ABSTRACT:The major aim of this article is to show that John Rawls’s theory of justice cannot be applied effectively to questions of business ethics and corporate governance. I begin with a reading of Rawls that emphasizes both the critical and pragmatic nature of his theory. In the second section I look more closely at the notion of society’s “basic structure” and its place within Rawls’s theory. In the third section, I argue that “the corporation” cannot be understood as part of (...) this basic structure and is not, therefore, a subject of justice for Rawls or his interpreters. Finally, I show that Rawls’s inability to speak to the corporation is a weakness, regardless of one’s particular view on the corporation. I conclude by considering what Rawls’s theory helps us to understand about the problems involved in integrating corporate governance, business ethics, and political philosophy. (shrink)

Accepting a promise is normatively significant in that it helps to secure promissory obligation. But what is it for B to accept A’s promise to φ? It is in part for B to intend A’s φ-ing. Thinking of acceptance in this way allows us to appeal to the distinctive role of intentions in practical reasoning and action to better understand the agency exercised by the promisee. The proposal also accounts for rational constraints on acceptance, and the so-called directedness of promissory (...) obligation. Finally, the proposal, conjoined with Cognitivism about intentions, addresses recent criticism of Scanlon’s expectation-based view of promissory obligation. (shrink)

Assuming the existence of a supercompact cardinal and a weakly compact cardinal above it, we provide a generic extension where there are no Aronszajn trees of height ω 2 or ω 3 . On the other hand we show that some large cardinal assumptions are necessary for such a consistency result.

ABSTRACT:In his 2018 presidential address to the Society of Business Ethics, Jeffery Smith claimed that political approaches to business ethics must be attentive to both the distinctive nature of commercial activity and, at the same time, the degree to which such commercial activity is structured by political decisions and choices. In what we take to be a friendly extension of the argument, we claim that Smith does not go far enough with this insight. Smith’s political approach to business ethics focuses (...) solely on the outcomes of political choices. But if we think of politics in terms of processes—as in, ongoing disagreement and contest—and not merely a series of legal, administrative, or institutional outcomes, a different view of business ethics emerges. In particular, we argue that such an emphasis points us toward seeing business actors as having a normative duty to preserve the integrity and functioning of democracy. (shrink)

The human microbiome is the bacteria, viruses, and fungi that cover our skin, line our intestines, and flourish in our body cavities. Work on the human microbiome is new, but it is quickly becoming a leading area of biomedical research. What scientists are learning about humans and our microbiomes could change medical practice by introducing new treatment modalities. This new knowledge redefines us as superorganisms comprised of the human body and the collection of microbes that inhabit it and reveals how (...) much we are a part of our environment. The understanding that microbes are not only beneficial but sometimes necessary for survival recasts our interaction with microbes from adversarial to neighborly. This volume explores some of the science that makes human microbiome research possible. It then considers ethical, legal, and social concerns raised by microbiome research. Chapters explore issues related to personal identity, property rights, and privacy. The authors reflect on how human microbiome research challenges reigning views on public health and research ethics. They also address the need for thoughtful policies and procedures to guide the use of the biobanked human samples required for advancing this new domain of research. In the course of these explorations, they introduce examples from the history of biomedical science and recent legal cases that shed light on the issues and inform the policy recommendations they offer at the end of each topic's discussion.This volume is the product of an NIH Human Microbiome Project grant. A forcing poset of size 221 which adds no new reals is described and shown to provide a Δ22 definable well-order of the reals . The encoding of this well-order is obtained by playing with products of Aronszajn trees: some products are special while other are Suslin trees. The paper also deals with the Magidor–Malitz logic: it is consistent that this logic is highly noncompact.

We motivate and introduce a new method of abduction, Matrix Abduction, and apply it to modelling the use of non-deductive inferences in the Talmud such as Analogy and the rule of Argumentum A Fortiori. Given a matrix $${\mathbb {A}}$$ with entries in {0, 1}, we allow for one or more blank squares in the matrix, say a i,j =?. The method allows us to decide whether to declare a i,j = 0 or a i,j = 1 or a i,j =? (...) undecided. This algorithmic method is then applied to modelling several legal and practical reasoning situations including the Talmudic rule of Kal-Vachomer. We add an Appendix showing that this new rule of Matrix Abduction, arising from the Talmud, can also be applied to the analysis of paradoxes in voting and judgement aggregation. In fact we have here a general method for executing non-deductive inferences. (shrink)

This paper focuses on a hypothetical case that represents an intervention request familiar to those who work with individuals with intellectual disability. Stacy has autism and moderate intellectual disability. Her parents have requested treatment for her hand flapping. Stacy is not competent to make her own treatment decisions; proxy consent is required. There are three primary justifications for proxy consent: the right to an open future, substituted judgment, and the best interest standard. The right to an open future justifies proxy (...) consent on the assumption of future autonomy whereas substituted judgment justifies proxy consent via reference to past autonomy. Neither applies. Stacy has not been, nor will she be, competent to make her own treatment decisions. The best interest standard justifies proxy consent on the grounds of beneficence. It is unlikely that hand flapping harms Stacy. None of the three primary means of justifying proxy consent apply to Stacy’s case. (shrink)

Recently there has been a strong movement towards reflections about the “geography of reason,” especially among philosophers who deal with postcolonial thinking. There is also a renewed interest among different schools of thought, both analytical and continental, in the ways our “life world,” or “embodiment,” or “situated cognition,” shape our minds and eventually the philosophy we do. As a result, we have seen some recent publications on the nature and import of the concept of “place” by authors such as Edward (...) Casey, Jeff Malpas, and Bruce Janz. In Philosophy in an African place, Bruce Janz introduces the concept of “philosophy-in-place” with the question as to what it is to do philosophy in a particular context of lived experience or, more specifically, what it is to do philosophy in an African place. This paper expands on Janz's “philosophy-in-place” by developing what will be called a “philosophy through place.” It starts with Janz's discussion of the problem of placing philosophy and a philosophy-in-place. Then it attempts to develop an argument for a “philosophy through place” and its implications for considering the place of philosophy in Africa and the challenge it poses to philosophy. (shrink)

The aim of this paper is to give a critical discussion of Sartre’s concept of sexual desire and its relation to self-identity and freedom. Why Sartre? Sartre is one of very few philosophers who offers a systematic account of sexual desire. He has influenced eminent philosophical concepts of sexual desire held by, for instance, de Beauvoir, Lacan, Foucault, Levinas, Irigaray and Butler, but not much is written about his own notion of sexual desire. This alone is reason to explore Sartre’s (...) view. What makes his view of sexual desire particularly interesting is that it is framed by his theory of freedom. Sartre offers the original, radical notion that freedom is absolute. Because consciousness is never self-identical, he argues, human identity is not fixed. Instead, we are consequently nothing else but what we keep desiring to make of ourselves. He concludes that we are always free to choose our drives and desires, even what seem to be our most enslaving, natural sexual instincts. The question raised in this article, however, concerns what the nature of sexual desire is and how free we really are to choose our sexual desires. I first contextualise Sartre’s view of sexual desire within his notion of desire in general and its relation to instinct, drive, consciousness, freedom and identity. Then, I give a detailed discussion of his analysis of sexual desire, its relation to freedom, and, what Sartre calls its failures. Finally, I discuss a critique of, and alternative to, Sartre’s theory of sexual desire from the perspective of my own notion of heteronomous and autonomous desire and freedom. (shrink)

This paper addresses two issues. The first part deals with the classic question of human nature by focussing on the problem of human consciousness, in particular, the relationship between subjective and intentional consciousness. I argue for an essential link between subjectivity and intentionality by suggesting a phenomenological conception of the human condition. On this basis, the second part deals with what I call ‘humane’ ethics. This part shows that my conception of the human condition contains a humane approach to morality.

This article examines how scientists and regulators distribute the benefit of the doubt about drug safety under conditions of scientific uncertainty. The focus of the empirical research is the regulatory controversy over the hepatorenal toxicity of benoxaprofen in the United Kingdom and the United States. By scrutinizing the technical coherence of the arguments put forward by industrial and government scientists, it is concluded that these scientists are willing to award the commercial interests of the pharmaceutical industry an enormous benefit of (...) the sccentific doubt, which is not consistent with the best interests of patients. Interpretative flexibility, the burden of proof falling on regulators and their trust in, and dependence on, industrial scientists facilitates that distribution of the benefit of the scientific doubt. However, regulatory authorities' need for viability and the rationality common to opposing scientific views suggest that it is possible, in principle, to alter this dominant trend. To achieve adequate patient protection, drug regulation in the United Kingdom and the United States requires extensive reform. Some preliminary policy changes are sketched. (shrink)

Drawn from the conceptual vocabulary of cultural theorist Félix Guattari, this article argues that the central purpose of transversality is to create linkages between previously unexplored singularities in a field, and then to create connections in other conceptual topographies at different levels of discursivity. The article advances an extension of Guattari’s “transversal” into a more capacious concept of the “trans*versal,” to analyze the #blacklivesmatter and #blacktranslivematter movements that draw on (...) critical animal studies to reveal ways that species hierarchies are always present in processes of racialization that allow some lives to matter more, or less, than others. Here I establish a parallel between modern epistemology and traditional metaphysics: between the way we know an object, on the one hand, and the way an object's causes cause it to exist, on the other. I show that different efficient causes in the Thomistic system correspond to different questions of knowledge, as analyzed by Stanley Cavell, and that in particular the question the Cavellian skeptic asks corresponds to God's causation in creation. As I have explained in detail elsewhere, and discuss (...) briefly here, this parallel represents far more than a formal analogy between a series of issues in epistemology and a series of issues in metaphysics. It helps to explain, in fact, why modern philosophers (e.g., Husserl) were ultimately driven to put the human ego in the place of God, as creating (or “positing”) the objects of its knowledge, thereby denying the very distinction between epistemology and ontology. (...) Bradley's own explicit philosophical premises are those of the contemporary academic Left—the blend of Foucault, Adorno, and other authors commonly known as "theory." He defends Maistre's claims on our attention partly by pointing to the kinship between the latter's critique of the Enlightenment and that of Foucault, Adorno, et al. Further, Bradley reminds us of the intimate relation between anti-revolutionary thought and historicism, here understood as the doctrine that new climates of belief and social arrangements always have their roots in what precedes them. In this as in other respects he allows us to see the kinship between the thought of Maistre and that of his younger and more liberal contemporary Tocqueville.Maistre was, moreover, a seminal thinker for the French tradition of sociology whose best-known representatives are Comte and Durkheim, and which, like him, was concerned above all with the religious conditions of social order. Maistre was himself a disciple not just of Vico's New Science but of Plato's Republic and Laws, works equally preoccupied with this topic. One of the most interesting themes of the book, in fact, is Maistre's concern with political theology.Maistre was particularly attracted, Bradley shows, to the neo-Platonic and possibly heterodox theology of Origen. Maistre, Bradley shows us, argued against the Enlightenment's attempt to replace a politics dependent on faith with one based on modern science partly by showing that modern science itself has its roots in mysticism, magic, and enthusiasm. The Enlightenment, which understood itself as entirely secular in spirit, was ruled by a project of salvation descended from ancient gnosticism. As the gnostics sought salvation through the rejection of the world of creation, the Enlighteners sought political salvation through a rejection of all traditions and institutions, a project which culminated in the Jacobin Terror.But political violence, in Maistre's view, does not stem from theological error alone. According to Maistre, "sacrifice" in the larger sense is central to all human societies. The problem of political order is in large part how to channel the impulse to collective cruelty, which is necessary to political order but can be restrained or allowed to run [End Page 287] wild. Politics is largely theater and symbol; the wise use of these elements is indispensable for taming the love of violence.Maistre's famous assertion of the authority of the Pope is not, Bradley insists, a formula for theocracy; rather, the preservation of a spiritual power distinct from and independent of the sovereign serves to check tyranny without subverting sovereignty (132). This essay analyzes the view of evolution of Jan Lever (1922–2010), founder of the biology department at the Vrije Universiteit Amsterdam, and compares his view with those of J.H. Diemer and H. Dooyeweerd. Together with Dooyeweerd, Lever wrote a series of chapters on the species concept inPhilosophia Reformata(1948–1950) in which species were defined as constant types. In his book,Creatie en Evolutie(1956), Lever still subscribed to Dooyeweerd’s philosophy but also suggested that it is possible that biological evolution occurred, including that of (...) human beings, and that scientific research can shed light on these processes. Influenced by his idea of individuality structures, Dooyeweerd criticized Lever and suggested that species are constant; that science cannot speak to the topics that Lever discusses. It is argued that Dooyeweerd’s views are influenced by the typological thinking of the time and that reformational thought would benefit from de-emphasizing this aspect of reformational philosophy. The aim of this dissertation is to show that, if one is committed to the scientific worldview, one is thereby committed to ethical non-naturalism. In the first chapter I offer the reader an outline of the three primary domains of ethical inquiry: normative ethics, applied ethics, and meta-ethics. I commit myself to a meta-ethical thesis--ethical non-naturalism--and contrast ethical non-naturalism with its competitors. In the second chapter I offer a cursory defense of the moral realist's semantic thesis. I offer reason to (...) think the realist has the correct semantic account and argue against the semantic accounts offered by the realist's primary opponents. In the third chapter of the dissertation I argue that commitment to the scientific worldview requires that one think that the methods of the sciences provide privileged access to facts about the external world and I offer a brief sketch of inference to the best explanation--the primary method I will employ in offering a defense of ethical non-naturalism. In the fourth chapter I develop a method for identifying non-natural properties. The method relies heavily on the predictive power that can be gained by the accurate application of predicates. In the fifth chapter I apply the method developed in the previous chapter. The results are mixed. The method fails to demonstrate that there are non-natural moral facts; however, it does demonstrate that there are non-natural normative facts. Using this result as a lemma, I identify a hypothesis--"[H]"--that, if true, would vindicate ethical non-naturalism. In the sixth chapter I rely on [H] to respond to evolutionary criticisms of ethical non-naturalism and argue that, if morality evolved, we have good reason to believe [H]. In the final chapter, I defend the view I have developed from objections arising from the existence of moral disagreement and I argue that [H] provides the best explanation of the existence of actual moral disagreement. In a methodological milieu characterized by efforts to bring the methods of philosophy closer to the methods of the sciences, one can find, with increasing regularity, meta-ethical arguments relying on scientific theory or data. The received view appears to be that, not only is it implausible to think that a scientific vindication of a non-mentalist moral semantics will be forthcoming but that evidence from a variety of sciences threatens to undermine non-mentalist views. My aim is to push back against this (...) apparent consensus. The well-established phenomenon whereby moral judgments influence our attributions of putatively purely descriptive properties has come to be known as the Knobe Effect. Joshua Knobe has attempted to explain this surprising phenomenon by arguing that our folk psychological judgments are partially constituted by moral judgments. Drawing on an argument originally offered by Moore, I argue that if some instantiation of Knobe’s explanatory strategy is accurate, we have good reason to believe that mentalist moral semantics are untenable. Though accountable care organizations are increasingly important to American healthcare, ethical inquiry into ACOs remains in its nascent stages. Several articles have raised the concern that ACOs have an incentive to avoid enrolling high-cost patients and, thereby, have an incentive to deny care to those who need it the most. This concern is borne out by the reports of consultants working with newly formed ACOs. This paper argues that, contra initial appearances, there is no financial incentive for ACOs to avoid (...) enrolling high-cost patients. (shrink)
