The theory of emotions as affective position-takings (PT) is investigated from the perspective of a computational model of the belief-desire theory of emotions (CBDTE) proposed by the author. Both theories assume that a core subset of typical emotion episodes are the products of an evaluation process in which cognized states of affairs are evaluated for their congruence with the person's desires; and that emotions are, on the conscious level, feelings of pleasure and displeasure. However, according to PT the evaluation (...) is a concern-based construal and emotional feelings are intrinsically object-directed, whereas according to CBDTE, the evaluation is performed by a hardwired mechanism that produces nonintentional feelings. Furthermore, CBDTE suggests that hedonic feelings are simultaneously reactions to the detection of value, and representations of the detected value. (shrink)

Leif Wenar examines the impact on takings scholarship of the redefinition of "property" early in the twentieth century. He argues that the Hohfeldian characterization of property as rights (instead of as tangible things) forced major scholars such as Michelman, Sax, and Epstein into extreme interpretations of the Takings Clause. This extremism is unnecessary, however, since the original objections to the idea that "property is things" are mistaken.

:A norm of equal treatment is cited regularly in the American jurisprudence of property “takings” under the Fifth and Fourteenth Amendments to the Constitution, as a benchmark of fair treatment of owners. According to an increasingly prevalent version of this equality norm, courts should look to parity of treatment among property owners in investigating whether particular regulations “take” property. This essay argues, however, that such an equality norm is misplaced, and that courts should judge fairness by the criterion of (...) expectation—including reasonable expectations of regulation.A norm of equality becomes problematic in the face of the economic theory of the evolution of property. This theory posits that as resources become more congested, their uses carry increasing common pool costs or “externalities”—a scenario that should predictably result in more stringent resource management—up to and including the establishment of regulatory regimes as well as property rights themselves. This evolutionary pattern, however, places earlier and later resource users in different positions vis-à-vis both common pool externalities and regulatory responses, and their different temporal positions fragment the meaning of equal treatment and destabilize it as a jurisprudential norm. This essay argues that while equal treatment may be a benchmark for special or invidious cases, like those relating to civil rights, the great bulk of takings cases involve regulatory responses to congesting resources, where a norm of equal treatment breaks down. Thus, in seeking fair treatment, takings jurisprudence should downplay equality and instead look to the understanding of property as a basis of expectations—but those expectations should include the anticipation of reasonable regulatory responses to resource congestion. Discussion of W. Sellars's rediscovery of experiential presence continues with special reference to J. McDowell's and J.F. Rosenberg's recent articles on Sellars's understanding of perception, and a later effort by Sellars to cast light on the intimate relation between sensing and perceptual taking. Five main sections respectively summarize my earlier discussion of Sellars's account of experiential presence, draw on Rosenberg's explication of two Sellarsian modes of responding to sense impressions, consider McDowell's claim that Sellars's perceptual takings are shapings of (...) sensory consciousness, introduce Sellars's Kantian late account of experiential presence, and return critically to McDowell's thesis: Sellars's perceptual takings, notwithstanding their being purely conceptual actualizations, give us awareness of the very pinkness of a pink ice cube. The Endangered Species Act (ESA) can impose significant limitations on what landowners may do with their property, especially as it pertains to development. These restrictions imposed by the ESA are part of a larger controversy about the reach of the “Takings Clause” of the Fifth Amendment, which says that private property shall not be taken for public use without just compensation. The question this paper addresses is whether these restrictions require compensation. The paper develops a position on the general (...) question of compensation for regulatory takings and applies it to the ESA. The main argument concludes that compensation should be paid. It is based on the proposition that the goods provided by regulatory takings are typically public goods, and on a principle of fairness, which holds that compensation should be paid when those who benefit from a regulatory taking pay virtually nothing and those who pay receive hardly any benefit. It is argued that this principle is implicit in many of the Court's rulings on regulatory takings. (shrink)

Procreation with donor gametes is widespread and commonly accepted, but it involves ethical questions about the child's best interest. Understanding the historical structures of the moral discussion of gamete donation may contribute to reflecting on the child's best interest. This is why I have analysed the debate on gamete donation in the Netherlands, and this analysis has uncovered some striking discontinuities. Notions of the child's best interest have undergone a radical swing. In the past, it was considered acceptable to conceal (...) the truth about the child's biological origin, but in the past two decades the general opinion has changed to the common belief that this information should be shared with the child. This changed notion of the child's best interest will be analysed using a framework encompassing three views of the child, which derive from the debate on children's rights. These three views each provide a different interpretation of the child's moral and political status. I conclude that the changed notion of the child's best interest results from a view of the child that focuses on autonomy and citizenship, and which frames the child's interests according to its legal status. I comment on this view and I champion an alternative one, namely ‘the embedded child’. This is a relational view based on care ethics that goes beyond what can be articulated in law, and that will help to establish a more balanced interpretation of the child's best interest at the practice and policy levels of gamete donation. Taking Wittgenstein at His Word is an experiment in reading organized around a central question: What kind of interpretation of Wittgenstein's later philosophy emerges if we adhere strictly to his claims that he is not in the business of presenting and defending philosophical theses and that his only aim is to expose persistent conceptual misunderstandings that lead to deep philosophical perplexities? Robert Fogelin draws out the therapeutic aspects of Wittgenstein's later work by closely examining his account of rule-following and how (...) he applies the idea in the philosophy of mathematics.The first of the book's two parts focuses on rule-following, Wittgenstein's "paradox of interpretation," and his naturalistic response to this paradox, all of which are persistent and crucial features of his later philosophy. Fogelin offers a corrective to the frequent misunderstanding that the paradox of interpretation is a paradox about meaning, and he emphasizes the importance of Wittgenstein's often undervalued appeals to natural responses. The second half of the book examines how Wittgenstein applies his reflections on rule-following to the status of mathematical propositions, proofs, and objects, leading to remarkable, demystifying results.Taking Wittgenstein at His Word shows that what Wittgenstein claims to be doing and what he actually does are much closer than is often recognized. Taking on the Tradition focuses on how the work of Jacques Derrida has helped us rethink and rework the themes of tradition, legacy, and inheritance in the Western philosophical tradition. It concentrates not only on such themes in the work of Derrida but also on his own gestures with regard to these themes—that is, on the performativity of Derrida’s texts. The book thus uses Derrida’s understanding of speech act theory to reread his own work. The book consists in a series (...) of close readings of Derrida’s texts to demonstrate that the claims he makes in his work cannot be fully understood without considering the way he makes those claims. The book considers Derrida’s relation to the Greek philosophical tradition and to his immediate predecessors in the French philosophical tradition, as well as his own legacy within the contemporary scene. Part I examines Derrida’s analyses of Plato and Aristotle on the themes of writing and metaphor. Part II looks at themes of donation, inheritance, pedagogy, and influence in relation to Derrida’s readings of the works of Michel Foucault, Jacques Lacan, and Jean-Pierre Vernant. Part III considers the promises and legacies of Derrida’s work on autobiography, friendship, and hospitality, themes Derrida has recently taken up in his readings of Martin Heidegger, Maurice Blanchot, and Emmanuel Levinas. In the Conclusion, the author analyzes what Derrida has recently called a “messianicity without messianism” and shows how Derrida develops two different notions of the future and of legacy: one that always determines a horizon for the donation and reception of any legacy or tradition, and one that leaves open a radically unknown and unknowable future for that legacy and tradition. Winner-takes-all (WTA) typically describes a mechanism for selecting the highest peak of activity in a sensory map that encodes independent representations of potential targets. To Findlay & Walker, WTA is an inherent property of a motor map that is incapable of representing multiple targets independently. Although the output of a WTA system should be characteristic of only one target, actions can be influenced by multiple targets.

We investigate partner effects on spatial perspective taking behavior in listeners, comparing behavior with a human versus a computer partner (Experiments 1 and 2), and with computer partners of different perceived capabilities (Experiment 3). Participants responded to spoken instructions from their partner which could be interpreted egocentrically (from their own perspective) or othercentrically (from their partner's perspective). In contrast to earlier work, we found that participants were more egocentric with a computer than a human partner. Participants were also more egocentric (...) with a computer partner that appeared more modern and capable, compared to one that appeared outdated and limited in ability. Our results show that perspective taking behavior is sensitive to information about one's partner; in particular, listeners consider their partner's potential ability to collaborate, adjusting their egocentric tendencies accordingly. Moreover, we highlight what appears to be a shift in listeners' expectations regarding computers' collaborative capabilities, leading to greater willingness to push the burden of perspective taking onto a computer partner. This is the first book in modern times that makes sense of the Nicomachean Ethics in its entirety as an interesting philosophical argument, rather than as a compilation of relatively independent essays. In Taking Life Seriously Francis Sparshott expounds Aristotle's Nicomachean Ethics as a single continuous argument, a chain of reasoned exposition on the problems of human life. He guides the reader through the whole text passage by passage, showing how every part of it makes sense in the light of (...) what has gone before, as well as indicating problems in Aristotle's argument. No knowledge of Greek is required. When the argument does depend on the precise wording of the Greek text, translations and explanatory notes are provided, and there is a glossary of Greek terms. Sparshott offers insightful and useful criticism, making Taking Life Seriously the best available companion to a first reading of the Ethics. (shrink)

Public funding institutions are able to influence what aspects researchers take into account when they consider the future impacts of their research. On the basis of a description of the evaluation systems that public research funding institutes in the Netherlands (STW and SenterNovem) use to estimate the quality of engineering science, this article shows that researchers are now predominantly required to reflect on the intellectual merit of their research and on the usability and marketability of the technology it contributes to. (...) In addition, SenterNovem also mandates reflection on sustainability. Here it is argued that these requirements do not suffice. Funding institutions should also do more to enhance reflection during the research process on the “soft impacts” of technologies, which refer to the alterations that technologies may bring about in the quality of human life. To do this it is suggested that it is helpful to engage a specifically trained ethicist to monitor the research process and create a feedback loop from the ethicist to the funding institution. _Taking Religious Claims Seriously_ is a systematic, critical, and comprehensive study of the fundamental questions of the philosophy of religion: religious experience, the existence and nature of God, religious knowledge and truth, good and evil, immortality of the soul, religious diversity, religious claims about the person, faith, and the religious way of life. In this study the author seeks to capture the reality and meaning of the religious as such: What is the foundation of religion? Under what conditions is an (...) authentic religious way of life possible? His method of inquiry is phenomenological. The author begins his discussion with a general characterization of the basic features of all the literate and illiterate religions of the world. He then identifies the ideas, beliefs, and concerns which are common to these religions: What are the central claims of these religions? How did the various religions understand these claims? The author makes a serious attempt to clarify these claims and explore the possibility for a reconcilation between them. For him, the foundation of religion is the religious experience, and the essence of this experience consists in a serious, cognitive, and meaningful encounter with the Ultimate Being. This being is the ground of the world and human life. This book is a comparative, pluralistic study of the philosophy of religion. (shrink)

BackgroundNational Ethics Committees (NECs) offer important oversight and guidance functions and facilitate public debate on bioethical issues. In an increasingly globalized world where technological advances, multi-national research collaborations, and pandemics are creating ethical dilemmas that transcend national borders, coordination and the joining of efforts among NECs are key. The purpose of this study is to take stock of the current NEC landscape, their varying roles and missions, and the range of bioethical topics on which they deliberated since their inception.MethodsData on (...) the availability, functions, and ethical deliberations (publications) of NECs globally were gathered through a systematic search of NEC websites and through contacts known to the authors. The search was conducted in English, French, and Spanish. The data abstraction was done in Excel and included the NEC’s country, region, functions, and deliberations on bioethical issues. Deliberation topics were classified into thematic categories through an iterative process of regrouping to arrive at the main set of themes.Results124 NECs in 100 countries were identified. 44% of the NECs are in Europe and 47% are in high-income countries. Out of the 1108 retrieved publications, 40% were on bioethics in the context of research, followed by the clinic (28%) and public health issues (22%). The top five topics of these publications were: research ethics (124; 9%), genetics and genomics (62; 6%), organ transplantation (58; 5%), assisted reproductive technology (49; 4%), and end of life (36; 3%).ConclusionOur study makes an important contribution to understanding the current interests and functions of NECs and the range of their bioethics deliberations. By making the data publicly available through this publication, it allows users to conduct tailored analyses and queries based on their interests, and to seek and strengthen collaboration and exchange. It also makes the case for the fruitfulness of developing and maintaining a global repository of current and new deliberations to more effectively advance this field for the greater good of humanity, research, and public health. The effectiveness of decision rules depends on characteristics of both rules and environments. A theoretical analysis of environments specifies the relative predictive accuracies of the “take-the-best” heuristic (TTB) and other simple strategies for choices between two outcomes based on binary cues. We identify three factors: how cues are weighted; characteristics of choice sets; and error. In the absence of error and for cases involving from three to five binary cues, TTB is effective across many environments. However, hybrids of equal weights (...) (EW) and TTB models are more effective as environments become more compensatory. As error in the environment increases, the predictive ability of all models is systematically degraded. Indeed, using the datasets of Gigerenzer et al. (1999, Simple Heuristics That Make Us Smart, New York: Oxford University Press), TTB and similar models do not predict much better than a naïve model that exploits dominance. Finally, we emphasize that the results reported here are conditional on binary cues. (shrink)

THIS PAPER is not a piece of "research"; it simply offers a series of reflections on the transcendental method. It is occasioned by the realization that, while this method is interesting and important in the opinion of some, it can count on little familiarity in the United States. And where philosophers and students of philosophy make the effort, they have great difficulty appreciating transcendental philosophy or understanding its proposals. This difficulty is, as I say, largely circumstantial and due to a (...) lack of familiarity with the relevant works, but, viewed less superficially, it is motivated by a positive affiliation to another philosophical tradition. In fact, the positions of this other tradition are, if largely in a modern guise, the very ones against which transcendental philosophy reacted. This historical relationship has also systematic relevance. In many ways, pre-transcendental positions seem to have priority: we need only think of formal logic, certain basic stances in empiricist epistemology, common sense. Accordingly, the subjective difficulty of philosophers and students of such persuasions can be treated "objectively," as the difficulty of ever establishing arguments for the transcendental turn or for what Kant calls the "Copernican revolution." Transcendental philosophy must provide arguments, so it seems, on the pre-transcendental level to establish the transcendental position. Further, supposing this problem can be overcome, there is the genuine difficulty of understanding what the transcendental theory actually says and in what way it does its job. And lastly, supposing we find that it lives up to its program, there may still be difficulty with certain implications such that philosophers and students take refuge in non-transcendental positions rather than calling for improvements of transcendental philosophy. In this paper we cannot, of course, fully discuss to what extent the transcendental position can take care of its critics. The paper is mainly concerned with the difficulty of access or introductory argument to transcendental philosophy. (shrink)

Diversity of opinion both presents problems and aff ords opportunities. Diff erences of opinion can stand in the way of reaching an agreement within a group on what decisions to take. But at the same time, the fact that the differences in question could derive from access to different information or from the exercise of diff erent judgemental skills means that they present individuals with the opportunity to improve their own opinions. This paper explores the implications for solutions to the (...) former (aggregation) problem of supposing that individuals exploit these opportunities. In particular, it argues that rational individual revision of opinion implies that aggregation problems are unstable in a certain sense and that solving them by exploiting the information embedded in individual opinion has profound implications for the conditions that we should impose on aggregation procedures. I argue that the effectiveness of forgiveness in the healing of relationships is dependent on both the givers and recipients of forgiveness understanding that once it has been granted, forgiveness is not normally able to be retracted. When we forgive, we make a firm commitment not to return to our former state of moral resentment against the offender, replacing it by good-will. This commitment can be broken only where the forgiving party makes some significant cognitive adjustment to her appraisal of (...) either the offender or the offence, believing that her original forgiveness was granted in error. I reject the view that forgiveness can lapse or be withdrawn on the basis of a return of hurt or disappointed feelings, arguing that these do not amount to a restoration of the resentment that is extinguished when forgiveness is granted. I contend that a person who ‘forgives’ and later takes back that ‘forgiveness’ because certain negative feelings have returned either did not genuinely forgive in the first place or shows that she has not fully grasped the nature of forgiveness. The following article examines Augustine’s efforts in De gestis Pelagii, the bishop of Hippo’s commentary on the acts of the Synod of Diospolis at which Pelagius was acquitted of heresy in December 415 CE. Gest. Pel. is far from an attempt to offer an impartial account of the synod’s events. Rather, it forms a key part of Augustine’s efforts in the aftermath of Diospolis to re-interpret what appeared to be a disaster for the anti-Pelagian cause. In this sense, gest. Pel. (...) is a work with a clear rhetorical purpose. The question at the heart of this article is whether, as two scholars have recently suggested, Augustine’s rhetorical aims in this work led him to consciously misrepresent the facts—about the synod’s decision, Pelagius’s views, and his own history with Pelagius. I will argue that we can plausibly take Augustine at his word in gest. Pel. (shrink)

There are two things about Siewert's project that worry me. First, it's not clear to me that by taking Siewert's first-person approach, we can come to grasp what he means by 'consciousness'. And second, even if we are able to come to grasp what he means by this term, it's not clear to me that all the "consciousness-neglectful theoreticians of mind" - for example, Dennett, Rosenthal, and Tye - have failed to give an account of the property which Siewert's term (...) picks out.
