Pour répondre, l’article revient sur les parcours d’engagement dans des dispositifs participatifs municipaux. Il montre en quoi les temporalités de la sphère civique sont déterminées par les sphères professionnelles et familiales. La démonstration déconstruit des figures habituelles de l’indisponibilité (actifs, salariés, parents) et de la disponibilité (retraités) pour l’engagement participatif. Les temps de la participation citoyenne sont situés dans l’espace (...) social. L a disponibilité biographique conditionne la disposition à participer, mais de façon différenciée selon le groupe social. La retraite peut entraîner la quête d’activités ou le choix de s’en détacher ; les modes de travail peuvent sensibiliser aux méthodes participatives ou y rendre hermétiques ; le rapport au travail peut impliquer la subordination ou la subjectivation ; la parentalité... Although there exist advantages to group-living in comparison to a solitary lifestyle, costs and gains of group-living may be unequally distributed among group members. Predation risk, vigilance levels and food intake may be unevenly distributed across group spatial geometry and certain within-group spatial positions may be more or less advantageous depending on the spatial distribution of these factors. In species characterized with dominance hierarchy, high-ranking individuals are commonly observed in advantageous spatial position. However, in complex social systems, individuals can develop (...) affiliative relationships that may balance the effect of dominance relationships in individual's spatial distribution. The objective of the present study is to investigate how the group spatial distribution of a semi-free ranging colony of Mandrills relates to its social organization. Using spatial observations in an area surrounding the feeding zone, we tested the three following hypothesis: (1) does dominance hierarchy explain being observed in proximity or far from a food patch? (2) Do affiliative associations also explain being observed in proximity or far from a food patch? (3) Do the differences in rank in the group hierarchy explain being co-observed in proximity of a food patch? Our results showed that high-ranking individuals were more observed in proximity of the feeding zone while low-ranking individuals were more observed at the boundaries of the observation area. Furthermore, we observed that affiliative relationships were also associated with individual spatial distributions and explain more of the total variance of the spatial distribution in comparison with dominance hierarchy. Finally, we found that individuals observed at a same moment in proximity of the feeding zone were more likely to be distant in the hierarchy while controlling for maternal kinship, age and sex similarity. This study brings some elements about how affiliative networks and dominance hierarchy are related to spatial positions in primates. (shrink)

ABSTRACT This paper is concerned with the question of whether an individual has a moral obligation to sign a protest petition which has been initiated on moral grounds. It is argued that there is such an obligation when the petition represents a viewpoint with which one broadly agrees. This is a general dury which may lapse with changed circumstances or which may be redeemed by some alternative action. It is argued that the duty to initiate a protest petition is, on (...) the other hand, supererogatory as far as an individual is concerned, but may be a duty for a community or group. Finally it is argued that protest petitions are essentially protests, not against evil deeds as such, but against evil deeds done in one's own name, and are therefore a vital aspect of democracy. La création d’entreprise n’obéit pas toujours à la finalité économique de la recherche du gain et du profit. Elle peut être aussi le moyen par lequel certains groupes sociaux, en l’occurrence ici les entrepreneurs d’origine maghrébine, contournent le marché du travail qu’ils considèrent comme le lieu privilégié d’expression de la discrimination ethnique. Seront analysées les trajectoires sociales et professionnelles de ces petits entrepreneurs et la façon dont ils mobilisent les réseaux sociaux pour trouver de nouveaux marchés, recruter du (...) personnel ou encore se procurer l’argent nécessaire pour lancer leur entreprise ou parer aux difficultés économiques conjoncturelles.The creation of an enterprise does not inevitably stems from an economic search for money and profit. It may also be the means through which some social groups – in this case entrepreneurs of Maghreb immigrant background – skirt around the labour market they regard as a privileged place for the emergence of ethnic discrimination. The social and occupational paths of these small companies’ heads will be analized, as well as the way they mobilize social networks with a view to finding new markets, recruiting staff or raising enough money to set up in business or face an economic crisis. This study aims to reveal patterns of e-petition co-signing behavior that are indicative of the political mobilization of online “communities”. We discuss the case of We the People, a US national experiment in the use of social media technology to enable users to propose and solicit support for policy suggestions to the White House. We apply Baumgartner and Jones's work on agenda setting and punctuated equilibrium, which suggests that policy issues may lie dormant for periods of time until some event (...) triggers attention from the media, interest groups, and elected representatives. In the case study presented, we focus on 21 petitions initiated during the week after the Sandy Hook shooting in opposition to gun control or in support of policy proposals that are alternatives to gun control, which we view as mobilized efforts to maintain stability and equilibrium in a policy system threatening to change. Using market basket analysis and social network analysis we found a core group of petitions in the “support law-abiding gun owners” theme that were highly connected and four “communities” of e-petitioners mobilizing in opposition to change in gun control policies and in favor of alternative proposals. La nouvelle rhétorique de Perelman identifie plusieurs types d'auditoires, dont l'auditoire spécialisé (un groupe de physiciens, les adeptes d'une religion) et l'auditoire universel ("l'ensemble de ceux qui sont considérés comme des hommes raisonnables et compétents en la matière"). Ce dernier se distingue des autres par son caractère fictif, car il est une construction mentale de l'orateur. Il pourrait donc reposer sur une pétition de principe, c'est-à-dire sur une ou des prémisses que l'on suppose admises alors qu'elles ne le sont pas. (...) Le travail avec les familles ayant une histoire en lien avec la migration nécessite une réflexion et une écoute adaptées. Dans ce contexte a été pensé un dispositif thérapeutique au sein d’un centre médico-psychopédagogique pour accueillir et prendre en compte l’origine culturelle ainsi que la situation transculturelle de ces familles. Cet article relate l’expérience clinique d’une mère et de son enfant autour de contes issus de la tradition orale du Maghreb dans le cadre d’un atelier rassemblant des dyades mères-enfants. Le (...) dispositif a pu restaurer le lien symbolique et dyadique, activer une autorisation à apprendre. La remobilisation des représentations culturelles au travers du conte a joué un rôle essentiel dans la renarcissisation à un niveau individuel pour une (re)construction identitaire. (shrink)

On vise à saisir les dynamiques de petits groupes sociaux et de réseaux personnels, de leur formation initiale à leur délitement. Pour cela, depuis 2011, je mène des enquêtes ethnographiques dans trois résidences universitaires en France, aux États-Unis et au Canada. J’effectue ainsi une analyse sur deux niveaux : celui de plusieurs groupes suivis conjointement sur chacun de ces terrains, et celui des relations et des réseaux qui émergent et évoluent. J’articule la représentation graphique des réseaux personnels (...) à des données qualitatives sur ces groupes et ces réseaux. La représentation des liens et des réseaux permet de compléter l’étude des relations affinitaires et de leurs degrés d’intensité. Elle donne aussi à voir l’évolution des réseaux personnels au cours de l’année universitaire. Les descriptions ethnographiques, quant à elles, révèlent la réflexivité des acteurs sur leurs réseaux personnels, et sur leurs évolutions. Cette analyse permet dès lors d’identifier quatre étapes dans le processus de formation et transformation de petits groupes sociaux. Ces quatre temporalités se retrouvent dans l’ensemble des groupes suivis conjointement, malgré la pluralité de leurs compositions. Nous pouvons alors nous demander si dans tout groupe social de ce type se retrouveraient ces quatre temps. En ce sens, cette recherche contribue à compléter les travaux sur les réseaux personnels et les temporalités de leurs évolutions, en apportant une démarche ethnographique et microsociologique. The use of epithets was a fundamental component of Greek polytheism. The present study brings attention to a small subgroup of such divine bynames, referred to as individual epithets because they stem from the names of mortal individuals. The function of these epithets is to designate a deity specifically concerned with the individual in question, thereby providing a close relationship and personal benefits for the eponymous worshipper and his or her close kin. The article exemplifies the phenomenon through the investigation (...) of a goddess Isis Aphrodite Dikaia identified in Hellenistic Delos. Through the epithet Dikaia, two Athenian brothers, Dikaios and Asklepiades, sons of Dikaios, intimately tie the deity to themselves and their family. It is moreover proposed that a positioning of the epithet in its historical and physical context furthers our understanding of its origins and significance.L’usage des épithètes était une composante fondamentale du polythéisme grec. Cet article se penche sur un petit groupe de surnoms de ce genre, que l’on appelle des épithètes individuelles, dans la mesure où elles dérivent du nom d’individus mortels. Ces épithètes ont pour fonction de montrer qu’une divinité est particulièrement concernée par l’individu en question, fournissant dès lors une relation étroite et des bienfaits personnels pour le fidèle éponyme et sa famille proche. L’étude illustre le phénomène en investigant la déesse Isis Aphrodite Dikaia que l’on rencontre dans la Délos hellénistique. Par l’épithète Dikaia, deux frères athéniens, Dikaios et Asklépiadès, fils de Dikaios, associent intimement la divinité à eux-mêmes et à leur famille. Ce qui frappe chez Spinoza, c'est une volonté constamment manifestée de se rendre maître de son destin. Fils de notable, ses qualités intellectuelles laissaient augurer d'un brillant avenir dans la communauté judéo-portugaise d'Amsterdam. Mais il éprouva le besoin d'élargir son horizon intellectuel. La preuve en est son désir d'apprendre le latin, langue savante de l'Europe chrétienne. Ce fut alors la rupture avec les siens. En 1656, après avoir échappé au poignard d'un fanatique, il fut excommunié par le conseil des rabbins (...) pour hérésie. Devenu polisseur de verres optiques, Spinoza mena dès lors une vie simple et retirée, tout en restant attentif aux événements de l'époque, entouré d'un petit groupe d'amis sûrs. Spinoza fut le premier à proposer une exégèse rationaliste de la Bible, qui l'amena à formuler la distinction entre le croire et le savoir : Dieu n'est pas extérieur au monde, mais immanent à la nature, il est la Nature. Il réfuta également toute supériorité de l'âme sur le corps et substitua ainsi une éthique à la morale : il n'y a pas de Bien ni de Mal, mais du bon et du mauvais. Du Court traité à l'Éthique, en passant par le Traité théologicopolitique, Jean Préposiet a choisi de donner une vue panoramique du projet philosophique de Spinoza. Il suit pas à pas l'élaboration d'un système qui fut en même temps, pour son auteur, une manière de vivre. D'où la part centrale que tient dans l'ouvrage l'élément historique et biographique. Connu pour sa contribution à l'historiographie spinoziste internationale - Spinoza et la liberté des hommes, Bibliographie spinoziste -, Jean Préposiet est également l'auteur chez Tallandier d'une Histoire de l'anarchisme, ouvrage traduit en plusieurs langues. Le plus ancien exemple de l'utilisation de statues féminines pour remplacer des colonnes se trouvant à Delphes, l'article suggère que ce sont les exigences du sanctuaire, avec son espace réduit, qui sont en quelque sorte à l'origine de ce type. Ces figures peuvent être mises en relation avec un petit groupe de trésors éoliques et ioniques de Delphes qui étaient ornés d'une profusion de moulures au décor élaboré. La richesse de l'architecture y était rehaussée par l'addition de la sculpture et (...) par l'introduction d'une frise ionique sculptée continue à la place des denticules. La grande taille des moulures suggère qu'à Delphes les architectes ioniens tentèrent de reproduire en miniature la profusion et l'élégance des grands temples monumentaux de leur patrie. C'est dans le cadre de ce processus de miniaturisation que la figure féminine isolée aurait été introduite, à la place des tambours de colonnes sculptés utilisés dans les temples colossaux d'Ionie de l'Est. L'idée, reprise ensuite par l'architecte de l'Érechthéion, se serait répandue à partir d'Athènes. (shrink)

Les expériences de «classe inversée» apparaissent aujourd'hui prometteuses. Alors que, dans les «classes traditionnelles», on «fait cours» à l'Ecole avant d'envoyer les élèves «travailler» chez eux, dans les «classes inversées», le professeur propose aux élèves de prendre connaissance d'un exposé enregistré ou d'une séquence illustrée puis les accueille en classe pour répondre à leurs questions et les accompagner dans la réalisation d'exercices ou de projets... On comprend que ce modèle pédagogique soit particulièrement attractif : à l'ère du numérique, au moment (...) où tant de ressources documentaires sont disponibles, le professeur voit ainsi son rôle renouvelé et peut se consacrer pleinement à l'appropriation des connaissances. Mais il ne faut pas, pour autant, basculer dans la naïveté spontanéiste. Prendre connaissance d'une information ou regarder une vidéo pour en tirer quelques enseignements ne vont pas de soi et le risque existe que beaucoup d'élèves n'en profitent guère. De même, interroger le professeur pour mieux comprendre un phénomène, faire un exercice de manière autonome ou travailler en petits groupes pour résoudre un problème ne sont pas des comportements faciles à mettre en oeuvre. Etre intellectuellement actif, s'engager dans un travail et le mener à bien ne se décrète pas, cela se forme. Et, précisément, l'ouvrage d'Alain Taurisson et de Claire Herviou nous montre comment faire. Prenant appui sur des travaux scientifiques éprouvés et des expérimentations solides, présentant les références théoriques nécessaires et donnant de très nombreux exemples d'outils utilisables, les auteurs fondent une véritable «pédagogie de l'activité», garantissant pleinement l'engagement de chaque élève tant dans la prise d'information que dans l'assimilation et le réinvestissement des connaissances. Ils font ainsi de la «classe inversée» une véritable «pédagogie alternative». Au service de la réussite de toutes et tous. Et pour retrouver le bonheur d'enseigner... (shrink)

Pierre Teilhard de Chardin, jésuite et paléontologue, est surtout connu pour ses idées peu orthodoxes, au travers desquelles il tenta de concilier la science évolutionniste avec ses théories spirituelles personnelles. En dépit de la censure de la part des autorités ecclésiastiques, Teilhard essaya d’élaborer cette conciliation et de la disséminer dans les milieux intellectuels catholiques. Pour mener à bien ces deux projets, il trouva du soutien dans les cercles évolutionnistes de l’Université Catholique de Louvain et la maison jésuite de la (...) même ville belge. Le réseau louvaniste de Teilhard agit comme un amplificateur important de ses idées et lui offrit une aide concrète pour répandre celles-ci et pour éviter la censure. Malgré leur influence mutuelle significative, des divergences d’ordre philosophique entre Teilhard et ses amis louvanistes demeurèrent pourtant, et finirent par les séparer. Pendant les années 1930, le réseau louvaniste de Teilhard fut dissous en grande partie. Ses actions ne restèrent pourtant pas sans résultat. Ce petit groupe d’intellectuels fit sans aucun doute évoluer le climat en faveur de l’évolutionnisme au sein des milieux catholiques, et prépara, de cette manière, le succès des idées teilhardiennes à la suite de la Seconde Guerre mondiale. The Jesuit and palaeontologist Pierre Teilhard de Chardin is basically known for his not always orthodox conceptions by which he tried to reconcile evolutionist science with his personal spiritual ideas. In spite of censorship from the ecclesiastical authorities, Teilhard attempted to elaborate this conciliation and to spread it among catholic intellectuals. For both of these projects he found crucial support in evolutionist circles at the Catholic University of Louvain and the Jesuit house in the same Belgian town. Teilhard’s Louvain network proved to be an important sounding board and it offered concrete help in spreading his ideas and in bypassing the censorship. Despite significant mutual influences, philosophical divergences between Teilhard and his Louvain friends remained, and would eventually drive them apart. Therefore, in the 1930s, Teilhard’s Louvain network largely dissolved. However, its actions had not been without result. This small group of intellectuals definitely changed the climate among Catholics in favour of evolutionism and thus prepared the success that Teilhardian ideas would have in the aftermath of the Second World War. Bei der Verwirklichung dieser beiden Projekte fand er Hilfe in den evolutionistischen Kreisen der Katholischen Universität Löwen und bei der Jesuitengemeinschaft derselben Stadt. Das Löwener Netzwerk half ihm dabei, seine Ideen einem größeren Publikum zugänglich zu machen, und lieferte konkrete Unterstützung bei der Verbreitung der Thesen und bei der Umgehung der Zensur. Trotz ihrer bedeutenden gegenseitigen Beeinflussung bestanden jedoch auch weiterhin philosophische Divergenzen zwischen Teilhard und seinen Löwener Freunden, die schließlich zur Trennung führten. In den 30er Jahren wurde der Löwener Kreis um Teilhard größtenteils aufgelöst. Sein Handeln blieb jedoch nicht ohne Resultat. Diese kleine Gruppe Intellektueller hat mit Sicherheit dazu beigetragen, das Klima zugunsten der Evolutionstheorien innerhalb der katholischen Kreise zu verbessern und bereitete auf diese Weise den Weg für den Erfolg der teilhardschen Ideen nach dem Zweiten Weltkrieg. The reinterpretation of the Lord’s Prayer (Mt 6:9–13) as a prayer of thanksgiving rather than petition, based on their argument that the aorist tense in imperative and/or subjunctive verbs signifies actions completed in the past, along with their critique of the Lembaga Alkitab Indonesia (LAI) translation as erroneous, sparked debates among Christians in Indonesia and was leveraged by non-Christian groups to question the Bible’s authenticity. This study aimed to evaluate the validity of Purnomo et al.’s research by focussing on their (...) interpretation of the aorist tense in imperative and/or subjunctive verbs, research methodology, use of literature, critique of the LAI translation and theological implications. A comprehensive review of literature and exegesis was conducted to analyse the grammatical, linguistic, methodological and theological aspects of the text. Based on a detailed examination, this study found that their interpretation of the aorist tense in imperative and/or subjunctive verbs in the prayer was unsupported by linguistic evidence and contradicted the principles of biblical Greek grammar, where the aorist tense emphasises ‘aspect’ rather than ‘time’ (e.g., ‘past tense’) of actions. Consequently, the theology derived from their study was flawed. Moreover, the study affirmed that the LAI translation accurately reflects the original context of the text. This research concluded that Purnomo et al.’s interpretation of the Lord’s Prayer (Mt 6:9–13) contained significant theological and linguistic errors that require revision.Contribution: This research critically contributes to biblical theology by addressing interpretative challenges in Matthew 6:9–13, refuting claims that the Lord’s Prayer expresses gratitude based on the aorist tense. It reaffirms the prayer as a supplication, grounded in biblical Greek grammar and theology, while defending the accuracy of the LAI translation. Advancing critical exegesis, the study promotes rigorous theological discourse and a deeper understanding of Scripture. (shrink)

To examine Heidegger's pedagogy is to be invited into a particular era and cultural reality—starting in Weimar Germany and progressing into the rise and fall of the Third Reich. In his attempt to reform the German university in a strictly hierarchical, authoritarian and nationalistic mold, Heidegger addressed one group of students and professors and not another. The petit‐bourgeois student and the future philosophers he invited with his ‘logic of recruitment’ into the corps of instructors, would share his coded language with (...) its built‐in taboos and censorship. The result was a rhetoric of absolute self‐reference and a semiotic of pure propaganda, based on the evocation of the ancient Greeks in which the philosopher meant to project all that was properly Germanic. Heidegger's rhetoric is exclusionary; its politics and its philosophy are interpenetrating. His lecture courses grew increasingly poeticized, and thus mired in ambiguity, evasion, elision, avoidance, grandiloquence. Parallels are drawn in this essay between Heidegger and our time. Is Heidegger's insistence on autocratic controls within the German university comparable to the corporate positions taken today by some educators? How does the shifting relation between disciplines affect the role of the specialist? How might the sciences morales or humanities, along with the much maligned ‘humanism’, be redefined morally and holistically? (shrink)

Freedom of association holds an uneasy place in the pantheon of liberal freedoms. Whereas freedom of association and the abundant plurality of groups that accompany it have been embraced by modern and contemporary liberals, this was not always the case. Unlike more canonical freedoms of speech, press, property, petition, assembly, and religious conscience, the freedom of association was rarely extolled by classical liberal thinkers in the seventeenth and eighteenth centuries. Indeed Thomas Hobbes, David Hume, Adam Smith, and others seem to (...) have regarded freedom of association with some trepidation because of the violent, irrational, and factional behavior of groups. This chapter illuminates these anti-associational assumptions in the writings of James Madison. Although Madison famously deplored political associations as sources of faction and civil dissension, he differed from other members of the Founding generation in his willingness to defend associational freedom. Madison's writings also shed light on the unenumerated status of the freedom of association in American constitutional law. (shrink)

Kleinschmidt's definition of the “Weltformenkreis” as the smallest systematical unit of affinity removes any danger of obliterating the type and at the same time opens a way for judging the superior taxonomic groups on principle differently from the subspecies of a “Formenkreis”.It is demonstrated that the characters of geographical subspecies are characters of apparent shaping, those of the species however are characters of construction and qualitative and autonomic ones. It is the type differentiating in quality that justifies the definition of (...) species. As the characters of type do not necessarily appear gradual and quantitative, but are qualitative, the types cannot be derived from one another, unless they are conceived by the common superordinate idea of the superior systematical category next in order.The distinct division of species is opposed to the hypothetical continuity of the pedigree, which cannot be explained by a consanguinity nor by an affinity based on reproduction. The pedigree, however, is an expression of the spiritual order of nature, in which the types appear as units hierarchically graduated and determined by entelechy, not by dead matter.Within the systematical units there is a creative evolution, steadily pursuing its aim and leading from the primitive stage to the differentiated one, beginning with a juvenile phase, which is followed by orthogenetic maturity and, finally, by the aged stage with its “detypification”. The adaptation to the environment may be also proved for the primitive forms and is an organic part of the whole design of the world for them as well as for the specialized and differentiated forms. — The formation of new types cannot be explained in a merely mechanical way; everywhere, even in the gens and genoms, we state ingenious modifications, which do not only bring about a reaction of a single modification to the whole, but operate from the whole. Since the origin of man, since the tertiary formation, the creation of species has completely ceased. There are only alterations of subspecific character.After a digressive treatise on the fundamental difference of man and animal in order to explain the type the superior systematical categories are characterized as spiritual realities. It is especially for the “genus” that a revision is necessary. The reality of the common origin of certain species within the genus is not based on reproduction , but on the superior totality comprising the species. Individuals can be conceived by the character of the species, species by the character of genus only. This is an evidence for the methodicalness of creative nature. It excludes any evolution of the genus “from bottom to top”, which is irregular, accidental or immediately formed by environment. Après un traité digressif sur la différence essentielle de l'homme et de l'animal pour expliquer le type les groupes systématiques supérieurs sont caractérisés comme des réalités spirituelles. C'est surtout pour le genre qu'une révision est nécessaire. La réalité de la racine commune de certaines espèces dans le genre ne se fonde pas sur la reproduction , mais sur la totalité supérieure qui implique toutes les espèces. Des individus sont compris par le caractère d'espèce, des espèces seulement par le caractère de genre. C'est une preuve de la méthode de la nature créatrice. Elle exclut une évolution de genre „du bas en haut”, qui est irrégulière, faite par hasard ou formée directement par le milieu. Qu'est que la mathematique? Quel role y joue l'intuition? Sur quels principes repose-t-elle? Les Premiers ecrits de Bolzano proposent une reponse. Ils reunissent les oeuvres philosophiques, logiques et mathematiques les plus representatives de la periode de son activite publique, de 1804 a sa revocation de l'universite en 1819, et sont groupes autour de deux textes fondamentaux: les Contributions a un expose mieux fonde de la mathematique (1810) et la Demonstration purement analytique (1817), completee par des extraits de la Theorie (...) des fonctions. Les Contributions, bien que tributaires en partie de Kant, renouvellent l'heritage leibnizien en soulignant le caractere objectif de la science. Accueillies par Goethe - un petit ouvrage distingue par sa valeur et son esprit - et commentees par Husserl, elles constituent une premiere etude moderne des fondements de la mathematique, dont les notions de demonstration et d'organisation deductive du savoir sont les pivots. En annexe, Bolzano offre une critique penetrante de la philosophie de Kant. La Demonstration purement analytique, un petit classique d'histoire et de philosophie de la mathematique, inaugure avant Cauchy l'arithmetisation de l'analyse infinitesimale. Cet article propose la première publication complète d’un monument consacré par les Thespiens aux Muses dans leur sanctuaire au pied de l’Hélicon, dont les éléments constitutifs sont connus depuis le xixe s., et notamment depuis les fouilles de P. Jamot au Val des Muses. Les statues en bronze de petite taille des neuf Muses se dressaient sur une base en arc de cercle d’une ampleur de ca 10 m, placée dans un écrin architectural largement ouvert sur l’extérieur. Un nouveau lustre (...) est donné à ce groupe statuaire hellénistique exceptionnel à l’époque d’Auguste par la gravure, sous chacune des figures, d’une épigramme descriptive et érudite signée par le poète corinthien Honestos. Est ainsi conservé l’un des rares exemples archéologiques de recueil de poèmes décrivant des œuvres d’art figuré. L’analyse des épigrammes et l’observation détaillée des mortaises de fixation visibles à la face supérieure des blocs de la base permettent d’émettre des hypothèses sur les types utilisés pour la représentation des Muses, mais aussi d’assurer, au‑delà de tout doute, que les statues prenaient place au milieu d’ornements végétaux en bronze qui évoquaient le paysage du Val des Muses. La représentation de la nature comme élément non plus secondaire, mais essentiel d’un groupe sculpté correspond aux recherches nouvelles de la basse époque hellénistique. Faute de fouilles exhaustives du sanctuaire des Muses, l’emplacement du monument ne peut être déterminé avec certitude. Des lettres de remontage nous apprennent en revanche qu’il a été déplacé, peut‑être à l’époque où furent gravés les poèmes d’Honestos. (shrink)

In 2013, when the state of Oklahoma erected a statue of the Ten Commandments on the grounds of the state capitol, a group calling themselves The Satanic Temple applied to erect a statue of Baphomet alongside the Judeo-Christian tablets. Since that time, The Satanic Temple has become a regular voice in national conversations about religious freedom, disestablishment, and government overreach. In addition to petitioning for Baphomet to appear alongside another monument of the Ten Commandments in Arkansas, the group has launched (...) campaigns to include Satanic "nativity scenes" on government property in Florida, Michigan, and Indiana, offer Satanic prayers at a high school football game in Seattle, and create "After School Satan" programs in elementary schools that host Christian extracurricular programs. Since their 2012 founding, The Satanic Temple has established 19 chapters and now claims 100,000 supporters. Is this just a political group perpetuating a series of stunts? Or is it a sincere religious movement? Speak of the Devil is the first book-length study of The Satanic Temple. Joseph Laycock, a scholar of new religious movements, contends that the emergence of "political Satanism" marks a significant moment in American religious history that will have a lasting impact on how Americans frame debates about religious freedom. ABSTRACT Between 1920 and 1922, the University of Bristol biochemist, Maximilian Nierenstein, published four papers in a series exploring the structure of catechin in the Journal of the Chemical Society. The Society then abruptly refused to accept any more of his papers on catechin, or any other subject. It provided him with no reasons for the embargo until 1925. It then transpired that Nierenstein was boycotted because it was deemed that he had not responded adequately to criticisms of his work (...) made by his rival in catechin research, the German natural products chemist, Karl Freudenberg. It was not until 1929 that, as a result of a petition by a group of his former Bristol pupils and friends, that Nierenstein was again permitted to publish in the Society’s journal. The paper explores the Chemical Society’s treatment of Nierenstein in detail, sheds new light on his career and his reaction to the Society’s unprecedented boycott, examines some of the structural chemistry involved in the disputes, and discusses whether Nierenstein’s research deserves the label of ‘bad science’. In 1944, American Polonia consisted of two separate social groups. The first one was the so-called “old Polonia”. This group was significantly assimilated into America’s culture and way of life, and had strong self-help organizations. The second group, “new Polonia”, was formed of wartime émigrés, mainly with intellectual backgrounds. They experienced at first hand the anti-human policies of the Nazi and Soviet systems.In the Polish American Congress, founded in 1944 by representatives of both groups, there was great concern about the (...) policies of President Franklin D. Roosevelt. The fear was that these policies would allow Stalin, by a method of fait accompli, to introduce the Soviet system in all countries “liberated” by the Red Army. Old Polonia was under the influence of the US Administration and, despite reservations, supported the approach of Polish Prime Minister Stanisław Mikołajczyk who was committed to finding a Polish-Soviet compromise. Such a compromise turned out to be impossible because of Stalin’s demands. Firstly, nearly 50% of the pre-war territory of Poland was to be ceded to the Soviet Union. Secondly, fundamental changes were to be made in the government leadership of the Polish satellite state.New Polonia, which in 1942 formed the National Committee of Americans of Polish Descent, had a strong intellectual group. They warned the Polish American Congress and the US Administration against conceding to Stalin’s demands. From the perspective of the Sixtieth Anniversary of the Warsaw Uprising, their evaluation of Stalin’s policy has turned out to be correct.There was also a small group of Polish American activists centered around Professor Oskar Lange and the eminent poet Julian Tuwim, who belonged to the so-called Kościuszko League. During the Warsaw Uprising they were willing to accept Stalin’s demands and in connection with this supported the policies of the Polish Committee for National Liberation (a pro-communist coalition).The overwhelming majority of American Polonia was involved in unmasking false information about the Warsaw Uprising in the American press. They signed petitions to the President and Secretary of State. They collected money. They organized religious and patriotic meetings at which true information about the Warsaw Uprising was presented. This article investigates pro-environmental behaviours and activism focusing on the patterns of environmentally-oriented public behaviours (e.g. civic activities such as signing a petition about an environmental issue, giving money to an environmental group, or taking part in a protest or demonstration about an environmental issue, being a member of an environmental group) as well as environmentally-oriented private behaviours (e.g. sorting glass or tins or plastic or newspapers and so on for recycling, cutting back on driving a car, reducing the energy (...) or fuel you use at home, choosing to save or re-use water and avoiding of buying certain products for environmental reasons). Chaos theory is a rapidly growing field. As a technical term, chaos refers to deterministic but unpredictable processes being sensitively dependent upon initial conditions. Neurobiological models and experimental results are very complicated and some research groups have tried to pursue the neuronal chaos. Babloyantz's group has studied the fractal dimension (d) of electroencephalograms (EEG) in various physiological and pathological states. From deep sleep (d=4) to full awakening (d>8), a hierarchy of strange attractors paralles the hierarchy of states of consciousness. In (...) epilepsy (petit mal), despite the turbulent aspect of a seizure, the attractor dimension was near to 2. In Creutzfeld-Jacob disease, the regular EEG activity corresponded to an attractor dimension less than the one measured in deep sleep. Is it healthy to be chaotic? An active desynchronisation could be favourable to a physiological system. Rapp's group reported variations of fractal dimension according to particular tasks. During a mental arithmetic task, this dimension increased. In another task, a P300 fractal index decreased when a target was identified. It is clear that the EEG is not representing noise. Its underlying dynamics depends on only a few degrees of freedom despite yet it is difficult to compute accurately the relevant parameters.What is the cognitive role of such a chaotic dynamics? Freeman has studied the olfactory bulb in rabbits and rats for 15 years. Multi-electrode recordings of a few mm2 showed a chaotic hierarchy from deep anaesthesia to alert state. When an animal identified a previously learned odour, the fractal dimension of the dynamics dropped off (near limit cycles). The chaotic activity corresponding to an alert-and-waiting state seems to be a field of all possibilities and a focused activity corresponds to a reduction of the attractor in state space. For a couple of years, Freeman has developed a model of the olfactory bulb-cortex system. The behaviour of the simple model without learning was quite similar to the real behaviour and a model with learning is developed. (shrink)

O'Meara here articulates primary themes and developments in philosophical political thought in the classical Neoplatonic period, from Plotinus's (...) day in the mid-third century into the sixth century. Concurrently, he addresses head on "the conventional view that the Platonist philosophers of Late Antiquity had no political philosophy" (3). This view exemplifies the more general perspective that the Neoplatonists were simply disinterested in this-worldly affairs in lieu of "an immaterial world... our true 'homeland,' where we can at last attain the good we desire" (3). Consequently, O'Meara provides both a unique study of an important [End Page 205] topic and a compelling case for a more complete, balanced understanding of Neoplatonic other-worldly-ness. Over the past decade, genetically modified organisms have come to be viewed as problematic in Japan, as evidenced by a large number of newspaper articles covering questions ranging from the unknown ecological impact of GMOs to uncertainty about food safety, and by the fact that a number of consumers’ groups have organized activities including demonstrations at the experiment stations and the submission of petitions to the government. Against this backdrop, this article attempts to understand the changing interpretation of the perceived (...) rational social order in the context of the Japanese GMO controversies. Drawing on the French Theory of Conventions, the article will shed light on the conventions that serve as templates enabling actors to interpret what it means to introduce GMOs and what constitutes a rational decision concerning GMOs. The article will argue that rationality is best viewed as an emergent and interpretive process involving interpretation and negotiation by and among actors, and that conventions which may be taken for granted are nevertheless unstable and mutable. The Brazilian ayahuasca religions, Santo Daime, Barquinha, and União do Vegetal, have increasingly sought formal recognition by government agencies in Brazil and other countries to guarantee their legal use of ayahuasca, which contains DMT, a substance that is listed. This article focuses on new alliances and rifts that have emerged between and among different ayahuasca groups as they have sought and in some cases achieved formal recognition and legitimacy at the state and national levels in Brazil and abroad. It presents (...) a historical overview of the origin of the main ayahuasca religions, and their connections to the Amazon region and the state of Acre in particular, where the political environment has facilitated petitions seeking the elevation of ayahuasca as cultural and historical heritage in Acre and Brazil. This process has resulted in the active selection of certain symbolic, cultural, and historical elements and subtle changes in the ways various ayahuasca groups represent themselves in the public sphere. It also resulted in the reconfiguration of political alliances and a recasting of the historical facts regarding origins. The article reflects on notions of origin, place, authenticity, and tradition throughout the ongoing transformation of ayahuasca from “dangerous drug” to state and national heritage. (shrink)

This research aims to examine the concept of haecceity conceived by Gilles Deleuze and Félix Guattari - which has started from the notion given to the concept in A Thousand Plateaus - Capitalism and Schizophrenia 2 (Mille Plateau: capitalisme et schizophrénie 2, 1980). To illustrate this concept the philosophers turned to literature, and more specifically the Proustian literature. They affirm that the haecceity concept has found in the episode with the small group (la petite bande) of girls in the seaside (...) town of Balbec - the novel by Marcel Proust, In Search of Lost Time (À la recherche du temps perdu, 1913-1927) ¬- its best translation: "What's a girl, what is a group of girls? Proust at least show us and for all that their individuation, collective or singular, proceeds not by subjectivity but by haecceity, pure haecceity" (A Thousand Plateaus - Capitalism and Schizophrenia 2. Translation and foreword by Brian Massumi, Minnesota Press, 1987: 271). According to the Deleuzian thought, the fundamental question of haecceity concept is concentrated in its own definition: an individuation devoid of subjectivity, foreshadowing an individual who doesn't belong to individuation anymore, but it does to singularization. This non-subjectivated affirmation is part of an innovative philosophical proposal which has its own conceptual vocabulary: haecceity will exist in a new space (not extensive), where there's no distinction between the beginning or the end; the middle is where haecceity (formed by lines and not by points) will present itself as a rhizome. This mode of impersonal individuation reveals itself as a cartography that is made by forces - longitude - and intensities - latitude. Taking the group of girls as such a composition of forces moving, we will extract Albertine Simonet from it. She has the synonym of a group, and being adopted as an intercessor, she will leave the "group by group". The trajectory of this poetic and psychosocial entity (where the concept of haecceity originates from), will support us in the examination of the mode of existence of haecceity. (shrink)

Mayer (bio)Introducing the TaleA young girl about eleven years old appeared on the TV screen. She stood in an art museum expounding upon the painting hanging behind her. She talked about the artist and what the image portrayed. With an air of elitist prissiness that suited the museum environment, the girl delivered her (...) presentation to a group of schoolmates. As I and the other art museum educators assembled in the conference room where the video was shown learned, the girl had participated in a program at a prominent art museum in which students from her school came to the museum many times during the school year. This repeat-visit program culminated with these youngsters demonstrating what they learned about art by giving a talk on a single artwork to friends, family, or other classmates. The girl's recitation of art historically correct information was impressive. She sounded just like a junior art historian. Yet, something was missing. The little girl appeared to copy the style of art historical talk more than its content. I turned to the colleague sitting next to me and wondered, "Did that girl learn how to make meaning or how to talk like a curator?"Despite the several years that have passed since the conference, the image of that little girl lingers in my mind. A repeat-visit school program is what an art museum educator working with school tours desires.1 All an art museum educator can hope to impart on a one-shot tour is a simple exposure to art and the museum. Hopefully, that one encounter will result in a lifelong appreciation of art and art museums, but that is a tall order for one field trip. Repeat-visit programs, by contrast, allow knowledge and skills related to art to be presented in the school and museum and reinforced in subsequent sessions. Students can learn to meaningfully interpret the content [End Page 48] of works of art as well as make personal connections with them.The girl in the video, however, did not appear to be engaged in meaning-making. No hint that the painting had metaphorically come off of the museum wall and moved into her life experience appeared in the girl's presentation. Instead, she successfully imitated the manner of an art historian.In the essay "The Precession of Simulacra," the French sociologist Jean Baudrillard theorizes that reality or meaning no longer exist.2 Like the Moebus strip, which when split generates a duplicate of itself, what we experience as reality in this increasingly mediated age in which we live is no more than the repeated circulation of models or simulacra. Rather than models emerging out of real phenomena or originals, they beget themselves—models precede models. Any notion of reality implodes in the circulation of these simulations. Reality becomes what Baudrillard calls the hyperreal—simulation generating simulation. What does this imply for visual art? Interpretation of meaning in artworks would not reveal some represented truth of human experience; instead it would be the repetition of interpretive forms masking that there is no reality to represent. The talk by the little girl in the video indicated that art museum education, at least in that program, had become the perpetuation of a model of inquiry. Rather than making meaning, the girl reproduced the aesthetics of art history interpretation. Even under the ideal circumstances of a repeat-visit school program, the girl became the perfect model of a petite connoisseur.Although the video depicts one little girl in one art museum program, is there not a cautionary tale here for the field of art museum education?3 When visitors to art museums, including children on school field trips, participate in educational programs, are they engaging in meaning-making or an experience in the hyperreal? In theory art museum educators espouse facilitating meaning-making as their mission; however, in practice are they falling into a vortex of recycling the models of art historical interpretation they assimilated during their own education? This book offers an examination of the political dimensions of a number of Jean-Luc Godard’s films from the 1960s to the present. The author seeks to dispel the myth that Godard’s work abandoned political questions after the 1970s and was limited to merely formal ones. The book includes a discussion of militant filmmaking and Godard’s little-known films from the Dziga Vertov Group period, which were made in collaboration with Jean-Pierre Gorin. The chapters present a thorough account of Godard’s investigations on (...) the issue of aesthetic-political representation, including his controversial juxtaposition of the Shoah and the Nakba. Emmelhainz argues that the French director’s oeuvre highlights contradictions between aesthetics and politics in a quest for a dialectical image. By positing all of Godard’s work as experiments in dialectical materialist filmmaking, from Le Petit soldat to Adieu au langage, the author brings attention to Godard’s ongoing inquiry on the role filmmakers can have in progressive political engagement. Written by colleagues and friends in the United States and Britain, the essays are intended to reflect Simpson's own legal interests. Une revue socialiste méconnue, Révolte (1931-1934), donne à voir l’expression de « l’esprit des années trente » dans une SFIO marquée par la sortie de guerre et la défaite de Tours. Au sein de cette petite tribune parisienne, un groupe de jeunes militants cherche à rénover la doctrine socialiste, « chose vieille, trop connue », et à redresser la « vieille maison » pour qu’elle puisse conquérir les masses nouvelles et assumer enfin ses responsabilités en prenant le pouvoir. Cette « (...) Classe 22 », génération tout à la fois effrayée et fascinée par la modernité de l’après-guerre, élabore un discours et une pensée propres et singuliers, qui ne trouvent que peu d’échos dans la gauche française. Étouffée par un Parti qui cherche à maintenir coûte que coûte l’unité d’une famille socialiste fragile, puis invisibilisée par le Front populaire qui est le triomphe de la génération suivante, la Classe 22 échoue à exister. Cette génération entravée donne tout de même à voir la manière dont le phénomène de « l’esprit des années trente » a infusé dans le socialisme français. (shrink)

Let us hypothesize that there are three main "registers" of writing: narrative, description and commentary. "Narrative" and "description" are by definition concerned with diachronic and synchronic relationships ; and it may be said that taken together, they therefore exhaust the inventory of all relationships constituting the "world" our language regards as possible. It is often remarked that there is such an affinity between narration and description that on occasion they are hard to distinguish: narration is the description of an action (...) or change, and description mimes the action of relating items one to the other, and hence may have a narrative function. This solidarity of narration and description justifies their being grouped together as constituting the "topic" of literary discourse. But the function of "commentary," which correlates the text with a context, is to create a different type of relationship, in which makes the narrative/descriptive topic "meaningful." We are thus distinguishing "meaning" and "meaningfulness" on the grounds that "meaning" can be understood as the object of semantic analysis , whereas "meaningfulness" is the meaning bestowed on a set of relationships by an act of interpretation . This type of meaningfulness is what the moral of a La Fontaine fable most characteristically seeks to create. On s’interroge, dans ce livre, sur la façon dont les peuples sont représentés : question indissolublement esthétique et politique. Les peuples aujourd’hui semblent exposés plus qu’ils ne l’ont jamais été. Ils sont, en réalité, sous-exposés dans l’ombre de leurs mises sous censure ou – pour un résultat d’invisibilité équivalent – sur-exposés dans la lumière artificielle de leurs mises en spectacle. Bref ils sont, comme trop souvent, exposés à disparaître. À partir des exigences formulées par Walter Benjamin (une histoire ne vaut (...) que si elle donne voix aux « sans noms ») ou par Hannah Arendt (une politique ne vaut que si elle fait surgir ne fût-ce qu’une « parcelle d’humanité »), on interroge ici les conditions d’une possible représentation des peuples. Cela passe moins par l’histoire du portrait de groupe hollandais et des « portraits de troupes » totalitaires que par l’attention spécifique accordée aux « petits peuples » par les poètes (Villon, Hugo, Baudelaire par exemple), les peintres (Rembrandt, Goya ou Gustave Courbet), les photographes (Walker Evans, August Sander ou, pour un exemple contemporain, Philippe Bazin). Le cinéma, quant à lui, nomme figurants ces « petits peuples » devant lesquels agissent et s’agitent les « acteurs principaux », les stars comme on dit. D’où que les figurants incarnent un enjeu crucial, historique et politique, du cinéma lui-même, depuis sa naissance – La Sortie des usines Lumière – jusqu’à ses élaborations modernes chez Eisenstein et Rossellini, et bien au-delà encore. Une longue analyse est ici consacrée au travail de Pier Paolo Pasolini, à sa façon de retrouver les « peuples perdus » dans leurs « gestes survivants », selon un processus que permettent d’éclairer les analyses d’Erich Auerbach (pour les formes poétiques), d’Aby Warburg (pour les formes visuelles) et d’Ernesto De Martino (pour les formes sociales). Solar radiation management (SRM) may help to reduce the negative outcomes of climate change by minimising or reversing global warming. However, many express the worry that SRM may pose a moral hazard, i.e., that information about SRM may lead to a reduction in climate change mitigation efforts. In this paper, we report a large-scale preregistered, money-incentivised, online experiment with a representative US sample (N = 2284). We compare actual behaviour (donations to climate change charities and clicks on climate change petition (...) links) as well as stated preferences (support for a carbon tax and self-reported intentions to reduce emissions) between participants who receive information about SRM with two control groups (a salience control that includes information about climate change generally and a content control that includes information about a different topic). Behavioural choices are made with an earned real-money endowment, and stated preference responses are incentivised via the Bayesian Truth Serum. We fail to find a significant impact of receiving information about SRM and, based on equivalence tests, we provide evidence in favour of the absence of a meaningfully large effect. Our results thus provide evidence for the claim that there is no detectable moral hazard with respect to SRM. [Open access]. (shrink)

Pour l’auteur, l’enjeu est de doter la science d’un nouveau principe démocratique (...) qui permettrait, non pas de la sortir de la tourmente sociétale dans laquelle elle semble être prise, mais de la penser au pluriel dans la profondeur de son implication radicale au réel. In a profile in the November, 2012 issue of the magazine Architect, activist-architect Raphael Sperry, a founder of the group Architects Planners & Designers for Social Responsibility discussed his petition to amend the AIA’s Code of Ethics and Professional Conduct to include a prohibition on “the design of spaces intended for long-term solitary isolation and execution.”1 This issue is both serious and timely. It deserves contemplative attention before any action is taken. Flood University ofSurrey, England Claudel's career as a writer spanned almost seventy years, from the 1880s to the 1950s. The publication of his collected works now runs to twenty-nine large volumes, excluding his correspondence and diaries, so a brief overview of any particular dimension of his writing must necessarily be reductive. On the other hand, (...) Claudel's work lends itself particularly well to discussion in terms of the relationship between violence, sacrifice and religion. In a valuable study published more than twenty years ago under the title, Claudel et l'usurpateur, Jacques Petit drew attention to the recurrence in Claudel's plays, and in many of his non- fictional writings, of a narrative structure hinging on acts of usurpation and counter-usurpation. There is a pattern of conflictual rivalry, domination and coercion, whereby acts of aggression are ultimately legitimized, or in some sense excused, in the light of a positive outcome, providential necessity and/or reconciliation between usurper and victim. Claudel's world is indeed "a world of violence," as Petit puts it (79, ch. title).1 It is also a world ofreligion: after his return to the Catholic Church in 1890, all of Claudel's major dramatic works intermesh the process of usurpation with themes deriving from his religious beliefs, and the same is true of many of his non-fictional writings. My aim is not to reinvent the wheel by going back over all of the terrain mapped out by Petit. Nor do I intend to rework Petit's empirical model wholesale in the light of René Girard's anthropological model of mimetic desire and sacrificial violence, although there are obvious areas of convergence between them. However, I shall draw implicitly on both, in order to Translations throughout this paper are my own. 160Christopher G. Flood argue that the notion of sacrifice, which is central to the resolution of rivalries in Claudel's major plays, is transformed into an idiosyncratic conception of international conflict resolution in various non-fictional writings which emerge from his forty years of experience in his parallel career as a profes sional diplomat.2 1 shall start with a schematic discussion of certain features of the plays. The first point relates to Claudel's assumptions concerning the mechanisms involved in the outbreak of individual or collective violence. It needs to be emphasized that in his plays the path towards violence is always opened by a withdrawal or weakening of temporal and/or spiritual authority. This allows the crystallization, and the direct expression, of latent rivalries which eventually lead to an explosion of aggression. The causes of the violence invariably center on the fact that one individual or group is in possession of an object which is coveted by another individual or group. The question of whether Claudel himself appears to recognize a mimetic element in this pattern of behavior would be too complex, and too fraught with imponderables, to discuss here, but there are some indications that he does so. Whatever the case, in the absence of authority, rivalry and jealousy engender verbal, and usually physical conflict, culminating in usurpation of the desired object. Thus, for example, in Tête d'or, the elderly Emperor of the unnamed kingdom has neither the authority nor the resolution to defend his kingdom against external invasion, or against the man who saves the kingdom only to usurp the throne and murder the Emperor himself.3 Similarly, in the second version of La Ville, neither Besme, the positivistic scientist and plutocrat who has created the godless City, nor his brother Lambert, the former politician, has the will to maintain or defend the society against the tensions emerging within it. Thus, the City dissolves first into immobility, then revolution. Or again, in the family drama of La Jeune Fille Violaine (second version), the obsessional rage andjealousy ofMara towards her elder sister, Violaine, explodes into coercion, slander, and horrific violence when their father absents himself from the farm for an indefinite period, leaving Violaine to marry Jacques Hury: the fact that Hury loves Violaine, but does not love Mara, makes the latter all the... The article presents the argument that administrative decision-making should be understood as devoted to balancing between conflicting interests of individuals or groups, usually when none of the affected parties has predefined legal rights that are relevant to the substantial content of the administrative decision. Administrative decisions often have a direct effect not only on human and civil rights issues, but also on matters bearing on the quality of life, living conditions, prices of regulated products, and the allocation of government funds. (...) Since the decision as to which interest should prevail in the conflict is a distributive one and has many possible answers, the role of administrative law is primarily to ensure that these decisions are made fairly, with due weight given to the conflicting interests of the various groups and individuals involved. With this as background, the article shows how the doctrines of positive administrative law are designed to meet the challenge of coping with conflicting interests in the administrative decision-making process, using such examples as the prohibitions against decision-makers’ conflicts of interest and the rules regarding interest representation and judicial review. In the second part, the article applies the interest perspective to the administrative decision-making process in order to analyze the highly extensive regulation of land resources in Israel. The analysis concentrates on the Israeli Supreme Court decision in one of the most controversial petitions brought before it: against administrative decisions on the development of formerly agricultural lands. Depuis la fin du xiiie siècle et le « moment 1300 », l’Occident connaît une large diffusion de savoirs sur l’écrit juridique et gestionnaire. Ces savoirs semblent cependant se limiter à un groupe spécifique, celui des « clercs », « notaires » ou juristes, qui font de cette maîtrise le socle de leur activité professionnelle : apparaissent alors des usages graphiques participant de la construction de cette identité professionnelle. À partir du milieu du xive siècle, cependant, nous pouvons observer une (...) lente appropriation de l’écrit juridique par d’autres que ces professionnels de l’écrit grâce à un nombre de plus en plus important de documents, phénomène qui reste encore largement méconnu. Le manuel de Guillaume Flambart, noble de moyenne envergure et petit officier des forêts, est l’un de ces documents : regroupant des textes de toute nature ayant trait à l’exercice de la justice, il constitue un corpus linguistique de premier choix. La combinaison de plusieurs approches méthodologiques permet de faire émerger des normes graphiques cohérentes au sein de ce manuscrit et, en contre-point, de s’interroger sur l’appartenance de cet homme au groupe des « professionnels de l’écrit ». Publier en sciences économiques impose des délais considérables se chiffrant facilement en de multiples années, de la soumission à la parution. Aussi, le contenu des revues est en retard par rapport à la frontière de la recherche. Les principaux médias pour s’informer de cette frontière sont alors les conférences et les cahiers de recherche, des polycopiés qui circulent parmi certains scientifiques. Ceci favorise la formation de petits cercles fermés et exclut la participation de tiers à la pointe de la (...) recherche. L’apparition d’Internet a fondamentalement changé l’accès aux cahiers de recherche, mais encore faut-il que cet accès soit organisé et qu’il permette d’être lu par les autres. Le présent article décrit RePEc, une initiative qui a justement permis d’accorder tous les économistes sur un dénominateur commun et qui est maintenant devenue un instrument incontournable dans leur domaine de recherche. Des initiatives similaires dans d’autres champs de recherche sont aussi abordées.Publishing articles on the economics involves long time frames of up to several years, from submission to publication. Consequently, journal contents tend to lag behind what is happening on the research frontier. The most usual sources of information on frontier research are conferences and « working papers », which are photocopied documents that circulate among certain scientists. This practice is fostering the emergence of exclusive small groups and prevents third parties from participating in pioneering research. The Internet has radically changed possibilities for access to working papers, but Internet access still needs to be organised and to allow others to read one’s work. This article describes the RePEc initiative, which effectively places all economists on the same footing and has become an essential instrument in its field. Similar initiatives in other fields are also investigated. (shrink)

One of the main characteristics of this phase of the Israeli-Palestinian conflict is the resort by Palestinian groups to suicidal terror. This paper focuses on the unique nature of suicidal terror, since, I believe, it is this kind of terror that presents the most immanent threat to the foundations of politics and law in the free world. The article begins with a phenomenological exploration of the effect of suicidal terror on politics in Israel, inspired by the work of Hannah Arendt. (...) It presents the various manifestations of the suicidal terror as a new Paradigm of Violence. This new paradigm poses a great threat on politics: as the terrorists waive their effort to stay alive, deterrence becomes useless; the Israeli politics, in response, redraws the boundaries of the collective according to demographic lines; the feelings of helplessness reduces politics to personal tragedies giving up on normative arguments and long term policies. Compassion replaces persuasion. The attempt of an organized army to respond effectively to suicidal terror is ridden by the dilemma of effectiveness-legitimacy, that is, the more the response is effective, the more difficult it becomes to retain the distinction between the actions of the army and the actions of the terrorist. Moreover, during the attempt to bring the actions of the army to the review of the court, the legal system itself is infected by the same dilemma. The article examines the response of the Israeli Supreme Court to several petitions that questioned the legality of the means employed by the IDF in its fight against terror. These cases provide a unique opportunity to examine the way in which terror infiltrates into the very legal system that is called upon to respond to it, mainly by changing the legal language. The question that guides my discussion is what effect terror exerts on politics and law, and can law provide a way to resist the destructive influence of terror on the political system. (shrink)

The rule of law supports public discourse through, inter alia, the right to petition. The right to petition requires identification of those engaged in public discourse through petition. This requirement reflects a principle of general application. Solicitors owe an ethical duty to support the rule of law, including the right to (...) petition. Lawyers without a specific duty to uphold the rule of law have ethical duties to maintain the reputation of the legal system and their legal profession. Lawyers, including solicitors, are frequent contributors to public discourse. Lawyers sometimes resist identifying the clients or client groups they represent in public discourse on the ground of the need to protect client confidentiality.
