The paper advances an interpretation of political scandal and its place in democratic politics, taking the scandals of the ‘Watergate era’ in American politics as its evidential basis. The interpretation focuses on an aspect of political scandal that has been neglected in existing treatments, namely the politically constructed rather than epistemologically simple nature of scandalous ‘exposure’. The career of the ‘smoking gun’ in the Watergate era provides illustration. The paper goes on to relate political scandal as both symptom and stimulus (...) to trends in late-modern democratization concerning ‘hyperpolitics’ and ‘metainformation’ . In this article, we build on the stakeholder-politics literature to investigate how corporate scandals transform political contexts and give impetus to the contentious movements of fringe stakeholders against multinational corporations (MNCs). Based on Adut’s scandal theory, we flesh out three scandal-related processes that directly affect political-opportunity structures (POSs) and the generation of social movements against MNCs: convergence of contention toward a single target, publicization of deviant practices, and contagion to other organizations. These processes reduce the obstacles to collective actions by (...) fringe stakeholders by pushing corporate elites to be more sensitive to their claims, by decreasing MNCs’ capability to repress contentious movements, by forcing the targeted MNCs to formalize a policy to monitor and eradicate the controversial practices, and by helping fringe stakeholders find internal and external allies to support their claims. This conceptual model of scandals as catalysts of contentious actions contributes to a better understanding of stakeholder politics by unveiling the role of the political context in the coordination of fringe stakeholders. I apply stigma-management strategies to corporate scandals and expand on past research by (a) describing a particular type ofstigma management strategy that involves accepting responsibility while denying it, (b) delineating types of stigma that occur in scandals (demographic versus character), and (c) considering the moral implications of shifting stigmas that arise from scandals. By emphasizing the distinction between character and demographic stigma, I make progress in evaluating the moral implications of shifting different types of stigma.

We analyze whether companies involved in a security class action suit (SCAS) exhibit differential capital structure decisions, and if the information revealed by a corporate scandal affects the security issuances and stock prices of industry peers. Our findings show that before a SCAS is filed, companies involved in a scandal show a greater amount of security offerings than their peers and, due to equity mispricing, are more likely to use equity as a financing mechanism. Following a SCAS filling, these companies (...) exhibit a decreasing amount of total external finance raised and lower levels of book and market leverage. Industry peers' issuance patterns exhibit significant contagion, with reduced debt and equity issuance following the SCAS filing. Corporate scandals also have meaningful negative effects on stock prices and bond ratings. Similar to capital structure, we document contagion at the industry level with peers' share prices yielding negative returns as well. (shrink)

Ethics instructors often use cases to help students understand ethics within a corporate context, but we need to know more about the impact a case-based pedagogy has on students’ ability to make ethical decisions. We used a pre- and post-test methodology to assess the effect of using cases to teach ethics in a finance course. We also wanted to determine whether recent corporate ethics scandals might have impacted students’ perceptions of the importance and prevalence of ethics in business, so we (...) used in-depth case studies of several of the major scandals (e.g., Enron, Tyco, Adelphia). Our results are somewhat surprising since studying ethics scandals positively impacts students’ ethical decision making and their perceptions of the ethics of businesspeople. (shrink)

A review of the literature on corporate governance serves to demonstrate the applicability of many governance solutions to the university setting. Based on a review of university scandals, most of which are recent but some of which took place decades ago, it is possible to categorize them as follows: sex scandals, drugs, cheating, hazing, admissions and diplomas, on-the-job consumption, athletics, and murder. Several examples are provided in the paper, along with their impact on various stakeholders. The paper then discusses a (...) variety of solutions designed to either preempt the activities potentially leading to scandal, to deter them or to punish perpetrators. Some of these involve structural changes, institutional policies and procedures, fines, terminations, and sanctions. The paper emphasizes the proactive safeguards which govern and monitor to make sure that universities do not suffer on the back end and that their reputations do not suffer into the future. (shrink)

I want to argue here that certain Buddhist and Jewish thinkers say scandalous things on purpose. More scandalously still, I suggest that these statements are infused with deeply transformative ethical power, intended specifically as a way of relating to the dreadful fact of suffering. As scandals, these special responses to suffering intentionally rupture normal semantic patterns and sequences of thought, often through statements or actions which appear paradoxical. These scandalous statements are, in fact, always communicative in function, structure, and intent, (...) but they are designed to create a kind of 'cognitive dissonance'. The thinkers I consider here say scandalous things in order to cause a breaking-open in the consciousness of the hearer and practitioner, which produces compassion, transformation, and liberation. Counter-intuitively, this rupture highlights intersubjectivity and language. In thus talking about scandal and about ethical responses to suffering, this essay brings into dialogue ideas from two very different source traditions . I engage Mahayana Buddhist ideas in conversation with the modern Jewish philosopher of ethics, Emmanuel Levinas. (shrink)

This essay proposes to examine minority literature, and the scandals often associated with it, as a function of economy and choice. Rather than weighing the political strategies of identity and representation available to minority literature, this approach aims to dissect the ways its circulation is conditioned both by the modern liberal principle of self-ownership and by the flexible conversion of value among different economies characteristic of late capitalist forms of recognition. The entanglement of these spheres of value becomes explicit in (...) the moment of choice inherent to scandal, where the political or philosophical questions of minority identity are reduced to a matter of expenditure. Using the insights of Amartya Sen and Jean Baudrillard on the prerogative of choice in the constitution of capitalist subjects, I argue that it can offer a more comprehensive account of the political valence of minority literature, and its scandals, than the hermeneutics of representation. This article provides the first comprehensive reconstruction and analysis of Hintikka’s attempt to obtain a measure of the information yield of deductive inferences. The reconstruction is detailed by necessity due to the originality of Hintikka’s contribution. The analysis will turn out to be destructive. It dismisses Hintikka’s distinction between surface information and depth information as being of any utility towards obtaining a measure of the information yield of deductive inferences. Hintikka is right to identify the failure of canonical information theory (...) to give an account of the information yield of deductions as a scandal, however this article demonstrates that his attempt to provide such an account fails. It fails primarily because it applies to only a restricted set of deductions in the polyadic predicate calculus, and fails to apply at all to the deductions in the monadic predicate calculus and the propositional calculus. Some corollaries of these facts are a number of undesirable and counterintuitive results concerning the proposed relation of linguistic meaning (and hence synonymy) with surface information. Some of these results will be seen to contradict Hintikka’s stated aims, whilst others are seen to be false. The consequence is that the problem of obtaining a measure of the information yield of deductive inferences remains an open one. The failure of Hintikka’s proposal will suggest that a purely syntactic approach to the problem be abandoned in favour of an intrinsically semantic one. (shrink)

This paper examines the views of a number of late scholastic moral theologians, with emphasis on Francisco Suárez, about the limits of the duty to refrain from those otherwise permissible actions which make it difficult for people to choose uprightly. In so doing, the paper singles out and analyses a number circumstantial factors capable of excusing ordinary agents for giving others an occasion of sin.

This paper explores how a particular form of regulation—prior ethical review of research—developed over time in a specific context, testing the claims of standard explanations for such change against more recent theoretical approaches to institutional changes, which emphasize the role of gradual change. To makes its case, this paper draws on archival and interview material focusing on the research ethics review system in the UK National Health Service. Through an analysis of several high‐profile scandals in health‐care in the UK, this article discusses the nature of scandal and its impact on policy reform. The nursing profession is compared to social work and medicine, which have also undergone considerable examination and change as a result of scandals. The author draws on reports from public inquiries from 1945 to 2013 to form the basis of the discussion about policy responses following scandals in health‐care. In each case, the nature of the (...) scandal, the public and government discourses generated by events and the policy response to those failings are explored. These scandals are compared to the recent scandal at Mid Staffordshire Hospital. Conclusions are drawn about the impact of these events on the future of the profession and on health policy directions. Recent events have raised public anxieties about caring practices in nursing. Health policy reform driven by scandal may obscure the effect of under resourcing in health services and poses a very real threat to the continued support for state‐run services. Understanding the socially constructed nature of scandal enables the nurse to develop a greater critical awareness of policy contexts in order that they can influence health service reform. (shrink)

In this article I would like to turn away from our usual use ofthe word scandal and look more deeply at the connection between Rousseau's system and the theological or, more properly, the biblical notion of scandal. This notion is obscure. Girard calls this desire "mimetic" or desire that one receives from another. This type of desire leads to scandal. It is here that the connection with Rousseau becomes evident. He finished third, and thus created a small scandal: the judges—experts on Charlie Chaplin—proved to be so inept that they could not recognize the genuine article1. The simple, mimetic entertainment of a look-alike contest can become more (...) interesting when marked by a spirit of ironic play, which we may plausibly attribute to Charlie Chaplin, and it certainly becomes more interesting when marked by the scandal of inept authorities. Scandals have a way of attracting attention: we take notice, and often pleasure, when experts are shown to be fools. If, on the other hand, we are the experts, then we are likely to take offense and become embarrassed or uncomfortable, defensive or aggressive, humiliated or angry. Either way, we may be scandalized—at the actions of others or at the treatment of ourselves. The Chaplin story suggests three observations about scandal and imitation, which must be understood together because they are necessarily related, one requiring the other. First, models (in this case, Chaplin as the object ofimitation) may be transformed into idols, something fantastic or untrue that we are led to admire, desire, or worship. The movie idol Chaplin was sufficiently far removed from the actual human, Charlie Chaplin, that Charlie Chaplin finished the contest in third place. David McCracken147 Hebrew Bible, idolatry is more extreme: the golden calf is an attractive idol because it can be seen, a fantastic improvement (it would seem) over an invisible God whose mediator has decamped. Instead of worshipping God, the Israelites worship their own desires, which are literally "dungballs " in Ezekiel's graphic vocabulary. Whether the movement is from an invisible God named YHWH toward a golden calf or dung-ball, or from a movie star, who is usually seen as a large image on a silver screen, toward the movie-goer's fond, mental reconstruction ofhim, the process of idolatry leads humans to mistake the false for the real. Second, imitation has different forms: in a look-alike contest, imitation will depend to some extent on the happenstance of physical similarity—the size and face should resemble Chaplin's—but it will also depend on clothing and movement. The entrant Chaplin must have had a significant advantage in size and face, but this advantage was obviously not decisive. Since he failed to win, we begin to wonder: Did he wear the right clothes and hat? Did he, consummate actor that he was, move like Charlie Chaplin or rather more like Buster Keaton? Did he, for the sake of his little scandal, fail to appropriate himself, so to speak; did he misrepresent himself in order not to win? Looking alike is one thing, but appropriating and representing are quite another. Finally, imitation often involves rivalry, which leads to scandal: the Chaplin look-alike contest is a competition, a form ofrivalry that involves winners and losers—that is the point of the contest. By entering the contest, Chaplin made himself an unfair obstacle to the other contestants. But ifhe tried to lose, by not acting like Chaplin, he became an obstacle to thejudges, misleading them into the ludicrous conclusion that someone other-than-Chaplin looked more like Chaplin than Chaplin. The potential scandal is inextricably related to judgment and rivalry, however lighthearted it may be in this case. Like our ordinary contests, New Testament imitation raises the specter of competition: the Pharisee gives thanks that he is not like the poor man (he wins the competition for righteousness hands down, he thinks, and he is fundamentally persuaded that there is a competition); the disciples want to know who among them—the competitors—gets to sit on the right hand; and Peter maintains that, while other disciples may be scandalized, he will not be (he wins, they lose). This paper engages with the theme of disgrace from a Bourdieusian point of view. Starting out from a specific definition of ‘grace’ in terms of misrecognition, it goes on to consider some of the ways in which disgrace can be generated and some of the ways it can be handled by the disgraced party. While there are certainly many intra-field modalities of the genesis of disgrace, including violation of the rules of the game, the paper also emphasizes that disgrace can (...) be generated by cross-field events, necessitating a switch of perspective from individuals in one field to individuals in multiple fields. Academia bases reputation and standing on the number of published articles. As a result, the abilities and potential of researchers are also being judged by the number of articles they write, as well as on the impact factor of the journals in which their articles are being published. In itself this is not a problem, although one could of course question the assumption that the quantity of the output reflects the competence of individual researchers. As Altman has stated: “The length (...) of a list of publications is a dubious indicator of ability to do good research.”1 However, if senior faculty decide that the career progress of junior researchers in academia should be based on these criteria, academic medicine is bound to fail in fulfilling its role, namely maximising the quality of medical research and doing research for the right reasons. Like many corporations, the Catholic Church in the United States and Ireland has tried to move beyond scandal. In this case, the scandal was the failure of church leaders to protect minors from clergy sexual abuse, particularly in Boston and Dublin. Like corporate leaders, church leaders have faced the challenge of restoring trust after scandal. Influenced by corporate trends toward codes of conduct, the archdioceses of both Boston and Dublin provide codes of conduct, but the differences between them are worth (...) noting. In 2015, the Catholic Church in both the United States and Ireland highlighted the need for a culture of accountability that does not succumb to complacency, and in the United States the bishops have once again been encouraged to learn from business. This paper will demonstrate that the Catholic Church is in dialogue with and learns from codes of conduct and cultural practices in business. At the same time, it will highlight that the Catholic Church must also be attentive to its own mission since a simple adoption of other corporations’ practices can be detrimental to sharing the Gospel. The appropriation of codes of conduct and cultural practices from business reflects the church’s attentiveness to the signs of the times, and this appropriation needs to be evaluated in the light of the church’s mission to share the Gospel with the world. Classical liberalism stipulates that individuals may only reliably escape a state of war by joining a body politic whose unity is consolidated and preserved by the formation of a sovereign government. Frederick Douglass, through his own experience of slavery and then as a radical abolitionist critiquing the racialized laws and society of the United States, shows that there is an inherent scandal, a schism in the very idea of a body politic. This scandal cannot be overcome, but Douglass enacts a (...) treatment for it through a polemical ethic that endeavors to reconstruct political community, expansively and inclusively understood, by ever again bringing the ideal, as a regulative idea, into confrontation with the real. By putting Douglass and the historical situation of his time into dialogue with the natural law tradition of Aquinas, Locke, and the American Founding, this essay argues that Douglass’s thought and example provide a fresh way to address the crisis of liberal democracy in our time. This requires understanding the instability of the body politic as a source of strength rather than weakness, if properly confronted in a polemical ethics. (shrink)

Few scholarly writings compare to (...) this discussion ofmimetic rivalry and collective persecution for conveying a sense of the Bible's depths and secrecy, and for deciphering the wisdom inscribed in its images. Yet it is curious that Girard eschews the parables said to be the repositories of scriptural secrets. Both in Things Hidden (189) and in Quand ces choses commenceront (171-172), he distances himself from the parables as conceding too much to the human desire for a mythical God ofretribution. In light of all we have learned from Girard about our traditional misreadings of the Gospel, we might well question even the strongest impressions left by some of its figures. Might the parables' language of apocalyptic vengeance conceal a different revelation, just as an innocent death on a cross should disclose not the bloodlust ofa deity but the violence ofmen? Matthew's Jesus tells a story about a sowerwhose crop was infested by his enemy's weeds, weeds to be uprooted and destroyed at the harvest. And, granted, when Jesus translates the parable for the disciples he describes divine violence at the end ofhistory. The enemy is the devil and the sower is the Son ofMan who sends out his angels to discern the unrighteous ofhumanity and cast them into the furnace. But something does not seem quite right. Isn't Jesus' reduction of his own parable a little too obvious? And is there not John F. If we look closely at the very parable that surrounds the suggestion of "things hidden since the foundation ofthe world," we may see, however, that something is indeed hidden, hidden in the text. And what is hidden there confirms Girard's insight about the dominion ofmimetic rivalry since the world began. The Wheat and Tares is more than amyth ofdivine punishment. It is a parable ofthe essential human malady, a parable ofscandal. Despite the historical implausibility of contemporary commitments to a sovereign state-centric geopolitical imaginary, these commitments are indeed in force. Unfortunately, though, contemporary political theory and political philosophy are unable to account for the momentum of the sovereign state-centric geopolitical imaginary.The author claims that much of International Relations theory is a symptom of, rather than a serious analytical engagement with, this imaginary. He then provides an account of sovereignty as conceptually contradictory, exposing sovereignty as caught in a transcendental deadlock wherein its (...) conditions of possibility are at once its conditions of impossibility.Sovereignty is discussed as necessarily incoherent, leveraging the claim that sovereignty must be understood through the ill-fated attempts to instantiate it historically – attempts which, due to their conditions of possibility, are incessantly incomplete and thus ever repeated through domestic and foreign policy making. Following the landmark corporate scandals of the early 21st century, there appeared to be a tremendous increase in the U.S. business media's emphasis on issues of ethics in corporate leadership. The purpose of this research was to examine whether that apparent increase was reflected in an actual change in that media's portrayals of successful leaders. We content analyzed the text of a total of 180 articles in Business Week, Fortune, and Forbes magazine, 90 from the five years preceding the landmark (...) scandals and 90 from the five years following the scandals. We found no evidence that the landmark scandals had any impact on the media's incorporation of ethics in their portrayals of leaders. We attribute this substantially to the persistence of a world-view in the U.S. business press that emphasizes leader traits and actions that have a direct impact on corporate profits. Additionally, we found some interesting consistencies and differences in media portrayals across the two time periods, likely related to the rise and fall of dot-com businesses. We discuss the implications of these findings for researchers and corporate leaders. (shrink)
