This book addresses the problem of how to make democratically-legitimate public policy on issues of contentious bioethical debate. It focuses on ethical contests about research and their legitimate resolution, while addressing questions of political legitimacy. How should states make public policy on issues where there is ethical disagreement, not only about appropriate outcomes, but even what values are at stake? What constitutes justified, democratic policy in such conflicted domains? Case studies from Canada and Australia demonstrate that two countries sharing historical (...) and institutional characteristics can reach different policy responses. This book is of interest to policymakers, bioethicists, and philosophers, and will deepen our understanding of the interactions between large-scale socio-political forces and detailed policy problems in bioethics. Despite decades of research on the reconstruction of proto-Korean-Japanese (pKJ), some scholars still reject a genetic relationship. This study addresses their doubts in a new way, interpreting comparative linguistic data within a context of material and cultural evidence, much of which has come to light only in recent years. The weaknesses of the reconstruction, according to J. Marshall Unger, are due to the early date at which pKJ split apart and to lexical material that the pre-Korean and pre-Japanese branches (...) later borrowed from different languages to their north and south, respectively. Unger shows that certain Old Japanese words must have been borrowed from Korean from the fourth century C.E., only a few centuries after the completion of the Yayoi migrations, which brought wet-field rice cultivation to Kyushu from southern Korea. That leaves too short an interval for the growth of two distinct languages by the time they resumed active contact. Hence, concludes Unger, the original separation occurred on the peninsula much earlier, prior to reliance on paddy rice and the rise of metallurgy. Non-Korean elements in ancient peninsular place names were vestiges of pre-Yayoi Japanese language, according to Unger, who questions the assumption that Korean developed exclusively from the language of Silla. He argues instead that the rulers of Koguryo, Paekche, and Silla all spoke varieties of Old Korean, which became the common language of the peninsula as their kingdoms overwhelmed its older culture and vied for dominance. Was the separation so early as to vitiate the hypothesis of a common source language? Unger responds that, while assuming non-relationship obviates difficulties of pKJ reconstruction, it fares worse than the genetic hypothesis in relation to non-linguistic findings, and fails to explain a significant number of grammatical as well as lexical similarities. Though improving the reconstruction of pKJ will be challenging, he argues, the theory of genetic relationship is still the better working hypothesis. The Role of Contact in the Origins of the Japanese and Korean Languages shows how an interdisciplinary approach can shed light on a difficult case in which the separation of two languages lies close to the time horizon of the comparative method. The present study applies a new method for investigating dynamic unconscious processes. The method consists of selection of words from patient interview and test protocols that in the clinicians' judgments capture the patients' conscious symptom experience and the hypothetical unconscious conflict related to the symptom, subliminal and supraliminal presentation of these words, signal analysis of event-related potentials obtained to the word presentations. Eight phobics and three patients suffering from pathological grief reactions served as subjects. A time-frequency ERP analysis revealed that (...) subjects' ERPs classified the unconscious conflict words better subliminally than supraliminally, while the reverse was true for the conscious symptom words = 2.82, p = .011). The relationship between frequency and latency revealed a similar mirror image pattern for the unconscious conflict and conscious symptom words . This method demonstrated that objective, brain-based evidence for unconscious conflict can be obtained. (shrink)

This article is the lead piece in a special report that presents the results of a bioethical investigation into chimeric research, which involves the insertion of human cells into nonhuman animals and nonhuman animal embryos, including into their brains. Rapid scientific developments in this field may advance knowledge and could lead to new therapies for humans. They also reveal the conceptual, ethical, and procedural limitations of existing ethics guidance for human‐nonhuman chimeric research. Led by bioethics researchers working closely with an (...) interdisciplinary work group, the investigation focused on generating conceptual clarity and identifying improvements to governance approaches, with the goal of helping scholars, funders, scientists, institutional leaders, and oversight bodies (embryonic stem cell research oversight [ESCRO] committees and institutional animal care and use committees [IACUCs]) deliver principled and trustworthy oversight of this area of science. The article, which focuses on human‐nonhuman animal chimeric research that is stem cell based, identifies key ethical issues in and offers ten recommendations regarding the ethics and oversight of this research. Turning from bioethics’ previous focus on human‐centered questions about the ethics of “humanization” and this research's potential impact on concepts like human dignity, this article emphasizes the importance of nonhuman animal welfare concerns in chimeric research and argues for less‐siloed governance and oversight and more‐comprehensive public communication. There is now a considerable literature on Michel Foucault but this is the first monograph which explicitly addresses his influence and impact upon education. Personal autonomy has been seen as a major aim, if not the aim of liberal education. But if Foucault is correct that personal autonomy and the notion of the autonomous person are myths, then the pursuit of such an aim by educationalists is misguided. The author develops this critique of personal autonomy and liberal education from the (...) writings of Foucault, and also considers Foucault's own educational practices. The author, James Marshall, who lives in New Zealand, has already written several articles for academic journals on Foucault. (shrink)

Next SectionIn a series of previous articles, we have considered how we might reconceptualise central themes in medicine and medical education through ‘thinking with Homer’. This has involved using textual approaches, scenes and characters from the Iliad and Odyssey for rethinking what is a ‘communication skill’, and what do we mean by ‘empathy’ in medical practice; in what sense is medical practice formulaic, like a Homeric ‘song’; and what is lyrical about medical practice. Our approach is not to historicise medicine (...) and medical education, but to use thinking with Homer as a medium and metaphor for questioning the habitual and the taken-for-granted in contemporary practice. In this article, we tackle the complex theme of ‘translation’. We use the lens of translation studies to examine the process of turning the patient's story into medical language. We address the questions: what makes a ‘good’ translation? What are the consequences of mistranslation and poor translation? And, while things are inevitably lost in translation, does this matter? In a vigorously argued passage of the oration Pro L. Flacco, Cicero defends his client L. Valerius Flaccus against the charge that he had acted improperly during his governorship of Asia three years previously in claiming as heres legitimus the estate of one Valeria, wife of Sextilius Andro, who had died intestate in the province. This section of the speech involves Cicero in a brief display of his knowledge of the civil law concerning tutela, the forms of acquiring manus in (...) marriage by usus and coemptio and inheritance ah intestate, and it is described by the scholiast as ‘negotialis quaestiuncula’. The passage is regularly cited in the handbooks to illustrate those features of the civil law which Cicero treats, but the Valeria in question is otherwise wholly obscure. (shrink)

BackgroundAccurate reporting on sex and gender in health research is integral to ensuring that health interventions are safe and effective. In Canada and internationally, governments, research organizations, journal editors, and health agencies have called for more inclusive research, provision of sex-disaggregated data, and the integration of sex and gender analysis throughout the research process. Sex and gender analysis is generally defined as an approach for considering how and why different subpopulations (e.g., of diverse genders, ages, and social locations) may experience (...) health conditions and interventions in different or similar ways.The objective of this study was to assess the extent and nature of reporting about sex and/or gender, including whether sex and gender analysis (SGA) was carried out in a sample of Canadian randomized controlled trials (RCTs) with human participants.MethodsWe searched MEDLINE from 01 January 2013 to 23 July 2014 using a validated filter for identification of RCTs, combined with terms related to Canada. Two reviewers screened the search results to identify the first 100 RCTs that were either identified in the trial publication as funded by a Canadian organization or which had a first or last author based in Canada. Data were independently extracted by two people from 10% of the RCTs during an initial training period; once agreement was reached on this sample, the remainder of the data extraction was completed by one person and verified by a second.ResultsThe search yielded 1433 records. We screened 256 records to identify 100 RCTs which met our eligibility criteria. The median sample size of the RCTs was 107 participants (range 12–6085). While 98% of studies described the demographic composition of their participants by sex, only 6% conducted a subgroup analysis across sex and 4% reported sex-disaggregated data. No article defined “sex” and/or “gender.” No publication carried out a comprehensive sex and gender analysis.ConclusionsFindings highlight poor uptake of sex and gender considerations in the Canadian RCT context and underscore the need for better articulated guidance on sex and gender analysis to improve reporting of evidence, inform policy development, and guide future research. Nursing policy and healthcare reform are focusing on two, interconnected areas: person‐centred care and fundamental care. Each initiative emphasises a positive nurse–patient relationship. For these initiatives to work, nurses require guidance for how they can best develop and maintain relationships with their patients in practice. Although empirical evidence on the nurse–patient relationship is increasing, findings derived from this research are not readily or easily transferable to the complexities and diversities of nursing practice. This study describes a novel methodological approach, called (...) holistic interpretive synthesis (HIS), for interpreting empirical research findings to create practice‐relevant recommendations for nurses. Using HIS, umbrella review findings on the nurse–patient relationship are interpreted through the lens of the Fundamentals of Care Framework. The recommendations for the nurse–patient relationship created through this approach can be used by nurses to establish, maintain and evaluate therapeutic relationships with patients to deliver person‐centred fundamental care. Future research should evaluate the validity and impact of these recommendations and test the feasibility of using HIS for other areas of nursing practice and further refine the approach. (shrink)

One of the most important pieces of evidence which we possess concerning the judicial rights of Roman provincials, particularly their status in relation to the governor's tribunal, is provided by Cicero's brief outline of those provisions of the lex Rupilia, the Sicilian provincial charter, which dealt with judicial administration. ‘Smart’ devices are becoming increasingly ubiquitous. While these sophisticated machines are useful for various purposes, they sometimes evoke feelings of eeriness or discomfort that constitute uncanniness, a much-discussed phenomenon in robotics research. Adult participants (N = 115) rated the uncanniness of a hypothetical future smart speaker that was described as possessing the mental capacities for experience, agency, neither, or both. The novel condition prompting participants to attribute both agency and experience to the speaker filled an important theoretical gap in the (...) literature. Consistent with the mind perception hypothesis of uncanniness (MPH; Gray & Wegner, 2012), participants in the with-experience condition rated the device significantly higher in uncanniness than those in the control condition and the with-agency condition. Participants in the with-both (experience and agency) condition also rated the device higher in uncanniness than those in the control condition and the with-agency condition, although this latter difference only approached statistical significance. Though academic debate over gender-inclusive God-talk seems to have fizzled, the issue is a pressing one within many Christiandenominations today—both within and outside the Church—and for that reason deserves to be briefly revisited. Accordingly, althoughin this essay we approach the issue as professional philosophers, our focus is on the life of the Church—more specifically, those no doubt sizable segments of the Church for which a personal God and Satan exist and evangelism matters. Running an elimination argument, we contend that if (...) a certain sort of feminist concern about traditional God-talk is well-directed, the best response is to speak of not only God but also Satan in both masculine and feminine terms. And in closing, we address the possible worry that this response to the God-talk problem would not be Christian enough. (shrink)

Background The rise in genomic and biobanking research worldwide has led to the development of different informed consent models for use in such research. This study analyses consent documents used by investigators in the H3Africa (Human Heredity and Health in Africa) Consortium. Methods A qualitative method for text analysis was used to analyse consent documents used in the collection of samples and data in H3Africa projects. Thematic domains included type of consent model, explanations of genetics/genomics, data sharing and feedback of (...) test results. Results Informed consent documents for 13 of the 19 H3Africa projects were analysed. Seven projects used broad consent, five projects used tiered consent and one used specific consent. Genetics was mostly explained in terms of inherited characteristics, heredity and health, genes and disease causation, or disease susceptibility. Only one project made provisions for the feedback of individual genetic results. Conclusion H3Africa research makes use of three consent models—specific, tiered and broad consent. We outlined different strategies used by H3Africa investigators to explain concepts in genomics to potential research participants. To further ensure that the decision to participate in genomic research is informed and meaningful, we recommend that innovative approaches to the informed consent process be developed, preferably in consultation with research participants, research ethics committees and researchers in Africa. What should we make of the intuitions marshaled on behalf of the existence of supererogatory actions, or actions that are “good but not required”? Are they trustworthy or dissembling? This question is important considering the great respect many writers give to them. The attitude of Daniel Guevara is not unusual: "My discussion relies upon the intuition that certain acts, such as those described by Urmson, are supererogatory, indeed, that they are paradigms…I shall proceed on the assumption that a theory is (...) discredited if in fact it makes supererogation impossible." There is thus a widespread attitude that the supererogatory status of certain acts should be taken to be one of those elements out of which a moral theoryshould be constructed, something like one of Rawls’s “considered moral judgments” or “considered convictions of justice.” The comparison with Rawls’ methodology is sometimes quite explicit. My purpose is to throw this conviction – that the supererogatory status of these actions can be accepted with a confidence not too much less than that with which we accept that slavery is wrong – into doubt. Whether there is a category of the supererogatory acts is a matter for another paper; personally I see no conceptual incoherence but merely doubt that it is instantiated very often. My goal shall be rather narrow: to cast doubt upon the reputation of the intuitions. First I shall describe my conclusion abstractly, and why I think the intuitions are much less indubitable than supposed. Then I shall discuss a few common examples of supererogatory acts and show how my account explains them. Finally I shall consider how most important intuitions of supererogatory status – those associated with extreme self-sacrifice – might be integrated into my overall account. (shrink)
