The major stakeholder classes in education have three distinct ways by which they judge the quality of knowledge claims. At times this can cause considerable distraction or mis-communication among stakeholders.

In this book Kristi A. Olson addresses the question of fair labor income distribution by proposing the solidarity solution, a new test she defines and defends. She takes as her starting point the envy test, discussed by the philosophers Ronald Dworkin and Philippe Van Parijs and by the economists Jan Tinbergen, Hal Varian, Marc Fleurbaey, Duncan Foley, and Serge-Christophe Kolm. According to the envy test, a distribution is fair when no one prefers someone else's circumstances to their own. (...) After rejecting the envy test, Olson distinguishes two types of envy: personal and impersonal. Impersonal envy makes a demand on others; personal envy, in contrast, does not. Using this distinction, Olson argues that fair labor-income bundles must be impersonal envy-free, but need not be personal envy-free. Stakeholder theory is often unable to distinguish those individuals and groups that are stakeholders from those that are not. This problem of stakeholder identity has recently been addressed by linking stakeholder theory to a Rawlsian principle of fairness. To illustrate, the question of stakeholder status for the non-human environment is discussed. This essay criticizes a past attempt to ascribe stakeholder status to the non-human environment, which utilized a broad definition of the term "stakeholder." This paper then demonstrates how, despite the (...) denial of stakeholder status, the environment is nonetheless accounted for on a fairness-based approach through legitimate organizational stakeholders. In addition, since stakeholder theory has never claimed to be a comprehensive ethical scheme, it is argued that sound reasons might exist for managers to consider their organization's impact on the environment that are not stakeholder-related. Using a fair allocation approach, this paper identifies and examines important concerns arising from the Philippines’ COVID‐19 response while focusing on difficulties encountered by various sectors in gaining fair access to needed societal resources. The effectiveness of different response measures is anchored on addressing inequities that have permeated Philippine society for a long time. Since most measures that are in place as part of the COVID‐19 response are meant to be temporary, these are unable to resolve the inequities (...) that have led to the magnitude of morbidity and mortality associated with the pandemic. These cannot improve the country’s readiness to deal with pandemics and other emergencies in the future.Transition to a new normal recognizes the possibility that other infectious diseases could come and endanger our health security. Our pandemic experiences are proving that having an egalitarian society will serve the interests not only of disadvantaged sectors but also of everybody else, including the privileged. Response measures should thus take the opportunity to promote equity by giving importance to the concerns of the underprivileged and vulnerable while giving preference to initiatives that can be sustained beyond the period of the current pandemic. We explore the marketing, networks and communications channels of the brand which have led to rapid growth from niche player to a mainstream brand. It is widely supposed that the Everettian account of quantum mechanics has difficulties with probability. In this paper I shall argue that those who argue against the Everettian interpretation on this basis are employing a double standard. It is certainly true that there are philosophical puzzles about probability within the Everettian theory. But I shall show that orthodox metaphysics has even worse problems with probability than Everettianism. From this perspective, orthodox metaphysicians who criticise Everettians about probability are a classic case (...) of a pot calling the kettle black. (shrink)

For a significant number of patients, there exists no, or only little, interest in developing a treatment for their disease or condition. Especially with regard to rare diseases, the lack of commercial interest in drug development is a burning issue. Several interventions have been made in the regulatory field in order to address the commercial disinterest in these conditions. However, existing regulations mainly focus on the provision of incentives to the sponsors of clinical trials of orphan drugs, and leave unanswered (...) the overarching question about the rightful place of orphan drugs in resource allocation systems. In this article, we analyse the ethical aspects of funding research and development in the field of rare diseases. We then propose an ethical framework that can help health policy makers move forward in the difficult matter of fairly allocating resources for the prevention, diagnosis and treatment of rare diseases. In this article we report the findings of a randomised control clinical trial that assessed the impact of a Philosophy for Children program and replicated a previous study conducted in Scotland by Topping and Trickey. A Cognitive Abilities Test was administered as a pretest and a posttest to randomly selected experimental groups and control groups. The students in the experimental group engaged in philosophy lessons in a setting of structured, collaborative inquiry in their language arts classes for one hour per (...) week for a number of weeks. The control group received the standard language arts curriculum in that one hour. The study found that the seventh grade students who had experienced the P4C program showed significant gains relative to those in the seventh grade control group at a high level of statistical significance, but the eighth grade students in the experimental group did not show such gains over the eighth grade control group. It was discovered that the seventh grade teachers started the program early in the school year and continued it for a period of 22 to 26 weeks, while the eighth grade teachers started much later and used the program for only 4 to 10 weeks. Our findings suggest that the P4C program must involve students in activities for a significant period of time before the program shows results, but that a meaningful impact on students’ cognitive abilities can be achieved in about 24 weeks of lessons, less than half the time evidenced by the study by Topping and Trickey. The paper examines the epistemological side of the Laclau’s political theory, incorporating tools that aim to convert discourse theory into a rigorous, useful, and valid method for socio-political and critical analysis in social sciences. In the first part, it displays some epistemological assumptions and arguments. The second part analyses some problematic epistemological aspects derived from the arguments. The proposal is based on Laclau’s main texts, complementing the analysis with related tools from critical hermeneutics and existential phenomenology. It is argued that (...) the incorporation of these tools to political discourse analysis contribute to solve some of the methodological and epistemic deficits of the theory of hegemony. El trabajo examina el plano epistemológico de la teoría política de Ernesto Laclau, aportando herramientas que tienen por objeto convertir a la teoría del discurso en un método riguroso, útil y válido para el análisis sociopolítico y crítico en ciencias sociales. En la primera parte, despliega una serie de postulados y presupuestos epistémicos. En la segunda parte, analiza algunos aspectos gnoseológicos problemáticos que se derivan de los postulados. Para desarrollar la propuesta, se toman como base los principales textos de Laclau, complementando el análisis con herramientas afines provenientes de la hermenéutica crítica y la fenomenología existencialista. Se sostiene que la incorporación de estas herramientas al análisis político del discurso contribuye a resolver algunos de los déficits metodológicos y epistémicos que presenta la teoría de la hegemonía. Allocating scarce organs to transplant candidates is only one stage in the long process of organ transplantation. Before being listed, all candidates must undergo a rigorous assessment by a multidisciplinary transplant team. The Department of Health and NHS Blood and Transplant (NHSBT) are responsible for the development of detailed strategies to ensure a fair and objective assessment experience for all transplant candidates. Difficulties arise when particularly vulnerable candidates, such as candidates with psychiatric illnesses, are assessed. NHSBT has already developed (...) unique assessment guidelines for alcoholic and substance-abusing liver transplant candidates to allow for a more comprehensive evaluation, but candidates with psychiatric illnesses are still assessed against general criteria. Should these candidates be assessed against their own criteria? On what clinical grounds do transplant teams justify excluding such candidates from transplantation? Is redress available for candidates who feel they have been unfairly refused a liver transplant simply because of their psychiatric illness? This essay will critically examine the provisions published by the Department of Health and NHSBT for the assessment of liver transplant candidates with psychiatric illnesses, and will provide a commentary as to whether enough is being done to protect these particularly vulnerable candidates from inconsistent assessment decisions. In this paper, we offer a defense of non-punitive measures as morally justified responses to crime within a framework of society as a fair system of cooperation among free and equal individuals. Our argument proceeds in three steps. First, we elaborate on the premises of our argument: we situate criminal acts within a model of society as a fair system of cooperation, identify the types of unfair disadvantages crimes bring about, and consider the social aim of the criminal (...) justice system. Next, we reject the claim defended by fair-play retributivists that fairness considerations make punishment a necessary response to criminal acts. In the last step, we demonstrate that it is rather non-punitive responses to crime that are warranted under the principle of fairness and, as such, are morally justified. We conclude the paper by rejecting two possible objections to our defense: the “responsibility gap” and the “victims’ claim to justice” objections. (shrink)

ABSTRACTIn light of the large recent inflow of refugees to the EU and the Commission’s efforts to relocate them, I raise the question of what a fair distribution of refugees between EU countries would look like. More specifically, I consider what concerns such a distributive scheme should be sensitive to. First, I put forward some arguments for why states are obligated to admit refugees and outline how I believe the EU should respond to the refugee crisis. This involves, among (...) other things, resettling a proportion of refugees from countries neighbouring Syria in the EU. Second, I consider how the intake into the EU should be distributed between member states, that is, the shares different countries can be expected to admit. I discuss the relevance of a number of different factors that may be claimed to affect such shares, including population size, GDP, number of refugees admitted so far, unemployment rate, country-specific costs and cultural ‘closeness’. Third, I consider whether the distributive scheme should be restricted to reflect specific states’ responsibility for creating refugees in the first place, levels of racism and xenophobia, and whether other states are required to pick up the slack if some refuse to admit their fair share. Causation has traditionally been analyzed either as a relation of nomic dependence or as a relation of counterfactual dependence. I argue for a third program, a physicalistic reduction of the causal relation to one of energy-momentum transference in the technical sense of physics. This physicalistic analysis is argued to have the virtues of easily handling the standard counterexamples to the nomic and counterfactual analyses, offering a plausible epistemology for our knowledge of causes, and elucidating the nature of the relation between (...) causation and physical science. However, there is still a paucity of research analysing the northern fair trade actors outside the Anglo-American communities. This paper contributes by presenting a qualitative study of how the Finnish World Shop movements’ key actors understand the movement’s role and position in the rapidly changing operating environment. The study depicts the polyphonic nature of this particular democratic social movement and discusses how success, public trust (...) and the importance of different stakeholders become constructed in various ways within it. His essay "Religion and Science in the Global Age—Their Essential Character and Mutual Relationship" (Abe 1985: 241–248) challenged me to expand my thinking to consider not only how theistic religions such as Christianity relate to science, but also to consider how nontheistic religions, such as Buddhism, might fare when interacting with modern science.In his essay on religion and science Abe expressed his agreement with the thought of Keiji Nishitani in this way:1. It is necessary for each religion to re-examine the basis of its world view. For any religion its world view is not like clothes that one can change whenever one pleases. A world view is to religion what water is to a fish. It is the indispensable condition through which religion can actually come into existence. Water is neither the life of the fish as such, nor its body, yet it is fundamentally linked to both. For a religion to change its world view is a matter no less fatal to it than for a fish to change from salt water to fresh.2. What is even more crucial and important is that each religion re-examine and reinterpret that tradition's understanding of God or the 'ultimate' and His or its relation to human beings and the world. With regard to this second point, Buddhism which is fundamentally non-theistic, is in a somewhat different situation from Christianity, which is basically theistic. Brian Ribeiro argues that the pragmatic theory of truth massively misrepresents the actual use of the terms “true” and “truth.” Truths, he observes, can be distinguished from “illusions.” The latter misrepresent reality and the former do not. Psychologists, as they report on the way mentally healthy people commonly overestimate themselves, draw just this distinction. They tell us of many beliefs that are “adaptive” but illusory. Pragmatists cannot draw this distinction because their theory explains truth as adaptiveness. Therefore no sensible person (...) will be a pragmatist. In fact, however, Ribeiro paints a flawed picture of what both psychologists and pragmatists do. Psychologists provide us not with “reality-based accurate beliefs” but instead with beliefs that work, and pragmatists do not identify all beliefs that are adaptive or useful for individuals as true. Pragmatism turns out to be quite sensible, though often misunderstood. (shrink)

Distribution of responsibility is one of the main focus areas in discussions about climate change ethics. Most of these discussions deal with the distribution of responsibility for climate change mitigation at the international level. The aim of this paper is to investigate if and how these principles can be used to inform the search for a fair distribution of responsibility for climate change adaptation on the local level. We found that the most influential distribution principles on the international level (...) were in turn built on one or more of seven basic principles: (P1) equal shares, (P2) desert, (P3) beneficiary pays, (P4) ability, (P5) self-help, (P6) limited responsibility for the worst off, and (P7) status quo preservation. It was found that all the basic principles, but P1, P3, and P7, are to some extent translatable to local climate adaptation. Two major problems hamper their usefulness on the local level: (1) several categories of agents need to take on responsibility; and (2) emissions do not work as a base for all principles. P4, P5, and P6 are applicable to local adaptation without changes. P4 is of particular importance as it seems to solve the first problem. P2 is applicable only if the second problem is solved, which can be achieved by using risk of harm instead of emissions as the basis for desert. (shrink)

This article reviews Hamid Dabashi’s “Can Non-Europeans Think?”. It attempts to show that while Dabashi offers a powerful analysis of Iranian and Middle Eastern politics, his arguments turn to be unpersuasive when he aims to radically criticize European philosophy and enlightenment thought.

This article is a preliminary attempt to map EU research policy from a feminist perspective hitherto absent. The framing and management of national and international research policy have reflected the priorities of an entrenched masculinist scientific elite. Despite the critical role of quantified data in policy analysis and formation, international research labour force statistics remain ungendered. Feminist approaches have been integral to the third wave of epistemological criticism of science this century, claiming that systematic knowledge of the natural, as well (...) as the social world, is socially shaped and thus could be reshaped in ways friendlier to the diversity of women. Such criticism has generated opposition on the part of the scientific elite. The state funding of research is shrinking, while industrial research expands. Women's place within this restructuring research labour market may even be deteriorating, yet feminism still addresses its demands to a retreating science/state relation. Sustained pressure from women's studies researchers and women natural scientists and engineers for a fairer share of the research pie has, in the light of the Amsterdam Treaty, led to Europe introducing gender into research policy. The policy dimension of 'Quality of Life' to enhance 'trust', offers possibilities for feminist intervention. Changing the gender and ethnic composition of the research labour force so that it more adequately reflects the diversity of Europeans enhances Quality of Life. Trust requires that we build on the diverse experiences of European countries in strengthening democratic participation in socially shaping science and technology. (shrink)

Should public health authorities have access to your personal medical information without your permission? The usual justifications for requiring informed consent do not necessarily apply. That is not to say that consent may be avoided in all situations, just that the reasons for requiring consent in public health are different than for traditional medical treatment.

Three recent research reports by Topping and Trickey, by Fair and colleagues, and by Gorard, Siddiqui and Huat See have produced data that support the conclusion that a Philosophy for Children program of one-hour-per-week structured discussions has a marked positive impact on students. This article presents data from a follow up study done three years after the completion of the study reported in Fair et al.. The data show that the positive gains in scores on the Cognitive Abilities (...) Test were still present and had not faded after three years. Given the strength of these confirmations of the positive durable impact of the P4C program of structured discussions and given the relatively low cost of implementing the P4C program, it is recommended that it become a standard part of the school curriculum. Biobanks are essential tools for furthering a broad range of medical research areas. However, despite the plethora of national and international laws and guidelines which apply to them, the access and sharing policies of biobanks are only sparsely addressed by regulatory bodies. The ‘give and take’ process of biosample sharing is largely left up to biobank stakeholders themselves to oversee; it is therefore both in stakeholders' power, and in their interest, to ensure that sample accessibility is fair. This is (...) an important step in motivating researchers to collaborate and pool samples, and is crucial to fostering trust in the absence of universally accepted standard practices. To date, little attention has been paid to how fairness considerations affect scientific material sharing, and no empirical research has been carried out to determine the role that fairness plays in collaborative studies. In order to begin to gain understanding in this area, we interviewed 36 biobank stakeholders currently working in Switzerland, focusing on their perceptions of current and optimal fair sharing practices. Our findings reveal that fairness is an important feature of exchange situations for these stakeholders, and that they have well-formed notions about the practical elements of fair sample access, although ideas about the concept of fairness itself are vague. In order to support efforts to network biobanks, attention should be paid to this issue to reassure all involved that they are getting a fair share in their cooperative efforts. (shrink)

ABSTRACT After initially pitting partisans against purists, the literature on the ethics of fandom has coalesced around a pluralist position: purists and partisans each have their own merits, and there is no ideal form of fandom. In this literature, however, the fair-weather fan continues to be viewed with dismissal and derision. While some fair-weather fans may earn this contempt, many fair-weather fans, we argue, are not only acceptable, they have important advantages over partisans and purists, and as (...) such are in a better position to navigate some of the moral complexities inherent in modern sports. We develop this argument first by clarifying the nature of the fair-weather fan. We then examine challenges that fans face in many modern sports, first owing to their economic nature and, second, due to the morally tainted status of many of them. We argue that the fair-weather fan meets these challenges in ways that the partisan and purist cannot replicate. (shrink)

Sin embargo, mantiene un elevado nivel de abstracción y de complejidad conceptual, promoviendo una multiplicidad de interpretaciones divergentes. Sin asumir la defensa de un objetivismo, el presente trabajo se propone analizar algunos mitos y creencias vinculados a la obra laclausiana. De este modo, se busca contribuir a estimular el debate y la crítica sobre sus principales postulados.

When the accrediting association for collegiate schools of business, AACSB International, reformulated its accreditation standards to include a systematic assessment of undergraduates’ progress in analytic and reflective thinking, our interdisciplinary team looked at available instruments. Logistical problems, concerns about validity, and an interest in assessing quantitative skills not covered in the available instruments led us to devise the Texas Assessment of Critical Thinking Skills™ (TACTS™). As part of the process we followed a suggestion from Scriven and Fisher and incorporated novel (...) multiple-rating items. We went through a lengthy process of test validation, employing both expert consultants and a large-scale comparison between performances on a standard critical thinking skills test and the TACTS™. Consequently, our university is in a position to regularly assess the progress made by undergraduates from our College of Business in acquiring the relevant analytic and reflective thinking skills. Can governments keep the pace of global markets? It is a defining characteristic of the present times, tested and measured within multiple studies, that we are living in an increasingly interconnected economy in which giant companies emerge and compete presenting new goods and products at a global scale. The competing environment of international markets produces quickly growing creatures that old nation-states struggle to understand, monitor and, consequently, regulate. In this regard, the selection process taking place in the market seems to (...) be far more effective and greedy than the selection process we apply to our governments. In this paper I discuss the basic theoretical mechanisms for the persistence of wealth concentration, introducing a general game-theoretical framework to connect governance, market economy, and wealth distribution, and to rethink democracy and fairness in policy-making, especially with the aim of global sustainability governance. En este trabajo se intenta elaborar una indagación epistemológica crítica que contribuya a enriquecer al debate sobre la posibilidad o imposibilidad de abordar los fenómenos de las ciencias sociales y humanísticas de una manera neutral y/o objetiva.. A partir de un enfoque centrado en la teoría post-estructuralista francesa y, más específicamente, en los aportes brindados por el psicoanálisis lacaniano, se concluirá que el psicoanálisis, en su vertiente lacaniana, y retomado de un modo distinto por otros autores, como Zizek, ha mostrado (...) de una manera consistente que este supuesto objetivismo no es más que un imposible. La realidad objetiva no puede ser más que una utopía, en tanto toda realidad es construida por un lenguaje, un orden simbólico, que es contingente y, por lo tanto, relativo. Sin caer en un mero relativismo de los actuales enfoques “posmodernos”, que no exista la Verdad con mayúscula no implica que no existan verdades a medias, “minoradas”, como las denomina Lacan en su obra.Palabras clave: Objetividad, neutralidad valorativa, pos-estructuralismo lacaniano, ciencia sociales y humanísticas.This work tries to elaborate a critical epistemological inquiry that enriches the debate about the possibility or impossibility of approaching social and human science phenomena in a neutral and/or objective way. Starting from a view based on French post-structuralist theory, and more specifically, on contributions from Lacanian psychoanalysis, conclusions will be that psychoanalysis, at least Lacanian psychoanalysis, taken up again in a different way by other authors such as Zizek, has consistently shown that this supposed objectivism is impossible. Objective reality can be no more than a utopia, because all reality is constructed by a language, a symbolic order which is contingent, therefore relative. Without falling into postmodern relativism, the fact that there is no Truth with a capital letter does not imply that there are no truths.Key words: Objectivity, valuative neutrality, Lacanian post-structuralism, social and human sciences. En los últimos 30 años asistimos a un drástico proceso de cambio que ha modificado profundamente los parámetros con los que se guiaba la relación entre el Estado y la Sociedad civil. Este proceso, ligado a la hegemonización mundial del neoliberalismo, ha generado intensas transformaciones en los diversos campos. Este artículo se propone indagar en esas transformaciones. Para ello, examina las características principales que definen a este paradigma, dando cuenta de la apropiación que han hecho sus principales teóricos del concepto (...) de globalización. En segundo término, analiza los efectos que sus políticas han provocado en la política, la economía, la cultura y la sociedad. Se sostiene que el éxito del “sistema global neoliberal” reside en que ha logrado despolitizar en gran medida a la sociedad y a su propio discurso. En este sentido, se coloca el eje en sus efectos de despolitización, en particular durante la década del noventa, fase critica del sistema. En el tramo final, se pregunta acerca de las alternativas surgidas en las nuevas democracias latinoamericanas al modelo de globalización neoliberal. (shrink)

Este artículo investiga los vínculos entre el sujeto y la estructura en el transcurso de la teoría política de Ernesto Laclau, integrando sus aspectos teóricos, onto-epistemológicos y axiológico-normativos. A través de la sistematización de sus principales trabajos escritos durante el período 1977-2014, se indaga en sus contribuciones al debate Agente-Estructura y se propone una periodización compleja de su obra. Mediante una articulación pragmática de conceptos del (pos)estructuralismo, el psicoanálisis, la deconstrucción, la fenomenología, el marxismo y la filosofía posanalítica, a partir (...) de su ruptura onto-epistemológica con el esencialismo de los años 80 Laclau construyó una innovadora teoría discursiva del sujeto, superadora tanto del subjetivismo como del objetivismo, y convergente con una estrategia socialista y radicalmente democrática. La razón populista aportó nuevas herramientas que destacaron la capacidad del agente de articular (parcialmente) lo social. Sin embargo, este trabajo marcó un quiebre en su obra, que dejó de lado el análisis retroductivo de las transformaciones históricas más recientes en la estructura social y en las identidades y su conexión con la creciente fragmentación y proliferación de las luchas sociales. Al mismo tiempo, relegó la centralidad de la categoría de articulación para amalgamar la pluralidad de luchas sociales en el capitalismo complejo actual, para priorizar la construcción (tendencial) de un antagonismo binario y una lógica de simplificación y reducción conceptual del espacio social. Desde el plano axiológico, la teoría formal del populismo Laclau abandonó la iniciativa socialista y el desarrollo de los contenidos ético-políticos críticos, inherentes a la teoría posgramsciana de la hegemonía. Se concluye que ―más allá de estas inconsistencias― la teoría posfundacional del sujeto de Laclau realizó aportes innovadores, relevantes y valiosos que contribuyen a superar la falsa disyunción sujeto-estructura, a complejizar el análisis político y social, y a fortalecer la lucha hegemónica, desde una perspectiva antiesencialista. Stakeholder theory has become a central issue in the literature on business ethics / business and society. There are, however, a number of problems with stakeholder theory as currently understood. Among these are: 1) the lack of a coherent justificatory framework, 2) the problem of adjudicating between stakeholders, and 3) the problem of stakeholder identification. In this essay, I propose that a possible source of obligations to stakeholders is the principle of fairness (or fair play) as discussed in the (...) political philosophic literature of Rawls, Simmons, and Cullity among others. The principle of fairness states that, “Whenever persons or groups of persons voluntarily accept the benefits of a mutually beneficial scheme of co-operation requiring sacrifice or contribution on the parts of the participants and there exists the possibility of free-riding, there exist obligations of fairness on the part of these persons or groups to co-operate in proportion to the benefits accepted.” In this essay I discuss the gaps in the current stakeholder literature, elucidate and defend a principle of fairness that fills the gap, compare the fairness model to other similar models of business ethics, and draw some conclusions for the future of stakeholder theory. There is an emerging consensus among political philosophers that state legitimacy involves something more than—or perhaps other than—political obligation. Yet the principle of fair play, which many take to be a promising basis for political obligation, has been largely absent from discussions of the revised conception of legitimacy. This paper shows how the principle of fair play can generate legitimate political authority by drawing on a neglected feature of the principle—its stipulation that members of a cooperative scheme must (...) reciprocate specifically by submitting to the scheme's rules. This paper explores how fair trade social enterprises manage paradoxes in stakeholder-oriented governance models. We use narrative accounts from board members, at governance events and board documents to report an exploratory study of paradoxes in three FTSEs which are partly farmer-owned. Having synthesized the key social enterprise governance literature and framed it alongside the broader paradox theory, we used narratives to explore how tensions are articulated, how they can be applied within an adapted paradox framework, and how governance actors (...) seek to mitigate paradoxes. The paper contributes to current debates in social enterprise scholarship concerning hybridity :455–476, 2010; in Institutional logics in action, Part B, 2012), hybrid organizing :397–441, 2014) and operational tensions :407–442, 2013) by illustrating empirically how the central social/enterprise paradox manifests in FTSEs governance arrangements. We build on the paradox categories proposed by Lüscher and Lewis :221–240, 2008) and adapted in Smith et al. :407–442, 2013) by developing a recursive model of legitimacy-seeking governance processes, conceptualizing how boards seek to mitigate, but not necessarily resolve, paradoxes. Recently, unrestrained consequentialism has been defended against the charge that it leads to unacceptable trade-offs by showing a tradeoff accepted by many of us is not justified by any of the usual nonconsequenlist arguments. The particular trade-off involves raising the speed limit on the Interstate Highway System. As a society, we seemingly accept a trade-off of lives for convenience. This defense of consequentialism may be a tu quoque, but it does challenge nonconsequentialists to adequately justify a multitude of social decisions. (...) Work by the deontologist Frances Kamm, conjoined with a perspective deployed by several economists on the relation between social costs and lives lost, is relevant. It provides a starting point by justifying decisions which involve trading lives only for other lives. But the perspective also recognizes that using resources in excess of some figure to save a life causes us to forego other live-saving activities, thus causing a net loss of life. Setting a speed limit as low as 35 miles per hour might indeed save some lives, but the loss of productivity due to the increased time spent in travel would cost an even greater number of lives. Therefore, many trade-offs do not simply involve trading lives for some lesser value, but are justified as allowing some to die in order to save a greater number. (shrink)

This case study highlights some of the latest research on setting executive compensation at ethical levels. The board of directors of Spade’s, a mid-size U.S. hardware chain, considers altering the pay package of its incoming CEO to best align his interests with those of shareholders and stakeholders. Students are invited to consider various options on current trends, which seem attractive and convincing on the surface, but might present certain risks over the longer term. This paper reviews the severe visual focus problems of health economists–they have developed a one-sided fixation with equity issues, neglecting the efficiency agenda. The problems of meeting need are not just about access–they will vary with cost and supply. Economists in fact developed a more balanced agenda in the 1970s but have failed to follow it up. The paper defines the triple nationalisation of the National Health Service , and presents evidence that pluralism, using the purchaser/provider split, has become more (...) efficient in long term care, home care and services for people with learning difficulties. Health economics has failed to explore options for using the dynamic forces of choice and competition for improving health services. The paper makes the case for a decision rule that “we should seek the process of health care service supply and development which maximises the delivery of high quality, lower cost user relevant services”.
