The notion that the firm, and economic activity in general, is inherently amoral is a central feature of positive economics that is also widely accepted in business ethics. Theories as disparate as stockholder and stakeholder theory both leave this central assumption unchallenged. Each theory argues for a different set of external ethical restrictions, but neither adequately provides an internal connection between business and the ethical rules business people are obliged to follow. This paper attempts to make this connection by (...) arguing that the purpose of business is to produce a good or service for trade. Trade involves both a respect for individual autonomy and property rights and squarely places moral norms internal to the practice of business. Trade is not a contingent activity of business, it is a practice rule which also provides the common sense boundary between business and charity on the one hand, and crime on the other. Business and those who engage in it are, from the internal point of view, bound by the purpose of trade and not just the laws of the land. (shrink)

HLA Hart tells us about how law would have emerged in a world of primary rules—informal, beneficial norms—by adjustments that the primary rules would naturally require; these adjustments would have introduced secondary rules for regulating the primary. But he does little to explain how the primary rules would themselves have emerged and, by most accounts, does not expand appropriately on the idea that the relevant players in his story would have taken an internal point of view, as (...) he calls it, on the rules involved. This article, presented as the Hart Memorial Lecture on 14 June 2018, argues that both problems can be resolved at once. Elaborating on Hart’s story with an account of how primary rules might have emerged, it also explains why those regularities would have attracted such a point of view. It argues that the emerging primary rules would have come to be perceived, internalised and ratified by all, and would even have been seen as rules to which each was personally committed. (shrink)

The most discussed theory of law of the twentieth century – HLA Hart’s theory from _The Concept of Law_ – is fundamentally _psychological_. It explains the existence of legal systems in terms of an attitude taken by legal officials: the internal point of view. Though much has been said about this attitude (what statements _express_ it, what it is _not_, how Hart _ought_ to have conceived of it, etc.), we nonetheless lack an adequate account of the attitude (...) itself. This paper presents and defends an account of the internal point of view and shows how, when understood as the account suggests, this attitude can play the several roles that Hartian positivists need it to play. Though the “internal point of view” is perhaps H.L.A. Hart’s greatestcontribution to legal theory, this concept is also often and easily misunderstood. This is unfortunate, not only because these misreadings distort Hart’s theory, but, more importantly, because they prevent us from appreciating the infirmities of sanction-centered theories of law and the compelling reasons why they ought to be rejected. Can one consistently (i) be a positivist, and (ii) think that the internal attitude to the law is a moral attitude? Two objections are raised in the literature. The first is that the combination is straight-out contradictory. The second is that if the internal attitude is a moral attitude, those who take it cannot be positivists. Arguments from Shiner, Goldsworthy and Raz are examined. It is concluded that neither objection works. This article addresses the question of whether judges can take the internal point of view towardtheir legal system's rule of recognition for purely prudential reasons. It takes a fresh look at an underappreciated conceptual argument of Joseph Raz's that answers: no. In a nutshell, Raz argues that purely prudential reasons are reasons of the wrong kind for judges to accept their legal system's rule of recognition. Setting aside its conceptual issues, it remains an open question whether the internal point of view is a good descriptive tool for the behaviour of ordinary citizens or if a sanction‐based explanation of legal compliance is sufficient. This paper will discuss strains of experimental literature corroborating Hart’s criticism of sanction‐based accounts and suggesting that compliance with norms is indeed a shared practice sensitive to social influence. Legal institutions can interact with this shared practice in a way that (...) cannot be reduced to pure incentives. Sanction‐based theories cannot account for norm compliance: They face a challenge in explaining the complex behavioural patterns observed in the minimalistic setting of laboratories. (shrink)

This article insists on the relationship between law and morality from the internal point of view. H.L.A. Hart makes distinction between internal and external viewpoints. In the framework of Hart’s approach, it is difficult to imagine the internal point of view as a moral point of view. In fact, the internal point of view illuminates the normative character of rules; it shows that the members of the group accept (...) the rules as standards of behavior for the group as a whole. To explain the internal point of view which includes also moral view, we should leave Hart’s definition. But we may use his definition as accepting and using a rule. Humans have this extraordinary cognitive ability: They imagine inexistent objects, they treat them as if they were real, and by doing so they make them real. They thus give rise to a shared institutional reality that enables them to cooperate in ways that would be impossible otherwise. In this paper, we would like to revisit the account that HLA Hart gives of the practice of collective acceptance that makes a legal system possible. We try to provide an explanation of what (...) Hart calls the ‘internal point of view’, on the basis of experiments on institutional concepts, drawing on the paradigm known as ‘embodied cognition’. Experts and non-experts in law rated the role of several cognitive dimensions for a list of words referring to two kinds of abstract concepts (institutional and theoretical/scientific) and two kinds of concrete ones (food and artifact). Institutional concepts were distinguished into pure-institutional (e.g., ‘contract’, ‘state’, ‘property’) and meta-institutional (e.g., ‘norm’, ‘duty’, ‘justice’). The results provide an empirical account of how our way of thinking about institutions changes as we acquire expertise in the legal field, thus shading light on the cognitive underpinnings of the ‘internal point of view’. In this dissertation, a logical analysis of points of view is presented. It is based on the concept of determinable presented by Johnson in his book Logic. A point of view is a set of Determinables. Determinables generate a many-dimensional conceptual space. Concepts are subsets of this space, and their relations form a lattice. A logical system to present points of view is introduced and proved to be complete. Whatever the precise analysis of the notion of an `internal point of view', to talk about `religious traditions' is to imply that traditions of a certain kind primarily deploy an internal point of view. But what can be said about the notion of an intellectual tradition that would at the same time also be, or be connected to, a religious tradition? To some, such notions appear to border on contradiction. In accordance with the Cartesian (...) criticism of coutume et exemple, we tend to think of an intellectual stance as the correlate of a detached view, with the rational remaining the enemy of the traditional. In that case, every application whatsoever of the predicate `intellectual' to a tradition would be flawed. According to a certain Enlightenment view, inspired by science, is it not of the very essence of the intellectual stance in general that one stand back at a critical distance from any tradition, especially one's own?In fact, historically oriented philosophers of science like Crombie, Kuhn, Laudan have reminded us of the fact that there is nothing disturbingly paradoxical in speaking of `intellectual traditions': to quote one of Kuhn's book titles, there is the "essential tension" that characterizes science in its development just as much as any other cultural tradition. This tension between the old and the new is the mark of traditions, including the ones defining the rationality or rationalities of science. We could say that Kuhn's `paradigms' already outlined the borders of specific `catholicities' for the specialized fields of scientific research traditions. If Kuhn ever had a point, it must be that science too can develop only within the framework of styles of reasoning, which is to say that it demands viewpoints that cannot be characterized as `external', at least not in an absolute, metaphysical sense of the word. In his now internationally renowned novel, Pamuk's anachronistically created characters confront each other on ways of seeing and visual narration in the context of sixteenth-century Istanbul, when it was the capital of the Ottoman Empire. The visual narratives of miniature painting are elaborated in comparison with the contemporary Renaissance art, unfolding the differences in the depiction of faces, in particular. Style in visual narration is treated in the novel as a reflection of seeing and imaging the faces in their uniqueness and iscontrasted with the tradition of Islamic book illumination where all faces appear to be the same. Western concerns with individuality and the uniqueness of the POV as revealed in one-point-perspective, suggests it is an indispensable aspect of style. In that sense, My Name is Red highlights portraiture in the visual arts as a reflection of character in visual narration; reflecting both the subject and the artist whose individuality is represented in the style of painting. As a technical term in film practice, however, it is defined rather clearly: POV is a camera concept which describes what is seen by the camera. Where one puts the camera and what the camera sees defines the frame and the image. When one wants to tell a story with a sequence of images, one has to consider how one will use the camera, both for the whole sequence and for each image. From whose point of view, or from which different points of view will the story be told? Will it originate with a omniscient point of view or with the point of view of one of the characters, diving into the story from the inside? According to Vázquez and Liz (Found Sci 16(4): 383–391, 2011), Points of View (PoV) can be considered in two different ways. On the one hand, they can be explained following the model of propositional attitudes. This model assumes that the internal structure of a PoV is constituted by a subject, a set of contents, and a set of relations between the subject and those contents. On the other hand, we can analyze points of view taking as a (...) model the notions of location and access. If we choose to follow the second approach, instead of the first one, the internal structure of a PoV is not directly addressed, and the emphasized features of PoV are related to the function that PoV are intended to have. That is, PoV are directly identified by their role and they can solely be understood as ways of accessing the world that bring some kind of perspective about it. Having this in mind, we would like to propose a notation that explains how to understand such access as a sort of models (that can allow the creation of concepts), independently of whether the precise PoV under consideration is impersonal or non-impersonal, its kind of content, and its subjective or objective character. First, we will present an account of some previous approaches to the study of points of view. Then, we will analyze what kind of structure the world is assumed to posses and how the access to it is possible. This volume contains the papers read at the conference on 'Semantics from different points of view' that took place at Konstanz University in Septem ber 1978. This interdisciplinary conference Vias organized by the':Sonderfor schungsbereich 99 - Linguistik' and sponsored by the Deutsche Forschungsge meinschaft. Li~guists, philosophers, logicians, and psychologists met to dis cuss recent developments in the study of the semantics of natural language from the point of view of their disciplines. But this is not to say (...) that there was one particular topic shared by all the participants. The conference was organized because the seven research groups that constitute the Sonderforschungsbereich wanted to discuss their results in an international context and to get advice and guidance for the work still to be done. Therefore, quite a number of topics were covered, though at different levels of precision, under the general label 'semantics'. Quine claims to be "working from within" our conceptual scheme and proceeding scientifically. This description makes his views of interest to those who are skeptical of traditional metaphysical projects and to those with confidence in science. This study examines whether Quine is in fact starting within ordinary language and proceeding scientifically and, if not, how his views are to be best understood. I proceed by exploring some central doctrines in Quine's writing, most notably indeterminacy of translation, but also his views (...) on underdetermination of scientific theory, truth, reality and the dispensability of theory, and the nature of scientific method. In examining Quine's arguments for these doctrines, I find that they do not all issue from what we would ordinarily or scientifically say on the topics concerned. Instead, I find that most arise from an underlying view of the nature of language and knowledge, which I call natural empiricism. I argue that natural empiricism involves assumptions and dynamics of reasoning characteristic of metaphysical points of view, rather than of an ordinary or scientific stance. This is a result with consequences for a critical evaluation of Quine's views. ;I show that natural empiricism leads not only to the central doctrines in Quine's writing that I examine, but also to his general claim to be "working from within" our conceptual scheme and proceeding scientifically. I argue that there is a tension between natural empiricism and "working from within" that is the major tension in Quine's views, leading him to reach different conclusions on the same topic. Quine's views are unusual in that this tension is internal to natural empiricism; most metaphysical views, while they may conflict with the ordinary, do not also endorse it. Natural empiricism is also an unusual point of view in its thoroughgoing empiricism: I claim that it is an empiricist overreaction to the vestiges of rationalism in twentieth century logical empiricism. It shares with the views to which it reacts the need to ground language and knowledge, in a metaphysical sense. Thus Quine's position is particularly valuable for showing up the differences and common motivations in the analytic tradition. (shrink)

In Finnis´s methodology it is very important to build the appropriate concepts to describe, analyse and define law. As a natural law theorist Finnis goes beyond Hart when considering that the internal point of view is useless for delimiting what law is if one does not define the internal point of view of the internal point of view, that is, the moral point of view. Only from a moral (...) class='Hi'>point of view it is possible, according to Finnis, to build an authentic theory of law able not only to describe law but also to morally evaluate it. In Finnis methodology there is also the distinction between the focal and peripheral meanings of a term or concept, whichcorrespond, respectively, to the central and peripheral or secondary cases of and object referred by such term or concept. Because of this distinction Finnis is able to use a wide concept of law avoiding in this way many of the mistakes, which, according to legal positivism, are typical of natural law theories like, for example, confusing legal and moral validity. The importance given by Finnis to the internal point of view and the distinction between central and peripheral cases in order to analyse law is not original but Finnis introduces some particularities, which is what I try to present in this paper. John Cottingham, a contemporary English philosopher, believes that it is necessary to pay attention to the emotional aspect of faith in two ways: (1) the impact of the emotional aspect in human conversion and explanation of the problem of evil, and (2) attention to the language of religion and its function in philosophical issues. From his point of view, conversion is not a forced process but achieved through internal acceptance. This acceptance is not realized just by listening (...) to rational arguments, but it is a response from all the intellectual, emotional, moral, and spiritual aspects of a person. In Cottingham’s view, the problem of evil needs an emotional explanation that considers the world based on Divine providence and God’s love. He also believes that although religious beliefs have propositional and cognitive content, such content is expressed in layers of figurative and literary metaphors in the form of symbolic language. The discovery and extraction of content from these layers need a unique method, so, the literal analysis of these phrases results in misunderstanding. Paying attention to the emotional aspect of human conversion is a valuable point, but weakening the rational aspect in this field is not in favor of religion, and this is one of the important weaknesses of Cottingham's thought. Regarding the emotional explanation of the problem of evil, generalizing it to all human beings -especially the prophets- is not true. Also, not all religious content can be understood by symbolic language, rather, religion consists of different propositions, many of which have a literal meaning. (shrink)

My discussion addresses the differences between analytic and continental philosophy concerning the use of logic and exact reasoning in philosophical practice. These differences are mainly examined in the light of the controversial dominance of Hegel's concept of logic (and theory of concept) in twentieth-century continental philosophy. The inquiry is developed in two parts. In the first (Sections 1-2), I indicate some aspects of the analytic-continental divide, pointing to the role that the topic 'logic and philosophy' plays in it. In the (...) second part (Sections 3-6), I give a short account of the views of logic which are typical of the three main trends of continental philosophy (see Table 1). There are very few analyses of the structure of points of view. However, we can identify two general approaches. One of them assumes as a paradigm the structure of propositional attitudes. A hyperfinitely long coin flipping game between the Gambler and the Casino, associated with a given set A, is considered. It turns out that the Gambler has a winning strategy if and only if A has Loeb measure 0. The Casino has a winning strategy if and only if A contains an internal subset of positive Loeb measure.

This work analyzes how the internal point of view, which represents the perspective of the participant in the legal domain, can be understood within a Hartian framework. It critically examines how legal conventionalism has dealt with this issue. In particular, it criticizes the way in which contemporary conventionalists represent the perspective of participants in legal practice on the basis of cognitive mental states. It also criticizes the way in which they understand how the rule of recognition constitutes (...) the practice. To address these problems, a model based on the philosophy of recognition is presented, showing how its historicity and the way it understands conflict may help to represent the participants' perspective from a practical point of view. Several deconstructive readings of Kierkegaard from the early 1980’s and 1990’s begin with a critique of the role the aesthetic plays in The Point of View for My Work as an Author in order to trouble the entire (ostensive) hierarchy of religious-ethical-aesthetic. These readings suggest that there is no way to discern with certainty whether the signature “Kierkegaard” (here and elsewhere) indeed refers to the factical author, or is just another playful aesthetic pose. From this point, they (...) go on to challenge the received view that the first authorship as a whole should be understood as fundamentally religious rather than aesthetic. I argue that this is a largely unsuccessful move, because these readers do not do full justice to Kierkegaard’s understanding of the transfiguration (or appropriation) of the lower stages of existence into the higher, in the balancing of the self. Re-reading the autobiographical texts with this in mind shows that the authorship is indeed a religious enterprise, even granting the questionable status of The Point of View. I conclude by arguing that On My Work as an Author represents a more successful autobiographical transfiguration of the aesthetic within the ethical-religious stages – and hence a more complete balancing of his own self – and that this work should also be understood as an act of witnessing. Indeed, for Kierkegaard to witness in a way other than through his writing would be a kind of despair, insofar as he would be willing to be someone other than himself. (shrink)

My discussion addresses the differences between analytic and continental philosophy concerning the use of logic and exact reasoning in philosophical practice. These differences are mainly examined in the light of the controversial dominance of Hegel's concept of logic in twentieth-century continental philosophy. The inquiry is developed in two parts. In the first, I indicate some aspects of the analytic -continental divide, pointing to the role that the topic 'logic and philosophy' plays in it. In the second part, I give a (...) short account of the views of logic which are typical of the three main trends of continental philosophy. I also suggest how, with the aid of some typical analytical devices, some continental 'anti-logical' attitudes may be corrected, on their own terms. (shrink)

That Hume 's theory can be interpreted in two widely divergent ways-as a version of sentimentalism and as an ideal observer theory-is symptomatic of a puzzle ensconced in Hume 's theory. How can the ground of morality be internal and motivating when an inference to the feelings of a spectator in "the general point of view" is typically necessary to get to genuine moral distinctions? This paper considers and rejects the suggestion that in moral education, for Hume, (...) the inculcation of morality internalizes the sentiments of the ideal observer. The article offers a reading of the famous tale by Kafka focused on the consequences triggered by the sudden transformation of Gregor Samsa into an insect. This event constitutes the starting point of a shift that involves phases and components of perception both of the self and of the world as well as the relations among the inner and the external world, the most elementary awareness and feelings and the most complex ones, which are affective, cognitive and related to (...) interactions, expressed with particular emphasis by the dynamics of the spatial dimension of the story. Two discursive paths intersect above all: on one side, the traveling salesman wakes up with the/in the body of cockroach while his soul is the same as always. He will have to try to become cockroach, that is to assume its perceptions and then, slowly, its tastes, its impressions and any other animal sentiment. At the same time, the becoming of Gregorio’s family will be antiphrastic to the one experienced by him: from inept, passive parasites of their akin, as they are depicted at the beginning of the story, his family members will gradually turn into active bourgeoisies full of projects, rejecting Gregory up to eliminate him: they are the ones dehumanizing themselves, while Gregory refines his sensitivity in suffering, even to the sacrifice. Time has a highly unstable place between the objective and the subjective. On the one side, there are very well known philosophical arguments trying to show that time has only a subjective reality, even that it is merely a subjective epiphenomenon. On the other side, we are compelled to take points of view as non dispensable elements of reality, at least of a reality capable of containing beings like us. And points of view offer a world of temporal (...) entities existing in an objective way. Moreover, points of view themselves appear to be temporal entities among other temporal entities. We analyse both aspects of time. Our main focus will be McTaggart’s arguments against the reality of a fluent time, what he called temporal series of kind A. We will distinguish three very different arguments in McTaggart works. We analyse them in detail. And we reject their conclusive character. Our final target is to maintain that there is a room for fluent time in what is internal to points of view but external to the subjects adopting those points of view. (shrink)

In this paper, the methodological character of the internal point of view (IPoV) will be examined. That the IPoV is a method of legal philosophy is not disputed. What is disputed is which point of view a theorist needs to occupy in order to successfully theorise about law. However, the choice between different points of view is based on the participant the theory chooses to study. This means that the participant’s viewpoint is not a (...) method of our theory but an epistemic point through which the object of our study becomes available. If this is the case, different theories simply aim to study different participants. Hence, the criticisms raised on methodological grounds against theories not taking the IPoV or not taking the correct IPoV lose their force. Here, to demonstrate this point, the paper will offer a definition of method from a theory-construction perspective and examine the uses of the IPoV in Hart’s theory since it is the one that introduced the notion in legal philosophy. I will argue that the IPoV cannot play a methodological role for reaching main epistemic aims, but it can be a method for identifying the object of study. (shrink)

The vast visual coverage of the Boxer Uprising in northern China that ended with foreigners traipsing through the Forbidden City in Beijing reflects both the richly innovative image technology at the turn of the century and the international interest in events that involved many of the world’s most powerful nations. Historians and students who seek to understand the incident through the innovative technology of today can, for the first time, access primary source images in large numbers malleably displayed in the (...) digital environment. The sheer volume of images collected in one place offers powerful new insights into a history already broadly covered in analytical texts and first-person accounts. One qualitative difference from previous histories is the emergence of subjective points of view that can be conveyed in multidimensional models that juxtapose experiential recordings of the day. Harnessing the tension of contrasting viewpoints – who knew what when – enables today’s learners to see through the lenses of past participants whose understanding was limited by location, communications and, one must remember, by not knowing the outcome. Those who were besieged in the Foreign Legations did not know if they would survive; soldiers and rebels on the road to Beijing knew only the difficulties of the march; illustrations in newspaper reports overseas were coloured by politics and both national and international rivalries. Digital visual representations have the possibility of recreating the collision of experiences that allow users to move between personal records and public reporting from the time to gain a knowledge that is unmitigated by an author’s text-based presentation and conclusions. The result is as much a revolution in perception of historical events – perception-based learning – as it is in information about these events. (shrink)

There are very few analyses of the structure of points of view. However, we can identify two general approaches. One of them assumes as a paradigm the structure of propositional attitudes. Here, points of view are understood as having an internal structure similar to the one we can find in propositional attitudes. The other approach is based on the notions of location and access. Here, the internal structure of points of view is not directly addressed. (...) The features that are emphasised are related with the role that points of view are intended to have. Points of view would be ways of having access to the world, and to ourselves, from certain emplacements. The paper has three parts.
