ʻAlī b. Abī Tālib (d. 40/661), who took over the caliphate duty in a troubled environment after the murder of ʻUthmān b. ʻAffān (d. 35/656), first faced with the demands that the murderers of his murdered predecessor be punished. Although Hazrat ʻAlī himself was of the same opinion, he wanted to ensure public order in the city first. However, the Companions of the Prophet (aṣ-ṣaḥābah) like Zubayr b. al-ʻAwwām (d. 36/656) and Ṭalḥa b. ʿUbaydallāh (d. 36/656), who were not convinced (...) about this issue, started an opposition movement under the leadership of ʻĀ’isha bt. Abī Bakr (d. 58/678), who went to Mecca. The attempts of this movement, which got out of control with the participation of Umayyads and ʻAbdallāh b. Saba’ supporters of different intentions, ended with The Battle of the Camel. Before the war took place, Hazrat ʻĀ’isha heard the barking of dogs when the army led by ʻĀ’isha came to Hawaab on the road to Basra. For this reason, she asked where they were. When she heard that this region was Hawaab, she wanted to go back. Because the Hazrat Prophet had said the following before: "Which of you the Haw's dogs will bark for." The following statement is used in the ḥadīth sources in several different variants, generally without specifying a name: "Thereupon, the people with her wanted her to continue her journey, hoping that the Muslims would recover.” At this point, there is a difference between ḥadīth sources and Islamic historical sources. Islamic historical sources state that the people who wanted her to continue her journey were Ṭalḥa b. ʿUbaydallāh, Zubayr b. al-ʻAwwām and ʻAbdallāh b. al-Zubayr (d. 73/692). The following statements are included in another narration reported from Ibn ʻAbbās (d. 68/688) regarding the issue: The Prophet said to his wives: “I wish I knew! Which of you owns the beautiful hairy camel!” She will set out and then Hawaab dogs will bark at her, many people will be killed, right and left. Then she will survive when she is almost dead. A fifth piece of news mentioned within this framework was narrated by Abū Rāfiʻ (d. 40/660). According to this rumor, the Prophet of Allah said to Hazrat ʻAlī: "Something will happen between you and ʻĀ’isha." Hazrat ʻAlī said: "O Prophet of God! Me?" Allah's Prophet said: "Yes." Hazrat ʻAlī said: "Is it me among my friends?" Allah's Prophet said: "Yes." Hazrat ʻAlī said: "Well, did I trouble them?" The Prophet of Allah said: "No," and then added: "If such a thing happens, take her to a safe place." The sixth narration on the subject is a statement made by Ḥudhayfa b. al-Yamān (d. 36/656). Accordingly, Ḥudhayfa said: "Would you believe me if I told you that one of your mothers will set out with a group of Muslims and will fight you?" Those who were there said: "Will this really happen?" Ḥudhayfa said: "Yes". The last narration mentioned in this context is the news of Abū Bakra (d. 52/671). According to this narration: "Abū Bakra said: Immediately after joining the people of Camel in order to fight with them in the days of Camel, Allah helped me with a word I heard from the Prophet. When the news that the Persians appointed the daughter of Kisrā as the ruler reached the Prophet, the Prophet said: ‘The people who entrust their works to women will not find peace’. " In such a situation, it becomes important to analyze the narrations. Because analyzing the reliability of the narrators and the contents of the narrations will help to understand the subject in a healthy way. Although ḥadīth scholars make some different statements about the reliability of the people who narrated the narrations, the view that gains weight is that they are reliable. Likewise, no problem was detected in the contents of the narrations. Some problems draw attention when Islamic historical sources are considered. For, these historians were not as sensitive as ḥadīth scholars regarding the evaluation of the narrations. At this point, two problems draw attention: The transponder understanding adopted in the early stages of historiography. The effort to protect some valued people. Early historians generally adopted the transponder understanding while writing their works. For this reason, some misinformation that was not analyzed began to be passed down from generation to generation. At this point, the science of history should benefit from the methods of ḥadīth and its sound narrations. In addition, the effort to protect a valuable person like Hazrat ʻĀ’isha has brought the understanding of holding the Companions like Ṭalḥa b. ʿUbaydallāh and Zubayr b. al-ʻAwwām responsible for a behavior that is thought to be wrong. However, it should not be ignored that people can make mistakes. Loving Hazrat ʻĀ’isha does not require defending her wrong decision. In addition, this has brought the accusation of other Companions of behavior unbecoming to them. (shrink)

It is a known fact that interdisciplinary studies were valued in the past as well as today in the scientific world. As a matter of fact, the dimension of the relationship between Islamic law and Sufi sciences makes the books written by combining these disciplines more valuable. Gazali's Ihyâ and Şa'rânî's work named al-Mîzânü'l-Kübrâ are examples of books written in this manner. In Sâ'id b. Ahmed b. In Ebî Bekr el-Razi el-Hanefî's work “el-Cem'u Beyne'l-Fetvâ ve't-Takvâ fî Muhimmâti'd-Dîni ve'd-Dünyâ”, the relationship (...) between law and morality was compiled under the concepts of piety and fatwa. On the other hand, the fact that it was published as early as the sixth century AD further increases the value of the work. The work, of which there is only one copy in the world in the Kastamonu Manuscripts Library with registration number 935, was researched and published by Mehmet Sadi Çögenli, Mustafa Kılıçlı and Îd Fethî Abdullatif. We will criticize this book published by İrşad Publishing House in its original form. In this critique, which we will do with the aim of introducing the book to the scientific world, it would be appropriate to make a few evaluations regarding the investigation made while examining the book. Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

The treatment of employees during downsizing and corporate restructuring raises many ethical issues. To provide a common framework for understanding ethical decisions facing organizations delivering the news of dismissal to affected employees, Integrative Social Contracts Theory and the research on social exchange was used to integrate existing research on employee dismissal. Of particular importance was determining the criteria necessary to manage the dismissal process within ethical boundaries. Three basic criteria, which together represent a variety of contractual and transactional obligations, are (...) proposed as necessary for an ethical approach to dismissal; 1) advance warning of the job loss, 2) open communication, and 3) institutionalized support services. The frequency with which organizations meet these criteria is examined using a geographically dispersed, cross-organizational sample of 770 involuntarily displaced professional employees. In addition, the effect of such an ethical approach to dismissal on individual psychological and financial outcomes is examined. Findings are discussed as they relate to the implicit contract between employee and employer and organizations' responsibility to employees during corporate restructuring. (shrink)

The eruption of Krakatau in 1883 has been studied more as a global event than a moment of change for Indonesia. The eruption has a prominent place in world history and many interdisciplinary studies of both site and event, positioned as a moment that was pivotal to the advancement of volcanology as a field of study and the establishment of infrastructure that enabled colonial knowledge-making. Little is known about the site before the colonial period. Further obscuring historical changes in sociopolitical (...) governance of the archipelago resulting from the eruption is the undue attention paid to religious, particularly Muslim, extremism as a disaster response. This essay, however, argues that the instrumentalization of science, not religion, was central to statist management of the volcano in the twentieth century. The Krakatau eruption posed a management challenge for the state, which attempted to insulate the surrounding populations from risk while sanctioning visits on the site for science and tourism. This essay surveys state-led efforts to corral, conserve, and commercialize the volcano from 1921, when the Dutch colonial state first declared the site as a nature reserve, to 1991, the year the Ujung Kulon Marine National Park that encompassed the Krakatau area was formally established. The modern management of the site and its attendant politics created new vulnerabilities even as the state moved toward domesticating and (imperfectly) anticipating its hazards. (shrink)

The role of digitization and globalization have changed consumers’ online buying behaviors, specifically in the times of the COVID-19 pandemic crisis. This seriously influences the online retail industry in developing countries that are already struggling to move toward digital trading through e-business. Pakistan being a developing country is no exception, and it is, therefore, pertinent to examine factors that contribute to digital trading. Employing theories of reasoned action and the technology acceptance model, this study aims to investigate how personal innovativeness (...) and perceived usefulness impact consumers’ online purchase intentions through a serial mediational model. The data were collected through an online survey from 410 respondents. Structural Equation Modeling was used to test the proposed model. This study showed significant results for the direct effect of personal innovativeness and perceived usefulness on online purchase intentions as well as the indirect serial effect via internet browsing and attitude toward online purchasing. The study results have some important practical implications for selling firms, especially in the times of COVID-19. The study suggests that online retailers should be more responsive to the aforementioned factors to facilitate consumers to spend more time browsing, which influences consumers’ interest and intention to make online purchases. As the social distancing and lockdown approaches were implemented in Pakistan and other parts of the world, the trend toward online purchases has increased. Due to this shift in the overall purchasing behavior of consumers and the potential for strong growth in e-commerce, organizations need to consider the post-COVID situation to expand their business in an online platform for addressing the future pandemic crisis. Given suchmagnitude, the multifaceted poet deserves research attention from variousperspectives. A fascinating aspect of his poetry is that, in spite of his refusal tobe labelled as a Christian, he displays strong faith in God and the afterlife. Hispoetry is steeped in religious connotations that derive heavily from the Bible.There are striking similarities between many concepts preached by Islam andChristianity. It will be (...) interesting to view his poetry from the perspectiveof the former. Islam emphasises its own unique concepts and values to helpits adherents achieve their vision of success. Browning, though acceptingthe central ideas of Christianity, deviates from it conceptually. Given thisbackground, this article attempts to evaluate his notion of faith and its practicefrom Islamic perspectives and discover where the poet’s ideas converge withthose of Islam and where they differ. Witnessing suffering and death in palliative care can cause moral distress, emotional exhaustion and maladaptive coping strategies. How sense and meaning is made from these experiences influences how physicians think, feel and act as professionals (professional identity formation or PIF). It also determines how they cope with their roles, care for patients and interact with other professionals. Timely, personalised and appropriate support is key as shaping how these physicians develop and contend with sometimes competing beliefs and roles. The Ring Theory (...) of Personhood (RToP) and the Krishna-Pisupati Model (KPM) offer a means of mapping PIF and thus moulding, coping and meaning making. This study uses the RToP and KPM to explore how caring for end-of-life patients impacts the personhood of palliative care physicians. Semi-structured interviews with a purposive sample of 13 palliative care physicians—eleven females and two males aged between 35 and 50 years—at a cancer specialist centre were conducted. Transcripts of the audio-recorded interviews underwent content and thematic analysis where complementary themes and categories identified were combined to form domains that highlighted the physicians’ key experience of providing end-of-life care. The domains identified were (1) identity formation, (2) conflicts, (3) KPM elements and (4) support systems. Together, results revealed that palliative care physicians are driven by Innate, Individual, Relational and Societal belief systems that create an intertwined professional and personal identity, enabling them to find meaning in their experiences and adapt to present contexts within cultural norms and professional expectations. However, their failure to recognise their need for support when hampered by evolving personal, existential and clinical factors underlines the exigency for ongoing surveillance and a potential role for a RToP-based tool and portfolio system that can detect and direct timely, appropriate support to in-need physicians. What is the right paradigm for professional ethics? According to Mike Martin, there is a received or dominant one—he calls this the consensus paradigm—in which professional ethics is reducible to duties and dilemmas. It consists of identifying the duties that are or should be standardized within professional codes of ethics applicable to all members of a profession, and grappling with how to apply the duties to particular situations where they conflict or have unclear implications. Martin rejects this as “implausible and (...) constricting”. His counterproposal is that professional ethics be expanded to include personal commitments and ideals. By “ideals” he means “commitments to forms of goodness around which individual character is formed and which are not reduced to general duties,” and by “personal” he “means that they shape the work of individuals without necessarily being incumbent on all members of a profession”. In a set of original essays by renowned scholars from all over the world, the volume extends important critical debates and frames new ones. Offering new views of American classics, it also breaks new ground to show the role of popular genres - such as science fiction and mystery novels - in (...) the creation of the literary tradition. One of the original features of this book is the dialogue between the essays, highlighting cross-currents between authors and their works as well as across historical periods. While offering a narrative of the development of the genre, the History reflects the multiple methodologies that have informed readings of the American novel and will change the way scholars and readers think about American literary history. It is evident, in the face of the COVID-19 pandemic that has physicians confronting death and dying at unprecedented levels along with growing data suggesting that physicians who care for dying patients face complex emotional, psychological and behavioural effects, that there is a need for their better understanding and the implementation of supportive measures. Taking into account data positing that effects of caring for dying patients may impact a physician’s concept of personhood, or “what makes you, ‘you’”, we adopt Radha (...) Krishna’s Ring Theory of Personhood (RToP) to scrutinise the experiences of physicians working in intensive care units (ICU) using a fictional scenario that was inspired by real events. The impact of death and dying, its catalysts, internal constituents, external factors, dyssynchrony, and buffers, specific to ICU physicians, were identified and explored. Such a framework allows for ramifications to be considered holistically and facilitates the curation of strategies for conflict resolution. This evaluation of the RToP acknowledges the experience and wide-ranging effects it has on ICU physicians. As such, our findings provide insight into their specific needs and highlight the importance of support on a personal and organisational level. Although further research needs to be conducted, the RToP could serve as the basis for a longitudinal assessment tool supported by the use of portfolios or mentorship due to their provision of personalised, appropriate, specific, timely, accessible and long-term support. This Focus section introductory essay makes a case for new histories of volcano science. While studies of individual volcanoes are pervasive and well known, the twentieth-century history of volcanology remains largely written by practitioners. The essays in this focus section—written by scholars with specialisms in the history of science, the environment, culture, agriculture, and geography—draw out the wider significance of volcano science in a range of regions including Indonesia, the Philippines, Mexico, and Antarctica. The essays highlight the significance of imperial (...) and colonial contestation in the formation of volcano science and the fraught relationship between Western, Indigenous, and local forms of volcano knowledge. The essays also point to the importance of volcano science to new conceptions of earthly evolution and history. The introduction concludes with reflections on potential new research directions in the historiography of volcano science. (shrink)
