In this book, I consider whether the hypothesis of moral dilemmas undermines ethics' pretensions to objectivity. I argue against the view that moral dilemmas challenge the very possibility of ethical theory, as a practical and theoretical enterprise. By examining Kantian, Intuitionist and Utilitarian arguments about moral dilemmas, I show that no ethical theory is capable of avoiding them. I further argue that an adequate ethical theory should admit dilemmas. Dilemmas do not reveal (...) a logical or normative flaw in the theory that permits them to arise, nor are they necessarily generated by subjective mistakes. Rather, dilemmas are a sign of the deliberative capacity of an agent who operates in non-ideal conditions of rationality and cooperation. The inevitability of moral dilemmas shows that we should reconsider the bounds of deliberation, and the purposes of ethical theory. My argument for the philosophical significance of moral dilemmas rests on the claim that an adequate ethical theory should make sense of moral phenomenology, and that moral phenomenology should to be understood from the perspective of an agent who conceives of herself as an agent. The view of moral dilemmas I advocate does not invite skepticism about ethical theory, but suggests that we redefine its scope and its many practical aims. (shrink)

During the last two decades there has been an enormous development in treatment possibilities in the field of neonatology, particularly for (extremely) premature infants. Although there are cross-cultural differences in treatment strategy, an overview of the literature suggests that every country is confronted with moral dilemmas in this area. These concern decisions to initiate or withhold treatment directly at birth and, later on, decisions to withdraw treatment with the possible consequence that the child will die. Given that the (...) neonate cannot express his or her own will, who will decide? And on the basis of what information, values and norms? We explored some of these issues in daily practice by interviewing a small sample of health care practitioners in a Dutch university Neonatal Intensive Care Unit (NICU). It turned out that experiencing moral dilemmas is part of their daily functioning. Nurses underline the suffering of the newborn, whereas physicians stress uncertainty in treatment outcome. To make the best of it, nurses focus on their caring task, whereas physicians hope that future follow-up research will lead to more predictable outcomes. As for their own offspring, part of these professionals would hesitate to bring their own extremely premature newborn to a NICU. For the most oppressing dilemma reported – terminating an already initiated treatment – we propose the concept of ‘evidence shift’ to clarify the ambiguous position of uncertainty in decision making. A strong tradition in philosophy denies the possibility of moral dilemmas. Recently, several philosophers reversed this tradition. In this dissertation, I clarify some fundamental issues in this debate, argue for the possibility of moral dilemmas, and determine some implications of this possibility. ;In chapter I, I define moral dilemmas roughly as situations where an agent morally ought to adopt each of two alternatives but cannot adopt both. Moral dilemmas are resolvable if and (...) only if one of the moral oughts overrides the other. ;In chapter II, I criticize several opponents of moral dilemmas, including utilitarians, Kant, Aquinas, and Ross. My main criticism is that no opponent of moral dilemmas can adequately justify moral residue . ;Chapters III and IV concern the two main arguments against the possibility of moral dilemmas. First, the argument for 'ought' implies 'can' runs as follows. If the agent cannot adopt both, then it is not the case that the agent ought to adopt both. But the agent ought to adopt both, since the agent ought to adopt each . Thus, the defining judgements of a moral dilemma seem to imply a contradiction. In response, I argue that the relation between 'ought' and 'can' is not a logical implication but a conversational implicature. ;Chapter IV concerns the argument from 'ought' implies 'permitted': If the agent ought to adopt one alternative, then the agent is permitted to adopt that alternative, which means that it is not the case that the agent ought not to adopt that alternative. But the agent ought not to adopt that alternative, since the agent ought to adopt the other alternative and cannot adopt both. I respond that 'ought' does not logically imply but conversationally implicates 'permitted'. ;In chapter V, I argue that, despite recent claims, both moral realism and anti-realism are compatible with the possibility of moral dilemmas. Moral dilemmas set a challenge for ethical theory. They are situations where agents seem to be under an obligation both to do, and to refrain from doing, a specific act. Are such situations possible? What is their exact nature? These are the questions that _Moral Dilemmas_ tries to answer. The book argues that moral theories should not allow for the possibility of irresolvable dilemmas, for situations in which no right answer exists. To this end, arguments seeking (...) to prove the existence of irresolvable dilemmas, especially the argument from the incommensurability of values, are discussed at length and refuted. The book shows that though on the normative level dilemmas are resolved, they typically involve a high moral cost for which there is no adequate compensation. This moral cost is the source of the regret and pain suffered by agents in moral dilemmas. Thus, moral dilemmas do not point to any inconsistency in our moral reasoning or theory, but to a problematic aspect of the human condition; at times (probably less often than is usually believed), human beings are justified, and even required, to dirty their hands by behaving in ways that in ordinary situations would be strictly forbidden and condemned. I criticize standard lines of dilemmatic defense, but side with the defense against standard arguments well presented by David Brink. A leading analogy: moral dilemmas are no more logically offensive than checkmate (another case in which absolute obligations clash: always move out of check; never move into it.) The aim of the consequentializing project is to show that, for every plausible ethical theory, there is a version of consequentialism that is extensionally equivalent to it. One challenge this project faces is that there are common-sense ethical theories that posit moral dilemmas. There has been some speculation about how the consequentializers should react to these theories, but so far there has not been a systematic treatment of the topic. In this article, I show that there are at (...) least five ways in which we can construct versions of consequentialism that are extensionally equivalent to the ethical theories that contain moral dilemmas. I argue that all these consequentializing strategies face a dilemma: either they must posit moral dilemmas in unintuitive cases or they must rely on unsupported assumptions about value, permissions, requirements, or options. Previous studies have found that the proportions of people who endorsed utilitarian decisions varied across different variants of the trolley dilemma. In this paper, we explored whether moral choices were associated with beliefs about outcome probabilities in different moral dilemmas. Results of two experiments showed that participants’ perceptions of outcome probabilities were different between two dilemmas that were similar to the classical switch case and footbridge case. Participants’ judgments of the outcome probabilities were associated with their (...) moral choices. The results suggested that participants might not accept task instructions and thus did not perceive the outcomes in the dilemmas as certain. We argued that researchers who endorse descriptive tasks in moral reasoning research should be cautious about the findings and should take participants’ beliefs in the outcomes into account. Some philosophers have recently complained that moral theories almost always portray the distresses of ordinary people in moral predicaments as irrational. In the name of having a minimally realistic picture of ethical thought, these philosophers argue that accounts of morality must allow for strong moral dilemmas, choices involving mutually exclusive all-things-considered requirements or jointly exhaustive all-things-considered prohibitions. In this dissertation I clarify and reject several versions of this argument, which I call the argument from experience. ;In (...) chapters one and two I define strong moral dilemmas as essentially involving conflicts of moral reasons, and reject as premature attempts to reduce questions about strong dilemmas to questions about deontic logic. I accept the goal of representing ordinary experience faithfully, and ask whether a theory will necessarily distort that experience if it employs interpretations of 'ought' and 'prohibited' in ways guaranteeing a priori that there are no strong dilemmas. ;The argument from experience claims that people can have a justifiably high degree of confidence that they are in strong moral dilemmas, and in chapter three I question whether people ever have the needed sorts of confidence about the limits of their abilities, the precise location of their wrongdoing, or the futility of continued moral deliberation. ;In chapter four I reject specific arguments based on regret and guilt. The tendency to feel unavoidable agent-regret or guilt allegedly shows that the agent sees the choice as a strong dilemma, and the appropriateness of such distresses allegedly shows that the agent's way of seeing things is rational. I reply that someone can feel agent-regret without endorsing any moral judgment involving 'ought' or 'prohibited', and that guilt is never unavoidably appropriate. ;In chapter five I trace the failure of the argument from experience to the presence in ordinary thought of a notion of blame which is both conceptually guaranteed always to be avoidable and regarded as an infallible indicator of moral requirement and prohibition. In this paper I argue for modesty concerning what theoretical reason can accomplish in the moral dilemmas debate. Specifically, I contend that philosophers' conclusions for or against moral dilemmas are driven less by rational argument and more by how the moral world intuitively appears to them.

This paper examines the structure of moral paradoxes, arguing that moral dilemmas are grounded in moral agents and necessitate the same explanation as the logical behavior of these agents. Consequently, logical and moral laws derive from a different source than nomological and metaphysical laws. Furthermore, it is asserted that logical and moral laws are pluralistic in nature, permitting numerous logical deviations without leading to absurdity.

I examine recent work on moral dilemmas and argue that there are no moral dilemmas which issue in inescapable wrongdoing . In the first three chapters I examine some important arguments for and against tragic dilemmas---arguments from deontic logic, Martha Nussbaum's view that vulnerability is essential to human values, Bernard Williams' argument from guilt , and the argument from the fragmentation of value---and show that these arguments for and against are inconclusive. ;In Chapter 4 I (...) attempt to provide a reason to reject tragic dilemmas which will have force for those most inclined to accept dilemmas---those, such as Williams and Nussbaum, who are engaged in a critique of modern moral philosophy. Central to their critique is their denial of the distinction between moral and nonmoral reasons and of the primacy of the moral. I show that an account of practical deliberation which can accommodate the possibility of tragic dilemmas has the effect, not of undermining the distinction between moral and nonmoral reasons and the primacy of the moral, but of strengthening that distinction and that primacy. This is because a picture of practical deliberation which can accommodate the possibility of tragic dilemmas makes moral reasons distinct from nonmoral reasons in how they achieve their deliberative weight. ;In Chapter 5 I present an alternative picture of practical deliberation which I commend to these critics. In my alternative picture, moral reasons have deliberative weight for an agent for the same reason nonmoral reasons do: because the agent sees things from a point of view from which such reasons are important. My picture takes seriously the critics' view that moral value is continuous with other sorts of value and is not overriding and supremely regulative; but my picture does not accommodate the possibility of tragic dilemmas. I conclude that their project of criticizing modern moral philosophy is better served by accepting my picture and thus rejecting the possibility of tragic dilemmas. (shrink)

The current chapter provides an overview of research on responses in moral dilemmas where maximization of outcomes for the greater good (utilitarianism) conflicts with adherence to moral norms (deontology). Expanding on a description of the traditional paradigm to study moral-dilemma judgments (i.e., the trolley problem), the chapter reviews the most prominent dual-process account of moral-dilemma judgments, normative conclusions that have been derived from this account, and criticisms raised against this line of work. Patients in a vegetative state/ unresponsive wakefulness syndrome (VS/UWS) pose ethical dilemmas to those involved. Many conflicts occur between professionals and families of these patients. In the Netherlands physicians are supposed to withdraw life sustaining treatment once recovery is not to be expected. Yet these patients have shown to survive sometimes for decades. The role of the families is thought to be important. The aim of this study was to make an inventory of the professional perspective on conflicts in (...) long-term care of patients in VS/UWS. A qualitative study of transcripts on 2 Moral Deliberations (MD’s) in 2 cases of patients in VS/UWS in long-term care facilities. Six themes emerged: 1) Vision on VS/UWS; 2) Treatment and care plan; 3) Impact on relationships; 4) Feelings/attitude; 5) Communication; 6) Organizational aspects. These themes are related to professionals and to what families had expressed to the professionals. We found conflicts as well as contradictory feelings and thoughts to be a general feature in 4 of these themes, both in professionals and families. Conflicts were found in several actors: within families concerning all 6 themes, in nurse teams concerning the theme treatment and care plan, and between physicians concerning all 6 themes. Different visions, different expectations and hope on recovery, deviating goals and contradictory feelings/thoughts in families and professionals can lead to conflicts over a patient with VS/UWS. Key factors to prevent or solve such conflicts are a carefully established diagnosis, clarity upon visions, uniformity in treatment goals and plans, an open and empathic communication, expertise and understanding the importance of contradictory feelings/thoughts. Management should bridge conflicts and support their staff, by developing expertise, by creating stability and by facilitating medical ethical discourses. Shared compassion for the patient might be a key to gain trust and bridge the differences from non-shared to shared decision making. (shrink)

The demands of morality can seem straightforward. Be kind to others. Do not lie. Do not murder. But moral life is not so simple. We are often confronted with difficult situations in which someone is going to get hurt no matter what we do, in which we cannot meet all of our obligations, in which loyalties come into conflict, in which we cannot help everyone who needs it, or in which we must compromise on important values. It is natural (...) to describe such situations as moral dilemmas. This chapter is about the psychology of how we represent, process, and make decisions about what to do when moral life is difficult in this way. Our first aim is to provide some conceptual clarity on what exactly turns a choice situation into a moral dilemma. Here, we propose a normative account of moral dilemmas in terms of moral appropriate feelings of conflict in response to strongly conflicting reasons. Marcus argues that moral dilemmas are real, but that they are not the result of inconsistent moral principles. Moral principles are consistent just in case there is some world where all principles are 'obeyable.' They are inconsistent just in case there is no world where all are 'obeyable.' What this logical point is meant to show is that moral dilemmas do not make moral codes inconsistent. From classical antiquity to contemporary times, challenging situations of dilemmatic or paradoxical nature continue to fascinate both scholars and the casual reader. Although Western literature provides a fruitful source of philosophical discussion on the circumstances under which a morally competent agent faces incompatible moral requirements, Sinology has rarely accepted the idea of moral dilemmas in Chinese philosophy in general and Confucianism in particular. The present paper explores moral and morally motivated dilemmas in Liu Xiang’s 劉向 (...) Lienü Zhuan 列女傳 and the philosophical strategies employed for their resolution within the framework of the Confucian tradition, emphasizing similarities with Western traditions such as Greek tragedy or Thomistic philosophy. It is sometimes claimed that the Kantian Ought Implies Can principle (OIC) rules out the possibility of moral dilemmas. A certain understanding of OIC does rule out the possibility of moral dilemmas in the sense defined. However I doubt that this particular formulation of the OIC principle is one that fits well with the eudaimonist framework common to ancient Greek moral philosophy. In what follows, I explore the reasons why Aristotle would not accept the OIC (...) principle in the form in which it rules out the possibility of moral dilemmas. (shrink)

The authors’ aim is to bring to the attention of readers the inadequacies of care for people in Hungary who are terminally ill. They believe that both objective and subjective factors cause these inadequacies. Most of these factors arise from moral dilemmas that could be eased or even solved if ethics education had a much more prominent place in the nursing curriculum. Even if nurses would not become automatically better persons morally, a much wider knowledge of medical/nursing ethics (...) could significantly improve nursing care both before and at the end of life. Although the article is also critical of the nursing care provided, it is not its purpose to make any generalizations. The study utilized selected passages from essays written by 76 practicing nurses on their personal experience of ethical dilemmas in their work environment, and a questionnaire administered to 250 students (registered nurses and health care students) studying for a college degree. Influential theories on moral judgments propose that they rely either on emotions or on innate moral principles. In contrast, the mental model theory postulates that moral judgments rely on reasoning, either intuition or deliberation. The theory allows for the possibility that intuitions lead to utilitarian judgments. This paper reports two experiments involving fifth-grade children, adolescents, and adults; the results revealed that children reason intuitively to resolve moral dilemmas in which action and inaction lead to different (...) outcomes. In particular, the results showed female children to be more utilitarian than female adults in resolving classical moral dilemmas: they preferred an action that achieved a good outcome for a greater number of people. Within the mental model theory’s framework there is no reason to expect that females and males differ in their ability to reason, but at the moment the results for females cannot be generalized to males who were not properly represented in the adults groups of the two experiments. The result revealing that (female) children are more utilitarian than (female) adults, which is hard to explain via many current theories, was predicted by the mental model theory. (shrink)

The goal of responsible engineers is the creation of useful and safe technological products and commitment to public health, while respecting the autonomy of the clients and the public. Because engineers often face moral dilemma to resolve such issues, different engineers have chosen different course of actions depending on their respective moral value orientations. Islam provides a value-based mechanism rooted in the Maqasid al-Shari‘ah (the objectives of Islamic law). This mechanism prioritizes some values over others and could help (...) resolve the moral dilemmas faced in engineering. This paper introduces the Islamic interpretive-evaluative maxims to two core issues in engineering ethics: genetically modified foods and whistleblowing. In this paper, using Mark Schroeder’s (2008a) expressivist semantic framework for normative language as a case study, I will identify difficulties that even an expressivist semantic theory capable of addressing the Frege-Geach problem will encounter in handling the logical possibility of moral dilemmas. To this end, I will draw on a classical puzzle formulated by McConnell (1978) that the logical possibility of moral dilemmas conflicts with some of the prima facie plausible axioms of the standard deontic (...) logic, which include obligation implies permission. On the tentative assumption that proponents of ethical expressivism should be generally committed to securing the logical possibility of moral dilemmas in their semantic theories, I will explore whether and how expressivists can successfully invalidate obligation implies permission within the framework developed by Schroeder. The case study eventually reveals that this can indeed be a hard task for expressivists. Generalizing from the case study, I will suggest that the source of the difficulty ultimately lies in the mentalist assumption of the expressivist semantic project that the logico-semantic relations exhibited by normative sentences should be modeled in terms of the psychological attitudes that speakers express by uttering them. My final goal will be to show that the difficulty expressivists face in dealing with the logical possibility of moral dilemmas is a reflection of the more general problem that their commitment to the mentalist assumption prevents them from flexibly adopting or dropping axioms in their semantic theories to get the right technical results. In 1963 Roderick Chisholm proposed a category of acts called “offences” to capture what he called acts of “permissive ill-doing.” Chisholm’s proposal has proven to be controversial. Here I propose that some progress can be made in validating acts of offence by focusing upon moral dilemmas. Given the problems which have been alleged to beset moral dilemmas, this may initially seem like a puzzling strategy. However, I will call attention to a type of moral dilemma (...) unlike what is standardly discussed in the literature and attempt to show that those who acknowledge that such dilemmas are possible are likewise obliged to acknowledge that acts of offence are possible. He aims to show that this is not the case by examining debates on the subject of moral dilemma from the twelfth to the fifteenth centuries. According to medieval terminology, an agent in a moral dilemma is considered to be perplexed (perplexus) or to be suffering from perplexity (perplexitas). Dougherty emphasizes the importance to his study of the ontological and objective sense of perplexitas: an agent is said to be confused in the presence of a genuinely dilemmatic situation. The book deals with the topic through a selection of prominent thinkers from the major schools of the period (e.g. Franciscan, Dominican, and Thomistic).Canon law was the first discipline in which systematic discussion of moral dilemmas took place. Accordingly, in chapter 1 Dougherty discusses two opposing views from the twelfth and early thirteenth centuries that were equally authoritative and conveyed the canon law tradition to later medieval thinkers. Gratian asserts, in his Decretum, the existence of genuine moral dilemmas (through conflicts within natural law itself) and counsels agents in those situations to choose the lesser of two evils. Gratian’s views were commented on by many glossators who argued against him in the Glossa ordinaria, contending that moral agents can fulfill all moral obligations, as the well-known maxim “ought implies can” asserts, and so avoid moral wrongdoing. If an agent finds himself in a perplexed state, it is due to his own culpable negligence, never the result of the disordered moral order.In addition to canon law there were other forums for discussions of moral perplexitas. In chapter 2, Dougherty expands the theme to two influential thirteenth-century summaries of theology: the Summa aurea, authored by William of Auxerre, and the Summa Halesiana, associated with Alexander of Hales. In these, Dougherty thoroughly examines a number of dilemma cases and shows both works concluding that moral agents can find themselves trapped in such situations, with some degree of moral wrongdoing being inescapable. The maxim “ought but cannot” is evident, then, in these works. Further, their concrete advice for agents in a moral dilemma is to apply the principle of choosing the lesser evil, or, as William of Auxerre specifies in certain cases, “what obliges more greatly is to be done”; however, his connection between these two principles seems not so clear: why would the choice of that which obliges more be identified with the choice of a lesser evil?Chapter 3 is one of the book’s highlights. It presents the distinctive medieval moral dilemma position of Raymond Lull (ca. 1232–1316) through an analysis of four of Lull’s own dilemmas in his autobiographical work, Vita coaetanea. Dougherty argues that Lull is opposed to the traditional solution of medieval commentators on Lombard, since Lull did not claim that a judgment of conscience, which dictates something contrary to natural law or a command of God, had to be in error. Lull thinks that the world truly is such a place where agents find themselves in dilemmatic situations from which they are unable to escape by their own powers and therefore are in need of divine intervention (“the Divine Intervention resolution”). Departing from hypothetical dilemmas and drawing on examples from law, this paper offers a pragmatist account of normative induction that characterizes moral particularism and generalism as stages of inquiry into ethical problems, rather than rival accounts of moral knowledge and motivation. Pragmatism’s response to analytical moral theory lies in understanding the transformative nature of John Dewey’s social continuum of inquiry. The continuum is unrecognized in the analysis of hypothetical dilemmas, like the trolley problem, but can (...) clearly be seen in studies of law. Real moral dilemmas represent actual conflicts, of which the dimensions emerge through experience and the solution cannot be addressed through the analysis of cleverly balanced moral puzzles. Repeated over time, real problems drive the consensual formation and revision of social practices and the predication of general moral rules and principles. Ethical particularism holds that the evaluative cannot be “cashed out” propositionally, and that it is descriptively “shapeless.” It fails to recognize that real moral problems occur in a continuum, and at first encounter a shapeless particularist context of seemingly unlimited non-moral properties. Normativity is driven by repetition of similar situations toward shared practices and descriptive predication. Rather than a Dancian retention of epistemic status by defeated reasons, this illustrates retirement of relevant properties and accompanying reasons, transformation of the reasons environment, and a pluralist normative ontology. This paper examines moral dilemmas faced by family caregivers of older adults who employ live-in migrant care workers. Being both a family caregiver as well as an employer of a live-in migrant care worker often puts family members at a crossroad, where moral decisions must be made. Lacking a formal role, family members do not have a professional code of ethics or other clear rules that can guide their actions, and their choices are rooted in cultural, community, (...) familial, and personal values. This paper discusses moral dilemmas that result from family caregivers’ dual commitment, to the wellbeing of their older sick relative who is the recipient of care, and to the wellbeing of the live-in care worker whom they employ. The paper uses relational ethics as a theoretical framework to discuss three cases that involve complex moral decision making in real life. (shrink)

Although common sense and literature support the possibility of moral dilemmas, many traditional and contemporary philosophers deny this possibility because of several arguments. Probably the strongest argument against the possibility of moral dilemmas can be called the argument from ought and ought not. By looking at the situations faced by the protagonists of two classic plays , I try to shed light on what it means to face an insoluble moral dilemma, what it might mean to deal with it, and how the dilemma can reveal certain crucial information about the decision-maker to us readers-spectators, to other characters in the play who witness, or are implicated by, the incident, as well as, and perhaps most importantly, to the protagonist himself. In so doing, (...) I distinguish the above dilemmas from moral-prudential dilemmas and from apparent dilemmas constituted by the mere lack of epistemological access. Indeed, I generally resist the various reductive approaches characteristic of much analytic moral philosophy, and challenge the notion of a uniquely right answer to which all rational moral agents can be held accountable. In recent years, Alasdair MacIntyre and others have observed an increasing interest on the part of contemporary ethicists regarding the question of whetherinnocent agents ever find themselves in moral dilemmas. This present-day support for the existence of moral dilemmas for innocent agents has spawned a re-reading of canonical ethical texts in the history of philosophy. The point of departure for the present paper is one particularly contentious battleground of this ongoing historical retrieval, namely, the ethical writings (...) of Thomas Aquinas. I contend that Aquinas is not an ally of those who defend the existence of moral dilemmas for innocent agents. However, Aquinas does present what is in my view a valuable contribution to the discussion of moral dilemmas as such. I show that a close textual reading of one of Aquinas’s examples leads to some rather interesting consequences for his moral theory, and that, surprisingly, this example could be of interest to contemporary ethicists who argue for the existence of moral luck.
