The traditional international law of self-defense provides little indication about how far states should be willing to defend. That choice is better understood as constrained, beyond the jus in bello and the jus ad bellum, by human rights norms that implicate responsibilities of the sovereign vis-à-vis its own population. Different conceptions of human rights, however, underscore different possible theories of the extent of self-defense. The main polarity is between a conception of self-defense as protecting bare life and a conception of (...) self-defense as protecting collective self-determination. In the practice of justifying particular uses of self-defense, these foundations are constantly and dynamically rearticulated to justify fighting on, surrendering, or negotiating. This raises questions about the impact of conditions of uncertainty, different conceptions of agency, and the role of the international community. Ultimately, the article suggests that self-defense radicalizes anxieties about the foundation and finality of rights. (shrink)

Filling the most glaring gap in Shrivaishnava scholarship, this book deals with the history of interpretation of a theological concept of self-surrender-prapatti in late twelfth and thirteenth century religious texts of the Shrivaishnava community of South India. This original study shows that medieval sectarian formation in its theological dimension is a fluid and ambivalent enterprise, where conflict and differentiation are presaged on "sharing", whether of a common canon, saint or rituals or two languages, or of a "meta-social" arena such (...) as the temple. Srilata Mueller, a member of the Shrivaishnava community, argues that the core ideas of prapatti in these religious texts reveal the description of a heterogeneous theological concept. Demonstrating that this concept is theologically moulded by the emergence of new literary genres, Mueller puts forward the idea that this original understanding of prapatti is a major contributory cause to the emergence of sectarian divisions among the Shrivaishnavas, which lead to the formation of two sub-sects, the Tenkalai and the Vatakalia, who stand respectively, for the "cat" and "monkey" theological positions. Making an important contribution to contemporary Indian and Hindu thinking on religion, this text provides a new intellectual history of medieval Indian religion. To enact democracy, which is to live in communication with difference, requires a formative process that involves an education of the whole person for and through civic life. Drawing on Charles Mills's theory of Herrenvolk ethics and Jonathan Lear's analysis of psychosocial lapses that ail us, Sheron Fraser-Burgess and Chris Higgins pursue a critical, historiographical, and psychosocial reading of our failures to live up to this aspiration, offering (1) a critique of our tendency to saddle ourselves with a false choice (...) between a homogenizing unity and a differentiated but fractured republic; (2) a demonstration of why we must eschew a thin universalism of principles and confront difference as embodied; (3) an argument from the ethics of risk against the urge to reify and compartmentalize difference; and (4) an evocation of how deep pluralism itself might serve as a unifying creed. Civic education is not a matter of informing but of forming and cultivating vision and values. In pursuing the credal deep pluralism that is required to do justice to the prospects and perils of our democracy-in-the-making, the task of the formative educator may be more difficult; but by embracing this creed, teachers may inspire their students to do the same. A friend's mother who was taking an automotive repair course said, " We're going to learn to fix the brakes next week." The same folks would also use the possessive for common nouns in phrases (...) like: "I'll be ready after I take my shower." Although not incorrect, I believe this type of usage reflected a different attitude about brakes, showers, and other things. These tended to be more hands-on people and thus, in my understanding at least, had a more particular relationship with things in their world than others for whom objects were examples of types of things.This brief vignette serves as an introduction to my qualified enthusiasm for the project taken up by Allison Mitchell in her paper, "Taking Mentality Seriously: A Philosophical Inquiry into the Language of Addiction and Recovery" (Mitchell, 2006). Indeed, as a practicing psychiatrist I would be hard pressed not to endorse the use of language as a key to deeper aspects of experience.My following remarks are mostly contra Mitchell's hypothesis, but before beginning I name one more reason I think this project is worthwhile. In spite of much research and recitations of the motto "treatment works," we do not presently have a reliable treatment for addiction. The linguistic portrait painted by Mitchell allows us to view our treatments in vivo and reflect upon what we see. (For the purpose of this commentary, I consider alcoholism and Alcoholics Anonymous [AA] as a general example of addiction and treatment.)Medication treatment remains almost inconsequential except when applied for comorbid psychiatric disorders rather than the primary addiction. Even then it rarely serves to undo some form of self-medication, but instead only offers an important leg up in battling the addiction.Research and much experience has shown AA to be the single best treatment for alcoholism (Vaillant and Hiller-Sturmhofel 1996). Some investigators have proposed underlying mechanisms for its efficacy (some, like "creating dependency" run very counter to Mitchell) (Vaillant 2005). AA's success is highly dependent upon attendance (McCrady et al. 2004), which can of course be a marker for getting better in the first place and not solely a cause of improvement (i.e., people who are doing better attend more meetings not vice- versa). Even within AA, the dropout rate is quite high (Martin et al. 1996). Workers in this area [End Page 223] have raised questions about AA's approach and have proposed other avenues to sobriety, including interpersonal, cognitive–behavioral, and relapse prevention programs (Witkiewitz and Marlatt 2005, 2004; O'Dwyer 2006). Lamentably, some very large studies failed to show any effective ability to match up alcoholics with a particular treatment modality (Church 2004; Read 2004).Given the lack of clarity with which we still work, I think an approach like Mitchell's is a welcome call for serious reflection. The limitations of a linguistic analysis place an unfortunate constriction on implications to be drawn.Mitchell's chief concern is that the language of recovery, as reflected in twelve-step programs, betrays and even fosters a degree of passivity, which leaves the addict without an adequate sense of agency and autonomy with which to combat addiction. From a more philosophical perspective, Mitchell believes this is due to an incomplete philosophical materialism; one that lacks "mentality" (i.e., the sense that part of our physical being is made up of mental activities such as emotions, motivations, beliefs, etc.). This attitude is manifest in a "pretheoretic conception of the self" that leaves the addict with a dearth of self-awareness as a mental agent of action and change.In place of the standard recovery model in use today, Mitchell suggests cultivating a sense of self that values and fosters engaged agency that is both capable of self-control and responsive to external obligations.A Few ConcernsFirst, I will offer a few concerns about premises at work within the paper. In the contemporary US, a configuration of market theocracy has melded together laissezfaire economics and right-wing religious conservatism, in spite of the many differences among the groups involved; it is a configuration that remains powerful even as it is increasingly fractured. Market theocracy draws on the mechanism of literalism, not the literal reading of texts but a concept of realism based on a belief in a common-sense version of unmediated natural law. Literalism filters meaning through two concepts long available in (...) American culture: spirit and surrender. Analyzing this configuration requires an analysis of a double structure: a highly complex deployment of strategic vagueness, joined to claims of simple clarity, and wrapped in passionate, emotional intensity. It is the most valuable prize in mass-mediated US politics. This article traces literalism by way of the concepts of ‘surrender’ and ‘spirit’ in three secular discourses: a best-selling marriage self-help book for women; marketing texts directed at entrepreneurs and investors; and an academic study written for neoconservative economists, in order to assess the importance of the strategic deployment of literalism. Unlike the literal, literalism draws on the most advanced sophisticated technological resources of modernity in order to produce a form of ‘vague clarity’ characterized by passionate, affective intensities. This literalism often confounds scholars and activists on the left who, in too many cases, still presume that knowledge and faith, the secular and the religious, the rational and the emotional can be kept ‘cleanly’ separate. Recent years have seen psychoanalysis move out of the clinical area into the arena of empirical social research. This article uses a case study from a psychoanalytically informed media research project to explore conceptual, ethical, and methodological implications in research design in the light of this shift. The ideas of unconscious communication between interviewer and interviewee, the role of the researcher's subjectivity, and the impact of unconscious defences on the generation and interpretation of data are explored. The fate of war captives has been extensively explored, as, indeed, has the way that fate affects both the conduct and course of hostilities. Nevertheless, little research has been conducted on the link that connects the two, namely the act of surrender, and this is especially true of classical Greece. This article seeks to remedy this situation by answering three interlinked questions, namely: how men attempted to surrender on the battlefields of classical Greece; in what tactical conditions they (...) did so; and finally, what prospects they had of surviving the process. In this work I hold that William James’s conception of religion is divided between what could be identified as his voluntarism and his idea of self-surrender. In my approach, James’s voluntarism is the heart of The Will to Believe, whereas the idea of self-surrender is the key to understand The Varieties of Religious Experience. These two works respond to a tension in James’s philosophy and canbe seen as two antagonistic intellectual projects. The analysis of this inner tension in (...) James’s conception of religion is the core of this paper. I will also state that his self-surrender notion, unlike his voluntarism, allows us to visualize an essential aspect of James’s conception, that is to say, its morbid aspect. (shrink)

Although there is a vast body of work on legitimacy, we still have a limited understanding of the discursive aspects of moral legitimation. This is surprising considering the increase in morally laden societal discussions, for example related to understanding gender, rights and regulations during a pandemic, political scandals and ethics of global business amongst others. In particular, from an organization studies perspective, we lack knowledge on how journalists negotiate moral legitimation of controversial organizational decisions such as closures or shutdown decisions (...) related to global industrial restructuring. Therefore, drawing on the critical discourse studies tradition, we examine the media coverage of controversial shutdowns in Finland over the past 2 decades. Our analysis suggests three moral legitimation types: moral engaging, moral distancing and moral surrendering. These types involve specific discursive moralization practices and strategies, and they each paint a different picture of the moral options, responsibility, and inevitability in these decisions. These types can be found in the same texts supporting each other, but they also help us understand how legitimation may involve a pattern where the most explicit reflections (moral engagement) are followed by more indirect (moral distancing) and less apparent but very powerful (moral surrendering) forms of legitimation. By so doing, we also offer a heuristic that can, with due caution, be used for analyzing other texts on adverse effects of globalization or events that might include moral and ideological conflicts. This paper first argues that a state can justifiably fight a hopeless war of self-defense when its enemy determines to massacre its people after it surrenders or is defeated. The main reason is that, in this situation, even if the victim state surrenders, it still has to suffer from harms that are similar to or worse than the harms involved in fighting a hopeless war. This paper then discusses some complicated issues raised by applying this argument to various situations in (...) which the victims of war and the victims of massacre are not identical. I argue that, when the victims of massacre are randomly chosen, the victim state can justifiably fight such a war. When the victims of massacre belong to a specific group of people, the victim state should not fight such a war, even though the victims of massacre can defend themselves. Our cultural situation is to seek a moral form of self-constitution, rather than an ontological or epistemological foundation. Such a moral ground lies in the paradox of willing surrender of the will to do wrong or dysfunctional acts in order to enter temporally-extended processes of moral change. But the paradox of willing surrender of the will requires analysis. The propositional form of it cannot be sustained and must instead give way to willingness as an ongoing choice. The self-reflexivity (...) of the will with which we accomplish this turns out to be a core activity of human activity that seeks openness to moral growth through humility. The paper suggests that self-constitution in this manner this is what freedom is for us and is therefore the source of our hope. (shrink)

Education has long been charged with the taskof forming and shaping subjectivity andidentity. However, the prevailing view ofeducation as a project of producing rationalautonomous subjects has been challenged bypostmodern and poststructuralist critiques ofsubstantial subjectivity. In a similar vein,Emmanuel Levinas inverts the traditionalconception of subjectivity, claiming that weare constituted as subjects only in respondingto the other. In other words, subjectivity isderivative of an existentially priorresponsibility to and for the other. Hisconception of ethical responsibility is thusalso a radical departure from the prevailingview (...) of what it means to be a responsible moralagent. In this paper, I use jazz improvisationas a metaphor to focus on three interrelatedaspects of ethical responsibility on Levinas'saccount: passivity, heteronomy, andinescapability. I then point toward some waysin which reframing responsibility andsubjectivity along this line might offer newpossibilities for conceiving subjectivity andmoral agency in education. (shrink)

According to the ego-depletion account of loss of self-control, self-control is, or depends on, a depletable resource. Advocates of this account have argued that what is depleted is actually glucose. However, there is experimental evidence that indicates that glucose replenishment is not necessary for regaining self-control, as well as theoretical reasons for thinking that it is not depleted by exercises of self-control. I suggest that glucose restores self-control not because it is a resource on which it relies, but because it (...) serves as a signal of environment quality. I suggest that the evidence is better explained by a rival opportunity costs model of self-control than by the ego-depletion account. (shrink)

In this chapter, I argue that a certain kind of envy is not only morally permissible, but also, sometimes, more fitting and productive than admiration. Envy and admiration are part of our emotional palette, our toolbox of evolutionary adaptations, and they play complementary roles. I start by introducing my original taxonomy of envy, which allows me to present emulative envy, a species of envy sometimes confused with admiration. After reviewing how the two emotions differ from a psychological perspective, I focus (...) in particular on the distinct and complementary roles they play in the ethical and political domains. Like the determinist, the New Critic must proceed by assuming what he hopes to prove; he assumes the existence of "objective" relations between the words of the poem he is studying and then attempts to perceive such relations.1 The distinction between "objective"—that is, in some sense verifiable—and purely subjective or personal meaning must necessarily be a central one for this type of poetics. New Critics are constantly protesting that they are not "reading into" works, that the meanings they ascribe to (...) the words or images of a literary text are objectively there rather than subjectively imposed. Empson declares, speaking of a recurrent image in Donne's poetry, "the point is not so much what 'connotations' this 'image-term' might have to a self-indulgent reader as to what connotation it actually does have in its repeated uses by Donne"—there is clearly a semantic distinction to be made here, for Empson is using the same term, "connotation," to describe both what he does and what he does not mean.2 · 1. Would it be ethical to deploy autonomous weapon systems (AWS) if they were unable to reliably recognize when enemy forces had surrendered? I suggest that an inability to reliably recognize surrender would not prohibit the ethical deployment of AWS where there was a limited window of opportunity for targets to surrender between the launch of the AWS and its impact. However, the operations of AWS with a high degree of autonomy and/or long periods of time between release and (...) impact are likely to remain controversial until they have the capacity to reliably recognize surrender.
