Cet article illustre les différences entre les processus d’expertise en France et aux États-Unis par une comparaison des procédés d’évaluation des risques du perchlorate, un contaminant environnemental détecté dans les eaux de consommation et dans l’alimentation. Ce cas atteste d’une opposition entre deux modèles, l’un fondé sur la confrontation et l’ouverture aux parties prenantes, l’autre fondé sur le consensus et la centralisation de l’expertise. Les différences principales concernent la formalisation de l’interaction entre différentes instances évaluatives et les autres parties prenantes, (...) les processus permettant des évaluations externes de la qualité des évaluations des risques et le rôle du chercheur dans leur élaboration. Après avoir décrit les différences, l’article développe les avantages et les désavantages des deux systèmes d’expertise, et conclut sur la possibilité de développement d’une voie intermédiaire pour l’expertise institutionnelle européenne, alliant centralisme, collégialité et pluralité.This article illustrates the differences between expert assessment procedures in France and the United States by comparing their respective procedures for the risks raised by perchlorate, an environmental contaminant detected in drinking water and food. This example highlights the contrast between the two models, one based on confrontation and stakeholder involvement, the other on consensus and the centralisation of experience. The main differences lie in the way interactions between the various bodies responsible for the assessments and the other stakeholders are formalised, in the procedures governing audits of the risk assessments, and in the role of researchers in the production of these assessments. After describing the differences, the article describes the advantages and drawbacks of the two systems and concludes with a proposal for the development of an intermediate method for EU institutional expert appraisals, combining a centralising approach with pluralist and collegial principles. I will clarify when and how a tension arises between epistemic environmentalism (a new focus on assessing and improving the epistemic environment) and respect for epistemic autonomy (allowing, empowering, and requiring people to each govern their own beliefs). Using the example of participatory conceptual engineering (improving the linguistic environment through rational discussion with broad participation), I will also identify an option for avoiding the tension—namely, participatory environmentalism. This means a new focus on how people can each contribute to improving the (...) shared epistemic environment through rational deliberation and thereby govern their own beliefs that are shaped by that environment. This book offers a new approach to the analysis of the multiple meanings of English modals, conjunctions, conditionals, and perception verbs. Although such ambiguities cannot easily be accounted for by feature-analyses of word meaning, Eve Sweetser's argument shows that they can be analyzed both readily and systematically. Meaning relationships in general cannot be understood independently of human cognitive structure, including the metaphorical and cultural aspects of that structure. Sweetser shows that both lexical polysemy and pragmatic ambiguity are shaped by our (...) metaphorical folk understanding of epistemic processes and of speech interaction. Similar regularities can be shown to structure the contrast among root, epistemic and speech act uses of modal verbs, multiple uses of conjunctions and conditionals, and certain processes of historical change observed in Indo-European languages. Since polysemy is typically the intermediate step in semantic change, the same regularities observable in polysemy can be extended to an analysis of semantic change. (shrink)

"These essays advance a reinterpretation of pivotal categories such as self-knowing, moral agency, and altruism.

This article analyzes the institutionalization of the global organic agriculture field and sheds new light on the conventionalization debate. The institutions that shape the field form a tripartite standards regime of governance that links standard-setting, certification, and accreditation activities, in a layering of markets for services that are additional to the market for certified organic products. At each of the three poles of the TSR, i.e., for standard-setting, certification, and accreditation, we describe how the corresponding markets were constructed over time (...) and the role of the different actors in their evolution. We analyze the politics at stake among the actors at each pole, their competing or cooperative interests and visions, and the tensions between them in the promotion of markets. Through the lens of the TSR heuristic, we show that the institutionalization of the organic field beginning in the 1990s and its de facto inclusion in the broader sustainability field beginning in the 2000s contribute to a progressive distancing between the organic movement and its initial political project of alterity, to which public and private actors both contribute actively. As a set of interlinked market institutions, the TSR orients and narrows the scope of debate, which becomes restricted to “market-compatible” dimensions and objects. We conclude that the TSR is a promising heuristic for analyzing contemporary global regulation. (shrink)

In "The Nature of Evil"2 I offer an analysis of evil action, in a sense distinct from merely very wrong action, in which I claim that the evil act is one in which the agent silences overwhelming considerations against performing the act. Christopher Hamilton 's interesting commentary raises five objections against my account of evil in terms of silenced reasons I shall argue that all five objections can be met.

This essay focuses on conceptual engineers who aim to improve other people's patterns of inference and attention by shaping their concepts. Such conceptual engineers sometimes engage in a form of epistemic paternalism that I call paternalistic cognitive engineering: instead of explicitly persuading, informing and educating others, the engineers non-consultatively rely on assumptions about the target agents’ cognitive systems to improve their belief forming. The target agents could reasonably regard such benevolent exercises of control as violating their sovereignty over their own (...) belief formation. This is a pro tanto reason against such engineering. In addition to the relevant projects of conceptual engineering, paternalistic cognitive engineering plausibly includes certain kinds of nudging and evidence suppression. I distinguish the sovereignty-based concern from other ethical worries about conceptual engineering and discuss how one might justify the relevant conceptual engineering projects despite the sovereignty-based reason against them. This article shows that forms of analysis and calculation specific to finance are spreading, and changing valuation processes in various social settings. This perspective is used to contribute to the study of the recent transformations of capitalism, as financialisation is usually seen as marking the past three decades. After defining what is meant by “financialised valuation,” different examples are discussed. Recent developments concerning the valuation of assets in accounting standards and credit risk in banking regulations are used to suggest that (...) colonisation of financial activities by financialised valuations is taking place. Other changes, concerning the valuation of social or cultural activities and environmental issues are also highlighted in order to support the hypothesis of a parallel colonisation of non-financial activities by financialised valuations. Specifically, the language of finance appears to gradually being incorporated into public policies, especially in Europe—and this trend seems to have gathered pace since the 2000s. Some interpretations are proposed to understand why public policies are seemingly increasingly reliant on financialised valuations. (shrink)

The study of the notion of ideology shows that this corpus lends itself to a wide variety of different definitions. A certain opposition runs all the way through this set of definitions. Ideology would appear to be torn between a conception that emphasises its distortion and dissimulation dimensions and another conception which views as a set of social representations. After rapidly presenting the main characteristics of these two polar extremes, Paul Ricoeur's suggestion that these two conceptions can be united is (...) discussed and illustrated by the concept of the `spirit of capitalism', as defined in the book by Boltanski and Chiapello (1999). It is shown that this constitutes an ideology which is in fact an attempt to encompass both these conceptions. It is also shown that the concept of `trial' as proposed in that book helps greatly to understand how this reconciliation is actually possible. (shrink)

Debates regarding clinical ethicists’ scope of practice are not novel and will continue to evolve. Rapid changes in healthcare delivery, outcomes, and expectations have necessitated flexibility in clinical ethicists’ roles whereby hospital-based clinical ethicists are expected to be woven into the institutional fabric in a way that did not exist in more traditional relationships. In this article we discuss three emerging roles: the ethicist embedded in the interdisciplinary team, the ethicist with an expanded educational mandate, and the ethicist as a (...) therapeutic presence in the patient care space. Such expanded capacities offer more robust, positive contributions to institutional culture, stakeholders’ relationships, and patient-centered care. (shrink)

The jury remains out about the bottom-line relevance of organisational spirituality. This article reviews the arguments made thus far, using those sources most commonly cited as providing ‹evidence’ that organisational spirituality adds value to the bottom line. Having collated the evidence, this article offers some observation about the robustness of this existing ‹business case’. It then offers some preliminary conclusions on the literature review, examining the merits of pursuing a ‹business case’ in this field and identifying some specific questions for (...) future research. This paper considers whether we have any reason to forgive the perpetrators of the most terrible atrocities, such as the Holocaust. On the face of it, we do not have reason to forgive in such cases. But on examination, the principal arguments against forgiveness do not turn out to be persuasive. Two considerations in favour of forgiveness are canvassed: the presence of rational agency in the perpetrators, and the common human nature which they share with us. It is argued that (...) the presence of rational agency does not generate a reason to forgive. However, our common human nature may be sufficient to provide such a reason, and evidence for its general reason-giving power can be seen in phenomena such as vicarious shame, and the moral significance which we attach to the notion of crimes against humanity. A reason for forgiveness based on common human nature will not be a strong one, but a weak reason still has some force. (shrink)

' These are perhaps Kant's most well-known and oft-repeated words. They reflect not only the profound feeling (...) that underlies his technical and abstruse treatises, but also his characteristic preoccupation with law. The "starry heavens" are a synecdoche both for the wonder of nature as we perceive it in all its multiplicity, and for the marvel of science's ability to reduce, order, and subdue that infinite multiplicity into a few elegant laws. These two types of law, natural and moral, define the focus of Kant's critical philosophy, and metaphors drawn from jurisprudence pervade all three critiques. In the context of controversial statements on the role of metaphor in philosophical texts by Jacques Derrida, Paul Ricoeur, and Richard Rorty, I will analyze the legal metaphors in the prefaces and Transcendental Deductions of the Critique ofPure Reason. My goal in engaging Kant's texts in this controversy over metaphor is twofold: on the one hand to assess experimentally the value of these positions on metaphor in the history of philosophy, and, on the other hand, to examine the relations between critical conceptualization and insurgent metaphoricity in Kant's carefully elaborated and systematized text. In a textwhose key words are "universal and necessary for all possible experience," contingentand ambiguous metaphors might be expected to cause problematic unravelings. Richard Rorty has argued recently that "the history ofscience, culture and politics" should be viewed "as a history of metaphor rather than of discovery." 2 He compares the creations of new vocabularies to the 245 246Philosophy and Literature invention of "new tools" ("CL," p. 5), alluding to "Nietzsche's definition of truth as a mobile army of metaphors" (p. 6). From Plato's figures of the world as cave and the mind as charioteer with unruly horses, we shift to Locke's view of mind as tahda rasa and Descartes's description of the world as a machine. Rorty's paradigm of cultural history as a history of metaphor enters into an earlier, unresolved debate between Jacques Derrida and Paul Ricoeur over the relationship between metaphor and philosophical discourse. Like Derrida, Rorty follows Nietzsche's claims about metaphor in the history of philosophy, a view Ricoeur wants to disprove so that he can recover the privileged univocity of speculative discourse. However Rorty has nothing in common with die complexity and "invaginated" ambiguities, the dazzling multivocity of Derrida's writing on the economics of metaphor. Although Rorty appears at first to agree with Derrida that there is no truth or reality apart from the linguistic tropes which dominate different epochs and cultures, he retains a metaphysical distinction between literal reference and figurative play. Rorty adopts Donald Davidson's theory that metaphors do not have "meaning" precisely because diey have no place in the language game into which they are inserted. They produce an effect, but it is not meaning: "One can only savour it or spit it out"; it is not a " 'truth-value candidate' " ("CL," p. 6). However, through repeated use, the metaphor will find a role in the language game; dying as a metaphor, it will live as a literal statement. Therefore Rorty agrees with Ricoeur that a moribund metaphor is no longer a metaphor, but a literally functioning segment of discourse. Thus despite his initial move toward a Derridean, or atleast Nietzschean, position, Rorty ultimately takes a stand consonant with Ricoeur's desire to rescue speculative discourse from the unruliness of metaphor. Considering Rorty's celebration of Freud in an article on "The Contingency of Selfhood," 3 his failure to consider the role of unconscious associations and overdetermination in the writing and reading of texts is surprising. Dead or alive, a metaphor brings with it a host ofpersonal and public, conscious and unconscious, new and traditional associations that become juxtaposed against a similar number of associations connected with the signifying chain into which the metaphor has been inserted. In this paper, the principal objections to unconditional forgiveness are canvassed, primarily that it fails to take wrongdoing seriously enough, and that it displays a lack of self-respect. It is argued that these objections stem from a mistaken understanding of what forgiveness actually involves, including the erroneous view that forgiveness involves some degree of condoning of the offence, and is incompatible with blaming the offender or punishing him. Two positive reasons for endorsing unconditional forgiveness are considered: respect for persons and (...) human solidarity; and it is argued that the latter provides more plausible grounds for it than the former. Bei seinem Versuch, die Äquivalenz teleologischer und nichtteleologischer Erklärungen nachzuweisen und den Bedeutungsüberschuß teleologischer Sprache hinwegzuformulieren, ist er immer schon an die Voraussetzung dieses Bedeutungsüberschusses gebunden, dessen er sich nicht, wie seine Beschreibung zielgerichteter Systeme beweist, entledigen kann. Unser Ergebnis dispensiert jedoch nicht von der Frage, ob der Anspruch 'der in teleologischen Wendungen geltend gemacht wird, auch zu Recht besteht. This article focuses on the theological journeying of women ordinands in the Church of England, who have had to negotiate their belonging in the ‘pathway’ to Priesthood in ordination training. Attention is given to the extent to which the personhood of women is enabled to truly flourish in a theological education system that is dominated by men and predominantly patriarchal and Western theologising. It suggests that a gendered politics of belonging has been used and maintained through the socio-religious construct of (...) ‘shame’ in order to maintain the boundaries of belonging within the formation process, and therefore calls for an en-gendered ‘pathway to the priesthood’. This is exemplified in a re-reading of the bleeding woman who dares to challenge the hegemonies of patriarchy and purity by touching the cloak of Christ in Luke 8:40-48. This research is part of an ongoing project with Common Awards at Durham University that explores barriers to belonging in theological education for those in training for ordination. It has therefore received ethical approval for interviews and participant observations. (shrink)

I will argue that those thinking about conceptual engineering should think more about ways of believing. When we talk about what someone “believes”, we could be talking about how they are inclined to act, or what they have put forth as their position on a matter, or what gives rise to a feeling of endorsement when they reflect on the matter. If we further recognize that the contents of our beliefs are at least sometimes framed in certain concepts and that (...) projects of conceptual engineering at least sometimes aim to change our beliefs by changing the concepts they are framed in, the question arises: which beliefs does conceptual engineering target? Is it always “belief” in the same sense? I will argue that it is not, using examples from feminist and mainstream metaphysics. Suppose that revisionary ontologists call on us to eliminate the non-joint-carving concept TABLE from our beliefs about the world. They then plausibly have in mind only “belief” in the sense of practically detached reflective assent: they want the concept eliminated from the content of such assent. On the other hand, when feminist metaphysicians of gender call on us to ameliorate the ethically problematic concept WOMAN, they target our “beliefs” in a sense that encompasses both the content of our everyday observations and experiences and what might be called practically engaged reflective assent; but they do not target the practically detached assent. In the past forty years, Bruno Latour’s claim that Science Is Politics By Other Means (SIPBOM) has been the underlying creed of Science and Technology Studies (STS), most of us simply taking it for granted. In contrast, this special issue is predicated on the observation of an enduring lack of exegesis of this catchphrase so remarkable that is has caused an outcry among natural scientists, echoed in some social science quarters. Abstract“Science Is Politics By Other Means” (SIPBOM) was coined in The Pasteurization of France, Latour’s 1984 empirical study of the birth of microbiology. Yet, it encapsulates an outstanding political theory of science that Latour has never formalized and that has remained unnoticed to this day. The theory is comprised of two dimensions. The first one is the ontological labor performed by science, that is, the laboratory production of new nonhumans. The second one is the ability of science to devise and (...) implement novel policies targeted at the new beings it produces. These “other means” are incorporated in political projects and contribute to the shaping of society. Fifteen years later, Latour published Politics of Nature ([1999] 2004), a full-blown political treatise equally devoted to the political character of science. It would be mistaken, however, to assume that it falls in the same SIPBOM paradigm as the Pasteur study. The compositionist theory it offers redefines politics as the institution of the nonhumans that make up external reality, a task that has traditionally been monopolized by Science. In this sense, “science is politics by other means” has become “politics is science by other means,” these “other means” now referring to “cosmopolitics,” that is, the due process advocated by compositionism. The first claim of the present paper is that the respective weight ascribed to politics and ontology is different in The Pasteurization of France and in Politics of Nature. The second claim is that compositionism is not as successful as Latour’s early theory to account for the politicity of science. (shrink)

Cloth, $75.00.This collection of essays spans 27 years of John Cooper's career as an interpreter of ancient philosophy. Its earliest essay, "The Magna Moralia and Aristotle's Moral Philosophy," already shows Cooper's distinctive approach; (...) he seeks to discover "a simpler and more natural way" (200) to understand the discrepancies between this small treatise and Aristotle's major ethical works than by the comparatively convoluted theory of Dirlmeier. In seeking this simpler and more natural interpretive route, Cooper attends to "the philosophical content of the work" (202), rather than considerations of style and linguistic usage. He concludes with frank discussion of the problems which his interpretation cannot solve; these are dismissed with characteristic exasperation-italics: "... one must not expect to explain everything..." (210). He confines his rougher polemical points to footnotes (Dirlmeier "doesn't even face the question squarely" in note 19, hence he is "wildly off" in note 28). [End Page 430]These characteristics run through all the essays here collected. Only two of the 23 essays are previously unpublished: a reconsideration of Xenophon as a source on Socrates, and a treatment of pleasure and desire in Epicurus. Other essays take up moral problems examined by Socrates, Plato, Aristotle, and several Hellenistic philosophers or schools. A theme running through most if not all the discussions is the desire (shared by the ancient philosophers and by Cooper equally, it would seem) to develop and defend a viable eudaimonism. The relation between human goodness and human happiness must be shown to be one of extremely close affinity, such that the virtuous are also the happy, even in adversity. Thus though no attempt is made to connect the essays into a coherent argument leading to a global thesis about ancient moral philosophy, the book nevertheless contains the ingredients for such an argument and thesis. The book presenting such an argument and thesis could in some ways be both more elegant and more helpful than this collection; it could spend fewer of its pages in arguing against other interpreters over minor differences (the standard journal-article format for our time), more of its pages awakening the texts, eliciting their message, and presenting it in a form useful for guiding life. Perhaps Cooper will write such a book soon.But the present volume will certainly be of interest to scholars and students, who will find in it much to enjoy and ponder. Generally what is striking about Cooper's interpretations is their freshness. He is at his best when dislodging some stale orthodoxy. The essay on Xenophon's Socrates is a case in point. The portrait of Socrates which emerges in Xenophon's Memorabilia is usually taken to be far less accurate than that presented in Plato's earlier dialogues. The Memorabilia seldom appear on the required reading lists of Greek philosophy courses, nor does Xenophon's version of Socrates' approach to moral questions receive even a fraction of the scholarly attention devoted to Plato's early work. Cooper convincingly shows this neglect to rest on a prejudice. The Socrates of Xenophon's portrait addresses a different kind of audience than that of Plato; the difference in the style of questioning and in the topics discussed reflects the historical Socrates' sensitivity to his partners in conversation. He addresses them where they live (so to speak), and this makes him "all the more remarkable a person" (14).Two other strengths run throughout the essays here collected. No matter how intense the exegetical quibble may have become on any given page, Cooper is able to make a sudden soaring flight upward and provide a synoptic view of the broader philosophical terrain, both for any given philosopher and for that philosopher's contemporaries, predecessors, and successors. These flights are sometimes dizzying and often unpredictable, but always refreshing.In addition, Cooper is able to make connections with large issues in contemporary moral philosophy, relating the ancient controversies to their modern versions (John Rawls, Bernard Williams, Leo Strauss... J’arrive ainsi à lire une seule thèse à travers les diverses formulations. Je dois admettre, par ailleurs, que (...) les variations sont suffisamment importantes pour semer la confusion. Dans la deuxième section, je retrace les arguments offerts par Quine en guise de justification de l’indétermination de la traduction. Je rappelle l’évolution de cette argumentation et je montre qu’il y a des variations là aussi : au début, Quine fait surtout appel à son physicalisme et, à la fin, il invoque seulement son behaviorisme. Même si je conclus qu’il ne s’agit pas là d’un changement radical, force est d’admettre que le changement est suffisamment important pour déconcerter plus d’un lecteur. Finalement, dans la troisième section, je montre comment mon interprétation de la thèse de l’indétermination de Quine, si elle est correcte, contribue au débat sur l’asymétrie avec la sous-détermination. Les deux premières sections de l’article permettant de distinguer clairement les arguments épistémologiques du contenu ontologique de la thèse de l’indétermination de la traduction, il devient facile d’admettre l’asymétrie défendue par Quine : l’indétermination de la traduction est une thèse ontologique ; elle ne peut donc pas être confondue avec la sous-détermination, une thèse épistémologique.In the first section of this article, my aim is to grasp the content of Quine’s indeterminacy of translation thesis. I propose a review of Quine’s formulations, and I try to identify what is constant and what varies in them. Guided by charity, I keep what is constant as the core of Quine’s thesis, and I consider what varies as secondary. I thus achieve to read a single thesis throughout all the formulations. I must admit, however, that the variations are important enough to be confusing. In the second section, I identify Quine’s arguments for indeterminacy of translation. I retrace the evolution of his argumentation, and I notice that there are variations there too. At first, Quine appeals mainly to physicalism, and, at the end, he appeals only to behaviorism. Although I think that this is not a radical change of mind, I conclude that the change is, once again, important enough to have confused some readers. Finally, in the third section, I show how my interpretation of Quine’s indeterminacy of translation contributes to the debate over the asymmetry between this latter thesis and underdetermination of theory : my analysis of Quine’s treatment of indeterminacy of translation leads me to conclude that, whereas the arguments are epistemological, the content of the thesis is ontological. Once this ontological content is well seen, it is easy to acknowledge, with Quine, the asymmetry with underdetermination, which is an epistemological claim. (shrink)
