Lex Mercatoria play a crucial role in resolving disputes arising from international trade contracts before arbitration bodies, thus establishing them as an independent legal system capable of regulating international commercial relations. This legal characteristic imposes a certain obligation on various arbitration bodies to apply them to the disputes brought before them, either based on the parties' intentions or based on the legal force inherent in those customs. Consequently, this research examines the extent of recognition of the binding force of commercial (...) customs before arbitration bodies, and based on that, it elucidates the authority of these bodies in applying them to international trade disputes. It is evident that these customs, due to their flexibility derived from the nature of commercial transactions and the customary practices of traders resorting to them, have become today an independent legal system that imposes itself on arbitration bodies even if the parties did not choose to apply those customs. This paper recommends the Jordanian legislator to explicitly adopt the application of these commercial customs in the Jordanian Arbitration Law texts, following the example of national and international comparative legislation. This study dealt with one of the most important legal subjects in private international law that relates to the topic of law applicable to electronic signature and is problematic by the lack of clear and explicit texts to determine the law required on the topic The main objective of the study was to reflect the legal regulation in private international law of such a problem, as well as to address some practical and applicable problems relating to the topic of the (...) study, including the legal nature of an electronic signature, When preparing this study, the researcher relied on the inductive approach by extracting legal texts on the subject of the letter in accordance with Jordanian legislation. in addition to the analytical approach where the researcher analysed and described the legislative and doctrinal positions and international conventions associated with the subject matter of the letter, The prescriptive approach, through a statement of the legal nature of the electronic signature. The researcher produced a series of results, the most important of which was the absence of clear and explicit texts specifying the law applicable to the electronic signature. This result was reflected in the recommendations of this letter, which were the most important recommendation to the Jordanian legislature that legal rules should be drawn up to determine the law applicable to the subject matter of the study. Sufism has been neglected in the religious discourse and educational practices of modernist Muslims in the Islamic world, including Indonesia, where Kiai Moechtar Boechari (1899-1926) had emerged as an early activist in the Muhammadiyah Surakarta and Sufism. This research aims to examine Kiai Boechari’s religious thought, emphasizing the idea of Sufism as a practice of moral education (_akhlaq_). The data of research comprised mainly documentation and library archives. The findings reveal that Kiai Boechari’s religious thinking was driven by persistence in (...) reformulating Islam to be relevant and able to answer the challenges of the modern era based on purification and dynamization. Boechari emphasized on the problem of purifying faith (_aqidah_), the dynamics of worldly _muamalah_ problems, comparative religions, women’s emancipation, and moral Sufism. Kiai Boechari’s Sufism thought emphasized the purification of _aq__i__dah_, guided by the Quran and Sunnah, respect for the Shari’a, and the practice of individual social moral education, which are characteristics of the typology of Sufism (_transcendental mysticism_), moral Sufism, and orthodox/prophetic Sufism. This was known as neo-Sufism formulated by Kiai Boechari to practice moral education. It requires persistence to carry out the process of purifying oneself from despicable and immoral traits (_takhalli_), such as anger, envy, arrogance, pride, riya, and the urge to lust; which eventually starts the process of internalizing good qualities (_tahalli_), culminating in _mahabbah_, the disappearance of the human hijab (_tajalli_), giving a peak of spiritual experience. This study implicates that, in the prophetic orientation of Sufism, spiritual experience is not an end in itself, for the sake of the experience itself, but to give meaning to actions in history. This article examines the relationship between religion, tradition and identity as seen from the myth about eclipses in a village in Central Java. Javanese people in rural areas still hold beliefs passed down from their ancestors about eclipses, both lunar and solar eclipses. Using a qualitative approach, the results of the study showed that the villagers believe that eclipses occur because of evil giants called buto named Batara Kala who try to devour the sun or the moon. This natural phenomenon (...) is believed to bring disaster to pregnant women and livestock. To fight the disaster, they must perform certain ceremonies or rituals. Based on ethnographic studies, this research provides an overview of eclipse mythology for Javanese locals and analyses it from identity theory. This shows that mythical rituals reflect a continuous identity formation. Although the traditions associated with these myths to some extent transcend the boundaries of the Islamic religion, they remain unchallenged. CONTRIBUTION: This research suggests that myths play an important role in the life and identity of the people who believe in them and perform the rituals associated with them. (shrink)

By a well-known result of Kotlarski et al., first-order Peano arithmetic \ can be conservatively extended to the theory \ of a truth predicate satisfying compositional axioms, i.e., axioms stating that the truth predicate is correct on atomic formulae and commutes with all the propositional connectives and quantifiers. This result motivates the general question of determining natural axioms concerning the truth predicate that can be added to \ while maintaining conservativity over \. Our main result shows that conservativity fails even (...) for the extension of \ obtained by the seemingly weak axiom of disjunctive correctness \ that asserts that the truth predicate commutes with disjunctions of arbitrary finite size. In particular, \ implies \\). Our main result states that the theory \ coincides with the theory \ obtained by adding \-induction in the language with the truth predicate. This result strengthens earlier work by Kotlarski and Cieśliński. For our proof we develop a new general form of Visser’s theorem on non-existence of infinite descending chains of truth definitions and prove it by reduction to Gödel’s second incompleteness theorem, rather than by using the Visser–Yablo paradox, as in Visser’s original proof. The “problem of memory” in epistemology is concerned with whether and how we could have knowledge, or at least justification, for trusting our apparent memories. I defend an inductive solution—more precisely, an abductive solution—to the problem. A natural worry is that any such solution would be circular, for it would have to depend on memory. I argue that belief in the reliability of memory can be justified from the armchair, without relying on memory. The justification is, roughly, that my having (...) the sort of experience that my apparent memory should lead me to expect is best explained by the hypothesis that my memories are reliable. My solution is inspired by Harrod’s (1942) inductive solution. Coburn (1960) argued that Harrod’s solution contains a fatal flaw. I show that my solution is not vulnerable to Coburn’s objection, and respond to a number of other, recent and likely objections. (shrink)

Davidson’s later philosophy of language has been inspired by Wittgenstein’s Investigations, but Davidson by no means sympathizes with the sceptical problem and solution Kripke attributes to Wittgenstein. Davidson criticizes the sceptical argument for relying on the rule-following conception of meaning, which is, for him, a highly problematic view. He also casts doubt on the plausibility of the sceptical solution as unjustifiably bringing in shared practices of a speech community. According to Davidson, it is rather success in mutual interpretation that explains (...) success in the practice of meaning something by an utterance. I will argue that Davidson’s objections to the sceptical problem and solution are misplaced as they rely on a misconstrual of Kripke’s Wittgenstein’s view. I will also argue that Davidson’s alternative solution to the sceptical problem is implausible, since it fails to block the route to the sceptical problem. I will then offer a problematic trilemma for Davidson. (shrink)

Miriam Schoenfield argues that moral realism and moral vagueness imply ontic vagueness. In particular, she argues that neither shifty nor rigid semantic accounts of vagueness can provide a satisfactory explanation of moral vagueness for moral realists. This paper constitutes a response. I argue that Schoenfield's argument against the shifty semantic account presupposes that moral indeterminacies can, in fact, be resolved determinately by crunching through linguistic data. I provide different reasons for rejecting this assumption. Furthermore, I argue that Schoenfield's rejection of (...) the rigid semantic account is based on a presupposition that ultimately implies the very same claim that is under dispute: the vagueness of moral predicates in imperfect languages persists in the perfect language, as well. For over four decades, the topic of Chief Executive Officer (CEO) compensation has attracted considerable attention from the fields of economics, finance, management, public policy, law, and business ethics. As scholarly interest in CEO pay has increased, so has public concern about the ethics of high CEO pay. Despite growing interest and pressure among the public and government to reduce CEO pay, it has continued to increase. Using a multi-method design incorporating a pilot study, two online experiments, and an event (...) study, we investigate the impact of CEO pay on consumer purchase intent and find that this negative relationship is magnified under conditions of brand crisis. We also find that the negative interaction of high CEO pay and brand crisis on purchase intent is more negative when the brand has strong equity. Finally, when the CEO is awarded high pay while the firm they manage is undergoing a brand crisis, consumers lose trust in the firm’s brand which reduces consumer purchase intent. This research provides insight on how governance decisions can impact consumer perceptions of corporate brands and consumer behavior, with implications for public policy leaders, boards of directors, CEOs, and Chief Marketing Officers regarding how to manage and message CEO pay. In this article, I present a critique of Robert Geraci's Apocalyptic artificial intelligence (AI) discourse, drawing attention to certain shortcomings which become apparent when the analytical lens shifts from religion to the race–religion nexus. Building on earlier work, I explore the phenomenon of existential risk associated with Apocalyptic AI in relation to “White Crisis,” a modern racial phenomenon with premodern religious origins. Adopting a critical race theoretical and decolonial perspective, I argue that all three phenomena are entangled and they should (...) be understood as a strategy, albeit perhaps merely rhetorical, for maintaining white hegemony under nonwhite contestation. I further suggest that this claim can be shown to be supported by the disclosure of continuity through change in the long‐durée entanglement of race and religion associated with the establishment, maintenance, expansion, and refinement of the modern/colonial world system if and when such phenomena are understood as iterative shifts in a programmatic trajectory of domination which might usefully be framed as “algorithmic racism.”. The principal result of this paper answers a long-standing question in the model theory of arithmetic [R. Kossak, J. Schmerl, The Structure of Models of Peano Arithmetic, Oxford University Press, 2006, Question 7] by showing that there exists an uncountable arithmetically closed family of subsets of the set ω of natural numbers such that the expansion of the standard model of Peano arithmetic has no conservative elementary extension, i.e., for any elementary extension of , there is a subset of ω* (...) that is parametrically definable in but whose intersection with ω is not a member of . We also establish other results that highlight the role of countability in the model theory of arithmetic. With the excessive emphasis that modern PhD training places on the epistemological contribution of the thesis, a question that arises is: do PhD programmes help PhD students achieve philosophia – “love of wisdom”, or do the programmes just facilitate deepening and developing students’ knowledge? This paper challenges the modern approach to PhD training and by extension all academic research, and considers phronesiology, a wisdom-based approach to research design, to add value to traditional epistemic methodologies. In illustration, we use phronesiology and (...) social practice wisdom principles to reflect on the merits of a recently completed empirical study of wise managerial decision-making. Through a reflective analysis, this paper demonstrates that phronesiology not only allows for contributions to knowledge, but can, as a matter of principle and choice, also increase research practitioner wisdom. In doing so, this may enable researchers to implement better and more comprehensive intellectual and practical outcomes that deal effectively with the economic, social, political, and environmental complexities of the contemporary world. Further, we argue that such a wisdom approach is more “practical” than further instrumentalizing PhD training. The paper offers a series of phronetic reflective questions for PhD researchers in social sciences, especially in organizational and management fields, to consider when designing and carrying out research. The novel depicts Jasmine’s journey of transformation from a passive, traditional girl at the mercy of fate in a village in India to an active, modern, and most importantly cross-cultural hybrid woman in America. All through the novel, her identity is transformed in line with shifts in her name from Jyoti to Jasmine to Jazzy to Jane. Accordingly, she stands in-between (...) two cultures, shuttles between identities, welds opposing identities, enters the third space and emerges as a hybrid. The present study in the light of Homi Bhabha's insights seeks to demonstrate that immigrating, experiencing displacement and in-betweenness, and being positioned in the third space pave the way for Jasmine’s becoming a hybrid and being liberated. This study examines the representations of male and female social actors in selected Iranian EFL (English as a Foreign Language) textbooks. It is grounded in Critical Discourse Analysis and uses van Leeuwen’s Social Actor Network Model to analyze social actor representations in the gendered discourses of compulsory heterosexuality. Findings from the analysis show that the representations endorse the discourse of compulsory heterosexuality which is an institutionalized form of social practice in Iran. Three male and three female students were interviewed to (...) find out what they think about these representations. Their responses with regard to whether they think textbooks should also include representations of other forms of sexuality were non-committal and vague. To them LGBT people are the ‘‘Other’’ practicing a form of sexuality that is not normal. Such exclusions could obscure the reality regarding the existence of such gender identities and represent the world in a particular manner. (shrink)

The struggle for domination clearly persists in The Homecoming as it does in almost all of Pinter’s works. Because of the vague atmosphere, enigmatic characters, and dark, tragicomic dialogue and action, a single decisive meaning for the play cannot be identified. Many character analyses have been carried out on the play, frequently focusing on Ruth and her decision at the end. Moreover, critics have sought to read the play in the light of psychoanalysis, centering on the characters’ past and complexes. (...) By adding a sociopolitical dimension to purely realistic or symbolic readings, this article attempts to analyze the relationships of domination and servitude between characters at the micro-level of the family structure through Marx’s notions of fetishism in relations between individuals, and commodity fetishism as expounded by Slavoj Žižek. With the help of Žižek’s ideas on ideology, a new layer of sociopolitical signification to the relationships held between characters is added, particularly that between Ruth and the men, which is seen as a parallel to the macro-level fetishized relationships in pre-capitalist societies and commodity fetishism in a capitalist one. This research investigates the representations of gendered social actors within the subversionary discourse of equal educational opportunities for males and females in Iranian English as a Foreign Language (EFL) books. Using critical discourse analysis (CDA) as the theoretical framework, the authors blend van Leeuwen’s (Texts and practices: Readings in critical discourse analysis, Routledge, London, 2003) ‘Social Actor Network Model’ and Sunderland’s (Gendered discourses, Palgrave Macmillan, Hampshire, 2004) ‘Gendered Discourses Model’ in order to examine the depictions of male and female social (...) actors within this gendered discourse. The gendered discourse of equal opportunities was buttressed by such representations within a tight perspective in proportion to gender ideologies prevailing in Iran. Resorting to CDA, we can claim that resistance against such gendered discourse in Iranian EFL textbooks militates against such gender norms. These representations of male and female social actors in school books are indicative of an all-encompassing education, reinforcing that the discourse of equal opportunities is yet to be realized in the education system of Iran. Small and medium-sized enterprises (SMEs) play a crucial role in national economic growth and contribute significantly to GDP, acting as the backbone of economies in competitive markets. However, ethical issues in SMEs are often overlooked compared to those in large organisations due to limited public financial exposure and minimal media coverage. Research on ethical culture is still limited, particularly in SMEs, as past studies have predominantly focused on large organisations. To gain deeper insights into the ethical culture of SMEs, more (...) qualitative research is needed to uncover the complexities of ethical conduct and organisational dynamics in SMEs. Therefore, this study employs a qualitative approach to explore the elements of ethical culture implemented in Malaysian SMEs. The data, gathered through in-depth interviews with eleven SME managers in Malaysia, revealed that ethical culture is reflected through formal systems, informal systems, leadership, and the newly highlighted element of religiosity. These four elements were explained with three goals for each element: communication, training, and management. The ethical issues faced by SMEs (favouritisms, selling company inventories, and disrespect towards female-led managers) were also highlighted. Accelerators (family influence, customer retention) and barriers (financial constraints) in implementing ethical culture were identified. Interestingly, this study highlights the significant role of religiosity in the ethical culture of SMEs, contributing to the literature and serving as a framework for future research. It aims to provide valuable insights for policymakers, business leaders, and stakeholders seeking to promote a robust ethical culture within the context of Malaysian SMEs. (shrink)

Most readings of Tayib Salih’s Season of Migration to the North have focused on Mustafa Saeed and the nameless narrator, both male characters, and they have largely avoided a politically radical reading of the novel. This article attempts to present the female character, Hosna, as the revolutionary par excellence, following Lacan and Slavoj Žižek’s reading of Antigone. Th rough Žižek’s distinction between the act and action, this article argues that Hosna’s deed at the end of the novel, murder and suicide, (...) is not just an action out of hopelessness but rather an act that aims to make a new social order possible. We will try to connect Žižek’s distinction between act and action to Benjamin’s distinction between divine violence and mythic violence and Lacan’s idea of “Th ing-directed desire” (Marc De Kesel 245). By doing so, this article aims to put the extreme violence of Hosna in a new light and argues against the readings that simply ignore her act as an extreme form of violence and fail to see it in a broader framework of philosophical and sociological understanding. Rawls in his later philosophy claims that it is sufficient to accept political conception as true or right, depending on what one's worldview allows, on the basis of whatever reasons one can muster, given one's worldview (doctrine). What political liberalism is interested in is a practical agreement on the political conception and not in our reasons for accepting it. There are deep issues (regarding deep values, purpose of life, metaphysics etc.) which cannot be resolved through invoking common reasons (this is (...) the fact of free reason itself), and trying to resolve them would involve us in interminable debates and would hamper the practical task of agreement on the political conception. Given the absolute necessity of a political society which is stable and enduring, it is thus wise to avoid these issues in founding a political society and choosing its basic principles - this is the pragmatic part of Rawls's position. In this paper I argue that this strategy leads Rawls into a paradox: (i) although the intention is to stay independent of comprehensive doctrines, the political conception is in fact totally (and precariously) dependent on comprehensive doctrines (not just on one doctrine but on each and every major doctrine in society). It is dependent on them: for its conceptualisation as an independent idea, for its justification, for the check of its reasonability in relation to the external world, for the formation of identities and value inculcation and hence for the formation of its model citizen; (ii) the very search for independence makes the political conception more dependent on comprehensive doctrines, and by extension makes it potentially more prone to intervention in and tampering with comprehensive doctrines (it is enough to show that it is a strong conceptual possibility to cast doubt on the whole strategy). Thus, for example, the political conception relies on the hope that “firmly held convictions gradually change” and that it would “in fact . . . have the capacity to shape those doctrines toward itself”. The purpose of the Rawlsian conjecture is to give these “hopes” a concrete, practical form by giving advice to proponents of the comprehensive doctrine on how they can do all this and “try to show them that, despite what they might think, they can still endorse a reasonable political conception”. I further argue that this paradox can be overcome by making the core of political liberalism more flexible. (shrink)

The genetic code is a set of instructions that determine how the information in our genetic material is translated into amino acids. In general, it is universal for all organisms, from viruses and bacteria to humans. However, in the last few decades, exceptions to this rule have been identified both in pro‐ and eukaryotes. In this review, we discuss the 16 described alternative eukaryotic nuclear genetic codes and observe theories of their appearance in evolution. We consider possible molecular mechanisms that (...) allow codon reassignment. Most reassignments in nuclear genetic codes are observed for stop codons. The continuum between involuntary autobiographical memories and déjà vu, as proposed by Barzykowski and Moulin, can be better defined by considering research on autobiographical retrieval in patients with Alzheimer's disease. Although autobiographical retrieval in patients with Alzheimer's disease can generally be associated with a sense of familiarity, involuntary retrieval can trigger an autonoetic experience of retrieval in these patients.

William Lane Craig has recently formulated a set of arguments that aim to undermine the rationality of Islamic theism. This paper will consider seven arguments that Craig deploys against Muslim belief. The seven arguments can be summarised as follows: (1) the Quran makes an egregious historical error by denying the crucifixion of Jesus; (2) the Quran contains legendary stories about Jesus; (3) the Quran is mistaken about the self-understanding of Jesus; (4) the Quran misunderstands the Trinity; (5) the Islamic concept (...) of God is morally deficient; (6) the Islamic concept of God is less plausible than a Trinitarian concept of God; and (7) the Muslim doctrine of salvation compromises God’s holiness and proves to be unattainable. Abstractabstract:The concept of “boring dystopia,” a term coined by Mark Fisher, describes the banal and mildly coercive signs that are prevalent in contemporary neoliberal society. It is characterized by a pervasive sense of boredom, banality, and total alienation, which arises from the depletion of social connections caused by free-market fundamentalism and consumer culture. For the author, Edward Hopper’s paintings embody this sense of dystopia, as they depict deserted cityscapes and isolated figures, creating a vision of a society where human connection (...) and interaction have broken down. The COVID-19 pandemic response has further highlighted the erosion of empathy and compassion under neoliberal capitalism, making Fisher’s call for collective action and the creation of new forms of community and solidarity even more urgent. Edward Hopper’s haunting art reminds us that we are already living in a dystopia, and that it is crucial to confront this dystopian reality and imagine new possibilities for the future. (shrink)

: The "major Islamic philosophers," writes Deborah Black, "produced no works dedicated to aesthetics, although their writings do address issues that contemporary philosophers might study under that heading." The emergent theme in this essay is that classical Islamic philosophy may be studied within a framework of aesthetics. To achieve this goal, the metaphysics of Abu Hamid al-Ghazālī (1058–1111) and the aesthetics of Arthur Schopenhauer (1788–1860) will be brought together.

The COVID-19 pandemic has inspired numerous opportunities for telehealth implementation to meet diverse healthcare needs, including the use of virtual communication platforms to facilitate the growth of and access to clinical ethics consultation (CEC) services across the globe. Here we discuss the conceptualization and implementation of two different virtual CEC services that arose during the COVID-19 pandemic: the Clinical Ethics Malaysia COVID-19 Consultation Service and the Johns Hopkins Hospital Ethics Committee and Consultation Service. A common strength experienced by both platforms (...) during virtual delivery included improved ability for local practitioners to address consultation needs for patient populations otherwise unable to access CEC services in their respective locations. Additionally, virtual platforms allowed for enhanced collaboration and sharing of expertise among ethics consultants. Both contexts encountered numerous challenges related to patient care delivery during the pandemic. The use of virtual technologies resulted in decreased personalization of patient-provider communication. We discuss these challenges with respect to contextual differences specific to each service and setting, including differences in CEC needs, sociocultural norms, resource availability, populations served, consultation service visibility, healthcare infrastructure, and funding disparities. Through lessons learned from a health system in the United States and a national service in Malaysia, we provide key recommendations for health practitioners and clinical ethics consultants to leverage virtual communication platforms to mitigate existing inequities in patient care delivery and increase capacity for CEC globally. The standard Leibnizian view of identity allows for substitutivity of identicals and validates transitivity of identity within classical semantics. However, in a series of works, Graham Priest argues that Leibnizian identity invalidates both principles when formalized in paraconsistent semantics. This paper aims to show the Leibnizian view of identity validates substitutivity of identicals and transitivity of identity whether the logic is classical or paraconsistent. After presenting Priest's semantics of identity, I show what a semantic expression of Leibnizian identity does amount (...) to. Then, I argue that Priest's semantic definition of identity is not Leibnizian. Finally, I offer a semantics characterization of identity in paraconsistent logic that is truly Leibnizian. I demonstrate that the correct formalization of Leibnizian identity in paraconsistent logic also validates substitutivity of identicals and transitivity of identity. (shrink)

One of the contexts for the development of social capital and spiritual health is cultural capital. The relationship between religion as an independent variable and social capital as a dependent variable has been analysed. This article aims to analyse the role of cultural capital in the development of social capital and spiritual health from the perspective of religion and negative Islamic teachings. This study attempts to answer the question, 'what is the role of cultural capital on the development of social (...) capital and spiritual health from the perspective of negative Islamic teachings?' In this article, an attempt has been made to compare the negative aspect of education in the form of the Qur'anic concept of 'cultivation', with its positive aspect in terms of principles, approach and method, in order to return to the model arising from Qur'anic and mystical teachings. The research method is descriptive and analytical, and data processing is interpretive and critical. Data collection has been performed utilising documentary and library study methods. The research findings demonstrate that 'ethics, science, values, norms, rituals and art' are the most important elements of embodied cultural capital, which are effective in the development of social capital. CONTRIBUTION: Therefore, there is a substantial relationship between religion, negative Islamic teachings, the development of embodied cultural capital and the development of social capital and spiritual health. In the probability literature, a martingale is often referred to as a “fair game.” A martingale investment is a stochastic sequence of wealth levels, whose expected value at any future stage is equal to the investor’s current wealth. In decision theory, a risk neutral investor would therefore be indifferent between holding on to a martingale investment, and receiving its payoff at any future stage, or giving it up and maintaining his current wealth. But a risk-averse decision maker would not be (...) indifferent between a martingale investment and his current wealth level, since he values uncertain deals less than their mean. A risk seeking decision maker, on the other hand, would readily accept a martingale investment in exchange for his current wealth, and would repeat this investment any number of times. These ideas lead us to introduce the notion of a “risk-adjusted martingale”; a stochastic sequence of wealth levels that a rational decision maker with any attitude toward risk would value constantly with time, and would be indifferent between receiving its pay-off at any future stage, or giving it up and maintaining his current wealth level. We show how to construct such risk-adjusted investments for any decision maker with a continuous monotonic utility function. The fundamental result we derive is that a pay-off structure of an investment (i) is a risk-adjusted martingale and (ii) can be represented by a lattice if and only if the pay-off functions are invariant transformations of the given utility function.
