who claimed that they are pictures of our thoughts, and their mechanical counterparts produced by neural networks designed for object recognition and classification. Freud’s theory of dreams has largely been ignored by philosophers interested in cognition, most of whom focused solely (...) on the linguistic incarnation of thoughts, but even though commonly neglected by respectable theories of thinking, dream images may prove to be the key to the black box of thought. As argued in this article, when seen from the right perspective and approached with the right set of questions, oneiric visions yield groundbreaking insights into the mechanism of how concepts and judgments are formed. Support for this conclusion comes from a tradition seemingly remote, if not opposed to psychoanalysis: the mechanical model of the mind conceived by information sciences and embodied in the form of artificial neural nets which mirror the activity of human visual cortex producing visions strikingly similar to those created by the sleeping mind. These purely mechanical, artificial ‘dreams’ constitute byproducts of algorithms designed for object recognition and classification, which, as I shall argue, reveals the true purpose of our own oneiric visual formations. Just like their mechanical counterparts produced by neural networks, condensations and displacements encountered in dreams are in fact visual universals. (shrink)

The paper delves into the methodological aspects of how foundational mathematical and physical tenets, most notably the principle of least action, are interpreted and assimilated within humanities discourse. The pursuit of the article’s objectives is driven by the necessity for a philosophical and methodological analysis of the current conceptual status of the principle of least action. This analysis is informed by cognitive-axiological and teleological imperatives of a “synthetic” development program for the principle. Any fundamental principle will not have a (...) definitive explanation, as otherwise it would not be fundamental, but in this case, some justification can be given based on deeper grounds discussed in the article. Drawing on the epistemological frameworks of French philosophers P. Hadot, E. Levinas, J. Bouveresse, and J.-T. Desanti, the article weaves together mathematical abstractions with human experience and philosophical doctrines with physical theories. J.-T. Desanti’s perspective on mathematical objects as an outcome of human activity is examined. Also scrutinized is B. Nicolescu’s concept of transdisciplinarity, which challenges the traditional subject-object dualism in science. The author’s methodological stance emerges from a dialectical viewpoint, one that eschews a simplistic dichotomy between materialism and idealism and is grounded in rigorous scientific inquiry and an exhaustive examination of the subject matter itself. The principle of least action, as a paramount principle in physics, is shown to exemplify a legacy of innovation, positioning it as both methodologically insightful and heuristically valuable. The paper also highlights how this principle diverges from the classical principle of economy. The broader goal – within the context of “sustainable development,” transdisciplinary studies, and creative industries – is to establish the principle of least action as a paradigmatic imperative for interaction within social and economic systems. The conclusions drawn from this study contribute to a deeper understanding of the principle’s essence, the nature of transdisciplinarity, and confront the vestiges of scientism in the humanities. At the beginning of Martin Heidegger’s lecture “Time and Being,” presented to the University of Freiburg in 1962, he cautions against, it would seem, the requirement that philosophy make sense, or be necessarily responsible (Stambaugh, 1972). At that time Heidegger's project focused on thinking as thinking and in order to elucidate his ideas he drew comparisons between his project and two paintings by Paul Klee as well with a poem by Georg Trakl. In front of (...) Klee's Saints from the Window and Death of Fire —though we wouldn’t absolutely understand what we were seeing—he writes, “we should want to stand…a long while.” In a similar manner, of Trakl’s poem “Septet of Death”—although it is likely we are unsure in what we hear—Heidegger states that, “we should want to hear…[it] often.” Heidegger further states that in appreciating these, “we “should abandon any claim that [they] be immediately intelligible” (1). So also we must we approach, Heidegger continues, the realm of theoretical physics, in which the difficult work of Werner Heisenberg, be listened to “without protest” and without “any claim that he be immediately understood.” These works, like his own project, merit the time they take to be originally (mis)understood. But this is not necessarily true for philosophy, Heidegger advises, because, “That thinking is supposed to offer ‘worldly wisdom’ and perhaps even a ‘way to a blessed life’” (1). Philosophy is in the unique position of being both abstract (what do we talk about when we talk?) and at the same moment, useful. There are demands that it make sense, that it be, grounded, immediate, and most importantly, rational. Heidegger draws these comparisons between the works of Klee and Trakl and Heisenberg not to claim that philosophy is totally irresponsible. He does not claim that the poet, the painter, nor the physicist have acted irresponsibly. Rather, he would say, they are rising to the highest levels of intelligibility, though it is perhaps an intelligibility that is commonly unavailable to us. In Trakl’s case, as we shall see, mastery is the end result of difficult words. Instead, Heidegger seems be making pleas: for a period of uninterrupted unintelligibility (pure unintelligibility); and that there is a time (that time is now) when, “thinking is…placed in a position which demands of it reflections that are far removed from any useful, practical wisdom” (1-2). Heidegger argues that philosophy requires a period of time in which, instead of focusing on the practical—or even on the worldly—the discipline draw its “determination” instead from the place of painting and poetry and physics. In doing so, “we should have to abandon any claims to immediate intelligibility” (2). But Heidegger doesn’t offer this as a way out. We still have to turn up, we “still have to listen, because we must think what is inevitable, but preliminary” (2). The point for Heidegger, is not to listen to a series of propositions, but instead to “follow the movement of showing” (2). Speaking separates the human from the animal world, and despite advances in primatology that seek to give ‘voice’ to primates and other non-human animals, it can safely be said that our form of communication—what we call speech and know as language—is the most advanced, the most complicated. We use it to present and represent the world around us; through actual utterances (vocalization) or through the written word or through ‘unvoiced thoughts’ and dreams. We use language, but more specifically speech—naming—to transmit moods, thoughts, desires, aversions, and feelings. These expressions, mere utterances, nearly always find a source in words, whether spoken or not. Heidegger writes that this common view of language means “that only speech enables man to be the living being he is as man. It is as the one who speaks that man is—man” (187). Speaking then—utterance—surrounds us constantly, whether in the form of careful thought—in the form of an academic paper, say—or in the half mutterings and forgotten thoughts of a nearly remembered dream. Like scaffolding, the apparatus of speech sustains and explains the world, making, in a sense, the world rational, making it apparent. When we speak, we describe, and in doing so, name the world. We use words, through this process of naming, to interpret and sustain the world we see, and the world we imagine. Like Rilke’s naming of jug, and bridge, and window, and stream, we describe—and inscribe upon—the world through an activity of naming. Are we here, perhaps, to name? Is it possible not to name? Is it possible to regard and to view and to look around without naming what we see? Is it possible to feel—to experience—world without giving utterance to that feeling, that process? Sadness, grief, joy, ecstasy, hunger, thirst. Desk, light, room, pen, book, world. White, black, tomorrow, today. Each of these words is a name given to a thing I see in front of me, or a concept that I imagine (in the case of tomorrow or world). What arises in my mind has already existed. If I imagine it, it is named. The word for ‘tomorrow’ and ‘desk’ and ‘light’ precedes me, and precedes my concept of it. The idea of it is already pre-informed, and I must, in a certain sense, bend my ideas to it. When I imagine a table, I imagine my own table (or I imagine an idea of table) but that imagining must follow certain general rules; while, perhaps, it might not always require four legs and a horizontal surface, it must, at least not be, say, a pool of water, or a pile of excrement. It must have some tableness to it to be a table. It must, with Heidegger, table. Otherwise, speech is reduced to gibberish. For Heidegger however, the discussion of language points to something deeper than its “scientific and analytic” study as a communicative device. Indeed, Heidegger seeks to understand language not in reference to man or woman, not as an utterance of humanity, but in reference to itself. In doing so he abandons the conversation—that is, he casts away the traditional arguments surrounding philosophy of language; that it is a means of expression; that it is a human activity; and that it is somehow a representation of something that is—in order to seek to understand language as language, on its own terms. Heidegger is not a philosopher of language, but a philosopher of world, of being. Despite these “correct ideas” holding sway “over the whole field of the varied scientific perspectives on language…they ignore completely the oldest natural cast of language” (191). What is this “oldest natural cast of language? It is the act of language itself. Language is language and language speaks. “Most often,” Heidegger writes, “and too often, we encounter what is spoken only as the residue of a speaking long past” (195). Speech, as we normally encounter it, is like Echo herself calling out to Narcissus, doomed to repeat what has already been said, a mere remnant of what was once language, a trace left behind in the gathering silence of becoming. In both the essay “Language” and in his three lecture course “The Nature of Language” (1982), Heidegger attempts to unpack the seeming tautology of language as language. In each, he focuses on poetry as a way out, or into, a true discussion of the oldest natural cast of language. Poetry is pure speech. In poetry, language is brought to language and language speaks ( Die Sprach spricht ). In the act of poetry, the act of pure speech, the poet names (on the surface not different from how I name this table, this computer) but in the poet naming, the naming does not “hand out titles,” “apply terms,” but rather the naming is a call, a calling forth of entities that bring them into their own, allow them to take their place purely, without compromise. This calling, Heidegger (2001) states, “here calls into a nearness. But even so the call does not wrest what it calls away from the remoteness, in which it is kept by the calling there. The calling calls into itself and therefor always here and there—here into presence, there into absence” (196). II. Window with falling snow is arrayed, Long tolls the vesper bell, The house is provided well, The table is for many laid. Wandering ones, more than a few, Come to the door on darksome courses. Golden blooms the tree of graces Drawing up the earth’s cool dew. Wanderer quietly steps within; Pain has turned the threshold to stone. There lie, in limpid brightness shown, Upon the table bread and wine. Georg Trakl “A Winter Evening” Heidegger is often given short shrift as an abysmally difficult writer, as one that makes no sense and is needlessly difficult. In doing this though, we forget sometimes his eloquence, his simple beauty in writing. Of the above opening stanza, “Window with falling snow is arrayed/ Long tolls the vesper bell.” he writes (2001), This speaking names the snow that soundlessly strikes the window late in the waning day, while the vesper bell rings. In such a snowfall, everything lasts longer. Therefore the vesper bell, which daily rings for a strictly fixed time, tolls long. The speaking names the winter evening time (197). The speaking names the winter evening time. It is almost impossible to comment on that one line by Heidegger. It is as though it must exist on its own completely, without elucidation—as though in front of it we must stand as we do in front of a painting by Klee, that is, we must abandon any claim . Silent and devoted. The speaking of the poem here is not clearly different from common speech ( rede ) yet there is, via Heidegger, an invitation to experience that auracular quality of light and stillness that a gentle, dusk tinged snowfall gives; words evoking a quality so clear, so poignant that, in a sense, Heidegger’s work, at this moment, has been done. But what does this naming accomplish? What does the call call? Remember, it is not the poet that calls, but the naming which calls. The poet has only brought the words forward; it is now the words— snow, vesper bell, window— that take new life in the pure language of the poem. Entities are called forth into presence, like the speaking that names the winter evening time. Not to be present amongst us now, however; naming ‘table’ in the poem does not place it in front of us in this room. Rather, the naming places entities into a gathering which is also a sheltering. The naming brings them to be. In an act of appropriation, things come to be purely as their own, unimpeded by a predetermined expectation. They are called to themselves into an arrival. In Being and Time (1962), Heidegger famously describes the movement between present-at-hand and ready-to-hand in his analysis of the hammer, and of equipment in general. This analysis is already known, if not always clear, to most readers of Heidegger. Briefly, a hammer is ordinarily zuhanden or ready-to-hand; it is part of the background of the world, equipment used and never thought about, like this desk, this sheet of paper, this room. Our interaction with it is temporary and it is historically different for each entity and each relation. We need a hammer, we use a hammer. If all goes according to plan, the hammer remains ready-to-hand; it remains, in a sense, undisclosed and certainly unobtrusive. Our world is undisturbed by the hammer. Only when the hammer or the car or the computer is broken (or sometimes unused or unrecognized or missing) does it intrude into our world, become conspicuous as an object present-at-hand, or vorhanden . In this case, we reach for the hammer, it is broken and we suddenly notice it’s being, broken though it is. The thing which was always ready to hand—handy—is suddenly abstract, something to be examined, if only in its absence or disfunction. This can be exhibited for all entities, and it is important to note that in this analysis the zuhanden / vorhanden split is not restricted to a specific form of constructed material; zuhanden does not refer to the car, and vorhanden the sunset. No entity is ever exclusively ready-to-hand or present-at-hand; they are instead, interpenetrated with each others mode of being, one informing the other in a way that both brings things forth into the world—discloses is the word Heidegger chooses—and at the same time conceals them. As one mode is coming to be so another mode is withdrawing. This flux and movement between modes is precisely what brings the world forward, and what makes it manifest. It exists beyond where we tread and before man took dubious control of the world. We go to find a book or turn on the computer and it is missing or broken and we become aware of the object, as though for the first time. We walk to the water to glimpse the sunset and miss it, or it is less than stellar; in the sunset’s grayness, we become aware of it’s being sunset. The thing is disclosed in its withdrawal. Echoing Heraclitus, we can say that as something is coming to be, it is already becoming something other. Of similar importance to the fact that things are never all of one, or all of the other, they are also never alone. The hammer is never a single object, but is in relation always to the whole. Heidegger (1962) states, Equipment—in accordance with its equipmentality—always is in terms of its belonging to other equipment: ink-stand, pen, ink, paper, blotting pad, table, lamp, furniture, windows, doors, room. These ‘Things’ never show themselves proximally as they are for themselves…What we encounter as closest to us…is the room; and we encounter it not as something ‘between four walls’ in a geometrical, spatial sense, but as equipment for residing…it is in this that any ‘individual’ item of equipment shows itself. Before its does so, a totality of equipment has already been discovered (97). Equipment resides—dwells—in its relations, in its proximal being to other beings. Within the structure of totality, a series of relations is always occurring. The hammer is on the workbench in the carpenter’s hand in the workshop in the village under the sky and under the sun. It doesn’t stop there. Equipment surrounds us and the focus is not on what it does, or what one does with it—the carpenter with the hammer, the writer with laptop—but with the fact that it is. Equipment occurs in relation and is always occurring around us overhead, underfoot, by the stream and in the city. There is a constant exchange of relations happening, and as this occurs, so the world occurs, so the world both discloses and withdraws, into and out of itself. In a very real sense, language is also equipment. It is the thing that we use most often without thought, it is ready-to-hand (except when it’s not.) As we re- cognize the world around us, as we offer names for things and make lists, we are using language much like we might use a hammer, that is, bluntly. Most of the time it is invisible and we draw on it without wondering how we are going to say something. When language does intrude, it does so in an awkward moment, that moment when we can’t remember the right word, when we forget a phrase. At that second, it “speaks itself as language,” it reveals itself as malfunctioning equipment, and we “undergo” an experience with language, in Heidegger’s famous formulation. Language is not a tool anymore that we use to bludgeon an object, but something instead that we submit to, that we experience. In “The Nature of Language,” Heidegger (1982) writes, But when does language speak to us as language? Curiously enough, when we cannot find the right word for something that concerns us, carries us away, oppresses or encourages us. Then we leave unspoken what we have in mind and, without rightly giving it a thought, undergo moments in which language itself has distantly and fleetingly touched us with its essential being (59). The poet’s words become themselves, become appropriate, only when they no longer function in the prosaic world; they instead intrude as they come to be. Language itself brings itself to language. Names, like the entities they indicate, are always becoming something else. As noted above, language, through the poet, has brought forth entities from words previously “known.” I thought that I knew snow, but through Trakl’s re- presentation of the word, language calls forth a new image of snow, indeed calls forth snow itself. The vesper bell tolls longer, the table is for many laid. In bringing forth things , language has brought the world to presence. In everyday naming, word occludes world, preventing, in its everydayness, its coming forth, its disclosing. But what is this world that word has been brought forth into? In the same way that language speaks, world worlds. World, left alone, un-interfered with, comes into itself. It worlds. Again, this sounds like a tautology, but it is essential to Heidegger’s thought (and in my mind is more of a “god killer” than Nietzsche.) One of the most overlooked (and under-appreciated) aspects of Heidegger is his later examination and enthusiasm for the “fourfold,” or the system through which things come to be, through which things thing in a world worlding. The fourfold is the interaction of earth and sky, mortals and gods. Things come to be in the interstices and gathering of the fourfold. The fourfold provides both a place of being, and a sheltering, a place to dwell. Heidegger writes that “the things that were named, thus called, gather to themselves sky and earth, mortals and divinities. The four are united primally in being toward one another, a fourfold.” The poet has called, through the act of pure naming, things to come forth. In the purity of the fourfold—that is, when that is all that there is, when there are no other distractions, definitions, things—entities themselves can come to be. It is important to note that Heidegger is not saying that there are four formal things in the world, autonomous entities unto themselves. He is not evoking a pre-Socratic formula as to what makes up the world; instead, the four mirror each other constantly. (Heidegger calls this the ‘mirror-play.’) They interpenetrate in the same way that the modes of being of things interpenetrate themselves. There is no discrete exclusivity in being or the fourfold. What makes up things is not a precise recipe of the four main components; what makes up things is the action of the fourfold coming together, the movement of the fourfold which is a becoming. Heidegger (2001) writes that “this gathering, assembling, letting stay is the thinging of things.” And he later adds that “thinging, things are things. Thinging, they gesture—gestate—world” (197). Language brings the world to be. It works not again as a recipe added to things, but instead it is a bridge, or more precisely, a relation. Language relates world to thing, brings world to thing. In a sense, it does not say anything; rather it allows, or calls in its movement. Heidegger (2001) writes that, The intimacy of world and thing is not a fusion. Intimacy obtains only where the intimate—world and thing—divides itself cleanly and remains separated. In the midst of the two, in the between of world and thing, in their inter, division prevails: a dif-ference (199). It is in this inter that language prevails. Language is difference, it is the differential aspect between world and thing that brings world to thing. In the final stanza of Trakl’s poem “The Winter Evening,” Trakl evokes this difference in the second line when he writes, “Pain has turned the threshold to stone.” Christopher Fynsk, in his essay “Noise at the Threshold,” draws attention to this point when he writes “it is the figure of the threshold that is language itself, inasmuch as language is defined as the articulation of difference by which difference comes about” (25). Language, as used in the pure language of the poem, draws together world and thing, bridging relation between entity and world. The calling of language calls world to thing, world to being. Heidegger (2001) describes this difference as unique; “of itself, it holds apart the middle in and through which world and things are at one with each other” (200). III. Neither reading nor writing, nor speaking—and yet it is by those paths that we escape what has been said already, and knowledge, and reciprocity, and enter the unknown space, the space of distress where what is given is perhaps not received by anyone (99). Maurice Blanchot The Writing of Disaster So far, we have allowed Heidegger to put forward what language does, how it functions as a relation and how it operates as a threshold, as a bridge. What interests me is what happens beyond language, beyond the relation. What happens to the thing without the naming, without the poet, or even without the everyday chatter—Fynsk calls this ‘noise’—intruding on being? If language allows things to become by bringing thing to world, what happens when we remove this bringing, this threshold turned to pain? In “The Nature of Language,” Heidegger examines the work of the poet Stefan George, specifically “The Word”: Wonder or dream from distant land I carried to my county’s strand And waited till the twilight norn Had found the name within her bourn— Then I could grasp it close and strong It blooms and shines now the front along… Once I returned from happy sail, I had a prize so rich and frail, She sought for long and tidings told: “No like of these depths unfold.” And straight it vanished from my hand, The treasure never graced my land… So I renounced and sadly see: Where word breaks off no thing may be. That final line, “Where word breaks off no thing may be” is evoked on nearly every page of Heidegger’s essay. It is the line to which he returns over and over and bears repeating. Where word breaks off no thing may be. Where naming ends, no thing. We can interpret this in two ways (at least.) Where word—naming—breaks off, then there is nothing . Or, as I choose to read it, where word breaks off no thing may be. In this I see a hint forward, a marker left behind by Heidegger. What could this look like? What does no thing look like? Like a zen koan ( there is no mirror ) it is as thrilling and horrifying as contemplating what preceded the Big Bang. Because language as naming wasn’t always here; we weren’t always here. One or maybe two aspects of the fourfold (depending on your view of gods) were not always here, and there is no guarantee that we will always be around. What then? Heidegger (1982) describes the landscape that the poet finds, “It names the realm into which the renunciation must enter: it names the call to enter into that relation between thing and word which has now been experienced” (65). The poet, in renouncing, allows for the “may be” of “where word breaks off no thing may be.” This “may be” becomes “a kind of imperative, a command which the poet follows, to keep it from then on.” No thing is lacking. Where word breaks off, there may be, a totality, a completion. If we place the emphasis on may be , we make it affirmative, make it positive. One allows it. No thing is where the word, that is the name, is lacking. If we remove then (if we can remove) the word, the name, than that is where no thing is, that is where no thing may blossom, enrich, belong, become. What is no thing? Heidegger writes that “thing is anything that in any way is.” And just after this he writes that the “world alone gives being to the thing.” But what happens if there is no word? Word, in this formulation can be seen as an enframing, a challenging of language. By naming, by drawing a perimeter around an object, we hold it, by its definition (that is a brick) to an ordered future. If we borrow from Heidegger’s essay “The Question Concerning Technology” (1993) the idea of this standing-reserve of an ordered future, we see that “everywhere everything is ordered to stand by, to be immediately on hand, indeed to stand there just so that it may be on call for a further ordering” (322). What happens if there is no naming of the thing? Silence perhaps. Stillness. We can name—and do name—that which we know. We equate knowledge with knowing the name of something. A brick is a brick, a hammer is a hammer, the universe is the universe. By naming a thing, we create, and draw its parameters, the parameters of the thing, not as thing thinging in the fourfold, but as blunt object apparent. In the four dimensions relatively available to us, we observe (and name) that the brick takes up possibly six by four by two inches and is, in the sense that it currently occupies this time slot. It fulfills its destiny, its being, its brickness, it bricks . But what happens when we remove the name for this brick. We no longer know what to call this no-thing (if indeed we can even arrive at the point of uncalled calling.) In fact the it (this brick) is no longer a thing in the sense that by not naming—by removing the name—it still occupies the same dimension but is indiscernible from the world. It simply is , un-reliant, un- needed by me. By removing the subject (me) from it (the brick) do I not then also remove the object—or at least the duality objectifying it? Why is this important? Why does this matter? I have not really removed anything. I have not changed any thing , per se . The brick still occupies the same space in geographic and temporal dimensions. I have literally not even touched the brick sitting on my desk. But what I have done is removed the name, removed the word (the bridge, according to Heidegger) and in this (again, if this is even possible) there is something vertiginously liberating, not only for me (and my way of thinking) but also for the brick itself. Like the poet who calls the thing forward, by refusing to name, by avoiding any thing that demands me to name it, I release the thing into the fourfold. I am no longer challenging the thing to be there for me ; I do not en frame it through language. Rather I, in an act of extreme responsibility, am refusing the challenge. By refusing the name (refusing to name) one allows, (or no one allows no thing) the brick to be all things , to manifest its manifold being, to incorporate all things into its thinging . It becomes, quite literally, every thing . Because, in its infinite manifestness, it incorporates everything; the mud that gave it its current being, the water that formed the mud, the sun, the stars, the universe and it also allows it to become mud again, to become landfill, to become again, water and sun and stars and universe in an endless, infinite cycle of coming to be some thing (else). Perhaps this is what Heidegger is suggesting when he talks about the stillness at the end of his essay, “Language” (2001): The dif-ference stills particularly in two ways: it stills the things in thinging and the world in worlding. Thus stilled, thing and world never escape from the dif-ference. Rather, they rescue it in the stilling, where the dif-ference is itself the stillness (206). It is in this stillness that I can imagine a gellasenheit (here I mean both “releasement in the Heideggarean sense, as well as Meister Eckhart’s use of the term meaning “letting the world go and giving oneself to God”) of thing and world, a releasing into the stillness and silence of no thing beyond where word breaks off. Telling the truth is one of the most respected virtues in medical history and one of the most emphasized in the code of medical ethics. Health care providers are frequently confronted with the dilemma as to whether or not to tell the truth. This dilemma deepens when both choices are critically vicious: The choice is no longer between “right and right” or “right and wrong,” it is between “wrong and wrong.” In the case presented and discussed in this paper, (...) a research team in Saudi Arabia unintentionally uncovered information regarding misattributed paternity. In such a situation and in the context of a tribal cultural system, what should the team do with this information? This case analysis demonstrates the joint application of ethical resources originating from within and outside the Saudi Arabian context. The article analyses the case based on the moral problems involved, relevant medical application, and the impact of such information in the Saudi tribal and Islamic domains. The most pertinent relevant values and secular debates on similar matters are discussed. Finally, the article aims to provide an Islamic dimension of family, fatherhood, and adultery. (shrink)

Dennes, who wrote the biographical sketch of Paul Marhenke which is included in the In Memoriam volume published by the University of California, informs me that he was unaware of the existence of this paper. Professor Dennes writes in this connection: I can only say that ever since our year of graduate study together (1919-19207) Paul and I often discussed the question how far Kant's apparatus of Categories and so on merely expressed a strong confidence in various sorts of regularities in phenomena; and if the apparatus really grounded the confidence, did it do so by a question-begging procedure of, for example, assuming causal regularity, and then grounding and guaranteeing such regularity by a "deduction" of the category of causation. Henceforth, however, it is denied that we perceive anything but these sensations and the truth of the realistic premises on which the conclusion is based must therefore be denied. By BERNARD MCGINN. New York: Crossroad, 1994. Pp. xv + 630. $49.50. This second volume of the History of Western Mysticism covers the period from the sixth through the twelfth century, from Gregory the Great to the Victorines. It fully lives (...) up to the high expectations raised by the first part and displays the same skill in presenting the fruit of enormous learning in a clear, comprehensible manner. The compact section of notes, occupying onethird of the volume, shows how well the author has succeeded in mastering the abundance of sources, primary and secondary, the current Renaissance of medieval studies has rendered available. Undaunted by the mass of recent literature McGinn's established and constantly renewed acquaintance with the original texts enables him judiciously and critically to compare interpretations and judgments. Method and balance mark this work as much as learning and erudition. Its unadorned but easy style, the language of the lectern, renders his work accessible to a wider public, even if the casual tone does not always reflect the intensity of its subject. The author has structured his study around four major figures: Gregory the Great (sixth century), Scottus Eriugena (ninth), Bernard and William of Saint-Thierry (twelfth). They form the centers of three spiritual epochs of the early Middle Ages. Each one of these periods is introduced by informative chapters on the general conditions of spiritual life. The study concludes with a chapter on visionaries who belong to none of the schools represented by the key figures and a chapter on Victorine writers that already prepares for the next volume on the high season of Christian mysticism. The simple structure allows each of the great ones to be given a full chapter. Rather than drowning his survey in an abundance of forgettable names as encyclopedic histories tend to do, McGinn has accommodated the minor figures in his transition chapters where general headings dominate individual characteristics. By devoting so much space to the great ones, the author has transformed much of what could have remained a mere survey into a series of monographs. It enabled him to highlight the unique significance of at least two previously neglected figures in the rather arid span of time that separates the patristic period from the flowering of the twelfth century: Scottus Eriugena and William of Saint-Thierry. Eriugena's intellectual importance has been established for some time, yet mainly with historians of philosophy and Neoplatonist thinkers. Was Eriugena a mystic? The question returns us to the provisional definition given in the general Introduction and consistently maintained throughout volume one and most of volume two. There we learned that "mystical" refers to any belief, system, or practice conducive to the experience of God's presence (vol. I, p. xvii). This definition happily replaces the one adopted through much of the modem period of exclusively private, mostly exceptional, experiences and the unusual expressions (visions, raptures, etc.) that often accompany them. Professor McGinn presents a more objective and more controllable criterion. He extends the mystical to a more or less direct consciousness of the divine presence as evident in texts that witness of, or are conducive to, such a consciousness. This sensible change enables him to include a great many theological texts of the first millennium without having to worry about the degree of their authors' subjective awareness of God's presence and to avoid the predicament to which all attempts to ascertain another person's private experience lead. There is a prevailing opinion in the literature that the first name to mention the interpretation of the Qur'an with the Qur'an as a method is Ibn Taymiyya. He puts it at the forefront in the hierarchy of evidence in his Muqaddima. However, Abu Bakr Ibnu'l-Arabi, who lived two centuries before Ibn Taymiyya, also refers to the same method in the first place among the tafsir methods he suggested. Based on this finding, in the article, after briefly mentioning (...) the aforementioned tafsir method, a brief information about Ibn al-Arabi's Qânûn al-Ta'wîl is given and his approach to this method is examined. Within the scope of this subject, the common and different aspects of both authors' methods of interpreting the Qur'an with the Qur'an are presented. In addition, the findings regarding the problems arising from the authors' putting this method in the first place are shared. Finally, the possible reasons why both authors put this method in the first place are discussed. The aim of the study in this background is to reveal that there was another scholar mentioning the method in the first place before Ibn Taymiyya among the exegetical methods in the classical period and to perform an analysis within this framework. By the application of "data and content analysis", the content in Ibn al-Arabi's Qânûn al-Ta'wîl and Ibn Taymiyya's Muqaddimah in the context of the Qur'an's interpretation with the Qur'an has been analyzed. Psychologists investigating dreams in non-Western cultures have generally not considered the meanings of dreams within the unique meaning-structure of the person in his or her societal context. The study was concerned with explicating the indigenous system of dream interpretation of the Xhosa-speaking people, as revealed by acknowledged dream experts, and elaborating upon the life-world of the participants. Fifty dreams and their interpretations were collected from participants, who were traditional healers and their clients. A phenomenological methodology was adopted (...) in explicating the data. Themes explicated included : the physiognomy of the dreamer's life-world as revealed by significant dreams, the interpretation of significant dreams as revealed through action, and human bodiliness as revealed in dream interpretations. The participants' approach to dreams is not based upon an explicit theory, but upon an immediate and pathic understanding of the dream phenomenon. The understanding is based upon the interpreter's concrete understanding of the life-world, which includes the possibility of cosmic integration and continuity between personal and trans-personal realms of being. I am currently composing a monograph on this sacrament for a series in biblical theology, surveying the Scriptures to see how, within them, the Church's sacraments are prefigured, revealed, and commanded, and to illustrate Scripture's witness in a way that will "strengthen" and "rejuvenate" our theology and (...) practice, following Dei Verbum (DV) §24. My contribution here focuses especially on how to approach writing a biblical theology of penance. Biblical treatments and defenses of the sacrament are often brief, contenting themselves with proving a few conceptual points or doubling down on Jesus's giving his apostles the power and duty of absolution in John 20:19–23. Robert Fastiggi's discussion of the biblical "foundations" of reconciliation, for instance, spans less than thirty pages for both testaments combined, and concludes with a kind of anti-climactic apology: "While it's clear that the Sacrament of Penance has been instituted by Christ, the actual form of the administration of the sacrament will need to develop within the Church's tradition."1 This is a roundabout way of saying that although Scripture clearly attests to the sacrament's theological foundations, it leaves us only with foundations. If this is true, how far can a biblical theology of the sacrament go, and how should one go about it?Approaching a biblical theology of penance, I think, requires us to pause and consider two aspects of the task. First, we should give an account [End Page 1371] of "biblical theology" and our aims in writing one. Secondly, we should consider how to write a theology of this sacrament in particular. What should we be looking for? Such questions will help us gain a clearer vision of what illumination we should expect from Scripture about penance and how we will go about finding it. With our approach and aims discussed, this essay can then conclude with an attempt to follow them in practice by offering a theological, penance-focused exegesis of the sin of Cain (Gen 4:1–16).A Biblical Theology of the SacramentWriting a biblical theology of the sacrament of reconciliation requires us to attend to the notion of "biblical theology." Unfortunately, there continues to be little agreement on exactly what biblical theology is. The phrase is "a wax nose" molded always to the interpreter practicing it.2 Thankfully, however, this lack of consensus allows us to offer our own proposal and tailor it to the task at hand. Rather than offering a requisite Forschungsbericht or haggling with other proposals in detail as though my goal were to dismantle or replace them globally, I can in this brief essay tell you how I think one should go about this task and why.Our task is writing a biblical theology of penance, and we may begin by noting already two small words in that phrase that tell us much. The first is the indefinite article, "a." We are writing a biblical theology. That designates our goal already as an academic product that fits a particular genre, not simply a lens with which I read. Depending on which term one emphasizes—biblical or theology—and depending on what one means the phrase to rule out, the phrase "biblical theology" can be used to indicate exegesis that is "theologically interested"3 (as opposed to exegesis that spurns dogmatic theology) or to indicate theology that is "biblically faithful"4 (i.e., explicitly biblically sourced as opposed to theologies that operate from first principles other than revelation). We present experimental evidence that an interpretation was accurate. Current wisdom notwithstanding, we could interpret from the text alone because its information is redundant: repetition provides internal checks. Knowing neither dreamer nor their associations we made falsifiable predictions that we tested by subsequently gathering information about the dreamer. Predictions were supported. Results were repeated with seven additional dreams. Each dream was tightly crafted, used humor, drama or hyperbole to penetrate the dreamer’s defenses, and furthered the (...) emergence of personality. Our experiment compliments fMRI and statistics because it studies a whole text as a unique narrative: one iteration identified healing steps during therapy; another confirmed the psychological meaning of a myth. Our experiment might generate a body of objective knowledge about interpretation and make interpretation itself more accurate. In the US 20% live with mental illness. Cicero's essay On Friendship (Laelius de amicitia) is of interest as much for the light it sheds on Roman society as for its embodiment of ancient philosophical views on the subjects of friendship. The Dream of Scipio was excerpted in late antiquity from Cicero's De Republica, a dialogue in six books which now only survives in fragmentary form. In the excerpt, which probably formed the conclusion to the dialogue, Cicero describes his vision of the cosmos and the rewards of (...) immortality that the good statesman can expect after death. This work is particularly important for its influence on later literature in the Middle Ages and Renaissance.Both dialogues are examples of the best Ciceronian prose. They are presented in this volume in the context of Cicero's philosophical writing. Their place in ancient thought and their literary characteristics are discussed fully in the introduction, while individual points of interpretation are dealt with in the commentary. The “information age” is often thought in terms of the digital revolution that begins with Turing’s 1937 paper, “On computable numbers, with an application to the Entscheidungsproblem.” However, this can only be partially correct. There are two aspects to Turing’s work: one dealing with questions of computation that leads to computer science and another concerned with building computing machines that leads to computer engineering. Here, we emphasize the latter because it shows us a Turing connected (...) with mechanisms of information flow rather than solely with the mathematical and logical problems of computability for which he is better known. Our reasons for doing so will become clear in what follows. In fact, the 1937 paper just mentioned provides a general schematic for building a computing machine; this mechanical connection puts Turing on an historical continuum with others who discovered mechanisms to cope with information. Of those involved in this quest in the 19th Century, two people in particular, Edison and Bell, had explicit visions of an information age that would follow from their work. Because they were explicitly aware of what they were doing and partly brought it about long before 1937, they deserve substantial credit for the information age they set out to inaugurate. Regarding one purely mechanical and non-electronic technology, Edison noted ten uses for the phonograph, including not only the replication of sound, but also “connection with the telephone, so as to make that instrument an auxiliary in the transmission of permanent and invaluable records, instead of being the recipient of momentary and fleeting communication”. Even though the telephone was only two years old when Edison wrote of a network made up of mechanical hard storage systems and people connected by wire, the network vision was already clearly in his head. Functional information means an encoded network of functions in living organisms from molecular signaling pathways to an organism’s behavior. It is represented by two components: code and an interpretation system, which together form a self-sustaining semantic closure. Semantic closure allows some freedom between components because small variations of the code are still interpretable. The interpretation system consists of inference rules that control the correspondence between the code and the function (phenotype) and determines the shape of the (...) fitness landscape. The utility factor operates at multiple time scales: short-term selection drives evolution towards higher survival and reproduction rate within a given fitness landscape, and long-term selection favors those fitness landscapes that support adaptability and lead to evolutionary expansion of certain lineages. Inference rules make short-term selection possible by shaping the fitness landscape and defining possible directions of evolution, but they are under control of the long-term selection of lineages. Communication normally occurs within a set of agents with compatible interpretation systems, which I call communication system. Functional information cannot be directly transferred between communication systems with incompatible inference rules. Each biological species is a genetic communication system that carries unique functional information together with inference rules that determine evolutionary directions and constraints. This view of the relation between utility and inference can resolve the conflict between realism/positivism and pragmatism. Realism overemphasizes the role of inference in evolution of human knowledge because it assumes that logic is embedded in reality. Pragmatism substitutes usefulness for truth and therefore ignores the advantage of inference. The proposed concept of evolutionary pragmatism rejects the idea that logic is embedded in reality; instead, inference rules are constructed within each communication system to represent reality, and they evolve towards higher adaptability on a long time scale. Scientific models share one central characteristic with fiction: their relation to the physical world is ambiguous. It is often unclear whether an element in a model represents something in the world or presents an artifact of model building. Fiction, too, can resemble our world to varying degrees. However, we assign a different epistemic function to scientific representations. As artifacts of human activity, how are scientific representations allowing us to make inferences about real phenomena? In reply to this concern, philosophers (...) of science have started analyzing scientific representations in terms of fictionalization strategies. Many arguments center on a dyadic relation between the model and its target system, focusing on structural resemblances and “as if” scenarios. This chapter provides a different approach. It looks more closely at model building to analyze the interpretative strategies dealing with the representational limits of models. How do we interpret ambiguous elements in models? Moreover, how do we determine the validity of model-based inferences to information that is not an explicit part of a representational structure? I argue that the problem of ambiguous inference emerges from two features of representations, namely their hybridity and incompleteness. To distinguish between fictional and non-fictional elements in scientific models my suggestion is to look at the integrative strategies that link a particular model to other methods in an ongoing research context. To exemplify this idea, I examine protein modeling through X-ray crystallography as a pivotal method in biochemistry. (shrink)

People of Socrates' time were frequently aghast at the questions he would ask. Their responses were of the sort elicited by very dumb or ex tremely obvious questions: "Don't you know? Everyone else does. " Socrates was hardly alone in his knack for asking such questions. Phi losophers have always asked peculiar questions most other people would never dream of asking, convinced as the latter are that the answers were settled long ago in the collective "wisdom" of society, including ques (...) tions about woman: should women be educated? should they rule socie ties? should they be subordinate in marriage? do women and men have the same virtues, or are there separate virtues for each? which of the dif ferences between women and men are conventional, and which are natu ral? is there a woman's work? do women and men have different types or degrees of rationality? Philosophers of the most diverse periods have raised these questions and their answers were often quite creative, not merely reflecting the conventions and mores of their societies. With the publication of this anthology, their writings will be brought together in a single volume for the first time. This anthology differs from others not just in its inclusiveness. The belief that obscure dreams have meaning, that they can be understood in spite of their seeming incoherence, is shared by most cultures: the importance attributed to the interpretation of dreams comes up several times in such sacred texts as the Bible and Talmud, where it is warned that an uninterpreted dream is like an unopened letter. However, even if such a point of view may justify the interpretation of obscure dreams, it does not provide a basis for (...) a systematic interpretive approach. Roger Caillois considered the will to interpretation “one of the noblest flaws of the human spirit,” defining it as “this passion to find meaning in what has none, and thus to derive meaning from the meaningless.” And it is surely the human spirit's inherent need for intelligibility that underlies the desire to account for the existence of dreams, whether as a divine message or a symptom of neurosis. The act of interpretation consists of giving meaning to something that, at first glance, appears to have none; and this is done not arbitrarily but by discerning a meaning - with the help of methods created for this purpose - that is believed to be implicitly contained in the dream. Thus to interpret a dream we must explain it in relation to the context in which it takes it meaning. For Freud “the interpretation of a dream” requires specifying its “sense” and then replacing it with something that can fit within the chain of our psychic actions. (shrink)

Sünnîliği merkeze alan siyasetin neticesinde Eş‛arîlik ön plana çıktı. The historical adventures of the sects, which are Islamic schools of thought, have a complex plane that includes different orientations rather than simple and one-way directions. Understanding and correctly interpreting this multi-layered factual dimension requires multiple perspectives, like the variable leg of the compass. As of their historical processes, sects determine their positions depending on political, economic, social, etc. This position draws a route according to its positive or negative relations with its interlocutors. Intellectual debates and works of rejection are the outward manifestations of the interlocutor. It is a common acceptance to try to explain the progress of Ash‛arī thought by centering on the Great Seljuks and Nizamiyyāh madrasahs. This research examines the historical development of Ash‛arism by focusing on the period after the collapse of the Great Seljuks. As it is known, in the Great Seljuk period, the relationship of Ash‛arism with the state did not have a linear progression, but with the support of the state, it had a position that paved the way for it. After the collapse of the Great Seljuks, political conflicts, wars, invasions and plunders increased in the region, causing a great chaos in the region. In this process, it is understood that the chaotic environment continues until the state authority is re-stored. (shrink)

The answer to the question whether Central Register and Information of Entrepreneurial Activity or the register of entrepreneurs of the (...) National Court Register have also the creation function incites many controversies and is subject to discussions, in the process of which two main standpoints were formed. It is also important to note that the resolution of the discussed issue not only holds scientific value, but above all, it has significant importance in practice. Therefore, it is necessary and even essential. Furthermore, it is typical for this issue that concerns related thereto and arguments raised during the discussion have their basis in the legislation in force and in fact, encapsulate the favoured path of its interpretation. Purpose. The research is aimed at finding out the grounds, forms and essence of the correlation between the projects of information philosophy and transhumanism from the point of view of the problematics of philosophical anthropology. Attention is focused on the status of the knowing subject and the transformations of the forms of its activity within the specified correlation. Theoretical basis. Insufficient thinking on the issue of the functioning of traditional cognitive models, in particular Kant’s transcendental questioning, which (...) formed the basis of modern rationality and classical science, in the new sociocultural reality led the authors to problematize the forms and essence of interaction and operating with knowledge and communication in the information sphere of human existence and communication. A comparative consideration of the worldviews in the information philosophy and transhumanism projects, made on the basis of a study of current scientific literature, provided an opportunity to assume the probability of implicit elimination of the problems of philosophical anthropology from the horizon of meanings of modern science through the blurring of essentially anthropological analytics. Originality. The article proves the ambivalent nature of the correlation between the projects of philosophy and transhumanism information that are externally close on the subject and problematics, and for the first time in the domestic literature, they have been compared. The content of the powerful potential of information philosophy for the development of philosophical anthropology approaches to the phenomena of the human world determined by the technological nature of civilization and the powerful sociocultural issues of modernity have been clarified. The threats of the dehumanization of the problem field in the modern science and spheres of applied digital technologies associated with transhumanism, interpreted as an ideology, are underlined. Conclusions. The analysis of theoretical positions relevant for the philosophy of information and transhumanism resulted in a number of conclusions, central among which is the statement of the "blurring" situation, the hidden elimination in the content of problematics of philosophical anthropology and its humanistic pathos within the limits of modern forms of correlation and existence in the scientific discourse of the philosophemes and ideologemes in the information philosophy and transhumanism. Epistemological phenomena of "cognitive closure" and a man as a "blind spot" in the thinking on the science and technology development, primarily communication, indicate the relevance of a full comprehensive consideration of the problems of philosophical anthropology in projects of the information philosophy and transhumanism. The article examines the first phase of the universalistic interpretations in Juri Lotman’s semiotics, which is characterized by holism and maximalism derived from the Saussurean cultural concept. There is an analysis of Juri Lotman’s 1967 lecture, previously unpublished, where universal status is accorded to text functions (including magic functions). Such an approach is a substantial revision of the Saussurean understandings of the relationship between language and speech. This interpretation of magic is compared with the examination of (...) the same concept in Juri Lotman’s 1981 article “Contract and self-sacrifice as archetypical cultural models”, which substantially contradicts the concept developed in his 1967 lecture. Both these magic models produce a number of objections, and apparently seem to bear the deforming traces of their respective universalistic theoretical schema. (shrink)

Recent advances in out understanding of the cognitive neuroscience of perception have encouraged cognitive scientists and scientifically minded philosophers to turn their attention towards art and the problems of philosophical aesthetics. This cognitive turn does not represent an entirely novel paradigm in the study of art. Alexander Baumgarten originally introduced the term ‘aesthetics’ to refer to a science of perception. Artist’s formal methods are a means to cull the structural features necessary for constructing clear perceptual representations from the dense (...) flux of sensory information in conscious experience. therefore, he interpreted artist’s formal methods as tools for studying the structure of perception. Art was a field whose interests coincidentally overlapped with aesthetics. In what follows I examine three approaches to cognitive science and aesthetics that rest on a tacit assumption of Baumgarten’s program. I argue that whereas this new research can explain how viewers perceptually recover the content of artworks, it does not explain what makes those works aesthetically interesting. Therefore, the challenge for cognitive science and aesthetics is to tie the perceptual practices of artists and viewers to their more narrowly construed aesthetic, or artistic, practices. What is needed to establish this link is an interpretation of Baumgarten’s original definition of aesthetics that treats attention to the way the formal structure of an artwork works to convey its content as a source of aesthetic interest. Unfortunately this interpretation is not transparently established by explanations of the perceptual practices of artists and viewers. I conclude that it remains an open question whether this research can contribute to philosophical aesthetics. (shrink)

Abstract The Me as a socially constructed self presenting itself, is the subject of new conceptual interest. Discourse analysis is the preferred tool for analysis of the linguistic repertoires that we use to order the experience of our selves. But we also present ourselves visually, with some care. An attempt is made to apply a kind of discourse analysis to self?portraits by eminent photographers. Within the process of portraiture and the rules of the pose, professionals should be able to (...) present their true visions of themselves. Specific dilemmas are likely. While women have been the site of many contradictions in themselves as a sight, men in their images must be prepared to bear the castrating power of ?the look?. It might even be that in some romantic sense, there is the revelation of an authentic, spontaneous self. A set of ten examplars is interpreted, ranging from 1901 to 1986. The photographic evidence for men clearly shows situational self?characteristics in terms of the role of the photographer in the period. Although the women included are comparable in status, using the non?verbal interpretative models of Goffman and Wex, they rather demonstrate signs of the conventional submissive feminine identity. Such an analysis of visual discourse cannot decide on the degree of awareness in the presentations. Further the interpretations are as open to rational contradiction as other forms of discourse analysis. (shrink)

The article explores the semantic potential of social narratives associated with the creation and constitution of the Orthodox Church of Ukraine, which caused a interpretations conflict, marked by conflicting interpretations and differences in meanings that are applied in different contexts. The narrative arranges events in a certain time sequence, accumulates and translates meanings, individual and social experience. The presence of meanings in the interpretation of the narrative depends on the perspective, interpretation horizons and the subject's ability to (...) analyze information and its correct application. The social narrative accumulates a set of stories and messages that are fragmentary and disordered, constructs a coherent plot aimed at finding and defining meanings, and forming social discourse. Social narratives materialized in social structures, orientations, expectations, and stereotypes of their bearers due to everyday modification in the form of simple images, attitudes, and principles. Since each social narrative claims to be exclusive and correct in its own way of understanding events, a clash of narratives and their interpretations is inevitable. A large-scale event determines the modification of social structures, standards, and evaluation criteria, is accompanied by the transformation of everyday life, reveals deep mental layers, and opens up new perspectives. The extraordinary event that was marked by the creation of the Orthodox Church of Ukraine is accompanied by diametrically opposite assessments from the clergy, believers, politicians, experts – from the statement about autocephaly as the only opportunity to achieve unity and recognition of Ukrainian Orthodoxy to the political subtext justification of the new religious organization creation. Church circles represented by representatives of the Ukrainian Orthodox Church of the Moscow Patriarchate claim that the state interferes in the internal Affairs of the Church. The Constitution of the Orthodox Church of Ukraine takes place in the context of the confrontation of two social narratives – the «ukrainian world» and the «russian world». The social narrative «ukrainian world» is based on values rooted in the national soil, but the social narrative «russian world» denies the existence of the Ukrainian nation and the Ukrainian state. Under the patronage of the Russian Orthodox Church, the expression of the ideas of the «russian world» is the Ukrainian Orthodox Church of the Moscow Patriarchate, which enshrines in the minds of believers ideologies about «the common origin of the Ukrainian and Russian peoples», «the common baptismal font», «the unity of the historical space of Holy Rus», «the identity of the East Slavic Orthodox civilization». The Ukrainian Orthodox Church of the Moscow Patriarchate did not support the decision of patriarch Bartholomew to grant autocephaly to the Orthodox Church of Ukraine. Metropolitan Onufriy did not give his blessing to the hierarchs to participate in the Unification Council, which is called «a non-canonical assembly of schismatic groups». The Ukrainian Orthodox Church of the Moscow Patriarchate, according to its primate, has de facto autocephaly, so it is the only canonical local Orthodox Church in Ukraine. In the face of the conflict of public narratives, the Orthodox Church of Ukraine, along with meeting the spiritual needs of believers, contributes to the formation of national identity, the formation of a worldview matrix that will determine the vision of the future development of the country. The Archaeology of the Soul is a testimony to the extraordinary scope of Seth Benardete's thought. Some essays concern particular authors or texts; others range more broadly and are thematic. Some deal explicitly with philosophy; others deal with epic, lyric, and tragic poetry. Some of these authors are Greek, some Roman, and still others are contemporaries writing about antiquity. All of these essays, however, are informed by an underlying vision, which is a reflection of Benardete's life-long engagement (...) class='Hi'>with one thinker in particular -Plato. The Platonic dialogue presented Benardete with the most vivid case of that periagoge, or turn-around, that he found to be the sign of all philosophic thinking and that is the signature as well of his own interpretations not only of Plato but also of other thinkers. The core of The Archaeology of the Soul consists of a set of essays Benardete produced in his last years; the collection provides at the same time an entry into that world through some of Benardete's earliest articles on Plato and on Greek poetry. Benardete's earlier path of close textual analysis always reflected his intimate philosophic dialogue with the thinker in whose work he was immersed; later, he drew on resources of erudition acquired over a lifetime to present a broader picture, on a theme like the dialectics of eros or freedom and necessity. In his late work Benardete was not only engaged in putting together in more general form material he had worked out earlier; he was still on the trail of new discoveries, above all, by extending his Platonic understanding of philosophy to pre- and post-Platonic thinkers. He had become increasingly aware that the discovery of philosophy through the "Socratic turn" was really the rediscovery of an understanding already present in some form in the Greek poets and that awareness guided his last years of study of the pre-Socratic philosophers. According to the standard view of the history of Greek philosophy, the Socratic turn, with its focus on "the human things," marks a point of radical change in philosophy's history. Benardete's late studies led him to the conclusion that the kind of pivotal reorientation thought to be Socratic is in fact the mark of what it means to think philosophically, and Heraclitus or Parmenides is a genuine philosophic thinker precisely to the extent that a Socratic turn can be found in some form within his own thought. At the same time that he was pursuing a track backward, from Plato to the poets and pre-Socratic philosophers, Benardete was also proceeding on a forward path, from Plato to the Latin writers, who adopt the Platonic way of thinking with full understanding of what it means to be "post-Platonic." As the essays collected in this volume demonstrate, the Platonic notion of a "second sailing" gave Benardete a key to the relation between Greek and Latin thought - and with that to a comprehensive under-standing of antiquity-as it did to the relation between poetry and philosophy as such.
