Utilitarians are attracted to the idea that an act is morally right iff it leads to the best outcome. But critics have pointed out that in many cases we cannot determine which of our alternatives in fact would lead to the best outcome. So we can’t use the classic principle to determine what we should do. It’s not “practical”; it’s not “action-guiding”. Some take this to be a serious objection to utilitarianism, since they think a moral theory ought to be (...) practical and action-guiding. In response, some utilitarians propose to modify utilitarianism by replacing talk of actual utility with talk of expected utility. Others propose to leave the original utilitarian principle in place, but to combine it with a decision procedure involving expected utility. What all these philosophers have in common is this: they move toward expected utility in order to defend utilitarianism against the impracticality objection. My aim in this paper is to cast doubt on this way of replying to the objection. My central claim is that if utilitarians are worried about the impracticality objection, they should not turn to expected utility utilitarianism. That theory does not provide the basis for a cogent reply to the objection. (shrink)

This paper addresses the question “what connection is there between our answer to the question of what we are, and the question, what our actions are?” Suppose that actions are reflexive changes of agents. On that supposition, there would be a direct connection between the answers to those two questions. An action of mine will be a reflexive change of me, and what I am will fix the nature of those changes. I hold that supposition to be true and consider (...) reasons in favor of believing it. However, the paper is not primarily aimed at defense of that thesis. It rather concerned with exploring what consequences accepting it has for the competing notions of what we are, given what we ordinarily think actions are, and bringing to light a tension between thinking of actions as reflexive changes of agents in this way, and a kind of causal understanding of actions that is prevalent. What emerges is that we should shift where we start our theorizing: we cannot assume that action theory primarily involves the task of characterizing the relation between an agent and changes caused, rather than a characterization of a particular kind of relation between the agent and herself. This study of the concept of orbit is intended to throw light on the nature of revolutionary concepts in science. We observe that Kepler transformed theoretical astronomy that was understood in terms of orbs [Latin: orbes] and models , by introducing a single term, orbit [Latin: orbita], that is, the path of a planet in space resulting from the action of physical causes expressed in laws of nature. To demonstrate the claim that orbit is a revolutionary concept we pursue three (...) lines of argument. First we trace the origin of the term; second, we document its development and specify the meaning of the novel term as it was introduced into astronomy by Kepler in his Astronomia nova . Finally, in order to establish in what sense the concept is revolutionary, we pay attention to the enduring impact that the concept has had on the relevant sciences, in this case astronomy and indeed physics. We claim that orbit is an instance of a revolutionary concept whose provenance and use can provide the insights we are seeking. (shrink)

The idea that our conscious decisions determine our actions has been challenged by a report suggesting that the brain starts to prepare for a movement before the person concerned has consciously decided to move . Libet et al. claimed that their results show that our actions are not consciously initiated. The current article describes two experiments in which we attempted to replicate Libet et al.'s comparison of participants' movement-related brain activity with the reported times of their decisions to (...) class='Hi'>move and also the reported times of their decisions of which hand to move. We also looked at the distribution of participants' reports over time to evaluate an alternative explanation of Libet et al.'s results. Although the Readiness Potential was usually present before all of the decisions to move, consistent with the findings of Keller and Heckhausen and Libet et al. , we found that many reported decision times were before the onset of the Lateralized Readiness Potential, which measures hand-specific movement preparation. The latter finding is consistent with the conclusion that the LRP always started after the conscious decision to move. We conclude that even though activity related to movement anticipation may be present before a conscious decision to move, the cortical preparation necessary for the movement to happen immediately may not start until after the conscious decision to move. Organizational institutionalism has shown how institutional entrepreneurs can introduce new logics into fields and push for their broader acceptance. In academic science in the United States, however, market logic gained strength without such an entrepreneurial project. This article proposes an alternative “practice selection” model to explain how a new institutional logic can gain strength when local innovations interact with changes outside the field. Actors within a field are always experimenting with practices grounded in a variety of logics. When one logic (...) is dominant, innovations based on alternative logics may have trouble gaining the resources they need to become more broadly institutionalized. But if a changing environment starts systematically to favor practices based on an alternative logic, that logic can become stronger even in the absence of a coherent project to promote it. This is what happened in US academic science, as growing political concern with the economic impact of innovation changed the field’s environment in ways that encouraged the spread of local market-logic practices. In The Law of Peoples, John Rawls sets out his normative conception of global justice. The book remains a foundational text for scholars in the field. In recent years, however, new issues have arisen in the global justice literature, which Rawls did not consider. Moreover, his view has been rejected by many. So, as we move forward, does Rawls’ The Law of Peoples deserve to retain this foundational status? I argue that we have two weighty reasons to afford it (...) this status. As we consider the future directions of global justice, we should do so by returning to The Law of Peoples. (shrink)

The latest Omicron variant of the novel coronavirus has itself created a novel situation—bringing attention to the topic of healthcare rationing among hospitalized pediatric patients. This may be the first time that many pediatricians, nurses, parents, and public health officials have been compelled to engage in uncomfortable discussions about the allocation of medical care/resources. Simply put, finite budgets, resources, and a dwindling healthcare workforce do not permit all patients to receive unlimited medical care. Triage and bedside rationing decisions are happening (...) in a range of difficult everyday circumstances both implicitly and explicitly, but in ways not recognized by even the best ethically framed intentions. Clinicians and hospital administrators have largely been left on their own “to flatten the rationing curve” in hopes that resources never have to be explicitly rationed at their facility. Unfortunately, the downstream result is a misinformed and distrustful public (i.e. parents, guardians, and caregivers) filled with people who are already burdened with inflammatory pseudoscience narratives and deficits in health literacy. This paper aims to elevate a more thoughtful conversation about healthcare rationing by analyzing some existing ethical principles/framework developed for rationing decision making during previous emergency responses and drawing from the day-to-day clinical perspectives of a frontline pediatric acute care/hospitalist. In this paper I argue that it is finally time to move beyond the Nagelian framework and to break new ground in thinking about epistemic reduction in biology. I will do so, not by simply repeating all the old objections that have been raised against Ernest Nagel’s classical model of theory reduction. Rather, I grant that a proponent of Nagel’s approach can handle several of these problems but that, nevertheless, Nagel’s general way of thinking about epistemic reduction in terms (...) of theories and their logical relations is entirely inadequate with respect to what is going on in actual biological research practice. The Court of Appeals of New York held, in Council of the City of New York u. Giuliani, slip op. 02634, 1999 WL 179257, that New York City may not privatize a public city hospital without state statutory authorization. The court found invalid a sublease of a municipal hospital operated by a public benefit corporation to a private, for-profit entity. The court reasoned that the controlling statute prescribed the operation of a municipal hospital as a government function that must be (...) fulfilled by the public benefit corporation as long as it exists, and nothing short of legislative action could put an end to the corporation's existence.In 1969, the New York State legislature enacted the Health and Hospitals Corporation Act, establishing the New York City Health and Hospitals Corporation as an attempt to improve the New York City public health system. Thirty years later, on a renewed perception that the public health system was once again lacking, the city administration approved a sublease of Coney Island Hospital from HHC to PHS New York, Inc., a private, for-profit entity. In addition to their function in transport of water, ions, small metabolites, and growth factors in normal plant tissue, the plasmodesmata presumably serve as routes for cell‐to‐cell movement of plant viruses in infected tissue. Virus cell‐to‐cell spread through plasmodesmata is an active process mediated by specialized virus encoded movement proteins; however, the mechanism by which these proteins operate is not clear. We incorporate recent information on the biochemical properties of plant virus movement proteins and their interaction with plasmodesmata in a (...) model for transport of nucleic acids through plasmodesmatal channels. We propose that only single stranded (ss) nucleic acids can be transported efficiently through plasmodesmata, and that movement proteins function as molecular chaperones for ss nucleic acids to form unfolded movement protein‐ss nucleic acid complexes. These complexes are targeted to plasmodesmata. Plasmodesmatal permeability is then increased following interaction with movement protein and the entire movement complex or its nucleic acid component is translocated across the plasmodesmatal channel. Connolly, Noel Pope Francis in Evangelii Gaudium defines the church as a 'community of missionary disciples'. We have to be missionary to be called disciples. He dreams of 'a missionary option' that will transform everything. For Francis, mission is clearly essential to the church. He is continuing a movement that began with Ad Gentes, the missionary document of Vatican II. The fathers at the council insisted, 'The pilgrim Church is missionary by her very nature. For it is from the mission (...) of the Son and the mission of the Holy Spirit that she takes her origin, in accordance with the decree of God the Father'. This was reiterated by Paul VI in Evangelii Nuntiandi: 'Evangelizing is in fact the grace and vocation proper to the Church, her deepest identity. She exists in order to evangelize'; and by John Paul II in Redemptoris Missio: 'the Church is missionary by her very nature'. (shrink)

Psychological science is maturing and therefore transitioning from explorative to theory-driven research. While explorative research seeks to find something “new,” theory-driven research seeks to elaborate on already known and hence predictable effects. A consequence of these differences is that the quality of explorative and theory-driven research needs to be judged by distinct criterions that optimally support their respective development. Especially, theory-driven research needs to be judged by its methodological rigor. A focus on innovativeness, which is typical for explorative research, will (...) instead incentivize bad research practices (e.g., imprecise theorizing, ignoring previous research, parallel theories). To support the advancement of psychology, we must drop the innovation requirement for theory-driven research and instead require the strongest methods, which are marked by high internal and external validity. Precise theorizing needs to substitute novelty. Theories are advanced by requiring explicit, testable assumptions, and an explicit preference for one theory over another. These explicit and potentially wrong assumptions should not be silenced within the peer-review process, but instead be scrutinized in new publications. Importantly, these changes in scientific conduct need to be supported by senior researchers, especially, in their roles as editors, reviewers, and in the hiring process. An important obstacle to further theory-driven research is to measure scientific merit using researchers’ number of publications, which favors theoretically shallow and imprecise writing. Additionally, it makes publications the central target of scientific misconduct even though they are the main source of information for the scientific community and the public. To advance the field, researchers should be judged by their contribution to the scientific community (e.g., exchange with and support of colleagues, and mentoring). Another step to advance psychology is to clearly differentiate between measurement model and theory, and not to overgeneralize based on few stimuli, incidences, or studies. We will use ideas from the theory of science to underline the changes necessary within the field of psychology to overcome this existential replication crisis. (shrink)

Is there more to the recent surge in political realism than just a debate on how best to continue doing what political theorists are already doing? I use two recent books, by Michael Freeden and Matt Sleat, as a testing ground for realism’s claims about its import on the discipline. I argue that both book take realism beyond the Methodenstreit, though each in a different direction: Freeden’s takes us in the realm of meta-metatheory, Sleat’s is a genuine exercise in grounding (...) liberal normative theory in a non-moralistic way. I conclude with wider methodological observations. I argue that unlike communitarianism (the previous contender for the discipline’s renewal), realism has the potential to open new vistas, though their novelty is to a large extent relative to the last forty years or so: realism is best thought of as a return to a more traditional way of doing political philosophy. The distinction between action and omission is of interest in both theoretical and practical philosophy. We use this distinction daily in our descriptions of behaviour and appeal to it in moral judgements. However, the very nature of the act/omission distinction is as yet unclear. Jonathan Bennett’s account of the distinction in terms of positive and negative facts is one of the most promising attempts to give an analysis of the ontological distinction between action and omission. According to Bennett’s account, an (...) upshot is the result of an agent’s action if and only if the relevant fact about her conduct is positive. A proposition about an agent’s conduct is positive if and only if most possible movements of the agent would not have made that proposition true. However, Bennett’s account will fail unless it is possible to make sense of claims about ‘most possible movements of the agent’. We need a way of comparing the size of subsets of the behaviour space (the set of possible movements). I argue that Bennett’s own method of comparison is unsatisfactory. I present an alternative method of comparing subsets of the behaviour space. (shrink)

Regulation of gatekeepers of taxation has been so controversial and important that a review of ethical standards, professional responsibility and industry guidelines is examined. This paper explores whether gatekeepers of taxation need more ethics and enforcement to increase the compliance rate. In this paper we argue that an effective mixture of professional ethics and enforcement of gatekeepers can increase tax compliance. However, we question how much is optimal or reasonable? We theorize that ethics and enforcement should be proportionate to the (...) ecosystem because too much of it can lead to unintended consequences such as increase costs and higher noncompliance. A friendlier tax authority with less complex laws can enhance the compliance process. This strategy, in amalgamation with professional ethics, enforcement policies, and effective reporting systems, could increase the compliance rate. (shrink)

The history of the early phenomenological movement involves a tale of two schisms. The Great Phenomenological Schism originated between 1905 and 1913, as many of his contemporaries, for example, Pfänder, Scheler, Reinach, Stein, and Ingarden, rejected Husserl’s transformation of phenomenology from the descriptive psychology of his Logical Investigations into the transcendental idealism of his Ideas I. The Phenomenological-Existential Schism started between 1927 and 1933, as with Being and Time Heidegger moved away from Husserl’s transcendental phenomenology of consciousness toward an ontological (...) analytic of existence. Yet these schisms were not unrelated developments. Closely following the documentary evidence to determine the exemplary nature of Heidegger’s critique of Husserl’s move into transcendental idealism, this essay establishes the inextricable linkage between the Great Phenomenological Schism and the Phenomenological-Existential Schism. The last 15 years have seen a remarkable set of changes in the global business environment. Established companies and start-ups alike have been subjected to some fundamental shifts in the very way that we conceptualize business. Together with some generational challenges we have seen myriad calls for a new narrative about business. And, even more recently, the COVID pandemic has reinforced a number of these shifts and led to even more fundamental change. The purpose of this essay is to outline (...) these challenges to the dominant narrative about business and to suggest that it is no longer a useful way to think about value creation and trade (business). Kant’s conception of nature’s having a “purposiveness without a purpose” was quickly picked by the Romantics and made into a theory of art as revealing the otherwise hidden unity of nature and freedom. Other responses (such as Hegel’s) turned instead to Kant’s concept of judgment and used this to develop a theory that, instead of the Romantics’ conception of the non-discursive manifestation of the absolute, argued for the discursively articulable realization of conceptual truths. Although Hegel did not argue for the (...) “end of art” (although it is widely held that he did just that), he did, curiously enough, claim that it is art and not philosophy which tells us about the “life” of agents. To see how he reconciles that claim with his otherwise entirely discursively oriented philosophy, it is necessary to look at his thesis of the end of art’s “absolute” importance. Hegel’s worries have to do with the impossibility of fully exhibiting the “inner” in the “outer” in modern art and with the newly emerging problem of “fraudulence” in the poet’s voice. This is illustrated by examples drawn from the history of music and the problems besetting the lyric poet in modern life. Because of these problems, we are, Hegel says, now “amphibious animals” having to live in different and seemingly incompatible worlds. Hegel’s student, Heinrich Heine, found that the only satisfactory way of responding to this was for the modern artist to adopt a distinctive type of irony in response to the Hegel’s worries about modern art. This form of irony, it is argued, is itself Hegelian in spirit. (shrink)
